"It started from the day we came down the elevator. That was the way former president Donald Trump usually described the FBI's investigation of his campaign's ties to Russia. And former attorney general Bill Barr seemed to concur in that assessment. I think there's a spying did occur. Yes, I think spying did occur. So Barr directed U.S. attorney John Durham to investigate the FBI's investigation. Now, nearly three and a half years and more than $5.8 million later, Durham's investigation has come up empty. He lost the only two cases that went to trial. The second acquittal came on Tuesday when a jury found Igor danchenko, a Russian analyst, not guilty of lying to the FBI about where he got his information for the infamous Steele dossier. Joining me is Eric Larson, Bloomberg legal reporter. Eric tell us about danchenko. Igor danchenko is a 44 year old Russian business analyst based in the U.S.. He was hired by the former British spy Christopher Steele. I think a lot of people remember the field dossier. That was really at the center of this trial because Igor danchenko was the main source for providing details, including some very salacious and explosive details that made their way into the steel dossier, which then made its way eventually to the FBI. Mister gancho, for example, provided the pretty explosive claim in the dossier that there was a well developed conspiracy between Trump's campaign and the Kremlin. He also supplied the sort of salacious detail about Trump's alleged sexual behavior at a Moscow it's called in in 2013. None of those were ever proven, but that tip was never part of the charge. It was whether or not he lied about where he got that information. The Justice Department said he did and the jury did not agree. So the counts the jury considered were all about whether danchenko lied about one person and one call. That's correct. It was all about whether or not mister danchenko truly believed that an anonymous phone call that he got in 2016 from a tipster, the one who had the tip about the well developed conspiracy between the Trump campaign and the Kremlin, whether or not he truly believed that that caller was a guy named Sergey Milligan, who was the president of the Russian American Chamber of Commerce at the time. So he said in his FBI interview that he believed that to the person was, who had called and the FBI said not only do they believe that it wasn't in who called, but that the call never happened, but they didn't really present enough evidence to prove that. I don't know how you bring a federal case over what someone believed at the time. It seems awfully thin or stretching it. It did seem a bit thin after say the evidence that was presented. It wasn't very hard evidence it could go either way about whether or not he believed it. I mean, as we know back in May, the first case from his investigation to go to trial against former Clinton campaign lawyer, Michael sussman, also ended in acquittal. He was also charged with lying to the FBI about a Trump Russia tip. So to bring these narrow cases about telling what amount of fairly small lies, I guess you could say alleged lines that that's really what this is focusing on after all of this time and money spent is not a terribly good look for the special counsel, but you could also argue that he is doing the job that he was asked to do. The trial seems a little unusual, Durham personally took part and did he end up lashing out at some of his own witnesses? Yeah, he did question them a bit harshly. Some of the main witnesses were FBI agents who interviewed danchenko in 2017. And I think in particular when one said that bencho had actually been a valuable confidential human source, you know, if he got a little, I think snippy and the questioning and then of course in his closing arguments told the jury not to feel bad for the FBI because on the one hand, the FBI was portrayed in the case as being victimized by danchenko, but also he wanted to portray the FBI as being sloppy and making mistakes and essentially going after Trump's campaign on fairly. You know, prosecutors don't usually lose cases. It's unusual because if they're bringing a case, they think they have enough evidence to prove it beyond a reasonable doubt. Well, there's, of course, speculation that these trials were really about putting these FBI agents on the stand, whether or not that's a proper use of the federal criminal trial. Who knows? But that's what certainly a lot of dorms to own supporters. And Trump supporters have been saying, is that how these verdicts are beside the plane? Doesn't matter. It was exposing these FBI agents getting details of the investigation out in the open. But yeah, you're right, usually the government comes in a case like this with an upper hand. And usually they also come at it with a lot more evidence. So we'll see what his final report says and assuming it'll be pretty damning and mostly about the FBI. But I'm sure that there was some amount of pressure for him to bring some cases. Out of all this three and a half years, he's gotten one conviction, a guilty plea. There was one guilt please as former FBI lawyer who admitted he had altered an email that was used in part of the Carter page warrant application process and it was actually uncovered by the Justice Department's own internal watchdog rather than returns on investigation. So it's certainly been said by Durham critic, basically these cases, this whole investigation is sort of a remnant of the Trump administration sort of witch hunt attack on the investigation into him and Russia. They really said that John Durham is going to expose the deep state revealed a huge conspiracy to people at high levels. We're