"What's apparently an unprecedented decision announced today by D.C. council chair Phil mendelson. He's trying to withdraw the sweeping D.C. crime bill in an effort to keep it from being nullified by Congress. Joining us live from Capitol Hill is Mitchell Miller and Mitch, the Senate is set to vote on a disapproval resolution this week on the D.C. measure. Is that boat still going to take place? Counsel chairman clearly hopes that it won't, but all indications right now are that it will take place on Wednesday. It's likely to be embarrassing for the district. Tennessee Republican Bill haggerty who's led the Republican effort for a vote to overturn the changes in the criminal code sharply criticized mendelssohn today on Twitter he called it a desperate made up maneuver that has no basis in the D.C. home rule act, Senate aides also point out that the D.C. Bill has already undergone a House vote and the disapproval resolution passed easily, so it doesn't appear there's any way that D.C. can now unilaterally pull its bill, which automatically undergoes review by Congress once it's approved, and it looks like the Senate vote is going to be pretty lopsided. Some are predicting it may pass with close to 70 votes since no one wants to be seen as approving a bill that lightens many criminal penalties. Yeah, Mitch politically, this issue definitely has become a major headache for congressional Democrats and even President Biden. It really has. It began as a well intentioned effort to revise a criminal code that most people agreed needed to be updated since many of its provisions go back more than a hundred years. But council members clearly underestimated the reaction it would get when people learned that mandatory minimum sentences were being reduced for crimes like robbery and carjacking. This comes at a time when the number of yearly carjacking says nearly tripled in the past four years and concerns, as you know about crime have grown, that's why mayor Bowser vetoed the bill, which is over ridden by the council, and ultimately President Biden felt he needed to weigh in on the Republican backed resolution saying he would not veto it if it were passed. Image, what do you think is ultimately going to happen with this effort to reform D.C. sentencing guidelines? I think it's clear they're not going to change in the immediate future. Keep in mind that even if all this controversy had not come about, the changes weren't scheduled to go into effect until 2025. And now the council and the mayor are trying to work out a compromise. I'm changing various penalties with Congress looking very closely over their shoulders. So I think it's going to take a while for this to be worked out locally and then let's not forget that the next year as a presidential election year and there's going to be a lot of talk about whether candidates are soft on crime. So I think the current sentencing guidelines are going to stay in place in D.C. at least for a while. All right, Mitch, lots to talk about thanks much. You bet. And that's WTO Capitol Hill correspondent Mitchell Miller. 5 18. Traffic

D.C.'s mayor muriel Bowser is urging Senate leaders to vote down a resolution that would block the district from implementing new guidelines to punish violent criminals. The story from WTO's Mitchell Miller. Today on the hill. The mayor has written Senate majority leader Chuck Schumer and minority leader Mitch McConnell, calling on lawmakers to respect D.C.'s right to self determination. Tennessee Republican senator Bill haggerty, who's leading an effort to intervene in the manner, notes Bowser herself has issues with the measure passed by the D.C. council. As mayor Bowser put it and vetoing the bill, this bill does not make us safer. But while the mayor opposes some of the changes to light and penalties for violent crimes, she says she's working those out on a local level. "Did or did not President Trump and or his administration Or for national guardsmen To Nancy Pelosi and her people before January 6th Unequivocally yes January 4th in the Oval Office I was there with the commander in chief the Secretary of Defense the chairman of joint chiefs of staff and the chief of staff for the president of the United States where the president unequivocally authorized up to 20,000 national guardsmen and women on January 4th immediately thereafter as chief of staff for the Department of Defense We executed that authorization and went to Nancy Pelosi and the capitol police and mayor Bowser and they all said no and mayor Bowser put it in writing in the United States Capitol police timeline that was just released shows that they declined and put it in writing Do we know why The Speaker of the House Nancy Pelosi declined the president's offer For national guardsmen and how many did he offer The president offered up to 20,000 in the law works as you know mark is the president can authorize the National Guard or the second component of the laws there must be a request by a federal agency or a governor in this case mayor of D.C. And Nancy Pelosi controls the federal capital police and therefore they report it to her and why they did not want it I would leave it to the political experts I'm a national security guide but they seem to be worried about the optics just like they were worried about the optics of Lafayette square though there was the hypocrisy of their way And they also could have put up a no crime fence around the capitol They failed to do that And they failed that federal law enforcement there surrounding the capital such as the FBI and DHS They failed to do a great many things that would have been very simple to do

