"The desert still tend tonight, Coast Up to 59 Today Inland 60, the mountains 49 desserts up to 83 Right now downtown. It looks like we do have some drizzle. It's cloudy. It's 59 Kogo News time is 8 11. The former Minneapolis police officer who knelt on George Floyd's neck for more than nine minutes last year was found guilty of all three charges against him, joining us on the Koga news, live line criminologists and civil rights attorney Brian Levin. He is also a professor of criminal justice and director of the Center for the Study of Hate and Extremism at Cal State San Bernadino. Good morning. Thank you. Just too many darn titles. Well, you know, we wanted to get that all in there because you're a very important man. So here we go. First of all, what's your reaction to the verdict? Well, do it three possible charges to murder charges and a manslaughter and I think based on the evidence presented It was it really It really was clearly guilty on all counts that the one thing that the defense really tried. To put most of its chips in wood, the issue of causation with regard to criminal law. You have an act to require the intent, and then you have to show that the prohibited harm Was caused by that act. What was interesting, Hear that? Listen to this. The murder charges were not about whether showman intended to kill What they were about with respect to second degree murder was that he intended to do in a soul. And in the course of that assault. The victim died. The second one is what we call depraved mind. Depraved heart murder. That's something which is even different. You engage in an act. It has such a reckless disregard it to pray. Just regard for human life. You don't necessarily want to take a human life. But your active such so dangerous. And get results. That's that's That's the thing. The murder three and manslaughter was really more around negligence. So you know, the defense was really trying to tow hold onto George Floyd's perhaps level of intoxication. They also, you know, autopsy results, um, that they were trying to say we're proved basically that he died essentially of a drug overdose and of heart failure. Can both of those things be true? Yes, but here's the thing. What it looks like here is that that suffocation was the butt for caused by the way. It doesn't under the law have to be the only cause. But it does have to be substantial and the bottom line is from all the expert testimony. Uh, taken together, along with the masterful presentation that road map that was laid out in the opening arguments, then buttress by all these experts. I think it was a pretty clear verdict for you know, looking someone like may by the way, one of the quick thing I'm former NYPD. There is nothing about what transpired with regard to the use of force. It is in any way related to any of the training that we have. In fact, it once countered to it. And remember the fact that George void within his custody made the duty of care Particularly important here is well, what type of time do you think that he will spend behind bars? Derek Sheldon? Wow. Well put under Minnesota. You'll see all kinds of things in the news where it says that you know the top murder charge. You can get 40 years, but for someone who has no criminal record The presumptive for each murder charges 12.5 and then another four for the manslaughter, which can get you up to up to 29. By the way here, they do things a little differently in Minnesota that we have. What we call lesser included offenses so you don't even touch those. You just go to the top of fence but bottom line. I think we're talking about 30 years, maybe more, because I think there's gonna be an upward departure from the Minnesota sentencing guidelines, which resemble the federal ones. Because of the cruelty. On also because I think prosecutors really wanted to send a message. And I think the judge and the judge is gonna be the one making the decision here show been waived this with respect to a jury. I think he's gonna be pretty strict. I think about 30 give or take is what we'll see. All right? Criminologists and civil rights Attorney Brian Levin with us here on the Kogan years live line. Thank you so much for your time and the info Thank you. Thank you. All right. Here. "But we haven't gotten a lot of specifics from him just yet on exactly what he will do Another thing you know, I have been reading online about these hotel rooms that were acquired by the county during Cove it and you know, are we getting political here? Is this all the money issue? Would nonprofits not get funding? If we, you know, use some of these rooms. It's a complicated issue, so the way that AH lot of communities including San Diego County and in some shape or form, it's a little confusing. I've been asking a lot of questions about this, actually. But the state had a program called Project Room Key that many of your listeners may have heard about because Governor Gavin Newsom was speaking a lot about it. Where There was funding from FEMA to help put homeless individuals up in hotel rooms during the pandemic. Recently, Earlier this year, the Biden administration announced that there would be full reimbursement for cost to put people up in hotel rooms. With the real challenges in terms of you know where rubber meets the road in terms of the city. Taking advantage of this opportunity is a lot of homeless service providers and you know, insiders, City officials have said One of the challenges is that you need to have service providers who could support those hotel rooms. So whether somebody is in a shelter or