"To keep out the mob. Tomorrow is a six month. Mark six months since the worst attack on american democracy arguably probably since the civil war. And it's still not over of course continues to rest in charge more and more people by the day scott mcfarland's investigator reporter for nbc four in washington. He's been following all the details of these cases and he joins me now. I'm scott let's start with the former police officer roberson and his case a sort of remarkable brief. I have to say by his defense attorneys. who again. It's their job to advocate for their client. But i'm not quite sure the judge is gonna buy it. It's striking crisper. A few different reasons first of all his defense lawyer in this new filing is arguing mr robertson. There's no evidence. He had the guns that he did have the guns antique guns. because he's an antique gun hobbyists. Put those specifics aside. Here's where we are six months after the insurrection so many back and forth arguments brin defendants and prosecutors over whether just simply be held in jail pending trial trial itself. That's a long ways off the first major trial to be scheduled so far in this insurrection. Chris is the accused oath keepers group. The trial date is late january. Twenty twenty two. I think year after the insurrections worth mentioning some of the defendants in that case are being held in jail pretrial which means they'll have served a year in jail just to get to the trial date the basic point here chris. We're closer to the starting line then to the finishing line of most of these cases. Yeah it's a really good point and we you know i've talked about this before the sheer volume and the capacity issues that are straining against that one basically. Dc office is dealing with it. You mentioned the oath keepers. I think judges seems to me. The vast majority of folks that have been apprehended have been released. Pretrial some have not like the oath keepers and one of the things that comes through in that new york times video is is how key us relatively small sort of vanguard of very coordinated folks were to these key moments of breaching the outer perimeter the inside of the capital. In january judd released robertson pending trial on the condition. He could not own any firearms or other weapons. Well is later. Authorities found eight firearms at his home but the judge decided to give him a second chance. Now prosecutors are asking the judge to revoke robertson's release saying he has once again violated those same conditions by and i quote here possessing a loaded him for rifle and a partially assembled pipe bomb at his home and by purchasing an arsenal of thirty four firearms online they say robertson also tried to hide the transactions indicating the payments on venema. Were for wedding photos yesterday. Robertson's lawyers responded prosecutors. Be a truly special defense. That reason part quote. Mr robertson was an antique gun. Lover served his country honorably in the guns. He allegedly purchased but did not possess where antique guns from the world. Well luckily it was only thirty minutes away so she said you get out here on the interstate. And i was like this. Phone is taking me to the wrong place. Well the computers is a what lad to me a lot and i was already laid. I was tired of this trip supposed to eight hours. It took twelve. Or so. "Voters wants very popular idea. It's very popular to seal up our border and restrict immigration on the right. It's even popular in parts of the democratic party. Federal government can't be bothered to do that is they're too busy trying to suppress election audits. We'll get into this a little bit later later on in the week or next week. But there is this audit going on in arizona right now to oversee the twenty twenty election to look at some of the irregularities. Let's say and now. All of a sudden merrick garland and the doj are really concerned about this. They say that they're going to be overseeing the audit you're going to say that there is. There are already complaining that some of the audit has is utilizing normal post-election methodologies. They weren't concerned about the abnormal in some cases unconstitutional methodologies in states during the twenty twenty election but now they're really concerned about the audit. I've never thought that the audit would result in very much as a political matter. I do think that there was obviously Some fraud shenanigans in this election. There's fraud in every single election. It seems like in this one. They took away in the months preceding basically all of the election integrity measures and the the excuse was cove it but but i suspect there was probably more fraud than usual and the election. I don't think the audit is going to get very much. The fact that garland is so concerned about is the first thing that tells me That's a little weird now. i now. I really want to pay attention in a way that i had not not been paying all that much attention before there. Signaling a concern at the federal level here speaking speaking of that election and federal accountability. Actually babbitt ashley. Abbott was the one person killed in the violence of the capital riot in january. She was killed. She was a trump supporter. She was killed in the capital by A capital police officer. Actually husband is calling for the name of that cop. Mr robertson me ask you. There have been reports online. Seem credible. I don't know if they're true that the capitol hill police officer. Who shot ashley. But i'm not gonna mention. The name was the same officer who left his loaded handgun in public. Men's room on the capital. Do you believe that is the same officer. Seems a very reckless person. Who shot and killed ashley. Babbitt on january. Sixth that's that's my belief. I believe so if it turns out that she was shot for reasons again. They still haven't explained to us by a capital police officer who left. He loaded handgun in public men's room and kept his job somehow. Do you think maybe that's why they're hiding density. I don't know but i think One of the reasons. Why there is a dentist is they. Don't have a good explanation for this shooting now. The the congress voting to give metals to the capitol police who who kept down the riot that day we all know and they're they're trying to shame republicans. Don't do it all. Know that. If ashley babbitt had been. Blm rioter the sorts of riders who turned down government and private buildings for six months in two thousand twenty. If ashley babbitt had as blm writer there would be a federal investigation into this. That cops life would be absolutely. We would know the name that cops life would be destroyed. The capitol police would not be getting. They would all be ready and shipped to guantanamo bay if many democrats had their way. But but that's not. What happened. Because ashley abbott was a conservative. They're now asking for a no information given here and for everybody to go about their mary way. They want republicans to go along with this. "Who knows? Maybe some court case can come out of the blue. Maybe don't turn things around. I don't know. I don't believe that's gonna be true. And neither does Pat Robertson anymore. But I'm always concerned when I hear people describe what might be their own personal opinion to what God wants. I mean, Yeah, I heard him say this. I said well from your mouth to God's ear, I guess because that's actually what I think happened. In this particular case. It's uh, I want to get not making fun of Pat Robertson. I've met the man once years ago, back when he was running for president in 88. Seem like a decent enough guy. But I always get concerned. When I hear people say that God told him that this is what's going to happen. And then when it doesn't it doesn't happen. You have to ask yourself this question. Who were they really talking to? Where they talking to themselves? Where they wishfully thinking and applying God's name to it. Have a feeling one day God's going to say we'll hear all the things people said that I was for and against and said and didn't say, I don't know. I've never said any of it. Well, and I guess the good part of that is maybe we won't have to deal with the civil unrest like we've never seen before. Is Mr Robertson said would happen. Maybe that won't happen. Laundry.
