So it's good when Republicans react to the base and like I said in this case, parents, you have Republicans in some cases reacting to the demands of parents, which is good, but the problem is that when you don't get follow through, and so operation load star is a great example of this Abbott decided that he was going to build the wall in Texas on his own because his opponents like Don huffines and Allen west suggested that if elected, they would do that. And I mean, it's documented that Abbott never thought about this or talked about it until his opponent said they would do that. But the problem was that it was so like it was so political. It was so theatrical that when Abbott did it, it was totally haphazard and in some ways it backfired. Like in some ways, operation lone star actually made the problem of illegal immigration worse in Texas. And so what I'm getting at with these parent movements is that I hope that that's not the case. I hope that when Republicans react to parents that it's actually, it's actually going to yield some good.

You probably didn't get far enough away from the news to miss what's going on in texas. That's definitely true so before we dive into the latest developments. Can you give us all a little background on how we got here. Yes definitely so back in. May texas governor greg. Abbott signed sp eight a law that effectively banned abortions in the state after the six th week of pregnancy shurmur of. You have heard this by now. But in many cases that is before people even realize that they're pregnant and if they have figured out it gives them very little time to do anything about it but the texas law doesn't stop there aside from banning abortions after six weeks with no exceptions for rape or incest. This law also encourages private citizens to sue. Basically anyone who is involved in helping a patient receive abortion care. He's and how our legal scholars themselves viewing aliveness basically encourages vigilante justice. Yeah so for that. We spoke to leah lipman. She is an assistant. Professor of law at the university of michigan and a co host of strict scrutiny. A podcast about the supreme court. She was so helpful in explaining all of this but especially why that vigilante justice component is actually a critical part of how this law is designed so usually when the state prohibit certain conduct saying prohibiting abortions on people more than six weeks after their last period some state official will be charged with enforcing that law suit the texas law by contrast says no state or local official will enforce the law. Only private citizens can if this law allowed state or local prosecutor to bring a lawsuit against an abortion provider. There's no question. No question that a court would have prevented the state from enforcing it. And all the plaintiff would have had to do is named the state official charged with bringing that lawsuit and enforcing the law but texas new will. Let's create enough uncertainty to make it difficult for plaintiffs to identify the right defendant and to give courts essentially an excuse to say. We don't know whether this lawsuit is proper and that would give them an excuse to allow the law to go into effect award yet like evil masterminds But the law took effect on wednesday of last week after the. Us supreme court went against precedent and refuse to block it right and also spoke about what this actually means for roe. V wade and abortion access. Broadly in the us. This is the five alarm fire drill that people were worried about it. Ultimately doesn't matter whether the supreme court issues an opinion that says roe versus wade is overruled or not as a result of their decision. Abortion providers in texas are not performing abortions on people more than six weeks after their last period whether or not the supreme court says row is overruled or not. That's functionally ends almost ninety percent of abortion access in the state of texas so yes. This is absolutely making row practically inaccessible for people in texas. Who can't afford to leave state. Yeah and people across. The country have been responding appropriately. They have been protesting in front of the supreme court. They have spammed the anonymous tip. Line the site. That was actually set up for these anonymous. Tips has been removed from the internet twice so far and it is not just people on the internet who are fighting back. President biden spoke out forcefully against this law on thursday after the supreme court decision an earlier this week the justice department said that they will continue to protect women who are seeking abortions in texas. And that they will provide support from federal law enforcement when an abortion clinic or reproductive health centers under attack. I should add that it's unclear. How much power. The doj will ultimately have with this based on how the supreme court has positioned itself on this issue right and this is already having huge implications in texas itself but texas is also kicking off this trend for other states trying to pass legislation or restructure legislation that is similarly-worded and structure to the texas bill. Here's the allotment again. Florida has already reportedly been considering a law similar to texas's and i would not be surprised if other states do as well given that the supreme court has effectively told them if you regulate abortion providers this way. We'll let you do it. Yeah it's really terrifying to take in and an extreme contrast with what's happening right across the border in mexico so in a country with one of the world's largest catholic populations abortions were just decriminalize yesterday. They're moving in a really different direction than we seem to be. And that's not a good thing for us and leo whitman. Says she only sees two scenarios where the texas law is struck down. One is if an abortion provider is charged according to this law but sues and the case makes its way of the us supreme court. But she said that that's unlikely since providers have stop providing abortions to people more than six weeks after the last period and second if opponents of the law. Were able to name the right defendants in a case but whitman says here. It's unclear if the supreme court would agree with the lower court's decisions so it looks like this case is not going to result in this law being taken off the books and this law not being able to be enforced and also unlikely that there will be actual cases that would allow abortion providers to challenge this law if and when they are sued. So those don't seem to be realistic options. That is tough to sit with. Yeah and i know antiabortion law isn't the only big news out of texas. This also happened in texas yesterday. Integrity is now law. Yeah okay. That was abbot again. Signing this voting restriction. Bill that we've been talking about it is known as sp one and that is formerly now laws. He said this comes after the much followed efforts by democrats in the state to prevent this very scenario from happening including as listeners will likely remember a group actually fleeing the state at one point and this law takes effect three months after the special legislative session that just ended i e in time for twenty twenty two primary elections crag abbott back. Toback awful awful job. Let's remind people once again. What this law actually does because it is wild. Yeah it's a lot of things but highlight once more it bans twenty four hour voting drive thru voting which is largely aimed at harris county. Where houston is those options. Were quite popular in the last election given the pandemic among other things trying to keep people safe there are more onerous vote by mail. Id mandates and it is now a literal felony for a local election officials to give out unsolicited applications. Just the applications for mail in ballots. The new law also allows the free movement of a partisan poll-watcher addy polling location short of being able to actually watch a voter cast a ballot. There's also reportedly training for them. Which i guess was negotiated in this bill and the ability for them.

