"All right, let's turn to the market today because, oh wow, I mean, remember how I said you might want to diversify your portfolio? I mean, there are some real growing concerns out there about a recession. Our economy, just having runaway inflation, there were some inflation data today, which is contributing to these concerns. Of course, the fed has to deal with that, but what do you know? That's going to mean less money in the system. Therefore, less spending power, perhaps for consumers. And so this is catching up with Wall Street. You saw the month of April closing out there on a low note, the Dow ended the day off nearly a thousand points. The S&P traded down almost 4% the NASDAQ lost more than 4%, so for the month, we saw the S&P lose 9%. It's actually the worst month we've seen for the S&P since March 2020 because again, investors are fearing the threat of a recession. Because the fed's going to have to do something, right? Meanwhile, you've got the fed's favorite measurement of inflation, just posting another major increase. So the fed governors are going to have no choice here. They're going to have to raise rates. They're going to have to raise them big time. There's been a lot of talk about 50 basis points. It's a half a percentage increase, but some think, and I think this was reflected in some of the optimism you saw earlier in the market, at least in Thursday's session, something that, you know, maybe they'll go easy. "Right, I want to turn to another big one we're covering Deutsche Bank coming out and saying that there could be a major recession. I told you that. Probably a year ago. I actually have been very, very concerned about inflation as you well know, since July of 2020, I have echoed those concerns over and over and over and over again on this show, urging you course to be prepared for it, which is why we're going to talk about gold in just a moment. But I recently came out and said I did expect a recession, 85% chance anyway of a recession, because I don't know how the fed pulls this one off. I mean, they got to get a rabbit out of the hat somehow, you are telling me that you were going to stop printing all this money. You were going to raise interest rates, which makes everything more expensive, right? So businesses don't want to invest as much. People don't want to go out necessarily and buy that new house because it's going to cost a whole lot more for that new house because interest rates are higher. When you cause the price of money effectively to go up, it has a dampening effect on the economy. Now, best case scenario, the fed is watching this as they go along, right? They always wanted two to 3% inflation. I've always wondered why you even need a 3%, frankly. But I think the idea is you want a little bit, right? Just to incentivize people to be in markets and to do things in the here and now as opposed to waiting 5 years or ten years because there's the threat, the prices will go up. But somehow, this all got off track. They did what they needed to do in March 2020. And then they went crazy. And they just kept spending and spending and printing and printing to the tune of a $120 billion a month that they were buying of mortgage backed securities and treasuries in order to artificially suppress interest rates and keep the money spigot open. Well, now the chickens are coming home to roost, so to speak. And what a bad time. I mean, if it were normal time, maybe they could pull this off although I'd still argue it would be pretty challenging. But this is not a normal time. You get a whole bunch of other things going on. We are looking at worldwide inflation. We've got massive problems on the energy front in terms of what energy is going to cost us and our European allies. I mean, this is what you call one big old giant mess. And I would also add the historically, the fed has never been able to pull this off. Something Deutsche Bank, by the way, noticed in its notes. They said that history shows the fed has quote never been able to correct. Even smaller overshoots of inflation and employment quote without pushing the economy into a significant recession. I mean, I've looked back over the last 80 years. They've never been able to do it.

"Tell you what's going on. So there's this thing that Donald Trump administration put into place back in March of 2020 during the haida coronavirus called title 42. It's something that the federal government has on its books that it hasn't often used, but it goes all the way back to 1944, and it's enabling the federal government to quote have the power to prohibit in whole or in part the introduction of persons and properties from certain countries during a public health crisis if there is quote a serious danger of the introduction of such disease into the United States. And so of course, the Trump administration put this into place in March 2020 because they were trying to stop the spread of COVID, but now that's going away because the CDC is decided, you know what COVID's not quite the problem, that it once was. And so now people can apply for asylum and that whole process can happen right here on this side of the border. And so in anticipation of this, our border patrol is getting a very nervous, the expectation is that you're going to have at least 8000 people apprehended per day. That number could swell to 15,000 and the expectation is that you're going to see unlike a border crisis unlike anything you've ever seen before, you know, we were already pre COVID dealing with massive numbers and now, in this environment, even with title 42, they're on the books still, we've been looking at nearly a million migrants that have come in over the last 5 and a half months. It's the fiscal year beginning in October for the border patrol. So we're going to have a problem. I mean, the expectation is this is going to be at least twice as bad, and you can understand why states like Texas and Florida are concerned.

"I'm watching very closely the volatility index known as the vix, which I always keep an eye on because it's a measurement of fear. And what we see with the vix today is that it's not anywhere near the levels that we saw say in November of 2008. After Lehman Brothers went out of business or even in March of 2020, when it was clearly the thick of COVID and the whole country had shut down. It actually in March 2020, we were up around 65 on the vix and back in 2008, we were in the 70s on the vix. And I think it's really just important to keep that in mind and keep it in perspective as we watch the vix today. We see it's up about 13%, trading around 32. So up there, but nonetheless, it shows you that this is not sort of full capitulation, even though you've seen a 10% downturn in what we're looking at in the NASDAQ. Meaning, yes, it could get worse before it gets better, and it's the reason why I wouldn't say, you know, go all in, although, you know, look, I mean, I think a lot of people said today when it was draining off a thousand, it was time to get a little bit back in and to nibble. What I would say is you want to be sharpening your pencil right now. You want to be looking for companies good companies that have been sold unnecessarily.

