Appeals court keeps Flynn case alive
"Legal saga of Michael Flynn is not over yet. The full DC Federal Court of Appeals has ruled that the Justice Department and the former Trump National Security Advisor cannot force the trial judge to dismiss the criminal case against Flynn without a hearing. The 82 decision was the result of a rare on bank hearing after a three judge panel ruled in favor of Flynn in June. The case has taken unusual twists and turns with the latest separation of powers fight between a veteran federal judge and the Trump Administration. Perhaps the most unusual Joining me is former federal prosecutor Robert Mintz, a partner McCarter in English. But what was the reason the full court gave for reversing the decision of the three judge panel? Well, the opinion by the full court of people really was a procedural decision. It really turned on the question of whether or not the Court of Appeals should be granting this rarely granted writ of mandate in a kind of riddle, man. Dana is something that is Only infrequently used. It was really not a surprise that the full Court of Appeals ruled the way it did. Because in this case, judge Children have not actually done anything that he had not even had a hearing that he'd not ruled against. The Department of Justice is motion to dismiss. And so in this case, it was difficult. We're really impossible for Flint lawyers to argue that they were some manifest. Injustice. If this writ of mandamus was not granted, and that they had no adequate alternative beings in order to satisfy their claim or gain the release they were seeking here, the relief could simply come on appeal. It goes back to jail salivating dogs. Sullivan could make a decision on what the Court of appeal says. If you don't like the decisions I made, you could be right back before the court of Appeals again and we will reconsider the case at that point. The D. C court confirmed what many legal experts have been saying that this was an unprecedented move by Flynn saying that Flynn has not sighted any case in which our court or any court issued the writ to compel a district court to decide an undecided motion in a particular way. Does that put into context how odd this motion was at this time? Yes, This whole case has been extremely unusual for a whole variety of reasons than what it really turned on this question of who has the right to determine whether the case should be dismissed. Thankfully, the executive branch clearly has the authority to commence or to continue prosecution that something that is up to the Department of Justice. That rule 48 a required believe of court before a case is a mess, And I think that's what this entire controversies about. What does leave of Courtney did give the trial judge the authority to probe the Department of Justice for the reasons that they are dismissing a case or does the trial just stuff we have to accept the dismissal at face value? And dismiss the case. Regardless of any concerns that the trial judge may have about the motivation behind the Department of Justice is decision. What were the dissents by two Republican appointees based on Essentially that it is the Department of Justice is Lone authority to decide whether to prosecute a case. But what this hearing is really about the question of whether or not the trial judge gets to probe into the reasoning behind the Department of Justice is decision to drop this case what the dissenting judges are arguing that the trial judge does not have the authority. To probe into the internal decision making by the Department of Justice that that's an executive Department decision and that what the court here is doing is usurping the authority of the executive department to decide whether or not to prosecute criminal cases. This is obviously a victory for Judge Emmet Sullivan. But how much of a victory and what I mean by that is Did the D C circuit court define what kind of hearing he can hold. Can he actually dig into the administration's motives for dismissing the case against Flynn? The Court of Appeals sent a very clear signal to the trial judge that they do not expect the hearing to turn into any kind of a circus. And in fact, the lawyer who is representing Judge Sullivan before the full Court of appeals, actually represented during the argument that there will be no discovery from the Department of Justice during any kind of sharing will be no evidentiary hearing, And in fact, she argued that the judge may well decide to dismiss this case after the party simply found grief. Is this one of the longest guilty please you've ever seen. Michael Flynn pleaded guilty in December off 2017. This case does have a rather convoluted history. It began with a guilty plea in 2017, where he had been lying to FBI agent about his conversations with Russia's faster to the United States. In the weeks leading up to President Trump's inauguration. Then he hired a new lawyer, and in 2019, he began to retreat from his prior position, trying to undo his guilty plea. Initially, a Department of Justice opposed efforts to withdraw the guilty plea and then in an about face took the position that the case should be dismissed. That's what bled us to where we are today, but this has been a protracted battle where we've seen the defendant admit twice in court. For lying to federal agents amended now attracting his plea and wants the case to be dismissed. I mean, you know, Mark Pocanic catered us about it on this program that if you if you the pay go law allows the house or the Senate to waive the rules of pay go and all legislative, according the constitution that has to do with money which would involve pay go has to originate in the house of representatives. So if the legislation does not have an explicit waiver of pay go in it. Then it goes to the Senate and the Senate will impose their on pay go on it. It'll simply get written into it. And and boom, you've got you've got exactly the scenario, you're describing. But if you keep the pay go rule in place in the house of representatives, at least until you can blow up the law. Yes, we need to repeal the law. But if you keep the rule in place, then the house can pass legislation that a. Includes a sentence in it that says, and we are using our thirty under our pay go rule to waive the pay go law. So we're doing the same thing that Trump did, you know, saying, you know. Yeah, we're gonna spend a trillion and a half dollars. And we're just going to borrow it. It's not gonna be paid for it goes. And if if the Democrats were to have blown up that rule, they would have found themselves up a creek without a paddle. And that's why I think only three members of the entire democratic caucus voted against the rules package. And yeah, it was a it was a it was a symbolic vote. And I suspect that they all Alexandria, Cossio, Cortez, ro Khanna, and and Tulsi Gabbard, I'm guessing that all three of them just basically, you know, they they took the stand based.

