Ten years ago, justice Scalia was lamenting that the court had gone off the rails. What happened in a decade, where we went from a court that was insane and dominated by Sotomayor and Kagan and upheld ObamaCare is merely a tax, even though we know simply that that was an insane decision. We're ten years later, we now have restored constitutional sanity. What do you attribute the success to? I attributed this success to president Donald J Trump and Senate Republicans. President Trump in 2016 won an upset victory against Hillary Clinton in big part because he promised he would appoint constitutionalist Supreme Court Justices and federal judges who would follow the law instead of rewrite the law and what we saw with this Dobbs decision coming out was the culmination of that. It was because president Trump transformed the 5 to four John Roberts court to the 5 to four clarence Thomas court with the appointments of justices, Gorsuch, my former boss, justice Kavanaugh, who I helped lead through the Senate confirmation and then justice Amy Coney Barrett. Now mind you. None of this that you are seeing unfold is a mistake. The left is now going to put on their we must break up companies. We must regulate tech companies immediately. Why? Because of Donald Trump's truth social because of rumble and because Elon Musk buying Twitter. The fact they no longer control these companies is now a mandate for them to try to censor these companies. You see, they didn't want to break up Twitter. They didn't want to break up Facebook when they got what they wanted. When they got $400 million of money from Mark Zuckerberg to fund mail in ballots, they didn't want to break up Facebook. When Twitter was rejecting the Hunter Biden laptop story, they were perfectly appreciative of Twitter, but now CNN says, look, we need to regulate these companies. Play cut two. No, I think there's a bigger problem that when we focus on the personalities of people like Elon Musk and people say, oh, I think Glenn is thinking this or that. There's a bigger problem here about how we are going to control the channels of communication in this country. This is dangerous. We can't think anymore in this country. We don't have people. No, I'm serious. We don't have people in Congress who can make regulations that can make it work. I think we can look to the Western countries in Europe for how they are trying to limit it. But you need you need controls on this. You need regulation. You can not let these guys control discourse in this country or we are headed to hell. We are there. Trump opened the gates of hell and now we're chasing we need to control quote we need to control discourse in this country. "Me ask you a question, how likely is it that the final decision will be the same as the draft decision? Having clerked and having gone through that. Do you think now there's a chance that they change their mind or do you think that the draft was actually not a certain as we might have believed? Do you have any insight into that? Yeah, I mean, I don't have any insight into this particular case because I don't talk to justices or court employees including the clerks about current cases. That would be inappropriate but I will tell you just how the process is generally works is the first draft comes out and then the justices collaborate, which is an improved the draft. You maybe one of the justices and their clerks catches a mistake and they go through that editing process and it circulates for a long time. But circulates for several weeks and then the dissenting justices right there draft and circulated the concurring justices right their draft and circulate it, but I will say this if the intended effect was to get justices to change their votes, maybe waffling conservative justices to back away from a 5 or 6 vote majority to overturn roe versus wade and Casey, I think this leak is going to have the exact opposite of facts. Now justices can not condone this likely illegal behavior. They can not reward it by changing their votes. I think for judicial independence, they need to stay firm.

