"Really excited for you to hear today's episode with Scarlett Johansson. Before we get into the conversation, you might hear a little background noise, including our guest stars like my son gave and my dog turns out they were just as excited to talk to Scarlett as I was. All right, let's get into it. As an actor, you just get rejected all the time. But you build relationships with people, it's not a waste of time if you're making connections with people and learning and getting better. It's all time well spent. I'm Carly zakin, and I'm Danielle weisberg. Welcome to 9 to 5 ish with the skin. We've run into so many questions over the years and had.

"Started to feel like I had just felt like I didn't want to represent someone else's beauty ideal or beauty standard and I had finally kind of had the confidence to do something on my own. It just felt a little overwhelming because obviously it's a completely different industry to what I am accustomed to. I didn't want to license my name and go that route. I really wanted to start something that felt true to me and that I could kind of plant the seed and grow and so I went down many different avenues of just education and product development and discovering trying to understand is the consumer looking for what I'm looking for and obviously don't want to create something that's just for me. And while it was a very is a very noisy space. I thought that there was opportunity in that to create something that was really pared down and transparent. And sort of reject that rejected the idea of beauty secrets and which is really kind of what we're touching. We're talking about. And once I've kind of come to that realization, I knew I needed to find my person. You know, I have a film television and a film and TV production company here in New York and I have my partner in that and I couldn't do anything without him and because I do wear many hats and you know I knew that I would need somebody to be my person on this and so just put out a bunch of kind of feelers and with other people that I had met in the industry to see if anybody was curious to take a leap with me and when I met Kate, she was like sort of in between two worlds at the time but you know we just started dating a little bit and just got to know each other and it felt like what I was circling was yeah it was something that she just it resonated with her like she got it right away. She saw it and saw the potential in it. And we spent about like half a year kind of dating. And just like really getting to know one another and try and it could be any I have this thought like walking my dog the other day or you know I tried this product and it inspired this idea or I was having this conversation with my girlfriend and like this is what we both really care about. I don't know. All these kind of conversations that were really like discovery conversations and through that process, the outset was born. Yeah. That sounds like Sarah and I, honestly. Like I really love that. Sarah and I were paired together a lot. We were at separate publications competing publications actually. But we would always see each other. We hit it off and became friends. And then we were sending each other DMs, texts, emails, like, did you see that this is happening? Did you see that this was acquired? Oh, did you hear about this product launch? And then from there, we were like, why not create something together? We can just take these conversations public. So it kind of reminds me a little bit of our story as well. I love that. And also, you know, we built this, it really, the first time we met in person, it was just before everything explodes. It was March, you know, I know a lot of first time was actually in January. Oh, was it? Yeah. In person. No, no, no, oh, sorry. That's right. But when we had that lunch, we got lunch, yeah. Which was basically like two days before everything shut down. It was like, definitely the last meal I had at a restaurant in 2000, whatever. No, I remember my husband's birthday, and that was the last meal. I had ever had with anybody for like, you know, two years, 16 years, yeah. And then Kate and I had to get to do like we had to, you know, we just basically did a lot of FaceTime. And it was, I think, cathartic in a way, 'cause we both have kids and we were like, going through the school, like at home school, stuff, like all these humongous changes, and then there was in some way, it was almost like we were like in the creative rabbit hole together because of the circumstances, so. Came yeah. You're head bitch in charge. I just want to like take a minute to not get that needle pointed on a pillow. Is that okay? Your resume is incredible. I mean, you were at juicy couture at the height of juicy couture. You worked with Victoria's Secret beauty. I mean, you were really on the forefront on so many beauty and fashion trends. So I have to think to myself, if I were in your position, Scarlett Johansson wants to create a skin care line. Obviously the name is there, and you're like, oh my God, this is great, but I can't imagine you would partner with someone if they didn't know their shit. I was going to say too, like, at the time that you were having a conversation with Scarlett, we were working together and. Had a very successful situation previous to what you're doing now. Kirby's point for you to like, that was probably a really big decision for you to leave everything and join Scott. So why Scarlett? Why Scarlett? Well, yeah, I mean, it was very scarlet. Fine. There's only a thin wall separating us Kate. Just remember that. Part of me, I need to get my index cards. Line? Nope. Yeah, no, it was such a wild time because Sarah Sarah tan was very much in my life at this moment as well. So I had created a word of mouth product recommendations platform that was acquired by a very large media company. And when I got the call, do I want to meet Scarlett Johansson? I was like, I'm not kidding, like, in the thick of monster contracts and paperwork for this business to be acquired. And, you know, I was kind of like, it's not really a good time for me. I have this thing going on and it's going to be amazing. And I was kind of like, are you sure me? Did you mean to call somebody else? You know, I kind of had both that mixture of fear of, wait, really? Is this something that anybody thinks I can do? In addition to just kind of like the craziness of life going on and thinking like, oh, this might not be the time. And then I also, I passed on a major opportunity before creating my startup because my son was little, and I was like, I was like, it's just not a good time. And he was like, he was a baby baby, and I passed the spine and wound up being a monster success. And grianna, if the situation was different, I'm not sure I could have made it into the monster success it was. So no discount to the team that actually went on to build throwing shade. I was like, I need to watch my peas and cues over here. Yeah, so anyway, I'm saying I could, and maybe the story would have been written differently. But I think I learned from that experience is say yes. A bit more. It's never a great time to do anything. And but it's always the right time to be curious about new opportunities. And I was kind of like, I think the thing that really got me of why meet with Scarlett.

