"Today's featured stories and opinion piece from Jack soloway and Jennifer Schultz. Our piece today is entitled, we need regulatory clarity to keep crypto exchanges onshore and DeFi permissionless. At consensus 2023, senator Cynthia lummis, a Republican from Wyoming, and congressman Patrick mchenry, a Republican from North Carolina, voiced their goals of developing legislation to clarify crypto market structure in the united states, with a house proposal expected in the next two months. Last week, in a joint hearing of the digital asset subcommittee of the House agriculture and House financial services committees, work proceeds to resolve what congressman French hill, a Republican from Arizona, has referred to as an impossible situation where the same firms are subject to competing enforcement actions by the Securities and Exchange Commission, or SEC, and the commodity futures trading commission or CFTC, which is in their words, pushing entrepreneurs, developers, and job creators offshore. This is an impossible situation, and it's manifestly unwise for the U.S. to show the door to those working on what may be the next generation of global financial infrastructure. Congress must bring regulatory clarity to crypto market structure, defining the bounds and appropriate legal treatment of crypto securities, crypto commodities, and the exchanges, both centralized and decentralized over which they trade. Notwithstanding the skepticism and evasions of SEC chair Gary gensler, crypto's core innovation decentralization is the proper criterion by which to rationalize digital asset market structure and determine whether applying traditional financial regulations to crypto tokens in exchanges make sense. The phrase, same activity, same risk, same regulation, is oft repeated by financial regulators. But as applied to crypto, it raises the question, are the risks the same. Specifically, do crypto projects present the risks that issuers in the primary market or intermediaries in the secondary market can exploit their position to harm token purchasers by, for example, abusing non public information, misleading market participants, breaking promises, or otherwise engaging in fraud.

"Yesterday was for so many of us, akin to the Super Bowl of crypto regulatory action. It was the long awaited verbal comeuppance for the industry's number one antagonist. Yes, yesterday SEC chair Gary gensler sat in front of the House financial services committee for a grueling four and a half hour oversight hearing. Now, gender last appeared before the House in 2021, although he did appear in the Senate for an oversight hearing in September of last year. Ahead of the hearing notable Republican committee members, including GOP whip Tom emmer, and representative Warren Davidson, expressed deep misgivings about how gensler has been running the regulatory agency and foreshadowed a tough interrogation. The hearing covered a broad range of regulatory changes that have been introduced during gensler's tenure. This includes climate change disclosure requirements, proxy share ownership and major market structure reforms, all of which were seen as regulatory overreach by House Republicans. Since gensler came into office, he has used the agency's rulemaking power at an unprecedented level, introducing 53 new rules in the two years he's been in office. That's more than twice the amount introduced under each of the two previous SEC chairs. Of course, it seems odd, given that one of the key issues the crypto industry has with the SEC is ignoring proper process by avoiding the rulemaking procedure when making changes. But in broader financial markets, gensler is viewed as being far too prolific in changing the rules. He's seen as often speeding through the public comment process and increasing compliance costs for public companies with these plethora of new rules. Now, despite all of those issues being raised, the focus was undeniably on the SEC's recent rampage through the crypto industry. Republican committee chairman Patrick mchenry got right to the point in his opening comments. Which criticized the SEC's approach to regulating digital assets. But Henry said, under your leadership, the SEC has brought nearly 50 separate enforcement actions against digital asset firms. At the same time, you have refused to provide clarity on whether digital assets as part of an investment contract are subject to securities laws, and more importantly how these firms should comply with those laws.

