This is Republican Congressman Tom McClintock. He declared victory for another term in District four over his Democratic opponent, Bryn Kennedy. This is Kate because Bernie Fernandez, who spoke with McClintock after his win, it appears we've carried the day both here in the fourth Congressional district and more broadly across the country. Has your Democratic challenger Brent Kennedy as she reached out to you. No and in terms of the presidential election, how the map is looking. What are your thoughts? How are you feeling about President Donald Trump's reelection chances. I think it's looking very much like 2016 Aziz. I looked at the electoral map. It is pretty much a repeat of the 2016 election. I think that Ah, we should be saying about 320 electoral votes for the president. Once the dust settles. That was an interview that was done last night with Tom McClintock. This they spent a lot of money in this race. So Kennedy spent about 2.4 million of McClintock raised 1.9 spent 1.5. And this fourth congressional district is an entirely inland part of East Central California. So stretches Truckee, South Lake Tahoe right down to an area outside of Fresno. Democrats have been taken a shot at McClintock for as long as I can remember, and they can't knock him off the block. They've they've tried. You know, there's one trend though. Eldorado County that I thought was really interesting. How close that was. I mean, that Democrats almost won the day in in Eldorado County. I think that surprised a lot of people. I know when I checked it. Right before I went to bed. Last night, I saw a report showing it was going blue. It went, it went red. It went round, not by a lot, Esso, and they're crediting a lot of the folks who moved to Tahoe for that. More audio. NBC NEWS Projecting Democrats will retain control of the U. S. Senate. 2020 Vice Presidential Debate: Post Debate Analysis
"First, as always, when we have a debate, presidential, vice presidential or otherwise we bring in my friend Kpk political analyst Gary Dietrich, who joins us right now, Gary, Welcome to the show. They had good to be with you. And I look forward to a sharing with our callers. And perhaps even hear from them stopped on this. No doubt an important night, my friend. I think it probably is going to go down as one of the most. Important and watch Vice presidential debates. As you know, pad most people steer clear and find out which Channel V p debate it now. Not for me, not tonight. Well, you know for me, Gerry. Because we all know what happened in the presidential debate. Okay? But in the vice presidential debate, couple of things first thing I want to say is, I think we, um maybe learned a little bit more about about The candidates, and certainly one of the things I learned is it was a little different in the first one. It wasn't so testy, and that's college other names to do that, But But when, course, the moderator time, Susan Page us said to the University of Utah, where they held it, But she would say Thank you. Thank you. Thank you, And they would just keep talking as if she was not even ending it in. Both of them were guilty of that tonight. They just don't seem to follow the protocol. Anyone? Yeah, They certainly do a lot better tonight than last week. I mean, but that debt debt to me got annoying as well. But at least and then cure Point Palace is very well taken. It was a far far more substantive debate. Because again last Tuesday, a good third of it. You couldn't even make out what people were saying, because they were talking over each other so much. And then when that wasn't happening. I know the third of it was nothing more than name calling and accusing each other of stuff, right, right. I thought substance substantively. Far better. I know we want to dive into that. But I just think you know a farm or just say, I think helpfully conducted debate that we saw last week. Why a very extensive notes that I took care of it. Let's go to your notebook first. Gerry, what did you take away from this other than the things you've mentioned? Where there's wasn't much name calling, and it was a bit more substantive and it was in certain areas. But I tell you one observation I haven't we continue to have When it comes to politicians. They have an absolute art of avoiding questions, Gerry. It's amazing. It is an amazing talent. You know, sometimes it's so funny because it gets so extreme that they literally launch up on something completely unrelated. To what the question everyone's right. Never even come back, even attempt to do it right. You know, there's the art of bridging, which is you start with an answer that's related question, and you'll really get it. Bridge to something that you'd rather talk about. But somebody has just said I was just like, okay. Thanks for Thanks for speaking. I'd like to say this. All right, let me let me tell you one impression, and I came away from more generally. That and part of this is the nature of being an incumbent III, The vice president, who is currently in office, and part of it is and I have to say this, I felt like in this moderators case. Not a fair and thorough job of taking to cast. Some of Harris is history in elected office, which is extensive and buy even more, so I felt like the vice president Was on the defensive for most of the debate, particularly early on And and I felt like there could have been far more balance in saying, Hey, Well, you know the questions that's been raised about, you Know, X Y Z. When Joe Biden was in the Senate, we didn't hear anything about his voting. Many, many years of voting record Senate