"And we think there's a technical argument that's still good law, but fair enough, here are other arguments. Fox did not take that route, which is what I would have recommended when you're all over a case and then the state court is like, no, that case is not good law. The other thing you can do is say that the case law is more ambiguous than your opponent is making it seem, right? Because this is what Fox. There's actually a case number three comes after case number two that cast out on that one and then potentially reinstates case number one. There are only two problems. Yeah, yeah. Right. Here are the two problems. The first is that Fox hasn't really argued that way. They certainly haven't done it with the kind of humility that I've described. They haven't said, okay, it's a complex. They've just said, no, we think Edwards has got like, you read it, right? They said Edwards still good law for all the reasons we've previously stated. Right. It's not, right? And then the problem is, case number three, the Brian V Richardson decision. Right, right. Case number three, Brian V Richardson. The good news for Fox here is that it's a New York State Supreme Court case from 1995. So it does indeed post date case number two, which was Hogan. Yeah, the diminished case. But the bad news is that that case, Brian does not say what they say it does. And Brian, by the way, is another passing case, right? It's all over their reply brief. Yeah. I've read it. It literally has nothing to do with the neutral reporting privilege. It does not use those words. It's about an op-ed, which, you know, not reporting, right? The Brian case does not cite Edwards. It does not cite Hogan. It does not cite any of the cases that I've omitted that are it isn't what they say it is, it is just a garden variety case about an op-ed that was called a high-tech Watergate. It was about a software company you don't care. The court characterized that op-ed as, quote, something less than serious objective reportage, and then opined to that. The reader quote would understand the statements that were made in that op-ed as mere allegations to be investigated rather than as facts and of real quote from the holding of Brian. Yeah, that does not seem to be the case with fox's reporting on the 2020 election. So could be bad. Yeah. It gets worse. So, okay, they've messed up the law on neutral reporting privilege. They've said, we've got this Brian case and yes we can and Brian case isn't about neutral reportage. Fox also genuinely seems not to understand. And I know that's a big charge, but it's in all their briefs, right? That the Edwards neutral reporting privilege is what we call an affirmative defense. So that is crystal clear in the text of the Edwards opinion, right? Which calls it a special protection for newspapers for media. Right, and here's the difference. The plaintiff that is dominion bears the burden of proof on its claims. So if you're Fox and you dispute that your statements are not false, then it's up to dominion to show that they are false. But when you have an affirmative defense, you, the defendant, bear the burden of proof on that. So you're saying, okay, maybe we did defame you, but we're not liable because of this other argument, in this case, the neutral reportage privilege. Yeah, and there are a whole bunch of problems with confusing the segment, but the biggest one is that dominion asked Fox about its affirmative defenses during depositions. So Fox produced a 30 B 6 witness. That's a corporate designate. Fox's managing editor of news, a guy named Tom Lowell, and he first had the lightbulb that we talked about 20 minutes ago that the network might be in a Wii spot of legal bother, right? Yeah, but he was the one that set around the are there any times we didn't defame dominion email? Yeah. And also super bad corporate rep because when asked. Okay, state the factual basis for your claim affirmative defenses in this case. The ones you have to name because you bear the burden of proof as you've correctly described this. Lull said nothing about the affirmative defenses and their factual bases when asked to name them. He did not say fair reporting. He did not say neutral reporting. He said, we don't think those statements could be proven false because we were just honestly saying Sidney Powell thinks the election was stolen and that in and of itself is a true statement. So in other words, tablo and Fox News have confused an affirmative defense upon which they bear the burden of proof and have introduced no evidence and have disclaimed through their corporate representative at depositions with contesting the truth or falsity of statements, and that's that's a first year law, first year lawyer. It's really, really bad. Yeah, and Lowell's version of events just can't be the law. I mean, here, let's end this thing by quoting dominion's reply. If Fox is right, and no reasonable viewer would ever understand the publication of newsworthy allegations as being defamatory, then defendants obtain immunity from liability, even if they made the whole thing up and even if they are not a media entity. On that logic, all anyone ever has to do to render a false assertion non defamatory and thus non actionable is characterize it as someone else's allegation. So people are saying sources say a well placed