He urges governors to do the same for people convicted on state charges. He's also asking for a review of how marijuana is classified under federal drug laws. CBS News chief, Washington correspondent major Garrett who also hosts the takeout podcast joined Sean and Hillary to talk about the pardons. Timing clearly related to the midterm elections. There's been a lot of campaigning within the cannabis community on The White House to change policy about either those in prison or those who have been convicted and released on federal charges of possession and for our understanding of this, it really is more important to those who have already served their sentences and are out in the world trying to find jobs or housing opportunities, this pardon will remove the Specter and the stigma of having a federal marijuana possession conviction on their record, which could open up opportunities currently denied. White House officials on the conference call about this policy announcement made it clear that there is currently no one in federal prison right now strictly on a position conviction only. So even taking this away from them would not mean they would be released from federal prison. They'd have to fill out the remainder of their other charges. They were convicted of. But it does send a signal to governors, as you said, the president's in favor of reorienting all judicial policy about sole possession of marijuana and decriminalizing that as much as possible to as he said open up opportunities denied to people simply because they have one rap for one possession of marijuana. This announcement comes on the same week where OPEC says it wants to cut oil production by a couple of million barrels per day in that raises the specter of potential spiking gasoline prices once again. President certainly can't be happy with that piece of timing. No, no doubt. And this is bad for the administration on three levels. One, the administration made kind of a public last minute lobbying campaign to not have this happen. That didn't work so clearly the Saudis and all the members of OPEC plus, including Russia, ignored that. Two, it could increase gas prices right before the midterms never a good timing for any president in power. And third, it will reinforce Republican arguments, not about existing supplies because Biden administration changes on permitting and exploration. Don't have any real consequential effect on existing supplies, but they would reduce it in the future. Republicans say you're anti energy here in the United States. This will reinforce that argument in a generalized political sense. So it doesn't work well for the administration, but I would say after reading a lot about this and talking to some sources in the energy world, OPEC plus made this decision because it sees a global recession coming. Whether there'll be one in the United States or not, we don't know, but they see it coming and they don't want global or prices in a recessionary climate to fall below $90 a barrel. "Schedule your free estimate today It's 5 11 The House committee investigating the January 6th insurrection at the capitol last year holds its first prime time hearing laying out its findings starting at 8 tonight The 9 member panel hopes to grab the attention of the American republic and remind everyone of the violence that day And they plan to use the more than a thousand interviews to lay out evidence about people who played pivotal roles in the siege Well joining us live CBS News chief Washington correspondent major Garrett who also hosts the takeout podcast great to have you back major Thank you so much Good afternoon So from your sources and reporting what are we going to see and maybe just as importantly what form are we going to see it So the task of the committee tonight is twofold To explain to the country that the traumas of January 6th didn't just occur that day that they were set in motion in a premeditated way and you'll hear the words coup and conspiracy Just drive home the point that though it looked like a spontaneous event January 6th was anything but spontaneous The second thing the committee is going to try to begin to establish tonight and point to subsequent hearings is the following Responding to Republican criticism that this is a sham and it's only filled with a bunch of Trump haters That's the rhetoric of Republicans not mine The committee will bring forth testimony from those who worked in the Trump White House itself and to observe things that led up to January 6th to try to take away this accusation that it must be Trump haters who are focused on this No people who worked for the former president and who watch things unfold leading up to January 6th and on that fateful day have voluntarily come before the committee to explain what they saw what they noticed and what is relevant to why this all happened Nature one of the questions the committee has been interested in is how much responsibility if at all does Donald Trump hold for this violence What can you tell us about that So I've had conversations with many members of the committee as if my colleagues here at CBS and this question is sort of percolated on the