You know, you speak to activists and those who say that there are actions he can take and they look to the Environmental Protection Agency. They say that even with the recent Supreme Court ruling, they believe the EPA can start issuing rules saying how much how little carbon emissions can come out of manufacturing plans. He briefed them on the deleted Secret Service text messages from the day of the capitol riot and the day before. The agency had asked for records of electronic communication of that day as part of the continuing investigation on the capitol attack, the January 6th committee will now try to recover and retrieve text messages that were erased by Secret Service on that day. CBS News congressional correspondent Scott McFarland says the Secret Service of the watchdog agency are offering conflicting statements about all this. "This is the first such shooting since Crisis began. And it really ups the kind of sense of insecurity and that the reminder that all of these forces that are based at the airport are surrounded by the Taliban at all times. Jane Ferguson just remarkable reporting. Thank you so much and again, please stay safe. Thank you, Jane. Thank you, Judy. For those Afghans desperate to escape the Taliban. The challenges begin well before they decide to leave their homes. But if they do make it to the airport, the process for leaving the country is full of Logistical and bureaucratic challenges are Lisa Desjardin has been talking to American lawmakers to international nonprofit agency workers to refugees themselves and others. About these shortcomings these challenges and she joins me now. So Lisa, As we said, you've been talking to all these. These folks, you've been talking to people around the country. You shared your notes with this in the middle of the night. In fact, last night, tell us what is happening at this point with with all these efforts to get these Afghans to safety, I've spent days working on this and I have to say it would be an improvement. To call this a bureaucratic nightmare. It's not even clear what the bureaucratic path is. For some of these Afghans, essentially what you have right now is an army, an undesignated volunteer army of NGOs and honestly, thousands of individual Americans who have some clothes or sometimes even not very close relationship with an Afghan family. What is that is pleading for help to try and navigate the path that Jane was reporting for. How do you get that application to the the gate of the Kabul airport? And even what is that worth? So right now, we have is a situation where even congressional offices which we know obviously do have a priority path to the State Department. Even they are having trouble figuring out How can you get any visa? Which kind of visa is working the kinds of documents they're asking for our changing on a regular basis, and we spoke to one of these congressmen represented Mike Gallagher. He's actually a retired Marine intelligence officer, and even he has had trouble getting through the people that he thinks needs to get out. Here's what he said. Shouldn't take having to call a member of Congress, let alone be a member of Congress to get help. I mean, if you're an American, if you're an Afghan that risk you'd like to fight with us. We should be doing everything possible to protect you right now and get you out of the country. And so it's unfortunate we're having to make up a lot of this process on the fly. I think it speaks to the level of planning that did Not occur on the front end, but that's where we are. Now. Some people call this a digital Dunkirk. I think it's actually worse than that. I spoke to one Afghan here who's trying to get his family out. He was a translator for the U. S. He said. When you are drowning, you reach for anything. This is like Afghans drowning in the dark. They don't know if there is a way out there trying to reach for anything they can. So So are they. What would you say is the attitude of the Afghans and they hope able to hold out any hope. Yeah, I've been hearing stories of Afghans who are in hiding in Kabul, not even attempting to get to the airport yet because they're waiting for the paperwork. If it ever comes and they actually do have hope and those here in this country, Afghan refugees do have hope, But I have to say it's difficult for the NGOs and the Americans who are helping them because the Americans aren't so sure that that hope is justified. They're not sure that the paths really exist once the Afghans connect with an American. Oh, I think I have the contact that will get me through that The Americans and even members of Congress are really not so sure. There is one reason to hope. In the last couple of days. The numbers of people getting out of Kabul have increased dramatically. We've seen for the last two days. 10,000 evacuees today 10,000 yesterday. So total. This is unbelievable. Almost 50,000 people have been evacuated by the US in the last week. That is a reason for hope. However, as Jane reports, it's still chaos at the airport in a week to go, and finally Lisa. What about those refugees who are able to get out and some who have already come to the United States? Americans should realize they have come to the United States. There will be a huge need for these refugees as they come, and I want to look at sort of the numbers that we're talking about. Why this is such an issue of proportion. There are 34,500 visas available for special immigrants out of Afghanistan. Many of those have been used. There are still some 14,000 available, but then look at this number. Number of Afghans affiliated with the US in our 20 years, their 300,000. So we're talking about hundreds of thousands of Afghans who may have me how many will come here? We don't know. But we know that now refugee agencies, including one here in the Washington area really need resources. The refugees are coming some with I'd some, not by the way. And I think this is going to be a very long story that we're going to have to pay a lot of attention to. We also need to watch the Department of Defense. There are just discussion of whether the department offense needs to house more of these refugees as they come here, and I'm old enough to remember when all this was happening after Vietnam Vietnamese refugees, the younger one longstanding story that went on for a very long time. "This is one a. I'm chen white in washington. It's the news