Just the evolution of everything. When i played in one ninety four to nineteen ninety-seven didn't even cross my mind right when i saw my jersey hanging in the bookstore and people wearing it around. I just thought town. That's so cool or or my likeness on a video game. The nc double a football video. Game i just thought that was really cool but people realize how much money is being generated and the nc double a. After being spurned by the supreme court had no other decision than to approve an interim policy that removes restrictions from athletes hoping to earn unprecedented money. Yeah the ncwa was really in a bind. And obviously you know ryan your you had a tremendous college career and the chance to go pro afterwards but think of all your teammates who were just a notch below you write. That never had the pro career. But we're really good in college that could've could've generated significant earnings while while in school their their one chance to make money essentially in their sports. So this will open the door for athletes football players but gymnasts and others especially those significant social media followings and as you noted this the nc double it was in a tough spot. After the supreme court's unanimous ruling. The ncwa could have gone to court in every state. Where and i'll statute was gonna take effect on. July one or governor's executive order. But that was i. Think about fourteen states and they'd have to get a restraining order in every state it just would have been real real tough for them to pull that off and they obviously weren't in the fighting mood after the supreme court ruling so they they capitulated. They allowed A policy that for years they had opposed and now in every state college. Athletes can sign endorsement deals but also do things like sponsor camps and get paid to do an autograph and things that may not make a ton of money but provides some money. yeah. I talked about it all week. on my radio show about how After my scholarship check. If my parents wouldn't have helped me pay my rent in college. I would have had no money. There was no way for me to to take a job. There was no way for me to afford anything else. So for those of you that think this is about millions and millions of dollars is not this could literally be about two hundred and fifty bucks a month extra forgot for guys and gals were living on campus. That will help them through a a month with food and and other things are just to enjoy themselves while they're in college it's it's something that was inevitable and it was something that had had to come down the pipe. Yeah and like you say it could be two hundred fifty bucks. We're seeing a lot of companies. Get pretty good publicity. probably for what. They're spending on an endorsement. By by linking up with athletes. Who maybe aren't well known outside of their college campus. I i've seen a number of athletes who i admit. I haven't really heard of before until seeing that they sign these deals and i think that that's just a sign about how there are so many different opportunities for different athletes. Even if they're not huge names even if they're not on espn and not going to a pro league draft they still may have value or at least sort of attraction in in their communities. Or they've somehow cultivated a big following on social media those with significant instagram following Following amounts have done really well so far so yeah it'll be it'll be a new new set of opportunities that will reward different kinds of athletes and we're used to seeing work. I think a lot of people saw this as a doomsday. I think anybody does. People fear the unknown that fear change always is always worked our whole life this what college the sanctity of college football or or college. Athletics and the amateurism part of it. No matter how some of the tragic stories of people lose eligibility inabilities to to be a part of their team or losing. Let's say the heisman trophy. Like reggie bush whose whose family was compensated for for what his son's name image and likeness was about For those peop- for those people out there that see this as a doomsday. You probably have a better understanding that like this. This isn't going to be as lucrative a lot of people that there may be a few players. You talked about me during my time in college. I had a pro career. After that there are others who their their highest possible. Marketability may be during those four years in college and now their ability to maximize that to profit off. That can be really life changing. It could give you a job out of college. It could give you a purpose moving forward. These are a lot of positives that can lead these young men and women out of college than before they they didn't have. Yeah that's exactly right because it's easy to dwell on You know you were the number two pick in the nfl draft right. You were a superstar in college. What about the others. What about those that don't have that sort of projection after school into a pro career and this will allow those athletes. Chances that they they literally will have no chance to make money on sports other than while in college because it will end when college and and you know the doomsday Sort of fear. One is that. I just don't think it's true at all. I think most fans will be okay with college. Athletes signing endorsement deals or getting paid to sponsor a camp back home. Doing things like that. That is hardly sort of a major transformation of college sports at least in my view and.

