"Perhaps the most important moment of this month from a sports standpoint could be in washington. Dc at the supreme court. That's when the much-heralded landmark potentially landmark case will be heard oral arguments will be hurt and there's a lot of controversy going on right now and our next guest is going with with with michael mcmahon. Has shed some some light on that. A friend of the court brief an amicus brief was filed recently in this case the nc. Double a. vs austin and it was discovered by our next guest and his colleague that what these athletes have done may end up hurting more than helping daniel limit joining us. And it's really great to have you on david. Thank you so much. We we've talked in the past with michael mccann. Both of you have really uncovered quite an extraordinary story. Here good afternoon and is a gentle way possible explained of those of us who don't understand this stuff as well as you what this is all about well first of all. Thanks so much for having me on the program. It's a it's an honor. Um yeah as you as you sort of previewed There was a group of former college. Athletes who on february eight filed in the meekest brief which is also called a friend of the court brief in the end of the blame. The allston case This was the eighth emeka. Brief that was filed in this case. But it was probably the most interesting and possibly the most impactful because this was the only breach that was being written and signed off on by actual former college athletes others. Who had weighed in on this. Were economists and law professors and subject matter experts but you know offensively. The people who would have been impacted by changes to the restrictions in compensation or scholarship limits while they were still in school and they were voicing their support for the incident which was kind of interesting because the caption of the case is the blake. The allston allston is shown. Allston the former west virginia running back. Who's the The name on a on a class of of former college athletes. And so you know curious. Who are the athletes who are actually standing up for being simple a and so a couple of weeks ago i started calling around and and reaching out to the eighteen athletes who had signed off on this brief two thirds of them are former olympic athletes But six of them are former major sports athletes. Five of them played basketball in college. And one of them is darren. Mcfadden the star football player for arkansas. Who had a kenya year. Nfl career retired in two thousand seventeen. And those are the ones who i thought. Were most interesting. Because those are the ones from the revenue that the so-called revenue generating sports who you'd think would have the most to gain By changes to the restrictions of Of compensation and In calling around Particularly with mcfadden who is kind of the marquee name used by far and away the most high profile of the former college athletes to sign onto this brief Occurred to me in our conversations with a few of them mcfadden included that their words didn't exactly square with what the brief said that when i was asking them. Sort of what motivated their position on the issue of amateurism What led them to to join us brief. They were kind of making better arguments for the plaintiffs for the players for the allston side than they work for. The incident lay And then through additional reporting and and and you know continuing to interview them it really raise questions whether or not they knew exactly what they were signing onto in the first place and whether or not their perspectives on college sports and amateurism aligned with the incident. Belay at all The las firm. That's filed this brief Is a major international law firm. It's called orc. They've done worked previously for the aa. So this was a serious brief filed by serious group of lawyers but it seem like some of their key voices And and their biggest most high profile name didn't know what they were actually signing up for or really didn't understand the specifics or for that matter. The the overriding point of the Of the litigation in daniel not to turn this into a legal drama but maybe in a small town lawyer runs down to the courthouse on friday and file something quickly just to try to stave something off or two for quick injunction. But we're talking about the supreme court here and of the most important cases That we've ever seen in relation to the ncw has something like this happen. You know well. That's a good question and reach out to law firm which pushback strongly in vehemently against any kind of suggestion that the brief was anything other than fully representative of of all of the athletes who signed onto it But yeah your your. Your point is exactly right. This is a very serious case You know this is probably the biggest college sports case to go before. The supreme court gain a quarter century And these are serious lawyers who filed the brief. And you'd think that they would be able to you know. Gather together a group of former athletes. Who really had a full understanding and appreciation of their side I think one thing that might suggest is how difficult it is. How difficult it might be or the blades. Position to find support among former major Or or major sport or or you know so-called revenue sports athletes And and that seems to be where the sticking point is. I spoke with other people who filed the sign onto the who were olympic sport athletes Who were much more articulate and and sort of informed on the on the points of of what the brief would say and what the blades position is but it does somewhat undermine the the argument that that you know. There's a wide swath of diverse in a diverse group of athletes. Who support the simple as that. We had a really physical practice with weighted vests. And and you know. I'm not sure we had enough legs To play the fast place style of play that that obama plays and coach you know gets his guys really get out and run and and You know looking back. We knew that that practice