Appeals court keeps Flynn case alive

"Legal saga of Michael Flynn is not over yet. The full DC Federal Court of Appeals has ruled that the Justice Department and the former Trump National Security Advisor cannot force the trial judge to dismiss the criminal case against Flynn without a hearing. The 82 decision was the result of a rare on bank hearing after a three judge panel ruled in favor of Flynn in June. The case has taken unusual twists and turns with the latest separation of powers fight between a veteran federal judge and the Trump Administration. Perhaps the most unusual Joining me is former federal prosecutor Robert Mintz, a partner McCarter in English. But what was the reason the full court gave for reversing the decision of the three judge panel? Well, the opinion by the full court of people really was a procedural decision. It really turned on the question of whether or not the Court of Appeals should be granting this rarely granted writ of mandate in a kind of riddle, man. Dana is something that is Only infrequently used. It was really not a surprise that the full Court of Appeals ruled the way it did. Because in this case, judge Children have not actually done anything that he had not even had a hearing that he'd not ruled against. The Department of Justice is motion to dismiss. And so in this case, it was difficult. We're really impossible for Flint lawyers to argue that they were some manifest. Injustice. If this writ of mandamus was not granted, and that they had no adequate alternative beings in order to satisfy their claim or gain the release they were seeking here, the relief could simply come on appeal. It goes back to jail salivating dogs. Sullivan could make a decision on what the Court of appeal says. If you don't like the decisions I made, you could be right back before the court of Appeals again and we will reconsider the case at that point. The D. C court confirmed what many legal experts have been saying that this was an unprecedented move by Flynn saying that Flynn has not sighted any case in which our court or any court issued the writ to compel a district court to decide an undecided motion in a particular way. Does that put into context how odd this motion was at this time? Yes, This whole case has been extremely unusual for a whole variety of reasons than what it really turned on this question of who has the right to determine whether the case should be dismissed. Thankfully, the executive branch clearly has the authority to commence or to continue prosecution that something that is up to the Department of Justice. That rule 48 a required believe of court before a case is a mess, And I think that's what this entire controversies about. What does leave of Courtney did give the trial judge the authority to probe the Department of Justice for the reasons that they are dismissing a case or does the trial just stuff we have to accept the dismissal at face value? And dismiss the case. Regardless of any concerns that the trial judge may have about the motivation behind the Department of Justice is decision. What were the dissents by two Republican appointees based on Essentially that it is the Department of Justice is Lone authority to decide whether to prosecute a case. But what this hearing is really about the question of whether or not the trial judge gets to probe into the reasoning behind the Department of Justice is decision to drop this case what the dissenting judges are arguing that the trial judge does not have the authority. To probe into the internal decision making by the Department of Justice that that's an executive Department decision and that what the court here is doing is usurping the authority of the executive department to decide whether or not to prosecute criminal cases. This is obviously a victory for Judge Emmet Sullivan. But how much of a victory and what I mean by that is Did the D C circuit court define what kind of hearing he can hold. Can he actually dig into the administration's motives for dismissing the case against Flynn? The Court of Appeals sent a very clear signal to the trial judge that they do not expect the hearing to turn into any kind of a circus. And in fact, the lawyer who is representing Judge Sullivan before the full Court of appeals, actually represented during the argument that there will be no discovery from the Department of Justice during any kind of sharing will be no evidentiary hearing, And in fact, she argued that the judge may well decide to dismiss this case after the party simply found grief. Is this one of the longest guilty please you've ever seen. Michael Flynn pleaded guilty in December off 2017. This case does have a rather convoluted history. It began with a guilty plea in 2017, where he had been lying to FBI agent about his conversations with Russia's faster to the United States. In the weeks leading up to President Trump's inauguration. Then he hired a new lawyer, and in 2019, he began to retreat from his prior position, trying to undo his guilty plea. Initially, a Department of Justice opposed efforts to withdraw the guilty plea and then in an about face took the position that the case should be dismissed. That's what bled us to where we are today, but this has been a protracted battle where we've seen the defendant admit twice in court. For lying to federal agents amended now attracting his plea and wants the case to be dismissed. Interestingly, the Department of Justice is logic for dismissing the case is not the General Clinton did not lie to federal agents, but is that it wasn't

