"All right folks, well listen, no matter how much we want to move on, we are still living in an FTX fallout world. So today we're going to do a couple updates on that front and then we're going to talk about what I think is the beginning of a clear trend and whether it's good or bad for the industry. All right, so picking up where we left off yesterday, we had been discussing how SPF had turned down the invitation to speak before Congress at the hearing next week. He said that he didn't have all the proper information and then he wouldn't feel ready, but that when he did he would certainly testify. Now just after I finished recording, congresswoman Maxine waters chairwoman of the House financial services committee tweeted, SPF, based on your role as CEO and your media interviews over the past few weeks, it's clear to us that the information you have thus far is sufficient for testimony. As you know, the collapse of FTX is harmed over 1 million people. Your testimony would not only be meaningful to members of Congress, but it is also critical to the American people. It is imperative that you attend our hearing on the 13th, and we are willing to schedule continued hearings if there is more information to be shared later. Basically, this was a total BS call on Sam's statement that he couldn't speak yet. Another way to put it is that if you can go on YouTube channels that have basically no subscribers and do a Twitter space as every other day, you certainly can come get your scrawny little behind in front of the U.S. Congress. Mostly people were glad to see it. A lot of the comments are okay, maybe I'd like you to go harder, but sure, this is better. Still, a lot of people, though, probably agree with D.C. investor when he wrote, getting better Maxine, but you're going to need to subpoena him if you are actually serious. A lot of folks also pointed out that Maxine waters account was hiding hundreds of responses to the original tweet and complaining to Elon Musk about it.

And on Sunday he responded, representative waters and the House committee on financial services. Once I finished learning and reviewing what happened, I would feel like it was my duty to appear before the committee and explain. I'm not sure that will happen by the 13th. But when it does, I will testify. Now this garnered another response from Maxine a day later, which basically said, okay, so you can do endless Twitter spaces but not testify where it matters. Waters tweets based on your role as CEO and your media interviews over the past few weeks, it's clear to us that the information you have thus far is sufficient for testimony. As you know, the collapse of FTX is harmed over 1 million people. Your testimony would not only be meaningful to members of Congress, but is also critical to the American people. It is imperative that you attend our hearing on the 13th, and we are willing to schedule continued hearings if there is more information to be shared later. Now many in crypto appreciated the slightly more forceful tone, but still more or less agreed that without compelling Sam to come, he simply wasn't going to. AKA subpoena or bust. However yesterday, CNBC released a bombshell piece saying that waters wasn't planning on subpoenaing Sam. Quote, waters informed committee members of her decision at a private meeting Tuesday with Securities and Exchange Commission chair Gary gensler on Capitol Hill. Those at the meeting say water said she wants committee staff to try to convince bankman free to voluntarily testify those with knowledge of the meeting said. Now this absolutely set the Internet on fire. Dave portnoy, the head of barstool, went off just as a four example. An SPF is just waltz around there. I don't know, biggest collapse ever people lost their lives, their jobs, their livelihoods, all their money, life savings, gone. And he's not being called to testify. What are we talking about? Sorry, I don't remember it is somebody has their hands so deep in this and so much money and protecting his ass. It's disgusting. Now, one other note from that portnoy rant, he mentioned that one of the reasons that he was disbelieving of all of Sam's claims to not be involved in key parts of the business was that when FTX did an advertising deal with barstool in early 2021, Sam wouldn't finalize that deal until he had talked to portnoy directly. This is more or less the same source of my skepticism that I've shared before. The part of the biz that I saw limited, though it was to just brand marketing. Didn't just have Sam have visibility. He was the final call always. Anyway, there was enough of this sort of fierce intensity that waters was compelled again to respond. She tweeted, Liza circulating on CNBC that I am not willing to subpoena SPF. He has been requested to testify that December 13th hearing, a subpoena is definitely on the table. Stay tuned. Meanwhile, over on the Senate side of the table, the Senate finance committee also set a date for an FTX related hearing. The day after the house hearing. So the investigators interviewed the chairman of the state Senate Health Committee as part of its probe into Governor Cuomo's handling of nursing homes amid the coronavirus and that scandal, including is $5.1 Million book Deal. What a sleazebag! This guy sick $5.1 million. That's a lot of money to make during the pandemic when the average business can't even open up. So you have state Senator Gustavo Rivera, uh, from the Bronx. He said that he was invited to the FBI's Brooklyn headquarters earlier this month, and he was interviewed for nearly you know. Three hours by agents and prosecutors from the Brooklyn U. S attorney's office and they talked a little bit about everything, he said mostly the governor's interaction with the Legislature throughout the pandemic. The investigators also asked Rivera for records to corroborate what he told them, which he agreed to provide. Of course he did, and many questions involved. The Cuomo administration is cover up of the total nursing home death toll from Covid 19, which is a huge, huge issue right now, because they want to get to the bottom of it, so this State probes are also going to be addressing a string of sexual harassment allegations because we know he's not off the hook there mainly by former and current female aides. While the Judiciary Committee is investigating the nursing home deaths that is taking place as well, So it seems like this guy so many scandals up his sleeve. But the Brooklyn U. S attorney's office and the I have both declined for comment because we've been following the story in the press, but Cuomo's lawyers, this is interesting because in fact, it seems kind of, um Uh, sleazy to me to release a statement like this. Right. This is solely and completely about Trump's behavior in the lead up to the election is not about you. We understand that you guys disagree with us. We understand you voted for Trump because you may disagree with some of our priorities. But this is really about we, as the Legislature have to stand up for our for our own domain. If they had said that it would have removed a lot of the club from the hands of Republicans who didn't wanna vote for impeachment.