insider claims and so forth become magic words of immunity for any publisher, whether the people or sources are insiders against or not. That's an absurd result, contrary to common sense and decades of common law. This is not the law of New York, nor the law anywhere in the United States. Yeah, and that is a core opening arguments lesson from episode one, right? Like if something would lead to magic words, getting you out of liability free that's probably not an argument that's going to carry the name. Look, I could go on and on about how bad these briefs are. I really fantastic tangent on fox's ridiculous citation to the Carter page case from 2022. I'm not sick. I'm not making it up, but I guess it's going to have to wait for another episode. So look, bottom line, you almost never win on any aspect of summary judgment as the plaintiff on a motion to dismiss you on a motion for summary judgment. You've said that you're a 100% correct. But given how badly fox's litigated this, I would not be surprised to see dominion win partial relief on some of the aspects of its claims. Watch the court narrow down the scope of issues drastically, maybe issue a ruling that says fox's prohibited from contesting that the statements were neither true nor false or substantively true. Like, I don't know. It would be wild. I'm going to be watching. What do you think? You still team pessimist here? Oh, yeah, no, I'm still team pessimist, but I'm super impressed that you think it's such an enormous case. I do not think that the court is going to make what would be a pretty radical move in such a closely watched case for so many marbles. And that's fair that deserves to be voiced so I'm glad we're doing both sides, but like, yeah, wow, this is bad. Awesome. All right. Well, we will see you next week. "So now let's talk about the house. Oh, yeah. Let me give you my overall thoughts right now, and this is an OA take that I might be stealing off of your notes, and it is this. If either of these two things had happened, if we had no overt political gerrymandering, or if the Democrats had gerrymandered in California and New York, the way Republicans gerrymander in North Carolina and Wisconsin, this race would already be over. Oh, cats would have picked up seats. They would be way ahead in the house. So I think what you're saying is if we had anything resembling democracy in the deliberative body that's supposed to be responsive to the will of the people, the house. You're saying, if we had anything like democracy, we already won. Correct. And that's just indisputable, right? And as we go through and look, Republicans outside of Florida made their biggest gains in flipping four New York House seats and counting. I was wondering when we're going to talk about that because New York is so depressing. It is a disaster on so many levels, but I didn't want to go right in the bad news. I wasn't sure if your format is like the good news first. Their path to a house victory to 218 plus seats for Republicans goes through California goes through 6 California House seats that have been uncalled. I'm going to break those down, but the reason that we lost those seats in New York is because the Democrats, we talked about this on the show, the Democrats submitted a very partisan map that actually would have won us netted us a couple more seats, right? It was designed in the same way that Republican gerrymandering is designed. But and again, I can't fault the New York Court of Appeals to the New York Supreme Court. Because I get the right answer, but the court that what happened was New York State Supreme Court struck down the map and drew its own map and where you can fight the New York Democratic Party is in every other situation. This is an Andrew Jackson, right? Well, the court's drawn its map. Let's see it in force it. In every situation in which this has happened to Republicans, what they've done is said, okay, well that court map is nice, but we've reached on the map to answer what you said in your opinion. Oh, would you like to appeal that sure? Great. Maybe for next election. That's right. And you wind up using the gerrymandered map, even though the court is sort of impotently flailed around and said, hardball. And we needed to play that level of hardball in New York and we did not. Yeah, I'm seeing a lot of people including AOC, by the way, has been kind of retweeting and commenting a little bit that this is just an absolute failure and possibly corruption for the New York Democratic Party. And I'm certainly open to that. At least a strategy blunder, it really hurts Andrew to see such a good night and then to have the place that might that might, again, we still might be okay, but the place that might just completely scuttle what should have been house control in this amazing victory for Democrats. The place that screws all that up be New York. Be the strongest democratic stitch. It really hurts. But this should solve those wounds a little more. Okay. So let's start off with the race everybody has been waiting, you know, we're 25 minutes into the show, Lauren boebert in Colorado, third district. So here's the bottom line, we will not know the answer to this seat for a month. Wow. Here's why. Boebert has trailed all night, trailed until Thursday morning until we recorded the show where she is now