Justice Department drops challenge to California net neutrality rules

"Earlier this week. Department of justice dropped its challenge of california's net neutrality law. You might remember. The california introduced law after the trump administration rolled back the obama era policy which was creating more equal internet access. Trumping the doj's challenge could signal a return to net neutrality. So here to get us back up to speed and discuss what the impact of a change be is. Our reporter drew fitzgerald. Hey drew thanks for joining me shortly. So it's been a little while since we've talked about net neutrality and this is a complicated topic besides start here with a little bit of a primer. Can you explain what neutrality means and where it comes from well net neutrality. Is the idea that the company providing you access to the internet whether it's through cable a cell phone connection satellites. Whatever can't pick favorites if you're shopping online or watching netflix. Video or talking to people on zoom. Your internet provider shouldn't get away of those activities by blocking traffic or slowing. Some of the data down to make other services were better. That's the principle in practice. The federal government under president obama road rules discouraging a lot of activity with some exceptions. There were some loopholes that allow for a little bit more traffic management for cell phone providers. There were other rules dealing with privacy but on the whole it prevented the sort of blocking or throttling traffic. That open internet advocates had really worried about. What's the argument on each side of this issue. Will supporters of these rules argue that the modern economy flourished really because internet providers didn't control things too much look at google and amazon also look at net flicks that exploded even though provided entertainment. That competes directly with some of the cable tv providers. That were serving their netflix videos. Over the internet deponent's net neutrality. Rules argued that they're not really needed. Because these companies provide internet service and if they blocked or seriously degraded some of the websites and content that their customers want customers. We get mad and it would be bad business. Another argument against the net neutrality. Rules especially in washington has been that it would open the door to price regulation to setting prices. That's something that companies like. At and t. and comcast are very fearful of don't want the government involved in got it so net neutrality policies again. That's the idea that internet service providers shouldn't be able to pick favorites. That was an obama era policy. What was the trump administration's approach. Where did they follow. And how do they handle. Net neutrality will the trump administration opposed those rules and the new chairman of the fcc at the time named by president trump rewrote them They introduced new regulations that completely revoked the guidelines that the democratic led. Fcc headset few years before they also tried to make rules. That would deter states from writing their own regulations and they argued that the state of california had overstepped its authority when it filled the gulf and and wrote its own rules right and let's talk about that. California's law escalated into legal battle with president trump's. Doj what happened there. And why is it so significant that this happened in california. Yeah that's right. California did pass this law during the trump administration to try to protect the types of activities that the obama administration had supported and california's not ordinary states. The biggest state in the country as we've seen with other sorts of rules on greenhouse gas emissions internet privacy. If they pass a law that is sustained. It has the effect of really setting the agenda on a national level. A national company can't very well have rules for the rest of the country and ignore a with forty million people in it so it has the effect or it would have the effect of protecting net neutrality principles on a national level if it were put into effect now. The important thing to remember is that those rules have gone into effect yet. Pending legal challenges right and among them was a lawsuit from the trump administration's department of justice. But now that the new biden administration is in office. There department of justice is dropping that suit against california's net neutrality law. What does that tell us about how this administration could approach this issue. Well it tells us two things one is that the biden administration like most democrats still supports neutrality. Rules that are enforceable and doesn't want to get in the way of what california's doing they're aligned in their ideals. They're the second thing it tells us. Is that the diner administration. Ministration should be eager to have those california rules go into effect and become the law of the land essentially because it doesn't yet have a lot of power to act on a federal level. The fcc today is led by acting chairwoman jessica rosenworcel but is a two to split by administration. Hasn't yet named another commissioner to fill the five member commission or named a permanent chair person which really ties the commission's hand in writing the sort of sweeping rules that it did under the obama administration

