"On April 26th I was going to cover this later but since you brought it up April 26th he had tweeted out Twitter lawyer Jim Bakker general counsel of the FBI when general counsel of the FBI personally arranged a meeting between the FBI and Michael sussman In this meeting sussman presented fabricated evidence in the alpha bank matter and keep in mind again April 26th He said add Elon Musk This is who was inside Twitter he facilitated fraud Elon responded to that on April 26th Quote sounds pretty bad dot dot dot So I don't think there's any question he knew who Jim baker was And I don't want to get into like four and 5 D chess because it just sounds dumb but I know Elon's not stupid And I'm wondering I'm just speculating you know to be fair I'm wondering if they weren't setting him up I mean it may sound crazy and feel free to laugh at me but I'm just wondering if they didn't know he was going to pull this but they gave him a shot to kind of do the right thing and he did it And here's why I say that Julie Maybe they knew they wanted to get rid of them and wanted to avoid some kind of wrongful termination suit And now that they know he did this the discovery of this closure if he does decide to sue would be humiliating for him Again if it's a stretch tell me you're not going to hurt my feelings but I can't believe he didn't know especially based on this tweet exchange with cernovich I think that is a brilliant assessment I never thought about that But of course Elon Musk is like super genius scary brilliant too So maybe he was just giving Jim Bakker enough rope to hang himself which he did because you know this to Dan These guys always get away with it They operate out of such a place of unaccountability in arrogance The gym baker really probably thought he could pull the wool over everyone's eyes and scrub this material any FBI culpability So maybe that is the case It's pretty humiliating and for Jim baker but you know he'll end up somewhere else These guys are in the business No

"It started from the day we came down the elevator. That was the way former president Donald Trump usually described the FBI's investigation of his campaign's ties to Russia. And former attorney general Bill Barr seemed to concur in that assessment. I think there's a spying did occur. Yes, I think spying did occur. So Barr directed U.S. attorney John Durham to investigate the FBI's investigation. Now, nearly three and a half years and more than $5.8 million later, Durham's investigation has come up empty. He lost the only two cases that went to trial. The second acquittal came on Tuesday when a jury found Igor danchenko, a Russian analyst, not guilty of lying to the FBI about where he got his information for the infamous Steele dossier. Joining me is Eric Larson, Bloomberg legal reporter. Eric tell us about danchenko. Igor danchenko is a 44 year old Russian business analyst based in the U.S.. He was hired by the former British spy Christopher Steele. I think a lot of people remember the field dossier. That was really at the center of this trial because Igor danchenko was the main source for providing details, including some very salacious and explosive details that made their way into the steel dossier, which then made its way eventually to the FBI. Mister gancho, for example, provided the pretty explosive claim in the dossier that there was a well developed conspiracy between Trump's campaign and the Kremlin. He also supplied the sort of salacious detail about Trump's alleged sexual behavior at a Moscow it's called in in 2013. None of those were ever proven, but that tip was never part of the charge. It was whether or not he lied about where he got that information. The Justice Department said he did and the jury did not agree. So the counts the jury considered were all about whether danchenko lied about one person and one call. That's correct. It was all about whether or not mister danchenko truly believed that an anonymous phone call that he got in 2016 from a tipster, the one who had the tip about the well developed conspiracy between the Trump campaign and the Kremlin, whether or not he truly believed that that caller was a guy named Sergey Milligan, who was the president of the Russian American Chamber of Commerce at the time. So he said in his FBI interview that he believed that to the person was, who had called and the FBI said not only do they believe that it wasn't in who called, but that the call never happened, but they didn't really present enough evidence to prove that. I don't know how you bring a federal case over what someone believed at the time. It seems awfully thin or stretching it. It did seem a bit thin after say the evidence that was presented. It wasn't very hard evidence it could go either way about whether or not he believed it. I mean, as we know back in May, the first case from his investigation to go to trial against former Clinton campaign lawyer, Michael sussman, also ended in acquittal. He was also charged with lying to the FBI about a Trump Russia tip. So to bring these narrow cases about telling what amount of fairly small lies, I guess you could say alleged lines that that's really what this is focusing on after all of this time and money spent is not a terribly good look for the special counsel, but you could also argue that he is doing the job that he was asked to do. The trial seems a little unusual, Durham personally took part and did he end up lashing out at some of his own witnesses? Yeah, he did question them a bit harshly. Some of the main witnesses were FBI agents who interviewed danchenko in 2017. And I think in particular