First of all, who could potentially do something like this, do we know who probably did this? And if so, what is the proper course of action to hold that person accountable? So I clerked for justice Gorsuch on the Supreme Court and I also served as the chief counsel for nominations on the Senate Judiciary Committee and my part of my portfolio was oversight over the federal judiciary. I have never heard anything like what happens with this leak. I don't think it's ever happens that a draft majority opinion for a Supreme Court case has leaked out prior to the court issuing the opinion, especially in a case this monumental. This is the Dobbs case where it looks like the at least 5, maybe 6 justices on the Supreme Court are going to overturn roe versus wade and Planned Parenthood Planned Parenthood versus Casey and return abortion regulations back to the states where it belongs. This is a stunning breach of protocol. Each of the 9 Supreme Court Justices have four law clerks, each of them have generally two to three administrative aids. It is a very small universe of people who have access to these draft opinions and these opinions have to circulate among the justices because they have to work together. They have to collaborate in order to draft majority opinions dissenting opinions and concurring opinions. And if you shatter that trust, if you shatter that secrecy that confidence in the Supreme Court, the Supreme Court can no longer function. Right. So who potentially could do something like a clerk or just someone in kind of that orbit and what could be done to hold this person accountable for leaking this decision. Well, like I said, there are very limited number of people who have access to these draft opinions that knight Supreme Court Justices, each of their four law clerks in each of their two to three administrative aides, maybe IT people, but I doubt it. There is an intranet system in the Supreme Court that's not even connected to the outside world. It's not connected to the Internet where they draft and circulate these opinions. So it looks like to me, if I had my hunch, I would say that a disgruntled ball clerk printed this and gave it to the political reporter. If you look at the, if you look at the draft opinion that political published, it looked like a printed and scanned opinion, it is a draft majority opinion by justice Alito. What I would do if I were the chief justice of the Supreme Court of chief justice of the United States has already ordered the Marshall of the Supreme Court to investigate this. The Marshall is a Supreme Court officer, this person is the head law enforcement officer for the Supreme Court. This person runs the Supreme Court police, the Supreme Court actually has its own police force of nearly 200 police officers. They can investigate this. If they need additional help, they can call in the U.S. marshal service from the Justice Department and deputize them to help with this investigation. The U.S. marshal service has worked very closely with the federal judges protecting them, protecting federal courthouses for over a century. So that's the most likely federal agency who could step in if needed. I would just caution that we do not want the political branch branches sticking their nose into this investigation without the court's permission because you don't want to set a press network Congress or the Biden White House or any other White House thinks that they can meddle in the internal on the internal operations of an independent branch of government, especially the Supreme Court. So I think the chief justice is going to get to the bottom of this. I think that through the Marshall, I think what they're going to do is they're going to interview every single one of these law clerks and employees, other employees, and they're going to, if they make a false statement to these federal investigators, it's a violation of 18 USC 1001, which is a felony. Whoever leaked this is in serious serious trouble. If it's a lawyer, they're going to get fired. They're going to get disbarred and they might be prosecuted. You could prosecute this person for potentially misuse or even stolen federal property. This did not belong to them to give out to a reporter. Another thing that you can look at is a potentially obstruction of justice. If you are leaking out a draft opinion for the purposes illegally leaking it for the purposes of putting political or illegal pressure on a Supreme Court Justice to change their vote on a pending case, that is obstruction of justice. Yeah, I mean, I agree with you. I don't want to see meddling from other branches of government, but hasn't that already happened. I mean, I find it hard to believe this person acted independently. Maybe they did. And they leak it to Politico, which is just suspicious in and of itself. And so the calculus here is maybe we can get enough angry people upset about the decision that the rancor will make the justices change their mind. I think that's the calculus here, which is basically a complete and total undermining of article three of the U.S. Constitution, the idea of an independent judiciary, if this, as it stands today, basically they're trying to make the judiciary independent no more. Isn't that right? Yeah, I mean, this is a direct inside job attack on the independence of the federal judiciary, including the highest court in the land. This is, this is a serious as it gets. You, like, it is, it is unheard of. It's unprecedented for a draft Supreme Court opinion to leak out like this. And these shatters trust, it shatters confidence. It is a direct assault on judicial independence and they must fine tune did this and they must hold this person accountable to the fullest extent of the law..

