Comparing the impeachment trials of President Clinton and President Trump

"Right now on Capitol Hill ahead of the one PM eastern resumption of the Senate impeachment trial of president trump some Senate Republicans are holding a news conference led by Lindsey Graham South Carolina chair of the Judiciary Committee thank you all very much observations about yesterday it was a long day but that's okay a lot of Americans have long days a couple things I've been involved into impeachment trials this is the second one I just want to make an observation here what the house managers were proposing yesterday is basically destroy the institution of the presidency as we know it make it make it when it comes to the partisan impeachment not have a venue to go to court and litigate privileges at the end of an exercise our prior presence when it comes to Donald Trump willing to destroy the institution of the office in the name of getting him so bottom line the Clinton impeachment was conducted by outside counsel there's not here Ken Starr spent five years investigating the president before we took up the matter in the house the president was allowed to cross examining Ken Starr at the house Judiciary Committee he recommended eleven grounds for impeachment and president Clinton utilize the court's extensively on his behalf Robert Mull was an outside counsel appointed to investigate this press I want the public to note that this president cooperated with Mister Miller he turned over million documents his lawyer testified for thirty hours and after two years of investigation with nineteen lawyers forty F. B. I. agents two thousand subpoenas and five hundred search warrants they decided to take no action they said there was no collusion between the trump campaign and the Russian government when it came to obstruction of justice they did not recommend any action I thought that would be the end of actually introduce legislation to say that Robert Muller cannot be removed accept the call because the president felt like the motor investigation was of which I did not the present was frustrated because he said he did nothing wrong I can understand that but it was important for me to make sure that the country would have somebody to look at these allegations Ross are very serious and I supported Mahler's ability to look any work for a long time and I thought it would be over Mr Shipp said yesterday what they did in the house was just like what we did with Clint that is absolutely untrue from the time they authorized impeachment it took forty eight days not two years with Mahler not five years like Clint the forty eight days the fact finding process was done in the Intel committee now the Judiciary Committee the present was denied the right to cancel the Intel committee and could not request with they spent one day in the Judiciary Committee go back and look at the tapes of how long can start testified before the Senate excuse me the house Judiciary Committee of which I was a far what we've done for the first time in American history isn't Peter president without outside counsel and all in a forty eight day period well here's what struck me the most where the house manager said reason we didn't go to court we don't want to go through the courts is that we can engage in before the election they withdrew from the Cumberland cover of the dead the national security adviser case where the dead the national security adviser what course to tell me what to do judge the house actually withdrew the subpoena because they didn't want the court process to stop the impeachment trial they would have the United States Senate create an impeachment process where the president would not be allowed to go to article three court to argue privileges that have been argued in every other impeachment trial and have been argued by president since George Washington that would destroy the institution of the presidency as we know it what would it do it would allow a handful any three hundred plus million country people all along partisan lines ten PH a president without independent judiciary the before I came here I used to try cases we have a lot of good lawyers in this body all I can say is that when the court date was set and if I showed up and asked for a bunch of subpoenas and documents to be produced on the day of trial that I had not pursued before the trial in any serious way how to get tossed out what do we do yesterday exactly what happened in the Clinton impeachment trial we're going to hear the house's gate the president's response we're going to ask questions then we'll decide among ourselves do we want to know anything yesterday was about eleven hours of them telling us how bad their case was in my view they did not pursue these witnesses because they knew the president what's the judiciary very us and it literally would stop them impeaching him before the election so the only thing I can tell the American people when it comes to replacing those present nine months plus from the election you got an up hill battle with me because I really do believe that the best person group of people to pick a president are the voters not a bunch of partisan politicians senator Lindsey Graham every day we're here doing this is a day were taken away from doing things that really matter so when they say it was like Clinton no when they say the court's really have no place in impeachment that's all going to be done by the house and the Senate without any independent judicial review god help us all center Steve Daines of Montana we had a lot of time last night thank some twelve hours on the floor of the US Senate is the first impeachment trial I've been through senator Graham is the experience that is his prior political life it reminded me of when I went to high school in Bozeman Montana if I turned in a term paper he was half complete my teacher toss it back to me they didn't get it done is incomplete probably give it up and say it's a complete try yeah that's why I felt like we saw last night was an incomplete case I have not done a complete homework you're my enemy what Nancy posted back in two thousand ten on the Obama care is that first we got a pass to find out was it it feels like what happened last night they had a rush this through the house just get over to the Senate we'll