nor, frankly, honestly, really any kind of a hardball question about the years service vice president nor really questions that even within our own party have been raised about Senator Harris to me. I had a sense in which the questions themselves. What? Adequately reflective off some of the challenges that have been raised about those who currently or seeking the office. Not holding. I'm glad to hear you say that, Gary because I'm sitting there and I'm listening, and I'm listening very carefully in the moderator moderator plays a big part in this and you're absolutely right. From my perspective. I felt the same thing. I thought the questions were slanted. Um, the through the entire time all the way up until the end when we and I remember the presidential debate, Gary, I remember how the ending they manufacture this question about if you were to lose the election, Mr President, and would there be there smooth transition of power, and then we hear this. We hear this Susan page tonight at the end, and she asked both of them, and it's a slight on the president. He never said he was not going to leave the office piece. We never said anything like that. And there she is pressing this. What I consider to be a manufactured question about what's gonna happen. How would you handle that? Mike Panzer. How would you take? What would your response be? Comma Harris, you and Joe Biden. I am in total agreement. I thought that the questions were slanted, Gary. Well, and you know me, Pat and our listeners have known me for 20. Plus years on the station. You know, I I call them like I see him. I don't care what it was all going on, or Jerry about who was it doesn't matter in the national level, the exact game way, But I really came away feeling that And then there was and I do agree with you about that last question. Frankly, it's the only one she was able to oppose the moderate, she said. She had time for related to election integrity, and I really expected her to go to the integrity of the mail in ballots and these other questions. You know, our How long is the process could be could be drawn out. Could there be expensive court challenges. So take the time to go about whether the president's going to leave or not just seemed odd to me, particularly when everybody from Mitch McConnell on down it made utterly clear. That the president will be leaving if he gets voted out. Anyone if he isn't saying another thing about a question that I really found and I don't know how to use a word except disingenuous. It was the question about When Amy Cola coming back, so just highlighted? Yes, taking up picking up next week and it was about it was about what would you do? And it was a long and convoluted way to get to the Abortion question. What would you do that Mr Vice President in your home state of Indiana, if you'd get if you get approved, and if they throw out will be weighed. And if it goes back to the states, then what would you say Indiana should do what I said. He's not the governor of Indiana anymore. He's going to have absolutely no say in that policy making decision. It was so convoluted odd to me. I felt why don't you just ask you a few pro life or pro choice? Because that's really what the heart of your question is? Absolutely it is. And I believe the American people can see through that, Gary. I really do. Even if your vote he made up your mind. I mean, it's pretty obvious that you can see what's happening, and there was another point there. Where they were talking about late term abortions up until the last day and and pants and asked, you know about that. And there was no answer from Kamala Harris. There was no it was a redirection. It was abridging as you say, Hey, also asked if Judge Amy Kona bear it was going to be appointed. Would you be filling the Supreme Court room? She never answered it. He says to her. I want to make it very clear to the American people. I want them to note that she never answered the question that she says. Well, I'm gonna answer the question right now. Now I'm going to answer. The question can never answer the question. Never, and I listened. I was waiting for that. You know, I was waiting for the answer. It never happened. Yeah, that that and that is a very important issue. I mean, if there's three issues that people are very concerned about it last night, I happened to moderate a debate on I was in debate was a candidate forum of a number of different off was honored of moderate and you know, Congressman Tom McClintock. Well, Yeah, he he was headlining that candidate for him and added, he laid out very eloquently is senator as Congress. McClintock often does what he perceived to be the three major issues going report and it wasn't anything about specific foreign policy or even economic policy was packing the Supreme Court. It was about whether the filibuster is going to be thrown out in the Senate so that whoever has the majority will have complete and utter control. And and thirdly, whether state who is going to be granted to particular selected entities like Puerto Rico like Washington, D. C. That would then begin to quote unquote packed the Congress. And these are very, very significant issues for the future of the United States and our governmental process. None of that was raised tonight and to your point pat, which I think is well taken. Senator Harris refused, and there's no way to get around that refused to answer that question. And I thought that was very telling that you know that issue, which is a very central one right now and could have ramifications for many, many decades become was not answered.

