I mean, they're going to be able to run an honest election this time in Georgia. I mean, somebody, anybody who compared the ballots you got Stacey Abrams, The former governor is running around laughing and saying that well, we got another million votes will take care of things. Yeah, listen, the same practices that troubled President Trump and the Republicans and Lin Wood and City pile on Rudy Giuliani in Georgia are being employed in the special election the same way now, In fairness, Republicans have their radar up a lot more. And so they're watching for things. I don't think you'll see. Observers get jettison this time from Boat counting, but the mobile vote ballot boxes they're out there. There are still questions about whether significant, very signature verification will really be found. It's the law in Georgia, but it clearly wasn't followed in the November election. So I the same practices that Stacey Abrams, the Democrats. Got embedded in the November election are going to be available to the Democrats in the special run off. The question is, can Republicans do a better job of oversight? Can they catch more things? And they object, the more things and will they get signature verification. I think the key to everybody feeling better about the January run office. Will there be an honest signature verification process? That's what a lot of the Republicans in Georgia are focused on right? Heading into November, they discovered a sudden limitation that no one machine could count more than 10,000 votes and well turned out was pretty big in Georgian. So they were going to encounter the scenario where some machines might count more than 10,000 votes, So they had to go and tell the election officials in Fulton County that's Atlanta. Hey, you gotta crack open the machines when you get to Close to 10,000 votes. Take out the memory card. Stick it somewhere. Put another memory card in and keep counting. Well, real chain of custody issue, right? Where did that car go for a few hours or maybe a few days. Well, well, we focused on that. Then we learned Well, the Atlanta did something where they were told the limit was 10,000. But they started taking the cards out at 3000 votes way before the limit. So there were some irregularities that have yet to be explained. This was a story that they kept hidden from the public until we got this freedom of information Act. There are some real questions of chain of custody, particularly in Atlanta and Dominion. And I think those need to be resolved. I know lawyers. For the Republican Party. Been digging into that story the last couple days, John, I know that you just said that Republicans are gonna pay attention. Better this go around, But, you know, the I think we all can see in in our head. The Ruby Freeman video where she She sent everybody home. And then there's Thies four suitcases and rules him out. What's to keep them from doing that again? I mean, how will Republicans know if they're if they're being Snookered at the moment that it's taking place. Well, I think you will be two things in place that weren't in place. The last time I listen all the warning signs and giant it's Georgia, where available weeks before the Republicans were just asleep at the switch there. They knew what Stacey Abrams plan Woz, and yet they had no observers. No lawyers on standby to do things this time around. Election observers are going to go home. If they have any suspicion that something else is going to go on. You're gonna have 24 hour monitoring of the election counting sites just because of what happened separately. There are lawyers on call. If you get a sudden order everyone to leave at 10 o'clock. I think you're going to see lawyers go to a judge and try to get an injunction in real time. "Unlike some of these states where it's Philadelphia's the issue are Clark County's an issuer. Detroit's an issue in Georgia. The entire state seems that issue. The entire state is an issue. We've got an issue from from from front from the beginning to the end. We don't know whether the votes that were cast or legal or not. We're just supposed to take the word of the people who were verifying signatures and under normal circumstances, That would be okay. But there's so many reports of people who showed up on Election Day. And learned that a ballot had already been cast for them as an absentee ballot or requested. It's an absentee ballot for them when they did not request one so There's an issue with with that, and we need to know whether the votes that were cast were legal or not, And we still don't have any. There's no sunlight there at all. No transparency, and we don't have the answer to that, Then the next thing is that we're doing this recount the return of the complete and total sham. The rules keep if they seem to keep changing, the secretary of state said last Wednesday. There would be an audit off full manual recount and a re canvass of all the votes in the presidential election. But now it's changing to this. Well. If it's within the margin of error, then we'll just take what was on election. There's no margin of error when and that's fine for a poll on those sure, sure, weren't accurate, but there's no margin of error. When it comes to a vote. Here's what Mayor Giuliani just said about the situation in Georgia. So, for example, the recount being done in Georgia will tell us nothing because these fraudulent backlands we'll just be counted again because they wouldn't supply the signatures to match the ballots, so it means nothing to have counted these ballots. When you know all of us who work for groups that we may be conservative groups that maybe there were more aligned with Republicans usually than we are Democrats, but that it can be just as bad in a state that is run. Entirely by Republicans, and I think Georgia is showing that example is it you've got to have effective state leadership and enjoy in Georgia. Specifically, this is not just us is conservatives hammering Democrats or liberals. That is exactly correct. Over the last few weeks, I thought