find out what's really in try to fix a fair let me remind you remind all of us in two hundred forty four years of history of this great country United States Senate has never remove a president from office never you look at the two trials for presence but we have had in the Senate over the course of our history President Johnson eighteen sixty of course president Clinton nineteen ninety nine what's unique about this impeachment trial versus the other two the other two both had crimes alleged in the impeachment articles president trump does not the other two impeachment trials had bipartisan support coming out of the house president trump impeachment coming out of the house did not first time I've ever seen there were many things that I agreed with with with a German never said last night but he did say some and I hope everybody hurts actually back to the Clinton days was it and I will paraphrase it and god help us if we ever purely partisan basis numbers work back then were wives and I hope you would see them today this is the most hardest impeachment process ever seen a history of this great country no crimes alleged in the trunk articles not bipartisan in a very important final point is if you look for the Democrats are asking United States Senate to do is to remove president trump from office and to bar him from ever holding office again was also unique about this trial versus president when this is done in an election it's really big the fundamental question as well is to the United States Senate the side the two thousand twenty election and overturn a two thousand sixteen election by removing this president from office I put the trust in the voters of this country they should have that say not the nicest

"Lawyers Mr Shipp I just felt maybe I'll take a shot at this here goes thank you senators Mister Chief Justice house managers in the president's legal team we are here today not to defend the constitution against the present United States the defend the constitution from the house managers to the house managers for chairman of two of the so called impeachment committees in the house of representatives Mr Schiff you know well was chairman the house intelligence committee Mister Nadler was chairman of the house Judiciary Committee and they come here before the United States Senate a hundred senators three hundred million Americans the Chief Justice of the United States and they say with the with the service to prove our case and if we don't go with this it's a cover up it's a shame we need a fair impartial process the United States constitution could not be clear the framers could not have been clear after debating at lance the impeachment clause of the constitution they came up with very specific language what the house can do if it seeks to impeach a president the house is limited in what it can do to start the process of removing a president of the United States treason bribery or other high crimes and misdemeanors as I stand here before you today they have presented no information on treason no information on bribery those words don't even exist in their so called impeachment charges and other high crimes and misdemeanors meaning other offenses there are are as serious as treason and bribery where is it just tell us where's the treason where is the bribery what are the other high crimes and misdemeanors so what if they don't they amended the constitution of the United States illegally they changed the language and now they come before the United States Senate and say if you don't accept their narrative if you don't expect except their impeachment charges then you know you know the United States Senate you're involved in a cover up your obstructing you are not doing justice it's kind upside down isn't no we're here to defend the constitution of the United States from the majority in the house of representatives and these managers there is no trees and bribe or other high crimes and misdemeanors that's why they come to you with obstruction of Congress obstruction of Congress the last time I checked this body is part of Congress the managers represent the majority in the house I say the majority in the house because they couldn't persuade a single Republican despite the diversity the Republican caucus not one to join them in their effort to remove a constitutionally duly elected president of the United States now what so it is one party in the house of representatives and they come into this body and they insist that you do what they would not do prove the case for treason bribery and other high crimes and misdemeanors they wanted to impeach the president of the United States to remove the president the United States for treason bribery and other high crimes and misdemeanors bottles they change the language to obstruction of Congress and abuse of power now we know the history of the impeachment clause of the constitution no thanks to Adam Schiff or Jerry Nadler or the Democrats in the house we know it because the histories written down most conclusively by James Madison he was actually at the constitutional convention and had the most active role in framing our constitution the number one Frank George Mason a great founding fathers who wrote the Virginia declaration of rights a few weeks before Jefferson drafted the declaration of independence he was at the constitutional convention throw out he suggested that a president could be impeached by the house from our ministration James Madison stood up and said Mallon ministration that means the house of representatives of the United States Senate remove a president United States basically over policy differences we can't have that because the president of the United States would then be answerable to kidnapped by if you will the house of representatives in the United States Senate we have three independent political parties the house of representatives doesn't have a limit of all power the house of representatives may be motivated by politics but this is a constitutional process and these managers to of all more chairman who control the whole process come into this body they don't have one argument that can make for treason bribery or other high crimes and misdemeanors they might seek to amend the constitution and they they demand that you helped to make their case they