So many years ago. US border, patrol agent shot, and killed a fifteen year old Mexican boy after that. So what happened at the Rio Grande? Well, the facts are disputed. So we'll tell both sides of the story was talking about the circumstances that brought about the shooting the boy's parents say Sergio was playing a game with friends run across the border to the US side touch defense run back without getting. We the people of the United States People Citizens Resident Aliens International Travelers in this country on holiday or for business when you're in the United States, those protections apply to you. Sergio's parents sued agent Mesa in Federal Court for excessive use of force. They claim Mesa violated Sergio's rights under the fourth and fifth amendments. Now here's a reminder of what those are faulkner professor Melvin Odi. Okay so The Fourth Amendment Fifth Amendment each sort of presents a bundle of rights but the fourth amendment in particular. Presents a list of restrictions on government agents were investigating crimes. Okay. So the prominent one is protection against. Searches and seizures. The court has interpreted seizure to include killing the taking of human. Life. Would have been saying. This was an unreasonable search and seizure the fifth amendment includes several closets. Relevant one, but there's a catch all. Near the end of the Fifth Amendment that says a person can't read deprived of life liberty or property without due process of law. So. In this case, the young man's life was taken. And the Fifth Amendment says, you can't do that without due process of without fundamentally fair legal proceedings. The first time this case worked its way through the court system the fifth US Circuit Court. Of Appeals dismissed the case it held Sergio's parents were not entitled to fourth and Fifth Amendment protections under various legal doctrines, but the Supreme Court said the fifth circuit and properly applied those legal doctrines. So it vacated the decision rendered null and void that was Hernandez one in. Two thousand, seventeen, the Supreme Court then remanded the case with specific instructions. It's at another question needed to be addressed. I is a givens remedy available. The Fifth Circuit said, no in this Supreme Court, appeal followed Hernandez

I'm sorry there's another three weeks before those restrictions are due to the stage four restrictions. How likely is that going to be able to go back to a normal way of life at that time? There are a lot of variables I think is highly unlikely that people will be going back to a normal way of life in Victoria for a long time to come, for example, mandatory mass to be out there for a long time to come what's a long time I don't know the answer to that question. But really for quite awhile, and certainly it's going to be a help to have mandatory masks when they do start relieving restrictions I think we're going to be very nervous about lifting restrictions with anything more than zero spreads. So that's what they're expected expecting but I think that's Unlikely, in three weeks and people getting tired in D., H. S.. So you've got some incredibly hard workers who the contact tracing the testing who are running teams and they're getting really tired. It's emotionally difficult for them. They're they're doing incredible work as indeed are victorians under this lockdown you'd have to say so an since which those teams hold together manage to actually go the distance themselves and then are those teams really being held by the system. So you've got h care that still a problem Victoria it's not at all clear the extent to which you've got healthcare worker problems in hospitals. So a big reason why you want ninety five percent of kids in their first year of life to be immunized and a lot of the rest of us to be reunited as well as so there's not much around. So kids who are vulnerable in the first three or four months of life don't catch hooping cough. So in a sense you, we are trying to remove the burden of disease in the community how they distributed, but it's Unclear but I would imagine through general patches through pharmacies and also targeted immunization programs to healthcare workers and heath care centers, and so on. It would be very silver to try and create a whole new process. For this, we've got recognize immunizing the public and that's what we should use. In this case just make sure it was just the right place because you're going to maintain a call chain. also Jim Brown in there another scream of dole Jabbar who always stood up and spoke out but I must tell you it's just so sad to see something that is happening of this nature in twenty twenty that I experienced during the height of the civil rights watching the nightly news with Walter Cronkite seeing the black and white film footage of the fire hoses turned on young black teenagers attack dogs police dogs if you will that were put into that mode because that was the command they were given it's just hard to believe that we have evolved so many decades later we're sports's evolve where in the world now without sports we lost a hundred thousand people in this country and counting when it comes to the pandemic and this is on the front page and no matter how you look at it is just flat out sad to think we have not come that very far since Martin Luther king walked this earth and lost his life because of his fight for civil rights it almost makes you feel like robbery we haven't come anywhere you know we we're we're right back to where we started in the sixties in it is so sad to to have to be in a situation where where in hello to our address like that the only way they can can express those the end it is these were mostly protests that were peaceful in and well deserved and then they turn crazy because of outside sources apparently and no one knows for sure but it seems that that especially in Pittsburgh this was not something that was driven by the peaceful protests that started out in that that's bigger shame of it all in and I'm hoping that there is some way to find these people that came in there that that tried to incite the violence to to get to a point where we can catch them and get them off the street there's no place in our world you know Greg and I don't know if it's because when we were raised in one of the things that I've been stressing to my audience and I have been through it all I've been through rose Jonny Gammage obviously going back to the nineties up with Rodney king I have been on the radio talking about all of these things and how tragic they are and hoping that they would stop just like the school shootings that I go back to nineteen ninety nine covering the Columbine case the thing that I have