Christian Toto: Hollywood Creatives Are Being Left out Simply for Being White Males
"You know I read a piece this weekend I think you cited it on your social media feed or was it this weekend or less But I think it was by Barry Weiss on her sub stack but it was a different author And the gist of the piece was that this isn't just about actors you know Christian you and I think Hollywood like you say you think Scarlett Johansson and Brad Pitt and all these famous actors that's actually a very small sliver of Hollywood You got gaffers lighting people foley artists sound engineers I mean not all these people are died in the world liberals Matter of fact a lot of them believe in liberty and freedom like we do And the gist of the piece was that these writers and script writers that they're being subjected to these de facto racial quotas and you've got a bunch of middle aged basically white men who've done nothing wrong of dedicated themselves to the crap submitting scripts and stuff and being told straight out Christian they're not hiding it Hey sorry man We've got to hit some kind of quota for black minority LGBT or artists and writers and you're not it I mean that's the textbook definition of discrimination right there It is it's a great article I recommend everyone check it out to Barry Weiss's subsect page And I have some of that in my book as well I've also recently spoken to a comedian he's a straight white comedian very funny fellow and he played me an audio clip that he saved from one of his agents or reps basically saying you're a white male I can't do anything for you I'm so sorry It's happening It's real And part of this is Hollywood has done a terrible job of being diverse in the past I think the shame they have is real And they should have some guilt But this is a massive overcorrection It should be about the artistry and gifts and talents of the creators not the skin color So let everyone on board Any minority any group if you've got a great story a screenplay you're a great actor We want you That's what it should be Not this we've got to overcorrect and just an absurd way That's
Christian Toto: Hollywood's Fear Gave Wokeism Power
"How did they get woke Was it just a matter of like what happened with for instance big tech companies where you had this indoctrination system going on in our universities critical theory critical race theory and a bunch of kids became adults who populated the boards of these companies I mean how did it happen I mean you used to celebrate American ideas and the ideas of freedom and liberty and now we're at the point where that Brandon Ralph Superman movie they took out a truth justice and they took out the American way part I mean how exactly did that happen Well I think it's a better question How did it happen across the culture Why did it why did it swamp universities What did it jump from university life to real life What you have in Hollywood is a lot of fear And when you have incorporations as fear as well And for some reason this sort of woke sentiment is given much more power and cloud than it actually deserves It's just a very small part of the community as you well know So when they hear those voices rise up rather than being strong and courageous and saying hey this is what we do This is our art go away We're going to back up what we're trying to do They buckle like Howard One of the best examples of scarlet Johansson who is beautiful and talented and successful and when she makes a movie it often makes a lot of coin And yet when she picked the wrong role she was going to play a trans figure in a movie the woke howled and she apologized instantly And here's what's really important about this It's just one role it's just one actors You can kind of roll your eyes and say who cares But if you're a plumber if your work is kind of a blue collar guy or gal and you get under attack and you think the most famous actors in Hollywood couldn't stand up to the mob what chance do I have I think that's one of the real fears of what I'm covering here is that when these big players cower in fear it sends a cultural message and says well what chance do I

"The star of Black Widow in the movie studio have patched up their differences over the release of the film on streaming it's a quick and harmonious and what was shaping up to be a long acrimonious battle pitting Scarlett Johannson against the Walt Disney company the actor sued Disney over the screaming release of Black Widow saying that move breached her contract and cut into earnings at the time Disney said the suit had no merit and even went so far as to call Joe Hanson out for what it called her callous disregard for the effects of the pandemic on the world after both sides appear to be digging in their heels they have now settled their lawsuit terms of the deal were not disclosed but both sides say in a joint statement that they are now pledging to keep working together I'm Oscar wells Gabriel