roundup. It's been a big week for news. Alerts on the west coast drought fires and heat on the east legal rulings from not one but two supreme courts and everywhere else there's the covert nineteen delta variant blazing through america's unvaccinated population. We'll unpack that and a bit more onto the roundup today. We'll kick things off with lisa desjardins. She's a correspondent with the pbs news. Hour lisa it's always great to have you on grades here. So let's start with this latest news out of the supreme court this week. The justices wrapped up their term with a bang. Upholding two pieces of controversial voting rights policy in arizona which piece of arizona legislation were before the court. Lisa there were two. They were both notable one was in arizona law. That makes it a felony to deliver. Someone else's absentee ballot. A lot of folks might be familiar with this practice. Democrats have used it a lot to reach communities that they feel are under served to go out and collect those absentee ballots. Get them turn them in. Arizona outlawed that and that is that was a question that democrats said was discriminatory because especially minorities we know minority community marginalized communities have harder time getting their absentee ballots and in particular arizona. Where a very large amount of native american population lives without access to mailbox so democrats said this was discriminatory to ban this practice. The other provisions there was about provisional ballots for voters who cast their ballot in the wrong precinct. Arizona's law throughout those ballots and again democrats said that was discriminatory. We do know from research that this is another situation where voters of color generally are affected more than anyone else. They are the ones who vote in the incorrect precinct. More often than any other. And that i saw you mentioned isn't it's up. How to only allow voters. their family. members were their caregivers to collect or deliver completed ballot. How did the verdict shakeout which justices ruled which way this year. We had such an interesting few weeks where there were some un predictable splits in the court. This was the ideological split that i think. Many of us had been expecting six three with the conservatives voting to uphold arizona's law and the liberals railing against it. I have to say reading the responses. The opinion and also the descent in this case. I have rarely seen opinions. That have attacked one another so openly. This was a case where the justices felt very strongly. Elena kagan wrote that. This really was a very dangerous. Potential dismantling of the voting rights act but justice alito wrote. That he felt that this the arizona laws were not enacted with a racially discriminatory purpose. But one of the questions here does is the purpose enough or is it the outcome that matters. And that's what kagan was arguing. What does this mean for for similar. Laws restricting voting rights across the country lisa. Because we've seen these these laws pop up in several states universally democrats and and republicans believed that this means that republicans who want to enact more voting restrictions. We'll have an stronger footing with the supreme court that this raises the bar now. It doesn't eliminate any potential kind of suits over discriminatory practices here but it raises the bar to be much higher than it was before that it's it's not just enough to show that there is some discrimination happening but you have to also show the intent and you have to essentially prove more than you had before that has to be a law almost enacted specifically a to discriminate and and that is what democrats say is dangerous here and i think that democrats now have some soul-searching to do about how they react. This is a kind of case that could affect even the discussion in the senate over the filibuster and if they need to pass voting rights legislation to do it they have to break the filibuster and this case pushes Kind of those tensions very high. And what does this mean for the voting rights. Act as a whole. Well you know. The voting act voting rights act stands. But there there. I think we will see a very large discussion over how to change it. And there is of course. The democrats in the house have passed. Hr one that the for the people act that is a very large act but it does not stand any chance on the senate right now. So they're trying to pass the john lewis of voting rights act which is smaller but still would essentially Tell states that they need to be. They need to get pre clearance. In order to pass any kind of law that is seen as discriminatory it would give the federal government more power to rail in states in this area but but right now. The supreme court is giving the power to the states. And what other cases did the court make decisions about this week. That really stood out to you. Well i think the other one that we got was that was so significant was a case from americans for prosperity versus essentially california. This was about dark money. Americans for prosperity. A lot of folks. No is a coke. Brothers related organization conservative organization. The question here was whether california could force them to reveal their largest donors names to the state and this is sort of one of the final cases about after citizens united where citizens united declared that donors could donors had certain rights in terms of funding but disclosure was allowed this ruling again six three the conservatives ruling in favor of americans for prosperity declared that in fact california could not force that disclosure by donors does a very huge defeat for democrats specifically a win for conservatives and mitch mcconnell who want to see anonymous donations in large amounts to groups like americans for prosperity that are technically nonprofits. And i wanna say one thing. That's interesting to me. Is that the court. In that case chief justice roberts wrote the opinion stress that the reason they felt that this should stand that the donors should not have to be disclosed is that it was a chilling effect on the honest. Freedom of association is so interesting to me that in that case the conservative court kind of opened up their assessment of chilling effect to benefit the americans for prosperity versus in the voting rights law. They went the other direction right. They decided that no they weren't worried..

