You know to himself to his team. Look the election is complicated already. We. You know we have a lot of balls in the air one. We just put this off I was just put the Supreme Court off if we win then we got another chance at it. But. He didn't because that's not who he is. He is a guy who relishes fights who who can take punch and throw ten more back at you and so I think the and Mitch McConnell to his credit has I think adopted a lot of that spirit. Look at the way McConnell handled the cabinet hearings. He did not let his members off the hook he did not say it's okay to give into cory booker and Comma Harris and all the screaming that Tall and White House we're doing it was not okay. You had to stand up because if you don't. They will not be appeased I. Mean you have to fight fire with fire? And I think that's what Donald Trump has taught the Republicans and I think it's you know people say, Oh, we're so polarized we are polarized but we're kind of equally polarized now and I think that if if we're going to have peace, we're going to get along as a nation. We now have two sides that have something to lose something they must lose we're going to have peace. So I think the Democrats now are threatening holy war over the fact that the Republicans are going to confirm a new justice they're promising all kinds of retribution but then that's just tit for tat and there'll be another time when the Republicans will have the Senate and the and the White House, and they will use the new powers that the Democrats are now threatening to use against them. So I think if if nothing else. This should teach the country. That, we are going to gouge each other's eyes out if we keep going. And that's not that we shouldn't use the power that we have in government, but it's that this hatred, this utter hatred of the other side has got to stop or we really gonNA tear this country. When you said that both sides now have something. To lose they WANNA interrupt you because you're in the middle of thought. But do you know exactly what you were talking about there because I wasn't sure I was following. Well I think that both sides are are sort of equally. Somewhat equally pitched toward the battle. And everything becomes a winner-take-all and you know you hear it all the time. The other side is evil. The other side is immoral This is politics. This is not church and and I think this ascribing. Of immorality and evil to the other side, all the time I think is is dangerous and it's it's foolhardy. I mean you know we all have our flaws were all centers this idea that we all have a lock on virtue a lock on. Moore. I mean this is this is foolishness and so I think that the country is being harmed by both sides thinking the other side is evil. And I think we've got to get over that. Somehow we've gotta get back to simple disagreement. We can disagree without hating each other we used to be able to do that in this country most of the time, but we seem to have lost that and that's why I think the whole country stands to lose something if we don't find some way. Of disagreeing without turning it into war well, I agree. But I it strikes me that we have a real challenge on our hands when we have individuals in public life and the media who refused to acknowledge acknowledge that burning looting and beating even killing is anything other than peaceful. "But as I look at where I, draw more influence now today than. Five seven years ago. Probably the biggest change is how often I am quoting sourcing or influenced by something coming out of the New York Post we've had Carol Markowitz on the show. We've had Sarah Murray on the show we've had several I think very thoughtful folks from the New York, post and somebody's doing something very well there in addition to the best covers of a magazine in the business, always worth the view one. Of them is Michael Goodwin who was our guest a couple of months ago, and he is our guest again, today's also a Fox News contributor. He's written a piece entitled y the country needs a filled Supreme Court for the twenty twenty election and in a few seconds or less Michael, and then we'll explore that why do we need to fill the seat? Why can't we just wait until the next president? Well Michael I think the answer is Seen around the country and the way that the down some of the Democratic Governors and legislatures are extending the rules on ballot security and breaking down a lot of the safeguards and so this universal mail in voting, for example. In states Pennsylvania one case where they you can drop off your ballots in a dropbox that is unsecured and unintended. Well. If that's not an invitation to theft or to add ballots to subtract ballots I, don't know what else it is So I think the likelihood is that the election will be thrown into the courts and many of these states we're not going to know the results on November third. And both sides have lawyered up with armies of lawyers. And so this is looking very much like it's going to be an extended Contested election well after the day, it'll be fought out in the start probably in state courts but much as the two thousand presidential election Bush v Gore. was thrown into the federal courts ultimately, that's Supreme Court I. Think that's probably what's going to happen this time and you would not want to have a four four court. If if this big case comes before it, you would not want to have a decision that split and then gets reversed to kick down to lower to the previous appellate courts, which may not be in the federal system it may be in the state so. It seems to me that it it. The whole country should want to have a full complement of nine justices for