It's prudent to make sure that they're being vetted in that anybody who cannot pledge instead of just, you know. Hey, sending the guard. Let's go. We have a military coming in. We're good. Okay, Everybody's everybody's on the same page. Good. We have our mission. Good. We're training. Good. We're drilling. Fantastic. Nope. At this time. Everybody needs to be questioned. Everybody needs to be scrutinized. Invented. Did you ever think you would see 26,000? Armed men and women in uniform surrounding the capital as it's locked down for an inauguration and then on top of that those very men and women Are being scrutinized at this level. This is I can't even it's hard for me to get my head around because I've really been diving into this and I do not like what I see. I'm gonna give you the numbers. 25,000 National Guard troops 12 have been removed at his 120.48%. They're making it seem like there's a coup attempt in the making. As soon as Joe Biden takes the oath of office, you could go and pick a group of 25,000. Anything's and you're gonna find 12 people that have ties to something you don't like. So stop with the nonsense. I understand that we live in. It's a crazy time. I understand that we have skepticism about quote unquote fringe. What do they call it here In the U. S. We had Timothy McVeigh. Awful thing. What Timothy McVeigh did clearly, but he had ties to right wing militia. So they've been kind of running with this sort of narrative for the last 30 years, But nothing real has ever happened. Yes. Have there been instances of violence? Of course, there have Korben. The Charlottesville parade is an example. What happened to the capital's another example. As the FBI is now saying that it looks like the oath keepers, one of these groups. Did coordinate ahead of the protests, which again just means that Donald Trump didn't incite anybody because the oath keepers were planning on doing this, regardless of the fact that that's what the intelligence says. "And thank you for the question Amanda the district over a year ago as we were beginning preparations for the inauguration reached out to all our public safety on support agencies to estimate our costs for the inauguration, and we estimated those costs at $34.9 million. That was our request to Congress for the district's inauguration fund. It's important to note that part of our request was also looking at Deficits that we had run in our emergency Planning and security fund, which is annually appropriated by Congress because of the heightened number First Amendment demonstrations we've seen throughout the year s O as we were planning for this specific inauguration after the First Amendment demonstrations that we saw over the summer, we we change that number two as you mentioned 44.9 million Roughly $45 million. We want to make sure that residents are able to get access to their homes. So in the event that in the efforts to ensure security around the capital that also bumped out to some of the some of the neighborhoods and there's a fence line. Their residents were to show their idea again that the National Guard members that are there primarily there for traffic control. They should be able to gain access to that area on should not incur in current in the issues. If they do, please feel free to Reach out to the Metropolitan Police Department will coordinate without secret service member partners as well to resolve any issues that members of the community maybe having okay and then what steps are being taken to secure those residential areas and neighborhoods surrounding that capital perimeter area, So we have strategically placed resource is again Metropolitan Police Department resources in different areas around the capital footprint to ensure again a sense of safety and security for our residents. Other federal Resource is air here. We're very appreciative of that. That relieves us of the responsibility of having to take care of federal buildings in the downtown footprints. So I was watching this from television the other day, and the only person I blame is Mayor Bowser because the hotels in the restaurant thing knew this was gonna happen. They closed ahead of time, and I believe the police at the Capitol allowed the entry and I think she's gonna use this as a scare tactic for her platform for statehood. Yeah, I think it escalated because of her failure to stop things. Well, this is very interesting because this came across the wires this morning because now you know you have Governor Hogan's somehow. Criticizing the federal government for not