I haven't gone once So i don't know if it's if it's still dying in strategy. I don't know when that's going to come back. But apparently there's like we're talking just weeks ago. There's still money to be made by putting butts in seats to watch a film inside a movie theater. absolutely scarlett johansson black widow. Prove that dude. Three hundred and seventy eight million dollars in the box office with only one hundred and fifty million dollars on streaming. Oh dude it proves that people want to go back to the theaters. They want to pay for the candy. They want to take the girl or guy out on a date. They want that experience. You know because it's student experience whether or not it's safe it's still inexperience and if you're safe about it it is plenty safe you know is just with my leg and if i get sick i have the chance of really damaging my leg because i have a rod. A bunch of screws cadaver bone and stuff like that. I just don't want to take the risk of possibly catching something and getting secondary infection. That could leave me with no league. You know what i mean. Yeah me on a lesser scale. Have any physical damage to my body. But i just am probably like what i think the majority of americans are at the moment as well as just trying to be conservative in your thinking daily on the basis. What is the best decision for me and my family. Do i want to go to theatre where everybody's breathing coughing and it's the same air and or just going to watch what streaming on tv right now and there's so many good films that are just coming up like if you have hbo max. It's like they just released stuff. I'm just like wow. This is a streaming service ever. Because it's like it's in the movie theaters and i'm watching it at home right now. It's like so. I'm excited for dune. That's coming out in Next month october. And i've definitely going to be reviewing that that's going to be. Oh yeah for sure. Easy to talk about the coming out like the day. It's released in theaters i. It's so crazy that we can just like. Watch it on your on your tv when it's in the theaters such a big change. I believe hbo. Max has the right attitude with streaming services because they're saying that the movie is coming up at the same time as theaters but they encourage you to go to theaters to watch it because they say watching it at home as a disservice to the film and the filmmakers so those of us who actually care about the film will make that extra choice to go. See it in theaters. I i truly like that way of thinking. Not only are they getting extra people to sub to be able to watch that movie at home but they're also encouraging people to go out and pay money at the theaters and Spend their money. They're not making any more expensive on their app instead. They're sharing the with the feeders. And i think that is double kiss. Double french chef kissed beauty. Yeah okay well. Hopefully disney will. Their secrets will will not be remained so hidden. And we'll see something..

They told her that is going to be just like the other theatrical releases whereas when be only to the movie theaters and with them releasing it on coincide lee to disney plus. They ended up cannibalizing. The the box office like yes. They about three hundred and fifty eight million in box office so far and one hundred and fifty some odd million it disney plus but still one hundred and fifty some odd million. She's not getting her fair. Share out of the part. She played but disney is counter. Soon right now putting in the paperwork to move it to arbitration rather than litigation which. I'm not crazy good on the legal mumbo jumbo or whatnot. But this is kinda what i'm getting from. Both sides of the aisle right scarlett johansson lawyer wants to get in litigation because they want to go in front of a judge and they want it public. They want everybody to see what's going on the air disney dirty laundry for the deceptive practices that they're doing to cannibalize one industry while trying to promote their own interest in another right right. Yeah it's actually what you have been talking about for almost the better part of a year now of. Yes this monopoly. It's can be created with the streaming service and once they move over to arbitration all. This is gonna be behind closed doors. There's going to be sent and no one's going to know what happened and it'll be an nda talking about it. Yes yes so. She's trying to move over to make it public yet. This is an exact quote from her lawyer. John berlin ski. After initially responding to this litigation with misogynistic attack against scarlett johansson disney is now predictably trying to hide his misconduct in the confidential arbitration. Why is disney so frayed litigation litigating this case in public. Sorry i couldn't get litigating out as but what i'm understanding is that with the moving over to the streaming so my like we're both super movie fans like we love the movie experience. Have you been to a movie theater. Since the corona viruses dwindled down. Yeah i've been one time but it was right after. The virus started getting down when the theaters were just open back up and i haven't been in a while. It's just something about the environment right now. I don't trust still doesn't feel safe. I that's kind of where. I'm at myself like i normally. It might seem like obsessive for a lot of people. But i'm two or three times a week..

