I have been listening since the early days muller she wrote and i am indebted to all of you. Wonderful ladies for what you've done for me through Through this podcast. This is a bit of an overview of a decades long story. But i hope you'll bear with me right out of high school. I joined the air force in june. Two thousand one to serve and protect this country with the hopes of eventually retiring after full twenty years of service however i made the decision to exit the military in two thousand seven for what i interpreted at the time. As not wanting to move forward with that career i have since graduated with my phd. During at nineteen shutdown then moved states to start a new position as a postdoctoral scientists then spent most of the past year alone in my apartment in a new city with no friends family or even co workers to converse with on a regular basis. Who tough needless to say. It's been a rough year. Plus for all of us. But i didn't handle it as well as i had expected. I spent way too much time alone. Contemplating life choices questioning my current predicament. Coming to the slow realization that i had high levels of stress and anxiety. My imposter syndrome was running. Full tilt and i started having anxiety attacks a new experience for me. I normally address my issues with time and logically thinking my way through them. That wasn't working anymore. It was during this time that my lab started having monthly discussions about diversity and inclusion in our lab. The topic is extremely important to all of us here. And we've covered topics like celebrating black scientists past and present sexual harassment increasing diversity and science women scientists etc. We had two sessions to watch and discuss the documentary picture. A scientist which. I hope you and your listeners. Take a moment to watch at the same time. The daily beans has covered many of these same topics. And you all have been very open about your life experiences. All of these discussions have made me realize my life choices. My experiences might interactions with others. Then i listened to your episode on july fifteenth with elizabeth mclaughlin while getting ready for work her message that shame festers in silence that we should not be ashamed of our past and being open about our life. Experiences was the last strike. I needed to break down my emotional stonewall. Everything they'd been swimming around in my brain from these recent discussions in the past few years finally coalesced into a clear picture. The assault in the military. That got blamed for that. I had been labeled an adulterer and received an l. o. r. for because at the time it was punishable under military code. That assault ruined my marriage and turned my husband into an emotionally abusive man. I realized how much gas lighting had been done to convince me that it had been my choice to be taken advantage of while intoxicated. The shame i felt going to work every day believing. I was a terrible person. I left the military. Because i could no longer bear. The shame placed upon me and didn't feel worthy of the position. This is the reason. I got angry when people don't believe that assaults harassments happen. This is the reason. I'm so protective of my colleagues. And my friends. I realized that i to no longer had to carry this experience around in silence to paraphrase elizabeth. Needless to say. I was a complete mess as i went to work. That morning immediately broke down in front of my professor who took me on a walk outside to chat. I finally admitted to myself out loud. What had happened to me and he was more than willing to sit and listen and be there to support me. All of this is to say. Thank you to all of you at the daily beans for being brave enough to discuss these topics so openly and frequently and to elizabeth for speaking with so much strength employs. Not all of us are immediately ready to accept our own realities despite being able to acknowledge when it happens to others but with enough time reflection and support from our communities like the daily beans. We can begin to heal. I realized this is not something. I can handle on my own scheduled. My first official therapy session was a huge step for me. And i'm looking forward to finally moving forward and confidence of who i am without you all in the discussions at my lab. I would still be living that lie. So thank you so much for everything. "The department of justice will not represent mo brooks in the lawsuit filed by eric swale against him for instigating the attack on the capital. Which is what the complaint alleges and joining me to discuss. This is author of the watergate. Girl at fantastic incredible book and of course watergate prosecutor. Joe wind banks. Hi jill. hi thank you so much for letting me talk about this wonderful news. It's such a relief to me. Because i was so worried because of what happened with the aging carroll case and what happened earlier today with the pompeo case that pompeo was acting within the scope of his duties when he decided to stop letting the state department take care of someone's legal fees in the first impeachment. But this decision twenty. Nine page decision is full of really interesting information. Yes and i think that there is some logic to saying that peyot was acting in the scope of his job. There is none for saying that mo brooks or donald trump were acting in the scope of their jobs in inciting riots. At just is not a part of any federal employees job and the opinion actually does have some extra language. They're not just that mo brooks wasn't acting in the scope of his job but no federal employees would be acting in the sculpture. Their job seems to make clear message to donald trump. If you're going to apply to us to represent you we're not gonna do it yet. And i think that a couple of things here that i wanted to talk to you about because the initial reason for the department of justice to have this dismissed the certification dismissed is that mo brooks speech amounts to a campaign rally which is outside the scope of his duty but they go on to say but if the court doesn't agree with that and they do all the case citations. It's also very important to note that incitation the complaint from swallow alleges he conspired to instigate the attack on the capital and that is well with outside the scope of his duties. As a congressman. In fact it's kind of the opposite. And they said it would be incumbent upon mr brooks to prove in this case that he did not incite the coup basically and. I think that that's absolutely fascinating. They also mentioned. Were investigating this too. So this is an indication now. Isn't it that the department of justice is investigating some of these members of congress. It is an as you said in the beginning. This gives me new hope. Because i was. I am that i was but i still am frustrated by the decision that there is any possibility that donald trump was acting in the scope of his responsibilities as president of the united states. In defaming. A person who claims that she was raped by him and i. I don't see that. I don't see the argument that justifies that being considered part of his job. Yes it's part of his job to answer questions. It's part of his job to have press conferences but it is not part of his job. Y to the american people is not part of his job to defame a person who claims to have been wrong by him. Yeah and if if the logic in this particular document it should apply to that as well. And i don't understand how they could make those two decisions exclusively from different from one another because if you take the same logic and say all right. It wasn't a campaign situation. What he was talking about aging carol but that language is definitely outside of the scope of his duties as as president as this is a personal matter which they mentioned that. The verbiage personal matter when applied to campaign stuff comes in into into context within this decision about mo brooks why it doesn't apply to aging carol. I cannot understand. i'm disappointed that the department of justice decided to continue representing the president. Based on what the department of justice under donald trump had decided. It seems to me. It would have been a very good opportunity. For the attorney. General garland to make a clean break from william bar and the department of justice under trump and to have said there are certain things that are right. And we're gonna follow those. So i'm not i i really don't see the logical differentiation. I think this is the right decision right now. In the mo brooks case and and it would have been equally right at the time of the carapace. Yeah it almost makes. It seem like the only reason they stayed on the agent carol cases because a previous corrupt department of justice made that decision and they just wanted to continue with that decision. But that doesn't feel like the right thing to do. And and and i'm i'm gonna go ahead and say that it's not i i would love to have someone ask for that distinction to be made and it may be something that will happen in this trial in this court. It may come up of the right decision was reached here. Maybe it'll come up another point in an appeal of the decision in the carroll case. That's possible but i think she's being wronged in this situation because a your your listeners should know it's not just a question of who pays for the lawyer that's not i mean that's important issue Lawyers are expensive. I i get that. But it's also that if you substitute the department of justice as the defendant is really first of all no accountability for the individual. Did the wrong act. And secondly there's immunity for most government actors so people who act in the scope of their duties cannot be sued so therefore that kills the case. So it's not just who represents you. It's if they prevail in representing you. They also prevail in saying. You can't sue because we haven't waived our sovereign immunity and therefore you can't sue so it's it is the end of the case if it prevails. Why it's so important. I agree and one more question for you before. I let you go here. You pointed out the language that there are others anyone no one can say that this is part of their job and there is.