You said that the texas governor governor greg abbott plans on building the border wall by himself. How exactly does the governor go about doing that. So he is planning on picking up where trump left off and the trump administration built about four hundred fifty miles of barrier on the border but most of it was in arizona so abbots looking to finish the wall along the texas border and has so far put down a two hundred and fifty million dollar down. Payment that was drawn from state disaster relief funds. And he's also crowd funded almost another half a million dollars as of june twenty third. But that's still kind of drop in the bucket of what he might need to finish the project and the federal government estimated that it could cost as much as forty six million dollars a mile in some sectors of the border. So it's not really clear at this point where that money's coming from the is is that like a thing you can do can can a state governor just take disaster relief funds and put it towards a vanity project construction project or he probably would like to phrase it a essential Security spending project. Yeah it's not clear whether that's legal under texas state law. He basically declared a disaster for thirty four counties in the state last month Citing a recent increase in unauthorized immigration at the border and that freed up resources to deal with the problem and also allowed him to suspend any state laws and regulations. That would stand in the way. But as i mentioned before it's not really clear that the current levels of unauthorized immigration actually constitute a disaster as it's defined legally fair assuming he does raise enough money and doesn't run into legal challenges for using emergency funds for this which who knows but where where exactly in texas would this wall go. Yeah so this is going to be another challenge for abbott. We have an obligation to take care of this land in my family since seventeen fifty. It's in our dna. He basically needs the consent of private landowners on the border to build the wall on. What is currently there. Property hundred without a retired Officer now turn farmer rancher missile. Say molest name as we're standing on the united states. The landlord that you see is mexico and these landowners have already fought. Both the trump and biden administration the courts to prevent the federal government from seizing their land in order to construct the law army covering news. Already came in. They took their soil samples. Did some survey they did some cleanup. We have not received anything on the governor's office. How would not personally donate any land for that use for any youth. The texas civil rights project which is illegal aid organization is currently representing more than one hundred thirty property owners. That wanna keep their land so it's not clear that that land actually be available for texas to construct its wall. What are these landowners reasons for finding the wall. Do they just not believe in walls. Do they want to keep their property while lists. Yeah so this is texas and the idea of big government. Taking your property isn't all that popular. V sixty five plus acres of family land in mission. Texas sit right on the banks of the rio grande. It's belong to the cavazos family for three generations and it's no secret how they feel about a border wall going up on their property. How would you like somebody government to come to your house and said we're gonna put a gate right writing your house. It's actually been an issue not just in terms of constructing the wall but also It's been an obstacle to various infrastructure and rail construction projects over the years. And you also have to remember that the region of south texas has been really hard hit by both the pandemic and the resulting recession. So voters are more focused on boosting the local economy and resuming cross-border trade which has been a huge source of jobs and economic growth for the region for a long time so if locals aren't crazy about this wall and the governor's probably going to face a lot of challenges using this money to build the wall why bother it seems like state republicans. Aren't really that interested in capitulating to the predominantly hispanic communities along the border where a wall would actually matter to them. It's really much more of a political ploy than an actual project at this point and Much like the other laws we talked about before. This is an attempt to fire up a conservative base before two thousand twenty two and twenty four and we reached out to governor abbott's office for comment and his press secretary said that this wall is not about politics quote. Border security is not a red or blue issue. This is a public safety issue. She went on to say that until the biden administration starts doing their job. Texas is stepping up to secure our southern border and protect texans so clearly. The governor's office saying they don't see this as like some sort of gop ploy. Is this border. Wall going to be popular among texans though. It could work in the way that it did for trump. But it could also backfire. So in two thousand sixteen immigration was seen as an issue that helped mobilize white grievance voters as well as some swing voters in places like michigan wisconsin and pennsylvania and favor of republicans but in twenty two eighteen when trump really focused on the quote unquote invasion of migrant caravans and smugglers. It really didn't help. Republicans case and democrats who focused on healthcare for the most part instead ended up. taking back. forty-one how seats so it's definitely proved a risky strategy for republicans nationally in the past. But if there's a place where that strategy could succeed it's probably texas. You mentioned the texas governor might be gearing up for a presidential run in two thousand twenty four but before he gets there. He has to run for re election in texas next year. And he's going up against what.