"The case that they can't get. They can't get that. Number of signatures because of Covid nineteen and the court did reduce the amount of signatures that were required a it just happened the last few days and I. Don't remember what state it was. But. You might want to look into that because it is already. Court. Peg Record Court would already. Go that same reason, and then we're not saying that people are wrong. We've we filed against the governor, the Secretary of State and all of the county clerk. In these county. I mean common sense. That the lockdown of covert nineteen had is restricting your ability to get the number of signatures. Of course it is right or wrong for some relief on that just like these other cases have. So it's courts right now here. and. You've got a good judge. Do you know the judge yet? Yes we do. We, we filed June thirtieth. We've got a August fifth deadline to get all these signatures in county by county. And so we've we filed for relief to reduce the number of signatures require and to extend that date. To, allow us to get more nutrition. It was denied the prime time. And so we refiled two days ago. Emotion. I do see the map of And it is, it reduces it almost to the size of. What maybe a couple of Rhode Island's may be one Rhode Island. Have you seen this this map? Yeah, Idaho's huge under this plan. Oregon's TB little sliver. Yeah Idaho becomes much bigger than Washington state. Much right now right now. A lot of the counties in eastern Oregon far revenue negative counties for the state. The state more. removes those counties from their budgets. All of a sudden made got a lot of money. They can put into their liberal social program. Nice. I like that now. You should probably keep that to yourself when you're trying to convince Idaho. How are you going to convince Idaho when you ve used that with Oregon? But I think Idaho looks at those counties in different way. They're timber friendly. All of a sudden like you say they have a deep water port and Coups Bay. Off where we're all the products from Idaho, GONNA ship through to go out to the Pacific Rim. They're gonNA. Come across now it's. It's going to be a boon economically, yeah! Would be, it would be. All right well I best of luck, and will you stay in touch with us and tell us how it's going? And if there's anything we can do to help? Because I just think it's wrong. California's in the same situation to where there are the all those farm farms and farmland in California. They're not being listened to. They don't have any real representation. And they're sick of it and. Quite honestly I think they should be allowed to to carve out. Their own their own representation it, we're. We're being controlled now by the big cities. Absolutely, absolutely, you probably can say anything more, Glenn I would encourage any of Corrigan. Citizens that are listening to this that are in our counties to sign the petition to vote. He looked at me, and he smiled and shook his head, he said. Come downstairs. I thought I was going to get the punishment of my life. And then he said and don't wake your mother. The two of US both to back down the stairs. And we sat there, trying to contain our excitement is the game went into extra innings? I'd never seen a smile on. My Dad's based like this. I knew just the two of US had rooted hard enough that the red sox would win. They could lose because my dad and I were now in it together. It was the bottom of the twelfth inning. Up Steps, Carlton Fisk. Red Sox catcher. First Pitch Up, and in bowl one. Palm's were sweating. Anticipation Pat Darcy. Cincinnati pitcher began his wind and my dad said this is. This, is it. Darcy released a sinker down in in. Fist just belted down the line. My Dad stood up and yelled. Stay Fair, stay fair, and as if any thought of my mom's sleeping was completely gone and disappeared with a crack of the bat. Stay Fair. He kept screaming. Even fisk was standing on the plate with both hands waving, trying to will the ball fair. My Dad and I were both now standing screaming. Stay Fair. Some people would say that. My Dad and I had nothing to do. With the world series that year. Some would say that a father and a son can't make a ball. Stay Fair. But I know in my heart I. Know that's not true. The ball banged off the metal mesh the poll and it was fair. It was a home run. Won The game. My and I were just screaming. We were jumping so much I think can. We woke up the entire neighborhood in the process. Well, everybody except my mother. But we didn't care. And once everything's calmed down. Who's just me and my dad's standing there? Staring at the TV and then. At each other. Shoulders were squared back. Fisk could hit the ball. But we were the ones that kept it fair. The RED SOX GONNA. Lose game seven, but. It didn't matter. I had spent a night with my dad that neither of US would ever forget. My Dad I won game six of the World Series And we want it together. As I look back on. That night in October.