And i just don't care about rules i just don't so tell us about your business. I own four locations of franchise called one eight hundred radiator Started out in daphne. I bought that location about seven years ago and then the other locations over the last several years it is a wholesale autopart supplier. Okay so your card says one eight hundred radiator in a ac. Yep yeah it's you can tell by the name when that company was created it was originally created out of california in kind of a hub and spoke warehouse strategy and then about fifteen years ago. The decided to start selling franchises to get local ownership across the country. I love jazz candy now. Own wouldn't find franchise. We actually have two territories mobile and baldwin county for payroll bolt and people don't realize that two franchise didn't know that. Yeah and so this whole go. Local height the chains be. Be careful when you're hating because you don't know whether it's really corporate or if it's franchises because of its franchise i could be a local. That could be your neighbor. That owns that right exactly. And that's when was the taglines that we talk about. His were national company with local ownership. Two hundred twenty five locations across the country and in canada on four of them see. I didn't wanna reinvent the wheel. Garon knew that. Cpa's cannot make money doing payrolls just doesn't make sense because it's the billing structure right. People want to wrap theirselves around the business and not want to reinvent the wheel. And i think that's the smartest thing about franchises. It's all laid out for you. Yeah well i got into the franchise business we. We lived in memphis before we moved to a fair hope about seven years ago. Eight years ago we own a little business called three dog bakery based out of kansas city and a dog bakery. We bay birthday cakes in all fresh all natural foods in it was a fascinating little business and it taught me the value of franchises because i have no history in baking and neither did my wife but they taught us everything we needed to know. We had all the ingredients. We hit all of the recipes. And so we're good to go. So when i moved here i moved here to buy this business. But i was comfortable with the franchise model. So now you went from one franchise and kenny. Nap talked about this before you know. We're at a good place right now. So we're not looking for growth but you think about it. I've had a business with multiple locations before the struggles and tell us your three top challenges for all those listeners out there that own a business in hard enough as it is but then to open up. A second location yeah. I don't feel like that. I'm a control freak but i learned a much more of a control freak as a small business owner than i ever thought. I was before from the perspective that you've got to see in lead by being present a lot of times and in trust is a big issue and processes help solve both of those issues. I've lost in been hurt a lot by being in not having the right processes in place. But i'm a much better business person now as a result of those valuable lessons as a really good point because every time i've been burned i've learned something from it and i'm not a micromanager. Yeah i'm just not. I don't have time. I hire smart people. Expect you to do your job. Yep same here. I was in corporate world for twenty years with the medical company. Regional leadership been Sales leadership sales operations moved around quite a bit so a little comfortable with travel and comfortable with leading teams. That aren't directly in front of me. So i think that looking back that helped me be prepared to lead multiple locations right. Secondly when i got down here the first employees are hired. My wife actually found used to work at sam's and always joke at this. The best thing we've ever bought sam's is jessica and jessica is fantastic and jessica is a a rule follower a thorough honest Trustworthy person lover to death. That's how i define. Yeah yeah absolutely. And there's no way in the world. I could have gone to number two three or four locations. If it hadn't been for jessica and every time that we considered. It asked. Jessica i because i wanted to make sure she was okay with us expanding and doing these other things and she was always on board. It just wasn't something we did and now all those things are are being added back into scopes of work. I really we only saw in the medical space and now it's it's also coming into the light of back to what I said about before instead of somebody back in the in the background and and kind of hidden we're actually being asked to make sure they are seen so we are presenting them at certain times of the day. So that customers employees can see that they're being taken care of and and feel more comfortable in the facilities that they're in we've spoken with restaurants that have seemingly gone through the same thing and I'm very, you know, nice restaurants don't you don't want somebody wiping down a table next to you, but now you do you want to see those things happen. So how has you know, your birth? Kind of Labor had to maneuver and and pivot like the rest of us as well. But especially within that cleaning space to make sure that they're doing all the things that they need to be doing but also visibly doing sure will you know cleaning is is traditionally defined as an unskilled labor. So just think of that for a moment that this is an unskilled labor and now we're pushing in all all these these things that need need to be known by the person that's is providing the service so think about what what's on the page p a list that kills covid-19. Oh, first of all, we have to make sure that that we're providing the right chemicals, then there's dwell times. So now we we're teaching our own boat unskilled laborer to be mindful of the time that they're applying the disinfectants that they're using. There's PPE requirements. There's document job..