this presidential election. Unless you're the person who doesn't believe that you're going to win from this, which is, I. Think we're the Democrats perceive themselves. You make reference to what seems like ancient history in the political world which forgets yesterday twenty years ago the case of Florida. Talk a bit about that if you would to two thousand, right wish there as I say remember the hanging. Chad and there were a number of issues in in Florida ballot-counting but the particular one that got everyone's attention and that sort of as the word that throws remember you back to it was these punch the punch ballots were you like a punch card? Where you with a pencil, you press a piece of A. Piece of paper that is supposed to dislodge from the ballot itself, and then that's how the scanner reads it. Whatever's been dislodged like the emptiness is what's red and in some cases, voters didn't push all the way through they may be marked it instead of pushing it and in some cases, they pushed it and it went. The Chad did not dislodge completely and so the scanners may have mis read that intent also So you had a number of issues. So. Those Chad's were hanging and the number of issues you also had indifferent Florida counting different Florida counties, different rules about how they would count disputed ballot sometimes with these Chads sometimes with how they were marked sometimes if they were mark twice There was there was an attempt to decipher what was the intent of the voter when there were two marks on the ballot and you can only have one I mean. So there was a the numerous discrepancies being handled. In different ways by the Florida course and the Florida Supreme Court which seemed very partial to Al Gore was okay with this was okay with doing recounts and only in some counties and not others and in a way it looked as though it was designed to make sure that Gore won the state and. There were a number of issues like that where George Bush, the Republican candidate, of course, finally filed federal suit and got the case into federal courts and into the Supreme Court where the Supreme Court to significant rulings Right. Right. In the middle of December actually the first one. was that Bush was correct in in claiming that he had his equal protection rights of the Fourteenth Amendment were violated by these different standards of counting that the Florida Supreme Court had authorized. that was the seven to two vote. But on the on the next vote, it was five to four, and that was that there was not time to rectify this. There was not not not time because the electoral college was due to meet. And Florida Law required the Florida electors to have a certain number of days between the Finish Count in Florida and the federal. Then the Electoral College meeting to finalize the Electoral College totals from each state and so the Supreme Court said there's not time to fix it therefore, it's finished and it reverted back to the Florida Secretary of State's declaration that Bush had won the election by some several hundred votes now as you'll recall. Later, there were attempts to go back by media and other groups to find out what would have been the result under a fair counting. Most of them concluded that Bush would have won Florida almost no matter how you eventually decided nonetheless. then. Florida's twenty five electoral votes for a total of two, hundred and seventy one to Al Gore's to sixty six I. think there was one faithless elector who decided not to vote so to seventy, one, two to sixty six was the final electoral college, and of course to seventies the magic number. So is a very close election effectively decided by the Supreme Court by a five to four vote when it said there was no more time. So I don't think we want to have that situation with afford a four certainly don't Michael can you hold with me for just a.

He's never recruited good people. He's never rolled up his own sleeves, and so now in a time of crisis he. He doesn't know what to do. He's lost. He keeps pulling these word games well. It's not acceptable when a one year old is killed. Really thank you very much. It's not acceptable. Is that how a leader speaks? A one year? Old Child is shot in the stomach and dies in the street. It's not acceptable I mean it just his heart is not in it. It never was and so expecting him to do better. Now I think is frankly asking the impossible. How can you possibly ask the president of the United States, but help for New York when he allows those terrorists go and pink in front of building. He wants slipped. Slipped it. I mean it doesn't make any sense at all. No and Lousy I'm of course himself with Al Sharpton and others. They did it to taunt the president. There's no other way to look at. It was taunting maneuver and you ask you know how. How does this then lead the president to say well? I'M GONNA bail out new. York well obviously doesn't but I think what the Democrats are doing here and elsewhere is. They are not cutting their budgets, really the mayor, the governor. They're not really taking seriously. The budget hit I. Think what they're hoping. What they're planning and it. It becomes something of a strategy as well. well as an excuse it, they're gonNA. Put all their chips on a Democratic president and a Democratic Congress giving them what they want. Next year so I think that they're not gonNA. Make any effort now to seriously deal with the budget deficits, but they're just gonNa play politics and do everything they can to get a democratic congress and president. Sort of course in New York, doesn't matter that New York is going to vote for any even a dead Democrat New Yorkers would vote