But he criticized Democrats and President Biden for insisting that the bipartisan deal be passed along with A Democrat backed reconciliation bill. Less than two hours after publicly commending Our colleagues. And actually endorsing. The bipartisan agreement. The president took the extraordinary step up. Of threatening to veto it. But a real assessment of whether it can get the 60 votes to pass is unlikely until after the Senate returns from a two week recess that begins tomorrow. And Jimmy joins us now from the White House, along with Lisa Desjardin, back at the Capitol and Lisa to you first. We know senators who were part of this has spent many weeks trying to come up with this. Deal. Give us some of the details of what exactly is in here. Judy. This is a huge moment. Now. This bill does have a long road ahead. This hasn't crossed the finish line yet. But this is a very big victory for bipartisanship in an age of divide, And also this would be if it goes through the largest single transportation bill in American history. So let's talk about what's in it really quickly a lot at the top. Some of the biggest categories roads and bridges over $100 billion for those another 100 billion. And plus for rails and public transportation. Now, there is also in this bill a number of categories on climate and it depends on how you add up the math, but it's between 15 million and 60 billion. That's everything from electric vehicle charging stations to mitigations for our coastlines dealing with ecosystems addressing the effects already of climate change. And then finally, one thing I want to highlight $55 billion for clean water and pipes. That's for things like changing out lead pipes that are still in so many parts of America. Judy I could go on and on. This bill has a lot of money for the power grid for airports for our ports at seat for ferries for broadband. It is a massive bill and Lisa you as you and others are pointing out. It is not as much as the president. Originally wanted, but there's still a lot of money in here. How are they going to pay for it? This was the toughest part of reaching this point in the deal, and I have to tell you we just got the official release from senators laid out how they pay for it, Judy. There are no dollar figures next to the categories. Fortunately, I was able to get a copy of what the dollar figures were from one of the Senate from a senator who saw that and some of the biggest pay fors are things like taking unspent covid money and using the That also changing at how the IRS operates helping boost the IRAs so it could collect more taxes enforced Basically the law on tax.

"Received a threat against my life. My received over other threats against my safety. My address a picture of my home or my family lives was posted on kind of an anti dusty Facebook page. These are at the impeachment vote, and they really did believe that a vote for impeachment was something that would could put themselves and their family at personal risk. The same time they all took it seriously as well. On a philosophical level. This was a political and personal, very difficult decision. For many of them. It has been a difficult mood here today at the Capitol sad Also some fear, but I do want to point out one bright spot. Just a few minutes ago, House Speaker Nancy Pelosi signed the article of impeachment to get it ready for the Senate. That's not the bright spot, necessarily, but she signed it on. She used the podium. It had been stolen from her from this from the house from her chamber by the rioters that was brought back and she used it as clearly a statement that the house is back in full operation. Really interesting and good to see that that was received that it was returned to the capital. And Lisa. Finally, what about the Senate? This does now go to the Senate? What do we know about what happened there so much to stay Many fascinating developments there, Judy today. Senate Republican leader Mitch McConnell said he is open to impeachment, but he has not decided for it. Yet. He also let it be known that he does not. He will not sign on to a fast trial, meaning the soonest the trial could happen in the Senate is after the Senate reconvenes that next date is January 19th the day before inauguration. McConnell and his staff. Those around him are making it clear that he does not think it is all on doll conducive to governing to have impeachment go on before inauguration that he wants to try and have a stable transition of power and that an impeachment before President elect Biden takes office would not be helpful to that. So it's now clear that the Senate will move forward with the trial after President elect Biden takes office and we know several Senate Republicans are undecided, among them, Pat Toomey of Pennsylvania and another question to be resolved. Can you There will be a debate. Can you impeach a president after he has left office? There is some precedent, but there will be debate. Seems like a lot is unclear about where this goes from here on, But Lisa Desjardin reporting on it all. Thank you, Lisa. And now we go to Ru Miche Al sender. So you meet President Trump becomes the first president in American history to be impeached twice. What do we know about how he is reacting to this? President Trump is furious at the idea that his marred legacy became even more tartness day as he became the first president to be impeached twice. The president spent much of the day watching TV watching the impeachment vote in debate play out on TV. The president in some ways was really lashing out at people because what he saw where Republicans saying that he betrayed his oath of office, of course, along with Democrats, saying that he Is a walking impeachment a fence. The president also just of you know, the last few seconds released a five minute video where he says that no supporter of his would be involved in any sort of violence or