Governor Phil Murphy is calling on New Jersey U .S. Senator Bob Menendez to resign. Menendez was indicted on federal bribery charges that allege he accepted cash, gold bars and gifts in exchange for using his influence to help three businessmen and the Egyptian government. The White House is calling on Congress to do its job and pass legislation to fund the government and avoid a shutdown. House Republicans failed multiple times this week to do their basic duty, keep the government running. Instead, they were pushed to the extremes with increasingly severe cuts to programs Americans rely on. Press Secretary Corrine Jean -Pierre called on House Republicans to abide by the bipartisan funding agreement negotiated by Speaker McCarthy and President Biden. Texas Governor Greg Abbott is deploying more buses to the border towns of Eagle Pass and El Paso.

"And some of the actions happened in New York. But the Southern District of New York, the U .S. Attorney's Office, there is and they can overwhelm any individual or would -be defendant with really unlimited resources. I just want to bring that up again as a point that people may not go ahead. ...the senior U .S. senator from New Jersey and the chairman of the Senate Foreign Relations Committee and his wife Nadine Menendez engaged in a corrupt relationship with Hana Uribe and Davies. The indictment alleges that through that relationship the senator and his wife accepted hundreds of thousands of dollars of bribes in exchange for Senator Menendez using his power and influence to protect and to enrich those businessmen and to benefit the government of Egypt. The indictment alleges that Hana Uribe and Davies provided bribes in the form of cash, gold, home mortgage payments, show a no or no show job for Nadine Menendez. Next thing you know they'll be telling us that they set up some shell corporations. I wonder if they got any money from Egypt. I mean the Biden's got it from Communist China and that's just one of the enemy states and front corporations that were associated with China that they got money from. I'm just pointing this out because I listen to this and this is pretty overwhelming. And then the Democrats say where's the evidence on Biden? Well Biden never took a nickel but his family made millions, tens of millions. It's not like they didn't, they did. And they got gifts and they had access to daddy as vice president. So I'm just sitting here saying to myself okay they're not exactly the

"Absolutely. So yeah, so Fred, that's kind of a, we're going to go in depth with this on Derek malt, so stay tuned for that. You're going to love me for it. You'll love me. Well, let's get to the next one. He goes, Fred is in Texas. He says, one more question. I've really started to think about governor rabbit sending undocumented immigrants to sanctuary cities. I'm going to just mince words for a second. Illegal aliens. I know everybody wants to be politically correct, but if you enter this country, you are technically everybody is an alien. You are registered alien or an illegal alien. And that's just a matter of law. It's not a negative. It's not a pejorative. It's the way that, look, when I go to the UK, I'm an alien. But I'm a documented alien on their passport and everything. So, but they talk about sending them to sanctuary cities while he gets the concept and so he asks the question, do you think the drug cartels will start using this as a way to get their people to these cities and distribute drugs or use people to help with the sex trafficking victims as well? But that's already been done before they even shift the buses because guess what? Even without what Abbott's doing down there, he's really taking, it's called displacement. He's taking the problem and putting it in another location. We don't want to get into debate, is that right? Is it wrong? It's happening. So you deal with the reality. The reality is that's current reality. It's happening. So, but just to put it in context, I think it was New York or Chicago got like 800 immigrants and they declared an emergency. Texas is getting 2 million a year. Yeah. I think what's her name in D.C. starting to get them? Yeah. Mariel Bowser. So up in this area. And Lori Lightfoot, and the new New York mayor. So they're starting to feel this now. I will tell you this, Fred, I mean, that's done they're getting the word out because the media is saying, oh, look, here come the buses or here's what's happening. The cartels are sending people to these cities anyway because that's part of the trafficking. They want to go someplace. Sometimes once they dump them over the border, that's it. That's all they care about. So I don't think the cartels have a plan to say, hey, let's get our people out. Because they already done, once they get across the border, mission accomplished. But the people coming across the border that are being intercepted and voluntarily turning themselves in that are ending up on the bus. Those I worry about them, but the ones I worry about more are the goda ways. The ones that are not contacted by law enforcement because if your contacted by law enforcement and you've got fentanyl, you're arrested. I mean, that changes the game. But I think, but I think and from a sex trafficking standpoint, but realize a lot of these people coming across the border that are on these buses or that are being trans that are being displaced in other areas. Many of them are single adult males. So you look at the God aways too. There's a lot of those there. The ones I worry about too about terrorist getting into the country, they've captured MS 13 members that have active warts for murder. They've captured people off the terrorist watch list coming across the border. These places. So I don't think the busing is the issue. I think that is a political ploy designed to raise attention on an issue.