"America. It is as for officers. We would do january six. All over again wouldn't stay home because we knew it was going to happen. It would show up. That's courageous as a roic. So what i ask from you all is to get to the bottom of what happened and that includes like i echo the sentiments of all of the other officers sitting here. I use an analogy to describe what. I want as a hitman. If a hitman is hired and he kills somebody hit man goes to jail but not only. Does the hitman go to jail but the person who hired them does there was an attack carried out january six and a hit man. Sent an wants you to get to the bottom of. I encourage everybody to watch the hearings today in full they you can find them on youtube Very very powerful today and the heart to watch it through us all right back to where we were on january. Sixth i i will never forget it. I woke up in the morning. I was so happy. Because i had stayed up late the night before. Watching ossoff and warnock flip. The senate blew and woke up in the morning got coffee. I was on cloud nine. We won the election. We won the senate. And i said okay. Just one thing left. We just have to certify the results and then we all watched what happened on television. It's gonna be a very important that these hearings continue. And i'm i'm sure as i've i've said before that dino that there's some brilliant lawyers on this committee who are working closely with the department of justice to make sure that what they're doing in congress in the select committee on one six does not interfere with the criminal investigation into the insurrection. Everybody will be right back with joe. Wind banks stay with us. Hey everybody it's ag from the beans. Summer is heating up. People are rushing to get outside and back to normal and i feel like after a longtime in isolation it's overwhelming with everybody slam together again trying to catch up for lost time so when i get stressed out with socializing which i do now i go back to my favorite game during social distancing and that's best scenes i take it everywhere and it puts the world on pause it makes me feel like all the stress and my worries disappear since i started playing best fans. I do not want to stop. i am on level. Twenty one twenty to forty now..

"Let's hit the hotness hot notes. alright lead story. Today is the insurrection. Hearing but i'm gonna go over that like i said in its own segment a little bit later in the show so right now i want to discuss a couple of decisions coming out of the department of justice today. Of course we're waiting for that. Big one but garland actually formally declined today to assert executive privilege for potential testimony of at least some witnesses related to the january. Six insurrection include. That's according sark and that's including. That's from a person who was briefed on the matter. This decision paves the way for former justice. Department officials to testify on what they witnessed in chaotic days between donald trump's november election loss and early january when he tried to use the justice department and other means to advance false claims that he won among potential witnesses as you asked for which special select committee investigating the january six directors expected to seek testimony. Are jeffrey rosen. Who was the acting attorney. General in late. December and until the inauguration of joe biden rosen and other justice officials were at the center of pressure campaign by trump and the other white house officials to back his claims of vote fraud. The false claims of vote fraud frustrated that the justice department didn't find evidence of fraud trump contemplated replacing rosary rose with joseph news. Ne- rosary yeah. Mary's and that's exactly what it was. It was a hail mary to try. And fix the buck problem with jeffrey mark. Nice so now. I have to leave that mistake in the podcast. These wonderful wonderful segue there. But this is you know the campaign pressure the pressure that trump put onto the justice department about voter fraud and frustrated that they didn't find evidence. He wanted to replace. Rosen with jeffrey clark. Another justice department official who signalled support for the fraud. Claims rosen and a group of top justice officials prepared to resign. If clark were made acting attorney. General and the justice department's decision applies to former justice employees. Other potential witnesses that the committee may want to hear from such as former white house. Officials may be subject to different standards under executive privilege so this is just for department of justice officials in this is good. They're saying feel free to testify. They notified former officials in a letter. Monday saying you're free to provide unrestricted testimony and irrespective of of potential privilege. That's according to a copy of the letter reviewed by cnn. So that's absolutely the right call in another story. Garland has decided to give gordon sunlen. The jean carol treatment in that they have decided that secretary pompeo was acting within the scope of duties when he decided to pull state department payment of sun. Lindh's legal as member that yes that state department pompeo said we'll cover your legal fees. And then sunderland testified that there was a quid pro quo and they said we're not going to pay legal fees anymore. Well garland decided that that decision was within the scope of his duties. And i kind of agree with that. One i don't agree with the jin caroline but this one yeah seems like it's in the scope of his duties. We learned about an hour ago. That lawyers for the house of representatives house counsel doug letter will not represent mo brooks in the suit against him filed by biggies walls. Eric's wall well and that people were kind of confusing that with the department of justice. Decision that we don't have yet have that this next story at its. It's amazing and it happens throughout art history when civil rights leaders fight for what they know is right a lot of them a lot of them thirty nine people including reverend jesse jackson and william barber were among those arrested monday after refusing to leave the phoenix office of carson cinema. So she has faced unrelenting pressure. We've not we've seen this all over social media from liberal activists over her opposition to ending the filibuster into pass voting rights legislation. So jackson who is as we know one of the nation's most prominent civil rights leaders he said the us is in quote civilization crisis with battlelines drawn and he urges. He urged activists to fight nonviolently for their right and they've been doing this for decades and he said the powers and you the people and that was jackson so passing voting rights legislation. This is a top priority for congressional democrats and progressive activists who say it's essential to push back against state level efforts by republicans to impose new restrictions on voting. It's been stymied by the filibuster as we know which prevents democrats from passing most legislation without republican support. Which they don't seem to be giving a shit ton of these days. Several hundred activists marched about a mile from a park to cinemas office and phoenix's built more neighborhood chanting and the filibuster now eliminating the filibuster would open the door for democratic senators to enact voting rights bills and raise the federal minimum wage to fifteen dollars which needs to be done as well so those who who were arrested were actually cited for trespassing but they were released Phoenix police sergeant mercedes. Fortune said so they did get arrested with Were still fucking arresting. People voting rights. With the i mean their arrests eight will i mean they seem to be resting black people for less So we're still protesting voting rights. It's no it's ridiculous. It's absolutely ridiculous. Why do you have some good news. President joe biden will announce tomorrow a requirement that all federal employees and contractors. Somebody had asked me if the contractors were included yes and contractors be vaccinated against cove nineteen or be required to submit to regular testing and mitigation requirements. That's according to a source with direct knowledge. The announcement will come in. Remarks were biden is also expected to lay out a series of new steps including incentives new incentives in an attempt to spur new vaccinations as the delta variant spreads rapidly throughout the country. It will also follow the decision by the department of veterans affairs which we talked about yesterday to require their frontline. Healthcare workers be vaccinated over the course of the next two months. Now this new announcement will require that all. Va employees not just the frontline workers be vaccinated. And that's a huge agency that doubles the number of people that will be vaccinated in the. Va while the specifics are still being finalized. The source said federal workers would be required to attest to their vaccination status or submit to regular testing this source and fox. News goes off on this. Fuck them because they do this. Absolutely do this. The source said the proposal will be roughly similar to what's being implemented in new york city additional requirements for the unvaccinated could be added as agencies pushed to vaccinate their employees biden will not impose the requirement on the us military despite his authority to do so for the time being he is however likely to outline how the department of defense may seek to approach the issue going forward and to prevent further spread of the delta variant the us centers for disease control and prevention updated its mass guidance on tuesday to recommend.