"My Passion. Every single day that summer nine, o'clock I would meet with Jim and Freddie and my best friend Mike. Along with seven or eight other interchangeable stragglers, and we'd make about a two mile hike into a rundown field, who right off of mainstream behind the hardware store? Then none of us had two hundred dollars aluminum bat. Or a case of brand new baseballs and nobody was watching us. We had an old wooden bat that had been given to Freddie by his older brother. It cracked it at practice, so we we took some tape and we we down that bad up. Held together by the tape, the grip was so warned that you were sure to go home with a splinter or to every single day. The ball we had found in the woods. I grew up in the Pacific northwest, so it was a little waterlogged had been there for a few months. It was more of a shot. Put than a baseball. But that didn't stop us. Every day. All Day, we'd be there and we wouldn. Stop for anything. Except for the track or to the store on the corner. Where we would get a coke. Or, some Zuko bubble gum. And we'd all pretend. We were in the major leagues. We'd stand there for hours with sticking your hand swinging away against imaginary pitchers. Practice rounding the bases winning game the last game of the world.

Appreciate Tope to hear the adoration reverence that you guys have is as you kind of remember your experiences with Your Dad's for me. It was an as like prepping for the show. It was probably like the first time I really thought about it. Like as a kid, you know my father by biological father. Got Another father to reference, but my biological father was incarcerated for large portion of my adolescence, and died shortly as into adulthood, so we never had much of a relationship and I don't have any memories or any ties really there, but like I was lucky enough to have father figures through the course of my life and I think it was never like a thing of like. Oh, it's father's Day. It was just Kinda like another day another day in the house or whatever we was doing, but do remember at some point at least I. Think one of my mother's boyfriends shelter. That's a tremendous. Tremendous step for him to like take care of some child is not your own, and you're not married to that woman, you know. Plus because they I was more positive on mccarter remember he would great in Summer League last year and we had occurred before before we did you feel that Carter was below expectations last year well. He was hurt so I think that you assume you just completes the year about the level use planes over I think he was about at I think he was about at expectations but maybe I raised res My expectations after Summer League and so I don't think he may be met that Elvis and but he was you saw it I know opposition to to how he played and especially because the two drafted right after him. We're sexton in oxen. I like Carter better than both those guys but you know I'm not sure really yeah I mean unless you were going to go down to shake Alexander who would would've actually build a need for the Bulls or Michael Porter Jr. or maybe miles bridges. I mean those Carter. I think was a fine pick their absolutely so I you know I think that it would be just that one and I think I still don't like the Levin contract but it looks better for me now than it did before and the Jabari Parker Element didn't really work out except that it helped opened the door for the auto portrayed. I've said before that I think porter is a better use of capital than what they could have spent on into in summer nineteen and remember. They did pretty well with their caps getting fat. He's young and a few things we'll talk about that. When we grade they're twenty nine hundred off season? So the the the the Levin Part looks a little bit better hutchison yet was it was hurt by injuries but I wasn't super impressed with him when he was good summer league this year either and not hiding him and some of the players taken after him do do look better now. Landry Shamet most importantly shame it also would be a really useful piece on these Bulls shimmied..

