"That's good, yeah. I'm an American, most of my knowledge of Europe comes from crusader kings three. So here we are. Luxembourg's population is 632,000. And here in the United States, we mock several states for being essentially blips, Rhode Island, Wyoming, et cetera but Rhode Island has way more population than the whole country of Luxembourg. It's a bigger impact. And their economy is really skewed toward big dollar financial tech companies. But it's true. There are neighborhoods in Los Angeles that are bigger than Luxembourg. You know, we've been bought and sold by so many mega corps, tech crunch over the years that I think we've had to reinvent our soul several times. And I think it's gotten better over time. Who owns TechCrunch? Currently, we are part of Yahoo, which is the former Verizon media group, which was formed out of the collision of Yahoo and AOL, back when it was called os under horizon. And now we're owned by Apollo, which is a private equity group. Yes. Okay. So really, almost all the tech publications now are owned either by public equity, either red ventures or Apollo, right? Yes. Yes, this is why substack still will always no matter how much they make me mad, we'll have a place in my heart for building an indie place for people to just scribble. Yeah. Speaking of Indies, we have our favorite scribbler, our gastro nomad, mister Mike elkin is here in Barcelona actually sits just outside of Barcelona this week. On his way to Morocco and you still write for the tech press, but you're a freelancer. So you don't have to worry about that. Right, equity. Right, I've been writing for some of the usual suspects. I've added a couple new folks. And I also love substack. So substack has been very good to me. And yeah, I have a lot of fun writing on that for the same reasons that Alex pointed out. So yeah, it's great. It's great to be it's great to be a freelancer and have a diversified income streams and all that stuff really. Really enjoy it. So you moved Mike's list to substack win. Two years ago. Wow. Okay. So that was a good move. Yes. Very good. Nice. I mean, Mike's list is a bad idea. In general, because it's so hard and that end result, most of it is so frivolous. I read a serious piece and then I have a bunch of funny stuff. And the funny stuff is so hard to do. And it's totally not worth it. But it's worth it because I personally enjoy it. But as. An effort to impact ratio, it's a little off the charts. But I love it. We're glad you do it. I appreciate it. You still do Mike's nice list, right? Or Mike's nice photos, what is it called the mics? It's called the nice book. Nice book. Yes, and I occasionally dip in there and add some fresh things. It's a replacement for Facebook. It's a nice Facebook. But I tried to do it. You can Google photos. And so yeah, it's good. I've got a few hundred people who follow it regularly. And yeah, it's pretty great. All my personal photos and stuff. This is the place to go to visit all the various places Mike visits now. And do you miss, do you miss Google photos at all? I mean, Facebook at all? Not at all. They actually, this is kind of an interesting thing. They actually locked me out. So I was going to do the thing where once a year, you go in and reactivate your account that deactivate it just to keep ownership up. They got tired of that. And they just locked me out. And so we're on to your game, Mike. So now I'm just like, ah, forget it. I don't miss it. I don't miss it. Although I was at a dinner last night where four people, I was the only one not on Facebook. And they were all talking about how fun it is. And I felt a little left out. I have to say. Yeah. Well, one of my favorite Reddit Facebook. Pardon me? It's new to have a special Facebook that is spun? No, I guess, yeah, that was my I should have asked them. What do you mean? Fun. Really funny. There's a subreddit that sort of mocks pseudoscience and outrageous claims flat earth. There's all this kind of stuff. And it's called a Facebook science. That's the name of the suburb. I'm following it right now. It sounds like a very good name. Let me do slash R slash Facebook science. I can't find it. Oh, I forgot the last I put the slash in the wrong spot. A singing teacher or a voice coach. You know, there's a good question there. 'cause I need a voice coach. Oh, she is a voice coach. Okay, I want to hire her. Exactly what she is. So this is how it came up. So my daughter has nodes. She went to an ENT. When she was in high school, they did Balkan singing. That really hurt her voice. And now that she's doing stand up, but she's always been very talkative anyway. And she's got nodes. She's trying desperately to voice rest and she's going to end up going to a voice coach. But I as Joanna's specialty actually. Well, and I'll refer to Joanna too. But it made me think, I've never done anything along those lines. And you know what I'm concerned about? Bad symptoms or anything. I don't have nodes. And I don't get horse, and I think I'm okay. But I also have no training. And I thought, maybe be time to pay attention to that, especially as I get older, 'cause what I don't want, you hear it all the time, as people age, their voice gets thin. Oh, absolutely. And is that avoidable? Yes, it is. But it's such a common problem. I want to keep using this is my only ability. I realized how foolish I have been, you know, not taking this seriously over the last 40 years..

