"Hey, mardi gras. Good day at the barrage of store really has been cool. Appreciate everybody here. People somebody say, hi. Very very nice. Drove it all the way out here to give me a hug and a Christmas card. Very nice. The coolest guy brought me a bunch of pastries and said, I know you can't eat them. But here very funny. They wanna read something because we're talking about. Pittsburgh city council. We're talking about lawsuits, and we're talking about what this is going to lead to today. They're discussing gun control. They want to ban assault weapons and armor piercing bullets. All this stuff. They have no authority to do. They just this isn't a political statement and making it's just the truth. And they know this. I think. If you talk to them, and I have a big just want to run. Right. It out take this through the legal process. Make enough noise, and hopefully people will pay attention to actually get legal standing from someone in Harrisburg. Actually, make a difference. Well, as long as it doesn't cost taxpayers several hundred thousand dollars in legal fees and frivolous lawsuits. So. This is the Wall Street Journal, fantastic them. It's called Jesus and the judiciary. All right. Have you eaten a cheese at some time in the past eight years, my kids love cheese, its if so as they say on TV call now because you may be entitled to compensation. This is real. Three women in federal court are suing Kellogg's the manufacturer of cheeses over crackers labeled whole grain or made with whole grain. This is all fact as the box explains they contain five to eight grams of whole grain for each twenty nine gram serving. That isn't nothing but the package lists enrich. Flour meaning process flower as the largest ingredient the plaintiffs the women's suing feel deceived. This kills me. One of them Linda castle purchased the crackers approximately three times a two thousand thirteen from a grocer in California. She apparently wanted something closer to one hundred percent, whole grains, but didn't read the label the cheese at whole grain crackers mis- mis- castle received were worth less than the crackers for which she pay. The lawsuit says MS castle was injured in fact and lost money. Strangely. If the package were changed. She would continue to purchase the products in the future. This is amazing. Mrs castle and other plaintiffs so used to buy cheeses once a week or seeking damages. Monetarily declaratory relief an order enjoining Kellogg from continuing its false and misleading marketing they demand a jury trial. I'm reading this forbade them. The judge dismissed the whole case in seventeen ruling that the whole grains wording was factually, correct. The label would neither mislead or deceive a reasonable consumer. But there's more last week the US court of appeals for the second circuit reversed the dismissal a three judge panel held that a reasonable consumer would think cheese whole grain crackers. We're made with predominantly whole grain additional verbiage on the front inside of the package is no defense the court system. About this. Have you seen the cheeses? It completely lays out everything. That's in there. I mean down to the every single ingredient. Oh, you have to do is read it. Wow. Thus America's reasonable consumer is held to be dumber than a box of cracks. The second circuit remanded the case for further proceedings. Putting the federal judiciary one step closer to legal discovery. And possible jury trial on the content of cheeses. The plaintiffs what the court they're classify. Consisting of anyone wanna class? This would be a class action. Anyone out there is eating cheeses. The crackers since may of two thousand ten. That's thousands possibly millions of people clean my entire family. Nearly all much the way happy without formal complaint. When people sometimes ask if the American legal system has lost its mind. This is what they're referring to spot on that. That's unimaginable. To me. This is where we have dummied down anyone that wants to listen anybody who wants to sue anybody on a whim. They just want money than what the label changed. So they changed the label the week the same crackers. And how could a judge? Declare this a class. How could this be a class action lawsuit? We the ingredients are as clear as day. And by the way. For the woman that the purchase them several times at eight them. How was she damaged? Mark says oh my gosh. If those people when they were putting on the Ritz, thanks, Mark. It's just what I needed. That's hilarious. Get it putting on the Ritz. By the way, I want to continue this conversation about the goodwill in the good faith in the community. I always like to leave you on a high note. So I'm headed here to mckeesport to the Erste house. And this is this couple were. Nick Erste has contracted muscle Flavio Oma, which the cancer you get from a specis volunteered at nine eleven when the buildings came down in New York and they went through the rubble. And he and hills especially in his now is deadly missiles, and we are refurbishing a house for. In mckeesport, and I'm headed out there today because they're getting a new roof. I just talked this morning to a. A guy owns a big home remodeling company. He's going to do the. Kitchen guys going to do all the interior walls. All I wanna see us. Thank you. Congratulate the magnificent of strangers out there. Because I think we could caught up in the world today at the world James that everybody's angry that there's too much hate. But if you really get out there, and you meet regular folks, those great, and I see it every single day. I really really do. Hey, folks, Manila's Canada's next. We'll be right back..

"Put your product on a good car? Even if it means paying a little bit more. It's just so rare nowadays for any kind of big time team to just simply take the money and not really care about what the driver drivers coming along with it. But in this case, it seems like maybe they are. But who knows maybe it'll work out. Maybe maybe it will. I don't. Dumber things have happened. Yeah. Eric Merola finishing. Exactly, exactly. Well, and then you know, the same is kind of true this guy. We're going to talk about now. Ross Chastain now Chastain had the watermelon sponsorship because his family is involved in the watermelon industry. And so, yeah, I'm sure he bought himself a couple of rides. But now all the sudden he gets fulltime opportunity with Ganassi's xfinity series for two thousand nineteen because they gave him a couple of races. And he made the most of that opportunity by getting a win. So solar is going to sponsor the car. So that that steel of sponsor is successful and complete for. Asi who knows if that lawsuits still going on? And now, we're Chesini it's going to get a fulltime opportunity. I think that's an awesome thing. I think it's a great deal. That's a great deal for him. And I mean, he's shown in his time with gase in the series of he can run that car. Very very well. Yeah. So I think it was like a twelve a first and second down this three races. And that's pretty damn good. If you say, so if I say, so myself, so. I did opportunity for him, especially depending on what happens with that number one car because we don't know what the hell's going on with that. Yeah. We don't have an announcement yet. But even if we well, we'll talk about that in just a second when we get down to Kurt Busch William Byron like you mentioned in the first half of the show. He is the two thousand eighteen Cup series rookie of the year by virtue of his top ten finish last weekend at home or Phoenix rather. He's had four top ten finishes all year, including the Phoenix finish his best Pocono. He's twenty third in the points. Yeah. He wins the rookie of the air. But does it really feel like he won rookie of the year is a two horse race? Yeah. Honestly like I'm a two race. And one of them was saddled with a richer, Betty car one of them had a second place finish and that was their highlight. Yeah. I mean the first race of the air. Right. Exactly. I'm trying to think if there was a time. Gimme gimme gimme gimme a good year. Oh, the twenty. This is probably the worst classes twenty ten while really twenty ten can can you name the twenty ten without looking up man twenty ten rookie of the year or any of the candidates that would have been. Cole. Cole whitt coal. So sorry, man. Okay. Wait. Parker clear. Mun clear men. Give me man, I wanna lamb on me. So the the runners up were Terry cook God who didn't make the the minimum amount of acquired starts, even guests. I wouldn't even thought of Terry Cooke, the guessing didn't make a minimum of five starts if you would ask me was Terry Cooke NASCAR driver. I would been like, I don't know who. Then lending castle was a runner up. Okay. All right or didn't declare but ran more than five eligible races. I would've eventually gotten around the Linda castle eventually the winner. As we all know. Kevin Conway oh God. I wouldn't have gotten to Kevin Conway, though, the man who sued that's team because they stole the money from his penis drug. Extends. Actually was sued by front remover sports for lack of payment. So that's why. Man. Kevin conway. Then he goes to Robby Gordon motorsports. Oh, I do..