any sort of attacks on law enforcement. He also says that he's very worried about this free speech issue, saying that there are attempts to cancel people and to try to unfairly target people for spree speech. It was some defenders of the president. We're talking about free speech. But I have to tell you he is talking about a small group of people defending him because the number of people that I talked to today, they say, even if this is about free speech, they still believe that the president should not have said what he said. And yamiche picking up on that. What do we know about how the president would deal with a Senate trial is Lisa just reported? It's not clear that they will be one if if it happens after he leaves office, But what are they thinking? What are they planning? I spoke to a number of legal experts today, including a lawyer for President Trump, and it's clear that he's gonna have some real problems. Recruiting lawyers. Alan Dershowitz, who at one point was one of the lead attorneys during the first impeachment, told me that President Trump had the right to say what he said, but that it was not right for him to say what he said There are a number of other attorneys who are not going to be part of this defense, including J Secolo. The White House counsel packed a bologna. Alan Dershowitz also told me he's not gonna be part of this defense. The only person we think of right now, who's going to be part of that defense, for sure is very Giuliani, the president's personal attorney who has at times spread false information, so we have to see where this goes. The defense, though, will be about free speech. They will also be arguing that this is a political hack job in a witch hunt against the president, which is what he said today in that video that he referenced in that he released today. "I used to be a reporter on the hill and I can tell you on most days, the U. S Capitol is this buzzing hive of activity, lawmakers and their aides whizzing through the halls, rivers of tourists flowing through the rotunda. And journalists zigzagging through all of this traffic, trying to cover the news of the day, But on Wednesday, it was a scene of an insurrection. We wanted to get an insider's view of that extraordinary day and how it may reshape day to day life inside the Capitol going forward. And to do that, we reached out to two reporters who were in the capital Wednesday and who are both intimately familiar with the building. And the people who inhabited Lisa Desjardin of the PBS news hour and politicos, Sarah Ferris. It is so good to be talking to both of you. And I'm so glad that you're safe. Thank you for having us also, thanks for having us, So I just want to start by asking you to share what it was like for you personally. On Wednesday at what point did you realize That things had spun out of control. I don't know about Sarah. It happened really fast. We had the House office building across the street from the capital. The Cannon office building went on lockdown because of a breach. And I remember asking Capitol police outside the House chamber about that. And the police doing outside the chamber did not know about it. And it was not long after that, that I went to the Middle of the capital. Just around the corner from that same spot and I saw the protesters. The whole mob crushed up against the front door of the capital. And it was such a disconnect, and that was when I knew We've never seen anything like this before. Sarah, How about you? So I, too, was on the house side a little bit different place than release the wise. We were up in the House Daily Gallery, which is on the third floor right above where the chamber is. And some of the gallery staff who are there. They're amazing. They're so calm all the time, and he's running around and he's telling us we're getting. You know initial signals. We might have to shelter in place. If that happens, we're going into the chamber. Then all of a sudden, it's like, OK, get anything you want to take with you. We're going into the chamber and we're locking the doors and there's no police nearby. This is all the house gallery staff that have to do this and we were cramming. We are just Into the chamber. We don't know what's happening. You know, I took my computer. I left car keys I loved, you know, I just got a cup of coffee. My heart started to pound even thinking about it again. So was there a moment that you think it's just going to stay with you for the rest of your life? Like a particular interaction, a scene or even a sound? I have one. We're up in the House chamber. I'm crouched at the very bottom of the gallery upstairs behind this little wall in front of me. There's three members of the Congressional Black Caucus. Lisa Blunt, Rochester from Delaware is just saying this prayer. God help us. She's clutching hands with two other members. And that was it for me. That was when I have never felt that that scared and not because because because they were scared. I couldn't look at anything else. That was problem. There's probably a lot of stuff happening on the floor, you know, And that was when they were trying to keep them from blocking the from getting in through the chamber door, which was just right. I could see it right right in front of us, but I couldn't stop watching these members who were praying together. I was on the other side of those locks doors. And this is the first time any of us reporters who see each other all the time every day or even being able to compare notes. You know, after I saw the door front door being breached, I'm going to always remember. I interviewed a couple of the rioters as they came in, which is also a way to try and keep yourself safe. They were just so casual about the whole thing, you know, And in fact, some of them were even asking. They were looking for a bathroom, some of them at that point, Then the numbers grew. And I think the