Why those two gentlemen are sitting with you today after what you've done, so I'm gonna ask you a question. How are you going to give you some stats? The question is this You tell me what part of this organization isn't better today and really substantially better today than it was four years ago when they came So that's a little minor league system and I see since match drafted I believe you have two players that made the major leagues and Kohler bring this year and hazily. So outside of that, I'm wondering there's a feeder system. Other teams have injuries and they've overcome them. Why is this a problem? All right, let's go, Micro. Then we'll go macro. A micro problem. Is that Jay Serial Muto is a free agent in 30 games, plus the plaice. And the New York Mets need a catcher and Steve Cohen, for those of you don't know who he is and what his deal is Big Box New York to the point that the second he takes over the Mets John he becomes the richest owner in major league baseball. Soon as he takes over. And he's going to take over the Mets. He won the bidding war against Alex Rodriguez and Jennifer Lopez and Josh Harris and some others. He's the one who's going to win this which means when Jadiriyah Muto and by the way, really mute tone is agent probably have been aware ofthe. I'm sure his agent part of the reason they haven't signed is a wait, Wait, wait, wait and went to no brainer. Steve Cohen might be taken over the mats. House set to vote on marijuana legalization
"1000 representatives will vote on legalizing marijuana next month. The more act would remove cannabis from the Controlled Substances Act and raise some cannabis criminal records. "Today. The House Judiciary Committee is marking up. The articles of impeachment in a confrontational televised hearing. Were also learning new details about the inevitable Senate trial early next year. I've got to fantastic guests. Tell me unpack all the news of the day in a few minutes. We'll be talking with White White House correspondent for American Urban Radio Networks that CNN. Political analyst. April Ryan but I I'm joined by my colleague. CNN producer and reporter the relentless Marshall. Cohen Marshall Thank you so much for being here on the podcast. Thank you David so I want you to hear a little bit of sound from today's hearings now just I said marking up. The what is happening here is actually like the normal legislative process. What you know when When a bill gets introduced in committee it gets marked up that means each side? Has the ability need to make amendments to the bill change it and the committee homes that bill and then passes that to the full House and that is what is happening with these articles of impeachment. Now of course. The Democrats crafted these articles. They're very comfortable with the language and they're trying to change anything. Republicans are being given the opportunity Obviously To be able to slow roll this day make their political points Try to amend the articles but they're outvoted time and time again. procedurally These two articles are likely to be passed out of committee before the day is done and then onto the house floor for a vote next week. But that's the process. Here's the rhetoric I want you to I hear hear from Congresswoman Pramilla Jal of Washington state will any one of my colleagues on the other side. Say that it is an abuse of power to condition aid to condition aid on official acts. We'll forget about president trump. Aw Forget about President. Trump is any one of my colleagues willing to say that it is ever okay for President of the United States of America to invite foreign interference in our elections. Not a single one of you has has said that so far what I heard jibe. How say this Marshall? Today my ears perked up because she was really trying to remove donald trump from the equation and really focus on the fact that Republicans on the hill. Her colleagues on the other side of that day are would from her perspective blindly in lockstep with him no matter what so her her whole arguments here stripped him out of it. Are you okay with this presidential behavior. We've heard from a couple of Republicans. Mike Turner of Ohio will hurt Texas that have indicated the the phone call with Dolinsky that trump's language was not okay. I mean I think Turner used that that exact phrase Mr President. This is not okay yet. He fully does oppose impeachment She wishes it. Was that simple though. You could just strip trump out right hand mant trying to make an argument larger about Republicans here right about being just blindly lockstep with him. But they don't agree with her on the merits of this. Either right she's she said said two things she said trump Conditioned official acts on these favors number one and number two solicited election help from Ukraine crane. Now Democrats are in lockstep. That that's what happened Most outside observers that are acting in good faith would say that that is apparently apparently what happened but the Republicans dispute both of those right they say number one there was no direct proof that trump conditioned the military aid aide on the investigation. And you didn't hear that From anyone not even sunland right. Who said a Gordon Sunland the US ambassador to the U.? You who said that. It was conditioned on the White House invitation but not necessarily the military and then secondly we've been hearing this all day from Republicans today they're not conceding the ground that this was trump soliciting election. Help they're still arguing and they've been doing all day that this was trump trying to crack down down on corruption because Burris MMA The Ukrainian energy company was corrupt. And Joe Biden's son Hunter Biden was involved with these corrupt crooked get actors so problem with the ground. Marshall can you point to all the other places that Donald Trump has made it policy to fight corruption and using Presidential Oval Office meetings meetings and Military aid is a way to accomplish cycle no and the Republicans are acting in bad faith by pushing both of these points it strains credulity ability it it defies logic. It's it's not a good faith. Argument here is perhaps a better argument from the Republicans that I wanted to hear from a Republican