That attorney's name was samuel. Newton samuel went right to work and on august third two thousand fifteen filed the appeal with the utah supreme court. Doug's appeal soon. Hit some road. Bumps samuel newton struggled to get a complete copy of trial. Defense attorney sean. Young's case files. He ended up pursuing a court order to force the issue and effort that chewed up almost a year. Samuel also started talking regularly with doug. A fact dug himself pointed out in a letter to the utah supreme court. I have a great working relationship with mr newton. I completely trust him with my life and in his judgment in doing what is best for my legal case going. Forward samuel reached out to many of the people doug had listed as possible character. Witnesses in the lead up to the trial trying to understand why so many of them had failed to show up and testify. What he heard over and over again was that they had never been contacted by the trial defense team or if they had that the calls had been brief and superficial some told samuel they would have happily testified if they had only been asked. Mr young failed to contact over a dozen witnesses for the two thousand fifteen penalty phase. Once it was learned that mr young failed contact my character. Witnesses we were county terminated his contract solely because of my case in may of two thousand sixteen samuel asked the utah supreme court to send doug's appeal back to the trial court so they could get to the bottom of this. The supreme court agreed to the request in march of two thousand seventeen. The high court's order instructed the trial judge. Michael rita to hold what's known as an evidentiary hearing as mr bowis. He was lead counsel in charge of mr young. I believe the upcoming hearing will clearly show that. Mr balas failed when it came to overseeing mr young's work here were the questions judged to had to answer had sean young acted deficiently in failing to prepare several of doug's witnesses for their testimony. Was sean young deficient for failing. To even call. Fourteen of the potential witnesses doug had identified had shown young's cross examination of carl jacobsen ben inadequate. Did sean young failed to properly prepare the defense. Team's mitigation specialist. Whose job it had been to research and make initial contact with many of these witnesses. Should sean young raised an objection to the alleged interference of the church's lawyers. There was a lot of confusion and a complete lack of communication when it came to my character witnesses. The sheer number of potential witnesses covered. By the order meant the evidentiary hearing would likely take longer than had the entirety of doug's trial. The remand order instructed judge to read it to report his findings within ninety days. He didn't meet that deadline. Not even close. Here's why appellate attorney samuel newton had by the start of two thousand seventeen expended. The seventy five thousand dollars allotted by the county for the appeal. He anticipated the evidentiary hearing was going to require hundreds more hours of work. He began talking with county staff and commissioners about the need for additional funding. The county suggested samuel was overestimating the time required. They offered an additional fifteen thousand dollars but also expressed skepticism over. How much time. He was spending communicating with doug for the first time. I got an attorney who represented me to the fullest. Who knows my case inside and out and now the county has pulled the rug on funding him. Samuel claimed in a sworn affidavit. The county had refused to pay him one hundred twenty thousand dollars for work he had done on a different death penalty appeal that had caused stress. Which had in turn exacerbated a heart condition. This drew the utah attorney. General's office into the funding dispute in a letter and ag's office staff member said samuel had developed a conflict of interest. His health and doug's defense were now at odds in a court. Filing samuel referred to his situation as quote involuntary pro bono. He asked judge tarita to intervene and force the county to pay but judge rita declined on the grounds. That was a civil matter. The didn't fall within his jurisdiction. Doug argued to the contrary in a letter to the court. He said his very constitutional rights were at stake. I have the right to effective assistance of counsel for my defense. And i had just that. I had an attorney who was competent. Who actually read my entire file. Who met regularly with me. And who i believe had my best interests at heart. Doug pointed out the county would have to hire another appellate attorney for him. If the court allowed samuel to withdraw. That lawyer would start from scratch. The tens of thousands of dollars already spent on two years of samuels work would be for nothing. I ask this court to please intervene and see to it. That mr newton will remain as lead counsel in my case going forward judged a reader released samuel from the case at the end of august. This drew media coverage including editorials scathing in their assessment of weber counties handling of the matter. The bad publicity didn't help as the county sought to find another qualified attorney willing to take dogs appeal in fact it could find only one coleen coburg. She signed a one hundred thousand dollar contract with weaver. County at the end of september weeks later the weber county commission sent samuel a letter informing him. The county was terminating his contracts. The commissioners accused samuel.