when one said that bencho had actually been a valuable confidential human source, you know, if he got a little, I think snippy and the questioning and then of course in his closing arguments told the jury not to feel bad for the FBI because on the one hand, the FBI was portrayed in the case as being victimized by danchenko, but also he wanted to portray the FBI as being sloppy and making mistakes and essentially going after Trump's campaign on fairly. You know, prosecutors don't usually lose cases. It's unusual because if they're bringing a case, they think they have enough evidence to prove it beyond a reasonable doubt. Well, there's, of course, speculation that these trials were really about putting these FBI agents on the stand, whether or not that's a proper use of the federal criminal trial. Who knows? But that's what certainly a lot of dorms to own supporters. And Trump supporters have been saying, is that how these verdicts are beside the plane? Doesn't matter. It was exposing these FBI agents getting details of the investigation out in the open. But yeah, you're right, usually the government comes in a case like this with an upper hand. And usually they also come at it with a lot more evidence. So we'll see what his final report says and assuming it'll be pretty damning and mostly about the FBI. But I'm sure that there was some amount of pressure for him to bring some cases. Out of all this three and a half years, he's gotten one conviction, a guilty plea. There was one guilt please as former FBI lawyer who admitted he had altered an email that was used in part of the Carter page warrant application process and it was actually uncovered by the Justice Department's own internal watchdog rather than returns on investigation. So it's certainly been said by Durham critic, basically these cases, this whole investigation is sort of a remnant of the Trump administration sort of witch hunt attack on the investigation into him and Russia. They really said that John Durham is going to expose the deep state revealed a huge conspiracy to people at high levels. We're going to go down and things like that and clearly that hasn't borne out. Welcome to Bloomberg law. I'm June Grasso, heading this hour. The Supreme Court will not consider overturning a racist series of cases. The Trevor Milton guilty verdict comes with a warning from the Manhattan U.S. attorney, special counsel John Durham's investigation, fizzles out, and can just as you Brown Jackson shift the court's criminal docket. pure and simple witch hunt This is a political witch hunt Which nobody's ever seen before It's a pure witch hunt It's a hoax It's a disgraceful situation It's a total witch hunt I've been saying it for a long time Former president Donald Trump has repeatedly called the Russia investigation a witch hunt a hoax a deep state conspiracy to frame him and special counsel John Durham was tasked with uncovering government misconduct during that investigation But after three years of investigating the investigation Durham's only case to go to trial was a prosecution of Michael sussman a lawyer for Hillary Clinton's 2016 presidential campaign on a single charge of lying to the FBI Lying not about a conspiracy but about the identity of his clients when he passed a tip on in September of 2016 And after about 6 hours of deliberations the jury found the prosecution hadn't proved its case and acquitted sussman I told the truth to the FBI and the jury rec clearly recognize that we're their unanimous verdict My guest is former federal prosecutor Robert mintz a partner mccarter in English This was Durham's first major courtroom test after a three year investigation How big a setback is this for him Well it's a huge setback for special counsel John Durham because this is the very first case that's gone to trial after three years of investigating whether federal agents to investigated the 2016 Trump campaign committed any wrongdoing So in a sense the special counsel's office had really put everything on the line in this case even though it's ultimately what is a fairly simple case which charged a single count of lying to the FBI So in a meeting with the general council of the FBI sussman presented research that he said suggested a possible secret back channel of communications between computer service for Russia based alphabet and the Trump organization but that wasn't what the issue was here The jurors had as you mentioned this really narrow issue to decide one false statement Tell us what that was Sure So the whole case turned on the simple question of whether or not sussman when he came to the FBI had the single meeting with the general counsel of the FBI whether he was there in his individual capacity as an individual citizen giving information to the FBI that affected potential national security issues or whether he was there on behalf of a client Now what the defense argued ultimately successfully was that it didn't really matter because the FBI would have done the same thing had they known that he was there on behalf of the Clinton campaign and ultimately the FBI did investigate the information and find out that it was without basis Let's usman said he was there at his individual capacity even though he was working for the Clinton campaign at the time And the defense also argued that it was well known that Susan had worked for democratic organizations and for the Democratic Party And so the fact that he was tied to the Democrats was well known to the FBI at the time they received the information So whether he was actually acting on their behalf at that moment didn't have a material