edges Does the committee need to make a referral of evidence to the Justice Department And I've talked to members of the committee and they're like no look a referral from the Congress doesn't carry that much weight anyway And the Justice Department can evaluate all the evidence that it either has or watches us gather And it has been a fact gathering and evidence gathering process for the committee And it is going to try to assess and put down on the public record things that could suggest a conspiracy led by former president Trump to delay the proceedings in Congress to interfere with the things conducted under federal law on a peaceful transfer of presidential power and then let just the Justice Department evaluate the strength of that evidence and whether it warrants further prosecution But the committee itself does not consider that a mandate to bring or recommend criminal charges Major thanks as always appreciate it Major Garrett of CBS News stay with us here on WTO for complete coverage of the hearing It starts.

"Is the takeout with Major Garrett. Welcome Back to the takeout. Ben! Tracy. Ben, What is your title? My title is kind of clumsy, It's senior national and environmental correspondent. There we go. Titles matter and Jeff Bear daily. As I've said before meteorologist climate specials for CBS, so folks are watching on C. B s N and listen listening, but especially watching. I'm holding up a Photo copy of the cover of what is called the Intergovernmental Panel on Climate Change. Climate Change 2021 the physical science basis summary for policymakers. Jeff Bear Deli. What is that? So that's been going on since 1990. The world came together, you know, in the late eighties decided, Hey, climate change is going to be an issue. We have to come together as an international group and tried to figure out first of all, how to make sure that we understand the science and then what we do following that, so they've been putting out reports every five or six years, give or take. Since that time, Uh, this is a R six. So assessment report, 6261. And this was the science reports. So this is basically a compilation of all the science that's been done over the past several years built on a foundation of the science has been done over the past several decades. And so it's what we know. We're clear on what we still have to learn about, and it's it's quite a large document. Um, but it's no new. There's no new research, and it's just the research that's been done by scientists all over the world of the past three years. Experts will look at and say This is our degree of confidence. And this is how we see humans are impacting the climate and there's a lots. Hurricanes floods team works. I'm going to read some top line conclusions from the first few pages of this climate change, 2021 report, but first, Jeff From my audience benefit. Are there. Those who still disbelieve IP CC reports? Are there skeptics are there deniers? Are there those who say the scientist still wobbly? There are some. It's about seven or 8% of the population, so it's not huge. It's typically very, very conservative folks. Believe it or not, there's a counter I P. C. C report. Literally. There's an organization. I think tank that puts out a counter I V. C C report. I don't know if they did it this year, but they did it in the past, But the thing is is it's a It's a waning Percentage of the population. The vast majority believe that climate change is happening. But where there's some grey area is that a large percentage of people think that they're not certain if it's being caused by humans, But I can tell you that 99 And greater percent of scientists believed I know that climate change is being caused by humans. If you ask people black question, Bill Seo climate scientists are split 50 50. That is not the case. There is almost unanimous. Understanding that climate change is caused by All right, Uh, Ben, I'll get to you just a second. I want to run one thing more by Jeff. So this is a 11 from the IPCC report. I'm going to read it to you observed increases and well mixed greenhouse gas. Concentrations since around 17 50 are unequivocally caused by human activities reaching annual averages of 410. Parts per million for carbon dioxide. 186 parts per billion for methane and 332 parts per billion for nitrous oxide. What does that mean? Well, these are Green house guests that we're releasing through the burning of fossil fuels. You might ask. How do we know this is the highest that these gases have been like carbon dioxide, the highest spin in at least two million years. How do we know that? Scientists can go back and look at ice force from brain Lind from Antarctica. They can look at sediment cores down at the bottom of the ocean, and they can actually see preserved bubbles of air. It can then analyze those bubbles of air, and they can see that Used to be that the ports per million. So the amount department dioxide molecules per million molecules used to be 280 back in the 18 hundreds. Now it's 415. So we've seen a dramatic increase in such a short period of time, and I'll just emphasizes that rate of changed. That's a big problem. It's not good change. If