Yeah it's An a lot of people say that they think this one is goes against the grain kind of formula breaking like One of the only marvel movies are one of the first. I guess that is a genre film and not. It's a comic book movie. But it's also like a spy thriller. Yeah you know which is interesting. Yeah for sure. I think yeah go ahead. I love chris evans sculptor. His out agree. Yeah i agree I thought out of all of the huge cast of of the marvel cinematic universe pairing those together. it was just like a great idea You know they've paired her together with robert downey junior before and that was kind of like You know with mark ruffalo which. I also don't really care for her. Chris evans just like are just like two puzzle. Pieces fit together like whenever they're in interviews together. They did an actress on actor. I was going to bring that up. I saw that. Yeah scarlett johansson and I thought that they had like perfect. Chemistry and smoothie and I love this movie. Yeah i yeah i agree. I think i've talked about it. We just recently on the regular show where we were talking. Butter favorite moments of the twenty tens. And i brought up this movie because i think the causeway ambush sequence where the winter soldier jumps onto the car. And there's that whole sequence. I think is one of the best. Action scene marvel has ever done. I think it's such an intense gritty sequence at so well directed so well choreographed. I think that that when that moment comes. When i saw it for the first time i was like man. This is the best. 'cause it's so intense and i think that the especially the hand to hand combat towards the end of that sequences incredible with winter soldier and captain america and overall. I think that there are other great ones. Like there's the one where you i see the winter soldier and captain america chases after him in through the hallway and onto the rooftop does black panther. Show this movie. No thinking at civil war. Yeah okay. and so. I think that the the action really elevates it by still think. It's pretty solid espionage thriller. It's it's nothing groundbreaking when it comes to that. But it's still pretty solid for a movie like this. And i think that this definitely put the russo brothers on the on the map you know and i i agree. I think black Scarlett johansson and captain america or scarlett. Johansson and chris evans are fantastic together. A above the other dynamics that she's had and i think she's a perfect black widow. Yeah but it's like this movie is not bad. No oh no definitely not. Yeah we should do a retro review of yoga at some point. I'm easily entertained and not very critical. I can be critical when it's required of me but generally just choose not to be because it's easier. It's more fun find that you're more satisfied when you're not critical. Yeah you walk out of the theater and you just feel good. Yeah instead of just feeling you know said disappointed that we did with the rise of skywalker. Jake star wars movie. Yeah things happen. That's what most people are saying. It was action. It was exciting. Yeah you know. Just wanna see the white sabers yeah. That's hey that's that's fair. And that's kind of the on. I guess Giovanni rabih see as well and on a ferris very briefly as well this is. I believe jacob virtues favorite movie. He loves it. He loves sofia coppola as well. Yeah and the synopsis is a faded movie star and neglected. Young woman form an unlikely bond after crossing paths in tokyo. This one made one hundred and nineteen point seven million against a budget of four million so pretty big hit for sure and was pretty widely acclaimed critically an with audiences and it's definitely had a shelf life over the years and it's one that i am constantly hearing from best of the two thousands and is a favourite of many people. Like we just said you know we. We keep hearing all this stuff about theaters dying. You know people not going to theaters anymore. But i don't know. I feel like movies. Make more money these days. I feel like always hearing about the latest movie. Just hit a billion dollars you know. Yeah like i think not to get too off track. But i think it's almost select movies that are making that money and then it's a ton are not making any at all like the middle budget movies kind of dying you know but movies. Finally and i enjoyed it immensely I think they hit their stride towards the middle of the first season and up to probably the middle of the third season. They did have some weird kind of Piece different shows that we're just kind of concept pieces that were fun and you just kind of said okay. It's not about the college anymore. But i think it finished overall pretty strong and i was happy with the ending. Yeah i enjoyed the show. I mean there was at least one. Laugh out loud moment in almost every episode Well written troy and abed were hilarious. detroit bed in the morning stuff was great. Yeah it was a bummer. One troy leftist show but You know. I guess he had bigger things to do. I've not seen them in any movies. Though i know that's what he left for a movie career but Maybe movies that. I'm not watching also made a pretty big molik. I didn't know he was doing music. Okay so then so that was well worth it. If you haven't seen community check it out. It's pretty funny and you know the funny thing is at the beginning. When that show us. I started. It was running today. I don't think it would. It would be allowed and then The other thing. I wanted to say is i think you told me to watch ted lasso. I did not know someone else and somebody else right. It is i love. i've seen three episodes. I am totally in. Because i know you and your family like soccer is something i think you guys might enjoy and Yeah so it's got one season and the new season they put. I think a new episode every week one episode of weeks. It's kind of old school in that regard. But i'm really enjoying it. I'm three episodes in and i love the character. Ted lasso i absolutely love Love him and then the other ones that are involved. I'm already starting to warm up to him. I i know who. I like and who i don't you could see what growth is going to happen in the characters. He can kinda see that coming. But it doesn't bother me. I'm still enjoying it In this exclusively on apple plus right now though right apple plus yes santiago. So if you bought an iphone or one of your kids have. I believe you can get