Congressman of California in Utah McClintock. His argument is really neither of those things. It is that the president has the ability to set policy here. And what is At core in McClintock's point of view here is all of these witnesses. You've heard from data policy disagreement of the way he was managing the Ukraine relationship relationship and priority. Here's McClintock MR chairman. The constitution introduces the President. With fifteen words. Executive Power shall be vested in a president under the United States of America. It does not vest any authority in Lieutenant colonels the NFC Ambassador State Department officials are Cabinet Secretaries Rotarians the only authority that these officials exercise is delegated to them by the president so all of the criticisms and resentments Johnson personal and political disagreements. That we've heard from those officials are completely irrelevant. I give him some credit there for making a a constitutional to tional argument on the constitutional question of impeachment. Is he right well. The president does get to set the policy but if the the policy is essentially that the United States government should be used to help the re election of Donald J trump then okay. The president sets that policy but it's in his own personal interest. The outcome of that official policy is for his his personal benefit and as Democrats describe it. What you just described is in violation of the Constitution and the oath of office that he swore You know when he became president. That is Nancy Pelosi's ultimate point right when when we discussed this yesterday. Whenever she's pressed on the politics of this she she goes to her oath of office to protect and defend and uphold the constitution and that the president violated that very oath that he also takes? Ah On she's not you know hooting and hollering and making a big show out of this in many ways. It's been very much reluctant march to get here. And and you know I think the strongest proof of that is that when Nancy Pelosi in the Democrats took over in January of this year. They didn't impeach anybody they didn't even they tried to snuff out talk of impeachment and anytime did any of the more Liberal members of their caucus started bringing it up Pelosi's he just shot it down over and over the are largely here. I think it's pretty clear that they are here because they feel like the president forced them to do this that he was so so unconstitutional and so much putting the integrity of our next election at stake that they had to do it period. So where do we go from here. Marshall so These articles get passed out of committee. Today I assume on a party line vote. We have no indication that there's a Democrat on judiciary. WHO's not in favor of these? These articles of impeachment and judiciary is known to be a a more partisan committee of all the committees on on Capitol Hill And then we see action on the House floor Lord but what happens between now and then yeah right so the question is going to be. How many Democrats are going to break ranks and joined the Republicans a few have already stated their opposition? No big surprises there I think that the the same guys that voted against authorizing the inquiry are going to be voting against impeachment number two of those Jeff Andrew of of New Jersey and Colin Peterson of Minnesota. That's right so no big surprise there I don't think that anybody really believes that. Either of these articles of impeachment each mint will get voted down by the house. It seems like there's a They've crossed that threshold based off of where we are right now. That could change but You know is it going to issue going to drop. Is Nancy Pelosi to lose more to this. Point where it's kind of embarrassing and people will sort of get second thoughts and feel like it's limping. Something over to the Senate or will they keep it in the low single digits. Maybe you can count it on one hand and say well it's too bad that we didn't get any Republicans but look we still have a clear majority very few defections and we did our jobs and now we'll kick it over to our colleagues in the upper

"Sort of thing that tends to evaporate into the ether and now couple that today with this new sixty seven page report that has just been released on a bipartisan basis from the Intelligence Committee in the United States Senate now Robert Muller yesterday was at his most passionate and honestly his most coherent when he was articulating the scale of the Russian attack on our election. It's intentions implications how serious this was as a threat to our democracy. He said over all the things he has dealt with in his career. This is one of the most serious threats he have as he has ever seen to our country. Remember he was F._B._I.. Director in the immediate wake of nine eleven well now immediately in the wake of his testimony here today. Surprise is the Senate Intel Committee reporting unequivocally that that they have looked into this in detail and they agree with Robert Mueller. There can be no doubt about what happened here from page five of the report quote Russian government affiliated Cyber Actors conducted an unprecedented level of activity the against state election infrastructure in the run-up to the twenty sixteen elections. I mean even over the course of those two hearings. Yesterday you heard Republicans become less able to keep a straight face while questioning or denying the Russian attack attack happened or that. The Russian attack was any big deal. I mean it was poor. Republican Congressman Tom McClintock from California at the morning session yesterday who started off trying to say he didn't believe all the social media manipulation stuff run out of Russia from the Internet Research Agency Agency. He didn't necessarily believe that was necessarily even from Russia. Kenya prove it I mean that was a very strange assertion by congressman McClintock particularly because he's from California right like you sort of think that maybe he might they have trouble with that when he goes home I mean I guess he's going to say that. There are Internet research agencies everywhere. There was just the Saint Petersburg franchise. Maybe they could have been running that stuff out of Indonesia office. I