Apparently they have some native American ownership, which I'm sure would would warm the cockles of the hearts of this administration. I don't know the status of those pipelines. And if the Keystone XL is one of them or not, but perhaps J does. Yeah, well, good question, and I'll tell you the Keystone Pipeline. You know, a big blast time I was on the show. We talked about it. And Jim, I was thinking about it going. Okay? Well, yeah, they're going to come back. Somebody will come back, and that was a political move The day after the day he got into office. He Signed off and said No, no, no, no, no. We're going to do away with this. And so he shut down the pipeline, which is not good. That is not good for the place Oil by the way, Uh, but the pipeline was bound. All the workers are out of work. Thousands of workers and So forth and families and so No. And I thought, you know. How anybody can get by with that, Because you've got to have pipelines. Pipelines are so much easier to transport oil rather than further tanks and trucks. On the highways Turn up highway, So pipelines are so much easier. You can get so much easier access and and wells drilled and the oil out of my players are safer than any other form of energy. Transportation, are they not? Absolutely absolutely. All right. I said truckers just tear of tariff roads. 100%. Yeah. I'm the Indian. A married the native Americans and Indians and so forth. You know, I don't see. I can't see those those being done with. But of course, I said the same thing about Keystone Bob Klein. And look what happened there. True, Yeah, all right, And the third question that Sharon had had to do with oil workers stranded in the Gulf of Mexico. What is their status? The last I heard, which is an article that I read this afternoon. There was there was not anything good to say about that. Now, whether or not that I have not heard of that update in the last couple of hours. But still that was that was just so terrible trying to get everybody out. They couldn't get everybody out, and there's also shelled workers. 100 show workers on the on the boat. I came here to be on the boat and the and the gulf during a winds of that magnitude, But I have not heard an update you know, lately. My question is is that my understanding is that another thing that's contributing to are paying more for fuel is that we have not built an actual finery to convert oil into gasoline since the 19 seventies. My question is, is that some sort of moratorium that's been put on the oil industry by the EPA. Or is it a case of they've just piled on so many regulations and we're with all the distance. It makes it just not feasible to even attempt to make another one so that every time we have another storm or Something like we're going on to the Gulf Coast were always in a pinch in the price spikes up half a century. That's that's weird. J. That is, that is and I think all the above, I think Hey, number one. The cost is just astronomical. Number one. Number two is You know there. I'm not sure how much money they're making. A refinery is really making. And if you can't put up a billion dollars or whatever it cost to build a refinery, and you know you're getting oil in and and we have to refine it, And I'm sure the numbers just don't work and I would not. I bet the it's in the thousands of pages of regulations that you would have to sift through so that that alone would cost. I can't imagine how many attorneys would be putting all that information together. So it's like I said all the above money. Up front money trying to make money off of it. And also regulations would How about just Nimby? Not in my backyard about just people saying sure I want all kinds of oil and gas and heating oil and gasoline. But don't build that refinery anywhere near me. Is that part of it? Absolutely, absolutely. I mean, there's people going green so much that it's just it's right now The old industry is getting a bad name. And, you know, Biden thinks that he can cut down pipelines and things that nature and we're just going to kind of We're going to go greener really soon, and that's going to help the or go with the price oil, But that's not going to help. Like I said, your listeners because they're going to be paying more at the pump. Well, at some point, obviously, we've got to let me tell people we will build refineries in the safest places we can find that are as far from Housing is can possibly be, But we're going to build them. The more stories of police killings of black people seem to be coming to light and pressure is now mounting for a new investigation. Into the death of Elijah McCain. It happened after an encounter with three officers last August in Aurora, Colorado. Go to the family. The district attorney investigating the case says that Elijah McClane dismissed the officers requests for him to stop. The 23 year olds family says he was just walking home. He was listening to music. When Aurora, Colorado police approached him last August, the D A. Says McLane was carrying a plastic bag when police tried to pat him down and he refused. He's then heard pleading with the police as they tackle him and use a choke hold on him. Paramedics later arrived at the scene. A medic gave McClane ketamine to sedate him. McLane was taken to the hospital. Three days later, he was pronounced brain dead. 10 months after McLane's death, more than two million people have signed a petition calling on Colorado officials to fire the three officers involved. So far, the Aurora Police Department has declined. CBS News is request for comment. Dave Young is the one who decided not to charge the officers were the actions of the officers justified legally.