impact on how the FBI treated that information We will go back to that materiality in a moment but the case depended on the testimony of one witness James baker who was the FBI's general counsel when he met with sussman alone and he took no notes of that meeting So he had some credibility problems at the defense brought out That's exactly right And I think that was one of the reasons this was a very difficult case from the start because it was really one person's word against the other as to what happened at that meeting And as you mentioned James baker did not take notes So although his testimony was he was a 100% confident that sussman insisted to him that he was not acting on behalf of a client and that if he had known he was acting on behalf of a client he may have handled the conversation or the meeting differently The fact was the defense was able to impeach that testimony somewhat by pointing out that speaker had said in various times that he didn't remember certain parts of that conversation And when he took the witness stand he said he could remember a 116 times when the defense task in questions And so his testimony wasn't rock solid and ultimately the defense was able to make a big issue of the fact that this entire case was really turning on the question of what happened at a brief 30 minute meeting more than 5 years ago I think the jury ultimately looked at this case and decided that it was more political than criminal and that's why they ultimately acquitted assessment after this trial in only a day and a half of deliberations Let's talk about materiality because part of the reason why this was an uphill battle is that the prosecutor had to convince the jury beyond a reasonable doubt not only that sussman lied to baker but that the lie was material enough to influence the FBI's actions or decisions The testimony from baker again was critical on this point because he testified that had he known that sussman was acting on behalf of the Clinton campaign He may not have taken the meeting at all or he would have treated the information differently That was the government's proof that it was material Now in response the defense made it compelling case that the FBI was well aware that Michael sussman had worked on behalf of interest for the Democratic Party in the past And so whether or not he was acting on behalf of the Clinton campaign at the time he was at that meeting was really not a material factor So I think at the end of the day one of the problems the prosecution had.

"Brian chuck This is Bloomberg law with June Grasso from Bloomberg radio I've been talking to former federal prosecutor Robert mintz about the acquittal of Michael sussman Bob prosecutors use the case to try to put forward a larger conspiracy theory And in the closing arguments the defense attorney denigrated that effort Sean berkowitz said the prosecution was trying to turn a 30 minute meeting more than 5 years ago into a giant political conspiracy theory Apparently that was pretty effective because the jury for woman said the prosecution never should have brought this case Do you think that it hurt the prosecution to put this in context or did they have to put it in context Well that was the buying the prosecution ultimately was in it from the start in this case because on the one hand prosecutor said this case is not about politics It's about telling the truth It's about whether assessment lie to the FBI in order to get that meeting when he said that he was not acting on behalf of a client But ultimately it was about politics And they had to go back to the scene that this was really an attempt by the Clinton campaign to try to get the FBI to investigate this alleged tie between the Trump organization and this Russian bank And then leaked that information to the media in the hopes that it would get out there in the final days of the campaign and affect the campaign in some way That was really what they were trying to suggest and ultimately I think the defense was able to turn that around on its head and say this is simply what's done all the time It's opposition research and they were also able to point out that there was some information from the Clinton campaign that said that they did not want these allegations to be taken up by the FBI at that point because they were concerned that a new story about the issue on the investigation might complicate the news stories that might come out about it So it wasn't entirely clear that it was in the interest of the Clinton campaign to have the FBI investigate it They simply wanted the news media to write about the potential leak because they thought that would have more of an impact on the election than an FBI investigation Sussman decided not to take the witness stand in his own defense Obviously in hindsight that was the right decision But what kinds of considerations would the defense have been weighing I think that was a very shrewd strategic decision by the defense because they did not want to make this trial about Michael sussman They wanted to make this trial about the inconsistent recollection of James baker And by not having sussman take the stand and recall what went on at that meeting the defense was able to focus the entire case about what James baker recalled about that brief 30 minute meeting that occurred more than 5 years ago on the fact that he took no contemporaneous notes and was simply recalling from memory what was said at that meeting Pablo may ask you this since you were a prosecutor for so long isn't it like a matter of course for FBI agents or people in the FBI to take notes when they're