for for president, but a lot of the congressional seats are in play, and I don't know that that's going to be a great strategy in Rio contested districts. Question Michael Goodwin you worked to the New York Times a all the time they go. What happened to New York Times? Want to be so. Easy, you know John. I tell people that I did my undergraduate work there that I I graduated and moved onto higher education, and my my shorthand answer. Is that this happened in? Slowly and then suddenly slow part was at the standards were allowed to erode over time. The great standards of fairness impartiality of just decency that we don't have an agenda. Adam with is Michael Goodwin. How you doing good morning my thank you. Hey by the way we just found out Governor. Cuomo the Cuomo administration has pulled down off their website that March twenty fifth nemo sending ordering the Corona patients into the nursing homes. You where the one that led the charge on that. Where do you think this law end? Well I it's hard for me to think mark that there won't at some point be a an investigation Of what happened now. I think that the the thing that would work against that is that it's pretty obvious what happened We already know that. The governor ordered the nursing homes to take cove positive patients even as they banned visitors for the same reason. So it was the most idiotic thing done. It's it's so blatantly apparent what it was and and the effect of it on the nursing homes on the residents and and Patients of these other facilities and nursing homes rehabilitation centers. This whole sort of out of hospital culture that has grown up around some of it just being insurance companies WANNA discharge patients from hospitals as quickly as possible. Say How they? They can't go home so they have to go somewhere else. Well that was true of covert patients as well they needed to. They needed the hospital beds. They thought they did for incoming covert patients and so they sent people who are still contagious to nursing homes and the deaths. I believe are going to be far north of where they are. Now which is about fifty five hundred. I think we could easily see them. Eight nine even ten thousand deaths in nursing homes and when you think about that mark That is such a huge proportion. And and it's it's true across. The country is such a huge proportion of the overall deaths that it it begins to color everything. We did During the shutdown you could say well maybe if we had just drawn a circle built a law around the elderly and those with various Serious health complications we could. We didn't need to shut down the whole country. We could could've just shut down portions of it where the elderly and those who are sick live and and And get their treatment. If we just protected them it would be a very different profile as to what happened with Kobe. Because we know that for most people younger people who are healthy They get colder and it really is like the flu but for those elderly and otherwise sick. It's a death sentence so that distinction when we didn't deal with it in that way you know it reminds me a lot of what the what we do at the airports right. Everybody gets checked equally right. That's not how you find the people carrying bombs. I mean there are smarter ways to do that as someone from Israel once said to me. You know the problem with America's you worry what people are carrying. We worry who the people are. And I think it's the same thing with the way we treated code. It was just stupid to do this. I hope that governor Cuomo Is Forced to acknowledges forced to admit it was an error and. I hope that there is some accountability. I'm not sure what form that will take. ultimately is a matter for voters but for him to remove the document. Blame the FEDS. None of this is true. None of this is defense. Did Not order this. They did not recommend this. This was his thing and it was the doing of the governor. New Jersey Murphy. Did the same thing virtually so I when we when we I think eventually pull back the curtain on the entire scene of the Cova Epidemic in America. We will see that. This was the great failure the failure to protect the elderly. And then it warped everything else because we just counted. All data is oh. Everybody was equally liable to die from. This wasn't true and it was it was it was a man made disaster to that extent. Fake News cover up. Amazing even look at Florida governor was brilliant. Everything every move in fact with the nursing homes. He took one nursing home and just made that just corona virus patients and nothing else and that saved the other nursing homes and A. Remember that famous case now because of the post that of the Cobble Hill Nursing Nursing Home The owner there showed the post emails of him writing to the Department of Health. I can't handle these. People can't pay him go to the to the The company can we take Chavitz and and they said no they can only go there from hospitals so again there was always this kind of you know uman error involved. Why is that necessarily? Why is that rule necessary? Why why say that? Nursing homes have to take them from hospitals. I mean all of these things that were decided by the State Department of Health. Andrew Cuomo's State Department of Health. These were all preventable. This was not cove it this human stupidity. Yeah Hey Michael Goodwin great com today Jeff Sessions. Because reading his twitter back and forth with President Trump. It struck me. He still doesn't get it. He still does not understand that he was targeted by the deep state. Timing issue I had forgotten that if I ever put the pieces together that it was in Ja- It was in January of