"NYC Prosecutor alleges protracted criminal conduct at trump organization inquest for president's personal tax returns by Larry Neumeister of the Associated Press in New York. A Manhattan prosecutor trying to get President Donald Trump tax returns told a judge Monday that he was justified in demanding them citing public reports of extensive and protracted criminal conduct at the trump organization trump's lawyers. Last month said the grand jury subpoena for the tax returns was issued in bad faith and amounted to harassment of the President Manhattan District Attorney Cyrus. In a court filing Monday though attorneys for Vance said, trump's arguments that the subpoena was too broad stemmed from the false premise that the probe was limited to. So called Hush money payments this court is already aware that the assertion is fatally undermined by undisputed information. In the Public Record Vance's lawyers wrote, they said that information confirms the validity of a subpoena seeking evidence related to potentially improper financial transactions by a variety of individuals and entities. Over a period of years they said public reporting demonstrates that at the time, the subpoena was issued their republic allegations of possible criminal activity at plaintiffs New York. County based trump organization dating back over a decade these reports described transactions involving individual and corporate actors based in New York, county, but whose conduct at times extended beyond New York's borders this possible criminal activity occurred within the applicable statute of limitations. Particularly, if the transactions involved a continuing pattern of conduct, the lawyer said the lawyers urged Judge Victor Marrero to swiftly reject trump's arguments saying the baseless claims were threatening the investigation moreau against trump last year has scheduled arguments to be fully submitted by mid August every day that goes by day plaintiff effectively achieves the temporary absolute immunity that was rejected by this. The precise concerns that the Supreme Court observed justified its rejection of plaintiffs immunity claim in the first place. The Supreme Court last month rejected claims by trump's lawyers that the president could not be criminally investigated while he was in office bans lawyers said trump was not entitled to know the scope and nature of the grand jury investigation but they said information already in the public domain about trump's business dealings provided satisfactory support for the subpoena of. "A federal judge is ordering the release of former Trump attorney and fixer Michael Cohen, who's serving a three year sentence for fraud, campaign finance violations and lying to Congress as NPR's Ryan Lucas reports Cohen file suit challenging his recent return to federal prison. The decision from U. S District Court Judge Alvin Hellerstein is the latest twist in Michael Cohen's legal Odyssey. Cohen was released from federal prison to home confinement in May because of concerns about the Corona virus. But then, earlier this month he was taken back to prison after refusing to agree not to speak to the media or published a book a condition of his release that Cohen says violated his First Amendment rights. Cohen is writing a tell all book about his many years working for Trump. Now Judge Hellerstein has found that the government's decision to return going to prison was indeed retaliation for his book and a violation of his rights. "The trump administration gave Michael Cohen Choice. Sign this paper, saying you won't write a book or go back to prison. Silence or prison. Your choice then there's the book by Donald Trump's niece slated for official publication tomorrow Donald. Trump and his family have been in court up through today, trying to block the book from being published and Block Mary trump from saying anything about the book. which feels ridiculous because you probably feel like you've already read it, since just about every media outlet on the planet has gotten a copy and dissect it already. Well this evening. Donald Trump and his family lost that court fight a New York State Supreme Court Judge rejected. The trump families attempt to block the book ruling that quote the potential enormous cost and logistical nightmare of stopping the publication, recalling and removing. Thousands of books from all types of booksellers, brick and mortar and virtual libraries and private citizens is an insurmountable task at this time. The judge then quotes a different judge in another case Donald. Trump lost when he tried to block the publication of his former National Security Advisor John Bolton's book quote by the looks of it. The horses not just out of the barn. It is out of the country. Stone he can see the president's unmistakable sharpie signature there. The president commuted his old friend sentence on Friday night, but it's not clear how broad the commutation was. In fact, the judge in stones case demanded to see the actual order to determine whether it covered stones, prison, time or his probation as well well. Now, we know that the president took care of everything. His Old Friend Prison Time supervised released twenty thousand dollar. Fine all of it poof gone. And today Roger Stone announced that he celebrating by. Writing a book. You'll remember Michael Cohen used to say, I love Trump. I'll take a bullet for Trump. I'll never turn on Trump. Now, he goes to Capitol Hill to say that Trump is a liar and a racist and a cheater every sorts of terrible thing. So in advance of this ridiculous testimony that has zero credibility the GOP released an advertisement that just contrasted. If he's obviously