Hello everybody. Welcome to our viewers in the United States and around the world. We begin this morning with breaking news overnight in Chicago, where the third largest public school system in the country has followed through on its promise to cancel all classes today after the teachers union voted to refuse to show up for work in person. Teacher said they were concerned about a lack of lack of safety measures. They wanted to go online. But now, with no remote learning, hundreds of thousands of children are caught in the middle, just hours after President Biden said this. We provided the states with a 130 billion with a B, $1 billion to specifically keeps our students safe and schools open. Funding for ventilation, ventilation systems in the schools. Social distancing classrooms, even larger classrooms. On buses and everything from bus drivers to buses. So I encourage the states that school district to use the funding that you still have to protect your children and keep the schools open. Chicago had actually resumed in person classes on Monday in school officials insists that conditions are safe for in person learning in class, but this standoff could last for weeks. CNN's Omar Jimenez starts us off from Chicago. Well, this vote from the Chicago teachers union triggers a cancellation of class, which is what the school district warned would happen if this vote went through. In total, 73% of the rank and file members of the Chicago teachers union voted in favor of this in response, the school district called this an unfortunate decision and said they now worry about the well-being of the students. They also said teachers will not be compensated for this. Now part of what the Chicago teachers union has been so concerned with is they don't believe the current measures in place make it safe enough for students and staff to be in person, especially amid record COVID-19 case numbers among students, staff members, and the city of Chicago over recent weeks. The school district, however, has maintained that class in person is safe saying that there is no evidence of widespread transmission and the school's CEO, Pedro Martinez, arguing that this current tactic of negotiation isn't practical. And I have been very, very clear that it is not practical to have a district wide decision when there is such a variance across our city of how COVID is affecting us. It feels like Groundhog Day. CT leadership is compelling its membership to make a decision that will harm hundreds of thousands of Chicago families who rely upon CPS for their daily needs. For their education, for their nutrition, for their safety. That's real harm. Now, part of what the district has proposed includes school level metrics on when to move to remote learning. For example, when 50% of the student population has to either isolate or quarantine. Moving forward, the teachers union has indicated that this push to refuse in person instruction isn't just for today, but goes until at least January 18th or until both sides can reach an agreement on what safe in person learning looks like. Laura, Christine. All right, Omar in Chicago. So all this leaves parents, their employers, and of course the children in a really tough spot. Child mental health experts say uncertainty at school creates stress that's a cause for concern. They are feeling increasing anxiety around just how to be in communicate with people and build friendships and being able to feel comfortable in their environment. My 12 year old they still act so young, they're more like elementary school kids, their world was turned upside down. As adults, we are able to bounce back quicker, usually, faster, but for them, you know, it's going to take a little more time. This unpredictable school situation also leaves parents in limbo, yet again. The lack of understanding that we now have children and families in the crossfire of this gigantic mess that is kind of late in our laps because we have had a failure to plan for this moment, knowing that we were going to have a winter break, knowing that we were going to have a COVID spike. I mean, all of this is really being left on the shoulders of American families who are also hold trying to hold up the American economy at the same time. So only adding to the school problem, finding enough drivers to get schools there, the situation is so desperate that Biden administration now allowing states to temporarily waive some testing requirements for school bus drivers. Get this. The part of the test that asks drivers to identify under the hood engine components, that can now be waived until the end of March. It seems like a pretty a pretty good move. In August, many school districts offered cash bonuses for drivers as well. And more issues on the COVID testing front, the popular binax now rapid tests. Well, they're getting more expensive. Walmart and Kroger are raising prices on those test kits after an agreement with The White House to sell them at cost, expired last month. Health experts say these tests need to be inexpensive to encourage people to actually use them regularly. President Biden says the new rule requiring private insurance companies to reimburse people for rapid tests will go into effect next week. Officials say you will have to file a claim to be reimbursed though. All right, I do not see January 6th