it happened over thousands of years, it wouldn't be a big deal. But it's happening over literally decades and centuries, which really complicates matters in terms of us adapting in Michigan. That's an important part of the process of perfecting out of making the union more perfect, but ultimately accepting and celebrating it as a framework for deliberation that it doesn't sound as um Stirring as the words of the declaration pledging our lives and fortunes and speaking honored to rebellions, Germany or or even soaring, uh, words of the bill of rights. In the 14th amendment, Congress shall make no law respecting, you know, freedom of speech, but simply being able to deliberate peaceably. Rather than taking to arms and slaughtering each other. Is a tremendous achievement in human freedom. That's not been the case for the great democracies of ancient Rome, which fell as the framers recognized and ended in, uh tyranny or oligarchy or Bloodshed. It wasn't the case for the God It's no established UDS religions that govern the the monarchies of Europe for the middle Ages, and even the Enlightenment. We should we just can't take for granted the fact that we have a framework where for all of our polarization for all of the Twitter extremism for all of the, uh, the the passion that we see every day, generally with with the exceptions we've talked about, like July six Americans don't take up arms and try to shut down the government. They're willing to accept Supreme Court decisions that they disagree with. They're willing to accept. Election results they disagree with. They must be willing to accept that if the system is going to work, and that's a tremendous achievement that that is worth celebrating. So you live at this intersection of Research about reverence for an education about the constitution. It's my sense, but I could be wrong about this. That the Constitution itself has become a kind of polarizing document more in the last 10 years than it was in my memory. Before that, I could have that wrong. I'm just curious. I think the Constitution is the unifying document. There's no question America, of course, has become polarized. Okay, There's an awful lot of polarization about the meaning of the Constitution. As we see in the Supreme Court where there are, you know, important 5 to 46 to three decisions, but we've just ended a Supreme Court term where the court has been unanimous at a higher rate. And at any time in recent history, even despite the the the passing of Justice Ginsburg and the addition of justice, parent and we saw, remarkably, the triumph of Chief Justice John Roberts is hope. Of presiding over narrow unanimous opinions. Judd joined by justices of different backgrounds, All those unanimous decisions or nearly so 7 to 2 are unanimous. Upholding the affordable care act recognizing religious liberty, Recognizing the free speech rights of that cheerleader on Snapchat are all a triumph of the idea that the Constitution and the courts that shouldn't be polarizing and in order to maintain their democratic legitimacy. Citizens have to recognize the judges are not Politicians and robes as justice, Breyer said in a recent speech and that the constitution transcends politics. Um and it's wonderful that, um people across America can access them to free so I'm kind of a pro at this and what I've done is I've set up a springboard that I hope Jeffrey will jump on with relish and vigor. And the Supreme Court is this you've had and invited to this process. Liberals, conservatives and libertarians to think up and a draft alternatives to our existing constitution. This may take up all of this segment and our next segment. I don't care how long it takes because I've read about it. It's fascinating. There's the springboard, Jeff Jump. I'm happy to what an amazing project that was, As you say, We convene three teams libertarian, conservative and progressive of really well known scholars to draft constitutions from scratch and the results. Really surprised us. Far from completely throwing out the current constitution. All three teams proposed to reform or refine it, rather than totally abolishing it. But what was even more surprising was the areas of agreement. Remember, these teams didn't talk to each other. They went off in the state of nature of the state of Zoom and basically talked among themselves and they came back and it just blew our minds. The Conservatives and progressives both proposed Two amendments with nearly identical language. One of the amendments would have abolish the electoral college and replaced it with national popular vote with rank choice voting for president. And the Second Amendment would have 18 year term limits for Supreme Court justices. Now I just reconvene the teams and ask them. Do you think if we brought you back and you met in person at the National Constitution Center could you actually agree on the wording of the constitutional amendments that you know we could then offer as emblems for Consensus and, uh, for the world and they're up for it. So next year, we're going to convene in Philadelphia, bring these great three teams together and hold an actual mini convention. We were