"Street journal were joined today by my colleagues a w. columnist bill mcgurn and kim strassel for a week. After the new york attorney general released her report. Finding that governor cuomo had sexually harassed government staff cuomo defended himself said he had no plans to leave office and then on tuesday he switched course and essentially resigned effective in fourteen days bill. What do you think changed. Cuomo's direction here. I think he counted the votes I always thought that Andrew cuomo would not allow himself to be impeached but if he counted the votes and he was a going to be impeached and be going to be convicted I think he wanted to leave on his own speed. You know he. He still faces civil and criminal liability so that. That's that's still a problem with him but You know he's by nature fighter and i think if he thought he had any votes that he had the chance prevailing over impeachment. I think he would have done it. But i think he recognized the reality inlet and i'll say this form until very recently wasn't clear that he wouldn't be able to tough it out some of the other governors that have gotten trouble. You know ralph north them you know people think they're toast and then they fight it out. I think this time just the evidence. Especially after the attorney general latisha james weighed in with her report and the growing course. It was just too much for him to resist. He knew he'd be impeach probably convicted. And i think that's why he decided to resign on his own. And if you notice the the kind of disservice he did is that he resigned. While saying he's innocent you know he. He claimed the line moved. He didn't really know he didn't say i'm sorry really for what i did. He saying you know. I'm sorry kind of if it offended anyone and so forth You know i think as as we've editorialized if he really is going to insist on his innocence than you should have fought it. And he should've made albany do what it never does which is hold itself accountable and have an actual vote. Kim what do you make of this. I mean i'll read a couple of the quotes bill. Bill cited what here Cuomo said in my mind. I've never crossed a line with anyone. But i didn't realize the extent to which the line has been redrawn He also called the allegations unfair. He said I truly believe it is politically motivated and this while. He's in the process of resigning..

"Long awaited report on governor andrew cuomo and his And charges of sexual harassment is out and it is blistering. I don't think this ends well for governor cuomo. I don't think he'll be governor of the state of new york that law. This long anticipated report about the behavior of new york governor andrew cuomo along ago former client of mine. I should add for editorial integrity are will amex's even more interesting than we can get your so you guys carry the conversation. The headline is Cuomo sexually harassed current and former state employees creating a hostile work environment for women in violation of state and federal law. According to the attorney general latisha james. So what does it mean for cuomo. Who's up for reelection next year. Well here's my question. David especially since you were for the thing that surprises me about all this is that it seems to have been a pattern of behavior for a long time and a lot of it. How did he is. How did he skate this for so long. I did not see that particular behavior. I mean he can be tough on people around him. There's no doubt about it. I didn't see that particular behavior then. And i don't know if his behavior changed you're right. It was over a long period of time. When i worked for him. He was running for attorney general in the state but also times have changed and so people are more willing to come forward. It takes a lot to come forward. The interesting thing is this report. Gibbs was something that cuomo asked for ryan he asked for it because he was under siege ended bought him some time. The question is now that it's here is to borrow a phrase is time up it is and i'll tell you your question about how affect his reelection is moot. There won't be a re-election you think he won't even run give. I think he'll be impeached rather