"They've been in congress for the last two years trying to get that special protection from them so in a way that could be the sort of silver lining here the state loan. How we've been telling you that if you don't give us antitrust protection we're gonna get sued into oblivion and look what's happening. The supreme court has opened the door every anti-trust lawyer to ran a suit against us. If you don't protect us now were we're going to go away and as unpopular as the ncaa is even more unpopular than congress. I do think many members of congress still love college sports and don't want to see their college. Football team in college team destroyed. Not that i think it would destroy it. But i think plenty of people in congress particularly republicans have shown that they still have that in this solid and that reverence for college sports so it may be needed congress's their best bet but you talk about that nostalgia. For college sports. We also see politically very popular to support college. Athletes right now the bill. Nfl bills in congress as you guys know are the horde we've got. We've got a rubio bill. We've anthony gonzales bill. All these competing bills so while we have the state laws going into effect next week we don't with the. Ncaa is gonna do. We still have this mash of bills in congress. Mike where do you think that goes and could these bills. Beat we keep talking about narrow versus broad. Maybe one of those like the booker. Bill that involves a lot of health and safety. What would you pass or handicap in congress and win. Yeah i am more skeptical than gave congress intervening I just the sense. I get is at. There's a pretty healthy divide between those that seek no changes in those that want a broader instrumental reforms. That senator booker senator murphy and some others have proponents. I don't see a middle ground at this. Maybe that will change. It gave doted that once there's more litigation once there's disruption circumstances on the ground could change and that could lead congress to act but they had a chance here to act and they didn't and the first name image and likeness federal. Bill was in march of twenty nineteen past committee. None had here. None had a vote so that the track record is is discouraging for reform. And i also think there's reason to think that some of the proposals are maybe geared towards getting media attention that are not necessarily proposed in a way that that the person thinks that they're likely to pass especially in congress so evenly divided where the two parties seem like. They're pretty hostile position. So i i'd like to congress could act. I would think that's the best solution to be perfectly honest for. The reasons gave noted. But i don't know some recesses coming then we get september than who knows what will be happening in a country with issues this issue could get is important to us. Maybe not as important others so yeah. I don't know everybody's not talking about sports law. That was crazy is an you guys noticed as well as anyone. Even during the height of the pandemic congress stole holding hearings on name image and likeness rushing to get lost name image and likeness. And it is whether it's to grab headlines or because they wanna meet the athletes so the athletic directors wanna be the ones who staved college sports. I just i. It still feels like to me and mike very wealthy right. Wouldn't surprise me if if congress doesn't act. I think it's always safer to bet that congress won't get something done then they will get something done but given that. There is bipartisan support for greater athlete rights which is just a massive change from where we were ten years ago the fact that republicans and democrats wanna get called out more rights. And and i even before we talk about what this is about I would like to talk about the gravity of this moment That will appear that will occur tomorrow morning as you so eloquently described in your piece football. Thanks for having me on and thank you for the kind words about the piece. The the gravity of this moment is everything we know about college sports in terms of how is compensate. Athletics will come under question tomorrow at ten. Am eastern and the supreme court because the justices are going to ask. Why is it that the nc double a. And its member. Schools agree to limit what schools can pay college athletes. So they they don't agree on limiting what they pay coaches and athletic directors money for stadiums but they agree on what student athletes can. Get that question. I it's a. It's a question that the ncw has to be worried about because somebody could come to the conclusion that if schools aren't competing in other ways why are they conspiring when it comes to football players and basketball players. Anyone who's ever read constitutional law knows that these are very complex cases when they are determined and adjudicated but they usually start out with a very simple question or premise. In this particular case what is it very basically paul. It's whether or not colleges through the nc double a. Can agree to limit compensation a student athletes. That's the core question. And the the reason why it's a legal issue is because under antitrust law businesses can't conspire in ways that hurt the market

"Perhaps the most important moment of this month from a sports standpoint could be in washington. Dc at the supreme court. That's when the much-heralded landmark potentially landmark case will be heard oral arguments will be hurt and there's a lot of controversy going on right now and our next guest is going with with with michael mcmahon. Has shed some some light on that. A friend of the court brief an amicus brief was filed recently in this case the nc. Double a. vs austin and it was discovered by our next guest and his colleague that what these athletes have done may end up hurting more than helping daniel limit joining us. And it's really great to have you on david. Thank you so much. We we've talked in the past with michael mccann. Both of you have really uncovered quite an extraordinary story. Here good afternoon and is a gentle way possible explained of those of us who don't understand this stuff as well as you what this is all about well first of all. Thanks so much for having me on the program. It's a it's an honor. Um yeah as you as you sort of previewed There was a group of former college. Athletes who on february eight filed in the meekest brief which is also called a friend of the court brief in the end of the blame. The allston case This was the eighth emeka. Brief that was filed in this case. But it was probably the most interesting and possibly the most impactful because this was the only breach that was being written and signed off on by actual former college athletes others. Who had weighed in on this. Were economists and law professors and subject matter experts but you know offensively. The people who would have been impacted by changes to the restrictions in compensation or scholarship limits while they were still in school and they were voicing their support for the incident which was kind of interesting because the caption of the case is the blake. The allston allston is shown. Allston the former west virginia running back. Who's the The name on a on a class of of former college athletes. And so you know curious. Who are the athletes who are actually standing up for being simple a and so a couple of weeks ago i started calling around and and reaching out to the eighteen athletes who had signed off on this brief two thirds of them are former olympic athletes But six of them