The antibody tests are are fairly new inaccurate but this one was a very well researched and Accredited test that was done by a laboratory in New York City in Los Angeles County. So this so this was back in April twenty third. So we're we're well. We're three and a half weeks removed. Yeah so in New York City alone. They randomly tested thirteen hundred people. Twenty one percent of the people came back with positive antibody tests meaning that they've had the virus. Already enriched have recovered so if you take and this is how these re research things where they're doing the same thing now extrapolating percentages and and multiplying a by the masses to give us these projected numbers on both sides of it so I did the same thing. Okay so if out of the eighteen point eight million people in New York City. That's a total population. If now if we use that data to the twenty one percent that's tested positive for antibodies. That's three point. Nine million people have already had the virus in New York City and recovered that means the mortality rate as of that date so I went back and even looked at that date. What was the more tout? Was the death. The number of total deaths on April twenty third. It was eight thousand one hundred and thirty deaths in New York City in the NYC the NYC that puts mortality rate at point. Two one percent point two one percent Los Angeles County did the same thing around the same time. They came out with five percent positive rate for the antibody test. You put that against their total population. That's point two five percent mortality rate. So and we also know with us with that mortality rate who? It's affecting the age that it's a- affecting and the and the people that have preexisting conditions so for me as a forty one year-old healthy person. Yeah that is not around people with with At that age group and have pre existing conditions. Yeah my opinion okay. It is my personal opinion that I want to move freely about the way I wish. Now you you may have a different opinion about it and you may want to go a different way and you may be totally content being inside your whole time. But I'm telling you based on the numbers that are coming out slowly more slowly about how widespread this virus has already been in the people that have already been affected and recovered. Decentralization Philosophy Part 1 From Buddha to the Conquistadors

"I've been trying to figure out how to talk about this topic for a while because cryptocurrency is this really kind of strange flat structure. That has all of these little hierarchical structures built on top of it and you can take that analogy and you can really really zoom in on it or you can really really zoom out on it as kind of still true really regardless of how you're looking at it and I think a lot of this has to do with just the nature and sort of the oddness oddness of crypto currency and a Bitcoin as a community right as a movement and as technology that also is attached to people getting rich. Sometimes today I WanNa talk about a topic that I've been calling catalysts and CEOS and take a look at what the crypto currency space looks like. Today what it looked like in the past. Ask Talk about some of the different attributes that got us to where we are today. So Toshi said an interesting precedent. They led with their ideas and to a lesser extent their code and the early sparked a was association that contribution catalyzed first Bitcoin and then the crypto currency movement at large those who believed in that vision given an opportunity to get rich in some cases crazy rich rich and that combination of factors lead. I all coins coins than ICO's SAFT'S STO's and I don't think even talked about on the show before and who knows what will come next because clearly the path of innovation that's occurring here is not over at all but it also created what feels like a strange legacy that we're going to explore today as simply put are charismatic leaders who emerge from that flat structure that is the bitcoin protocol more or less dangerous more or less problematic more or less notable than the mark Zuckerberg's the Elon Musk's Jeff bezos. Goes and Steve. Jobs who really lead their movements. There's not that much of a difference between Associate Akimoto and a Jeff bezos except for the way that they fundamentally went about not inciting the change that now has kind of swept the world in one case kind of the e commerce site of and the other case this digital currency cryptocurrency or blockchain bitcoin movement. Or whatever you WANNA call it. Today's conversation is about decentralized catalysts and centralize CEO's the first thing I thought of when you said SA- Toshi contrasted to Jeff bezos. US was the difference. Between a certain personality type blended with introversion versus extroversion an extroverted rated person who is very smart and capable and intelligent and can see the future almost but wants credit and wants to be the face of an organization and is is comfortable in that role. You end up with someone. Like Jeff bezos. WHO's out there? And he's totally comfortable with that even though he retracts heat sometimes but but she didn't want the credit souto she wants to be behind the scenes and gets everything they needed from just being the mastermind. Mind who's kind of silent and letting other people be the face and I think that's really interesting. If