I mean, February 2020, you were like investigating marijuana and other things and then the virus comes and you just decided, I'm gonna start looking into this and I started to come across your stuff on sub stack where, you know, Aaron gin, who you might know is another guy that was really into it in the early days. And I was so outspoken about the lockdowns and I was we were really into it because I really had nothing else to do. Everything was locked down. And I'm by no means an expert, but just my common sense instincts that something's wrong and you are so informative and so courageous early on, walk us through that because you probably never planned to be center stage of one of the most important medical issues that humanity's ever faced. And, you know, I was working on a book about really about U.S. drug policy that would have been and I hope to write one day still a follow-up to tell your children sort of broadly about this, you know, the epidemic of legalization, the sort of very broad campaign to legalize drugs that we've seen and not just cannabis, but really all drugs that we've seen in the last ten or 15 years. And so I was working on that and then of course, you know, like everybody else, I saw the videos coming out of China. I think we were all pretty nervous back in January and February. And then in March 2020 and I talk about this in pandemia, I've read that Neil Ferguson report the imperial college London report that said, oh, if we don't do anything, 2 million Americans will die, but even worse, if we do, if we do mitigate a million Americans will die and we need to really lock down our society. And, you know, within days that started to happen in New York and California and everywhere else, and then and then amazingly to me, Neil Ferguson totally changed his prediction. Ten days after releasing this report that really shocked the world and pushed the United States and Europe into Loch Ness, he basically said, oh, you know what? I was wrong. I was wrong by 95%. Did I say 500,000 deaths? I'm at 20,000. Okay, so look, the science or the data was evolving very fast around the coronavirus. Back at that time. And everybody's got the right to look at new data and change their views. But what was shocking to me was that the media was not willing to acknowledge what Ferguson had

The job of men's national team player carries more responsibility within US soccer than the job of a woman's national team player and there was a indisputable science that women biologically were less skilled than men so therefore should be paid less even to the extent of questioning the female athletes about how strong they were. So this is a case involving four firefighters for the Fire Department of New York. One of them goes by the name of Salikh Bay. They are all African. American men who were employed by the firefighters fire department for many years all four of them suffer from a condition. That's known as pseudo Lights Bar by a probably call it be when I talk about this case. That's a physiological condition that causes disfigurement of the skin inflammation In the hair bearing areas of the Chin Cheek and neck It grossly disproportionately affects African. American men it affects approximately forty five eighty five percent of African American men. No other racial group is even in double digits of this has a significant adverse impact on the basis of race and most importantly for the purposes of our KS. The firefighters soup and they say the revocation of the accommodation violated with the violated. The Americans with Disabilities Act and this ends up with a federal court in New York and it ends up at what's known as the summary Judgment Stage You know I use phrases like summary Judgment from time to time and I realize I don't explain them. Firefighters are suffering from a disability And the court says well that's that's easy because they're certainly perceived as having a disability here and and they also suffer from major or limitation substantial limitation in a major life activity. What's the major life activities that their disability causes them to be substantially limited the ability to groom which is listed by the EEOC as a major life activity so step one firefighters potentially covered by the Ada? Then we get to Step to the departments answer to that department says hey. Firefighters aren't precluded from shaving. They only and I'm quoting cannot shave with a razor down to the skin because of PF. And therefore there's no substantial limitation on their major activity of grooming courtesan buying it the court says PF significantly restricted. The manner in which the firefighters shaved. It's reasonable to conclude that the limitations in grooming experienced by the firefighters are not likely to be encountered by the average person. Now we get down to where the real action is in the case with got four employees who have a disability and the next question is can the employer reasonably accommodate disability because he. Ada requires employers to reasonably accommodate a disability and the court says yeah Absolutely on the reasonable accommodation issue. These firefighters were reasonably accommodated. Nobody thought there was a problem with. They're they're going to fire scenes wearing these mass. They pass the fifth test. It wasn't an issue until we had this acting chief who simply changed the rules then department brings out. It's kind of last gasp argument here in the last gasp. Argument is that These firefighters you know we just assign them to light duty. We didn't fire them. So we didn't take adverse action against them and therefore they don't have any claim under the Ada and this is where the court waxes eloquently about the whole issue of firefighting. Here's what the court says. I'm going to read you that to three sentences ample evidence in the record indicates that the essential function of the job. The firefighters were hired to do was to respond to fires and other emergencies and admired position of service to the public by contrast the assignment. The light duty was an empty vessel of opportunities to carry out these tasks in accommodation allowing the firefighters to put their lives at stake to fight fires and protect the public from dangers rather than seeming to shirk.