would you know would would maybe set us back slightly but we're trying to think long term. We had a great environment. I mean we. You know i understand. It's a pandemic but we had a really good student section. Our crowd was good. There's there's there's been a lot of excitement over the last few weeks with the way that the team is played and and it was a big game. Th you know anytime you get a top ten cheap You know and you can you can you number one. You don't get a lot of opportunities to play top ten teams then when you do and you're able to to get a win. It is a big deal for the fans at former players boosters and and for the student athletes to reward them for for a lot of hard work but we have incredible respect coach oats and his team and we know that you know they're one of the top teams in the entire country so it was a big win. But you're right you gotta turn the page. And that's part of your team is having maturity when you do win a big game two to turn the page and get ready for your next game. I mean you're now final two days of february and and certainly you're going to be going through this now. You're going to be going through this in the sec tournament and ultimately in the nc double a. tournament for for a program that has not won a lot of big games lately. How drill that into their their minds. That this was fantastic. But it doesn't mean anything tomorrow. I mean i think you know all you can do. Really paul's just continue to talk. educate You know. You would consider a training camp drill but we want to get better and anybody that aspires to play beyond college. None of us have a crystal ball. But if i look at Twenty twenty ecommerce grew at an the crazy rate. Ecommerce grew it over forty percent year-on-year and yet oetzi grew two and a half times the rate of commerce. So i don't know what e commerce is going to do in twenty twenty one. But but i hope and believe that we'll be able to continue to outpace ecommerce overall in terms. Though of the way you think the shopping experience takes place you think by default the growth. You think i mean your how. What's the chance of the same kind of growth next year for example. Well i on the On the bull side of people we tend to forget. There's a lot of people even in twenty nine thousand nine who star shopped almost exclusively amal. Who never shopped online. So millions of people started shopping online and twenty twenty. And so we've brought a lot of people into e commerce warrant there before i'm the bear side during the pandemic can't spend on travel. "Let's do a little background on you. Give us the thirty second overview of who you are and in what brings you here. Share name's stanford for nick. I'm the global head of research at nc secret which is a large cyber security consulting firm prior to this iran a security team at a large bank. I've been doing security for a very long time long before. I realized that it was an actual industry in profession and grew up through Do undergrad and my masters was in systems engineering. And then he's a phd student in cryptography. So my main focus area has historically been progress. But of course it's expanded to much more recently Currently i run a security team that has several hundred researchers at antique group. So you are in fact. One of those jokingly jobs and i always talk about in crypto. There's like five people the world qualified to talk about it. You probably one of those five hundred. If we're going to talk about post quantum crypto. Maybe i was really interested in. Public key crypto systems in how quantum computers could be used to break them. So that's specific staff of probably. Although less over time i guess as i've stepped into maybe a broader a broader role within. I need to get back on the show to talk about. Post quantum crypto kaz. Admittedly tell you. I have absolutely so little knowledge in that stays. It's not even funny all right so you we wanted to get this conversation. Getting kicked off around Around open source You've done some work in this in this area. Tell us a little bit about de get started their shirt so Of course at nc group we do like of security research and some of this is the more traditional vulnerability research so about a year and a half ago. Maybe there were a bunch of people that were getting very interested in figuring out. How do we better secure of open-source ecosystem because we know that there's been this sort of lacombe. Ole finding of random security bugs sometimes super inconsequential on super small projects. Sometimes absolutely massive about things like heart bleed so so like across time There's been there's been an uncovering in a very patchy way of vulnerabilities within open source software. So we were interested in really finding a way to coordinate impulse together and figure out what are some strategic steps forward in open source software security cool all right so look there. There has been so much raging debate And i use that word. Because it's almost like the windows versus lennox versus mac discussion. These days right turns into like a pseudo religious argument oval open source versus commercial software. Which one's better which one's more secure in insecurities Everyone goes and even if you had an app. Even for those of us have spurs one way or the other. You wait five minutes. And there's there's proof to the contrary so a you mentioned heart bleed right like then there's bash bog that forget the name of it but i mean if it had its own logo and i think we even made a theme song for crying out loud like it got it. It's gotten a little absurd. Yeah people are spending too much time marketing. Their bugs navy. But but you know we we open ourselves stuff was such a. I guess a revelation or wakeup call for a lot of us because there was this there was this belief that somehow open source. Stuff is you know. can infallible. Like all right. There's so many people looking at it and you know it's being reviewed in real time. It's the community. Always like their community has the