picked up a narrow 386 vote lead over Democrat Adam frisch and that's 12 one hundredths of 1%. There is one block of votes left to count in Garfield county, which has been a fresh plus 14 area so far, so that's probably 2000 votes that seems more than plausible that you could be 1200 to 800. That would put fresh over the top. Except that in Colorado, you trigger the mandatory recount. If you're under what looks like in this rate, it's going to be about 1600 vote margin. And I don't see either candidate getting to a lead of 1600 votes or more. That is less than half a percent. The state pays for the recount that recount must be conducted under this is Colorado revised statutes, title one article 10.5 must be ordered by the Secretary of State within 30 days and must be completed within 35 days, 35 days out from the election. We will have that final recount in the bobert fresh race. And look, these are the kinds of margins in which recounts do matter. Yeah, yeah, with that few votes, right? But not only that, there are ways that people can still, if you're in that district, you may have gotten a notification about a spoiled ballot, there's all these ways that you can still make sure your vote is counted. I saw frisch tweeting about that. He said that make sure you get that done immediately. All the instructions will be on the notice you got that your ballot was spoiled. Like if you tried to vote for fish and something went wrong. So there's still ways to get ballots counted. And in that race, every single vote literally every single vote matters. I shared that out. I shared out a Colorado sun article on the same thing, and I want to say it on the show. If you live in Colorado, a particularly if you're in Colorado's third district and you tried to vote for frisch, the rejection is almost certainly because of a signature mismatch because of the stupid voter ID laws that they've put into place. You have 8 days to cure that mismatch. And you can start off by texting Colorado to the Secretary of State that is two 8 6 8 three and follow the instructions on your rejection letter. You may be able to cure this on your phone. So text, Colorado, to two 8 6 8 three. Every single vote for fresh their counts. I would also add if you're not tapped out. I know you probably are. I threw 25 bucks at Adam frisch this morning because they are taking incoming donations on their act blue page, and that's what they're using to fund the drives of trying to track down voters who have ballots that they can cure that will be counted. That is a valid thing to do. So yeah, that's an extremely good use of money Andrew. I'm going to go make a sizable donation literally right after we're done recording this. God bless you, Thomas. This is a, if I asked you how much would you be willing to pay to see Lauren boebert no longer a member of the House of Representatives? I got the mortgage guys on the phone, Andrew. They're saying if I do something called a reverse mortgage, I may be able to. This was not on anyone's radar. And this, by the way, is the example of what happens when you have an unexpectedly good night, right? You wind up with one of these seats where you've got a dimwit that thought they were cruising to reelection in a gerrymandered district.

What can people do to register and find out more about the process? Listen, every election is important in a democracy. And regardless of where you stand on the issues, you take an opportunity to let your voice be heard. Makes a big difference. And, you know, you've got all kinds of issues from jobs, the economy, climate change, you name it, that is essentially on the ballot because you're deciding who's going to speak for you. The biggest warning sign is you have the fed itself saying this is going to be a protracted high interest rate period. That means they know they didn't do their job, right? And it's going to take a while to get this fixed. So we're going to see all the movement of the markets and all the movement of the economy and jobs, all while going through a higher interest rate period, which affects real estate as well. And we're seeing that now. It's the 6th month of home prices coming down. Which sounds like a good thing for the average customer except if they're in a position where they need to borrow money to buy that home, right? Because now it's costing them extremely more money than just 6 months ago. So that puts a lot of pressure on what is most likely the biggest expense that Avery has in your life is their home. You own your home and that's usually your biggest source of wealth as a person in today's age. So it losing value. It's not positive for those who are at the end of the accumulation process so they can retire. Now it may be good for those who are younger, but that's some years to come yet. You know, as interesting as early as March, Charles, I remember the media doing those stories about older adults who are living on those fixed incomes and inflation was already having a huge impact cutting into those affixed incomes way back in March. And I have to imagine that is only going to get worse. Absolutely. We know that the fed still has two more raises this year. They're going to raise in November and they're probably going to raise in December as well. So that's going to get harder. It's going to get more difficult..