talking about the rules. And we think it has to be at least partly in private because Madison thought the original convention wouldn't have worked if the delegates couldn't have deliberated, Uh, you know, in private and made compromises, but part of it, of course, will be recorded and then we'll see what we come up come up with. So it was just an amazing project. There were really interesting areas of disagreement, of course, as well. Uh, the libertarian team emphasized Liberty. Unsurprisingly, progressive team emphasized democracy inequality, and the conservative team emphasized the Mattis Sony in values of deliberation. And I had lots of particular provisions that they disagreed about, but that that's central agreement just really surprised everyone and convinced me that there really is far more consensus about basic ideals in this country than 45 seconds before the next break. Did the libertarians have a thought on the electoral college one way or the other? Yes, the head of team will return said, Um, He, uh, thinks that it encourages nationwide campaigning and their general philosophy was, um, if it isn't broke, don't fix it. And the main principle that they wanted to embrace at the end of each constitutional provision was and we mean it right to enforce the Constitution as Mhm. Oh, and we mean it. Uh or as my Children you supposed on their doors? Stay out. This means you, Um Jeff Rosen is our special guest president, CEO of the National Constitution Center. Sadly, not doing very well, according to a lot of different metrics. Why're states like West Virginia doing so well? West Virginia decided a couple of things one that it would not do the federal model with its pharmacy distribution, meaning the federal government said you could work with the three major change Rite Aid Walgreens or CBS. Or opt out and what West Virginia opted out. So what that meant Woz. All the pharmacies in West Virginia could give vaccine supplies that West Virginia was able to With his hands on West Virginia has five hubs across the state that uses its national guard to take the vaccine from those five hubs and then move it straight to pharmacies. And that pharmacy used Has been accepted by the local communities in which those pharmacies are known and trusted a huge part of any successful vaccine campaign rollout and closest by proximity to the population that they most wanted to vaccinate first. Why what the president said all through Summer and through election day, and they're after constituted incitement, and that if he didn't know he should have known that his words had power and those who stormed the capital did so. It's not in his direct Urging. Thinking they were doing so with his support and committed crimes in the name of the president, and therefore the president has to some level be accountable, held accountable and they believe impeachment and conviction. The Senate is the remedy that the Constitution affords to do just that. Right, Major. You guys got some snow. You generally don't get as much snow as we get here in Wisconsin. So this appears to be the administration's first significant battle. What do we need to know about what's happening there? So what you accurately summarized with White House said today. We're not splitting us up, and I prefer everyone to something President, Biden said earlier this week. I think it was revealing and very, very important. And based and it's based on his knowledge as a legislative negotiator, he said. In negotiations, everyone holds out their position until there's no other alternative. That's absolutely true. And he knows that well, and what he's telling members of Congress is party and Republicans. Look, Let's not have this conversation. Let's not waste any time about whether we're dividing this or separated into two or three different component bills. That's not gonna happen. It's gonna be one bill. I'll talk to you about the size, the cost and some of the scope, But it's one bill and what's his big lever in his back pocket reconciliation? That's a 50 plus one vote majority in the Senate, So he's telling all the lawmakers We'll discuss your options, but no, This is your alternative, and that's where he's going to start the talks. How would you characterize the start of the Biden term in office? Well, it reminds me of kind of the start of the Trump. And we know all of this is happening while an impeachment conviction appears unlikely. What is this portend for governing and the countries? We move forward? Well, I think the most important component part of Kevin McCarthy's visit tomorrow. Lago is both released a statement afterwards, saying the focus is on winning a Republican majority in 2022. Now that would sound like a normal, rational goal. But there's been all of this house Republican fighting among one another to Lynne Cheney, the number three in the House Republican leadership be ousted should to be all this internal bloodletting and what McCarthy went down tomorrow. Lago to get from the president was an emphasis on unity, which means the Fang ng He's Trumpian hard core conservatives who want to knock off Lynne Cheney and have this big battle Royal within the party.
