"June grosso from Bloomberg radio. The National Football League is being investigated by California and New York over allegations that it fostered discrimination and harassment in the workplace. The attorneys general of New York and California announced the joint probe of the NFL's workplace practices and culture and have issued subpoenas to the league to gather information and determine whether it flooded federal and state pay equity laws and anti discrimination laws. Here's California AG, rob banta. Employees passed in present. Continue to make allegations of discrimination. And from where we stand, they have not been addressed. And so we're going to dig in and see. We're going to heavily scrutinize the NFL's practices, procedures, and work environment. We're going to look closely in turn all the stones. And see what's there. An NFL spokesperson said the organization takes the issue seriously and will fully cooperate with the attorney's general. But that the allegations are, quote, entirely inconsistent with the NFL's value and practices. My guest is Martin E Dell, co chair of the sports law practice at goulston stores. The NFL obviously has faced investigations before, but this investigation appears to be the first involving workplace violations in the league's corporate office, explain why the attorneys general decided to take this step. As best as I divine and try to put myself in the heads of both letitia James and her California counterpart, we have a group of employees more than 30 who complained last year about a hostile work environment in the NFL. You have the NFL also employing over 37% of its employees are women. 30% of people of color. With those kind of numbers, it incumbent distinct to me on the attorneys general of state in which the NFL has offices when we California in New York because very seriously complaints about a hostile work environment, Harrison, male cultures of dominance, frankly, not to exist anymore, but unfortunately still do. So I think they're looking into what's going on there based on the number of allegations and it's because it's more than one we've had as I mentioned 30 women last year filed allegations of a hostile work environment and discrimination against the NFL this year you have a couple of other people filing women in particular, but also people of color filing complaints to that hostile work environment to discrimination against the NFL. And I think the attorney general New York and California are taking very seriously their obligations to investigate. Will the attorneys general be able to get further than the women can in their lawsuits. With discovery. Well, what we do know, I think the answer is they can get to the root if there is a problem they can get to the root of it more quickly than in a civil lawsuit because this would be either a civil or a criminal investigation and the state has enormous powers in terms of subpoenas and investigative powers that would simply drag on for a much longer time in any civil law duty. There have been lawsuits filed by former employees, congressional hearings last year into the workplace practices of the Washington commanders, and that 2022 New York Times article reporting on allegations of gender discrimination by more than 30 former female NFL employees. So this is nothing new, the NFL has been on notice about this for a long time. Unfortunately, this is the most recent spat of complaints. Are coming on the heels of other complaints about a hostile work environment and discrimination. You know, we've seen them in the media with ray rice and his then partner, subsequently, his wife, who he beat up in an elevator in New Jersey, and you may recall that the commissioner initially handed him a slap on the wrist. And then the outcry was sufficiently large to the commissioner looked back into it again and handed out a much more severe punishment. But that wasn't the only incident. We have Flores who filed his lawsuit. He was a coach with Miami, who didn't get head coaching positions, although he was eminently qualified, and he filed the discrimination lawsuit in February of 2022. And that's why being its way through the southern district court and their in discovery at this point in that lawsuit. And more recently, as you point out, we have danced Snyder and the commanders, where it was reputed. He fostered a hostile work environment, did things that people shouldn't be doing at ever, but certainly not in a heightened sensitivity environment that we currently exist. And there were reports about that went to Congress. Ultimately, the NFL I think it's fair to say for Snyder out of his ownership position. Although he wasn't hurting for it because he sold the ownership position for an enormous sum. But yes, there are more and more incidents. It's coming out in sports and particularly in the NFL, although the other leagues are not immune from claims of hostile work environment and discrimination. I mean, how do you prove a hostile work environment? Well, it has to be more than he said. So you need to have a series of comments or actions that would make an employee feel threatened his or her client environment. And you have to have, in this case, it would be the NFL, not taking suspicion, at least serious the allegations or even if they did the allegations sufficiently seriously. Not then implementing a corrective plan for it. All of which are very difficult to do, but nonetheless, are required by the law. Roger Goodell, NFL commissioner, said that workplace misconduct is thoroughly investigated the NFL and retaliation against complainants is prohibited. The league has put more effort into diversifying its hiring and has mandatory anti racism training and an anonymous hotline called protect the shield for employees concerns. Is there a way to completely rid the NFL of any of these claims? Well, the answer is you can never eliminate entirely a hostile work environment because there are always bad actors out there. People who may feel entitled and just disregard what's there. But the NFL is starting down the right F this may be late in the game, although it's better than not having done anything. But taking allegations seriously, investigating them, thoroughly, because they have a media presence, they're wrong to start with if they're accurate. And also they have a negative media impact. And no matter what anybody says, the NFL is not simply a male domain. There are a lot of women who watch NFL games and you don't want to alienate your audiences. And the more they come down, the greater the risk of alienating your audiences, alienating your sponsors and alienating your media hosts, which will be down to negative impacts on profitability. What other sports have similar complaints lodged against them? I don't think any other sport which I'm aware currently has quite the same problem that the NFL has because