Lawrence Brooks was drafted into the army at age 31 in the mostly African American 91st engineer battalion stationed in New Guinea and the Philippines after the war. "Just days after taking office, the new Manhattan DA, Alvin Bragg says he won't go after lesser offenses. Things like prostitution and resisting arrest for certain crimes. He says he believes that the decision will make the city safer and the criminal justice system more fair. However, he has been met by major backlash as naysayers from the police union to Manhattan shopkeepers argue that the new policy is actually going to invite more crime. Let's talk about this now with CNN correspondent lira Laura Jarrett. Laura just walk us through specifically the crimes that we're talking about that he's not going to be going after. Yeah, guys, so it's interesting. Alvin Bragg, you might dismiss him as just another progressive prosecutor trying to make big changes in a city. He's come in. This was the progressive platform that he wanted. But he's backing up his ideas with data and essentially trying to strike this balance between fairness and the criminal justice system on the one hand. And this need, this real concern about public safety and he's essentially telling his prosecutors in his office do not get bogged down with low level petty crimes because if you do, then we can not focus on the real serious violent crime that everybody really cares about. So let's take a look at what exactly he's telling his staff. You do not prosecute anymore. Things like marijuana, misdemeanor offenses, failing to pay fines for traffic violations. Most trespassing crimes not talking about stocking, but lower level trespassing, resisting arrests, that's an interesting one getting some pushback and prostitution and I should also mention he's taking on the bail system telling his staff again, do not try to get pre trial detention for people for low level crimes. That's not where the focus should be. The police union, as you mentioned, a lot of pushback on this essentially saying, why should we arrest people if they're just going to be back on the street, but Bragg is backing it up with data again saying the vast majority of people who are out on bail do not go on to reoffend do not actually commit violent crimes where they are while they are out on bail. And if they are in jail for even three days, it has life altering repercussions. Now, you might wonder how the mayor feels about all of this, given his platform, given all the talk about tamping on temping down on crime in the city. But Eric Adams seems to be backing brag here. He says he's going to meet with him in the coming days. He says he respects his position as a prosecutor and he too says we should not be sending people the Rikers Island for petty crimes. How does it actually work though? What happens to someone you can still get arrested, then what happens to you? Well, the prosecutors, the prosecutor on the case, will essentially just defer prosecution or find some other means like community service. But again, you kind of point out John, will they even be arrested as one of the questions and, you know, some of these cases, how this all plays out on the ground remains to be seen. Yeah, I think practically speaking, we're going to have to see what happens here. So Laura, part of the point that DA Bragg is making is that Rikers Island shouldn't be a mental health facility, right? I mean, we saw a lot of deaths there in 2021 as people awaited trial. Yeah, Rikers is busying as a sort of a scourge on the criminal justice system. COVID hasn't helped that at all. De Blasio promised to take it on, but still it remains sort of embarrassment of the system and Bragg and mayor Adam saying they want to do something about it. Politicians are vowing to keep classrooms open, trying to reassure parents, they won't be left in the lurch on child care, unemployment, and their hope the pandemic's end was in sight. The FBI is now helping investigate last week's wildfires in boulder county, Colorado, two people are still missing as authorities survey the damage and look for the cause. The fire is destroyed nearly 1000 buildings. The only hospital in the town of Lewisville remains closed because of smoke damage. After 30 years in office, veteran democratic Illinois congressman and civil rights activist Bobby rush will not be seeking another term, according to several reports, he joins 23 of the Democrats who have said they will not be seeking reelection as their party tries to cling to its slim House majority. In New York, a federal judge has dismissed charges against two prison guards who admitted to falsifying records the night that convicted sex offender Jeffrey Epstein died in jail. Tova Noel and Michael Thomas who were accused of failing to check on Epstein in prison after he was placed on suicide watch. The agency also shortening how long you need to wait for your booster if you receive the Pfizer vaccine. Everyone 12 and older, now eligible after just 5 months, that's instead of 6. The CDC director is expected to sign off as soon as tomorrow. Some families in Texas went for boosters before heading back to class. I was at basketball practice and I just got in the car and my mom was like, we're going to get your booster today. I was ready to be like a long time before we got it. But I think it's good because we're about to teach you a lot of traveling for like sports and stuff. So I'm glad I got it now. It's been busy. It's been nice. I mean, this is what we've been wanting. Glad to see it busy. The omicron variant has been disrupting