come to believe it is all about what you can do teaching your children about how this is not how you act do not treat people of a different color race nationality religious belief other than how you want to be treated that's the way you and I were both raised in I'm not looking for us to get a gold star or a Pat on the back but you have to know is I know the way we grew up weather was on the basketball court or the classroom or just spending it time at home eating something that our parents prepare force and you looked across the table many times that person was black and I never looked at it any other way than just that a friend of mine enjoying a moment whether it be in school in that classroom or on that basketball court or on that of field of athletics and I think we become so isolated not just because of this pandemic but the world that we live in today that people have lost sight as far as what they need to do and how they should be raising their children and more importantly something that I've always thought was healthy a healthy mix of people from all walks of life we we need to get back to that if we want to survive this and move forward and be a healthier nation not so much for you and I but for your daughters and my children and generations to come yeah I can't agree with you more there has to be a way to figure this out there investors are seemingly every time an issue or an engine that comes up like this we often dialogue began everybody just kind of goes back to their quarters in as if it were a boxing ring what okay yeah we had these conversations but nothing gets accomplished you're nothing gets fixed and then you have another incident where were some law Yeah Yeah See I. My father loved this movie and my father in upcoming guests on the show we have the banks. It's quite a barn burner if if you like monologues by Jewish men is we just got great one right it is generally ask hour and a half long monologue by my father. Talking about spalding gray. It also will explain a lot of my brain. Yes and also why we're friends which all sort of rakes. Yeah you see the similarities between my father and my ever Lucien of new line that Ben wanted to blow and then calls US Beta Cox. Yeah but they're my father talks about in the episode that he was not a big movie guy. Despite working they are tame ministry which was sort of something he fell into did not I want to do. After many other careers had failed him at that point So I would always ask. My Dad was his favorite movies. Where because I only care about movies. There were the only thing I wanted to talk about. I'm like my dad. Works in the movie business. He must love them and he'd be like not really but the movies he would tell me he loved were. I mean this is kind of my dad's favorite type of movie sure. which is this very very sort of Seemingly slight small well observed human story with just a little bit of an odd bent and he would describe movies to me as a child where I'd go. What's that about? I think. Melvin Howard Hollywood movies. What's that about? And the way he would describe it to me would Seem so odd that it would stick in my mind for years and years and years before I ever saw them. We Brewster mccloud was another one like this where I'd go. What's the movie about? And he would say it's it's about this guy who's just kind of loser and he picks up an old man on the side of the road and it turns out to be Howard Hughes and he leaves him one hundred and sixty million dollars so he goes to the movies about him getting really rich at a nowhere and he was like no that happens at the very end the movie is just kind of the guy living his life and I would think I don't understand how that's a movie so it must be good? That would be my take away when I was. That's what made it seem magical to me. I was like whatever happens. Pins in the middle stretch of that movie. See Right incredible setup an amazing ending. There must be something so well executed. Because I don't understand how that can sustain ninety minutes you know and so would hold the sort of mythical place in my brain of what is this movie and it just sort of felt like I have in my head this sort flake. The folklore version of a laugh. A minute you know thrills and chills and you see it's kind of a shaggy dog must have been somewhat Shaggy Jaggi because you know the the inciting incident then takes an hour and a half to play out where I was like. There aren't hijinks tied to the Big Hook of the movie in order for that movie to be that good. Something has to be done so well in area that you're not even describing to me. That's what was Kinda magical talk about. I guess was that he couldn't describe what happened. In the whole Middle Chunk of the movie it would be hard to describe. I mean how would you describe it. It's like just kind of life. He's got the one wife and kids. ALZA party gets another wife actually kind of tries to make big a couple of times like brushes up against so you know tiny bits of man for a little while right good milkman. A bit like it's just been Yeti and sort of this and that the other movie that's sort of like this for me is terms of endearment. Why feel like everyone remembers the beginning? The humongous watches that movie. And it's like isn't this movie about someone getting cancer and dying and it's like no only right at the end. She gets cancer in the last ten minutes. Mostly it's just about her life mostly it's just about her life and different relationship. She has all these different things right. And it's like well that's the real meat of the thing but that's the hard thing to explain so everyone reduces it to right. What's the setup overbearing mother? What's the end cancer weepy? What's the setup this beautiful sort of meeting between You know nothing man and billionaire right. And what's the end he gets the will you know for like a second but knowing never but it's it's the same thing and that's like you talk about. What makes a good director what makes a good screenplay? What makes a good performance? It's all this stuff in the middle and the middle is ninety five percent of the movie is so gripping and so engaging and so emotional and there's there's no way to explain why it is because it's all just done well it's well observed you know it's done with like an incredible amount of intelligence and craft aft and also has like weird twists that you go with like yeah. They're watching a game show and he's like we should go on the game and then they go on the game show which is which is based in fact right. That's in the wikipedia page but it is. I mean it's a stranger than than truth story of what all the weird things this guy went through that he got married twice on the second