"Make sure that's yeah. Joan mccarter on the daily KOs staff. She and Mark summer. Just absolutely brilliant writers, and they're they produce so much great content for daily KOs. She says there's a nice little silver lining for vice President Mike Pence the cabinet and senior administration officials in the government shutdown. Eight hundred thousand federal employees and thousands of people working for the government under contract going without paychecks administration. Folks are getting ten thousand dollar raises, and this is the cabinet secretaries. All the all the cabinets members, the deputy secretaries the administrators like the EPA administrator, they're getting ten thousand bucks. Why? Because well here it is. She said former speaker of the house Paul Ryan refused to bring the funding bills for the multiple agencies to the floor including a pay freeze. I acted in two thousand thirteen and renewed every year when those bills died sort of the pay freeze. So not only do these guys get raises. They get five years worthy raises starting with next week's paycheck. And it's because Trump shut the government down. I mean, it doesn't get more bizarre than that. I mean, that's just breathtaking Lawrence in Saint Paul Minnesota hate Lawrence. Thanks for listening to him nine fifty. What's up? Hey, how's it going? Here. Good point. Quick. His covenant monetarily Dan will not work instead of letting feel. Off. And but I'll give you back later. That's another -nother topic. I wanna see Mitch McConnell refuses to even to even bring. A vote up to you and the ship now goes with Democrats did now tell you why. Now, we need to follow the trail of Mitch McConnell, and what he has in common is him. Elaine Chao, or Yeltsin and George Herbert Walker. Bush all of these people have something in common. Elaine, Chao, merica, Mitch McConnell. Elaine Chao in the peace corps from eighteen ninety one. A year in the peace corps. What she did was. She went over there and stab dare democracy. The American way and change their currency from the ruble to their current currency, and Yeltsin was never satisfied with it. Now after. Done with it. With dead, George. W bush. He now in steals her as secretary of labor can do much deer. And now, and she is now and transportation secretary now tell you why they're important the aviation industry has was call five freedoms. You're actually more than five five are most important where each state meaning rusher in the United States agreed to say, hey, you can fly your planes here, and you can fly airplanes there without any other subject case. In other words, you can make the revenue it used to be that you couldn't from the United States to Russia. You can only you can only stop in a United States such as England or state sponsored by Russia. So Elaine Chao in office now she's trying to get rid of it. So now the Americans. Would control the Airways in the Russian and the Baltic states, Latvia, Lithuania and Estonia, while they're already getting so schizo about how we violated the agreement not to put NATO on their borders. That would be that would push them right over the top. I'm glad you're seeing it. I think. Just explained will. So I'll just cut to the chase here. That's why you're not gonna see Mitch McConnell say anything that's going to be a detriment to his wife. His wife may be implicated to in some serious crimes and some serious mismanagement of government bonds if there's found that she did something illegal like she with her stocks. So so if you follow Elaine Chao, follow Mitch McConnell's reason for not letting near Garlan come up or not Liz come to a vote in for any other thing that he made you in the future. Now, let's keep an eye on the late show. See how Mitch McConnell X in our guarantee. We'll find a trail there. Fascinating stuff. Lawrence fascinating stuff. I don't you know, the level of, you know, digging into this that you've done I can't I can't match. So I can't either confirm or or argue with anything you've said, but I know that Elaine Chao has been around Republican circles for a long long time. And yes, she's married to Mitch McConnell, and she. She's got a very sketchy background, and and and has made a lot of money doing this. So we'll see where it goes Lawrence. Thanks for the call Jim in Maldon mass. Jim you're on the air. What's up? Yeah. Just had a thought after you mentioned that Trump had said Chuck Schumer that he'd be willing to keep the government shutdown for months or years wonder he would potentially use that as an exit strategy to you know, sort of avoid having to reside in embarrassment. He looks really strong defending his wall. The Republicans look good for putting their country over there party by going along with the Democrats to impeach him. And he, you know, he looks really good, you know, for his base. So he doesn't have to be embarrassed. And I don't know if you if you put any it has any merit at all or I don't know, you know, he's still riffing. I haven't heard his press conference. I'm you know, the last riff he did his cabinet meeting day for yesterday was just filled with lies and empty rhetoric. It's it's the the real shame here is that there's hundreds of thousands of families that are in distress right now as a consequence of Donald Trump playing chicken and or trying to play chicken. I mean, the Democrats are saying fine here opened the government. We we just passed the legislation which is identical in language. It's it's a it's an absolute clone of the language that the Republicans passed last year. This is exactly what you said. You were willing to sign before. Laura Ingram started yelling at you. And by the way, she