are former major sports athletes. Five of them played basketball in college. And one of them is darren. Mcfadden the star football player for arkansas. Who had a kenya year. Nfl career retired in two thousand seventeen. And those are the ones who i thought. Were most interesting. Because those are the ones from the revenue that the so-called revenue generating sports who you'd think would have the most to gain By changes to the restrictions of Of compensation and In calling around Particularly with mcfadden who is kind of the marquee name used by far and away the most high profile of the former college athletes to sign onto this brief Occurred to me in our conversations with a few of them mcfadden included that their words didn't exactly square with what the brief said that when i was asking them. Sort of what motivated their position on the issue of amateurism What led them to to join us brief. They were kind of making better arguments for the plaintiffs for the players for the allston side than they work for. The incident lay And then through additional reporting and and and you know continuing to interview them it really raise questions whether or not they knew exactly what they were signing onto in the first place and whether or not their perspectives on college sports and amateurism aligned with the incident. Belay at all The las firm. That's filed this brief Is a major international law firm. It's called orc. They've done worked previously for the aa. So this was a serious brief filed by serious group of lawyers but it seem like some of their key voices And and their biggest most high profile name didn't know what they were actually signing up for or really didn't understand the specifics or for that matter. The the overriding point of the Of the litigation in daniel not to turn this into a legal drama but maybe in a small town lawyer runs down to the courthouse on friday and file something quickly just to try to stave something off or two for quick injunction. But we're talking about the supreme court here and of the most important cases That we've ever seen in relation to the ncw has something like this happen. You know well. That's a good question and reach out to law firm which pushback strongly in vehemently against any kind of suggestion that the brief was anything other than fully representative of of all of the athletes who signed onto it But yeah your your. Your point is exactly right. This is a very serious case You know this is probably the biggest college sports case to go before. The supreme court gain a quarter century And these are serious lawyers who filed the brief. And you'd think that they would be able to you know. Gather together a group of former athletes. Who really had a full understanding and appreciation of their side I think one thing that might suggest is how difficult it is. How difficult it might be or the blades. Position to find support among former major Or or major sport or or you know so-called revenue sports athletes And and that seems to be where the sticking point is. I spoke with other people who filed the sign onto the who were olympic sport athletes Who were much more articulate and and sort of informed on the on the points of of what the brief would say and what the blades position is but it does somewhat undermine the the argument that that you know. There's a wide swath of diverse in a diverse group of athletes. Who support the simple as that. It's not just the olympic sport athletes who Don't want necessarily the the floodgates of new compensation to come in but that they're actually people who who played football and basketball who also Subscribe subscribe to that tibet. What's obvious in the statement is? They're saying his facts are wrong. And when you can pound on the facts, you pound on the facts, and now they leak because they can't because they cannot say things publicly in Rappaport, assess talk to somebody what's in the report. And now nobody's got their name on it. And now we're gonna violate the drug policy. Now, both of these things can be true. That's exactly what a smear campaign would look like against a against somebody who was targeted where the NFL would would would get the NFL PA to endorse their positions. So we could just bury this player quietly. But it's also true. It can also be true. That reads got his facts wrong on this that he is exaggerated. The number of times he was tested because again, he feels at every turn in every corner not just in his huddle not just in his locker room not just walking through any place in that league headquarters for the Commissioner anywhere in America. That black dude goes he's taking the black past with him. And why wouldn't he sit here and feel like he's being targeted? Whether it's factual or not. Of course, he wouldn't very few people have suffered more from this position than that. Dude has the facts are wrong. It doesn't mean he's not getting targeted. "McCain legal expert joins us on ESPN radio. Eric reed. How weird was it to see the NFL and NFL PA, sworn enemies. Release a statement that kind of buried the NFL P A's client like can you? What do you make of this statement that both of them put out saying, hey, Eric reads a bit full of it? You know? I mean, it's it's awkward for the NFL PA. There's no question about it. But as I understand the drug testing protocol, even though it was really weird that he kept getting tested and the odds of it were extremely low. There's no evidence that it was engineered by the NFL or by some other entity. It could turn out that that was the case. So I think the players association it's awkward for the NFL PA. But I also think it's good for them to say the right thing because if they went off on an argument that they knew was untrue. Just because it might have been popular with one player, maybe with others. I think in the long run that would have been a mistake because it would have discredited the NFL PA to take on view that that wasn't backed up by the facts if Trevor Lawrence is what he looked like a couple of nights ago. Is there any possibility whatsoever that he can be the one to challenge this nonsense that he can't play in the league after a year or two in college as a true freshman the three year? Rule. True. Freshman are now playing the three year rule is a year younger, I guess on the physical body. So help me understand what needs to happen for someone to successfully challenge this. So I was on Marie clerks legal team back in the case in two thousand and four, and we will obviously we lost that case we argued that. It's an antitrust violation for NFL teams to join hands and prevent somebody who on the merits is good enough to enter the league from entering it in our argument was that it's really designed goes back to that free. Minor league system idea that the league would rather have college football develop players, and that that's an it's an antitrust violation because NFL teams are supposed to be competing, but they're they're not. So here we lost that case it was in New York. It was in the second circuit. So Trevor Lawrence or some other player brought a case that was similar it couldn't be in New York. You would have to be some other federal jurisdiction, maybe California where labor laws a little bit more friendly for players somewhere out there or the. Out in the mid west potentially. It's unlikely that I think he would do that. And I just saw that the exit not that he's going to go to the XFL with the fact that the XFL it's interesting that they are thinking about having an age restriction that lets players go out of high school.