a apple plus for like six months and You could you could watch it on if you've got a tv. That has the I you know the apple service built the apple software built into it. "Same then the pandemic hits and things go down but in addition to that disney decides. Hey they're going to go down and we're gonna stream it at the same time. I'm not upset that they screamed at the same time but i am upset the fact that they violated the contract and decided. You know. we're just gonna do this anyways. And then their response to it was. We think it's heartless for scarlett johansson to to blame the pandemic when there are people struggling the pandemic and she's already made twenty million on this movie when it's not like they're gonna take this extra money that she would have made that she should have made that she's suing for and give it to widows and orphans right. I mean they're going to keep it for themselves. Why doesn't the whole response to. I think was pathetic But yeah i agree with you. I hope she wins. And i think that i again. I agree with you that it was okay that they went to disney plus release it. That's fine that's kind of the way the market is but at that point. I think they should have met with her and said here's what we're planning on doing. So let's work out some sort of equitable for. She takes even a cut of the disney. Plus yeah he didn't work out an equitable relationship. Exactly yeah yeah come up with some sort of formula you know on the believe. They made eighty dollars in the theaters. And they get half of that so they get forty million out of that. And i'm sure out of that. Forty million is what they paid. Scarlett johansson so you might argue that well you made sixty million on disney plus one hundred percent of it so whatever that percentage was. We're going to give you the same. So we're just gonna say the six million disney plus was like our take of the box office that we're gonna add that to the forty million that we made our half of the ticket sales so the total number there is one hundred million dollars. Here's your cut. I think she probably wouldn't have had an issue with that. I don't know for sure but at least that's a little bit more. I think fair than just saying up. Sorry you said Gross ticket sales. And this is what we have. I think actors going forward are now going to put disciple stuff in their contract. And this is what we alluded to last week when we said these deals are going to change in the future. They're not gonna make the same money that they made but It's is going to be based on a different metric and is going to be a combination of ticket sales and streaming. They just need to get the contracts going forward ironed out. And i think they will. She was caught in the middle and what disney did in. My opinion was not right. The interesting thing on this is had they done that. And i don't know what the full details were and how they tried to renegotiate the contract to make it so they could you know. Go day and date on streaming. But had they gone to her and said hey. We want to go. Dan dayton streaming. We know your contract says it has to be released. And she said no you can't does disney have any sort of recourse where they're like this movie. It's our content. Were distributing it that they can override her no. She can't have ultimate veto authority on the entire movie like that. It would impact everybody. Who was involved in it. So at some point disney had to pull some sort of shenanigans that said this is our content. We can do what we want with it even though she has this other contract and you know so even if she said no there they just went forward with it. But yeah she. She probably did in fact if they went and talked to she probably said no. I want to just take my chances in the box office. Let's see how well it does. Then they released a streaming. She said well that killed my box office and and rightfully so. That's a good point that you bring up. She's not the only person she got executive producer. Credits i guess she has a saying it. But the as you know there's a whole bunch of executive producers and They even answer to the studios so her input was just part of that input but the difference is they gave her nothing so even if she said no and they said. Here's what we're doing. Here's what you're going to get. And now she made. They may have made that offer and she said no because she wanted to sue them. So there is details that we need to Made available to us which we're not gonna get until this is all said and done but on the surface of it. This is how it looks to us. If you've got more information on it or other things please let us know i You know. I'm being really hard on disney but You know maybe there was something that Scarlett johansson was difficult to deal with. I don't know but it just seems like he got scarlett johansson against as big huge company on usually gonna lean on the big huge companies taking advantage of scarlett johansson. Yeah on one hand. You're like she got twenty million. How how is that not enough but on the other hand it's like why would disney deserve that money instead of her. You know it doesn't make any sense but it doesn't matter but i agree. It doesn't matter the amount of fantasy because you get you get what you deserve an earn and if that was the deal. That's what you get so whether it was a lot or not. Yeah i don't care about now. I think that her number her fifty million number that she's suing for is probably inflated. And that's probably a number assuming that the the box office would have been what it was pre pandemic and i don't think she's should be entitled to you know estimates based on pre pandemic. I don't know i could be wrong with that. Maybe she adjusted her number based on post pandemic predictions but if her number was based on pose a pre pandemic. There's no way the box office was ever gonna hit that so like you're saying going forward Actors who have the ability to get kinda the back in deals are going to have to restructure them. They'll still the same upfront money right. I don't think that'll change it all. But if they have the ability to get the back. End deals are going to have to restructure it if they want him to match the back end deals that they were getting before when the box office was massive. Yeah anyway it's a whole new world out there for movies and we'll have to wait and see that by just personally..