lost her radio show. Now, it's like really, but this is the legislation you're willing to sign and he's like, no, I'm not going to sign that that doesn't have my wallet. I want my wall. And I you know, I think that we're getting over it. I think we're definitely getting over it. We'll see where we'll see how it plays out. Jim. Thanks a lot for the call from Jimmy Jim in Los Angeles. Agem what's up? Town, my friend. You still are the smartest man in our media. I must say, and you do have the smartest, callers, including yourself. Jim. What's up? I truly so. One michigan. Wisconsin we have to figure out how to take over the legislature. How how they pass we has these laws obviously you written by. The quote brothers in the Alec how could they passed similar laws simultaneously? They do this. Jim they've always had this power. I mean, the the the politicians in these states have always had this power. They've just never had leadership of their parties. There was so willing to disrespect democracy small d democracy and use that power in a way that is clearly contrary to the will of the people and contrary to the interests of the people it's just never been done before. It's it's pretty shocking. What's going on? But it's it's you know, I mean, the precedent that Mitch McConnell set by holding Merrick garland back for almost the entire year is is the the whole thing is breathtaking. It is time and throw solutions Sayer, you know, one is Bernie or someone. The new democratic. A congresswoman Cascio cartels. Say steal my vote. New go to jail caps. All that's HR one. That's the first piece of legislation that was introduced this year, and it tightens up it. Here's a quick list of the stuff that HR one does not chance. The Republicans are going to pick this up in the Senate, which is tragic because this is much needed automatic voter registration same day voter registration online voter registration fifteen days of early voting and gerrymandering voting rights for post released felons. Prevent voter purges public financing for house campaign candidates who don't take big donations. Tighten the rules on dark money force for Chloe. Eczema disclosure on digital campaign ads expanded definition of a lobbyist to call closed. This loophole. It's being used new powers and disclosures for the office of government ethics and a code of ethics for the supreme court. This is really really important stuff. Oh and requiring presidential candidates to disclose ten years of tax returns applying conflict of interest rules to the president and vice president and preventing the vice president. And president from contracting with the government. This is a summary that was put together over daily coz by by Laura Clawson, also another brilliant writer, run daily coast. So any other it is Jim? Legislatures in Michigan or Wisconsin. I dare so gerrymandered. Yeah. How do we do that? While this federal law would actually force the states to adopt nonpartisan commissions to write their districts to to redraw the districts in a nonpartisan way. And I think it's veto. It's time has come. I mean elders Jerry was was back in the late seventeen. Hundreds dryer the early eighteen hundreds drawing the math in Massachusetts to look like a salamander. And you know, it's still going on. Wait. It's gotta come to an end. Jim I need to move along. But thank you for the call Joe in Cupertino, California. Hey, Joe, what's up? Tom. I just wanted to go Friday miss. I would have been very interested in your explosion in the last few days here by congressman quite boost lean Rickers there's a little difference between row. One point five trillion to the business Shelvin conflicts of war. And then tells the we have to struggle for healthcare students school, I agree on the point of the pay go law. That's absolutely all true. My understanding, and I'm pretty sure I'm right about this. As certainly the the two. Rokon is a vice chair of the congressional progressive caucus the to chair people are familiar Giac pal. And all and Mark cannon. They're both saying what I've been saying. Actually, I got it from them. I mean, you know, Mark Pocanic catered us about it on this program that if you if you the pay go law allows the house or the Senate to waive the rules of pay go and all legislative, according the constitution that has to do with money which would involve pay go has to originate in the house of representatives. So if the legislation does not have an explicit waiver of pay go in it. Then it goes to the Senate and the Senate will impose their on pay go on it. It'll simply get written into it. And and boom, you've got you've got exactly the scenario, you're describing. But if you keep the pay go rule in place in the house of representatives, at least until you can blow up the law. Yes, we need to repeal the law. But if you keep the rule in place, then the house can pass legislation that a. Includes a sentence in it that says, and we are using our thirty under our pay go rule to waive the pay go law. So we're doing the same thing that Trump did, you know, saying, you know. Yeah, we're gonna spend a trillion and a half dollars. And we're just going to borrow it. It's not gonna be paid for it goes. And if if the Democrats were to have blown up that rule, they would have found themselves up a creek without a paddle. And that's why I think only three members of the entire democratic caucus voted against the rules package. And yeah, it was a it was a it was a symbolic vote. And I suspect that they all Alexandria, Cossio, Cortez, ro Khanna, and and Tulsi Gabbard, I'm guessing that all three of them just basically, you know, they they took the stand based.