opportunity to bug on either. We didn't or or there's something wrong with that argument. Yeah there's this tragedy of the comments thing that happens around open source software where we assume that just because someone can look at it. Someone has And we also assume that if someone's looking at it they are not an adversary and totally wanna do a responsible coordinated disclosure which is not often or not necessarily always the case so the i think hardly really opened our eyes to the impact that these bugs can have. I mean if you think about it. This was wet like spring. Twenty fourteen that this came out in public Showed us what the risk really looks like in practice you know. There was a single critical vulnerability found within an individual open source project that was maintained by only a few volunteers recall correctly. Like maybe one person was working on it. Fulltime and this was like the underlying infrastructure for like a non trivial portion of the entire internet yet and it compromises security of. I think it was like seventeen or somewhere. Unplug percent of all of the web servers on the internet. And it's like. I think this really shows us how like important. These software systems are and how many dependencies trace back to open source software. So when people are having this debate what is more secure open source or proprietary software. Obviously there's trade offs right. Proprietary can't necessarily have everyone look at the source but you're at least guaranteeing that someone probably is looking at the source an all of these other things but i mean it's it almost becomes a moot point to me because whether you make a case for proprietary software being more secure or open source software being more secure weather proprietary or open source. There's often dependencies upon core pieces of infrastructure that are open source so finding a way to secure these things matters and out of like what came with heart lead. The lennox foundation started like the core infrastructure initiative which put millions of dollars into helping secure open source software. So really open necessarily just kind of the next phase of of that work effort will be good excellent point because this is something that the scene repeatedly because a lot of the the foundations of nobody writes all their libraries right. I mean only the insane Scratch even when. I was the world's worst developer a million years ago. There would still be things you would include you do from other y- find something like okay. I need to know how to do. X y and z. Like i have no idea how to write. I'm gonna go find a l and include that. I can bring in pop that in want to use somebody else's optimized i don't have threat from scratch. Brilliant web apps are the greatest way to see this in action because there's just tons of frameworks plug ins and whatever and a lot of that stuff is open source maintained by the community and then we find out that there are a event julia every once in a while we find a massive bugs in in some of these things and then we gotta go hunting and got to realize that A lot of the commercial products out there have been source things inside them. That are vulnerable that it will like okay. So how do we fix this now. Yeah and like those transitive. Dependencies can often go many layers deep lake sometimes depending on something. That's depending on something. That's depending on open source library. Which itself is depending on some other open source component and often it can go many layers steve unlike just understanding those transitive dependencies where that risk comes into any product. Yet open source or commercial is very hard. It's something that Organizations don't necessarily do The organizations that rely upon these critical things don't always finds them or study them at the depth that you might expect that they would. So there's a definite need for folks that are interested in doing security research in working with open source maintainers to really come together and pull in the same direction. Otherwise we just have this infinite like finding of random bugs but if you think about. I don't know the statistics that ucla seve owner vulnerability databases. There's tens of thousands of vulnerabilities disclosed every year. That gets vs. There's way more than that that are being disclosed. That maybe don't tv's there's even more than that that are being found in not patched and there's probably even more than that being created input into existence so when we think about just the massive stale at which there exist 'vulnerability in sourcing beyond Clearly something needs to change in in the ways that we develop software in the ways that we secure software throat like this. The biggest paychecks came out of the former World Cup, which South forty million dollars awarded between the qualifiers and the main event many other events put up a couple of million here a couple of million. One of those events was the fortnite Champions series better known as the fmcs is the closest continuous structures. They announced the fortnite Champions series was jumping to twenty million dollars for the 2021 season off epic blog posts. They made it clear where exactly the money's going. First of all it's being more heavily weighted on winners than in the past where qualifiers would paid out pretty nicely this you gotta make the finals if you want any do here's how the twenty million dollars breaks down. The first important split is between the F and C S and yet unnamed mid season and end-of-year events. The fmcs will have twelve million dollars for its thorns. Well eight million is being held for events based off winners and qualifiers in previous f n c s events, so they're like part of the ecosystem but they're not part of the four individual Seasons wage. Brings me to the next split that twelve mil is being split among the 4f NCS Seasons leaving 3 mil per season. The seasons will happen along with the actual Seasons with the first one month beginning in late January early February.