No kidding and it's t three answer time Let's find out if i Successfully got back on the saddle. Or if i fell right back off. That horse are thomas. this was a hearsay question. This was a trial for extortion. Prosecutor calls a witness who had previously testified to the grand jury in her previous testimony so his expectation is that she was going to say. I heard the defendant threaten a man with physical harm unless he made payoffs but when she gets on the stand in front of the actual jury. She denied ever having heard the defendants make such threats even though she had previously testified to that effect before the grand jury the prosecutor now seeks to admit her. Grand jury testimony. How should the rule so first thomas versus the coin thomas. His second chance law firm eliminated a admit the testimony because it contains a statement by a party opponent could elimination. that's nonsense. The witness is not a party opponent. By definition right you also eliminated see. Admit the testimony of the under the former testimony exception to the hearsay rule. That's also a good elimination. And we're gonna talk specifically about that so it is indeed between be admit the testimony both for impeachment and for substantive reasons because the witness made the inconsistent statements under oath at a formal proceeding or d. exclude the testimony for its substantive use but by implication use it for impeachment because it is testimonial statement. And so you went with the coin went with be thomas i gotta tell you. This coin is is bridging. The gap here. It's be you were actually led a straight here by having too much legal knowledge. That's where the corn got me that it is a one hundred percent with gaga's gascoyne had no prior Legal knowledge you were thinking about this. As a prior inconsistent statement which again is correct which you use for impeachment but not for the substance thereof but remember that when you approach hearsay as a lawyer there are really the you really do like a three level now. Once you've decided that it's hearsay you three level analysis i is. You'll look at eight. Oh one and you see. Is this the kind of thing that would otherwise be hearsay. But we're going to define it as not hearsay for reasons and those are called exclusions and these are things that are again very very obviously hearsay. But they're just defined as not hearsay if it's not if it's not excluded. Then the question is is it a definitional hearsay. But does it fall. Under the exceptions the exceptions there are exceptions that apply under eight three when the witness whether the witnesses available or not or they're exceptions that apply only when the witnesses unavailable. I have to tell a witnesses. Prior testimony is defined as statements. That are not here. it's eight oh one d- and it says when the declare testifies and is subject to cross examination about prior statement and the statement is which is which is what she's giving on the stand now and the statement is inconsistent with the declared testimony and was given under penalty of perjury at a trial hearing or other proceeding or in a deposition. Okay so your in so you can always do this. Then basically if they are presently why did. I think that you had said you can bring it up for impeachment purposes but not to just get it on the record. I remember. that don't know you are remembering. You're remembering correctly because usually what you were doing with a with a witness where you are impeaching is you are using that prior inconsistent statement to cast doubt on the veracity of their current testimony And i don't care about the underlying substance of and testifying about. You're right that if you want to get the substance in and they are presently on the stand and being cross examined and they have they have previously given testimony under penalty of perjury in a deposition and it is inconsistent That that falls under exclusions from that in there. Yeah i guess i misunderstood. No i think this is an area where my my history in practice. That sort of conflicted right because think about it this way. It depends on what you as the trial attorney want to focus the fact finder that either the jury the judge what you went to focus their attention if you want to focus on the content itself then you know you might use this eight. Oh one d- rule but if what you want to say is you should not. You should impeach this witness. You should not believe anything they have to say. Then you want to just use it as a prior inconsistent statement. You don't want to focus on the content involved but but you. Are you absolutely. Remember me telling story. Because i have done that i have impeached with deposition testimony as a prior inconsistent statement. Yeah that's totally what i've remembered yet and not that was just me telling more stories not trying to go for the the substantive content of what the lawyer statement was. Yeah man that really led me astray. I'll try to remember the. Don't blame you. The coin got me this time..