"And finally, what is your parting advice for fellow women entrepreneurs who want to be their own boss but are worried about losing that steady paycheck? Don't quit. You know, I know that I know that for all of my faith based people who say, step out on faith, you have to trust Geiger. Not is not is not going to be easy, right? But let me tell you what I did is not teach my clients this. If your house gets up at six o'clock to start its day, then you need to get up at five. If you are someone that works nine, five, you work outside the home. A lot of times when you work outside the home, you worked through your lunch and even if it's for your own company, you work through the lunch. You work through your lunch. You just sit at your desk to launch leave your desk with a Brown paper bag lunch. Go sit in your car. Go sitting leave out the building or go to acquire area in the building. Read a book, listen to a podcast writer, emails, like, do sales calls sales calls on my lunch. I did like that's the only time you do Southall's at us. My lunch. The other thing I say is rather than staying up late, get get up earlier, getting a habit of putting your house to sleep at a very specific time in go to sleep in e Annetta. "Big coach. So what's next for Kim, how are you planning to level up to continue to grow your own business? So one of the things that we did or twenty eighteen is I fell back a little bit from coaching in analogy, more consulting. I work with a lot of entrepreneurs who are at that space where they are really solid in making money in your businesses, and they just need someone to come in and level of how they're doing their own sales marketing campaigns and not so much as I have to coach them through the process with more. So I'm helping them build the team around how to help them do their sales marketing. So we have a lot going on in a consulting Satam actually excited about that. 'cause we actually had our now booked out January and consulting. Because we'd not only do I come in help it out. The strategy now have agency in place that kinda will go into all the sales channels. Do all the project management, stuff like that. So that's been really, really fun to build out that consulting agency in that space. And now what's next, which is a big secret, but I'm gonna let you know. And also disaster program mood is at noted. I can't do it alone, right? I can't be like everyone's. I can't be everyone's gonna track point. I can try. But I can't because now as I as I'm maturing in the space, I'm just realizing I can't be all things to all people. So what I'm doing is I'm actually opening up a beta program to license out my strategies in all of my techniques and all of the resources in tools that are built on how I help people build out their sales strategies and I'm taking under my wing some other some, you know, other funnel strategists also web designers and copywriters because winning big up sales. This a lot of moving pieces, right? There's a person that has to build up the landing pages, this person that does the strategy. There's the person that does the copy. There's the person that does the face beget sometimes MS who can do all of those areas. Absolutely. And that's where a lot of people who do funnels right in automation systems are right now, but I'm literally gonna show them how they can build out their own six, seven agencies like I did. I love it. You know why you're so right, because trying to do it all yourself. Is very overwhelming. And so I can see the benefit of having more funnel trap queens out here, open. Open. They're all come under the Kim mccarter consulting coaching consulting, but they'll be like their own account. They'll be account managers and what I wanna do. I wanna create these account managers and also they can use it in their own businesses. It'll be different license agreements, but I wanna base it on their areas of expertise like, you know what I mean? So if someone that e com they will be they will manage e commerce accounts. If someone is good at like, you know, business coaches, they'll be working with business coaches, someone's web design, they'll be working with web designers and we'll also have some crossover depending on what the needs of the client are..