time time was in Vegas to his wife who had left him got pregnant by another man. You know good that I relate to this character. Oh totally yeah I mean I think that's what I guess. The ultimate cash in on this movie is this is sort of the Goldman blank check. Because he had done Cuckoo's nest won the Oscar screenwriters and I do think this was his big pet project project he wins another Oscar for the screenplay but I think much like Ebert guess this was such a big news story that probably everyone was. How do you make a movie movie out of the lawsuit? How do you make a movie out of the trial right? He ignored that title card at the end. It's still under content which it was until two thousand six. It was still being contested. Ask someone wrote a book in the nineties. He sued again in the two. Thousands died just a year ago. A whole problem was that was never a real so it could they could just kind of drag drag it out forever right. This is the only thing the reason purporting was even purporting to be a very compelling narrative on both sides which were Hughes's people were saying then why would he leave it to this guy. This thing is riddled with spelling errors. It has a bunch of things that don't line up with his life. Why would he leave money to this guy this stuff that anyone could have researched in a book his wife? I've had access to all these documents. She could have copied his signature all this stuff and on Melvin side. It's like these guys wanted that money for themselves right right. They didn't WANNA give it up to some fucking guy. They never heard of me to stop funding the wonderful reality of this movie but he definitely made the wheel. It's like the evidence it gets if it's completely damning and there's no evidence that he that he would you read about this book though. That book is ludicrous. It has the most insane circumstantial like yeah. Well this one Guy Kinda saw him go to the sand one time like it's not very good. Also that Hughes had told other people about yeah. Yeah sure maybe he met Howard News. Yeah right whilst you have the idea of four refuses. Howard Hughes's will look? I think he probably made the will. But that is the beauty of this movie movie which is why not make a story about that being real. That's that's what I love about this. Moving right yeah. You don't really have to think about the real guys real this movies about the guy who actually got this you know they just said well yeah right. I'm doing a little research. I mean, especially coming from the history that you have what is it like working at a company like Facebook. It's refreshing a never charted this out in my career even lending it Google was never in the charts. It was never planned. It was all. Kind of going with what the universe said this is where you need to be. And I remember coming here and seeing the team in meeting, you know, the different design lead directors it felt like home and. Country to people by read in the news. And you know, there's been some negative press. There are a group of passionate individuals here that are trying their best to do right, by the user. But right do right by consumers and the experience to make sure that it is all cohesive in that we are transparent. And that the platform is delightful to use that that's the number one thing. I love about being here. Designed is integral to the platform. Everything that we do here revolves around good quality design. Excellent execution and well thought out ideas now soccer being that kind of refreshing change in terms of what you've just spoken on. How is it different from some of the other places that you've worked particularly out there in the valley? How's it been different that the biggest difference? I can definitely say. Jay is the emphasis on design. Facebook is not engineering lead. There is a heavy emphasis put on design in 'execution and quality in craft those elements make up the bedrock of the experience here at Facebook. You're looking for a company that's more driven by genera and capabilities in utility was not necessarily Facebook. Facebook to goal is to push the boundaries of what is possible design in stretch engineering to push and make new things. So it's it's fascinating to see was being done here. You know, you can look at look back in in the past at paper that I launched and in order to make that product of success. They built a prototyping tool. Tell bring. Concept to live now, while paper no longer exists that prototyping tool has evolved into a very powerful use within the organization and outside. So. The company has always pushing the envelope in a find that fascinating. Very cool. Very cool. So you're out in Sunnyvale right now. "To wrapping tanks in less right so i go from summit dallas pull the hamstring go back to grad school at uva finished my masters about to finish my masters in this they have a career fair in charlottesville and this woman behind the nasa booth she comes out they miss rosa rosa webster's he says hey what's your name leland melvin i've been looking for you come here am i what what do you mean you're going to work at nasa no i'm not 'cause dupont and our paying way more than the government of house going to get paid right and and she said well into the career fairs over helped me take these books and these pamphlets and things out to my car so i walk out with her she says just come down the nasa langley and and check it out so i go down the next week or something and i am basically interviewed by these people and she says you know just just give it open up your mind just think about it so the next week i have a job offer from nasa am i wow okay well and she says oh you can get your phd here too if you want to we'll send you back to school to get your while you're working and we'll pay for it right really wow okay and it was a beautiful campus collegiate people just walk around like thinking about things you know we're hidden figures where katherine johnson from the movie hidden figures i it was and i met her and we were in this organization together it was just this organic beautiful research and just a cool place until i took the job and i started working and i went back from a phd at university of maryland and something you just was not right it wasn't time for me to get that i just didn't feel like i should be there at that time and so i had about a year of of of classes and stuff and i came back to langley and i got this fiber optic sensor management position to to do this thing with this rely reasonable entrepreneurial so that got me exposure to the folks down a jc when john young came up to see the work in the you know they were hiring astronauts again and it just the timing worked perfectly it seems so weird.