twenty seventeen during his first confirmation hearings the first hearing where he was asked a question by Al. Franken the senator from Minnesota about a breaking news story on CNN that turned out to be the CNN leak regarding the James Colmer briefing of president trump about the P. tape allegations that turned out to be the steele dossier now. We didn't know any of that at the time. We didn't know where that was coming from Later that day buzzfeed Reprinted the entire still dose CA President trump wasn't told about the steele dossier with the exception of those two pages in it. So all of this was happening. There was this underground movement to disrupt and defeat and destroy. Mike Flynn Attorney General Sessions And eventually they got what they wanted in Rod Rosenstein. He was there man. Now whether he was consciously their man or whether he was working Just out of ignorance and didn't know what they were up to. We don't know yet because Rosenstein has never really been truly ammend but for sessions at this late date still not to recognize what happened to him why he was subjected to those leaks to. The Washington. Post why he was why this was dropped on his head at his confirmation hearings and not to understand that and for in for the move to pressure on him to recuse himself for him not to understand that this was to get him out of the way so they could get trump for him. Still not understand that. It's just unforgivable. Yeah you know listen I you're giving Rosenstein the benefit of the doubt but you take McCabe and struck and roses. The same crew cut the same nineteen fifties classes the same suit. There obviously all on the same team there. That's pretty clear and I think look you're right about Rosenstein. This whole sort of out of hospital culture that has grown up around some of it. Just being insurance companies WANNA discharge patients from hospitals as quickly as possible. Say how they. They can't go home, so they have to go somewhere else well. That was true of covert patients as well they needed to. They needed the hospital beds. They thought they did for incoming covert patients, and so they sent. People who are still contagious to nursing homes and the deaths I believe are going to be far north of where they are now, which is about fifty five hundred I think we could easily. Wouldn't it absolutely? This would be the in. The overall picture of the virus would change and I believe it should change because I think when we look across the country mark We're finding that disproportionately The deaths are occurring nursing homes. I mean it's it's anywhere from forty fifty sixty seventy eighty percent in some states in New York and New Jersey. It somewhat lower because there are more desks although the actual nursing home death totals astronomical between the two states New York and New Jersey. Roughly eleven thousand people so far that we know have died in nursing homes eleven thousand people and they both governor Cuomo New York Murphy in New Jersey. They both issued these executive orders in March own using almost identical language. So they clearly I think. We're coordinating Forcing nursing homes to take cova positive patients who were being discharged from hospitals to take them into the nursing homes. And you know I think we always have to remind ourselves mark that the absurdity of this is borne out by the fact the nursing homes and barred families and visitors from coming to see their loved ones less. They bring the virus into the nursing home so on one hand. We're keeping the families out because they're dangerous at the same time we're sending in people. We know are infected with that same virus and saying to the nursing homes. You must take them. You cannot deny them and if you do we'll take your license So I don't know how explain this other than the dumbest thing? Ever the most destructive the lethal the fatalities that flowed from. This is just remarkable. And so if if we if they had not done this and they did some version of this and other states as well If they had not done this. And let's say The New York Times says twenty at least twenty eight thousand people overall have died in nursing homes. Basically at that time they did this. Study one three of all deaths. Think just think for a second if the death totals and the country were reduced by thirty or forty percent. We would be looking at this entirely different way so this was not. This was not a predestined to happen. The way human error played an enormous role in these death. Totals and that does when you look at the when we finally examined. All of this will have to say that. The governor's in these states treated these nursing homes and the people in them as disposable. They sacrifice them to open up hospital space for other infected patients. And if someone wrote to me some one family member wrote to me. It was actually quite quite a powerful argument. They basically said the younger matter more than the older. So we're kicking you into the nursing home so we can free up a hospital for somebody who's more valuable than you are. Then the people in the nursing homes. I mean it's an extraordinary. I think description of what has happened and and there has got to be a national investigation of this. Absolutely this would be the in the overall picture of the virus would change, and I believe it should change because I think when we look across the country mark We're finding that disproportionately the deaths are occurring nursing homes. I mean it's it's anywhere from. Forty fifty sixty seventy eighty percent in some states in New York and New Jersey it somewhat lower because there are more desks although the actual