All right texas is open one hundred percent and we want to make sure that you have the freedom to go where you want without limits. The texas legislature passed a law. That i'm about to sign that prohibits vaccine passports in texas. No business or government entity can require a person to provide a vaccine passport or any other vaccine information as a condition of receiving any service or entering anyplace. I want to thank the texas legislature for getting this bill to my desk. Vaccine passports are now in the lone star. State love it. Yeah glad we made the choice to move down here to texas to do the high wire in a free state. Plenty of room down here. the water's warm. If you wanna come down from california all the rest of you all my friends still up there. Come on down. Freedom's going to reign supreme here for a long time to come so exciting. Yeah you don't have to worry it anymore clearly. A lot of texans were wearing this thing. That didn't believe in it. So you know we just see this shift the opening of texas. You know no passport. Which is a dream. So it's affecting the people here think it's affecting the psyche. I know mixing masks in the vaccine. But there's some waited all goes together and somehow here in texas people realize this things over and then how long was thinking before. This probably should've never got right in the timing of these of these bills and you know the executive orders as well in florida and texas is super interesting. Because the cdc is granting the cruise line industries a restart and saying that in their guidance that most ninety five percent of people need to be vaccinated the cruise ships are saying you can only do these tests cruises if you're vaccinated but there's a problem in. This is the headline reading. That new texas vaccine passport ban could make carnival cruise vaccine mandate illegal. Uh-huh now let's let's look at what Governor rhonda santa's over in florida. He already had this battle. Because a lot of the top courts for the cruise ships are in florida and this was the headline out of their royal. Caribbean reverses won't require passengers on. Us cruises to be vaccinated and it says here. The about face is an apparent submission to governor rhonda. Santa's who who has insisted that there will be no exception made for cruise companies to a newly pass. Florida law that finds companies five thousand dollars each time they ask a patron to provide proof of vaccination now royal caribbean. Made a press release. So they've kind of given into texas as well so they have texas and florida. They're dealing with with these bills. Their press release says those who are vaccinated or unable to verify. Vaccination will be required to undergo testing follow other protocols which will be announced at a later date so the mandatory vaccination will not be happening Out of those ports. It's important to know that Carnival and royal caribbean represented about almost sixty percent of the entire world worldwide. A cruise line market share. So this is a big chess game going on here. The top four ports in the us are port of miami port canaveral port everglades and port port of galveston. So three in florida. One out of texas there so this is a really really big deal that this jockeying is going on. We're talking big business that won't able to restart unless they came into this and and not allow these vaccine passports but does it really matter because we have a new study. That just came out. And this is the cleveland health clinic and this study a necessity of covid nineteen vaccination in previously infected individuals employees. At the cleveland clinic. Basically this is what it says here. Not one of the thirteen hundred and fifty nine previously infected subjects who remain unvaccinated had a sars kobe to infection over the duration of the study. This study concludes zero. The study concludes individuals. Who have had sars. Kobe to infection are unlikely to benefit from covid nineteen vaccination in vaccines can be safely prioritized to those who have not been infected before. So what's it old town hall has been really screaming a lot about right you cannot just say vaccinated or the only ones allowed what about me. I'm not the vaccine. I'm naturally immune and i. I think they're saying you know at least thirty or forty percent of america's probably naturally immune at this moment so this is huge. And if you're gonna you're gonna even dare to talk about passports. Better include naturally infected people or previously infected and then. This really begs the question. All those people are being told to get the vaccine after they've been infected. I know i know people that told that they had had the previous infection and still got the vaccine because they were told.