Sam darnold or with christian mccaffrey. Dj more but we know the is one of the best receivers in this class in. He is talented enough will were at some point career. He will get an opportunity probably sooner rather than later if not this year to really showcase what he can do and he has the talent to be a number one receiver. I love his size. I loved as a big bodied receiver. That's a great fan a red zone. There are a lot of good things about terrence marshall and so what i was saying earlier is the fact that not going to be good in the short term is almost a positive here for you as a dynasty are because now we're seeing him fall to the third fourth fifth round pick of the second round which is lower than it should be gone if anything. This guy should be going at the back half of the first half so now because the term concern that comes with marshall. Now you're gonna be able to go up there and gets terrorist marshall and you're not gonna have to reach from either he's probably just gonna fall right in your laps and you're gonna walk is one of the biggest winners in your dynasty graphs. Is that kind of situation in those leagues but in super flex it's a different ball game and in those leagues super flexi marcus mariota and joe flacco should be on rosters no question. They deserve to be drafted. If there if you're gonna start a draft or superplex someone's rostrum these guys. You can go. Choir them for the cheap because their backups to everybody But as he reflects you know it's gonna be a little more difficult just because of the fact that that team who who's roster and now knows that. And then they say the purchase the chances of percentage that you make the playoffs. Who do you think is the number one team in the national? Football league for projected wins and their chances to make the playoffs for this season. Well, Chris I'm not gonna lie the audience. I'm looking right at it. And it is the Kansas City Chiefs, you could just play along. They don't know looking at I don't act like you're smart truthful with our listeners Kansas City Chiefs, number one. I don't do bits FBI projects their win total the ten point three which I believe is under their win. Total in Vegas. I believe their windows at ten and a half. So they win ten point three games. "We're about three weeks from the NFL draft. It's been an interesting off season. If you were bears fan last season. It was interesting the bears gone out and done a lot of things this off-season than to talk about that and much much more. We bring in our guy NFL writer, Eric at home. Nice enough to jump on and Eric tonight. Everything's good. Yeah. It was just thinking these last three weeks for the drafter get a feel like any turn into here that always does every single year seems like it takes a long time here in Chicago. We've always been interested in the draft. Because usually the bears were bad a high draft pick. And now they were smart last year and traded pigs got gotta Khalil Mack. And now they've not picking until the third round unless they make a move. But I mean, I think it seems like all their other moves have been in you know, in free agency and bringing. Players in. So it's not nearly the draft excitement here in Chicago. Like, it was when just imagine if the draft was here, and it was no bears draft pick for you know, for the first day and a half down. Admit what difficult I think it would be legal to do that. The office. Like, let's about this. The bears probably will make their selection around nine o'clock. I think on Friday night. So you settle in. You know, maybe, you know, get some food get something to eat whatever it's going to be a while. I don't think they'll be moving up. They don't have a lot of picks. So yeah, it's gotta be patience is virtue for bears fans outside of kicker because kickers not real answer. When you talk about to what's the biggest need for the bears. Hang into the draft. It's a great question. You know, I think it probably, you know, I think what they did themselves. A lot of a good favor by refunding airless, you know, and just you know for a one year deal. Right. I would think running back has to be on that list. You know, I personally would like to see. Them. Get more death on the offense of line. And I think the secondary either corner or safety would be a spot they can look at and their few defensive action, the strap that I think could play, you know, cover the flight and also places safety. So there's some versatile guys in this great year for either position a corner safety, but it's deep enough where they could possibly get somebody there. So I would just, you know, spit balling kinda Dr throwing I would say those it's likely that they could be picking one of those three spots that eighty seven toys have you ever seen as I'm asking the question. I know we've all seen it. But have you? I was gonna ask you if you've seen the situation where teams running back like Jordan Howard performed relatively well and was light by many people. And but basically the head coach had no use form at this point. And that's why they ended up moving them. Yeah. I mean, obviously, totally different situation from what happened with Levy on bell. You know, those are the exceptions to the rule, but you know, it is one of those. Position where if you're not one of the elite top, you know, five or six guys in the league at your spot. You know, there's only so much teams willing to kind of sink into that dishing. I know that there have been back strapped in the top. You know, five ten picks several years, it's not gonna have this year. But it's happened. A lot in recent history or often more often than I would've expected. I know Todd Gurley got his big deal. I know other people have gotten pretty good money. That's dishing bell sign this off season. But there's a drop off, you know. And so I think if you're not special, you know, that maybe are deemed expendable depending on the system. And so you know, I can see both sides why they moved on. And I think they feel like with Mike Davis Torri Cohen, they add one more the draft. You know, maybe Ryan dollars trading