"Days after the Supreme Court struck down New York century old gun law, the state's lawmakers approved a sweeping overhaul of New York's handgun licensing rules. The new gun legislation severely limits where guns can be carried, includes a strict permitting process for concealed carry licenses and requires background checks to buy ammunition among other things. The law will almost certainly be challenged in court. My guest is Andrew willinger executive director of the duke center for firearms law. So even though this is a redo, there is this strict permitting process for concealed carry licenses, which includes in person interviews, for character references, turning in a list of social media accounts, et cetera. Is there a problem with having a strict permitting process like that? So as you mentioned, so the new New York law gets rid of the proper cause requirement, which the Supreme Court struck down, but it does make other moves to shore up the permitting process by requiring these types of submissions of information coming in person for an interview. And the court in its opinion actually says that in general, a shall issue permit regime, which is what New York will now be placed in that category is permissible, but still subject to an as applied challenge. So this will really depend how the new system functions and practice. If it results in a long waiting period, for example, for applicants that are seeking a permit, they may actually have a challenge they can bring saying that in practice the system is too burdensome. What about the applicants having to complete 16 hours of in person firearms training two hours of training at a firing range and they have to prove they're shooting proficiency. Right. So this is an aspect of the law that I think many people expected that in conjunction with removing the proper cause requirement that there would be additional training requirements that's an area that some states have focused on. I think that's something that is likely to be a permissible, even under Bruin, Bruin doesn't say anything about training requirements. And to the extent that these are actually requirements that an applicant go to shooting range, for example, prove that they are able to safely handle the gun. Those are things that seem probably fine under the courts approach in Bruin. The legislation sets out a list of

"States got some positive news from rating agencies What happened there They sure did Dave and upgraded the most in the last three months and they have compared to the past decade right So really interesting time for that state and that credit And I'm going to give them their due here right They have been doing some things to improve their financial picture Go back 5 years They had a $16 billion backlog of bills basically bills that were just sitting there piled on a desk that hadn't been keyed right They've cut that down to about two and a half billion now So certainly an improvement they've also improved their pension funding But I don't think that really changes a lot of the issues that they have on my leverage standpoint that really hasn't changed So I think that the radio stations are taking it probably a very short view And I think that based on where spreads are in the market for the state to market saying that they're not fans of the upgrade Let's say regional for a sec How's New York City doing It depends on who you ask Oh I'm a resident So is New York's back I think that's really the question And what is a new New York actually look like I think that New York along with other major cities are sort of trying to figure out who they are in an environment where COVID just sort of continues to exist Whether that means for people coming back into the city from a work standpoint what that means for local businesses and ultimately what that means for tax collections I think the thing that's positive for New York as well as other cities is based on a lot of stimulus money that they're working through But that runway is obviously has a timeline that's running out I think from a credit standpoint they're doing just fine in the market is saying so that they agree with that based on our spreads are But I think there's opportunities in this market too right So if you look at New York bonds that are trading right now I mean they look at absorbing the cheap compared to how high taxes are in the state And 2% opportunities for end state buyers Really good point I'll keep that in mind All right Eric thanks a lot 'cause boomer intelligence analyst All right coming up on the program We look at M and a trends in the convenience store sector You're listening to Bloomberg intelligence I'm Bloomberg radio providing in depth research and data in 2000 companies and.

"Radio All right you are listening to Bloomberg businessweek Cal master along with creedy Gupta And interesting in terms of one of the things I like to follow and Bloomberg terminal users also do is anything and everything to do with real estate And this story certainly popped up on our agenda Written by Bloomberg's Patrick Clark And it's about a massive office tower taking shape next to Grand Central terminal in Manhattan Latest evidence that the pandemic has not diminished the real estate industry's appetite for city shaping projects Remember going back to the early days of COVID and everybody was leaving the cities and buying properties and residential areas and getting out of urban areas And they were like the city's dead Yeah this is a sign that they were going to say Miami is the new New York City and everyone is leaving But you know we have some news for you They're not actually You are starting to see these massive real estate investments And a lot of this is of course coming from major corporations So the question here is first you have the real estate does the labor does the hiring follow And of course bring more folks back into the city Well and it's interesting I mean and keep in mind that some of these large residential not residential but large commercial real estate projects are often in the works for a long time You've got to get permits and all these different things But anyway RXR realty and TF cornerstone they are planning for a 1575 foot tall tower It would be among the city's tallest recently proved by the city council here in New York City clearing the way for a mixed use building on the site of a grand Hyatt that includes more than 2 million ft² of office space and up to 500 hotel rooms So it's going to be dabbed a 175.