practice He's co chair and a law professor at Columbia Marty welcome to the show Michael it's so nice to be here Thank you for having me Mike nice to speak with you and Scarlett it's a pleasure to meet you This is totally rock the league Your thoughts first of all on the impact of this lawsuit and what it means for the game Let me start off by what the naked allegations are what Brian Flores has claimed was systemic racism in the hiring and maintenance of head coaches in the NFL This is huge Whether the lawsuit itself has any gains any traction is another question which we can get to if you'd like later But right now the public relations fallout has to be overwhelmingly against the NFL That being the case there are a couple of charges he makes in his suit He talks about how he was ordered to tank games so that the dolphins could get a higher draft pick He was kind of ordered by the owner He also alleges and this is the more blockbuster charge I guess is that he was only interviewed by certain NFL clubs so that they could check the box under the Rooney rule And that he was not really a serious candidate for the head coach job as revealed by texts from Bill Belichick the head coach of the New England Patriots Which charge is harder to prove in a court of law So let me take it in two bites if I may Scarlett first of all the claim that mister Flores has made about tanking games is really difficult to understand why that would be in a discrimination lawsuit And it's problematic of his entire complaint that he throws a lot of claims in there and they may have legs to them But he throws a lot of claims which really have no basis in discrimination claim But cast the NFL in a poor light So if you go to then the second point that you mentioned which is sham interviews I think that's what mister Flores refers to them in his complaint That could be more significant Because you have the Rooney rule It was a rule that was adopted in 2003 and amended two years ago which requires NFL teams to interview a minimum of two minority candidates for a head coaching position If it is the truth as mister floris claims which will have the chance to take discovery on of his case survives It will be interesting to see whether this was just a series of sham interviews And a number of owners did not have any interest in hiring M minority candidate or if he just didn't stack up with some of the other candidates Hi Marty again this is Mike lynch up in Boston So you use the word traction How does this lawsuit get traction All right so a great question So what mister Flores has done is he's filed a claim which is called a class action And into it he's thrown a whole bunch of allegations You're going to see a concerted effort Once we get beyond the public relations part you're going to see a concerted effort by the defendant First to say that this does not this is not an appropriate claim for a class action That's going to delay resolution for an amount of time 6 months a year maybe a year and a half While the defendants are able to take what's called class discovery which does not go to the merits So the case will be in this legal limbo for that time If it is determined that Brian Flores has a viable class action then it will likelihood the defendants will move to dismiss the claims under the applicable law Again delaying resolution on the merit or even taking discovery on the merits for the period of time that the motion to dismiss needs to get decided probably another 6 months or so So as you can tell we're talking about an extended period of time before mister Flores's lawsuit can really see the light of day in terms of whether he's able to take what we call merits discovery or discovery on the merits And that's only assuming he survives those two motions that I just mentioned So that's what I meant by traction If he gets to the point where he can take merits discovery then there's going to be questions about what information is confidential and can't be disclosed to of all folks The media Or the consuming public And what is their game for disclosure Probably another set of motions and delays Before you get to the point at which the parties can get evidence to prove their claims From where you sit having practice law and covered the sports industry at large sports law over all not limited to the NFL What is specific about the culture of the NFL that has led to this that hasn't led to a similar problem in the MLB and NBA I have pondered over that For literally decades now without coming to a hard and fast conclusion I'd like to think it is not systemic racism in the NFL I think the NFL itself as an entity has tried to pave the way for opportunities for people of color for people who are not of color but it hasn't worked I'm not sure why Once upon a time I would have said that it's because the NFL has a group of owners which aren't as varied as some of the ownership interests elsewhere They had fewer corporations and more individuals