interviewing someone like that Well it was a bit of an unusual meeting because it was this phone call placed from assessment to the FBI general counsel This is not something that occurs on a daily basis and typically it would be something that would be handled by agents rather than by the general counsel But yes that is usually the practice of the FBI First of all to not meet with anybody alone So that seemed to be someone unusual that there would be only one person from the FBI at the meeting And secondly that there were no contemporaneous notes taken But at the time remember the meeting was simply to get information that the FBI may or may not use to launch an investigation So it's not completely surprising that there wasn't a full memorandum of that meeting but it is surprising that they were not at least contemporaneous notes that would have corroborated baker's testimony about what sussman said to him as to why he was there and who may have sent him Let's talk about materiality because part of the reason why this was an uphill battle is that the prosecutor had to convince the jury beyond a reasonable doubt not only that sussman lied to baker but that the lie was material enough to influence the FBI's actions or decisions The testimony from baker again was critical on this point because he testified that had he known that sussman was acting on behalf of the Clinton campaign and acting on behalf of his tech executive He may not have taken the meeting at all or he would have treated the information differently That was the government's proof that it was material Now in response the defense made a compelling case that the FBI was well aware that Michael sussman had worked on behalf of interest for the Democratic Party in the past And so whether or not he was acting on behalf of the Clinton campaign at the time he was at that meeting or whether he simply had worked for democratic campaigns on the Clinton campaign in other contexts was really not a material factor In other words they knew that Michael sussman was not working on behalf of the Republican Party They knew that Michael assessment was not working on behalf of conservative elements in the Republican Party They knew that this is somebody who aligned himself with the Democratic Party And so whether or not he was acting officially on their behalf at that moment or not really wouldn't have made any difference in terms of how the FBI treated that information And of course ultimately the FBI took the information and investigated it and found out that there was nothing to the alleged connection between the Trump organization and this Russian bank So in essence the process worked regardless of where the information came from the FBI ran into ground and decided that there was nothing to it So I think at the end of the day one of the problems of prosecution had was convincing yours that this case really mattered that it really mattered whether or not he identified himself as working for the Clinton campaign at that moment since the defense argued the FBI was well aware that he had worked on behalf of democratic interest in the past And the prosecution couldn't get it around the fact that the FBI agent they put on the stand who initially investigated said that he wouldn't have done anything differently if he'd known the tip originated from a partisan source So one wonders what that kind of testimony why Durham even chose to bring this case And that's a great question I think that the special counsel looked at this case and thought that.

Everything You Need to Know About Hillary Clinton's Spygate
"So John Durham files this motion, basically accusing Michael sussman who's been indicted for a line to the FBI of a conflict of interest. Now, why this was filed when it was filed is a question that cash Patel is going to answer for us later this hour. I'm not exactly sure. We could speculate, but I'm going to tell you what's in it, and I'm going to tell you some of the immediate takeaways. So in this filing, so many of the suspicions that we've had all along came to light. Now, you heard Donald Trump say many times. They spied on my campaign. They spied on my campaign. So we thought that that was limited to the fisa court application, which was a big deal, by the way. Using the fisa domestic courts to try and obtain a warrant to spy on a presidential candidate, a la or via Carter page was a massive violation of the Fourth Amendment constitutional orthodoxy and due process as we know it. And that story has been unraveling for a couple years. It's been drip drip drip leak leak leak. And without John Durham we'd never get to the bottom of it. But to be honest, I thought that was kind of the extent of it. I thought we had this kind of all mapped out. We had Hillary Clinton that paid fusion GPS multiples of millions of dollars, that money was then used. To try and concoct the Russian narrative, we know that there was involvement with that Russian woman who pretended to be in charge of an adoption agency who came and met with Donald Trump Jr. meetings were a big part of this. This was a collusion scheme. We know that. But what we suspected and what we didn't know was the extent of what Hillary Clinton did personally to continue this operation. So what we have is a timeline issue. You see the other side would say, yeah, okay, they tried to get a fisa warrant, but it's because there was a lot of intelligence and they'd created this dirty dossier and, you know, and then Trump became president and then we left it at that. But it's much deeper than that. And it's so. It's so reprehensible what these people did.