A year would produce one hundred thousand dollars in wealth that doesn't take agai- takes a decade. But if you stick around and pay another decades worth the premiums and never dry any more benefits than you still. You may still wind up behind. I would say this might be your weakest argument andrew because the whole business of health insurance by definition would have to be this way otherwise it wouldn't be a business on average anyone contributing on average has to be contributing more than they're getting paid out otherwise it wouldn't be a bazillion dollar business. It just has to be so. I think it's more a matter of degree than merely the simple fact that like all right end up losing out in the long term so i agree with that and there's a similar objection that catherine actually made that i that i want to get to dinner. I want to compare it to investing the premiums. Only that you understand the the dollar value of the contributions coming in and going out because the spirit that animated this response and a half dozen like this that we got was you say it's a scam but quote. I'm ahead financially right yet. And so how do we figure out if you're ahead financial right and like the fact that they're massive problems with our healthcare industry at like you know you're a listener. You already know where we are on that right like that. What i'm trying to respond to is the argument of. Hey i did. This and i came out ahead. And the two responses are one individuals coming out ahead are like individuals beating the dealer and number two. Let's carefully calibrate what you're thinking of in terms of coming out ahead. So for example. We add another relatively unambiguous winner. Was that one. Random canon lawyer guy on the facebook group. That's how he wanted to be identified. Who was in for two years. His wife had two pregnancies. They paid five hundred dollars a month in fake premiums and they cashed out with twenty thousand dollars and benefit. Okay look if you can you get in for. Get some children. Then yeah you you might show up as a winner in this. But i contrast that with another face bookstore where the person was absolutely certain they had come out ahead and again. Remember it like look. This is a bad thing. The cost of an the average cost of an uncovered pregnancy is between five and ten thousand dollars right the medical expenses associated with an uncovered pregnancy. And that is an un discounted number remember. We talked about an episode for ninety seven. It is a condition of the healthcare sharing ministry. That you have to beg down your bill or they will begged down for you if they're in network right so i want describes him again. Don't take legal advice for a podcast. I'm not saying this. Good that the underlying social conditions of this way if you're uninsured and you get a seven thousand dollar pregnancy bill without an h. Csm you can probably beg that down. Get them to write off a portion of and get on a payment plan with the hospital. I will tell you. My wife did that at a time. Prior to when we were not buried and she was uninsured and she had a big hospital. Bill went to the emergency room and paid off in twenty five dollars a month installments while i was in law school until we got to the point where the hospital wrote off the balance of the bill So this is a thing that people do end. it is key. It is a cornerstone part of the h. Csm business right negotiate down the bill again. I i don't really see the problem there. But what i'm saying is if you are comparing the benefit to say seven thousand dollar pregnancy. I had a five hundred dollar deductible. So i got sixty five hundred dollars worth of benefits you did you probably got more like twenty five hundred dollars worth of benefits because you would have had to have done the same begging to bring the bill down without the hcf okay and that reduces the overall sort of value so you know we. We had a person right in and say yeah this is. I'm i'm doing great You know my premiums are a month. So that's that's ten thousand dollars a year and his wife had two pregnancies. There's a different person from dot. Louis came random canon lawyer got a third person and he defined his wife as having taken thirteen thousand dollars in benefits to seven thousand dollar pregnancies for five hundred dollars each. Well you take him at his word. If he's been a member of the ministry for more than sixteen months he's lost out the but again right. If you bring that to net present value is probably still not right. Probably the first one probably within that first year is still not sufficient. Because i will say to you this way again. Don't take legal medical bill paying advice from podcast if seven thousand dollars an unpaid pregnancy and you can afford to pay the hospital. Five hundred dollars a month. They will absolutely discount though and you will pay it off again. Not saying you have to i. I really don't see the strength of this because it sounds like you're arguing against any insurance when that same thing applied to any insurance company. Well no for multiple reasons. The biggest reasons are that the insurance companies have to provide all of the benefits that are specifically excluded. Here right so we're just talking about what people back. Which is what. I'm trying to say like. It's not.

"Either or both statutory or judicial exemptions for process servers in alabama. The default is to have the sheriff service serve the papers and there is sheriff's immunity for serving papers right. So you know you can't go soo the sheriff for trampling your precious begonias. When they've walked through your garden to hand you the papers and probably that same degree of immunity would apply even if there was an arguable criminal trespass. Here you definitely can't recover civilly either against the guy that is six dash five to sixty two which says that you can recovering tort for any abuse of or damage done to the personal property of another unlawfully is a trespass for which damages may be recovered. Setting papers on the floor and walking into the garage does not seem to have done any damage arguably isn't even unlawful certainly doesn't seem to be compensable. Okay so at this point. I'm kind of wondering what this case is even about. Why is eric's well. Well hiring process server to kidnap someone's wife or whatever so this lawsuit is the lawsuit that Eric swale well filed after the january sixth insurrection pursuant to the kkk act that holds mo brooks and others responsible for letting folks onto the capitol grounds allegedly conspiring conducting. Tours is so all of this is in connection with the january six insurrection and yeah the fact that the story has been about service of process. Ed not a congressman evaded service of process for months in connection with starting at insurrection. Kind of tells you where we are and the last thing i'll say on that is as a matter of federal practice. Almost all instances of process are being pushed into a model in which you sign a waiver of service right because this goes back to the the the the question we flagged at the beginning about. Why didn't they just mail it to him. And the answer is because if you just mailed a copy to mo brooks then mo brooks is gonna file a twelve be five and say well. I never got it right. How do you prove that. This showed up at my address right. Yeah especially with louis. Dejoy right exactly. And so if there's a process server their affidavit from an adult and that will be disposer quarterback like yeah. I don't think that this process server who got paid sixty dollars to drop this off wilbur to perjure themselves in open court to say that they delivered it to you when they didn't although although i will tell you i certainly could tell stories off the air of of process servers who have Probably perjured themselves in their affidavit. But it doesn't matter yeah. You have an affidavit signed under penalty of perjury that says i did the following. We read it and the court can say yeah. That's that's good enough and You you tell me. I didn't get it i i don't care. I've got a signed affidavit. Here that's good enough. We're going forward. Case proceeds so one of the ways to avoid that is rule four of the federal rules of procedure which says that you can voluntarily affect a waiver and say. Yeah i agree i. I'm waving my rights to say. I never got this. I got this and the reason is because most law you know be. This was true even before covid but certainly in the era of covid i assume to people and i emailed their lawyers and i was like hey. Here's a copy of the lawsuit that we're going to file against you. Does your client agree to waive any objections to surface a process in both cases the will accept service. That's fine that's the way it's supposed to work when you sue somebody They're supposed to either accept service or say. I've waved my objections to to receiving service. All right well. Yeah as usual i. Andrew sounds like i trust the word of eric. Swale well over mo brooks and the footage and the filings back that up is that the takeaway here that is the takeaway from what i hear. When i'm being yelled at people caring loudly at me. Okay andrew as we teased on the last episode. We have gotten are still getting a recording feedback on the christian healthcare thing that we call a scam. You call scam lots of feedback. I'm wondering is this. An andrew was wrong or you retracting anything as andrew was right where this is an andrew was right. I retract nothing. I reiterate everything. But we've we've had some good feedback. I want to kind of kind of book end with folks that have agreed with us and that said boy. I always thought this was fishy. I had no idea it was this bad One listener sent us some actual document and we keep them quiet not reveal their name. I am still looking for if you have one of the contracts okay. And now i i have some idea as to why there might not be a formal written contract So let me describe. I a series of discussions that that somebody sent us Some email conversations that they had with an administrator of one of these health care sharing ministries. They said no. No no. there's no contract. There's nothing for me to show you. We don't have a written contract repeatedly. That's a red flag. That seems like an odd thing. And so what i have in my hands is a scam of one of the scale. And it is a checklist of understanding okay to this particular ministry and it says this form must be completed and returned as soon as possible. Thank you for becoming a part of scam ministries. Your participation is a testimony. How christians care for each other due to various state regulations. It is important that you fully understand that scam. Ministries is a group of christians who voluntarily assist each other with certain medical costs..