Kampe preseason hero again or something like that. But you know, we'll see I think they will try to add at least one more. And then maybe an underrated free agent to add on top of that. Daryl. Patterson is. Is an interesting guy. But he's been an interesting guys come into the league. Other people have found out ways to use them and the patriots even lined him up in the backfield as a running back. Do you expect Matt Nagy to do that? Also, not only just swing passes and give them in and around and things like that. And also given the ball out of the running back position. Yeah. It's a great option. I think you know, the patriots really the first team to really unlocked at running ability. I mean like you said when he was in Oakland, you know, other places he was running those kind of gadget runs and things like that. But I mean, they line them up as a tailback and got buffalo game was it was crazy to watch. He had twenty something carries. And so, yeah, it was it was a strange thing to think about you know, a six to two hundred twenty pound receiver who could run like the wind lining up kind of power back. But he can do it. I think that really added to the appeal. He's the perfect Matt Nagy player. They'll run kick off, you know, he could be a wide receiver if you need to. I don't think he's more than. A number four. But still, you know, having that deeper out option is important. And I think that's you know, that kinda speed if Taylor Gabriel is out there, they may not have that exact replica that so it's different version of speed. And then as you said we saw last year that he can be running back, you know, in cut a break glass in case for -mergency situation. Seahawks quarterback. Russell Wilson wants a new deal. He gave the Seahawks April fifteenth as a deadline to get that deal done. Do you think he gets done in what type of deal? Do you think Russell Wilson who get from the Seahawks? So here's my hypothetical question here. Like what they let's say if April sixteenth by parents diversity, by the way. Let's. Let's say April sixteenth. They offer him. The richest TV deal of all time. You're gonna say oh sorry. The deadline. Hey, understand that this thing happened in January. We didn't really hear about it until very recently. But meeting his, you know, giving them a deadline, but you know, it just doesn't make a lot of stints. It's not a if something magical happens on that calendar day, not as some kind of contract, you know, bonus kicks in or anything else that would prevent them from getting this thing done, or if there's some kind of you know, league deadline or something like that. It's not July fifteenth and the franchise player, so it's just one of those kind of subtle threats from the from the Wilson camp saying, hey, don't forget about me, baby. You know, I still want to get my deal. I still want to get this thing done. You know, there's an opportunity for him to really cash in. And also kind of hold them hostage a little bit. I suspect it there's a good chance that gets done. But for months now there have been whispers that you know, maybe the Seahawks aren't quite prepared to pay him. What what a lot of people think he's worth it would at least entertain the idea of. What could we get you know, trade for him? Just theoretically, what would he get you know, is worth three first Thursay? We're still talking about a thirty thirty one year old guy. And there's still a handful of teams that really badly need that franchise different speaking quarterback. So I I don't know. I still think it's gonna get done 'cause that's city loves them. Even if a lot of past teammates were the biggest Russell Wilson fan. They know how much he means for the team another couple minutes with NFL writer, Eric at home and Erica week or so ago, rob gronkowski decided to retire. A lot of people on Twitter and everywhere else going, okay. The best tight end. Maybe you'll ever play the game has retired. Who's the best tight end in the NFL? Now who do you like? Yeah. I mean, that's a great question. To kinda depends what you want. So if you guys can do with grunk did which is being impact players blocker, and as receiver, you know. And and think about all the calls that were made against gronk over the years. He was kinda like the Cam Newton of the tight end position like say what that's not interference. Though, he just, you know, even with that work in Gascony was so special. I love the fact that Travis Kelsey can be as dangerous, you know, the last couple of years he's actually been a better receiver than gronk. No question about it. But he's not nearly the blocker that he is. You know, we see some of these young pass catching tight. I mean, George Kittle out in San Francisco at times has flashed like he could be the best to way tight in the league because he blocks his tail off. He's got great receiving chops. And really the only thing that's kind of held them back injuries. I don't necessarily think you can have a long career. So this might be one of those debate that we kinda have for years. I don't think there's any one guy that fills that checked off all the boxes like like gronk did. And he had injury issues too. But still when he was out there. There's really no doubt. And I don't know that that that one guy even though there are some great blockers. It's about staying receivers you rarely see both. Do you think that Jason Witten can still be productive? I don't know man this. I wanted to I know Jason Witten the player, it was outstanding. He was just so consistent day in and day. I knew what you're going to get from. He was probably, you know, he was unsexy version of gronk and that he could block and catch fast but a year off his age. I know they say they're going to come in just and all that. His feeling this thing could kind of turn south, and we could see 'cause he looked slow by the end when he was out there last time. He just wasn't the same guy. They would go with that person. Yeah. So whether or not it's trying to find a quarterback in this year's draft. Or or or planning for the future? Elsewhere. But like I don't trust him as Winston do.