going to go down and things like that and clearly that hasn't borne out. pure and simple witch hunt This is a political witch hunt Which nobody's ever seen before It's a pure witch hunt It's a hoax It's a disgraceful situation It's a total witch hunt I've been saying it for a long time Former president Donald Trump has repeatedly called the Russia investigation a witch hunt a hoax a deep state conspiracy to frame him and special counsel John Durham was tasked with uncovering government misconduct during that investigation But after three years of investigating the investigation Durham's only case to go to trial was a prosecution of Michael sussman a lawyer for Hillary Clinton's 2016 presidential campaign on a single charge of lying to the FBI Lying not about a conspiracy but about the identity of his clients when he passed a tip on in September of 2016 And after about 6 hours of deliberations the jury found the prosecution hadn't proved its case and acquitted sussman I told the truth to the FBI and the jury rec clearly recognize that we're their unanimous verdict My guest is former federal prosecutor Robert mintz a partner mccarter in English This was Durham's first major courtroom test after a three year investigation How big a setback is this for him Well it's a huge setback for special counsel John Durham because this is the very first case that's gone to trial after three years of investigating whether federal agents to investigated the 2016 Trump campaign committed any wrongdoing So in a sense the special counsel's office had really put everything on the line in this case even though it's ultimately what is a fairly simple case which charged a single count of lying to the FBI So in a meeting with the general council of the FBI sussman presented research that he said suggested a possible secret back channel of communications between computer service for Russia based alphabet and the Trump organization but that wasn't what the issue was here The jurors had as you mentioned this really narrow issue to decide one false statement Tell us what that was Sure So the whole case turned on the simple question of whether or not sussman when he came to the FBI had the single meeting with the general counsel of the FBI whether he was there in his individual capacity as an individual citizen giving information to the FBI that affected potential national security issues or whether he was there on behalf of a client Now what the defense argued ultimately successfully was that it didn't really matter because the FBI would have done the same thing had they known that he was there on behalf of the Clinton campaign and ultimately the FBI did investigate the information and find out that it was without basis Let's usman said he was there at his individual capacity even though he was working for the Clinton campaign at the time And the defense also argued that it was well known that Susan had worked for democratic organizations and for the Democratic Party And so the fact that he was tied to the Democrats was well known to the FBI at the time they received the information So whether he was actually acting on their behalf at that moment didn't have a material impact on how the FBI treated that information We will go back to that materiality in a moment but the case depended on the testimony of one witness James baker who was the FBI's general counsel when he met with sussman alone and he took no notes of that meeting So he had some credibility problems at the defense brought out That's exactly right And I think that was one of the reasons this was a very difficult case from the start because it was really one person's word against the other as to what happened at that meeting And as you mentioned James baker did not take notes So although his testimony was he was a 100% confident that sussman insisted to him that he was not acting on behalf of a client and that if he had known he was acting on behalf of a client he may have handled the conversation or the meeting differently The fact was the defense was able to impeach that testimony somewhat by pointing out that speaker had said in various times that he didn't remember certain parts of that conversation And when he took the witness stand he said he could remember a 116 times when the defense task in questions And so his testimony wasn't rock solid and ultimately the defense was able to make a big issue of the fact that this entire case was really turning on the question of what happened at a brief 30 minute meeting more than 5 years ago I think the jury ultimately looked at this case and decided that it was more political than criminal and that's why they ultimately acquitted assessment after this trial in only a day and a half of deliberations Let's talk about materiality because part of the reason why this was an uphill battle is that the prosecutor had to convince the jury beyond a reasonable doubt not only that sussman lied to baker but that the lie was material enough to influence the FBI's actions or decisions The testimony from baker again was critical on this point because he testified that had he known that sussman was acting on behalf of the Clinton campaign He may not have taken the meeting at all or he would have treated the information differently That was the government's proof that it was material Now in response the defense made it compelling case that the FBI was well aware that Michael sussman had worked on behalf of interest for the Democratic Party in the past And so whether or not he was acting on behalf of the Clinton campaign at the time he was at that meeting was really not a material factor So I think at the end of the day one of the problems the prosecution had.