you don't have quite the same number of people complaining. Are there people complaining? Sure. We had the incident with the Phoenix Suns in the fall this year with Robert sarver, who a number of employees complained had created a hostile working environment discriminated against women. And unlike the NFL, the NBA investigated the claims. It was very public and its report in making its report public and in taking action to try to strip Sauber of his ownership interest and ultimately the Phoenix Suns were sold. That didn't take a year or two years. It took a couple of months, which is why I think the NFL seems to be new to what it's doing here and is perhaps a lot slower than an NBA. And how do NDAs play into this? Are some of the women prohibited from making public statements because of the NDAs? I'm not aware of that. It's possible. But it's hard to believe that in this day and age, especially in light of what's occurred in the media with our former president that people take NDAs that seriously entities will try to enforce NBA's that would preclude a claim. I think I'm going to do the work regardless. It's not about whether I can support for the National Football League or the NFL V8 or fans. I would do this work because I think that this is important. As with many other events canceled due to the covid nineteen pandemic. there is no south by south west festival in austin texas. This year. That is true. But there's a virtual south by southwest going on online through saturday march twentieth. And i got a chance to participate. Let me tell you a little bit about it. I've been scheduled to moderate a panel last year gaming for good but the festival got cancelled entirely when we knew there was going to be a virtual festival this year the company that sponsored the panel skills decided to go ahead and do it so we recorded our discussion over zoom in late february and it was really enlightening and very made me very hopeful about things. Has you can still buy a ticket to the festival. There's a link in my story for that too. But here's the basics. I learned from from the panel. The panelists we had three of them. there's a program called gamers outreach that provides video game carts that means it has like a secure tv and a game console on. It's it's either hook to wireless or however they do in the hospital in two hundred thirty children's hospitals around the us the founder zach. Weigel began the program when he was a high schooler halo tournament. The got cancelled He'd organiz the tournament but public safety official voice concerns about the high school cafeteria being used for a hobby. That was quote corrupting the minds of america's youth in quote. The guy said so to show the gamers from it meant well the next year weigel try it again and raise money for a local children's hospital with that resulting tournament part of that he learned. The hospitals often have trouble keeping kids occupied when they're recovering from treatment in their rooms so that led him to begin having online fundraising to get these. "Nearly six thousand amazon employees who work at a warehouse in bessemer alabama are voting by mail on whether to unionize. If they do this will be the first union amazon facility in this country. Here's jennifer bates. Who works there. I keep butterflies and butterflies. Normally come to calm me but hey this is my stomach faithful. It seems like it's getting bigger and bigger full of butterflies. Because there's no break in. Think i don't know how kogo nerve wracking. The election ends later. This month and i should mention. That amazon is a financial supporter of npr. But we cover them like any other company. Some lawmakers support the union. Including senator marco marco rubio or republican and of course president biden also michigan congressman andy levin earlier this month. He and a group of democrats traveled to bessemer. Good morning congressman. Good morning noel. How are you good thanks. What did amazon employees. They're tell you about why they want to unionize. Well you know a union election so often are about basic dignity and that was really true here. I was shocked to learn what it's really like in there They work in a facility. That's like fourteen football fields and it can take ten minutes to walk to a break room. They've to half hour breaks in a ten hour shift so they might get effectively ten hours to eat lunch be by the time they walk there and back lot of them. Don't feel like they can go to the bathroom. Except on their break. And they're watched and quantified every second they're monitored visually a listening geo positioning and every second they're not on task is measured and if they have a certain number of minutes off task in a week they could be fired sometimes might not even be a person involved it was really kind of dehumanizing to me. Here's the argument. That amazon makes amazon. Says look our employees. Earn fifteen dollars an hour which is a good wage in a place like bessemer alabama. Some of them have health benefits. 401k's essentially they have got the benefits that a union would get them. They don't need a union. What do you make of that argument. I'd like to tell that argument to any national football league player and the actor and a movie any presenter on major television or radio networks all of whom have a union every single one. The idea that unions are only for people who are the most poorly paid. It's ridiculous the one person who is unionized. That every airline is the pilot so this argument is ridiculous. These workers deserve a seat at the table to discuss a safe workplace. During a pandemic they deserve a seat at the table to have a workplace. That's human and a real person can go to and great make fifteen dollars. An hour amazon should pay them a lot more the owner of the company. The main owner had his wealth increase. Seventy eight billion dollars during a pandemic and they're about pay jeff bezos in their bag bragging about paying people fifteen dollars an hour there. What's wrong with workers having their own organization just that they can have input in their in in their work lives. And that's all these people are seeking is a seat at the table during this trip to alabama that you went on your colleague congressman jamaal. Bowman said this doesn't stop with amazon. He mentioned lift. Uber tesla and walmart as well. What is the ultimate goal here. The goal is for workers to be able to form a union and bargain collectively. If they darn well please. Noel were down to six percent of private sector workers in this country needing union. We're gonna pass the proactive in the congress and the president is going help. It's the Bucks and the Chiefs and on paper. This is a matchup like we have never seen before. In the history of this Super Bowl, the goat Tom Brady looking for his seventh Super Bowl championship. Playing in