And I'm Karen Moscow in U.S. stock index futures are rising this morning we are coming up to 6 O one on Wall Street and we check the markets every 15 minutes throughout the trading day on Bloomberg. Right now S&P futures are up 31 points. Gal future is up 85 at NASDAQ futures up a 154 that's up 1.2%, ten year treasury down 1130 seconds yield 2.71% and the yield on the two year 2.89% and nymex screwed oil is up 2.1%, Nathan. Carrying the big lift in NASDAQ futures follows earnings from two tech giants. Let's begin with Amazon. Those shares are surging by 12% the company reported revenue that top estimates and gave a strong sales forecast for the current quarter. Bloomberg intelligence senior retail analyst poonam goyal says it's quite a different story from another high profile retailer. We were not worried about what we saw earlier this week with Walmart taking down guidance as we had thought that Amazon has a different customer base. Amazon does a target the low income consumer. So we didn't think Walmart's votes would bleed into Amazon. And that's exactly what we saw today. Bloomberg intelligence analysts put them goyle says Amazon added full and part time jobs at the slowest pace since 2019 in an effort to cut costs. Well, Nathan Apple shares also higher they're up more than two and a half percent. The company's revenue and profit narrowly topped estimates with iPhone sales holding up better than expected. Tom Giles is an executive technology editor for Bloomberg news. The market took away that Apple so far is weathering the downturn relatively well. And they even though they missed on a couple of their different products, they did surpass Wall Street's projections on the iPhone, which is their biggest product, all important product. Bloomberg Tom Giles says the iPad also performed better than feared, though other products including max and wearables fell short of projections. One of the flip side Karen shares of Intel are down 9 and a half percent in early trading, the chip maker's profit and sales missed estimates, and it's also slashing forecasts, more from Bloomberg's Charlie pellet. The world's biggest maker of computer processors was weighed down by a steep drop in demand for data center chips and a steep decline in PC shipments. After two years of growth, spending on laptop and desktop machines is declining quickly, as rising inflation is leading consumers to shy away from large purchases. The market for chips that power PCs is still Intel's biggest source of revenue and the cash needed to fund an ambitious attempt by CEO pat gelsinger to restore the company to semiconductor industry leadership. The maker of streaming TV devices reported disappointing second quarter results, Roku said advertisers are pulling back on spending due to economic concerns. The earnings continue today, Karen, with big oil in the spotlight, Bloomberg's Jeff Bellinger reports ExxonMobil and Chevron post quarterly results this morning. There could be a lot to like when ExxonMobil reports, Bloomberg intelligence says the company likely saw a substantial increase in net earnings from its refining unit if that drove a major improvement in free cash flow it could mean faster share buybacks, refining improvements at Chevron likely lag behind ExxonMobil, BI says the company's balance sheet may be in a net cash position before the end of the year if it continues to hold back on share, repurchases. The University of Michigan issues its national consumer sentiment index for July at 10 a.m. Wall Street time, and Bloomberg's Vinny down giudice has more. The prayer report covering early July showed long-term inflation expectations declined at that time at least the consumer surveyed anticipated prices would rise at an annual rate of 2.8% over the next 5 to ten years. Today, we're pushing 9% inflation. Overall consumer sentiment is suffering with the University of Michigan index at historic lows. Any doubt should ice Bloomberg daybreak. Okay, Vinny, thanks to that sentiment report comes the day after the latest GDP data fired up the debate over whether the U.S. has slipped into a recession. One top official says no, let's get the latest live from Bloomberg's we need a young good morning gradina. Good morning, Nathan. Treasury secretary Janet Yellen is rejecting the notion that the U.S. has entered a recession. She points to continued job creation, gains in consumer spending, strong household finances, and growth in business. Although she acknowledges a slowdown is needed to tame inflation. We know there are challenges ahead of us, growth is slowing globally, inflation remains unacceptably high. And it's this administration's top priority to bring it down. Treasury secretary Janet Yellen says she remains optimistic about the country's ability to fight inflation. Live in New York, I'm ready to young Bloomberg day break. Try ready to thank you. We also have news on the geopolitical front this morning. Presidents Biden and Xi Jinping have now agreed to set up an in person meeting at Bloomberg's head Baxter has the details. This could be interpreted as a positive sign that dialog could remain open, but tensions remain high with words like constructive left out of the readouts. White House spokesman Cara and Jean Pierre says Taiwan