I believe that one of the most effective expressions of calling in is forgiveness and the most powerful example of radical forgiveness. I've ever seen happened after the twenty fifteen church massacre in charleston south carolina where nine people were killed and one of the victims funds. Chris singleton offered his mother's killer. I mean his mother's killer forgiveness. And i can't get his words exactly right but chris basically said forgiveness is more powerful than people realize because it lifts all of this stuff after you is freedom freedom from revenge freedom from anger freedom for patriot. Sadly he was called out for saying that. I believe that it's very possible to use these strategy. So i'm gonna tell you about my uncle frac- he ain't really my uncle but he's still living so i can't call him out anyway. Most people buried their faces in their plate. This was uncle frank. This is what he does. But i decided to respond but not with anger. I kinda organized a few comments and ask them a question uncle. Frank i know you. I love you. I respect you. And when i know about she was that you'd run into a burning building and save somebody if you could and you wouldn't care what race type person is. You wouldn't care whether they were gay or an immigrant. So uncle frank dust a man. I love and respect so tell me. How can i reconcile that. Good uncle frank. I know you are with the worst. It just came out of your mouth. You haven't called them in. You haven't called him out. You called on him to decide how is going to be and with this approach. He's less likely to become defensive. Because you haven't actually attacked him and while he's organizing what to say you've affirmed that he has options about how he wants to be especially in his thesis is and it's families is but most importantly the third thing you've achieved is that you did not let his bigotry go unchallenged and that was a witness by the entire family. How you stand up to bigotry and a family reunion without. Hey argument and throwing over the table now. Anybody can learn these tactics. As i've said and we really need to understand that we can offer people forgiveness and a chance to redeem themselves from their mistakes. he's proposed reforms of the mortgage lending market reducing regulatory hurdles to urban housing construction he's he's argue that we should get rid of those awful public housing prisons altogether that'll never happen and you want it never happened because that's how the political elite steak impact for housing authorities are political patronage urban renewal playgroups political patronage in places like Denver and Chicago the Minneapolis Los Angeles Dallas all those people stay in power through patronage and through unions and do you think they want to make a change no they do not but hinder you talk about taking a sledgehammer listen to this you know black parents love charter schools and vouchers supported private schools because charter schools and vouchers supported private "To the show good morning you've actually got some news that you came in with this one and I was not aware of so what we start with that the scan interesting yeah it's on the heels of the Equifax situation that occurred with the king to the breach and you know I I suppose the continuing breaches that are continuing can that are occurring on a fairly routine basis with you know the stores and and entities that you sign up with the house of representatives the United States Congress house of representatives have made credit freezes for you for the public the still obviously has to go through the balance of Congress at the federal level but it it looks like this is something that's on its way to passing and before in order to do this you would need to to pay between two dollars and ten dollars based upon which state you're in although some of them you know it may have done it for you for free but the nice thing is is that if you do it online or the phone over the phone once this gets passed then you within one business day your credit will be frozen and that will protect you from having new things happen to your credit wise if you do by mail there's a three business day on the tail end of receipt of that mail and and even with that being said we know that the credit bureaus are delaying the receipt of their store and experience in particular is read read delaying the receipt but you only have to freeze one bear I believe it's the same way as the fraud alert we only have to freeze it with one bureau and then the other those bureaus notify the other bureaus okay so here's the interesting thing about this this this is something that should happen long time with it for that breach happened in in August I think so I believe in the second the eighth or ninth or something of August the reality is is that two thirds of the country were potentially exposed it just came out last week that now passports because some people use passports were breached as part of this process yeah and now here we are in may and and and it's just getting done now and by the way Equifax was awarded about a truck truck with the IRS after post the breach being in the house only seven million Bucks it's a dusting dusting all right you are in the habit of bringing all kinds of fantastic material of the table today is no exception we're gonna talk about statutory violations and an issue involving a company called LV NV funding which is again nothing to do with Las Vegas it's just a national collection agency that just happens to be their name right so they or attempting to collect debts on on credit card debt and there's a there's an agency called the debtors legal clinic is a nonprofit service organization that helps out the elderly or the poor because certain kinds of assets are excluded from collection process in the debtors legal clinic would say you know by the way we dispute the debt but even if the debt were validated then here's the reasons why you can't collect against these people and you know so you've got this the these debt collection companies in there there were a few cases at issue here they're all kind of got consolidated into this in into this battery of cases that have the same kind of line of reasoning on them and the the critical things are good Jed was never reported as being disputed and that's a big no no it's an automatic violation under the fair debt collection practices act and the reason this matters to people is that if I dispute the nature of the debt it's amount whether it's my account and all then in the credit bureaus should be reporting out so the people that I might want to borrow from can recognize that fact right the other thing too is that all collection activity must stop during this period of time correct right soon as you say that to a collector yes everything ceases right so this this particular company