kids returning to physical classrooms across the country. The former acting head of the CDC says it could be a rough few weeks here, folks, but he sees a reason for optimism. As omicron goes through and it's going through at an enormously high and fast rate. It will leave behind, hopefully. People who have some protection against whatever variant comes next. If that's truly the case in the next 6 weeks, two months, we could be starting to see the endgame for this pandemic. It's time for three questions in three minutes. Let's bring in doctor Elizabeth Murray. She's a pediatric emergency medicine physician at gallicano children's hospital at the university of Rochester medical center. Doctor Marie so nice to see you this morning. This news from the FDA on expanding the booster, something like 5 million kids now eligible. What are you looking for when the CDC advisers meet tomorrow? I'm going to let a little nerd energy out. I am very excited for the meeting. I love these meetings, these advisory council meetings. They are jam packed full of great information. They are open to the public. They are live streamed. I highly encourage people to watch what you can because the discussion is robust and great and you get to see these great minds kind of go through all the data. So I'm expecting to see a safety update and then the data is saying why they think of 5 month window is the right window. And so let's see what they have to show us. I always like to say, let's see the data before we cast an opinion. And so I'm very much looking forward to it as a mother of a 12 year old who is approaching the 5 month Mark. I'm definitely very interested to see what the data tells us. Yeah, I'm right at the 5 month Mark two for two of my kids, so I'm real real interested to see what this is going to mean and how quickly we can do this. I want you to listen to what the Surgeon General of Florida said yesterday on COVID testing. My department's goal is going to be to put out testing that doesn't restrict access to testing, but reduces the use of low value testing and prioritizes high value testing. So if your grandmother gets a test, that's a much high, much more valuable test than the 8 year old third graders that Los Angeles County is sending in to get weekly testing. The first one is going to is much more likely to change outcomes. By changing outcomes, does this targeted testing strategy have merit in your view? Well, I think it depends on what our priorities are. And I don't think they have to be mutually exclusive. I get nervous when we're kind of pitting one thing against another, this strategy can be different. You know, making sure that the elderly perhaps more vulnerable person has early access to things like monoclonals or other treatments to prevent them from going to the hospital if they become sick. Certainly is very, very valuable, but keeping kids in school and adults in the school buildings all safe is also critically important. So the goal there is really keeping the germ out of school because we do have adults and we do have vulnerable children in school. So there's layers of protection that we need to focus on testing is definitely one of them. But it's not the be all end all as a week of now 300,000 pediatric cases in the United States blowing by the previous record of 250,000 cases hearing from my colleagues in Kansas City that some schools are going mask optional this week is certainly very, very concerning to me, I think we need to continue with these layers of protection, testing, being

Less dangerous, but spreading quickly omicron is twisting this nation in knots after two exhausting years, people are desperate to find a way to live alongside coronavirus, but striking a balance between restrictions and accommodations is tricky. At the center of it all, schools. Today, more than 3200 of them are closed nationwide. We need our children to be in schools. I think the term distance learning is like a contradiction in terms. I mean, Philadelphia, you know, when children aren't in schools, there are many aren't getting the one decent meal they get during the day, the instance of child abuse basically disappears because you're not picking that up in school, but most importantly, you know, the socialization, social development, the kids so sorely missed last year, is absolutely no, I think we need to do everything we can to get children back to school, but it's a precious thing. And because it's a precious thing, we need to treat preciously 77 of Philadelphia's 215 schools are shifting to 100% online today. Schools in Detroit, LA, Atlanta, Milwaukee, Seattle, Cleveland, Washington, all also going remote, or they're delaying their start for at least a few days after the holiday break. In many cases, they're waiting for COVID tests, rapid tests, which are scarce, or PCR tests, which take days to return results. In Louisville, Kentucky teachers are lining up to be tested before going back to class. They're hoping to avoid virtual learning. I do not want to go to NTI. None of the teachers do. The kids don't want it. I want to teach. And I'm scared right now, just the result of this. I don't want COVID. Meantime, hospitalizations in the U.S. now topping 100,000 for the first time in nearly four months, including children largely spared by earlier variants, the hospitalization rate for kids is the highest it's ever been with more than 500 kids admitted every day last week. Now, did those children