"Timothy. Dexter started his life with very humble beginnings he was born into the town of maldon in the massachusetts bay colony. In seventeen forty seven. He didn't receive much of an education growing up when he was eight years old. He dropped out of school to work on a farm at the age of sixteen. He became an apprentice to a. Tanner was a fine trade to be in back in the day. But nothing that would make you significantly wealthy when he finished his apprenticeship. He was given a set of clothes. By the tanner who he worked for. It was called a freedom suit. He sold his freedom suit for eight dollars and twenty cents and use that money to relocate to newburyport massachusetts. This was where his good luck started. While in newburyport he met the woman he would marry. Elizabeth frosting ham. Elizabeth was a widow ten years older than dexter. She had four children in a very nice house in He set up shop aching gloves and selling other leather goods. As well as reselling blubber from whalers by the end of the revolutionary war. He had saved up several thousand dollars which was quite a bit of money back then so far. His story is nothing special. Dexter however wanted to earn the respect of the local elite who never quite respected him and went all in he purchased the worthless currency just to give people something in return any purchase the currency for less than a penny to the dollar later when the federal government was formed they agreed to purchase all of the outstanding continental dollars at one percent of face value. "In in Newburyport mass and Diane rights my mother recently passed away after having spent some time in a nursing home in on Medicaid she had a life estate in our home and I own the rest of it can the state go after her life is the portion and make me pay back what they paid out on her behalf she was eighty five when she passed in the home is worth around five hundred thousand so I have good news for Diane nice I like good news but I think we should explain a little bit spend a little time explaining what a life estate is there and you know so people understand what what they did they did it the way I don't like which is the wrong way the bad with a bad way but if there is some good I don't want to make it sound like there's no good with what she did she transferred her home years ago to her daughter there's a gift there we talk about gifting and you know did we make a gift yes she did okay but so be it and and you created then a remainder interest in the hands of the daughter so that's actually subject to the daughters creditors while mom's living so I don't like it I don't like it because mom if mom wanted to sell the house before she had died these are all the people that are listening that that might have already done this and they need to know what they're getting into what they're into or people who are thinking about doing it yeah and if they really want to protect their house maybe consider an irrevocable trust either as the remainder man or as owning it a hundred percent because in this case completed gift with the daughter if you want to sell it if the mother wanted to sell it during life in in downsize or move to Florida or whatever then a portion of the proceeds for so you need the daughters permission right no thanks that's one thing I don't like going to a good chunk of the money would end up going to the doctor you got a look at you know tables that tell you based on the age of the life tenant how much would go to the daughter and how much of the proceeds would go to the life tenant but if the dog is good kids can give back right and then she's got a gift tax coming back again probably not go efforts will there be a capital gains tax when she probably doesn't live in the house so there'd be a capital gains tax because of the completed gift when you gave the daughter the remainder interest when she goes to sell it and whereas there wouldn't be if you didn't have the life estate or if the remainder interest was in the error of vocal trust daughter doesn't have to pay taxes on our own and all that no capital gains tax you get all the same capital gains tax exclusions you would get by owning your own residence in your own name so no adverse tax consequences no gift tax consequences no permission needed to sell it if the remainder interest is in the era vocal trust much more control for mom okay we get past all that she pays our capital gains tax the daughter and she's got the money now she's going to give it back provided you asking she gives wealthy at a little bit less money because of the tax here cat exactly I don't want to have to ask number one and now I got less money coming back and then a gift tax for daughter now the daughter is not going to have a gift tax but the daughter is going to have if there's a cap if there's a more than fifteen thousand dollars that she's giving and I'm sure it is and she's going to have to reduce her Massachusetts estate tax exemption even though there's no gift tax by the amount of the taxable gift yeah so it will come down which could hurt her from an estate tax planning standpoint in the future meanwhile we went through all those negative okay none of that happened she got lucky what good thing did come from giving the house to the daughter and retaining a life estate at least mom got the right to live there the rest of her life she couldn't be thrown out thankfully no creditors came after the daughter so yeah she's okay their Dodge that ball that she didn't care about selling it so it worked out okay there and now she dies and by the way she was on Medicaid which means that it did serve to protected from the nursing home because all you had was a life estate interest which is a property right to live there now it does have a value but that's what you had but why was it protected from the nursing home well because it's her primary residence she checked the box when she applied for Medicaid that she intends to return home so no No Way Out it's not countable great but lean a ball and that's what she's asking about right I know it took us a long time to get there but now it's legal right they put a lien on it to get money to pay back the state when she dies the estate recovery unit right yeah well couple things one the lien is on during mom's life in case mom sold it right if mom sold it during life they would have a lien on the proceeds portion her portion but mom didn't sell it during life so what happened to that lean well life is states expire when you do if they're done lean now has nothing to attach to right so the leans gone so now there's no estate recovery because it avoids probate passes directly to the daughter the lien is gone and there's nothing to put a lien on because it's not a probate assets after death so Diane you win here and a full step up in basis you way out but again I mom dodged a bullet basically Diane