You know, because electric cars they're they're not only will be safe to drive. They are very, very low maintenance. And you know They They are cheaper to buy. Uh, you could get a used electric economy used test, for example, for around 20 $25,000. But if you want to buy a wheelchair accessible vehicle The transformation only alone $10,000. So If you guys are fighting with TLC is fighting with rebel. Why not just, um, come out with the new rules say okay, every drivers can get one license per year. And so we tightened up the number of available for hire vehicles. And that proved to be very effective. We don't want this to be a loophole that reopens at the wrong way. We do want more and more electric vehicles, and we're trying to figure out the way to balance the equation for the good of the earth, more electric vehicles, but not at the price of a lot more congestion and a lot more for hire vehicles. And the aquatics programs cover not only lap suing, but senior splash the Children's and adults learn to swim, adaptive swimming and you swim team. Uh, the lifeguard shortage has been an ongoing problem for many years, and it's just much worse this year. So one question would be is what the city going to do about this in the future. But in addition to that, the, um the aquatic specialists that teach those programs Have water safety instructor and Red Cross CPR. They are not being counted as lifeguards. And there is a section of the Department of Health regulations that would allow, um um fewer lifeguards. In those programs that is being ignored. It's 1 65.15. I can outline more of this, Uh To one of your persons off the air. "Why are we only seeing a prominent piece on the fact that nine health officials have quit in New York nine. Top officials have quit in New York over the course of the last year because Andrew Cuomo was too meddlesome. In the States Coronavirus response that he was straight up, ignoring their data Beverly. They make claims like he didn't care what the actual data were. He was changing, closing guidance and reopening guidance on his own schedule. Based on his own assumptions, and not based on what the expert in his state experts in his state were telling him. And I give the New York Times some credit for having this piece out. They feel the writer for it even said that current and former health officials agreed to be interviewed about the crisis on Lee on condition of anonymity. They said that they feared retaliation for speaking out against the government. One quote from one former health officials said morale certainly was and continues to be at an all time low, so the fact that they don't even feel comfortable. Putting their name on this Now they sourced it with a lot of different people. So I take this seriously. But I give the New New York Times credit for putting this out in my hope is my hope is, is that even though yes, it is February, 1st. It's finally even some mainstream outlets. Even more left leaning outlets will finally report on the poor leadership at Andrew Cuomo since the virus. The damn appears to be breaking a bit because it was last week, Leticia James, the attorney general of New York, a Democrat, came out and said Wait a second, The Cuomo administration's been dramatically undercounting. The number of deaths. In nursing homes in the state of New York. And why is that important was important because Cuomo straight up, sent sick coronavirus paces back into those nursing homes. He had an order from March in which he told these nursing homes to accept these patients. You're not even allowed to test them. When they get back. You're not even allowed to test them. And then he reversed the order in May and then erase the existence of the order entirely from his website. One other issue here that deserves some notice. The vaccination distribution plan. So the state had a plan in place for distributing vaccines that they have worked up all year along the government, the governor Tor it up and came up with his own plan. Now New York has been Well documented, notably bad at distributing these vaccines so far. And here's what happened. The state had designated as a regional vaccination hub in New York City, not the city's 6000 Person Health Department, which is what the state plan was to do, but rather gave the vaccination responsibilities to the quote Greater New York Hospital Association. Which by the way, Is a multi million dollar lobbying arm. Of the hospitals in New York and is a gigantic donor to Andrew Cuomo. It has been a disaster. And why has it been a disaster because Cuomo ignored health authorities and gave the power for vaccine distribution to some of his biggest donors. Instead of the health Department, which was already ready to go. Amazing. Thank you to The New York Times for this reporting, although it comes really late as a lot of families in New York, er, probably asking themselves Where was this before My grandma died. That would be earthly That would have to affect the world like a 9 11 dead, although it wouldn't be a 9 11. So if you write a headline that says Wow, Here's Ah, Reason thing Trump did this and we're not sure if that's good, but he did this and that looks pretty pretty interesting people, they reasoned, headline like that. Nobody's going to share you on Facebook or Twitter or pass it around or nothing goes viral. If you say Trump's an idiot. There's an audience for that. If you say Joe Biden was caught doing something nasty. There's an audience for that. And it's tricky T o kind of navigate those waters in here, and I think that That's something we all have to kind of realize This is changing. And my biggest thing, though, right now is is putting people to understand that we need kind of some parody on the right. I mean, it went from an 85 15%, You know 85% liberal outlets 15% conservative. And when they were just kind of bias that that was one thing when they're so willing to To completely misinterpret the truth. That's where we're in a very, very weird thing. Which is why Republicans don't understand why certain things in the world were happening. How could trump lose? How could How can I do I trust these things? Because you know Trump goes and says something and help a lot of car and be well, they they had 50,000 votes stolen from me and stop okay? And But politicians are kind of known to kind of spin their own truths out there, which we've had the media beat of referees for so long, But then you look at the second. Well now I don't know who to trust on looking at that claim. And you know that's what ends up with people throwing Molotov cocktails at each other in the street, because because the fourth state of our government has lost all crowd of credibility and deservedly so you have to monetize your sight. Which means you gotta sell clicks. Eyeballs. You know, I know the metrics. You know the metrics will do And it's low low numbers. You know, people aren't even getting there getting a half a cent when you go on look at an article by those ads that they crap up all over the place. But when you so are you donor driven or you advertiser driven to start with. So, look, I just basically kind of made a shift in this. I am actually moving too. Really more of an advocacy model, and we've launched a second. Kind of part of our business called the Media Action Network. Where basically come to the conclusion that what we what we need even more than some conservative news out there is somebody help helping create that conservative atmosphere. And so on that were more donation driven on the on the straight new stuff. It's you know, it's Zulema, Programmatic adds, meaning you put in code from Google and from other companies, and they pop up all those ads that you see all over the place. And it's and it's and it's kind of a game of math at a very, very basic level. Um, but with the media action network, which basically it's zey I mean, I think of it as a media matters of the right where we're continuing to expose the media. When they lie about being objective. We come to the support of those who have been either either censored or slandered by the liberal press. And we do things to help build up the righteous fear and and especially in the online world, because, as we see we're getting slaughtered, and they in whether.