"The lawsuit also pointed out that certain disney executives had bonuses tied to the performance of disney plus and that that might be part of the reason why black widow was also released on streaming. It is true that in disney chairman bob eiger and disney ceo bob japex contracts. Their bonuses are in part based on the successive of disney. Plus you might expect in any. Ceo contract that they're going to get bonuses based on the performance of key assets. So that's not really all that surprising to me putting this in the suit the way scott. Joe hanson's team did though. Certainly they were trying to suggest that these two had their own personal motivations to put this movie on the streaming services. Well because it would help it perform and then hence allow them to have potentially bigger bonuses in response to the lawsuit disney put out a statement besides saying that the suit has no merit whatsoever disney said and i'm this a direct quote. The lawsuit is especially sad and distressing in its callous disregard for the horrific and prolonged global effects of the cove in nineteen pandemic and disney went on to say that they've fully complied with her contract. And furthermore the release of black widow and disney plus has significantly enhanced her ability to earn compensation on top of the twenty million. She has received to date. That's pretty strongly-worded. Yes i call it. A scorched earth statement even in a bitter legal fight. Usually the corporation being sued tries to strike a tone of neutrality or piece in its statement. A statement i might have been expecting would've been scarlett. Johansson is a valued member of the marvel. Universe we're very distressed by this lawsuit. We feel we have been fair in our negotiations with her but we look forward to resolving this amicably. Yada yada yada. What signal do you think. Disney was trying to send with the statement. Disney has a reputation as a tough company. They are fierce negotiators. They are very experienced. There's a lot of very knowledgeable people in there. And i think they were no doubt you know maybe trying to send a message to other talent as well then. They're not going to pay the kind of money. That warner brothers did earlier to renegotiate. These contracts right that they're not going to be pushovers. And they're not going to respond well to threats or litigation. How has joe hansen responded to disney's strong statement. She herself has not responded. But her agent brian lord who is a co chairman of creative artists agency. Which is of course. The biggest talent agency in town. He went after disney. He said that they have shamelessly. And falsely accused johannesson of being insensitive to the global cova pandemic in an attempt to make appear to be someone. They and i know she isn't you basically said the company included her salary in their press statement in an attempt to weaponize her success as an artist and businesswoman. As if that was something she should be ashamed of. Do you think that we are likely to more lawsuits like this. I do think we will see more. I don't know if we're going to see like one every day. But i think is just goes on. We will see more of these suits making all these changes especially in this rushed fashion. That we're seeing is what's got talent concerned that there needs won't be met that they will get squeezed in the desire of all these big media companies to control their own destiny and out net flicks net flicks. So i think it's going to be a very interesting and challenging next few years in the relationships between the creative community and the gatekeepers and know ultimately will. We'll see what happens. They both need each other even as much as i don't want to admit it. They both need each other to make the content that keeps people buying it and generating profits and allowing them to make more. "So how much money thing they lost this year. Maybe like six billion dollars like you know i mean. That's that's the thing is like they're they're they're you know. Obviously they decided to release it because of cova because they couldn't they did delay the movie a year. She's worried about people. Come to see the movie. they did. Delay it a year and whether they're like cows disregard for kovic meanwhile they're fucking parks are open and they tell people to wear masks and shit you know yeah spree critical genius of course so it is like fighting a big corporation. But it's wild. But then i saw this article from the hollywood reporter headline scarlet hanson's black widow lawsuit is game changing but may be legally week. These guys are saying basically if this doesn't get settled if it goes into arbitration disney's probably going to win the case the jury since yeah. They're they have more power that simple They probably have better lawyer. Disney you see what the parks open and all that other stuff even though they do everything in their power to project this like you know super like friendly corporation that's altruistic and progressive and this and that but blah blah behind the scenes they're all about the benjamins made absolutely and they will trust that. Yeah you have trust facade now. They are cut throat. So part of me is cheering for the scarlett johansson. Go get your money. Girl deserve it but the other part of me is like then you know everybody's gonna do this and we may not get..