nursing home death totals astronomical. Between the two states New York and New Jersey. Roughly eleven thousand people so far that we know have died in nursing homes, eleven, thousand people, and they both governor Cuomo New York Murphy in new, Jersey they both issued these executive orders in March, own using almost identical language. So they clearly I think we're coordinating forcing nursing homes to take. Cova positive patients who were being discharged from hospitals to take them into the nursing homes. And you know I think we always have to remind ourselves mark that. The absurdity of this is borne out by the fact, the nursing homes and barred families and visitors from coming to see their loved ones less. They bring the virus into the nursing. Home! So on one hand. We're keeping the families out because they're dangerous. At the same time we're sending in people we know are infected with that same virus and saying to the nursing homes. You must take them. You cannot deny them, and if you do, we'll take your license so I. Don't know how explain this other than the dumbest thing ever. The most destructive the lethal the fatalities that flowed from this is just remarkable and so. If if we if they had not done this and they did some version of this and other states as well. if they had not done this and let's say. The New York Times says twenty. At least twenty eight thousand people overall have died in nursing homes. Basically at that time they did this study. One three of all deaths think just think for a second if the death totals and the country were reduced by thirty or forty percent. We would be looking at this entirely different way. So this was not this was not a predestined to happen. The way human error played an enormous role in these death totals, and that does when you look at the when we finally examined. All of this will have to say. That the governor's in these states treated these. Nursing homes and the people in them as disposable. They sacrifice them to open up hospital space for other infected patients, and if someone wrote to me, some one family member wrote to me, it was actually quite quite a powerful argument. They basically said. The Younger Matter more than the older, so we're kicking you into the nursing home, so we can free up a hospital. For somebody WHO's more valuable than you are. Then the people in the nursing homes. I mean it's an extraordinary I. think description. Of what has happened and There has got to be a national investigation of this. common they do have this in common they would stand their ground so that to me doesn't seem like it's that out of it's certainly not out of character let's put it that way I'm always intrigued by what the headers today in other words what the major newspapers decide they're going to highlight the New York Post did the highlight Nancy Pelosi and what they wrote was the headline said this Nancy Pelosi shamed herself at trump state of the union address and then there were there's a picture of her holding it up and then there were several little pictures of her ripping it up they said trump employs these views spills over into the state of the union Pelosi rips up trumps state of the union speech in a stunning scene so that's what they chose to highlight that was the first thing that you saw all of their and this story by Michael Goodwin talks about the definition of insanity and says that you know you've been **** up for three years with the juvenile resistance where you were refused even to negotiate over big national interests such as border control control them what it seems you couldn't sink any lower than that cheap partisan impeachment you engineered you hit a new low during the state of the union this was from the columnist Michael good when talking about what he saw as Nancy closely and what the you know what what she did so now house Republicans were talking about he chanting four more years before the president began speaking and then really setting up an intensely partisan tone for the address on the night of the full let's face it virtual certain acquittal and the Republican controlled Senate so that whole impeachment thing wraps up tomorrow I can't imagine that it's actually the more flooding that leave my lips is not going to do that's not changing that's it I mean virtually that it even senator Susan Collins who waves in five different directions when she feels like it decided she's going to show up and she's going to vote to acquit the the presidents of pretty interesting and most of the headlines when they went with the state of the union sure the economic part of it leads with that and it it's interesting because even in the LA times the opinion piece there that was done by Michael my god I think his name is is the senior editorial writer he said even if the Republicans in the house chamber hadn't begun shouting former years would have an obvious that the president's state of the union address was a campaign speech by another name and it it he said it also shows Democrats should take note it was an effective one despite any even says despite exaggerations dubious claims that are already being dissected by fact checkers which is true he's saying the president's emphasis on optimism and is talk about building the world's most prosperous and inclusive society was laced with some score settling and it was he's right it was throughout that state of the union you could see that lurking there and some of the big moments including because this is something especially older people are scared to death about in fact my whole life probably when I was born they started saying you're not going to have social security