don't know I mean that was that was not in the morning but by the afternoon noon even the Republicans on the Intelligence Committee. Some of them were paying lip service to the fact that yes what Russia did was bad and yes. It was serious and yes. Maybe we OUGHTA start. Think thinking about how to how to stop that from happening again well that's yesterday and then today this bipartisan hi partisan report from the Senate Intelligence Committee hopefully will help Republicans get over whatever this tacit directive they've received from the trump White House that they should all pretend that Russia didn't do what it did but there's there's a couple of things that I think are worth noting about this report over and above its emphatic attic public conclusion that Russia attack the election in an unprecedented way and one of the things I think worth knowing about this report is just how freaking redacted it is. I'm not sure we expected the the intelligence agents committee's report on Russian interference to look like a barely unsealed indictment set aside like a whole big chunk of my day today I was like we've got a sixty seven page single-spaced report plus lots of footnotes to get through GonNa leave myself time. You really get through that not really it's more like a coffee break read. It's all under black boxes. It's all blackout. They all pages look like this. I mean presumably these reductions are at the behest of the intelligence community. I don't know but this is a serious toner investment for your printer. If you'RE GONNA print it out I mean here. Mueller Won't Say It, but Trump Clearly Obstructed Justice
"Just moments away from round two former special counsel Robert Muller taking questions from lawmakers this time on the intelligence committee we are just moments away from that committee hearing to convene on with a K. G. as Ron Owens cages John Ross manning KGO as Pat Thurston and I wanted to bring up something before we go back to the committee obstruction of justice and the argument by some that well he wasn't the Republicans keep raising this issue of underlying crime Richard Nixon did not order order the Watergate break in Richard Nixon ultimately fell because of a cover up of the argument that is being made as the president attempted to obstruct and cover up by the way a Dorian just sent me an email I feel I'm very informed I haven't missed a beat about trump I just hope the next election legitimately removes them I would prefer impeachment talk about a guy in the middle there it is the way I saw the it just south of the Hank Johnson from fifteen hundred on each side yeah the problems have been like Barry Goldwater said you know carpet off letter flowed out of the ocean yeah as to what Pat thirst and said earlier you don't you said you're more interested in hearing the questioning from the intelligence committee because they're going to focus on the Russia meddling which is important and multi even stated that was the most important thing that Americans the smaller all hearing give the reason yeah right well I is that the reason well this afternoon yeah I will be put on the spot and I think that one of the the reason that I want this more so we've talked a lot and I think the American people have been exposed a lot to the questions about obstruction although witness tampering with something that Miller also said occurred but the the rush investigation people just passed through the first part of this because there wasn't he did state that he there was insufficient evidence to prove a criminal conspiracy there was so much more there there's so much in there about the actual collusion the cooperation that was taking place the soliciting of information that was coming from the trump campaign there was so much in there and it didn't in his in his opinion rise to the level of a criminal conspiracy for which he could be charged but there's an awful lot in there that would indicate it either to my mind on ethical behavior corrupt behavior of behavior that was certainly collusion even if it didn't rise to that level and so I'm anxious for them to get that information out so that the American public here's an interesting you say that because it was inconclusive as you said but then the but then on the second part of the mall the report it really zeros in on the it was not structured as Jolla's so this seems like there's more there because it was more complicated it was mainly in lab so that whether it succeeds or not that's ridiculous I mean if up obstruction of justice is what you do if you want to file for impeachment the question of whether the Russians coopted the election influence the election is a critical question and I want to remind you the president of the United States to this day denies that the Russians influence the election and the president was asked if he trusted of the word of Latimer putting or American intelligence agencies and I also want to remind you that there is an active report this morning that Dan coats who is the DCI may be removed and who was the president consulting with on that but Devin newness so there's a lot there are a lot of layers former Republican has that's right there are a lot of layers here now but all right people need to keep their eye on one ball the Russians interfered in the American election there is no question about that even in addition to that John it's that the Russian interference would not have possibly been as extensive or as successful as it was without the cooperation of the trump campaign format once approached right once approached you know had day immediately gone to the FBI some of these efforts could have been thwarted some of this information could potentially have been made public the American people could have been aware so this I think also goes to a potential impeachment are they load are they starting to get in yeah Adam shooter yeah Schiff is taking his seat I thought it was interesting congressman Tom McClintock from the Sacramento area had an interesting way to sum up Muller's report and I want to play that for you here although weak up not you can't put it up okay never I was gonna try and play for my own computer and that's not going to be working but I talked about that Robert Muller ringing