was a major issue. President Biden underscored that the United States policy has not changed and that the United States strongly opposes unilateral efforts to change the status. In fact, let me play a piece of tape here from SC cup cut to here where she says that because of the overturning of roe, it's hard to imagine the Republican Party surviving this. Play cut two. The question that the Breonna asked, I think, is the right one. It's sort of now what are now that anti abortion activists got what they wanted, which is to overturn roe versus wade, what happens now politically do you think? It's hard to imagine the Republican Party surviving this. Between anti abortion, anti LGBTQ book banning anti democracy. I mean, add all of the regressive bull to this. Add it all together. And I don't know who's left in the future and future generations to be drawn to this party. Jack, is this a death sentence for the conservative movement? A death sentence? No, this is more like a new lease on life because as people have been saying, I think rightly so that the old conservative movement is dead. Welcome to the new right. So the difference is, if this were the old conservative movement, if this were the 1990s, if this were even the early 2000s, right, what was the status quo and abortion, right? And let's just let's just talk politics right now. Let's talk about where things were in the country back then. The status quo was safe, legal and rare, right? Remember that safe legal and rare. And it was sort of this entrenched battle where people, you know, really couldn't get any traction along the edges on this issue. But then what happened? The progressive woke left when completely crazy with it, you had president Trump there on the debate stage with Hillary asking her about late term abortion and she won't even deny that she supports it. She won't say that that's completely crazy. So when we've got the technology on our side, when we've got science on our side, when we've got right on our side because we know obviously individual DNA means an individual embryo individual person, right? They went so far with it that they gave us an inch and then we were able to swing the massive people in the

Michael Henry is a lawyer from New York. He's also a candidate for attorney general in New York and I want to set this up by tossing to a report from CBS News, listen to this. A New York State Supreme Court rules that non citizens can not vote in local elections in January, the New York City council passed a law allowing legal residents, including those with green cards to vote in municipal elections starting in 2023. A group of Republican lawmakers filed suit in Staten Island Supreme Court to block the measure which would have allowed an estimated 800,000 people to vote for mayor public advocates, city council and borough, presidents, the law did not allow non citizens to vote in state or federal elections. Okay, so this was an unconstitutional action from the beginning. It was argued in court and we're back. Our guest, Michael Henry. Welcome to the program. Good to be with you, rich. All right, my brother. So I want to get your take on this because again, you and I were both there when the city council speaker said, if you guys, in fact, pass this law, we are going to sue you. You're going to sue the pants right off of you and get this thing reversed. And guess what? There's now a pantless law that's not constitutional and it's been overturned by the Supreme Court in the state of New York. Tell us about it. Yeah, so I think that won the state party chair Nick langworthy and especially Joe borelli the minority leader on the New York City council deserve a lot of credit for taking this fight up. Look, it's clear. The New York State constitution explicitly defined the citizen and has age and residents are requirements on who's able to vote and New York State election law specifically defines citizens in state local state and local elections, even at the village or town level. So this was clear that this was a violation of the New York State constitution and the judge in Staten Island Supreme Court said basically said that if they wanted non citizens to have these rights or be able to vote, they should have expressively said selling the constitution and there was nothing that expressly said anything about non citizens being able to vote. And I think this is a big win. There was a little misinformation a lot of people were saying that this was for illegal aliens to be able to vote. That was not the case. It was for people with green cards or temporary status. But we all know how the left operates if they would have got this and would have eventually went to a legal aliens, and then it would have went to statewide. And I think this judge went with the side of the law. I mean, he made it clear. It's a plain reading of the state constitution of election law and even contradicts or has a conflict with municipal code. So it was a win for those who believe in the rule of law. And there was also a bipartisan opposition to this. So it was a very good day for the voters of the city of New York. Yeah, I tend to agree with that. I mean, I think the idea that allowing someone who's not a citizen of the United States to vote in any election