While crypto has remained remarkably bipartisan compared to most other political issues, there's no denying that mchenry is one of the most important advocates for the space and importantly, the principles that underlie it. But of course, given that FTX did implode and given that so many in Washington were standing in the blast radius due to their connections to SPF, it is doubly the case that crypto regulation is on the 2023 agenda. The knee jerk reaction has been to assume that because of FTX, things are going to be worse and harsher than they might otherwise have been. I don't think that that fear is unfounded. Certainly lots of people on the front lines in the crypto battle in Washington have some concerns. If you want to get a sense for that, go back and listen to my show with Kristen Smith from the blockchain association at the end of last year. At the same time, I find myself more optimistic than many here. I think that it is possible, even likely for a big event like FTX to wash away a ton of goodwill. Federal law enforcement is in contact with former employees of FTX and Alameda research as part of a criminal investigation. Two former employees have confirmed that they have been contacted by authorities. The investigation is still in the request for information stage and the employees did not provide details on what information was sought. The federal investigation into FTX and Alameda is being conducted by several agencies. This includes the Justice Department, the SEC, the CFTC state regulators, in court, FTX bankruptcy lawyers stated that companies new CEOs cooperating with law enforcement and regulators. In court proceedings, the CEO mentioned that there is a lack of record keeping at the company and that it has been reported that there was already an ongoing investigation before the company's public collapse. In a recent interview, sbf claims statements made by ray and FTX lawyers were false. And he said, while those statements were false, he can't remember certain details. We were talking earlier about the midterm elections and what is certainly no secret is the fact that Sam liked to donate to politicians. And there is some disagreement over exactly how much he gave to the democratic national party for the last terms elections alone. There is also a question on where he got that money. Disagreement in questions. So now SPF has claimed that he was some sort of a secret GOP mega donor. A nonprofit called citizens for responsibility and ethics in Washington is using that claim to file a complaint with the federal election commission. What they allege is that he violated federal laws by not disclosing millions of dollars that he gave to GOP affiliated quote dark money groups. And that he potentially distributed donations under other people's names. He recently told a YouTuber that he used dark money groups to hide his contributions to Republicans because he thought the press would cover it negatively. Now we do know that Sam gave around $37 million to Democrats and did Democrat leaning groups. In that interview, he said that he gave quote the same amount to both parties during the 2022 election cycle. The facts seem to be against him. Again, because public records show that he donated only around $320,000 to Republicans. Republican aligned groups. This directly contradicts his claim that he made his donations dark because reporters would have a negative reaction to them. According to the watchdog group, his comments about intentionally concealing political donations could be evidence of a violation of the federal election campaign act. This act requires that donations above $200 to influence election outcomes, they must be disclosed by the donor and that the correct person who funded the donation must be named. It is currently unclear exactly how much money he gave to dark money groups or to which organizations receive donations. These groups do not report donations and a spokesperson did not provide details about the size and scope of his Republican political giving. In the meantime, new management for FTX has reportedly hired Alex partners. They are a financial advisory company and they've been hired to conduct asset tracing to find and recover the billions of dollars worth of missing customer crypto. Alex partners is led by former SEC chief accountant Mark yachts. And this work will complement the restructuring experts of FTX. FTX and FTX U.S. were hacked on November 11th, the resulting in the loss of over $450 million worth of assets. And then in an interview on November 16th, SPF said that he had narrowed down the potential hacker to 8 people. And that he believed that they were either an ex employee or someone who installed malware on an ex employee's computer. On November 22nd, lawyer representing FTX debtors said that a significant amount of assets had been stolen or were missing from FTX and revealed that blockchain analytics firms had been enlisted to help in their investigation. The stolen funds have been moved through various crypto mixers and exchanges to launder the money. The hacker transferred their eth holdings on November 20th to a new wallet and swapped some of that for an ERC version of Bitcoin. And that's going to do it for us tonight. It makes it really really difficult from individuals primarily individuals of color who are coming from lower income families to even really seriously consider education And and also You know even for people who do come from middle class upper middle class families Do you really want to have to jump through all the hoops and hurls. You have to jump through to become a teacher. It's it's the most important job in this country in my opinion. Why are we making it so difficult. When there isn't necessarily evidence that says the teacher license actually makes them a better teacher. And i think if you've talked to our teachers aren't exile license teachers here and i don't think one of them's gonna say i'm a good teacher because of my teacher license And so i think we just need to rethink that And and and figure out a better way To to license our teachers not make it so difficult that runs people off mega such a financial burden that eliminates whole pocket section of our population. And then once you get it let them keep it. Let's do some wrong. You don't have to keep going back and get recertified. So that's that's more. What i'm saying. I couldn't be a school leader in the public school system so we need to examine that as a community as educational community as well so but to answer your question so i started in social services which is the path that i thought it was going to stay on Had an opportunity to work in a really really unique program in madison place neighborhood intervention program and i was my specific job was working with a group of kids almost all which who had come to madison by way of chicago because if you think back in the early nineties Chicago had a. It's the worst welfare system and madison. Had one of the most attractive ones if you wanted to be. If he were on wilbur soap they'll move scotto and brought the saco problems to specific communities in madison was really called of chaos and And so they were they. Were those kids. Were going to jail at young ages and in my particular program a judge could send them to my program as an alternative to prison Stand committed significant enough crimes where They were getting a prison sentence and if they completed my program there prison sentence would be stayed. If they didn't complete my program they went to jail. That's some camp to jail. Mostly gun robberies that nature really really tough kids and i could be forgetting a kid or two. But i don't know of once i can't recall one single kid that came through that program that didn't make substantial changes to their lives In this program was complete. It would take a minimum six months in and oftentimes longest nine months and When you entered the program we had six days a week of contact Four hours a day so it was really really intensive program but every last one of those kids were making it out of level one level to sink almost all all of them are almost all of them completed the.