the doorbell and then dropping his report on fire and running away so I thought it was a great way to describe it no matter what side you're on yeah I know it's it's to the biggest of the four hundred plus pages into that run on hers needs to do something right exactly and that's coming from a Republican and it's it's really important to realize that fact now I'm looking at the at the screen and we're going to bring you the sound but Adam Schiff is about to call together the Senate of the house intelligence committee and this will focus on the question of collusion cooperation Russian interference in the election and I will be fascinated by how the president tweets in response to what we are going to hear over the next several hours it is going to be an awful lot that he's not going to answer in this regard to because in addition to the Russians there were a number of other people who were not indicted and so those are individuals that the justice department has told him he should not be talking about including you know the don junior and I can't remove us but there are other people who are Erik Hicks was brought up in the last one though when he responded to that request just last week hope picks was subpoenaed refused to comply with a subpoena right because she lied well but whatever the reason the president extended executive what he it's not exactly a privilege she center it's some new myth right about executive authority to prevent her from testifying yes and let me tell you the committee was not happy about that the Democrats anyway well what if thirty four I think was a thirty four Russians that were indicted I'm not more than two dozen what yeah thirty by two thousand thirty six thirty seven I mean yeah thirty seven seven entitled and from big did more than two dozen indicted Russian right you know no matter what the Russians are going to interfere with this next election to I'm sure they already on that what what we didn't hear they call John show every night signal right it just goes all the way to Russia what we didn't hear it was the voice of errands that star general was false statements but the guy who puts the countries to this whole saga starts at all for three years we live this now he lies and you guys don't charge and I'm curious as to why well I can't get into it and and it's obvious I think if we can't get into charging decisions that wasn't about trump if I'm pretty sure is that was not about Donald Trump that was about that professor who It's amazing to me that we have angel moms and dads outside of Nancy's, Pelosi's office, she's in the office, and she won't even come out and talk to these these parents that can tell their stories, and we have featured many of them on the program, and while we had another murder young person in New Jersey last week where I grew up in Long Island, New York, you've got an admitted MS thirteen gang member who had been thrown out of the country after killing a man, I lived in Huntington Long Island, and this is back in he'd been deported in two thousand seventeen after he was convicted of manslaughter did time for the fatal stabbing of a man in may two thousand outside of Huntington deli and his back in Long Island again, he snuck right back into the country. Now, I know that's not the ninety eight percent of people that probably just want. What we take for granted everyday, freedom and liberty and a chance for a better. Life for their families. But when you add up the numbers, and you look at the number of deaths from the drugs coming across the border from the cartels. And then you add up, the violent illegal alien, criminals, and homicides and sexual assaults. Violent assaults. These are real people real families real tragedy, real death real suffering. And is being used by these sanctuary laws. The Democrats are imposing in states, like California again, I think they know exactly what they're doing. But they're they're serving a for them a much bigger purpose in that is to perpetuate their political power because they've alienated the American people, and you're going to say, yeah. Go ahead. That when I talked to border patrol agents. They're telling me, especially long-term agency. They'll tell you that ten years ago. It was a different kind of person who's coming across the people that were coming across legitimately researching for better life. But now what you're saying. You're seeing a lot of young men a lot of people that are not wanting to come into America. They're not wanting to come in here and get better jobs or or anything like that. They're coming here for many of them for nefarious purposes. It's not all of it. There's a lot of people wanna beer, but the point is we don't know who's coming across the border. That's what's makes a national security threat because of the the levels of criminal violence that are the result. But also because if you don't know who's coming into your country, and you can't control you are you really that defeat the very notion of a sovereign nation. And you put your nation at risk. And that's what's happening here on Tom's. Right. Exactly. Right. The Democrats know what they're doing. Well, I think they know what they're doing. But I think you you've got some Republicans that want to cater to. A big business in this idea of cheap labor, which I don't like either. Because you know, what we need to get Americans working. I I'm all for immigration, but we've got to be a vet you make sure we check your background. And also you've got to be able to sustain yourself here. I mean, the the burden financially on the American taxpayer when it comes to the educational system healthcare system and the criminal Justice system. I think, you know, all too, well and California, Tom, right? And we've seen it happen in California and can now project what will happen if the Democrats succeed at the national level, if they're able to rig the election laws open, the borders pack, the supreme court. I'm afraid is game set and match for for for this country. You will have a hard core, socialist agenda. We can see where it ends up. That's venezuela. California is now walking down that path. And I would ask every every business person who's looking at the prospect of cheap leap. Labor through open borders