"Let's talk about the business model of your sight and how workable this is because in my opinion, The marketplace of ideas, the more shelves stocked with various products. I like lots of different cereals and lots of different beers and lots of different wives. And I think this is a healthy thing that most folks don't have. Years of experience that Fox News and I look atyou, the team you've built John Moodie, executive vice president at Fox News Channel, Laura Falun, If I'm pronouncing that correctly, was that Fox News? So you? You've got some folks that bring big names. I'm guessing you could probably bring some investors in But I'm not asking for your tax return. But this is a slick Web site. It's not a cheap proposition. Somebody has to find advertising. You have to monetize this thing. It's not charity. What does this look like? And how many more of the court news is? Should we expect to see realistically? No, That's a really good question. It is. It is, um you know various them and what we've seen is an explosion of sites and some things you can do. Very cheaply and some things are expensive. You know, people are expensive. Getting a slick looking website. Very cheap. Um, you know you can you can do you know so so. Depending on kind of your level of journalism, and and are you just basically doing rewrites, which we spent a decent amount of time doing that we dig into into some some original stuff. It's um Let me say that the tricky part and it's it's could be discouraging sometimes because the tricky part about succeeding online right now. And this is something that I tried to resist a much as I can, and I'm still trying to, but I'm kind of realizing that That it's that extremism sells, and that's that's a problem. I mean, that's our biggest problem. Perhaps, but, you know, in the remember the old days of yellow journalism where you had the kids in the early 19 hundreds late 18 hundreds. They were that big sandwich board and there on the streets of New York screaming, you know, eight dead and house fire crackers. Right. No no tires, The muckrakers the yellow journalism, the muckrakers William journalist's type type of things. But the yellow journalist the Pulitzer Days that the hearse days where they sometimes just made stuff up. Well, basically what they had back then was Clickbait. Because whatever whatever headline, the kid was screaming on the street corner. Whoever had the most salacious headline would sell the most newspapers. And and that's what kind of drove that whole yellow journalism atmosphere. And to be honest, it wasn't until two things happened. One is people started moving to the suburbs, and so you'd buy a monthly subscription to your newspapers, and therefore they didn't happen, though so crazy on convincing you to divide this episode right here.