"Marshall i say like fan drives away. Plant sucks that's a scene from marvel's black widow which opened in theaters and on disney plus early last month to great fanfare but now black widow star. Scarlett johansson is suing disney who owns marvel studios over that simultaneous. Release saying that. It violated an agreement that the film would open in movie theaters. Only joining me to talk about the lawsuit and for a check in on. How hollywood is doing these days and in the summer movie season is kpcc entertainment reporter. John horn. welcome back john. Happy to be with you. So let's start with this black widow lawsuit. What's at issue here. Well it's important that she sued disney. But that's not with whom she had her contract. She had her contract with marvel and the whole ideas that if she sues marvel it goes to arbitration and the whole thing is secret. She says disney interfered with her contract with barb which makes it a public lawsuit. So yes there is the instant case of scarlett johansson saying that she was robbed of a lot of money because the film went on disney plus in at the same time but this is much bigger than that. She is represented by brian. Lord a very powerful talent agent and the creative artists agency they have tons of people who are in scarlets case so the question is is this litigation aimed at reforming the way these contracts are written 'cause scarlets people say that she could of made fifty million dollars more if her contract had been adhered to and the film had only come out in theaters. I think a little bit of a reach because it assumes the movie was gonna be a huge hit and so far. It isn't disney responded here. Well disney has said that they adhere to the contract and that she's already been paid twenty million dollars so you could say yeah. That's a lot of money but if she was entitled to more you know it doesn't mean anything so the question now is did scarlett johansson camp. Try to renegotiate her contract with marvel because a sequence is she's about to make the film. Bob eiger the head of disney says. We're gonna launch a streaming service and scarlets representative say to marvel. This feels like it might change things. Marv applies and say if it does. We're going to renegotiate. We don't know what happened. We don't know. Scarlet made an offer and disney refused. It or offer was too big or too small whatever. We don't know what happened but we do know that the film didn't do well and the national association of theatre owners which kind of speaks for all movie theaters. Said the reason it didn't do well is because it was on disney plus and dropped off precipitously in fact it's one of the worst performing marvel movies that disney has released and it collapsed. So battling its second weekend and also was the sharpest downfall for any modern marvel movie in its second regan. Well that's really interesting. So what kind of effect does a simultaneous release in theaters and on streaming have then. It's very hard to tell this movie. Dropped off sharply but then you look at the most recent fast and furious movie it wasn't on any streaming service and it opened pretty well like to seventy million dollars but then it fell sixty seven percent in. Its second weekend so you could say the die. Hard fans are coming out to see black widow and f nine the first weekend but the other people are staying home so it does feel like you know something that's fundamentally shifting and there's an research organization that tracks consumer confidence in being in theaters and feeling safe and that number is dropping as well as the delta variance spike. So i think this is a bill that can't be on rung. People are used to streaming the numbers for subscriber growth at net flicks at peacock. Nbc universals news. Streaming site are all going up. So i think it's really going to be hard for theaters to come back as vibrant as they were before the pandemic so tell us more about these new habits of movie goers people are generally not venturing back into theaters. Not at all and there are a lot of movies that people would expected to do. Really well i mean in. The heights was a movie that i really loved. I saw it in a theater but not a lot of other people did and even though it was a lot better than a year ago where we were in the height of the pandemic if you compare the second quarter of this year the box office. The total gross was five hundred million dollars if you go back. Two years pre pandemic. The july box office was one point. Three billion dollars so just a month of july. It's gone from one point. Three billion to five hundred million. Wow yes some theaters are still not open. Yes some have capacity restrictions. But that's less than half the business from two years ago and that to me would be a very worrisome. Sign for theater so our studios rethinking than holding their movies for theatrical. Release down the road at some point given those numbers that you just told us. Yeah i don't know. I mean that was certainly the case with black widow. This is a movie that was postponed for more than a year by the pandemic. But you know one of the things. That's an issue for the studios as they invest to release them. Big movie like this. It costs almost half a billion dollars. You've got maybe three hundred million dollars in production maybe another two hundred million and marketing and promotion so you have invested that money and if it's just sitting on your shelf and you're not getting in return on it. You know that starts to cost a lot of money in terms of interest though. I don't know that they're going to hold a lot of movies. Warner brothers famously..

"Flint. Hi joe thanks for being here. Thanks for having me so joe. Can you explain this lawsuit for us. In more depth. What exactly is scarlett johansson claiming and how disney responding well scarlet johanneson is claiming that when disney made the decision to release black widow and its streaming service disney plus simultaneously with the theatrical release that they breached her contract and the breach that she's claiming is that her paycheck was largely based on box office performance so by putting the movie on disney plus at the same time that she believes cut significantly into the box office take that would have been also reflected in her paycheck now. Disney plus carried the movie in part of course because of the kobe situation and theaters not being at full capacity and in some cases still closed around the globe. Just to be clear on scarlett johansson. She's not arguing that they should have never done. This are honoured the commitment to the theatrical experience regardless of kovic. He's just saying you did this by contracting call for it and you needed to renegotiate with me and you didn't at disney basically. They said her sued had no merit whatsoever. They took it a step further and called it. I'm reading from the statement now. They called it sad and distressing in its callous disregard for the horrific and prolonged global effects of the in nineteen pandemic. Disney went on to say that