no wonder the Democrats didn't trust the election to two years ago. And what are we going to do when we get to the end of this, and you have most Democrats and Georgia and most Republicans who actually question whether the vote they cast will be canceled by an illegal vote? What can you share with us today With regard to what is happening in Pennsylvania? I know that people are getting a lot of information, and some of it's true some of its false and a lot of it is being suppressed. So what are we seeing on the ground there? Well here. Here's what's going on, and you're right. A lot of being suppressed. We filed a lawsuit the other day it's supported by over 50 witnesses. Always after Dave. It's under oath, so it's based on very, very solid evidence that people are ready to testify, too. And just a simplified The major thrust of the lawsuit is That Republican Inspector We're not allowed to inspect any of the mail in ballots. Contrary to the law of Pennsylvania. And contrary to the war of absentee ballots, which has existed forever. I mean, I've been in many elections. Will you count absentee ballots, and you have a Republican and a Democrat observed about In this particular case, it was really important to have an observer. Because we were going to go to like. Million two million mail in ballots when usually we have 300,000. They made it especially important that they be observed, because the minute that you separate the ballad from the envelope. It could no longer be checked. The only chance you get the only chance you get to check if it's a valid vote by a valid living person who's registered. Is when you have the envelope. And both sides get to see it. Then we agree. It's a valid vote. Once you take it out of the envelope, and you put it in the vote pile. It's an anonymous private vote. There's no way to reconnect. So what the Democrats did very shrewdly. They They excluded 47 of our inspectors in pencil in Philadelphia, Pennsylvania, which is a crooked democratic city that cheats every election. And the even When we went to court, they wouldn't let us get close enough to see it. They did the same thing in Pittsburgh. Not for the whole day. They did it just to the first day. So in Pennsylvania, there were 623,000 ballots. That are unlawful. They were submitted without any inspection as to authenticity, and they are deemed there for unlawful. And the state Legislature gets to decide the winner, not ABC or CBS. And those votes should be deducted. When you deduct those votes Trump wins by pretty close to what do you actually won, by which is about 300,000 books. That is a huge number when we're you know, Usually when we talk about invalidating votes here, you're talking about very, very few hundreds or thousands. We have a almost the same lawsuit in Michigan, two of them one of the state court. One of the federal court. In which in Michigan, we now we're up to about 300,000 ballots. That were Waffle. In Michigan. It's traditionally it's a crime to exclude an inspector. So the people who did it committed crimes. And we have way have Two witnesses. I'm sorry. Three witnesses with affidavits. At four o'clock in the morning. 100,000 ballots were brought in. After everyone thought that all those nails ballots have been counted. 100,000 ballots were brought in the back door. It would counted furiously. Because they didn't want trump to be ahead in the morning. So Trump began The beginning of the night with a 300,000 votes leads. By the morning he was losing to buy. move to a section dealing with the law two issues in particular that my colleague Pat building the deputy White House counsel will be addressing issues involving due process and issue specifically legal issues dealing with the second article of impeachment obstruction of Congress so I will you my time now Mister justice to Mister bill but this is a repair she spread radio programming from Monday Mister Chief Justice senators Majority Leader McConnell minority leader Schumer the other day as we opened our presentation I touched on two areas some of the due process violations to characterize the proceedings in the house and some of the fundamental mis characterizations in errors that underpin the house Democrats charge of obstruction today complete the presentation on those points around out some of the fundamentally unfair procedure that was used in the house and its implications for this proceeding before you now and also addressed in detail the purported charges of obstruction in the second article of impeachment I'm due process there are three fundamental errors that infected the proceedings in the house the first is as I explained on Saturday the impeachment inquiry was an authorized an unconstitutional from the beginning no committee of the house has the power to launch an inquiry under the houses impeachment power was the house itself is taking a vote to give that authority to a committee I noted that in cases such as really verses United States United States forces walk ins the Supreme Court has set out these principles general principles derive from the constitution which assigns according to each chamber of the legislative branch to the house and to the Senate not the individual members of the subcommittees for an authority of the house to be transferred to a committee the house has to vote on the DC circuit has to still the principles from those cases this way issue about subpoena a committee or subcommittee must conform strictly to the resolution establishing its investigatory powers that was the problem here there was no such resolution there was no vote from the house authorizing the issuance of **** under the impeachment power so they think we began with nearly two dozen invalid subpoenas the speaker had has proceed on nothing more in a press conference in which she reported to authorize committees to begin impeachment power under the constitution she lacked that authority as the chairman of the house Judiciary Committee during the Nixon impeachment inquiry pointed out Peter Dino explained that such a