"Is covered by executive privilege for the activities he engaged in on and around January 6th and the weeks leading up to January 6th. I think a lot of people would view the most of those actions as political in nature, but he argues that they're part of his official duties as president and that he's therefore exempt essentially from being questioned by Congress about them on the basis of executive privilege. Of course, he's not the president anymore. He's been out of office for almost two years now. And so whether that's a valid claim, I think, is up in the air. He also makes some more general arguments that the January 6th House committee wasn't properly constituted, doesn't have the Republican members. It's supposed to have and a variety of other arguments we've seen other folks raise against that panel. Well, give us a quick history lesson have past president's been subpoenaed before. You go back in history over the last century or century and a half. There was one subpoena that was issued to Harry Truman. Generally speaking, these things had been negotiated either a president's testimony has been requested or something has worked out for them to answer questions in some other forum. We have seen presidents subpoenaed in criminal cases, folks may remember there was a grand jury subpoena to former president Bill Clinton. So we have seen that go on, but in terms of subpoenas from Congress, it's pretty unusual step for the House or the Senate to try to subpoena a president or a former president. You and your colleagues are reporting that the chances always seemed low that the subpoena in this case would actually get the former president mister Trump to testify. Why is that? Well, it's coming pretty late in the House select committee's investigation, Michelle. I mean, this investigation has long been expected to wrap up in the coming weeks, particularly if as many still expect the Republicans take control of the House. They're not interested in pursuing with this panel's work in the formulation that it is right now. They want to focus on other matters, not as directly implicating the president. So we expect this committee to go away. I think this was more of a way for the committee to button up its work so that they couldn't have former president Trump come back later and say, well, you never asked me for my side of the story. They've now asked him for his side of the story. He's officially declined to appear. And while he did file this suit, I expect within a couple of months that this litigation will actually Peter out once this Congress ends. It does, however, perhaps insulate him against a potential criminal charge for contempt of Congress. You're not supposed to just ignore a congressional subpoena as some of the president's former aides have found out. Well, Josh, before I let you go, any final thoughts on this, anything else we should be keeping in mind. Well, he did file this suit down in Florida, so we're waiting to see he filed it near his Palm Beach estate there at Mar-a-Lago. Of course there have been questions in past cases about some of the litigation ending up before judges who are favorable to him or were appointed by him. And so that's still a possibility in this case, I think a lot of people are looking to see who ends up picking up this litigation. But as I said earlier, I think at this point for this committee, you know, once it goes out of business, this dispute is basically

At a monitor breakfast yesterday, former senior Trump adviser Kellyanne Conway told us she expected him to announce soon after Tuesday's midterm elections. Former president Trump has long been hinting at a 2024 run, and he did so again yesterday at a rally in Sioux City, Iowa. I will very, very, very probably do it again, he said. Declaring this soon would be extraordinarily early. Candidates typically announce in the year preceding the election. But mister Trump could have several reasons for moving quickly. He reportedly believes that being a declared candidate could insulate him from various criminal investigations, including ongoing probes of efforts to overturn Joe Biden's victory in 2020. Announcing his candidacy could also help shore up his base of support, as polls show many Republican voters, including some Trump supporters, increasingly say they'd like someone else as their 2024 nominee. Mister Trump's entrance would have immediate ripple effects, there are at least a dozen other credible GOP candidates. Many a generation younger than mister Trump, who would feel pressure either to jump in or bow out. It would also likely supercharge the democratic side in ways that could actually help President Biden. He has long made clear that he ran in 2020 to counter mister Trump, whom he and much of the democratic base view as a threat to democracy. Of course, it's entirely possible that mister Trump is just toying with the media. Something he's done in the past. And he isn't actually planning an announcement at this time. The court left no legal impediments in the way of Graham's appearance before a special grand jury, which is now scheduled for November 17th. In practice, how closely has desantis agenda reflected Trump's? Yeah, that's a great question, and I will tell you that ad famously in modern politics never actually aired. It was such a shocking ad to watch a candidate positioned his toddler children in a room building Donald Trump's wall that the news of the ad itself penetrated the political mind, if you will. But here's the interesting thing about Ron DeSantis and his rise. He probably used Donald Trump and I mean that is a bit of a pejorative More successfully than any Republican in the country. As Donald Trump emerged, Ron DeSantis was one of his greatest ambassadors on Fox News. He was an evangelist. He was a defender, and Donald Trump repaid that when Ron DeSantis was running for governor. He was behind. He was not the establishment pick, but Donald Trump anointed him. You're going to be the next Florida governor. Importantly, when Ron DeSantis was elected, shocking conventional wisdom, he then stepped away from Donald Trump, and he receded, and he was no longer Trump's defender on Fox News no longer his evangelist, Ron DeSantis began to focus on Ron DeSantis and what would be his inevitable run for The White House that he's known for years. He was going to pursue. Donald Trump is now a full-time resident of the state of Florida, making him both desantis kingmaker and constituent. What is the governor's personal relationship with him like? You know, it has gotten a little icy. They are political competitors now. Donald Trump clearly considering that 2024 run Ron DeSantis already having mapped his out if he is successful in November, you will see a super PAC named ready for Ron that will begin the recruiting process for Ron DeSantis to run for president and maybe in the new year desantis would indicate he's exploring it. Donald Trump knows that, and frankly, by some estimations, Ron DeSantis has the hottest hand in Republican politics right now in a primary without Donald Trump Ron DeSantis is the clear favorite. So for the last year, they have avoided each other. In fact, when Donald Trump had his very first rally in Florida after having left the presidency, Ron DeSantis refused to show up. He was not going to show up. Donald Trump wanted it to be a bit of a fealty test of Ron DeSantis loyalty, but desantis was not going to be there and then tragically the event of the search side condominium occurred and Ron DeSantis actually had a legitimate reason not to appear. But that relationship has never healed. Well, let me divide it today. Let me ask you then, David, I mean, this is the big question for desantis. He's clearly trying to distance himself from the former president, but as you said, Donald Trump himself anointed desantis as the next governor of Florida. So how does desantis differentiate himself in a potential presidential race while still wrapping himself in the maga flag? Well, I think a lot of Republicans say with Ron DeSantis, you get all of trumpism without the baggage. But Ron DeSantis did something very importantly that no other leading Republican did, which is he's never crossed Donald Trump. He has hugged Donald Trump closely his agenda closely.