asking the Maryland National Guard for 90 minutes after a hard job. I think it was the mayor of Washington. You know, one would think the police. I mean, if the hotels and the restaurant's knew I knew, but I wouldn't venture all the way down there. But if they knew when they were closing up, she just used. This is a scare tactic. Statehood and the wherever the president and whoever the president is, that should not be a state. It shouldn't be controlled by someone like bells or when the president resides there. So whoever the president is no. Look, I think there's an argument for statehood for Puerto Rico if the citizens of Puerto Rico Want to move from being a commonwealth to being a state. I think that should be displayed, debated and discussed, however, the idea that you can carve a new state out of the property that belonged to Maryland to take over the map. You take a look at the District of Columbia. It was originally a square on the Maryland side and then also on the Virginia side. What is no Army of Virginia was originally part of the District of Columbia. It's pretty straightforward. Georgetown was actually a separate entity at the time, but you can't take away a state's property and create a new state. The only exception. That was when the states were in insurrection during the civil war. And so there's a very weak a constitutional argument for making DC estate. But you're right. I think, joy they're gonna push for it. And I think that hewing to the Constitution is our only defense here. And that's a case that may go all the way up to the Supreme Court because the Democrats control House Senate and the presidency, they're going to push forward. Well, and I just think the Republicans and even the Democrats that didn't do their job the other day. I would not want to be in the history book for everyone in the future to read about those people those names and go Why don't they just do what they were supposed to do do their job. So on our in 10 minutes, I think it was after Mayor Bowser requested the National Guard assistance. They will finally let him because Donald Trump refused. The department of refused allowed the Department of Defense to allow them to come in and get Tony. I accept what you say. And then we There could be a huge investigation of that. At the same time you spent you spent time in the military. I was in the military. It's not as if unless they had these these members of the National Guard on standby in an armory somewhere. They were. Well, that's good, and we're in that case. If they were on standby in an armory somewhere, they should have been involved. They should have obviously been involved immediately. The problem is I think that they had no clue what was coming at him on and they was a total breakdown in intelligence operations. They should have known all this stuff from some of these things wack a doodle organizations. They post this stuff on Facebook. You can see it. Yes, they did. And on Twitter. Yeah, they posted stuff on Twitter. It was it was. It was totally insane yesterday, but what I'm trying to get at Tony and I hope you'll agree with me on this is that there was a fundamental breakdown in communications they and intelligence they should have understood what the potential was and you prepare. For the worst case scenario. You don't report prepared for the best case scenario, and that's what I'm on and I That's why I think Speaker Pelosi is right here. Some head should roll now and you have people you have people barricading in the house and in the Senate. You have a woman who was who was shot to death inside the capital. I don't know the circumstances of that. Okay, but I I certainly think that there should be some questions asked. Why did that Police officer fire his weapon and it appeared to be a man. Why did he have to fire his weapon? At that point there were a lot of people they will do is we're barricaded. What happened to the Capitol police officer who was injured. What would the extent of his injuries and who inflicted those injuries? I mean, there's This. This has to they should have known Tony. That's the tragedy here. I agree. Okay, So the fact what you've seen over the past few months all over the country the last couple of months since the election happened, considering everything that we've seen coming from from the Trump supporters. They should have known. They should have known that this was a possibility, and by the way they approach and by the way, if they had Adequate personnel. On duty. You know a few blocks away. They could have stemmed it, You know, Nip it in the body don't want to quote don knots of memory, But they basically that crowd. Once that crowd realized that the resource is the police resources were inadequate. At that point, the crowd you know, a lot of people walked up those stairs or climbed up the scaffolding of that building that might not have there were people are going to try it anyway. But once the response was inadequate, People felt. Hey, Phil, let's go. It's Let's go. I mean, if you let me let me ask you a question and inciting and insurrection.