and ownership positions Than some of the other leagues But that really isn't the case anymore And there certainly are very qualified people of color who could So a good day to be playing the races down in South Florida and nobody knows that better than our friend Ron nicoletti, who is on top of all the action down there. Good morning, Mike. Nice. Nice to talk to you. Excited for this Rainbow Six today. Whenever you get these mandatory payout days, it just kind of it takes things to a new level, doesn't it? Yeah, it really does. The excitement just ratchets up and they're expecting a little over three $1 million to bet into going in. We got 450,000 live money. So, you know, that's adds to it. So it's up for the taking. And what is interesting about this one is this is the first time with a mandatory payout that four of the 6 races are on the new to Peter surface. So I find that totally interesting. And it's a new situation down here. So it's going to take a little bit of handicapping to get this thing done. Have you noticed any trends that folks can keep an eye on when it comes to those races on the tepida? Yeah, you know, we've been watching them and in the beginning, the first couple of weeks because the track has to settle. It was just basically mid race stock is or closers, and it seemed to level out. We had like just a spurt where four or 5 races of the FrontRunner one. So it seems to be loving it out and there's no like an old bias, we say, oh, it's speed. You got to have your speed. It seems to be pretty good. It's really a jockey's race on the torpedo. With the fact that we have the new whip rule. So you just got to sort of get your horse in the right position to make that charge down the stretch. The most amazing thing about it, Mike, is the second day it was and we had one of these belly washes here in South Florida, which we've been dealing with and that track was perfect. It was one of the same I don't know if this is going to work out and it has been fed path so far. As far as when it's raining. Now it's a slow track. We know that it takes 36 months to a year to get it to where they want it. So it's been fun. Yeah, that is one of the benefits of an artificial racing surface that Ronnie is the plan that say, for example, the championship meet, if we get a day where it pours down rain like you just talked about. And let's face it, they happen in South Florida. If we get a date like that, races are taken off the turf. Will they be moved to the tepida surface so that some of these Terra forces stay in and we keep bigger fields? Yeah, absolutely. That's the plan. And I don't think they're going to write the plan is not to write that many to Peter races for in the card, maybe one a day, but it's basically going to be used for exactly what you said. The last two days here in South Florida, in the afternoon, it's been pouring, you know? So we were making a joke yesterday that they should have taken the main track races up and put them on. It was perfect yesterday. You know what, it's a new situation. It's been fun handicap and, you know, sometimes you scratching your head, but that's what makes it all more fun. When you look at a day like today, and you have that mandatory payout in the Rainbow Six. Change the way you approach structuring your ticket and the horses that you choose? Yes. Because absolutely. I wanted to tickets I put together is what I can afford basically during the week. I don't like to put up a $200 ticket. For the folks out there, the best if they don't leave me to tell them if they spent $200 on a ticket, so I like to keep it $40 $30. But when it comes to day like this, you know, it's beautiful question. Not dealing with any takeouts or anything. You guys send it in. So I'll get a $100 ticket as I'll put it together. Now if I get a partner or something like that. And you know, the key to this I found is you got to find that one race where you might be able to single or use two horses and go deep in some of these races that are just so hard to handicap. So, you know, that's my thought about it. I try and zero in on something I really like. You know, best bet or whatever. And I try and build my ticket around that. You know, after you ended up at the end of the wait, I got to go back and change this a little bit, you know? Let's start with race number 5. That's the first race in the sequence. We'll walk through all 6 races and kind of get your thoughts on who you think might be live in those races and the 5th race here we go. Mile in 70 yards, $20,000 claiming event and how winters are two lifetime. Maybe for a lot of people a bit of a head scratcher, tell me about this one. Well, you know, I went with the four horse and Katie's dream girl actually like this was a lot today. 6 to one in the morning line. I'll tell you about wheeling back in 6 days. So just ran 6 days ago. But dropped to the 20 level and I like the fact that this horse is stretching out, broke out with at the start.