"Brian chuck This is Bloomberg law with June Grasso from Bloomberg radio I've been talking to former federal prosecutor Robert mintz about the acquittal of Michael sussman Bob prosecutors use the case to try to put forward a larger conspiracy theory And in the closing arguments the defense attorney denigrated that effort Sean berkowitz said the prosecution was trying to turn a 30 minute meeting more than 5 years ago into a giant political conspiracy theory Apparently that was pretty effective because the jury for woman said the prosecution never should have brought this case Do you think that it hurt the prosecution to put this in context or did they have to put it in context Well that was the buying the prosecution ultimately was in it from the start in this case because on the one hand prosecutor said this case is not about politics It's about telling the truth It's about whether assessment lie to the FBI in order to get that meeting when he said that he was not acting on behalf of a client But ultimately it was about politics And they had to go back to the scene that this was really an attempt by the Clinton campaign to try to get the FBI to investigate this alleged tie between the Trump organization and this Russian bank And then leaked that information to the media in the hopes that it would get out there in the final days of the campaign and affect the campaign in some way That was really what they were trying to suggest and ultimately I think the defense was able to turn that around on its head and say this is simply what's done all the time It's opposition research and they were also able to point out that there was some information from the Clinton campaign that said that they did not want these allegations to be taken up by the FBI at that point because they were concerned that a new story about the issue on the investigation might complicate the news stories that might come out about it So it wasn't entirely clear that it was in the interest of the Clinton campaign to have the FBI investigate it They simply wanted the news media to write about the potential leak because they thought that would have more of an impact on the election than an FBI investigation Sussman decided not to take the witness stand in his own defense Obviously in hindsight that was the right decision But what kinds of considerations would the defense have been weighing I think that was a very shrewd strategic decision by the defense because they did not want to make this trial about Michael sussman They wanted to make this trial about the inconsistent recollection of James baker And by not having sussman take the stand and recall what went on at that meeting the defense was able to focus the entire case about what James baker recalled about that brief 30 minute meeting that occurred more than 5 years ago on the fact that he took no contemporaneous notes and was simply recalling from memory what was said at that meeting Pablo may ask you this since you were a prosecutor for so long isn't it like a matter of course for FBI agents or people in the FBI to take notes when they're interviewing someone like that Well it was a bit of an unusual meeting because it was this phone call placed from assessment to the FBI general counsel This is not something that occurs on a daily basis and typically it would be something that would be handled by agents rather than by the general counsel But yes that is usually the practice of the FBI First of all to not meet with anybody alone So that seemed to be someone unusual that there would be only one person from the FBI at the meeting And secondly that there were no contemporaneous notes taken But at the time remember the meeting was simply to get information that the FBI may or may not use to launch an investigation So it's not completely surprising that there wasn't a full memorandum of that meeting but it is surprising that they were not at least contemporaneous notes that would have corroborated baker's testimony about what sussman said to him as to why he was there and who may have sent him Let's talk about materiality because part of the reason why this was an uphill battle is that the prosecutor had to convince the jury beyond a reasonable doubt not only that sussman lied to baker but that the lie was material enough to influence the FBI's actions or decisions The testimony from baker again was critical on this point because he testified that had he known that sussman was acting on behalf of the Clinton campaign and acting on behalf of his tech executive He may not have taken the meeting at all or he would have treated the information differently That was the government's proof that it was material Now in response the defense made a compelling case that the FBI was well aware that Michael sussman had worked on behalf of interest for the Democratic Party in the past And so whether or not he was acting on behalf of the Clinton campaign at the time he was at that meeting or whether he simply had worked for democratic campaigns on the Clinton campaign in other contexts was really not a material factor In other words they knew that Michael sussman was not working on behalf of the Republican Party They knew that Michael assessment was not working on behalf of conservative elements in the Republican Party They knew that this is somebody who aligned himself with the Democratic Party And so whether or not he was acting officially on their behalf at that moment or not really wouldn't have made any difference in terms of how the FBI treated that information And of course ultimately the FBI took the information and investigated it and found out that there was nothing to the alleged connection between the Trump organization and this Russian bank So in essence the process worked regardless of where the information came from the FBI ran into ground and decided that there was nothing to it So I think at the end of the day one of the problems of prosecution had was convincing yours that this case really mattered that it really mattered whether or not he identified himself as working for the Clinton campaign at that moment since the defense argued the FBI was well aware that he had worked on behalf of democratic interest in the past And the prosecution couldn't get it around the fact that the FBI agent they put on the stand who initially investigated said that he wouldn't have done anything differently if he'd known the tip originated from a partisan source So one wonders what that kind of testimony why Durham even chose to bring this case And that's a great question I think that the special counsel looked at this case and thought that.