they've fully complied with her contract and that she's received twenty million to date and that the release of black widow on disney has significantly enhanced her ability to earn additional. Compensation the statement was a little on the one hand. It was surprising just because most corporations don't like to air dirty laundry publicly but no they. They came out swinging trying to accuse scarlet being insensitive about the covert nineteen situation. When interestingly in the suit it includes an email from a marvel executive saying in spring of twenty nineteen so obviously before cove it the scarlett johansson camp was concerned about this i think when disney launched disney plus said how much marble was going to be a part of it. A lot of the industry was concerned. Well what does this mean for the theatrical movies. I'm making for them. So she had sought assurances long before. Kovin that you're not gonna move my movie to the streaming service which could hurt my box office paycheck. And if you do you'll renegotiate and the email back from the bible senior executive said yes. We would renegotiate your contract because much of it is based on the box office. So it'll be interesting to see how this ultimately plays out. So what does all this mean for. Contracts that were negotiated pre pandemic. Are we likely to see more of these kinds of lawsuits. What's your sense. Well fights between talent and what. I will call the gatekeepers meeting the studios. The networks streamers if been going on forever but They're getting more and more intense. In recent years particularly as companies such as disney and warner brothers and nbc universal are seeking to build their own streaming platforms go direct to consumer become net flicks or perish is the fear of all these companies. So that's where they're putting all their efforts in and that those are their priorities and that may not aligned with the talent or they at least need to try to make sure that their talent is on board with all this. We had a situation earlier this year late last year. When warner brothers decided to put all its movies on hbo max In part because of cove it but in part. Because hbo max was new and they wanted to give it a boost by having these fresh content on their and mortar went out and renegotiated with the stars with the talent with the producers. All the people who who's basically their salaries would be based on box office. They went out and redid the deals and made them whole disney is far as we can tell His taking a different approach. Now maybe that will change in light of the suit. We'll see if they start trying to negotiate with other folks but we'll have to see and this lawsuit is considered something of a bellwether for the entertainment industry. Which of course has made a lot of changes during the pandemic. what do you think even more broadly. This could mean an industry-wide well. I think as the industry consolidates. Everyone tries to get bigger. The fear of talent is that they lose leverage the negotiating table. It's tough to negotiate with one company if you can shop your wears to competitors and it's becoming more like that and i think some talent that feels they have the leverage will be willing to take this on and responded to hands and the reason this story is getting so much attention besides the fact that she's of course a huge colossal movie star and people are interested or is it is just rare to see someone of this magnitude. Take on a company like disney. It just doesn't have you. Don't do it and i think we may see like i said there's a possibility of more. There could be a little bit of a gate opening up with disney and other movies that they put disney plus where the stars didn't feel they were compensated for it but also just in general. We wrote a story in the journal of about a month ago about comcast and peacocking peacock wanting to get shows from nbc to put on it service and the talent wanting to be compensated more because of it and nbc ultimately decided not to put the shows on peacock because they weren't willing to pay the talent what they wanted so it is going to be an ongoing challenge in the media. Industry disease is he's giant conglomerates. Try to really focus on building platforms and doing everything in house and the talent who aren't employees per se and whether they will go along with this or play ball or if the zeal they're getting shortchanged get their lawyers on it. That's wall street. Journal media reporter jill flint joe. Thanks so much for your time today. Thanks for having.

A Review of the Newest Addition to the MCU: Black Widow
"I mean, the Marvel universe. Fans have been waiting for this for months and months and months, and now it's available. In theaters, and it's also on Disney plus so that you can see it there as well. It's going to be the apparently the only black widow films since Scarlett Johansson's character actually died in adventures and came this story has said a little before that. And she goes back to Eastern Europe in order to track down and ruined the great Russian spymaster who made her into a spy in the first place. And she also reunites with her fake family with which you were who she was an undercover spy in the United States in the 19 nineties in order to bring this fellow down, so it's a combination of family drama. Shall we say? With a big action, splashy action movie. I found the intimate moments in this film actually better than the action ones, which are in the typical modern way over cuts so that you can't really tell what's going on a lot of time and just overloaded with C G I the real star of the film, Although Johansson is very good is Florence Pugh. Who plays her younger, so called sister. They were sisters when they were undercover spies, and they unite along with their father and mother in order to bring down this terrible Russian mastermind who still wants to dominate the world with his army of brainwashed young women called widows. Uh, the people who Fans of the far Marvel universe are going to love this film. They're going to go out to it in droves. They're going to pay for it and dizzy. Plus, it's going to be a huge success. But it's really a kind of footnote to the series as a whole. It doesn't advance the overall marble saga very much. And as I say, it's probably a one off for Scarlett Johansson's Who cares whose character unless she miraculously comes to life will have to remain dead after this episode. Alright, that's black Widow Next up, Don Cheadle and

Now she's trying to talk about how, you know, just this contempt for the hypersexualization of her character. Also known as Natasha, from the Iron Man sequel. She goes, you look back at Iron Man two and it's really fun, had a lot of great moments in it. The character is so sexualized, you know? You know, really talking about the person like she's a piece of meat like a possession or a thing or whatever. Like a piece of ass and Robert Downey Jr. even refers to her as something like that at one point. What is he saying? I want some. Oh, heavens to fucking mercy.