flipped so significantly. Why did Trump Hiram doesn't show a lot of good judgment? Why do the put him on their board? Make he was deputy finance chairman. Why did they do that this ad actually requires humility and it demonstrates humility on the part of the GOP? It's an ad that admits that Donald Trump hired freight. "Which? Listener supported w in Weiss studios. Michael Cohen, President Trump's former lawyer was sentenced Wednesday to three years in prison for financial crimes for lying to congress in rendering the sentence judge William H Paul said Cohen's crimes among them tax evasion and campaign finance violations or quote motivated by personal greed and damn Bishen. Our democratic institutions the judge said depend upon the honesty of our citizenry in dealing with the government Cohen who had pled guilty to the charges offered. This quote, my own weakness and blind. Loyalty led me to a path of darkness. I listened to him inning Trump rather than to my own voice. He has called me week. And he is correct time and time again, I thought my duty was to cover up his deeds. I did not have the strength. I'm sorry. I admit my guilt. I have chosen another path. The case has implications for Trump himself as judge Pauley noted that Coen's campaign finance crimes were designed to affect the outcome of the twenty sixteen election, but there are many threads to follow. And for that. We turn to our colleagues from the Trump Inc podcast, which has just earned prestigious DuPont, silver baton award. The show is an open investigation from team of journalists at propublica hand WNYC this week they helpfully unpacked, what's notable. From the recent court filings by prosecutors in both Michael Cohen case. And that of Paul Manafort, it starts with WNYC's Ilya marritz, laying out what's coming up. Also this week a judge will consider Paul manafort's future. Now that he is apparently in breach of a cooperation agreement with special counsel, Robert Muller. Manafort, of course, was Donald Trump's campaign chairman and was convicted of Bank fraud and tax fraud. Right now. We've got my Trump Inc. Co host Andrea Bernstein here. Hi, andrea. Hey, andrea. And I have spent a lot of time tracing the twists and turns in Michael Cohen's. Very interesting life also here via Skype we have Franklin for staff writer at the Atlantic. He has paid closer attention to Paul manafort's career than any journalist. I know of high Frank God help me. Are you guys feeling overwhelmed as I am with all of the information coming at us all at once about these two men? Yes. Too many thread to keep hold of. And you know, we're living in this state of suspense, which is that we have all these disparate did a points. They looked dodgy as hell yet. You don't know how anything stitches together an ultimate sort of way into we've been living with this scandal for so long. And yet like we really don't know where it's going and I find several years into it. It's just it's kind of I wake up in the middle of the night just kind of screaming like make it end. I want need to know what what the hell happened. Lease tell me someone now except that the last time the three of spoke it was summer. It was really really hot. And it was during the first days of Paul manafort's trial. And I think. We know a lot more than we did. Then about the emerging narrative, I think including just beginning with Paul Manafort for one his crimes per molar did not end with some shady financial transactions involving Ukrainian oligarchs before the Trump campaign. But in fact, when up into may of twenty eighteen just a couple months before we sat down before his trial where he was speaking to administration officials and then subsequently lying about it to the special counsel. So I think there's a Paul Manafort has pulled his crimes into the present enter just to quibble with you. I feel like incrementally. We know a lot more about what happened. But when I step back, and I look at the bigger picture. It's still murky to me Franken feel like you're talking about these middle pages of the memo that came out on Friday, which have huge reductions, huge amounts of blue. Lack lines. But one name keeps coming up again. And again next to the redacted text. And that's Constantine Kalinic. You wanna fill us in on who he is. And the role that he played with Paul Manafort over many, many years cognizant Tino Constantine clinic, Nick as either Costa or K K. And I just love the nickname. So I think for the sake of this podcast can refer to miss K K sure clinic. Okay. So K K was kind of Paul manafort's little buddy emphasis on little. He's a very diminutive character. "And he didn't quite do it to the same degree here. What do you make? I mean, I I noticed that language to. And I thought it was very interesting because he basically says look I was I was watching the president's public statements. And I was watching what was happening with the Russia inquiry and so out of loyalty and knowing what the president was saying. And it's worth us stopping just her second to say that the president was sort of saying look the deal didn't happen in Moscow. The president's public statements. I don't think he ever said, yes, I had meetings and conversations till June of two thousand sixteen. I mean, he minimized it did make it seem. I think like it was done before before the primary season started on February first of two thousand sixteen. And so what I think is saying look, I was reading that. I was reading I was taking the that as signals to me, whether it was intended from Trump or anybody else, and so I live because of it, you know, it's that could be true. I it's hard for me to believe that there