"Okay. I'm putting them on the floor right here. I then dropped the papers near her feet and reminded her the papers have been served. I immediately walked back to my car to leave the property. However i was unable to immediately leave because martha brookes walked around to the rear my car extensively to note my license plate and reversing backup. The driver was the only way to leave after approximately five or six seconds. Martha walked around in front of the car. And the moment i saw she was clear. Mind to path of the property. I reversed up the driveway and left the area. That's the end of the affidavit. And so notice that what that does is describe in sufficient detail for the court the reasons to believe that the intended person actually got the copy of the lawsuit That that they were after. That's the whole reason behind all of the stuff in the first place and how if while we're doing a process and service deep debt. Is this some sort of get out of jail free card if you can successfully avoid process for for a long enough you are you. Are you free to go. So yes and no yes in the very technical sense which is often the best sense That if a case goes to court and you have not been served you can move to dismiss that pursuant to rule twelve b five of the federal rules of procedure right so if there has been insufficient service the process You can say. I have to be here. We gotta start this all over again. and if the court agrees with you They do Additionally if you have filed a complaint but not served the defendant after a certain period of time The court can order your process struck from the record. And could say yeah. Look like you're just sort of sitting on your rights like get this. Get this person served so those are the kind of the two major things now. Does that make a difference. It doesn't always make a difference. But remember like suppose you have a two year statute of limitations. And you i filed the complaint within the statute of limitations and the defendant evade service process for forever. You know you could wind up having to refile the lawsuit and then them coming back and we didn't follow suit until more than two years after the commission of the initial wrong right. So that's an area where i see that happening and coming up now on the flip side i will tell you that when somebody is evading process You can go to the court and inform them. This person is evading. Process and courts are not super cool with that. Yeah and so you know. If you demonstrate significant proof and affidavits rule five to be to subsection descend matching. The game film like in nfl sc when here and they. They did a quick spin move. Got around me. Yeah that's right. Get somebody on the telestrator. You know. Terry brian view. You could But but the point is is that in both the federal rules and state rules there are additional procedures. Where when you have diligently tried to find somebody but you can't right because they have no known address so sometime states will allow you to publish it in the newspaper. The federal rules allow you to leave it with the clerk of court. You know so courts will devise ways to help you. Serve your defendant if you're being diligent in the service of that defendant but the reason to evade service of process in addition to being a jerk like mo brooks is that service of process is what begins your obligation. It starts the clock running for you to have to respond or to answer or move to dismiss the complaint. And so you don't have to do anything until they've served you so if you want. You can't afford to hire a lawyer this month. But you're pretty sure if you evade for a week you can hire a lawyer next month right. Those are other reasons. Less militias right. Y you might say all right It's crucial to me and again. I'm not do not take legal advice from podcast. Do not take illegal advice from a podcast here right. Evading service process is not is not a cool thing to do but there are different reasons. Why folks might might try to do that so now understanding that. That's what happened and understanding by the way like the process. Server is an agent of eric but even if this person committed war crimes surfing paper like eric swallow hired a process server. And do this. I assure you i'm leaving. A bad yelp review. I didn't have anything to do with. That's exactly right the idea that you would ever hold the lawyer or the party that the lawyer represents responsible for the actions of a process server that is beyond silly i will say this is a good side gig for our taint team. Your could use the van while we're doing the team stuff just like bam roll out of the van you've been served yet. Well i think when we're looking free midseason spinoff good way of doing it. So now was a crime committed when the cancer that no no so. So here's the thing. The crime that mo brooks tweeted out. was alabama code thirteen hundred dash seven dash two which says that a person is guilty of criminal trespass in the first degree if he knowingly enters or unlawfully remains in dwelling. Since there's no proof that he entered the dwelling and the affidavit is that he entered the garage no like even by the video would not apply right. That can go in people's garages and that. Let's get that right. Neither so that's thirteen hundred. Seventy two first degree criminal trespass class a. misdemeanor. Seven dash three is second degree. That makes it a class c misdemeanor if you enter a remain upon real property which is fenced or enclosed in a manner designed to exclude intruders. Also not the case here. But what apply like your your question what might potentially apply would be thirteen. Hundred dash seven dash four which is third degree. Criminal trespass makes it a quote violation so like a parking ticket. Right to quote knowingly enter or remain unlawfully in or upon premises. That's the most that you could get right below misdemeanor. A violation But i have to tell you. I i did some looking about in in alabama case law most jurisdictions have.

"Off line. Yeah great definitely. You're getting the episode for. Yeah let's get to today's episode. Which sounds like it's going to be a lot of fun down down so andrew. Did eric swollen sending elite seal team six into You know. I don't know what i guess. Commit trespassing on mo brooks and assassinate somebody. I don't know what the the allegations are. Sound silly to me but did that happen. So why don't i quote look like we all know congressman mo brooks of alabama's garbage here is how here here is a direct quotation from the fundraising literature that he is sending out to his garbage constituents and anybody else on any like you know list if you've ever bought a related product. I'm sure you've got this pitch via email quote. Click below to watch eric. Swallows horrible agent speed. That's capital down our driveway run. That's in capitals out of the car and storm into our house. Radical left camp. Take me down so now. They're coming after my wife. Click here to make a donation to my senate campaign is why so. I assume there's also footage of them running out with his wife. Then ed help us fight back against eric. Swale well and the unhinged democrats that was also in capital letters. But i was bob dunne scouting this point for today. Yeah hint if you click on the video you will not see a car speed down the driveway. You will just run. I don't know it'd be running for me. But you know i say trot person wanted to get to their destination ed you would see them cross through an open garage. Door is what you will say. You will not see him. Enter the house which the agent denies doing You will certainly not see speeding kidnapping the wife storming the running away with a bloody knife or something and then was stabbed. Not as far as we can tell so look. This is a question about service of process. Okay and i thought it was time to do a little mini deep dive on that and to answer. Because we've gotten some really really good questions. Including like i think the best question which is folks who go out and like read the rules for themselves and then say well this in plain english seems to to to to allow ex right and so one of the thinks is this is service. A process governed by rule five of the federal rules of procedure. And it says rule. Five beat who subsection c says That you can serve By mailing to the person's last known address in which event service is complete upon mainly and so the question that gets into why gca through this whole you know storming the castle. Although i did she just mail it to the guy and i. I have answers to all that. So what is service of process service process. It covers two functions. The first is you can file a lawsuit but not serve it on a person right and that is to say you've gone through the trouble of actually putting it in the court You've paid your filing fee. But maybe what you want to say to somebody is hey man. I just filed a lawsuit against you can go online. You can look it up if you want to end this before. I serve you with papers and start the clock running for your time to answer. Which means you're going to have to go a lawyer the then i'm open and i'm listening but the clock is ticking and the clock is ticking