in a hotel room you they may need some help Case management. Help addressing some of the you know issues that might have, um, you know, really challenged them when they were on the streets, everything from maybe they have an addiction issue. Or maybe they suffered a lot of trauma on the street and needs some support. You need workers to support that, And so really, the challenge and Mayor Gloria had expressed this to me previously is making sure that there are service providers who could help. And so yesterday, Mary Todd Gloria and the Housing Commission Released a request for information essentially from providers to say could homeless service providers actually help with something like this A zoo? We all know the convention center has really been a focal point. Of the response when it comes to homelessness during the pandemic starting next week. That's going to be shutting down. And so there's a chance that that could sort of change up. Um, some of the capacities. And also maybe there are other providers that given this request that's been put out could say, Hey, you know, we're pretty small agency, but we could help. It will be interesting to see what happens. With that just next, you know, I know. Certainly advocates have been pushing for months for the city and county to put up more homeless individuals in hotel rooms. All right, Lisa, however sad from voice of San Diego. He was like that guy up in canada. That crack addicted mayor in toronto was right tom. Ford is offended by tom. Ford baena designer yes. Princess woke up. Rob ford yeah. Yeah always having to deny oral sex allegations. Planning you wait at home. So yeah bob. Filner was was a joy a pleasure. But i don't think todd gloria or barbara breen are going to bring that kind of razzmatazz the city hall. I think they're gonna be more. Frankly which is in theory what we want. I like the bob filner days. I like more. When maureen o'connor was mayor i think she was mayor when i first got into town okay. There is no question that she dressed in shiny leather at home. She had a lotta yeah. She had a lot of whips. A lot of those weapons that you saw and mel gibson scottish lower movies you know mace chains cat of nine ta all that stuff. Yeah yeah and when she came into the room you zip at fella you got right in the line. Yeah yeah she looks like she means business she did. She did no one ever sast her. Who else has been mayor in the last thirty years your boy jerry. Sanders was a dark period very very dark lot. The sex daniel there could with me. I know who knew. There was a camera next time jerry and i get together for our little. Get togethers if you will in balboa park can let me know that. There's a movie going on. Would that be too much okay. So jerry sanders. Yeah i liked him. Well i do like who is it. First named kevin there was also roger hitchcock. He wasn't here when i was here. Okay all right. Was that nike caller. You're exonerated sure. I'm pretty sure. I got this weird thing on my ankle. But what the hell okay. Golding was after maureen like susan. Golding lot dick murphy. What two thousand. Two thousand five did. I don't think anyone was paying attention to that. I must have been asleep for that. How long kevin mayor for two terms eight years something like that. I think he was just five eight years because he took over part of filner dollar. Yeah so he got elected. He started march third twenty fourteen. It looks like six years. I am for kevi so either. Todd gloria or barbara. Bree hung. I am going to say i'm going to declare without hesitation and full confidence that i wanna welcome mayor barbara bree to city hall. I'll remember you did the reduction values and you're so grateful that a mayor provided you with production value out crap. I forgot about that gloria. That's going to cost a lot of problems for us. you know. 'cause he's mayor. Gloria set the microphones to about five foot six because they're expecting some girl and high heels to walk out. Here comes todd. Laura down to five hundred four. Todd's weren't as flats today all right well. Congratulations salon kevin. Thank you for your service Where we see ya good luck. I'd vote for him again. Public service we have bigger fish to fry. Though bigger problems. Bigger scandals today As much as we're gonna talk about raising money today. Baretti children's hospital. I'm gonna take this one segment to point out that things do carry on and probably the most hideous thing that is carried on the work of matt. Lewis who operates deepfakes on our show. And i don't know if you saw it i don't know if you saw it. It is the worst is it's criminal. This guy's got to go to jail facts mayor. Gloria would probably get off to a great start if said he confuse it. Gloria is a. He is it. They is it day mayor. If mayor gloria would issue the immediate warrant for the arrest of matt lewis because he does all the deepfakes for our show and he recreated the pottery from ghost with anymore and patrick swayze and boyer of course is patrick swayze. But this time bromont de. I don't like that i that's actually well. He said this is what happened when they got home from queens on steers after co hosts. Tom oh you don't even see it. You boyer back. You don't notice what's happened and then looking at nibbling brahmos year you don't really see it because bromo is in the shadows but there's a close up on what's supposed to be demi moore and this is the green ever seeing him mayor. Gloria show a warrant for the arrest. Forget about kobe. Vaccine's move this up the top priority for our national security and.