wasn't some back channel or some conversation between. Cohen and folks on Trump's team, but but he didn't say that Niagara with you. He he certainly didn't have any hesitation to say what Trump had done when he took the plea in the southern district. The the one thing I I would you know, sort of throw out there is that, you know, Michael Cohen is a lawyer, and he lied to congress, and there's just a certain amount of I I mean, it shows both I think the fear of the Russia inquiry, which was obviously a lot more powerful than that. I think we've realized, but it also shows a level of arrogance that you know, it was doubling down on lies and thinking that you know, you can walk into congress and light of their face and get away with it. And so, you know, it may be that the president is not in this piece that he didn't direct or motivate Michael Cohen specifically to tell these lies. But there is there is a lot here that I think we want to know more about look, I think the significance of this charge of lying. Not to Muller not to law enforcement agents, not FBI agents. But to congress specifically a committee that was charged with looking into these matters is significant aid because it's outside of the law enforcement universe. So maybe maybe I'm overstating the significance of this. But you know, one issue that's gonna come up in the future is impeachment and the more evidence that there is that not only Michael Cohen lie directly to one of the chambers of congress. But that in some ways Donald Trump either knew that he did encouraged them to do. So and even you know, most minimally drew some benefit political benefit from those lies..

"And they will go through Email after Email after Email and say what is this? What is this? What is this and went when someone is cooperating? So Michael Cohen can provide a roadmap to any knows that he's on. But he can also explain the context for other emails, they have and what we saw this week Chris in Tom mentioned, it a little bit earlier is Muller has documentary evidence for everything that he asserts you saw it in the Jerome Corsi draft statement of offense where their emails you see it today in the information where there are written communications. And you can be sure that they are not accusing Paul Manafort with lying just based on the testimony of others. So when Donald Trump claims that everybody else's lying, and that Robert Muller's forcing people to lie. He's playing a very dangerous game. Game. Because at some point this documentary evidence is going to come out, and it is going to corroborate the allegations and surgeons and testimony of the witnesses that Robert Muller has final question. You had tweeted this today. There was some news about Deutsche Bank being rated to what your Bank has been the target of a lot of international law enforcement that the at money laundering. He said so far today and coordinate fashion. Appears Michael Cohen pleaded guilty related Trump. Ordeal. FBI searches Trump or outside counsel info provided by Cohen. That's a I believe a reference to Chicago alderman, Ed Burke, and Trump work primary lender. Db also searched do you think those are all related? Do you think this is coincidence? Ito? It may be it was it was somewhat tongue in cheek because it all it is interesting that all of these events have connections to Michael Cohen, obviously his guilty plea. The alderman Michael Cohen would know who they use as outside counsel for for the Trump organization, and we know Deutsche Bank is is the banker for for the Trump organization sort of the last one is there are additional reporting that it may relate to another investigation. And it was a massive undertaking in Germany, so it's unclear that it's directly related to this. But I think the point is that the the world seems to be closing in around particularly the Trump organization and their financial dealings in somewhat of the off off shoot of that is some of the campaign related information. But it's just another example it's another day where we see a lot of. Of legal activity that can relate back to Donald Trump, Daniel Goldman. Thank you make some time tonight. Joining me now is Georgetown law. Professor Neil Caccio, who's acting solicitor general in the Obama administration argued numerous cases before the supreme court Neil. What's the significance today to your mind? I think it's huge. So I think you know, the facts aren't all in. But I think we very well could look back on this day November twenty nine th two thousand eighteen as the beginning of the end of the Trump presidency. And I say that for three reasons one what we've been talking about the criminal stuff that Muller has on Trump. But there are two other important things going on one is the house investigation. Now, the house is controlled by Democrats. They'll take power in January. They'll be able to investigate all of these lies to congress. And the second is even if the Democrats don't wanna do it impeachment. They almost are going to have to look at it very very seriously now because this isn't just criminal. This is the president campaigning in two thousand sixteen in hiding all his business associations with Russia. Not the Russian like businesses like Marianne hotels or something. But with the Kremlin itself and the number two person as you were saying at the Kremlin. So that you know, that's bad. And the American people obviously should have had. A right to know that at the time. But also just think about the last two years have been a period of intense compromise. The Russians have known that Trump lied to the American people for two years and imagine all the things subtle things..