because you have to do that second component. When you file a lawsuit you have to prove to the court that you have actually given it to the person or persons that you're suing and that is called service of process and as i described it's governed by will five of the federal civil procedure in practice. This is carried out by Depending on the jurisdiction almost always hitmen. You know almost always carried out by professional process servers and they have a little cottage industry of what they do is you give them the papers. you tell them who they need to serve And then a blood hound is run off sometimes their former or current private investigators. Sometimes they're just people with a with some experience on that the the more tricky you think it is to serve somebody the more likely you are to call somebody that has a background sort of knows all the nuances and and i look. I've had to do. I've had to serve papers on folks who were evading process before and you know i've had process servers get creative right now. None of the get creative match up to sort of what you've seen maybe sometimes on tv. I've had them like hiding a potted plant. This was This is a key a competing business and my processor server showed up rang. The doorbell and said oh. Hey can i see you know mistakes. I have an appointment consulting appointment at three o'clock and then the receptionist buzzed him. In and in the process server went in and and wild the guy was like. I don't seem to see you on my calendar was like oh he was like. Oh maybe this will help. The papercity ended it too and then after that happens. Are you legally required to say you've been served You were not required but you are required to do that right so five. Be to says a paper served under this rule by a is handing it to the person. So that's what so that thing that you see on. Tv is in fact that the primary way in which people get served with process that is somebody will handed to them and like. Can they mislead you. Could they do exactly what i just described. That actually happened in real life on behalf of mea that they can do that. Okay and then what happens. Is the process. Server fills out a return affidavit. I'm no link the one in the swale well case Here i should call it. The swallowed by the processor here was a gentleman named christian. Celeski sec lucky. Sorry and. Mr cyclopes affidavit is Publicly available you can go. Click on it and read it and it just describes the process right. It says hey. I went out to x. address i saw by fatigue. I it just not mention that part right But it describes the circumstances under which you delivered the paper to that person and so for example this one says i initially tried making contact with the occupants at their address. Seventy six ten foxfire drive southeast in huntsville alabama. That's a matter of public record. So we can say that. I tried making contact with the occupants by going to the front door knocking ringing the intercom bringing the front door security device similar to a ring system however there was no answer after waiting nearby eventually saw a toyota highlander and then There's a note of the license plate that says two more brooks and martha brooks Which again leads me to believe that. There was some additional. Pi work behind the scenes. Done hearing pull into the driveway of the residents. I followed and also drove down the driveway. When i stopped my car at the bottom of the hill. The toyota highlander was parked in a parking garage and the garage door was opened. Which is true. You can see that on the video. I got out of my car. I walked driver's side door. The twitter highlander as i was approximately two or three feet away. The driver's side door opened. And i recognize the female in the driver's seat to martha brooks. I extended the papers toward the woman for her to accept. Instead mrs brooks i am serving you with legal paperwork. This is for your husband mowbray's so you know you got served as martha. Brookes exited the car. I asked her if she wanted me to hand her the papers she did not answer but yelled at me to leave and told me she is calling. The police then said okay. I'm putting them on the floor right here. I then dropped the papers near her feet and reminded her the papers have been served. I immediately walked back to my car to leave the property. However i was unable to immediately leave because martha brookes walked around to the rear my car extensively to note my license plate and reversing backup. Gerstein is a senior legal affairs reporter at politico where he has been covering the arrest of trump appointing federico klein and he joins me now. Josh i saw this story and obviously this guy was like particularly high up the state department but it i read the story. I thought he had left. He was working there right like until the end of the trump term. That's right chris. I was told. He tendered his resignation on january nineteenth. So that's two weeks after the storming of the capital and it became effective a couple of days later. So i guess he was wandering around at foggy bottom knowing full well that he had taken part as the video appears to depict in this assault on the nation's capital on the congress. Tell us a little more about this individual. So he's forty two years old He served in the marine corps in iraq. According to his mother. I haven't been able to determine much in terms of a work history. He had a couple jobs on capitol hill about fifteen twenty years ago as an intern briefly working for the house. Small business committee but he seems to have sort of potted around to different Different kinds of posts before fetching up at the trump campaign in twenty sixteen. There are pictures on his facebook page showing him a working at trump tower. I believe on election night in two thousand sixteen with a couple of other young men there and then he managed to turn that into a political appointee job at the state department in this special assistant a position. Exactly what he did. There is also a little murky. I have to say. I spoke to a number of people last night. Who worked in this department at the state department office at the state department and a lot of them didn't know him or said they'd only met him briefly he seems to have ended up an office that handled brazilian and what they call the southern cone affairs. I think those are the andes countries and somebody told me he was eventually transferred a believe it or not chris to the freedom of information act office which is not usually the career trajectory. Most people in government are looking for this quote from his mother. Cecelia klein saying that fred's politics burn a little hot. She said i've never known him to violate the law. I believe is. He said he was on the mall that day. I don't have any neural. Ever ask him unless he tells me where where he was after he was on the mall.

Federico Klein Arrested: what we know about the Capitol riot

"We now know that in the mall that stormed the capital on january six pushing into the building in fighting. The police was at least one trump political appointee an active employee of the trump state department on that day. His name is federico klein. That's his picture there. He's forty two years old. He was until his resignation on january. Twenty first of this year a special assistant in the bureau of western hemisphere affairs klein entered trump's orbit tech analyst on the two thousand sixteen campaign he then joined the state department as a staff assistant with the trump transition team. According the fbi affidavit as of january sixth the day that this all went down insurrection. Klein also had an active top secret. Security clearance that same sixteen page f. b. i. Affidavit published today by the new york times reveals. That klein was present in some of the most grisly violent odd setting scenes at the capitol on january six. This image captured by surveillance. cameras shows. Climb in the red maga- hat along with other members of that insurrectionist mob entering a tunnel that leads to the doors the capitol building. You might remember. The police were stationed at the entrance. Desperately trying to use their bodies to keep them about body camera footage shows. That klein himself pushed his way to the front of the crowd. That is the trump administration official in the mob pushing his way to the front of the crowd physically and verbally engaging with officers attempting to stop the invasion it also captured klein violently shoving a riot shield towards the officers pushing it in between doors so they couldn't be closed. Federico klein continued to fight to breach the police line and enter the building. According to the affidavit until an officer deployed a chemical irritant spray also identified client in this publicly posted video from january. Sixth the trump administration official. Who still official. When you're seeing him here you'll see him in the center your screen and the red cap dark green jacket with his back to us. You may recognize that we've shown you pieces of the seen before because in the scene the mob violently tries to break through the police line at the entrance the building and you will hear climb it trump administration