What Can We Expect Next From the Durham Investigation?
"What can we expect from this point forward? So is Durham wrapping up his investigation? There's still some skeptics out there, cash. There's still some cynics. Hey look, there'll be a couple process crimes, but don't hold your breath. You're not going to get a Comey. You're not going to get a struck. You're not going to get a page. You're not going to get him a cave. You're not going to get anyone from the senior level of the Clinton campaign. What do you think? Look, I've run these massive conspiracy, massive national security cases, and they take two. I spent two three four years on some cases. John Barnes in his second year. "Just to kind of sum up where we are now. This break in the SPI geh case on Friday was important because it shows Hillary Clinton working with the FBI and a group of attorneys to fake these connections between Trump and Russia. And it shows an FBI more than willing to take the information in and eager and looking for an excuse to get in front of a judge and say it was real and the problem is, they kept flooding the zone. Hillary Clinton, with all of these sources say Trump's colluding with Russia whatever, and they kept telling the FBI they were working with the DNC and Hillary And it created a problem for the FBI because they couldn't tell a judge that So they needed a clean source. They needed a white knight to come in there. Someone clean as the driven snow with a clean C B. Oh, no, no. These people are just in here to tell us about Trump. They have no ulterior motives whatsoever. How do we know that? Because we know On September 19th of 2016 this white knight showed up. According to the allegations, the FBI and the indictment on Friday Michael Sussman, who is a lawyer working with Mrs Clinton, this is why I'm telling you, it's a bigger deal than you think. This guy is connected to everyone. There's no way John Door, um, locked him up for nothing. So he comes into the FBI office. And he says, I have information about Trump colluding with Russia. And according to the allegation, he says, Oh, I'm not working with anybody. I'm not here on behalf of any client. I'm just here giving you potential information about a criminal conspiracy. And the FBI is like yes, finally. Finally The FBI is like this is just great. We gotta sources clean. We can put his information down in a fight application. We can spy on Trump and we won't have to lie and tell a judge, you know, uh, cover up for Hillary Clinton or anything like that. So, it says. In the end I and the FBI's press release that suspects showed up September 19th 2016. Why is this suspicious? No, no, I'm not working for anyone. They felt like they had it. How do I know the FBI is in on this? What I think. Let me read to you a piece of this footnote here. From the Horowitz report. The only express direction. We found that Andrew McCabe, who was the deputy director at the time gave regarding the use of a confidential human source concerned. A former confidential human source who contacted an FBI agent FBI Field office in late July. 2016 to report information from a colleague runs an investigative firm hired by two entities, the DNC as well as another individual to explore Donald Trump's long standing ties to Russian entities. So in of this part, one of the footnote, McCabe, the deputy director of the FBI knows that people are piling into FBI offices as early as July of 2016 who are working for Hillary and the DNC. Got it. The former confidential human source also gave the FBI agent a list of individuals and entities who surfaced in the firm's examination of Trump, which the former CHS described as mostly public source material. "Hillary Clinton want to set up Donald Trump for the fake Russian collusion thing Big break on Friday. Obviously, one of the lawyers involved in this propagating this collusion fairytale working with the Clintons gets indicted. Big story. Now we start to see what happened. It's clear the FBI was not fooled by the Russian collusion that they were part of it. They were just looking for someone to walk into their office who was credible enough that they could put the information down in a charging document or a fighter application and say, Hey, we heard this from Joey Bag of Donuts. He's credible. And what's the problem? The people who kept coming into the office in New York and London and elsewhere and saying, Hey, got information on these trump guys in the Russians all kept saying, Oh, and by the way, we're working with Hillary Clinton. So DOJ hears their release their indictment from last week of this lawyer, Michael Sussman, Right, pay very close attention to these dates. As alleged in the indictment on September 19th Michael Sussman met with FBI general counsel uh, in in Washington. Sussman had requested the meeting to provide the general counsel with certain data files and white papers that allegedly demonstrated covert communications channel between Trump and this Russian bank. Alfa Bank. It was all made up, folks. Assessment. This is the key line who had previously represented the DNC in connection with the Khyber, A cyber hack falsely stated to the FBI general counsel that he was not bringing these allegations to the FBI on behalf of any client. Finally, in