to ask themselves. Well, fine. How's it working out for you guys in Venezuela? And I wanna ask you about it that the president is fighting against the ninety percent of heroin in our country that comes across that border, the new Fenton, all and that kills three hundred people a week, the new federal crisis that we have he's fighting cartels human traffickers, including young girls being sex trafficking goes on he's fighting the gangs, and he's also fighting to protect America from those people that might commit other crimes we given the statistics on homicide sexual assault and violent assaults. What what are your fellow congressmen that are on the other side of the aisle, the Democrats, what are they fighting for here? Oh, they're fighting for open borders. I think they've made that very clear they see that as a political opportunity to maintain perpetual power in this country. And it relies on the sixty thousand foreign nationals that are illegally crossing our border every month of and and the problem with that is pretty simple, if we have no we're not gonna enforce our immigration laws. Our borders mean nothing, and if our borders may nothing we're no longer a country. We're just a vast International Open territory between Canada and Mexico both of which by the way, have immigration laws and borders that they actually enforce. Well, I I did see that you had written an editorial in the or an op Ed in Washington Examiner. And this is what I think you said declare emergency and build the wall. I think the president is going to let's assume for a minute they didn't put a poison pill on the one point three seven five billion for the wall. Which is all they've allocated for that. Now. They've also allocated another twenty three billion for everything else. But the wall, which I'm I'm happy about that. But the wall needs to be built that is the most fundamental part of it. The president says he has anywhere between nine hundred million and a couple of billion dollars of discretionary monies that haven't been spent that he gets to spend any way wants so odd. I think the president's plan is he'll simultaneously again. If there's no poison pill sign the Bill keep the government open if there's a poison pill. He may ask for short term CR, then he'll put those other monies together that he has the discretion to spend as he wants and then they'll declare a national emergency. And then they're going to go out to your state, and they're going to file a lawsuit which probably the Democrats will win. Then they'll go to the ninth circuit again in your state, California. Which is, you know, pretty socialist at this point, and they'll probably win there. But I gotta think the supreme court takes it up next. Don't you? Well, whatever he does. Even if it's using the congressional appropriation to build the wall, they're still going to try to block them in court anything he does they're gonna find a left-wing judge to temporarily block, but he is on absolutely solid ground in using his authority that dates back to nineteen seventy six to reprogram on obligated military, construction funds or projects for national defense. And I can't think of anything more important to our national defense, then securing our southern border, and you know, when you hear folks attack it they'll say, oh, well that's gonna come out of other military construction projects, and my response to that is what is more important securing the border of Iraq or securing the border of the United States. I just try and the Democrats always said they support this in Obama's second term. They all sounded like Donald Trump on the wall and funding the wall and building the wall they claim to care about dreamers, DACA. And they. Claim that they cared about furloughed employees. But it wouldn't even have a conversation with the president. Look look for years. Now, they have not even been able to call illegal immigration for what it is illegal. It's hard to believe that that they are opposed to illegal immigration when for years they've been working to reward illegal immigration with free tax payer page services, education, healthcare legal services, you name it, then you look at the sanctuary policies that they have been advocating for years, it released dangerous criminal illegals back into our communities rather than deporting them, you can't point to one thing. The Democrats have done to assist in securing our borders. They've done everything they can to undermine our borders. And that's why we're living with a crisis. We have today. Have you had any time to read any of this Bill? I assume you're probably, you know, handing off two hundred pages to this staffer toner pages of that staffer because you can't read a thousand pages. I read the portions dealing with the with the border wall. And what we know for sure from this is it's completely inadequate to address the crisis. So are there any restrictions on the president's spending? Yes. There are many restrictions on it, including they've carved out big sections of the Rio Grande valley where they're not permitted to build. They cannot start building until they get local government consultation completed. There are a lot of restrictions like that. But the principal question is this if it's not adequate to secure our border. He's going to have to use his executive authority anyway. And if he asked he uses executive story, anyway, why does he need the this appropriations Bill for the purpose of the wall? The other concern, I have is if this continues us on a spending trajectory that is producing eight trillion dollar annual deficit that's about eight thousand dollars of additional debt an average family in this country will have to pay through its future taxes. And is economists are screaming this warning at us that it is putting us on the verge of a a debt spiral that will lead to a sovereign debt. Crisis of. If if this Bill actually addressed our border crisis. I'd be willing to take one more step down that path. Let me completely inadequate to do. So I'm wondering what's the point Nita Lowey put out to our democratic colleagues a page and a half about the house vote on on the conference report covering the financial issues. Here, you know, billion for the census three hundred