When when i was in high school i used to go to the greek step shows they have and it was just a big big deal And when i got to madison maternity is had like two or three black fraternities had two or three people and it didn't seem as advantageous as being on the football team. When when i was asked what i wanted to be my last few years of high school you can ask that all the time and my first couple of years in college I always had a sports journalist. Because i actually enjoy writing about in reading about sports as much as i enjoy playing sports probably more than i enjoyed playing football and sr started down that paneling you know as a sports journalism major But i wasn't necessarily taking school really seriously when i got to college. I was making sure. I was staying eligible and and And then towards the end of my sophomore year going to my junior year Took an african american studies course which really changed Be as a person and change the direction of my life in In for the first time was seeing me in the context of this world. Learning about my history You know beyond the martin luther king area tug and what we would learn about slavery and it really just kind of prey to some esteem about me. Bat helped me be proud about who i am. How Would Financial Transaction Tax Affect Retirement Plans?

"Biden Well, he wants to study the idea of a financial transaction tax. Lots of your tax that you'd pay each time you buy or sell a stock Congressman Patrick McHenry. He's among those that believe this would be an absolute disaster for our retirement accounts. The financial transaction tax is intended only had Wealthiest, But when average everyday investors still buy stocks and bonds, they're gonna be hit. There's one study that shows that people have to work an additional 2 to 3 years in order to make up the difference for this financial transaction tax, a transaction tax talk. Talk to me about that. How will that affect our retirement badly? Just I hope they stop studying that and work on some other things. A lot of Democrats have backed his tax and its own stock trading. As a way to raise badly needed revenue and address concerns about the health of financial markets. So House Financial services chairwoman and Maxine Waters said she's quote unquote very interested and quote unquote certainly looking at a financial transaction tax, so they want to put a 0.1% federal tax on stock. On and derivative transactions in there saying, Hey, this could raise $777 billion over the next decade, according to a 2018 estimate by the nonpartisan Congressional Budget Office. But first of all attacks like this would have fierce opposition from Wall Street, and it's unclear whether even the moderate Democrats would support it and opponents warn Hey, this is going to backfire on the retail investors by raising costs and making financial markets less liquid. Because look is going to trickle down and everybody who knows stuff like this and what I means not trickle down. Economics is trickle down. If you want to put something every time somebody buys or sells a stock every time. Well, most people inside a four Oh, one case they're buying and selling stocks that that's that's what's going on. It's not going to just impact the wealthy, and if you're going to start putting taxes like that on there, it's going to be hard for people to accumulate more and save more for retirement. When every time you buy and sell is going to trigger attacks blood, there's some other stuff We already know from attacks perspective that that's coming with a new administration. That's bad enough. We don't need this one. But don't you also think that people who maybe want to try their hand it doing buying and selling some stocks, or maybe I just want to dip my toe in it to see if I'm comfortable with it. Well, now, if I know I'm going to get taxed every time, even if I'm just learning the process, I'm going to step back and say Maybe this isn't for me because this had more of a negative ripple effect than they perceive. I don't even think they're looking at that. I think what they're looking at us, man. We're getting ready to write this check for 1.9 Trillion. We wrote trillions last year how we're going to cover this stuff because right Now there is no plan to figure out a way to pay this money back other than keep printing more, and that's not a plan. It's you know, just kind of hoping for that. I'm not even gonna say Get out. Get out frosted hope for the past. Pray for you know, it just it doesn't make. It really doesn't make dollars and sense. The only benefit to this is He is going to raise revenue for the government to cover all the debt that we have. I mean, that's it's not something that's gonna discriminate between the wealthy and the middle class. It's just not going to do that is going to impact everybody and maybe they don't care. I don't know, but it really doesn't make sense. It's just it's a shortcut just being You know really good at what they're trying to do. And just a little loophole here, we're gonna slide this little tax in and maybe maybe maybe nobody knows where people won't think it's so small that it's not that big of a deal, but it is every time that's a huge deal and how you're going to do that on retirement accounts, Retirement Council tax deferred. So now you're gonna have somebody pay a tax on account that's growing tax deferred. So you're gonna have to pay taxes on money that you are using that Shelter, but it's sheltered from income tax.