"There's no you can't go after prosecutors. No matter what they do, Um, But why would he promised Bill Cosby? I won't prosecute you. Then he goes and does it anyway? No differently. Different prosecutors, Right? Right, Right. I know different D a passenger. And now I understand calling in. It's a good friend of wise. We have Alan Gershowitz and so many things are happening in the Supreme Court and so many things happening all over the place. How are you this evening, Alan? I'm doing great, but I just want to comment about your last interview. Women who have been abused must not remain silent and men who have been falsely accused by women who are trying to make money or false accusations. Must not be silent. I agree, 100%, and we cannot ever accept the notion that black people are so and so white people are so and so Jewish people are so and so and women must be believed, and men can't be believed. That is the beginning. Of bigotry. You cannot accept this notion that women must be believed everybody must be given an opportunity to prove their case and everybody who's accused must be given an opportunity to disprove the case. Whether it's Bill Cosby or me, I was accused falsely, and I did disprove my case. But I don't like this notion of only women who have been abused. Have to be can't be silent. Everybody must speak out if you've been falsely accused. That's the American system. Now President Trump bring up both know him well. Uh, should this CFO I mean, I've never heard of the CFO being indicted on those kinds of charges, have you? There's never been that there's never been a case like this is never been a case where they indict somebody for grand larceny. Against the federal government. The I R s when the IRS hasn't even made a claim. So you get the district attorney in Manhattan saying, Hey, we know more than the IRS knows the I r s is the victim of grand larceny. They're not complaining, but we're going to bring the case. Against the person who was accused of grand larceny against the I R. S So look in a federal crime where the local D A doesn't have the right to do that shouldn't be a tribute to us a Chinese if anybody, right? Well, I think that there's a real question of jurisdiction. Whether or not a district attorney has the right to vindicate federal law in this regard. Um at when the federal government has done anything that federal government may come in, they may feel the pressure. And they may say, Gee, maybe will now indict. But at the moment, it's only a tax case. I have to tell you. I've heard of many cases where the government is going after people and said You owe taxes. You got to pay taxes. You got to pay penalties. I've never heard of a case where there's a criminal prosecution of his video or see whatever for taking benefits and not paying what the 8% New York's city tax No. They also went after him. Or saying he is not in New York City resident they admit that he was not in New York City. He did say he was in New York City resident after I think, 2013 But there was a period of time when he had two homes, one in the suburbs and one in New York City, and he denied he was a city residents. So as a result of that, They have about four counts of the indictment one count for filing a false this and the filing of false paper. They're just piled on. Basically, the allegation is that this guy got benefits. His grandson's tuition was paid. You got a car? He got an apartment and he didn't list them as taxable income, And for that he should have to pay his taxes and have to pay a penalty. And if he's convicted the usual penalty for something like this would be fairly minimal. Not enough to make him flip. I think On former President Trump What I was, uh, focused on was if they really went after him for major major crimes. Anybody is capable of flipping no matter how loyal you are. You don't want to die in prison. And the reason they go after people like the CEO is not because they're so interested in the CEO. They're using him as a domino and hopefully the next domino the next domino, and ultimately, they'll get to miss the Big domino. Namely President Trump. That's the way the system works. That's the way it worked with when Rudy Giuliani was the U. S attorney, and that's the way it works today. Professor Dershowitz It's Judge Richard Weinberg. How are you? Hi. How are you? Uh, As an outsider looking in one could say that this is investigation search of a crime. They're just looking for something for leverage to try to move up the chain. You don't need to speculate about that. Look at Latisha James. She ran for office without knowing anything. She wasn't In the office as the as the chief, Uh, state attorney general. She ran for office on the campaign pledges he was going to get Donald Trump. Yes, She didn't tell us what she was going to get Donald Trump, by the way. The district attorney who went after Bill Cosby also campaigned on the promise that he would put Cosby in jail that he would not listen to the first District attorney. So what we're seeing is the politicization. Of the criminal justice system all over the country, and it's wrong, whether it's against Democrats or Republicans and it has to stop and I think the decision by the Pennsylvania Supreme Court was a good first step. And we'll see what happens in New York City, whether side to answer I've known for a long time and have a lot of respect for I do, too. His first big case was against me, and I beat him, But we remained on very, very good terms, and he's been a very good idea. I think now. You know, he's done himself an easy job he invites. Now he's leaving office so he won't be held responsible. If, in fact, the case ends up being a disaster for the Prosecution as it may well, so we don't know We have to stay tuned. But the politicization of the criminal justice something that system is something that all people. Liberals, conservatives Democrats, Republicans have to be concerned cause today. It's the Trump family tomorrow. It's going to be hunter buying and it could be in one day. Where you stop. Yes, it doesn't. I think we've got to draw the line to say equal justice for all we've got to go back to our values. I mean, Yeah. And look before these amendments as equal protection of the law, not not selective prosecution, And so we ought to be concerned, no matter what side of the political spectrum, where on I agree, Uh, Alan Dershowitz today and it was a few Supreme Court rulings. Have you read them yet? Yep. Yep. Talk to us about it This significant, he said, Yeah, one of them, particularly. The Supreme Court, has sent a powerful message to the Justice Department. That they're not going to be striking down. Voter. Rules if they're reasonable. I don't think you can anticipate that the Supreme Court will ever strike down voter rules that require identification. I think they're going to hold that. No, they may strike down some if they're very extreme, and if it's clear that they're based on Rachel, or rather considerations, but I think the message from the Supreme Court is go slow. We're not We're not going to just strike down, Uh, laws that we might not agree with..