is just, it's kind of atypical. Now, this was the argument that they made, though, was saying, hey, look, we're not going to let them vote for United States Senate or for Congress or for president, but this is where they live. They have to be able to vote for the school board. They have to be able to vote for mayor and for everything else that comes in between at the local level here in the city of New York. And again, like so many poison pills, they come wrapped in candy and they try to make it sound good and favorable to people and they hit you with a little bit of, well, you don't want to ostracize these people and we want to help to normalize things and they try to use an emotional appeal, but ultimately I think one has to think, you know, there are people that fought for a very long time because of the color of your skin or because of other factors like they came from another country and they had to pay and wait to become a first resident and then a citizen and to say that we're just going to bypass all of that and give this privilege of voting to me as a smack in the face for anybody who's an immigrant or anybody who's African American. Or even a woman who didn't always have the right to vote. No, I agree with you. That's the one thing, as I said, is this really devalues what legal immigrants who became who are in citizenship have done. It diminishes their accomplishment. And some of these arguments quite frankly, you had multiple bushes here, right? If someone has temporary status, that means they're able to vote on matters in the city that are going to affect the city resident like myself, let's say, for four, 8, ten years down the road, also you have to look at what kind of mess this creates, so they can only vote in a city election, but they can't vote in a state or a federal election. So now you're going to have hybrid ballots, or you're going to have specially marked ballots. I mean, the board of elections already has enough issues as it is. The whole thing was a mess. And even the one argument I also heard made that they said, well, it's like taxation without representation. Well, there's people that live in New Jersey. There's people who live in Connecticut. They come and work in New York during the day. Are they supposed to be able to vote because they're paying taxes in New York? This was just quite honestly one slap in the face to anybody who earns citizenship. Secondly, it was going to create a mess and then thirdly, these arguments look, they threw arguments against the wall. They had no respect for the rule of law and they were doing this because it was a power grab to try and get 8 to 900,000 more votes and they felt like if they were able to do this, they're going to control the mayor's office in the city government for years to come. And the long-term effects it would have on city residents allowing people that are probably not going to be here long term to vote was quite frankly just with any benefit of whatsoever. All right folks, we're on with Michael Henry, he's an attorney and a candidate for attorney general in New York State. Now, Michael Henry, so we talked about this non citizens voting. And to me it was open and shut then and it was open and shut now and thank God for that. I'm glad it didn't become a law and had to be overturned after a hundred and some odd years like the New York gun law did. But I'd like to get your reaction to

a human So happy doesn't deserve to be a human because he's an elephant and the court says that he's in a this is what's going on in New York in the Court of Appeals And I just think it's really really funny that they're saying he's being illegally detained or confined by being an exhibit in The Bronx zoo That failed because he doesn't have the right to be free because he's not a person Just remarkable this is what's going on And if you could see this maybe I'll tweet this out and put it on various social media so you could see it at richville this with an S if you want to take a look at it It is a it's a huge picture here of so many people and they're protesting and free happy basically it's free happy Let's bust happy out of jail and the bronzer I thought that was funny I want to go the case of stupid Happy if we put him out in a field I don't think he could take care of himself because he's been taken care of For all those years and he's an old timer So I don't think we'd stop to realize and use their common sense or have any intelligence at all But things And I wonder if we should guide the father very blessed and happy Father's Day Nobody else says that except in their hearts and in their prayers But I wanted to do that over the air weights And I see a lot of dirt domino timer And I see a lot of division and confusion and separation not just here in America but around the world A lot of confusion and a lot of hungry people and a lot of weird and careful people and things like that On the church case episcopalians I'd see the divisions not only in governments in an opinion and peoples and groups of people but I'd say division in the churches will come in for a long time the episcopalians have recognized the homosexual community and are even they even have ministers that their consecrating as ministers in their fiscal churches So