show up because they had a broken leg or a broken arm and then happened to test positive for COVID versus did they show up because they had trouble breathing because of COVID-19? I think those two are still needing to be a little teased out and unfortunately you and I both know that people who are seeking to minimize the seriousness of COVID-19 in children are going to hang on to that fact, but I think we would be foolish to keep minimizing COVID-19 in children at this point in the pandemic. I mean, let me repeat that 500 kids per day hospitalized. And some doctors are saying they're seeing comorbidities like asthma. Think of how many children have asthma and what a risk that is for catching the omicron variant here. The possibility of sending kids home for the umpteenth time in this pandemic, the cloud that looms over all parents now. It's also threatening to cause major economic disruption if workers can't get child care. I am marching into this year as calm and confident as possible. There's very little we can control. But I can control how I behave and how I present it to my kids. Some school districts, though, did reopen on time, most notably New York City. The nation's largest school system under a new mayor defying a union request to start virtually. I'm going to tell you what's going to happen day to day. We are saying open. We're going to do everything that we have to do to keep our schools open. And I know there's questions about staff. And I know this question about testing. There's a lot of questions. But we're going to turn those question marks into an exclamation point, we're staying open. We're going to make sure our children are in safe spaces. All right, that's New York. In Chicago, the teachers union threatening a walkout now members will hold an emergency vote today and whether teachers should go virtual. But that can only happen if the board of Ed agrees, if not, teachers could be locked out of their online classrooms, leaving kids with nothing. You have to ask them if they would prefer that children who they know won't be in these buildings. Should be without any type of interaction, any type of education. The number of children hospitalized in Illinois has tripled since the beginning of December. The governor wants kids in class. I've said all along that it's better for our students to have them in class. But safely. And so that's why we've provided an offered testing and we've offered and provided more vaccinations. And so we hope that school districts across the state will take us up on that. Students in Chicago, which has the third largest school district in the country, by the way, went back in class in person yesterday. School officials insist that it is safe to have kids in physical classrooms, CNN's Omar Jimenez has the latest from Chicago. Well, Christine Laura, today the Chicago teachers union is expected to convene an emergency meeting among its representatives at individual schools to vote on whether they would want to move to remote learning amid a surge in COVID-19 cases, which of course goes against what the school district has asked them to do. Now, if they vote yes and actually don't show up to school after this vote goes through it, puts the decision and the school district hands as to whether they would lock these teachers out of their remote classrooms as they have threatened to do under similar circumstances in the past. And for the school district, they resumed in person learning on Monday and have maintained all along that going to school is safe because of vaccinations, universal masking, social distancing, testing, and more. Mayor Lori Lightfoot even releasing a statement Monday that read in part, we can not forget that shifting fully to remote learning is not a panacea and comes with significant harm to students and their families. The best thing that we can do for our students, staff, and all our partners at CPS is to get vaccinated. Now part of the union's concern has come from a recent surge in COVID-19 cases and students, staff, and the surrounding community, but also from uncertainty on what the current COVID-19 picture actually looks like. But the real questions and conversations today about protests outside Supreme Court Justices houses. Particularly justice Kavanaugh. Where do you think that line is? I think there are a lot of people that a conversation about civility feels like it misses the mark when constitutional rights that you believe that you had for over 50 years are about to be overturned. The justices have security so far all of the protests have seen overwhelmingly nonviolent. There are plenty of protests that happen every single day in this country around the country at abortion clinics blocking women from getting into clinics. US attorney Jeffrey Berman had already recused himself from the investigation. And the times reports the president soured on Winokur when he was unable to make this happen. Responded say that say that I asked for his resignation, according to the times White House lawyers were so concerned about what Spicer said from the briefing room podium that they compiled an entire memo laying out his misstatements the White House counsel reviewed and determined that. There is not an illegal issue. But rather a trust issue. The report coming amid headlines that former deputy FBI director Andrew McCabe who was fired last spring briefed congressional leadership about the counterintelligence investigation.