his 10th game against Patrick Mahomes, who is trying to lead his team to back to back championships for the first time since 2000 and four with that it's now my honor and pleasure to welcome my broadcast partner for the 12th consecutive year. The Great Larry Fitzgerald of the Arizona Cardinals and NFL Man of the Year. Larry, How are you Today? I'm off standing. Jim was always great to be with you. The only thing that could be better was You being on the field, but glad to be back with you, Jim. He's called these games and the largest minutes he stole the Super Bowl for me and In 2009 s O. He understands the dynamics. He knows how to get his best players involved. He's gonna put his players in position to make the place that they're capable of making him. He does a really good job off. You know, putting guys in formations hiding emotion Ng s so they can create the matchups that they're looking forward to make it easy for time to get the ball to his best players, Larry on paper. This looks like The best matchup that I can remember in a Super Bowl. You know, in an awful long time, if not ever. Paper doesn't play. But as you now looking, analyze this game do you think it's going to be is appealing as the hype has been for this game based on this matchup that we see Absolutely. Yeah. I mean, I think we're seeing today the greatest player to ever play football and Tom Brady still proven to everybody who's ever doubted him that there's nothing that he can't do when he sets his mind to, it doesn't matter. New England or Tampa wherever he's all about business, and he's the standard that, he said is unparalleled. And then you look at Patrick Mahomes and what he's been accomplished in this three short years. The numbers has put up the winds of the magnitude of wins championships. Um Doable and VP last year. He is really, really a special player in a future Hall of Famer in his own right, and so to be able to see, you know, two of the best player of the game is has had, you know on this stage? You know, with everything that's going on this year is gonna be a special night. You look at the playmakers that both of these teams have is gonna be a lot of scorn was gonna be some wonderful place made. And I think everybody's looking forward to this match up today, all right for Tampa Bay to win. They have to what they have to run the football. They have to be consistent. They have to stick with it. They have to take two shots when they have the opportunity, but they got to continue to run the football. This will Limit the possessions that Patrick Mahomes gets. If you could do that, that takes him out of his rhythm. You get him in three and out a couple times and, you know, you just want to plant the seed of doubt in their mind, and I think Tampa can do that if they could stay consistent with the running game. And for Kansas City to win. They have to do what they gotta get Travis Kelsey involved early. We washed their games. When he gets going early. It really confined their safeties. They can't get outside the numbers to be able to take away some of the deep passes. And so I think it's very important that they get him involved in intermediate passing game, going down the seams and really put some stress on the temples defense up vertically. It's Is unbelievably tragic situation and you thinking about the young people that have been affected by this and you hope and pray that they'll be able to pull through. But I think the guys in the locker room I understand that you know, this year has taught you more than anything. You know what guys? Missing time We're called Did you know did schedule change and things that nature? You haven't you've had to deal with adversity that you never have had to deal with. So I think this year people are much more equipped to be able to deal with it. But I think the questions and the things that you get the day before two days before he came about it. You know, it was definitely a distraction. No. Obviously a horrible situation, and Andy Reid will coach the game today. Larry, Are you retiring? Matthew Stafford. A decade into his career in the National Football League is over playoff winds. He got the Lions to the playoffs three times in a decade. Back in 2011, which is now pretty long time ago where he got beat by the Saints, 45 to 28. All right. The team gave up 45 points on defense. I would say that wasn't a game that you could lay at the feet of Matthew Stafford, a loss that you would peg to him in 2014 made it against the Cowboys. A debatable called during that game. But the Cowboys did win 24 to 20 that was 2014. And then a couple of years ago 2016 against Seattle. They got beat 26 to 6. That was a game that the yes, the alliance did absolutely nothing on offense, and Seattle eliminated him their first game in the postseason, So he's sitting on an old for three in the post season one. I will absolutely not blame him. He scored 28 points defense gave up 45 the second game. Debatable playoff call. Um did that was active reason why the lines will have to game well, some on him. He got the chance. I'm trying to remember the exact way that that game played out. I think the lines had cancer. Get back in and get overcome that questionable call and in the game against Seattle a couple of years ago, Yeah, Stafford did not play well, The lion offense generated next to nothing in that game. Didn't go exactly the way I was thinking it would go. My wife passed away three years later. Um And you know, I met my current wife. Now I find myself doing TV and I thought myself quite off having an Aussie, which I never had before. And I found myself with more balance in my life than I did before spending more time with my kids. No, I got five grand kids. So you know, I think when you talk about coaching the National Football League is a tremendous sacrifice. It should make it terms of time commitment. No jury, no downtime, and you better have someone with you. That's a very supportive who also understands you know that that lifestyle so then obviously at the same time No. There's more transparency with cell phone came along. The camera phone came along. Always social media, all that you have no more really don't have much more private life anymore. If you're living in the glass dollars, is being head coach of the football team, and the city is So all those things doctor into it. Don't think of myself before I got great balance in my life right now. I'm very, very happy. And I love what I'm doing. And I love where I live. And yeah, so I really don't miss it. And you know you always miss competing the camaraderie of players, But, you know, I'm gonna wait for 14 years now I love talking about still loving our check interacting with coaches around again today from our players. They're in the game today. That was enough for a very long time, and I have a lot of respect for the game itself.