that little incident with the fiscal year that might have come up in a recent over some kind of incident like that Yeah well we don't have the details on that per se if it was something related to that But I see your point And I get it And I think there's always going to be differences these divisions I don't know if they're all divisions or if they're differences I think we have differences and how we view them and how we approach them Is what determines whether it's a division or not You know I know sometimes some of the guests coming on don't agree with me I don't interview the people because they particularly agree with me I try to get the best most entertaining and informative person I could find to tell that perspective of a story And I think that's how many of us live our lives not necessarily the way we choose radio guests but I think overall I've never in my life and I don't think anyone listening has either woken up and said you know what today I gotta make sure I stay away from so and so because there are Christian I gotta stay away from so and so because they're a Jew or I gotta stay away from so and so because they're a Muslim No I think by and large we live our lives we go to the store we go to the grocery store We go to the car wash We go to all these different places and we deal with different people from all different walks of life and we always show them respect And that's how life has been for a long time Now I agree with you There are movements afoot that are saying we must focus on creating division and this is part of Karl Marx's whole movement Is to create these silos to create these divisions and these subgroups so that it's really I guess personifying the divide and conquer mentality And it works it works if you allow it to work Me personally it doesn't work on me because I just don't see it I have friends that differ with me politically And I know there's people that say well what would I do at a party like that I don't know those people We don't agree on this and my thinking is they're people You know we just don't talk about politics You know talk about their kids if they don't have kids I don't know You can find something And again if you can't find anything don't talk to those particular people talk to somebody else I've always believed that our differences can bring us together or our differences can create chasms and focus on division And it's really up to us It's our outlook it's our worldview and you mentioned that you were a Christian and I share that faith with you and if we have a Christian worldview and we focus on those two commandments that Christ left behind love God and love people that oftentimes you're going to you know you're going to fire on all cylinders and you're going to hit a home run each time Hopefully because you're doing the right thing And I think we shouldn't really exclude people based on their faith and whatnot Even if you're Nancy Pelosi and you're very very very Catholic right And I just say that in just that I love the Catholics I love everybody But my point is it's all the way we see it Good morning. Good morning, everybody. Let's start first with Rudy Giuliani and that you worked closely with Rudy Giuliani on several very important cases over the last several years. And this this decision by the New York bar, I guess to temporarily suspend his license. Did he even have any sort of due process? Did Rudy have a chance to defend himself on this? Well, what's astounding about this. If you read the decision of the appellate division of the New York State Supreme Court, the state Supreme Court in New York by way, is a trial court. It's not the highest court In the land, Uh, in New York. They held no hearing. He was not given an opportunity to respond in person with an attorney. They simply took, uh, pleadings that have been filed by people and took the unprecedented step of suspending him. Interim from the practice of law because he represented a dangerous to the spreading of particular theories about the election and the disruption of civic life. This is one of the most This is a cost to ESC this ruling. I encourage people to read it. It reads like a screed from a highly paid political campaign organization rather than a legal document. But again, the most important thing about this is He was denied a hearing. They issued this ruling this interim ruling without a hearing. It's just disgraceful. I can't imagine what what? What they're doing, but it's pretty clear. It's very partisan. It's a Democratic court in a Democratic state, and it's pretty disgusting. So, Joe, can Rudy do anything to try to get his, uh, license law license back? Well, he can. He can appeal. He can demand a hearing. He has a lot of good lawyers working on this. Um, that the processes for these things, which are handled by the bar and by the court can be Byzantine and complex. Um, he's litigating. That's what he's going to do. I think he may actually have a right to go to federal court. And seek an injunction against the disciplinary proceedings because they are prejudicial and they are prejudiced and biased against him and joke that when when you read the ruling it it doesn't even read like the judicial opinions and what's going on here is it's so important is sort