they decided it's it's and this one was not L. the envy was P. R. A. but portfolio recovery strategies yeah but they wound up not notifying the credit beers of the dispute not basically processing the validation requests this is an automatic thing the court concluded that if you if if the company the debt collection company fails to report the dead is disputed that's a material issue it creates a violation and creates the the protection for the consumers out there you will routinely go after companies by the way that they don't mark an item is in dispute it may seem simple to folks that are listening but if a consumer sends a dispute in and then thirty days later it doesn't show on the credit reports of the items listed in dispute you'll you'll take that federal court correct in the tail end of that is for the people if you disputed or if they come to you and you've disputed obviously you're gonna be watching that calendar and and so would we button follow up on that and make sure that the dispute has been registered that you're seeing it pop up on your credit or that you've got some confirmation from the debt collector that says yes we acknowledge your your validity request and we're gonna go ahead and process and sees collection activity right now yes so if you are consumer you've disputed something we actually excuse me we just got a great case from someone this week I have that right I didn't waste any time Mr hinder the right off to you because the consumer knew exactly was right where he sent the dispute note he had paid a bill this is a one of the Big Five banks he paid a collection on it settled the debt with them they gave him some terms he paid it out immediately that was settled in you know in October something of last year and then you know three months ago he wrote them a letter and say Hey you're you're indicating that this debt is still owed to you but I paid it and it never got marked in dispute never got nothing ever got corrected he said everything the entire packet certified mail receipts the letter all that stuff it's just a great idea to stay organized so that if this happens the law firm can jump in it would take you now to file a case ten days or twenty days or something no we could have a case filed within wrote probably no longer than a week's time depending on on what the kind of of of the issue is but it it and and there may be you know we may want to notify the debt collection agency in advance their yeah they've got a problem and it may be resolved without filing a lawsuit who knows Eric fox cover law each week at this time your here and provide a whole lot of great information and and content this next story is weird we had to discuss this for a few minutes it's kind of remedial credit for for me as as you were walking me through the story this is kind of an interesting situation involving a hospital in an agency that's outside the hospital that's pushing people to pay their bills but they're not actually taking payment and they're not really a collection agency per se in their own mind yeah it depends on what the definition of is is well there you go yes there was and as you indicated there was a hospital and they had I mean the the most common form of debt we have here in the United States is medical debt that's what he's most people into bankruptcy right yes the you know and naturally some some people of all from from the hospital with bills and this company she she I would administer the efforts of debt collection on behalf of the hospital although they didn't have authority to settle anything they couldn't take payments they couldn't do anything they were acting as a debt collector but not not a debt collector in practice and what the they tried to get out from underneath the claim that they were acting in a false and misleading way under the federal debt collection practices act by age going into what the definition of a debt collector is the ninth circuit our court system said no no no you're doing everything that gives the impression that you're acting like a debt collector you're dealing with the the people you're sending out letters without approval you're doing all the things but for accepting payment essentially I wonder if the debt collector letter had any of the language that is supposed to have in there I think you know that's an interesting question and it wasn't part of the of the dialogue from the case but it would be an interesting thing did they put this you know is an attempt to collect a debt you know any information will be used for that purpose any of that my suspicion is no because that's a requirement of the FDCPA and ever that's released to third parties and if they viewed themselves as not a debt collector then I would bet that the probably that language wasn't included that that would have been an additional violation the court ultimately ended up coming down on them saying listen you're actually your repair freezing you're reaching out to these consumers and you're telling them that they have this that and you're pushing them to pay it even though you're not taking it your you are kind of a debt collector anyway right absolutely one hundred percent and it was you know they they try to at an early stage of the day the CCI company to get out from underneath these claims in courts socked him down and said no thank you I would imagine if you had them in a deposition the the one of the first questions would be to them how do you get paid by peace health right what what what do you pay based upon any it's you you're absolutely right and what do you want to bet it's a percentage of the money that comes in the door to the hospital right which basically means they're profiting on the deaths and right they deposit that collector right I should have gotten a lot I should I should do should then we'll have to go to law school coulda shoulda woulda so this is kind of interesting case I wonder if you had alluded to the fact that you you you settled I bet we see more this moving forward yeah I well you know is this area of law is expanding it I've been flows a little bit and you know did you see a persistent effort on behalf of debt collectors to try and shield themselves or try and skirt could be discouraged the gray line about what they can do what they call fire eyes and it's nice to see the court looking through these issues and and really honing in on what are you doing if you're doing things that look like and smell like debt collection then you're going to be accountable under the statute here looks like a duck quacks like a duck yeah it's a duck it's pretty interesting to work to see this happen I think you know and we've got two or three minutes here at in in the last part of the show and I think it you know just just basic you know a basic discussion about what folks should do when they're called by.