A lot of times when you work outside the home, you worked through your lunch and even if it's for your own company, you work through the lunch. You work through your lunch. You just sit at your desk to launch leave your desk with a Brown paper bag lunch. Go sit in your car. Go sitting leave out the building or go to acquire area in the building. Read a book, listen to a podcast writer, emails, like, do sales calls sales calls on my lunch. I did like that's the only time you do Southall's at us. My lunch. The other thing I say is rather than staying up late, get get up earlier, getting a habit of putting your house to sleep at a very specific time in go to sleep in e Annetta. If you start going to bed, let's say at ten versus going to bed at twelve, you go to attend, you make your body is ready to get up like four or five. You had that extra hour to work on your business is a lot more productive than trying to do it at the end of your day. Oh, yes. Learning that now. So Kim, I can't thank you enough. "Big coach. So what's next for Kim, how are you planning to level up to continue to grow your own business? So one of the things that we did or twenty eighteen is I fell back a little bit from coaching in analogy, more consulting. I work with a lot of entrepreneurs who are at that space where they are really solid in making money in your businesses, and they just need someone to come in and level of how they're doing their own sales marketing campaigns and not so much as I have to coach them through the process with more. So I'm helping them build the team around how to help them do their sales marketing. So we have a lot going on in a consulting Satam actually excited about that. 'cause we actually had our now booked out January and consulting. Because we'd not only do I come in help it out. The strategy now have agency in place that kinda will go into all the sales channels. Do all the project management, stuff like that. So that's been really, really fun to build out that consulting agency in that space. And now what's next, which is a big secret, but I'm gonna let you know. And also disaster program mood is at noted. I can't do it alone, right? I can't be like everyone's. I can't be everyone's gonna track point. I can try. But I can't because now as I as I'm maturing in the space, I'm just realizing I can't be all things to all people. So what I'm doing is I'm actually opening up a beta program to license out my strategies in all of my techniques and all of the resources in tools that are built on how I help people build out their sales strategies and I'm taking under my wing some other some, you know, other funnel strategists also web designers and copywriters because winning big up sales. This a lot of moving pieces, right? There's a person that has to build up the landing pages, this person that does the strategy. There's the person that does the copy. There's the person that does the face beget sometimes MS who can do all of those areas. Absolutely. And that's where a lot of people who do funnels right in automation systems are right now, but I'm literally gonna show them how they can build out their own six, seven agencies like I did. I love it. You know why you're so right, because trying to do it all yourself. Is very overwhelming. And so I can see the benefit of having more funnel trap queens out here, open. Open. They're all come under the Kim mccarter consulting coaching consulting, but they'll be like their own account. They'll be account managers and what I wanna do. I wanna create these account managers and also they can use it in their own businesses. It'll be different license agreements, but I wanna base it on their areas of expertise like, you know what I mean? So if someone that e com they will be they will manage e commerce accounts. If someone is good at like, you know, business coaches, they'll be working with business coaches, someone's web design, they'll be working with web designers and we'll also have some crossover depending on what the needs of the client are..

"Giving you these prestigious awards, we're going to create this other subsection that since you're that you're popular but not artistic enough, not good enough in our, but I don't know Americans who are cultural Neanderthal seem to think that you're great. This idea that popular and artistically brilliant are sometimes or are often divorced, and that's not true. A lot of the movies that are nominated for best film. Yeah. I mean, does. What if it? I mean, we don't know how this category will play out in practice, right, white. If black pain or the rest of the marvel cinematic universe gets best picture and popular film is where you know the the furious franchise finds. And a lot of people will be thrilled if the furious franchise. Finally, finally, there do. But do you think that that's possible? Are we presuming a lot to assume that the popular film category is is a consolation prize for. Busters. I don't think we've go ahead. I mean to certain extent, of course we're presuming you know, we do not have this crystal ball. We can't see into the future may my favorite part about asking questions is hearing the Cy. When the question is asked just does. I think also you have to kind of look at the track record here. Right? Right. And the track record a little bit suggests that this is going to be a repository for things that are beloved, an incredibly popular, and that the kademi knows that they'll be screamed at if they don't give some recognition to, but that they don't deem artistically significant enough to include in kind of their existing framework for what makes a best picture film. But I think part of the problem there is that the whole idea was you need to rework your framework. Right? That was the ask. The ask isn't to create an additional field. It was to rethink the way that you're evaluating things the Grammys. I understand also gone through some similar contortions and have been criticized for choosing albums and artists. They can honor in order to avoid controversy over diversity. Right, right. And there's some things I think, what does that category like best urban contemporary? What does that? What does that mean? What does that mean? Aside from best album made by black person, right? Like there's no, there's no sort of grounding unified cohesive musical, you know, factor that brings them together. It's literally just the color of who makes it. But yeah, I mean, I agree with everything that Jillian said, like, obviously, we can't know definitively, but this is when we're talking about the academy, we're talking about an organization that has historically refused to even watch films made by black people. They didn't watch what was it grows trip. I think which was like a massive blockbuster hit and also like an incredibly well done film. So I don't know that that that they've necessarily inspired hope or goodwill must smart. Onto the title of of your piece for the site. The other day was, what does it mean to sound black?