official encouraging members of the mob to come forward as reinforcements. I i i. A mob violently attempting to invade the capital. Stop the peaceful transfer of power. And that man frederick climb according to the fbi seen. They're on camera saying we need fresh people to help with the invasion on the day he's still working for the state department later on that same video. The fbi notes that we see further violent action from climb. You can see on the right side of your screen here pushing and shoving with the mob trying to break down the line police. Blocking the doorway the capitol right up against the officers right jailed. And he's visible again just a few minutes later. Struggling with officers pushing back with the shield is they keep trying to disperse the rioters attempting to stop the peaceful transfer of power sign was arrested yesterday. Charged with multiple felonies including assault on police officers interfering with police during civil disorder and obstruction of an official proceeding. New brief court appearance today conducted by phone. He was advised at two of the six charges. He's facing carry a maximum sentence of twenty years in prison. The fbi found interested federico klein thanks in part to tip from the public and the included his photo in a seeking information list posted online. They were able to verify identity and details about his actions through social media and videos like the ones we just showed you but there are still a lot of questions about other individuals involved in the attack on the as well as the organization and planning behind it fbi's investigating whether foreign governments groups are individuals may have funded extremists who helped plan and execute the january six attack fbi sources telling nbc news that the bureau is examining payments of five hundred thousand dollars in bitcoin apparently by french national two key figures and groups in the alt-right before the riot kind of weird also know the fbi collected thousands of phone and electronic records connected to people at the scene of the rioting including many records from the members of congress and staff members. Republican Congressman vs. David C. Smalley

"Let's jump straight in. Because i want to bring our guest in on the conversation immediately. He's a former congressman from virginia's fifth district he's now nc are is chief strategist and author of bigfoot. It's complicated which. I really hope we have time to get into and i really hope. He's still a republican. Let's find out join me in welcoming denver riggleman to the show. Thanks for joining me today. Sir thanks for having me sir. Oh well you heard that with us for the first time it just came out moments ago. What are your thoughts. So i'd like to state as we start here. The president trump reid tweeted a few months ago that the joe biden. Kill seal team six. I think god you're right. No you know. That's and that's what i was when i was listening to that speech after what i heard Down near the white house right before the siege on the capital. In fact that i've been in. Congress have been in the house. And i knew some of those people that spoke like madison call or mo brooks of talked to many times Don jr. meant obviously rudy giuliani I've met obviously and and what i really saw. Their david was absolute Language to incite really. It happened over the months and months and to hear that right now. My my first reaction is not really a politician but as an intelligence officer and something counter-terrorism like somebody's very afraid of the senate trial for impeachment. I thought the same thing Michael came in a few seconds in michael goes. Looks like a hostage video like he looks like he like. It's not really his words. He just feels the need to say these things he had to. I mean you know. The thing is is that his his term does end. I know that there are some people that are still listening to pastures and trucks talking about biblical prophecy that president trump is right now hidden a bunker and mike. Flynn is going to be the next vice president but by the way that's true. I just saw this video two days ago. One hundred eighty five thousand likes david on a facebook video from some dude in a truck saying that you know he's a pastor and had biblical prophecy and he just went through the whole cunanan thing and i just shaking my head about the ridiculousness out there. But he still wants to keep his brand to. He's got to make money. And how's he going to do that. And i think there's a lot of things you need to worry about. And that speech was the copa. That was so too late and show not anything that he said before that very hard to believe men. You're spot on. I mean. I i you know about damn time is the first reaction and then does he even believe the stuff he's saying is the second reaction So late you know so late to the party So that so that my listeners have a little bit background as to why this conversation between the two of us is so important You know you're you're only a former congressman because apparently you weren't conservative enough for your district right you. You lost to someone who was far more conservative and on top of that. I've seen you. I've seen pictures. Anyway of you officiating. Same sex wedding so you don't sound very republican the to us sir. What's going what's going on over there. Why are you so open minded and logical. You know when iran. You know. i've only been. I don't know people know this about me. I was i was a ceo. sell my company in two thousand twelve doing counterterrorism and counterintelligence work. Could you know not. Only that i can. I can go back in time. If i told you the crazy stuff. I've done like we mission plan. The first bombing runs death in afghanistan for nine eleven. that was our squadron. It was me Oman training omanis on. F16 sixteen operations in two thousand and ninety nine. I was on. The romanian serbian border for operation. Allied for trying to stop ethnic cleansing. I've had a hell of a life and that's just the beginning counter idea. Actually our team that was tracking sulejmani and two thousand six two thousand seven so when people saw my resume like this son of a gun never been in politics before when i ran as a republican i was asked to because the my predecessor had to resign because of alcoholism. Which is a little ironic. Since i'm going to stiller. I one on accident one by one. Vote against a christian. Dominion est They called me a baby killing sodomite But i thought if if practicality and i was a good guy team player like in my military days voted independently when i had to I thought i would see that. I care about people more than the career. Because i didn't need the paycheck and sadly after the same sex wedding david conspiracy theory started about me that i was working for soros to turn children into alternative lifestyles by funding schools. To teach that doug gay sex was okay. And that i really started saying cunanan was turning and blossom and this was back in twenty nineteen and since my background is in you tracking isis and al qaeda and disinformation and radicals. I said this also looks like that. We have almost the same type of thing here. We have people that are using language of dehumanisation and antisemitic. Tropes to go after people. And you know it's like a lot my book right. It's about bigfoot belief systems and take over people's lives so really been a hell of a time for me. I never thought that My family we get death threats You know i never you know. I never thought that. I can tell you this. Now that somebody would remove the lug nuts are in them all up on my right front tire at a rally where i came out and felt funny and took it to a shop and look like they tried to hurt me pretty bad so this has been one of my life has been like for the past two years david. And guess what athem you know. This is what they want to bring it. Bring it because i got fifty acres of distillery and i'm a second amendment guy and but i'm also a free thinker and pretty socially libertarian. So i don't know where. I fit bud