"Into side-hustle pro. The podcast that teaches you to build and grow your side-hustle from passion project to profitable business, and I'm your host Kayla Matthews, Kobe. So let's get started. Hey, hey, guys, welcome back to the show today. The share we have at fans, sales, funnel, strategists, and business success. Coach, Kim mccarter. I'm really excited about this episode and excited for you to hear it because it's more of a workshop, coaching training style episode, then my usual QNA's. So it's a little bit of a different spin and Kim Nye really go deep on funnels, and I'm asking her all the questions that I generally have myself because this is something I'm hyper focused on right now as you guys just heard on my most recent entrepreneur diaries episode, I shared what's been working and what hasn't been working in my business. And I mentioned that one of the things I'm still working on is how to best message and position my podcast coaching services, and that involves polishing not only my message, but my sales funnel, whatever. I started side how selene truth moment. I would just focus on learning one aspect of business at a time, and there wasn't always a big picture strategy going on. I didn't even know what a sales funnel was. When I first set up my Email is I just knew that everyone talks about building Email list of little mini courses. I talked about mentioned that, so I set it up put no one really did a deep dive on funnels. And as I grow as a businesswoman, I'm learning how to cultivate a relationship with my Email is, and that's something Kim knows all about a new. I wanted to do an episode on this because as I said, it's so important to my business, but also it's really important to all of our businesses. You need to understand the relationship between the people who join your Email list, and you know, sign up for your newsletter and how.

"Giving you these prestigious awards, we're going to create this other subsection that since you're that you're popular but not artistic enough, not good enough in our, but I don't know Americans who are cultural Neanderthal seem to think that you're great. So they went and mass. So yeah. Cool. We'll give you this award that does not solve the problem. It also I think implies. This idea that popular and artistically brilliant are sometimes or are often divorced, and that's not true. A lot of the movies that are nominated for best film. Do really, really well in the box office. So it may. It's also like, why? Why do we actually need to separate these things? Right? And I think we see that was music to right. There's a sort of derision with which people talk about pop music as though to be, you know, a top forty song as one and easy thing to stumble into in two, partly because those kinds of music or societas most often with, you know, women people of color, etc. It just feels like this really obvious sort of hoodoo using your falling, would this kind of thing? Yeah. I mean, does. What if it? I mean, we don't know how this category will play out in practice, right, white. If black pain or the rest of the marvel cinematic universe gets best picture and popular film is where you know the the furious franchise finds. And a lot of people will be thrilled if the furious franchise. Finally, finally, there do. But do you think that that's possible? Are we presuming a lot to assume that the popular film category is is a consolation prize for. Busters. I don't think we've go ahead. I mean to certain extent, of course we're presuming you know, we do not have this crystal ball. We can't see into the future may my favorite part about asking questions is hearing the Cy. When the question is asked just does. I think also you have to kind of look at the track record here. Right? Right. And the track record a little bit suggests that this is going to be a repository for things that are beloved, an incredibly popular, and that the kademi knows that they'll be screamed at if they don't give some recognition to, but that they don't deem artistically significant enough to include in kind of their existing framework for what makes a best picture film. But I think part of the problem there is that the whole idea was you need to rework your framework. Right? That was the ask. The ask isn't to create an additional field. It was to rethink the way that you're evaluating things the Grammys. I understand also gone through some similar contortions and have been criticized for choosing albums and artists. They can honor in order to avoid controversy over diversity. Right, right. And there's some things I think, what does that category like best urban contemporary? What does that? What does that mean? What does that mean? Aside from best album made by black person, right? Like there's no, there's no sort of grounding unified cohesive musical, you know, factor that brings them together. It's literally just the color of who makes it. But yeah, I mean, I agree with everything that Jillian said, like, obviously, we can't know definitively, but this is when we're talking about the academy, we're talking about an organization that has historically refused to even watch films made by black people. They didn't watch what was it grows trip. I think which was like a massive blockbuster hit and also like an incredibly well done film. So I don't know that that that they've necessarily inspired hope or goodwill must smart. Onto the title of of your piece for the site. The other day was, what does it mean to sound black? What does it mean. What was your. Of that question, it's complicated. That's generally the answer that I arrive at. You know, I think that we can point to. So I spoke with professor John mccarter who has written for the site before, but a little bit about, you know, what are the speech patterns? What are again, the sort of full nation, the syntax..