you study personality types. Maybe even like the Myers Briggs. Souto Souto she is like your classic. I N T J personality type. They're like the mastermind architect but they don't need the credit and they don't need to be the face. Jeff Bezos as US would be like an E. N. T. J. who's like the CEO and the leader and wants to be the public face. I think that's a really interesting point. But I think that there's another factor here. Maybe okay which is that. Was it a choice. For Satoshi to take the type of catalyst like behind the scenes never revealed role or was that a factor of the not just the disruptive potential but what was being disruptive of course it was a choice. I mean Saito. She clearly thought through the implications of what they were doing carefully but if they really wanted credit they would have justified some way to take the credit and to be public about it. I think you always have a choice. I think another pretty good way to differentiate so Toshi from Jeff bezos is one of them make several hundred million a year contracting with the CIA Eh and the other one was never heard from one someone spoke to the CIA. I don't know who's point that supports but I think the big different factors that there was a legal path for Jeff Bezos to do what he did and even if he was an introvert. It still a good choice for him to do it. If it winds up that he has all the resources and success. I don't think we see that in practice very often where you have a founder. Who Comes in catalyze is a thing and then leaves before it actually becomes successful and their contribution bution isn't largely replaced by what comes after? I don't think it's so cut and dried that. What Jeff Bezos was doing or wanted to do with there was a legal path for him him? I mean he was doing something that nobody had ever done before. What was that avoiding state sales tax? This is another good point. Jeff bezos has been really interested in Star Trek. He wants to create a star trek future and some of the things he's been doing are totally unprecedented. And so it's not as though you can really say. Oh they're definitely legal because there's never been a legal precedent to establish that they are legal. You could say oh well Ijaz doing things that are a gray area or questionable. But he's he's not asking for permission and that's an admirable quality so you're talking about different levels of challenge and so with Jeff Bezos thing and with examples like like Uber. And other things like that. You are talking about companies that are doing very disruptive things but the question is who are they disrupting and in both of those situations the person or the entity. That's it's being disrupted their state governments and so if you're like a national company and you have presence in many many states that actually gives you the ability to play a bit of a game there. The thing that Uber did is kind of the reverse of what happened with napster. Napster was a decentralized network for file sharing then hit a bunch of national and even global organizations that suited everywhere but it was ultimately fighting these national or global organizations whereas Uber. They weren't fighting any global or national organizations they were fighting lots and lots and lots of little regional monopolies and it's to a lesser extent. Sure about Amazon to every state where they weren't collecting sales tax. Well that was an individual a fight so it's not like they had a problem with the United States. They had a problem with each individual state. Look at what's happened with projects in the lead up to the invention of Bitcoin and all of those centralized charlize alternatives. They were competing with the federal government for fundamentally monopolized right in the right to issue currency and control sort of the dynamics of the money that we all use news. And that's a place where it seems like you couldn't have done this as a CEO because people tried that and they basically all wound up getting arrested or getting all their assets season in many cases giving customers assets assets seized two so as we can see. There are definitely reasons why people do decentralized and centralized organizations whether it's from personal reasons just because they don't want the credit in some cases or in some cases because having the credit is dangerous and on the other hand the advantages of taking on that leadership role. Well the thing about a flat structure is that it's a flat unstructured. So even if you're on top of it still major basically at the same level as everybody else but organizations you know. Companies these are hierarchies for the most part and so if you have that role at the top of that structure well. It's a lot higher than you'd be if you were at the top of a flat structure. All of this comes back to one of my favorite books. It's really short and highly recommended. Did starfish and the spider by Rod Beckstrom Ori Brachman. I read it actually before I became interested in Bitcoin and it was really kind of formation book for me. We've talked about on the show before but it's been like five five years so I figured it wasn't a bad topic to bring up again. The subtitle of the book is the unstoppable power of leaderless organizations. And if you're a fan of decentralized technologies but I've never read it I cannot recommended amended highly enough quoting from the book.