bigger moment I'll always remember is when I watched from that location back toward The House chamber. And, you know, I put my hand on my I d badge because I knew that there are four police posts, right? They're usually at least four police officers outside the chamber. And I wanted to have my badge ready so that they knew I was a reporter and I walk there with the riders behind me coming behind me. And there's no police there. And then I realized the doors all around me are locked and that the offices are on lockdown. And you know, it was just me and them for quite a while. There is one more moment from Wednesday that I want to ask you about that night just as soon as the mob have been cleared from the building. Congress reconvened to finish certifying President elect Biden's victory. And both of you as well as ah, many, many of your colleagues went back to work. Tell me how did that feel to go back to work on the same day that all of this happened? You know, I know. Members of Congress were defiant and they wanted to get back and send a message and I felt the same way. I felt like I really do want to get back to the business of governing and showing that America is transparent, and it's a place where the press can report on what it's government does, and You know, that may have been just me trying to like, you know, feel better about really bad day, but I felt so good when I could walk back into the chamber. It was almost like I was physically felt like I was hugging a friend I hadn't seen in a long time after we both in through something I felt that way about the chamber itself and about Finishing the election. So both of you have covered Congress for so long, And I'm just curious how Wednesday fits into the larger story of this Congress. Well, it's interesting. This is Sarah. It's interesting because this is the first week of a new Congress. And it comes after maybe the most chaotic last Congress, the entire 116th Congress, beginning with the shutdown, nearly ending with a shutdown everything in between the impeachment You know, this was many people expected 117th Congress to be the fresh start. You know Joe Biden would be coming in in two weeks. Even Republicans were tired of answering questions about President Trump's behaviors over these last four years and into a lot of people. This was supposed to be a fresh start. There was supposed to be the spirit of bipartisanship. And you know nobody expected so many different kinds of questions and this shadow to hang over the 117th Congress in the way that it now will for the next two years. You know, it's Lisa. I'm I'm really concerned, and I think The reason why is what happened after we got back in the House chamber for the joint session late into the night overnight, there was actually a moment where Democratic representative said something that Republicans didn't like, and they objected to it on the floor. And this led to a shouting match between the two sides..

But the most Uh, newsworthy was his calling on President Trump to go on national television and urged his supporters to leave the capital. We know that there were reports before Biden spoke. From other news organizations that President Trump had been asked by Republican leaders as well as Democratic leaders to urge people to leave the capital he was refusing to do he was refusing Go on television to do that. "Look at all these other immigrants. These all these people are like this man, who's a murderous dangerous person. And people are saying that that stereotypical and really that. It's that it's something that's unacceptable. And that's pretty remarkable for the president of the United States to be told that your ad cannot be run on major networks. Add to that the fact that there are people who are looking at President Trump, and you're saying that he is his rhetoric has really been unhelpful in forging racial divisions. Here this morning. The president was on a call with two hundred thousand supporters, and he's sounding a bit fearful of what could be coming tomorrow. He was saying that he does not really he doesn't really want to talk about the house in the Senate. He feels good about. But he said, I don't want this to be a referendum on my presidency while at the same time contradicting himself saying that if Republicans do pull this off any do keep control of the house and the Senate, I should Republicans. Feel good about my presidency. So this is a president who is being one on a lot of people see as racially divisive. But also someone who's a little bit nervous for what's going to come tomorrow. So Lisa you've got a number of Democrats out there in swing districts. How are they looking at this ad if this message of divisiveness and some say racism the truth is this immigration taxes? The president's puts both parties in a tricky position because he started it so late that they're not able to get pole as to how it's affecting their voters. There are some Republicans who hope that it does get out their base. It's obviously something that help the president get elected. But Judy I talked to one Republican campaign in a swing congressional district. They are very concerned that this is going to hit those swing districts, especially those ones that have newer representatives and have increasing minority populations about the state like California where there right now are six to seven seats in play. Democrats also have that hope and they're thinking about Senate seats like era. Zona Nevada, Texas where we've seen record early voting turnout. They think this could bring out even more say Hispanic population that they believe will vote their way, but the truth is they don't know yet. And when you look at both the house and the Senate that's also the case that it's not clear yet that for sure the Democrats will take over the house both parties think that's likely, but the Senate right now, it's still very unclear.