just voted what is their case they have no case they sat on it for weeks before they sent it to the nine state Senate they come up with conflicting arguments we have to remove the president quickly because of national security concerns any night anyway corrupt the next election then they sit on then they come in here and say slow down we want witnesses we want evidence we want this is about the constitution of the United States not with the majority party in the house of representatives demands their iron fist control in the house of representatives and they used and now they come over here and see the lecture you the United States Senate on what witnesses who can go they don't want all witnesses here they only want their witnesses here they don't want hunter Biden even though they say the present United States sought Ukraine's interference in the twenty twenty election ladies and gentleman read the transcript of the president's phone call he didn't seek Ukraine's interference in anything anymore than you sought Russia's interference in anything he didn't see anybody's interference in anything he wanted to know if the binds participated in corrupt practices why should they be immune why should they be the bubble family where only the trump family's investigated with endless a **** with a special counsel with all kinds of of power thrown at the president he can be investigated in fact this entire impeachment is intended to immunize the bind so you could never raise any questions about the to affect the twenty twenty election which is why it's time the way it has been and they continue to attack the credibility of the twenty sixteen election how do we know this they have no evidence of treason bribery and other high crimes and misdemeanors so they changed the bar they lowered Taylor now let's talk about what these managers what these manage your hand picked by Nancy Pelosi the speaker of the house did when they were running the house of representatives in these committees they talk about transparency well when they held testimony sworn testimony of witnesses in the basement of the house of representatives in the skin league transcripts to the media cherry picked information some of the transcripts still haven't been released in fall in order to determine the witness that would best fits their narrative was at transparent when they did not the Republican store right to call their witnesses including the so called whistle blower including the chief house manager was that transparency when the president the United States the target other Rappler impeachment wasn't able to have his counsel present during any of this process in the house intelligence committee to present witnesses to cross examine witnesses to present evidence in that phase in that impeachment was that transparency when the house Judiciary Committee talk with the house intelligence committee did I regard to tape and had two hearings one with four law professors and one with the lawyers representing both sides of the house intelligence committee was that really a serious impeachment inquiry ladies and gentleman they couldn't get one Republican go along so the president I'd states was denied the due process that was afforded Richard Nixon he was a diet the read the denied the due process I was afforded Bill Clinton he was even denied the due process that was afforded Andrew Johnson who was so shabbily treated during the impeachment back in the eighteen sixties and everybody agrees that that was an outrageous impeachment now what is the role of the Senate you've heard you've heard from the house managers who can't even get the role of the house right who can't even get the constitution's language right you've heard them tell you your role is to have a real trial with witnesses and evidence but only the witnesses they one and only the evidence they want and they want to send it to lower itself to get information thrown over the transom at the eleventh hour by Ukrainian national less harness there's been indicted on multiple felony counts in the Southern District of New York they insist that you listen to him they want you to take the testimony of the president's former National Security Council his chief of staff among others and I want to break this down very carefully so can be understood by all all right let's stop here we're taking a short break and we'll pick it up this is my opening statement to the Senate if I had an opening statement to make to the Senate but really to the American people as many as possible out the farce it's taking place as a result of what the farce look like in the house of representatives on impeachment I hope you'll stick "Comments and more questions from Capitol Hill reporters congressman Adam Schiff Democrat of California chair of the house intelligence committee following it was a closed door session involving Kurt Volker one of a series of closed door sessions this week as house Democrats trying to gather more information on the president Ukraine and as well as China meanwhile Republican Jim Jordan Ohio also speaking to reporters before that closed door session concluded. what I would just say this with Bob first of all ambassador Volker unbelievably knowledgeable about what was going on Ukraine just a true professional in our diplomatic corps but not wanting his sad comports with any of the Democrats in peace the narrative not one thing but I will say this the process Mr Schiff is set up. Mr Shipp was going to try to limit members from even asking questions when we started today's interview the fact that he won't let agency counsel state department counsel participate I participated in many of us have mark and I with the oversight committee have participated in countless number of transcribed interviews we've never. ever had an occasion where agency counsel was not allowed to participate where there were limitations put on our staff who can be there to assist in the interview and we've never seen a chairman suggests that members are allowed to ask questions so if this is not Mr Schiff is going to conduct these type of interviews in the future that's a concern as well but investors Volcker has been very impressive in as I said has said nothing that nothing that coincides with what the Democrats are saying with their whole impeachment..