"I think if you if you go back to the circumstances when the access Hollywood tape was released and you say, what would have happened? If a porn star had come forward at that point and talked about what stormy Daniels has subsequently. To come forward and talked about. I think it is reasonable to hypothesize that a certain number of votes may have been different or a certain number of people might have stayed home and not voted. There's no way to know that. But I do think if you say, was it a rational judgment on the part of Donald Trump according to Michael Cohen and Michael Cohen that this was a story that was worth breaking the law and spending a lot of money to suppress in the two weeks before the election. I, that's a pretty rational judgment. And I think they probably did it for a reason and without condoning the criminality of it, which I certainly don't condone. I have to say, I totally understand why they want that story to come out. This is a guy who like wouldn't pay painting contractors, nine thousand bucks for sure. Sure. Paid this one. Exactly like this is someone who's left a trail of people unpaid in the many years Eliza. The line from supported the president today, you know, and even the president self a little bit is the which continues no collusion. They still haven't found the smoking gun linking us to the Russian crime. And so really this continues to be much ado about nothing. You're shaking your head. Yes, I am. Well, it's just it's getting to be a very old song, but what he keeps doing is continuing to try to undermine the investigation in the minds of the public and hoping I guess against all hope. I believe that he can somehow stop this train. That's. Very far away from the station right now, and it's moving quickly towards him. So. Who who can say why Donald Trump keeps doing what he's doing. But I think he can't help himself actually Benjamin witness and Elizabeth de LA Vega. Thanks for joining us still to come. We have much more much more to talk about on this monumental day. So far including a jury, finding the president's campaign chairman guilty on eight felony counts. We're going to dive into that. We'll talk about what it means from all investigation, whether the president will party Manafort and how congress should handle the agenda president surrounded. Now by criminals, a lot of ground to cover do not go anywhere. Paul Manafort the president's former campaign chairman was found guilty today on eight felony counts, five counts of tax fraud. Two counts of Bank fraud and one count of failure report a foreign Bank account. The jury deadlocked on the remaining ten counts. But remember Manafort has yet another trial coming up just in September, Washington DC trial that could now be significantly more complicated for him any try to turn the outcome today. "The home in the hotel room of michael cohen was seeking documents not just about the stormy daniels hush money deal but also about his connection to new york taxi medallions and this type of thing should we think of this as having anything to do with donald trump at this point i mean both both jean friedman and donald trump were fairly extensive business associates of michael collins but there's no indication that friedman and trump had any sort of dealings with each other that friedman would would know anything of interest about donald trump not directly no so the the way the chain of events may be a risk to trump is this even if he has nothing to do attacks him italians and i think there's no indication that he does if this puts additional pressure on michael cohen and if that pressure causes michael cohen to start to cooperate then that's trouble for trump because michael cohen certainly does know things on other subjects about donald trump and that could contribute to special counsels case this is obvious a somewhat unusual situation because it's such a high profile federal investigation but a weird complication you would have here with regard to you know normally if you had an investigation we're trying to flip people and flip people and flip people and get to the top if donald trump is at the top here and donald trump most likely cannot be indicted by the special counsel if you get someone to give you information about the president but then you can't indict the president anyway what good is that well one of the things going on here is that a state prosecution and a state conviction is something that the president of the united states cannot pardon so that's a danger michael cohen in additional pressure on him because he knows that if he is prosecuted in the state than his friend the president of the united states can't pardon him to get him out of it in terms of what good it does at this point well president trump is still sitting to pursue potential charges against him i think that it's probably the same answer as the last few times we talked about it which is that the special counsel.