and eight million for research development, National Science Foundation. Twenty more million for the EPA hundred and sixty nine million for international peacekeeping, two hundred ninety three million for port infrastructure one hundred twenty three million for grants to combat homelessness. But then she has an altar an alternative to the conference report is a full year CR for the remaining bills. This would result in losing eleven billion and increased investments including the additional one billion for the census bureau that is desperately needed for our communities to be well prepared in the deck. That follows a CR would also lead to the department of homeland security spending two billion on border barriers and significantly increasing the number of detention beds sounds to me like the president should say no to this deal. And maybe just get the full two billion dollars, which is more than they're offering. I agree with you. And by the way, once she invokes is a thorny to reprogramme funds, and it's up held by the court. The Democrats are then being a very weak bargaining position. Yeah. I mean, so what are they gonna do? They gonna shut down the government because I don't think they have the stomach to do that either. Because this would be their shutdown. I can't read minds, and I can't tell fortunes, but I can tell you this this Bill does not secure our borders. The president even if he signed this Bill he's going to have to use his executive authority anyway. And an ultimately he's on very solid legal ground doing. So. Yeah. Is that true? What did allow lowest totaling her her own democratic conference that basically it's a better deal for Republicans not to support it? Well, what to see does is basically continued the priorities. Republicans set in the last congress the appropriations Bill removes a lot of those provisions. So it moves Moos much much farther to the to the left's idea of government, which is huge taxes huge spending. It can it to all farm seventy programs agreeing green energy subsidy programs, which are the worst form of corporate welfare. There are so yeah, I I agree with you. And if you're up to get with the program, congressman with all due respect to you. You got to pass the Bill to find out what's in the dark. Your little behind here. You're behind the times why read a thousand pages for trillion dollars. I mean, that's that's a revolutionary thought. Yeah. Wish actually read something before we vote on it. But you know, there are folks who are worried about well, if we leave it over the next couple of weeks, then people are gonna shoot holes in it. Well, if it's bad policy, we shouldn't be passing if it's good policy. It will stay in the criticisms in the scrutiny over the next ten fourteen days. So this is a really important topic. "And. Some days, especially when things work out well in a courtroom, you're driving back to the office. You say holy Toledo. You know? Can you imagine getting paid to do this? This is so much other days Paul, you know, it's not quite as good, right? You're listening to champions of Justice with Tom Brady. And Amanda McClintock, our guest today is professor Paul Bergman. He is a professor of law at UCLA. Also, the co author of real Justice the courtroom goes to the movies. Amanda, what do you think is your favorite portrayal of how evidence is used in a movie? Well, there's so many. I would I would give an example from. Film that probably not too many people I've ever seen. I'll go back to the mid forties for a movie that I write about in real Justice called criminal court and in this movie. The defense lawyer is representing a client charged with murder as they usually are in films, Tom, I know, you do great work in civil cases. But by and large audiences seem to like to see movies in which somebody is charged with murder. So anyway, in this film, the defense lawyers cross-examining witness who claims to have been standing on a street corner when a defendant ran up pulled out a gun and shot the person standing next to him. And so he's year classic eyewitness who points to the defendant. They're in court is the person who ran up and pulled out the gun and in cross examination. The defense lawyer becomes increasingly angry accuses him of lying the prosecutor objects. The judge says what's wrong with you? You know, you can't behave yourself. I'm going to have to kick you out of the courtroom and a defense lawyer gets angrier. Angrier and angrier and says, it's obvious. There's no chance for Justice in this courtroom. I'm going to have to take Justice into my own hands. And with that he pulls out a gun from his pocket waves it around the courtroom and the witness who says he stood calmly by watching defended on the street corner. Pull out the gun dives for cover behind the witness chair, the jurors die for covered the prosecutor dies or cover the spectators rush out of the courtroom. And at that point the defense lawyer goes and asked the jurors to get up and look at the witness who says he stood calmly by watching a will for murder take place as he cowers behind the witness chair. So I love that demonstration. I love that use of the testimony. To demonstrate that it's implausible. What's really interesting about that is that basically took place in an actual case that was tried in Los Angeles. In the early nineteen hundreds the lawyer was Earl Rogers, probably somebody heard, Tom. I have indeed matter of fact, I, you know, Dave, Dino, if you take from one person it's called stealing if you take from everybody, it's research. So I've read Earl Roger staff, and I've read a bunch of a whole other lawyers, great stuff and have stolen from a mall. So on the way over though, we're talking about this. Amanda mcclintock. Dave, Dino, no kidding. Is truly one of the finest lawyers in Californian acknowledged by by everybody. And as we're coming over to do the show. Amanda says, you know, Tom women, though are not treated very well in the movies. Go ahead, Amanda in reading your book cover to cover. And of course, it's really really a great read. I notice that you treated many many movies to analysis, and there are very few that feature a female lawyer in a positive light. Can you think of any? Well, probably the it's amazing.