of dwell on this a bit because we saw this after the election, and we had so many lawyers coming out and trying to investigate. Whether there was any fraud in the 2020 election and some very serious legal and constitutional questions that still have yet to be actually challenged and discussed in the way that they should, in my opinion, Joe, But we saw lawyers who were intimidated by clients by their partners that had to pull out of representing the president of the United States, lest they they lose their business. And lose their partnership. Isn't this also sort of the next step of that where the message is sent that if you represent Donald Trump or or anybody in this regard, not only will you lose your business, you'll actually lose your license. This is insane. Well, this was part and parcel of that entire assault on the lawyers representing President Trump The The bottom line is that they have used the legal disciplinary process of bar associations. They've gone after people they've gone after representatives of the president to get them to spark. This is unheard of. People were in court making legal arguments in front of courts. Advocates are supposed to do that, whether you agree or disagree with their legal argument. That's the job of the lawyer, Rudy was doing nothing more than making legal arguments in court and on his radio show, by the way. Most of the things they cited about. Rudy had nothing to do with any court cases he was in. They were citing things from his radio show on his podcast. That's what about his rights of free speech under the First Amendment. I've never heard of lawyers being disciplined for things that they said on television shows or their own shows or radio shows or columns that they've written or opinions that they expressed in newspapers. That's another thing about this opinion, it basically says. That's the stuff that he was saying on his radio shows was incendiary and unsupported. Well, First of all, that's just not true. And second of all, what? What? What business of the bar is that? Joe diGenova is our guest. And Joe. What? While we're on this subject, we just saw the attorney General Merrick Garland. Followed lawsuit from the DOJ against the state of Georgia over their voting laws. I'd love for you to chime in on that, because last I checked in the state of Delaware has more restrictive voting laws than Georgia On what legal basis does Merrick Garland and the DOJ have to actually even filed this suit? Well, it doesn't appear that they have any legal basis for doing it. Larry, this appeals appears to be a blatantly political act by Merrick, Garland and the Department of Justice and by their new civil rights division chief. Kristin Clark, who has been described is articles as anti white and anti Semitic and radical, uh, that that those those credentials allowed her to file something that is so obnoxious. And so awful against the state of Georgia. They the government actually concedes in its own pleading. That the law is neither racist in language nor in its effect, But it's racist because of the motives of the people who enacted it, and when you go into the lawsuit And you beat some of the pleadings it actually claims. That because Georgia was one of the states that supported the Texas lawsuit in the Supreme Court about the election that claim that their electoral votes would saluted. But the DOJ says that participating in that lawsuit Was evidence of racism. I kid you not wow. Other things, it says the Senate passed the bill with only white sponsors. This is actually in a pleading by the Department of Justice. It's so silly and dangerous and I it makes you Very, very concerned for the state of the Department of Justice. They allege, in the in the pleadings that no black representative voted for the bill. And so that's evidence of racism. Uh, yet Governor Kent when he signed the bill did not invite any people of color to the signing is evidence of racism. And then they just out of whole cloth. They just say that for all of those reasons These these provisions were adopted with the purpose. The purpose of denying and a bridge E black citizens equal access to the political process in violation of Section two of the 1964 Civil Rights Act. Unbelievable. This is some of the worst. Legal work I have ever seen. The Department of Justice under Merrick Garland should be ashamed of itself. Yeah, I just got to say this is not going to just stop in Georgia. We can foresee Don't What do you think joke More of these lawsuits coming our way to these different states that are making Significant election reform lost. I don't think there's any doubt that this was the first of many, many lawsuits. There are at least 24 states that have passed Voter Integrity Act in the wake of the outrageous abuse of mail out voter ballots. Sending out absentee ballots to people who did not request them, which is at the core of the corruption of the 2020 election. The unregulated mailing out of absentee ballots, uh with no control over signatures, verification who signed those ballots, coupled with ballot harvesting. Yes, I expect the Department of Justice under Merrick Garland to file this lawsuit very much like the Georgia insane in every state. So this is it's so dangerous. Can you hold over?
