Biden told reporters at the White House today a face to face meeting with Xi is possible during the Asia Pacific Economic Cooperation Forum in mid November. The meeting would be the first between the leaders since they met on the sidelines of the G20 summit in Bali last November. Wall Street is closing higher despite a strong job strategy.

Supreme Court will not hear a challenge to former President Trump's 2024 ballot eligibility. On Monday, the high court rejected the challenge brought by a long shot Republican presidential candidate. It used a post -Civil War provision of the 14th Amendment that barred former members of the Confederacy from holding office. It argued Trump was ineligible to run due to his alleged connection to the January 6th Capitol riot. The White House is pressing Congress to provide more aid to Ukraine. The measure passed 335 to 91 with overwhelming Democratic support as dozens of Republicans voted against it. The bill now goes to the Senate for final approval. Former President Trump could be in New York City on Monday for his civil fraud trial. Trump's lawyers revealed his plans on Friday while discussing another case, a lawsuit against his former lawyer Michael Cohen. Trump was set to undergo a deposition in that case in Florida on Tuesday, but his lawyers asked the court to postpone it so he could get to the New York trial, which opens Monday. Earlier this week, the judge overseeing the New York case ruled that Trump had been overvaluing his properties and was liable for fraud. A Michigan judge is ruling the teen who shot seven people and killed four at Oxford High School in November 2021 can be sentenced to life without parole. Lisa Taylor has more. Judge Kwame Rowe made the announcement Friday morning that Ethan Crumbly has a slim chance of rehabilitation. He said the teen is obsessed with violence even while being held in jail. The hearing and ruling are required as the U .S. Supreme Court ruled that underage defendants could not be given a life without parole sentence without a separate hearing following a conviction. Just one of former President Donald Trump's 18 code defendants in the Georgia election interference case is being jailed. Harrison Floyd was denied bond Friday after being considered a fight risk. Floyd is charged with racketeering conspiracy and influencing a witness. He turned himself in Thursday before Trump but did not have a lawyer reach a bond agreement before he surrendered. Trump may be heading back to Atlanta soon after Thursday's surrender. Unlike his other cases, Fulton County does not arraign a defendant on the same day they're booked and processed at the jail. The arraignment where Trump would enter a plea in a courtroom happens at a later date. Members of the United Auto Workers Union authorized a strike against General Motors, Ford and Stellantis when their current deal expires. Lisa Taylor reports. The union says the final votes are still being counted but so far the average in favor of a strike was 97 % of union members. UAW President Sean Fain continued his campaign to demand a 46 % pay raise over four years, a 32 hour work week and making all supplemental workers full time employees. Fain also claims union employees are suffering while CEOs enjoy double digit pay increases. The UAW is still the oversight of a federal monitor after several weeks.

Justice Department lawyers are pushing for the case to be tried quickly while Trump's defense argues it could take years to review the government's evidence and gather their own. A Texas judge is ruling in favor of a group of women and their doctors who sued the state over its abortion ban. Jim Forbes has the latest. Travis County Judge Jessica Mangrum on Friday temporarily blocked Texas officials from enforcing the state's abortion ban against women who have pregnancy complications. Mangrum also shielded doctors from being prosecuted for performing abortions if they determine the pregnancy poses a risk to the patient's life. A lawsuit against the state was filed earlier this year on behalf of two doctors and 13 patients including a patient who was forced to go full term with a baby that died shortly after birth from a fatal condition. The suspect who turned himself in for the deadly New York City gas station stabbing of a man who was dancing to a Beyonce song has been charged by police. Jacqueline Carl reports.

This is Bloomberg intelligence with Alex Steele and Paul Sweeney on Bloomberg radio. How much is it going to cost to get Elon Musk out of his deal to buy Twitter? It is the question now permeating markets and ten Delaware court actually force Musk into buying Twitter. Well, let's break it down with Matt shenton helm. He's a Bloomberg intelligence litigation analyst. Matt, in a piece that you just did, you give Twitter a 60% chance to win in a court. How does Twitter win in a court? Yeah, so the key argument that Twitter is going to make is that it has a binding contract with Elon Musk for Elon Musk to close on this acquisition at $54 and 20 cents a share. And the real key to the legal argument is that Elon Musk agreed to a provision in that contract that says if either party doesn't comply with the obligations, a court can force it to happen. And so what's going to play out over the next couple of months in Delaware or chance to record is an argument about whether the court will force mister Musk to comply with this promise? If he's forced to comply at what price will he be forced to comply? Yeah, so his bid was at $54 and 20 cents a share. And so literally the only issue teed up in the case is whether he must honor his bid, whether the court will force him to comply with that bid or not. So it's not going to be a question of the court setting a price in between. Now that's the technical legal fights. But that shapes the dynamic for potential settlements. So meaning that Twitter must can take it offline and be like, fine. We won't do 54 20 a share, maybe we'll do 42, I'm making that up. And therefore avoid having to go to court. That's exactly right. So both sides face potential risk, Twitter faces risk that maybe the court won't force Musk to do the deal. Musk forces their faces the risk that the court forces him to do it. And so both sides might look at that and say, hey, maybe we should work something out. And that gets really take two shapes. It could be in the shape of Musk still purchasing the company or it could be in the form of him paying and walking away. If Twitter negotiates with Musk, although there's so much bad blood now, I feel like it'd be hard to sit in those conversations, but let's say they do negotiate a lower price down. Do Twitter shareholders then sue Twitter? Yeah, so that's, I think, a really great question. On Twitter, Twitter's board has an obligation to its shareholders to maximize the value of the shares. And I think that's something that they're going to struggle with as they look at settling this case or resolving it. And so we'll shareholders Sue is probably a different question of whether shareholders would sue and win. And so I think shareholder, I think the board has the ability to contemplate the risk that the $54 and 20 cent bid is facing at this point. There is the real risk. We put it at about 40% that the court won't side with Twitter here and would let Musk walk away paying only $1 billion or maybe nothing. And so I think the board is reasonable in taking into account that risk and then saying, look, maybe a settlement here is in the best interest of shareholders. What is Musk's strongest argument? As I understand it, there's three basic ones. One that he keeps asking for stuff from Twitter and they don't give him the information. To the Twitter like outright didn't tell him the correct information about the bots, three Twitter's done stuff since he said he was going to buy the company that made the company worse, whether it's freezing hiring, laying off people, et cetera. What's the spread am I missing any? And what's the strongest one? I think that lays out the big three that he set out in his letter explaining why he wanted to terminate. In my view, the best argument must have is going is the informational one that Twitter has an obligation to share data with him about the transaction. I'm tied to consummating the transaction. And it failed to do that. And I say it's a better argument forum for a technical legal reason because his second his fallback argument on the bot is the idea that Twitter has been misleading the SEC for years about how many bots there are on the system. That doesn't work for Musk unless it rises to what's known as a material adverse effect, which is really hard to show. Why I say Musk's stronger argument is the data access one is he doesn't have to reach that high bar. He just has to show that Twitter didn't comply with its obligation. It promised to share data and it didn't. And but the problem for Musk, even though I think that's a more winnable argument for Musk. The problem for him is that Twitter's duty to share data isn't unlimited. The contract itself says that Twitter can consider whether sharing that data. One would violate the law or two and I think the more important one would create a competitive threat. Matt, your job is cool. Something that I'm sure maybe you haven't heard, but it is cool.