It's been fun handicap and it, you know, sometimes you scratching your head, but that's what makes it all the more fun. When you look at a day like today, and you have that mandatory payout in the Rainbow Six. Does that change the way you approach structuring your ticket and the horses that you choose? Yeah, because absolutely. When the tickets I put together is what I can afford basically trying to wake. I don't like to put up a $200 ticket. You know, for the folks out there, you know, the best. You know, they don't leave me to tell them if they spent $200 on a ticket so I like to keep it $40 $30. But when it comes to day like this, you know, it's beautiful question, not dealing with any takeouts or anything. You know, you guys send it in, so I'll get a $100 ticket as I'll put it together. Now if I can get a partner or something like that. And you know, the key to this I found is you got to find that one race where you might be able to single or use two horses and go deep in some of these races that it just so hard to handicap. So, you know, that's my thought about it. I try and zero in on something I really like. You know, best bet or whatever. And I try and build my ticket around that. You know, after you add it up to the end, you then say, go to a wait, I gotta go back and change this a little bit, you know? Well, let's start with race number 5. That's the first race in the sequence. We'll walk through all 6 races and kind of get your thoughts on who you think might be live in those races and the 5th race here we go. And I like the fact that this horse is stretching out, broke out with at the start and then showed some rally in the end and trained by Ralph Knicks and written by Chantal Sutherland. It was just been on fire lately and she I think she's time for most wins. I'm talking about this is on the tap most wins on the tape with 13 or 14 or something like that. I just think this horse is 6 to one, actually made this one my best bet on the cardinal my long shot on card today at 6 to one. So I thought that horse had a chance. I mean, you got to sort of use quite strength any police to junior roses started, but you're right. So this is where if you find that single, you got to go deep somewhere because it's not an easy one to start. So is Katie's dreamgirl strong enough to single in the spot for you? Almost. You know, you go to the probably in there with the quiet strength to I like for Eddie pleased the junior, you know, just one ran back. I like the fact that this horse is turning back and what I've been doing is I've been sort of key in a horse that already have a race over the surface, you know? I just don't know that we know how to do that. And we've talked about it, Eric Hansen, a director of operations, come over here for just a minute. Let's lighten the mood here for a moment before we get back to serious stuff. Eric has put up with me for a hundred years. How many years 22 years? My goodness. It's 22 years almost 20 years. All right, 20 two years you've been the operations manager of the Mike Gallagher show. Now try it up and I Tom tried it, but I had this idea that we'd videotape the head shaving and then sell it to donors or give it to donors who make a donation to our prison fellowship campaign, but I told time the other night I don't know how to do that. How would we send a link back? Right. Do we have a platform to be able to do that? Here's what I would, as you were talking about this because it's the first I've really heard about it. Here's what I was thinking, which might be kind of fun. What you can do is videotape it. And then what we're going to do Joe is coming and pat Kelly from the radio station they're going to have two angles. We're going to videotape. And people can make donations. And I don't know. I'll have to ask some of our rumble experts if this will work. But what we could do is then have a watch party on rumble for an exclusive group of people who donated who can then come and watch the rumble video. So it doesn't have to be one person and we don't have to send it to people. They can all come for sort of a on demand watch party. But can you do that through rumble? I don't know. Maybe. It sounds like it's something it feels like it's something we ought to be able to do or we could probably do some kind of we have a movie platform with the company, so we could probably do something like that. If it's not on rumble, we could do it. It's got to get into involvement all those people at IT, and all those guys. That's like going into there's a secret weapon which is 9 months to get that unnecessarily. We could ask there's one person I'm thinking of who I could ask, who's who can cut through the red tape? He's one of the big guys. You know I'm talking about. I know who you're talking about. He's one of the big guys. Yeah. All right. So that's the way to think about it. That might be, let's think about it. You know, if our listeners, if anybody has an idea suggestion, 'cause it would be fun to make this a win win. It is a scary sight to see me. Do you know how many baseball caps I