"That's right. The big news today is that Senator Josh Holly and pledged to challenge Joe Biden's victory in Pennsylvania and maybe other states on January, the sixth when Congress is set to certify the results of the 2020. Election. This is going to be big. Not only are we going to see on Wednesday a lot of protests around the country, a lot of rallies of support for President Trump probably a fair share going against him as well. The president himself says that that the showing of support in Washington D. C will be something You see, Now we know something interesting will happen. On January the sixth, there will be a contest to the election results led by Senator Josh Holly in the Senate, Mo Brooks and other congressional Republicans in the House of Representatives. This is This is a pretty big deal. He guaranteed that both chambers will now be forced to at least debate the results of Pennsylvania's election. Maybe other states whether or not to accept Bynes victory, And this is important because if this had just been an issue raised by the House of Representatives, it probably wouldn't have gotten a lot of play. But now that both chambers are into this into the fight, want to see the debate. That looks like what will be on the schedule on January. 6 now a guy who never Gives up the fight is the author of a new piece out right now in the Spectator, the American Spectator. The title of it caught my attention and said the president should stay the course. So this is an answer to the New York Post. Headlines on the cover of their newspapers few days ago that President Trump should give it up that he's ruining things in Georgia and that he should just exit stage right and that he should. Always kind of quietly. Well, our friend Jeffrey Lord, who you know from CNN. He is a prolific writer. He worked in the Reagan White House. He decided no President Trump meets to fight back and he wrote a piece about it Right now. He joins us on America first. Jeffrey Lord, follow him at real Jeffrey, Lord. And, of course, always the Jeffrey Lord Calm is a place for all of his articles. Welcome to America, First of Happy New Year. Well, happy New Year to you, Jen. And thanks for having me and thanks seven. Giving my best wishes I will. Absolutely. And you know what? At some point when I make it to the East Coast we will all make. We'll all get together. How about that when we can actually see each other in person? I think that is a great idea. Virtual only goes so far. Exactly. I know I'm done with zoom calls, which, by the way, is apparently one of the most popular new words of the year. Zoom. We'll talk about that later in the program, But Jeffrey Lord, I was so just heartened to see the New York Post, which seems to be one of the few Sources of reason in the news media coming out and saying it urging President Trump Tonto back down. And for multiple reasons, but because there are some real issues of voter fraud, it is the president's job to not just fight for his political longevity. But to fight for the American people in the 70 million Plus Americans who are questioning the results of this election and for the New York Post to come out and join the other media outlets and just Sort of. I don't know, brushing all of that under the rug. It made me I didn't love it. I felt like gosh, we're really losing the fight here. But then I was looking around on social media and I saw your piece. The president should stay the course. And it's available right now. Spectator dot orc and it was written by you. Were you feeling the same way I was. Is that why you wrote this piece? Yes, exactly. Yeah, I could tell you just is a a personal aside. I'm out here on Eastern Long Island for the holidays. Mark. My mother and father grew up out here. So I have all of my extended family here. So this is where I come for Christmas every year, So that means when I show up at the breakfast table, the New York Post is physically on the table. I love that I still love to read the physical newspaper, too. Yes, I saw it. And I thought to myself. Oh, my God. You know, I just I could not believe it. So I read it And I thought, Well, this deserves an answer which I promptly sat down and Good virtual style and sent into the spectator. But I just think You know a couple of things number one just in general. This is one of the reasons why Donald Trump is where he is because he fights and other Republicans do not. That's right. Better problem for the Republican Party for Ages and ages and ages and I'm so glad to see him do it. But secondly There are millions of Americans who really believe I'm one of them that this election was stolen from Donald Trump and Pennsylvania is mentioned here. I'm from Pennsylvania. I came up through the Pennsylvania political system on the Republican side. I can tell you I have never seen the response to a candidate. But I saw two Donald Trump when I went to these rallies in Pennsylvania, and I went to three of them right before the election. One I did not get to was in western Pennsylvania in a more world section of Pennsylvania Butler candidate They had Jen 57,000 people show up for it..

"Joining us now Congressman Mo Brooks to talk about a brochure that was put out by the Red Stone. Arsenal and now there's an army investigation into all of this, mo. Thank you so much for being with me. I appreciate you. My pleasure, J t. So I have. Ah, question for you. What were you more upset about the make America Great again, which promotes covert white supremacy or the fact that the you know, armed services used any political phrasing whatsoever. I Well, I'm gonna let you answer them. Well, I didn't really prioritize. What upset me. The most just say that there were lots of parts of it. Ah, this wire that was sent out to some unknown number of thousands. Uniform and civilian military personnel, but it was racist. It was also a partisan and direct conflict with the Hatch Act. And I'm confident that the United States Army is going to take to past those wayward individuals who violated any number of army regulations and the Hatch Act and putting this together and disseminating it. Two civilian and uniformed military personnel. Alright had the phrase covert white supremacy been left off this a brochure and just the phrase make America great again. On the brochure and there courting their commander in chief, and we view slogans before in our armed services. Would that have been OK in your mind? Does that still stretch and violation of the Hatch Act in that they used The president's phrase, make America great again, therefore picking sides politically. There has already been any number of decisions rendered by people in authority that you cannot use the phrase make America great again. Using government resource is because that is partisan. Whether you're for or against it. It's either for trump or against Trump. That means it's a violation of the Hatch Act, so that is already to settle sort of law. All right, just because it is the president's statement, and it's his campaign slogan on the hats. It's you know, licensed, I guess to him, eh? So therefore, if you mention anything about that you're choosing sides, even though he is the current commander in chief, You still can't do that, huh? You cannot under current law, But this flyer went far far beyond the use. Oh, yes. Make America great again and claiming that that is white. The primacy which of course means that it's racist. This brochure said that it is white supremacy to say, quote education funding for property taxes in quotes. To call the police on black people, regardless of where they committed a crime that is racist to use the phrase all lives matter that is white supremacist. To deny the white privilege argument. Those political figures that are using that argument that according to this fire is racist, too. B a For border security by being against, um open border immigration policies. Vast races to celebrate all of that was in the fire. His racist. Yeah, all these things there and dozens more. Well, You know what I tell you. What That is Outrageous. Yeah, I'm with you. I think these people are to be fired if they're printing that kind of garbage, and they're in their flyers and brochures from the Redstone Arsenal, claiming Columbus Day is racist claiming that you know All of those other litanies of things. You were talking about a racist. I mean, it's getting to the point now, Congressman, if you fly the American flag in your front yard, all of a sudden you're going to be called racist. That is a true statement. Their socialist Democrats there are marks is there are black lives matter. People they're racist who do not like America who do not like the American flag. And if you fly that American flag showing your love for country you have to be retaliated against in this sorry state of affairs that we have allowed. These radicals put us now. Yeah, it is. And I got it. I got to tell you, how are we going to turn this around? And you know, it gets scarier every day that that that voice is so much louder and being more accepted, as opposed to the way this country is founded, what we stand for as far as patriotism goes Well, there are many things we can do. We can take the fake news media to account weakened, boycott they advertisers and let make sure those advertisers know it if they're going to support These kinds of racist policies if they are going to support those media outlets, the dissemination of false information to the American people on a regular basis. The left wing has been very effective. At doing that. And, by golly, it's about time that American patriots started giving these radical leftist a taste of their own medicine. Amen. And you're in that district up there with Redstone. Arsenal. Please keep us posted. And do you think accountability will surface here in this in those people that put that garbage out there from the Redstone Arsenal. I spoke with the undersecretary of the Army and the Pentagon, Jimmy person yesterday. He is as troubled as upset by this as I am. He's called for 15-6 investigation that will be headed up by Colonel. That is being headed up by an individual with the rank of colonel suggests that they're taking this extremely seriously and the group will be in the pudding. If the originators of this get fired, then we know it was taken seriously. All right. Very good Congressman Mo Brooks.