"So this is not going to be a surprise because the left loves to scream and yell about racism, sexism, homophobia, It's all about identity politics. It's all about political correctness, cancel culture. But then every once in a while, they kind of step in it on their own, so right, and it's always something that happens. It's very fun. So last week we brought you the story about how the left the Democrats are attacking a gay Republican running for Grossmont Cuyamaca School district. That's Jordan Gascon. A gay Latino Republicans, so he's got two strikes against him. He's Latino, and he's gay and as your chastity to be Republican, anyway, they sent out mailers. The left the Democrats. The union's basically highlighting his sexual orientation by saying, Oh, he lives with his his husband. Right. Well, why don't you point that out? They would never point that Adipose Dog whistling there, So we called them out on that. The Union Tribune said nothing nothing at all. Then Friday, no surprise. Ah, the Union Tribune, which is literally the voice of the establishment of the union, groans and the big business, guys, the lobbyist get together and they tell us what to do. Their editorial page. Endorsed our Gloria and mind you The reason why they endorsed our Gloria because they praised Barbara as experienced and she's a capable executive. And and a ah, absolute, you know, managerial Sze powerhouse. They said that the reason why they're going with Gloria Is quote. He has the ability to bridge the Gulf between San Diego status as a diverse blend of many cultures. And its history of electing white Mayor's s So in other words, wait. He's not qualified to qualify is not qualified. But we're going to choose him because of his skin color. I want by the way we like the idea of a quote. Finishing off the editorial and inclusive leader, an inclusive leader in charge at City Hall sends a powerful message to young people of color and the G B T community about what they can achieve unquote. So it doesn't matter that you're you're not as qualified as he's exactly the sort of thing I mean, it's nothing about his his brains or is the skills or his leadership. He's just a Christmas ornament. Basically, they said, you know, he's he's He's ethnic and he is LGBT. And so therefore, as a result, boom, he gets our endorsement, even though in the editorial, they bend over backwards to say Barbara is more qualified. Barbara has the ability Oh, by the way, what they said, because what they said in the editorial where they said she's more qualified, But he checks the identity politics boxes. They suggested. That, Uh, quote perhaps Mayor Gloria could use a chief of staff like Barbara Brie people they did not. They did not say that the woman should take the assistant job to the handsome little things they confined for her to do around there. Maybe he should hire her and give her some pencils in a desk. Maybe she could actually serve up some really, really nice coffee while she's at it and take his dry cleaning in because she takes notes really well, and she's business, E and stuff, So that might be a good fit. We get the celebratory, you know, ornament for the figurehead and the real working person that could be the girl in the background. And then that would be a good fit. Hurry. Everybody at the UT Well, good for her. She called it out saying, Look, you said that was more qualified, but basically because he's got these identity politics boxes. Apparently you're going to go with him. And I think what they probably were thinking. Like, what do we do? We we got, you know someone who's ethnic and we also have a woman running. What do we do? She's more qualified await. He's gay. So he kind of checks the woman's box anyway, or multi gender box or whatever the hell box and you want to check their This is that the way it works is that she was she was more qualified, but they went with him because of the color of his skin and the fact that he's good. So she did not have enough hyphens that does it. Really not in the box is checked for her. Not enough virtue, signaling going on S O. So here's the thing. Now there's a all out political correctness war going on, with the Barbara people pointing out..
