"Of the United States and Maddie's Fund. This is Bloomberg Law, with Joon Grasso from Bloomberg Radio. With vaccinations, heralding a return to normalcy, the new year should see courtrooms around the country coming back to life and a number of high profile trials, including that of Elizabeth Holmes. The founder of Theranos Rain briefly as the world's youngest female, self made billionaire and a Silicon Valley star over her promised to revolutionize blood testing homes will be tried on March 9 for allegedly defrauding investors out of hundreds of millions of dollars. She settled a civil suit with the Securities and Exchange Commission after deposition in 2017 1st, broadcast by ABC News. It's a statement. That there is currently offers more than 200 is ramping up to offer more than 1000 of the most commonly ordered blood diagnostic tests. All without the need for strange it was that statement correct. Reading it Now. I don't think it is. I've been talking with former federal prosecutor Robert Mintz, a partner McCarter and English. So, Bob, what do we expect from homes trial going to be one of the most fascinating trials that we're going to see in the upcoming year? Elizabeth Holmes was criminally charged in June of 2018 with defrauding investors following the clap. For blood testing. Start up. The central issue in this case is that holds promoted a finger prick Blood testing machine that was going to absolutely revolutionize healthcare. It was going to replace vials of blood drawn from people in order to run the vast spectrum of blood testing that everybody undergoes when they go to the doctor around the hospital, and it was going to Replaced that with on Lee, a tiny prick of blood from which all of the same test could be run. So it was something that attracted the attention of Silicon Valley's most prominent investors and money poured in from all over the world, making Living at home, the youngest female self made billionaire. There's been some speculation that Holmes might try to push the blame onto her former boyfriend who was the president of Sarah knows and who will be tried in a separate trial after hers. Like that work. Well, whenever there are two people involved in a criminal conspiracy in this case, as you mentioned they're not going to trial together, so they'll not be seated next to one another. These are gonna be separate trials. It's often the strategy of the defense tried to shift the blame onto the other individual. And so in this case, it wouldn't be surprising if she does try to blame the ex president of the company who at one time had been her boyfriend for the criminal charges here, and it is, thankfully, comes down to a question. Whether she was knowingly exaggerating and lying to raise money on what was something that was going to revolutionize the blood testing industry. There's also been some indication at homes may try not an insanity defense, exactly, but something akin to that. One of the defenses that we're seeing Elizabeth Holmes lawyers floating now is the possibility that she has some type of mental disease or defect or other mental condition. That will act as a defense to her intent to commit this crime. But the problem that they're gonna say is that she has presented herself to the world as somebody who was extremely well educated, self, is it And affluent somebody who was in charge of this revolutionary company and to now say that she has some kind of a mental defect that they say may be based upon some type of sexual abuse of an earlier stage. Your wife may be enoughto find Steve Bannon, the former campaign chief for President. Trump and White House chief strategist is scheduled to go on trial in May in federal court in Manhattan over charges connected with his We build the Wall Group. Also going on trial with Bannon are two businessmen and a disabled military veteran. Tell us about the charges. He Bannon is set to go to trial on May 24th on charges that he and three other men, the fraud and donors and laundered money in connection with their group. We build the wall with trays, $25 million to fund the private construction of a U. S border wall. Prosecutors have a leg that Bannon and others used donated funds for lavish personal expenses, despite the fact that they played that 100% of these monies would go towards building the wall. Charitable entity raised millions of dollars from small donors all over the country, and the government has the legs that banning received $1 million from those proceeds and use them solely for personal use. Before Christmas. President Trump Pardon some of his controversial allies. His former campaign chair Paul Manafort, his former national security adviser, Michael Flynn, and his longtime friend and confidante, Roger Stone, So this trial could be scuttled if Trump decides to pardon Bannon. There is always the possibility that President Trump could in his final days in office. Pardon sees Bannon and that would eliminate the possibility of this trial. Going forward at all. At this point there is a congressman Paul goes, are Republican from Arizona, who is urging the president to part not only these Bannon but also a local retired Air Force airman who lost both legs and an arm in the 2004 rocket explosion in Iraq. And he's considered a word hero by many. In the event that pardons are granted in connection with this case, the federal case would go away. There still could be the possibility of some state Attorney general's office taking up this investigation, but at this point it's been solely handled. By the U. S attorney's office, and the pardon would essentially end the case in its tracks. From that case in 2021, President Trump faces a number of legal threats that could heat up once he leaves office and loses the protections of the presidency. But is it highly unlikely that a criminal case against him will be ready to go to trial in 2021? It's obviously a great deal of uncertainty about any possible criminal charges that may be brought against President Trump once he leaves office. The most active investigations of which we are aware are the Manhattan district attorney's office. And in New York attorney general's office. But it's highly unlikely that any of those cases if, in fact they materialize into actual criminal charges would happen in 2021. The one trial we may be in 2021 involving President Trump is the defamation lawsuit brought by New York advice columnist Jean Carroll. Where he accused President Trump of lying When T accused of raping her in the 19 nineties. President Trump has said that he has the absolute right to pardon himself if he does pardon himself will that face legal challenges. That would only pertain to any potential federal charges being brought against him. And at this point, there's no indication that a Biden Department of Justice would actually pursue criminal charges against President Trump once he leaves office. Pardon will not have any impact on the ongoing investigation by the New York district attorney or the New York attorney general's office. So while the part would be highly controversial and may be litigated always after the Supreme Court as a practical matter, it won't likely affect any cases that could actually be brought against the president. Since those Would likely be today charges and a presidential pardon cannot absolve somebody from state criminal liability. Thanks, Bob. That's Robert Man's apartment, A Carter in English coming up next on the Bloomberg long Show. Kind of lawsuit You may not have heard of. "Humane society of the United States and Maddie's Fund, the weekend forecast from K to just minutes from now at the bottom of the hour. Newsradio eleven ninety six. Okay. I just got a couple of emails here. And and it's from people who want to know if I ever found a way to fix the charging problem. I have on my apple watch series fours. Answer is no very briefly for some reason, but I have to apple watches, and they both lose charge when I put them on the charger. I have to shut them down before charging them every time if I don't. What did on the charger with the forty percent left and in five minutes, it'll be down to thirty five percents. So we got hold apple, and they started asking me to collect logs. And after about a month, they asked for a third collection of logs which had it was impossible to do. It was just. This is the kind of stuff that you would expect their engineers to be doing in the lab. And here, I am a consumer. It was such things as okay what we need you to do is put your watch next to the phone. And then I need you to put both the digital crown the button end for two seconds. And then go to the phone and immediately do the same thing on the phone, then put the watch on the charger for ten minutes. Take it off after ten minutes go through the button push again that will trigger the logs then connect the phone to I tunes. So that the log will automatically downloaded and send it to us. So what the hell can you just give me a wild? Guess why this might be happy? Anyway, it's been how long's it been months? How many three months now? Was before Christmas the Christmas. So I've got I've got two series for which I happen to love, but they will not charge on the charger, and I periodically. I get requests from people in the audience wanting an has ever been fixed.