resolution from the house has always been passed by the house it is a necessary step if we are to meet our obligations so we began this process with an authorized subpoenas does no compulsion on the executive branch to respond with documents or witnesses and I'll be coming back to that point that threshold foundational point when we get to the obstruction from this second fundamental due process there is it the house Democrats denied the president basic due process required by the constitution and by fundamental principles of fairness in the procedures that they use for the hearings I'm not going to go back in in detail over those as we heard from judge Starr the house Democrats essentially abandon the principles that have governed impeachment inquiry is in the house for over a hundred and fifty years and I'll touch on just a few points and respond to a couple of points that the house managers have made the first is that in denying due process rights the house proceedings were a huge reversal from the physician's house Democrats themselves have taken in the recent past particularly in the Clinton impeachment proceedings I believe we have manager Nadler's description a what was required engine Adler was explaining the due process requires at a minimum notice of the charges against you the right to be represented by counsel the right to cross examine witnesses against you and the right to present evidence all those rights were denied to the president now one of the responses that the managers have made to the the fact that we pointed out in the secret proceedings were manager shift began these hearings in the basement bunker is that well that was really just best investigative practice they were operating like a grand jury don't be fooled by that those hearings operated nothing like a grand jury a grand jury has secrecy primarily for two reasons to protect the direction of the investigation so others won't know what witnesses are being called in and what they're saying to keep that secret for the prosecutor to be able to keep developing the evidence and to protect the accuse because the accused might not ever be indicted in this case all of that information was made public every day the house Democrats destroyed any analogy when any legitimate allergy to a grand jury because that was all public they made no secret that the president was the target for you should file counties about him every day and they didn't keep the direction of their investigation secret their witness list were published daily the direction of the investigation was opened and the testimony that took place was collectively we to a compliant media to establish a false narrative about the president if that sort of conduct had occurred in a Rio grand jury that would've been a criminal violation prosecutors can do that under rule six eve the federal criminal rules it's a criminal offense to be leaking what takes place and a grantor and also the grand jury explanation provides no rationale whatsoever for the second round of hearings remember after the basement bunker after the secret hearings where the testimony was pre screen then the same witnesses who had already been depose four point on in a public hearing where the president was still exclude Patrick Sheldon deputy counsel to the president what was the reason for that in every prior presidential impeachment in the modern era where there had been public hearings the president has been represented by counsel and cross examine witnesses why did there have to be public televised here with the president was excluded there was nothing more than a show trial now I also address the other day the house managers contention that they had offered the president to process that at when things reach the third round of hearings in front of the house Judiciary Committee the manager never offered the prison to process not explain why that was illusory there was no genuine offer there because before any hearings began other than the law professor seminar in December fourth the speaker had already determined the outcome already said they were going to be articles of impeachment and the Judiciary Committee had informed the counsel's office and they had no plans to call any fact witnesses or have any factual hearings whatsoever it was all done it was locked in it was very and there was something else hanging over that when they had offered purportedly to allow the president some due process rights and that was a special provision in the rules for the house Judiciary Committee proceedings also unprecedented that allow the house Judiciary Committee to deny the president any due process rights at all if you continue to refuse to turn over documents are not allow witnesses to testify so that if the president didn't give up his privileges and immunities that he had been a certain over executive branch confidentiality interested he didn't comply with what the house Democrats wanted then it was up to chairman hours potentially to say no rights at all and there's a term for that in the law it's called an unconstitutional condition you can't conditions someone's exercise of some rights on their surrendering other constitutional rights you can't they will let you have due process in this way if you wave your constitutional privileges on another issue the last point I make about due process is this it's important to remember that due process is enshrined in the bill of rights for a reason it's not the process is just an end in itself instead it is a deep seated belief in our legal tradition it fair process is this central for accurate vision making cross examine cross examination of witnesses in particular is one of the most important Impeachment hearings: Tuesday was a disaster for Republicans
"Impeachment proceedings against President trump were a doubleheader today with hearings both this morning starting at nine. Am Eastern and men another marathon hearing this afternoon starting at three o'clock eastern extending well into the evening tonight ending less than a half an hour ago.