sun, September, mid September, September, 19th someone walks into the FBI who at least claims to not have any of these conflicts. Now the FBI is I go. We got it out. While denying connections to the campaign, the Clinton team denied involvement in the creation of the steel dossier through the 2016 campaign. Despite direct media inquiries. It was only after the election that mysterious expenses for its legal counsel led reporters to discover the truth. The payments for the dossier were masked as legal fees among the 5.6 million paid to the law firm. According to New York Times reporter Ken Vogel. Elias categorically denied involvement in the anti trump dossier. When Vogel tried to report the story. He said. Elias pushed back vigorously saying you or your sources are wrong. Times reporter Maggie Haberman later wrote that quote folks involved in funding this lied about it. And with sanctimony for over a year. According to the indictment, suspend told the truth and contradicted what he originally told the FBI general counsel when he was interviewed under oath. In December of 2017 before the House Permanent Select Committee on Intelligence, telling them he did not hold the meeting of his own volition. But at the request of the client So the whole point is here is not even the indictment of whether he would be found guilty of lying from what I can see. And you and I were discussing this on Friday. I don't think it makes a difference here. It's still sets the story that the Clinton campaign Paid for all of this. Yeah, and Sussman when he when he, uh, was interviewed under oath in 2017 told the truth and said No, he didn't do it on his own volition. But at the request of the of a client Well, Do we know that that client Did he admit that he admit who the client was? Did they ask him? We don't know. Notably another Clinton figure pushed the Alfa Bank conspiracy. It was Jake Sullivan, who now weighs intelligence reports for President Biden as his national security advisor. Sullivan, a senior policy adviser to Clinton, declared in an official campaign press statement that the Alpha Bank allegation could be the most direct link yet between Donald Trump and Moscow and portrayed it as a work of independent experts. And by the way, in terms of which client it would be The only thing that we have to go on is according to the indictment, the hours were billed to the Clinton the Clinton right. Exact campaign Exactly. And here's but here's the interesting thing, though, where you tie it all together. Gags. There's so many Different paths here. It was only last October, for instance, that we learned that then President Obama was briefed by his CIA director, John Brennan, on an intelligence report that Clinton planned to tie then candidate Trump. To Russia as a means of distracting the public from her use of a private email server. That was on July 28th 2016 3 days before the Russia in investigation was initiated. Okay? We have to go back. Remember the Bret Bear story that he got burned on that his sources told him there was a pending indictment coming down on the Russian are not on the Russian on the Hillary email thing. Yes. And hours after he aired that on Fox that story on Fox News. We said, Well, you better be right. Otherwise you're going to get you know you're gonna get burned. We don't know if his sources lied to him or his sources were wrong and told the truth to him. We don't know what happened. But it's interesting that they make the point here. That This, you know, in part was this distraction? Of the whole email thing. You know, I'm wondering. What attempts there may have been To get this out there. Sooner. Right to Were there any attempts by anyone else, you know, set assessment aside. The lawyers aside. Um anyone else to go to the FBI and say, Hey, there's a link between Trump and the Russians. Before. What happened in September 2016. And then take that to the media. And say, you know again, you know the FBI. I mean, that would be the ultimate goal. But the FBI is going to have to have An investigation going, They're going to have to have something going. And the Alpha bank thing seemed to be the only thing for whatever reason. You know it. It The FBI took it, and then they did look into it again. Eventually, they saw that there was nothing there and they dropped it. But it doesn't need to go on. Well. It only needs to go on in that case until through November, 8th, which was election day to keep the cloud hanging, but it went on further. Of course, as we know, as the Russian hoax thing went on for years. But I really wonder what other attempts Were made. To make this thing happen because you know, by the time you get it The Jake Sullivan, Uh, and Hillary tweet that came out October 31st. You're talking, You know, a little over a week from The the the actual Election Day. Uh, certainly there had to have been other attempts to to build something or did they just have nothing? And this was the You know, the biggest thing that caught fire I would love to love Love love. To know more about this entire attempt because I have to believe If you were willing to do this This wouldn't have been a first. Well, we're ready now. And that's why Richard Grenell stating. Oh, no, no, no. There's a ton of other people that lied under oath.