brought with me to South Carolina because after this gets done today, I mean, if I go out to dinner, the open hearth, we got a lot of listeners here in the upstate to 94 5 the answer, I'm gonna look like you guys streaming a mile away with this stupid big bald shiny head I'm gonna have. Well, you have you have hair, obviously, but it's very short, so it won't look that much different look a little bit different. And I will tell you that doing it at a barbershop, fantastic. I just stay in my lane. Like this is back to self-awareness. I stay in my lane. A salesman on a business builder. I've done my whole life. I was an f. student at thirteen fourteen. My friends parents told my friends. Not hang out with me. Because i was a loser. I'm more successful than my entire graduating class. Combined like like this is because the market doesn't understand that people don't have to double down on your strikes and you have to punch your weaknesses in america. There's billions of dollars made on selling you how to fix the things that you're not good at. It's a huge mistake. You need to figure out who you are and go all in. That's what i did and so when you talk about business or marketing when you talk about the new york jets and when you talk about wine i've got nothing but bravado everything else you should see me sitting around dinner tables right now talking about politics the level of humility and the level of listening. You wouldn't expect from me because that's not how you're used to consuming me. I'm loud and proud. Because i only stay in my lane. Papery close attention. It's lucky the reason i've been able to kind of grow is my narrow thing is consumer behavior which i can deploy against anything so my narrow thing happens to be quite wide which allows me to play good investor. It allows me to run businesses. And it'd be a personal. It allows me to do things. But i don't remember from that you know. I don't talk about building product. I've been around. Start as well hold on. I don't talk about product. And i'm pretty good at you. I saw my williams and and and david carpenter tumbler. They always like give me good dabs behind the scenes that i'm good at it because it's a little consumer be. It's consumer behavioral kind of so good feels like to know how to lay on my liquor store. And that's how. I did well in commerce early on i just think about all i do. Is deploy empathy at scale. I'm i'm i'm an empathy machine. That's what i do. So so on the flip side for the people that do have self doubt that. I feel like i'm the most extreme purebred entrepreneur. I'm not the wrong personnel. I'm just over here. And i think the more you have self doubt is the further away you are from being a pure bred number one to run a company like everybody knows the media's multiple dictatorship right like you can sell me you just better fucking bring it because i've got fucking ideas you know so i don't yearn at all for but what that makes me think is this goes back to self awareness. Maybe you need a cope. Hunter may need to bring in a secondary since. You've already built something. Twenty percents co founder. If you're yearning for that that you shouldn't listen to gary saying fuck co-founder don't give a fuck a dictator. You should be like no no. This is what i'm feeling. And this is what i need. And who cares what anybody says about giving me things that make no sense to people on paper i gave jay fifty percent of intermediate when we started it all the leverage i was eleven years older i got all the clients i was the social media guy and he had fifty percents of business. Because i knew that's what felt right in the energy of our brother ship so i make decisions all the time i stole. I sold stephen. If you've never heard me i'd be like i'm not confused at eight percent of people in this guy. He's got a huge fucking ego. I get it. May vader media was built to build the machine machines. People the the organizational scale of me. So i intuitively feel like something was happening with snapchat in the summer and then i deployed people. The math nerds. She's and he's in my organization that loved math. That don't have intuitive dna. That don't like each you. That don't like people but boy they fucking love numbers and then i have them double check and call my bullshit but i moved before they come back because it's worth it for me to lose because i'm right which i've been right enough that i want to keep going the upsides incredible in the first mover landgrab of this stuff because it is a marketplace and they do move and they move fast. They move real fast. You just wake up. And it's over like i built my brand on twitter. I was at the top of the heap top. I'm devastated that. That's the one that kind of faded off from attention. But i've written articles two years ago about my concerns about this. You know it was happening. I can taste it back to be an actual practitioner. I knew that when i had fifty thousand followers on twitter and follow my boy neat thousand people would do it. And then i knew today with my one point two million.