New York Gov. Cuomo apologizes, says he didn't know he was making women uncomfortable

"New york governor andrew cuomo gave a press conference today and You know we talked about the coronavirus pandemic and also broke his silence regarding the sexual harassment. Allegations that have been put out against him by three different women. Two of whom were actually former staffers of his. Now before we go to this video. I should note that if you watch the full statement He begins it by you. Know trying to be less offensive by arguing that he's in favor of women coming out and being able to to air their grievances to be able to share their thoughts and their discomforts and all of that and then he followed it with this. I i fully support a woman's right to come forward. And i think it should be encouraged in every way i now understand that i acted in a way that made people feel uncomfortable. It was unintentional. And i truly and deeply apologize for i feel awful about it and frankly i am embarrassed by it and does not easy to say and he followed that by saying that. It wasn't his intention to make anyone uncomfortable and that he did not inappropriately touch anyone even though we showed you a photo that was released by the third woman who alleged that he. He made her uncomfortable. He had his hands on her face. and he had asked her if he could kiss her and that was after he had put his hands on her lower back and then the first former staffer who came out with sexual harassment allegations said that he had kissed her on her on her lips without consent. That's putting yourself on someone physically. That is touching someone inappropriately That's worth noting. He is dealing with an independent investigation after he tried to appoint someone that he's close to to do the investigation. Luckily the attorney general in new york stepped in and did not allow that to happen so there will be an independent investigation. Which i'm happy about Latisha james Is the prosecutor who's pursuing this which is important But this is that statement. I not good in my opinion.

"One of the ANC brought more tough legal news for the president to end his family. A new court filing revealed that New York's attorney. General is investigating the trump organization for allegedly inflating the value of its assets to get loans state AJ Latisha James wants a judge to order the trump or to provide documents and compel testimony from the president's son Eric. As executive vice president. Now, according to this filing the younger trump abruptly cancelled and interview with the office. Last month, we should note this civil investigation, not a criminal case in a statement today their chief legal officer said, the company has done quote nothing wrong to that end, we welcome back to our broadcast Barbara, mcquade, veteran federal prosecutor, former US attorney for the Eastern District of Michigan. Counselor. It's good to see you I'd love your read on how much. Legal jeopardy how much real trouble the trump team could be in on this front Well, it depends on the facts Brian, but it could be very serious. We know that Michael Cohen testified before Congress about the trump organization propensity to deflate the value of assets and revenue when it came to filing tax returns, but inflating revenue and assets when it came time to seek loans, and so that is what Latisha James is exploring here and what's interesting about it is. Eric. Trump. Cancelling at the last minute and refusing to appear not wanting to invoke his fifth amendment rights but actually doing so. And so it does appear that they're concerned and have something to hide and when someone has something to hide, it makes prosecutors all the more eager to find out what's inside. What are the odds that we will see him go into testify? Can you just walk around and say now I'm not gonna I'm not gonNA come in there. No you can't. I think the odds are really quite high that he will have to show up. I think this is a stall tactic. We see this time and again I think it is the trump way. The way that he has built the real estate empire is to play hard ball and to assert frivolous legal claims. But everybody has a duty to show up and answer the questions. Now, that doesn't mean he can't assert his fifth amendment rights when asked particular questions but he can't do it in a blanket fashion. He can't say I'm not coming at all. He has to show up I mean she might ask questions like what's your name that's not protected by the Fifth Amendment Privilege but if there are particular questions then at that moment, he has to assert his right then but I think that is the the visual the Specter that he may be trying to avoid because that's when it looks politically perhaps to some like an assertion of the fifth, the Fifth Amendment might be an admission of guilt. And Barb we mentioned civil versus criminal. Is this a potential advantage to him and his dad that this is a civil not criminal matter. Well sometimes, yes. I mean, civil means that the penalties will be money damages and not sending someone to prison. So in that way I suppose civil makes people a little less fearful but in many ways when you are the prosecuting entity thinking about whether you want to proceed civilly or criminally can bring with it advantages and disadvantages. One of the great advantages of proceeding civilly is the burden of proof is much lower. It's only preponderance of the evidence as opposed to the higher guilt beyond a reasonable doubt that's necessary criminal case, and so in some ways, it could be more dangerous for the trump's to be facing a civil investigation because of different legal standard. Final question because Americans love being able to pick it things, they're not supposed to see. Can you manage expectations? There is no expectation correct that at the end of this case, or during this case, people get to take a look at the president's tax returns. It depends you're right. I don't know that we'll see the whole tax returns on display but if the attorney general is able to get her hands on the records, you may see allegations that come out of them in a complaint to civil complaint that would be filed here. So we may see excerpts, and if the case ever went to trial, those textures could end up being exhibits in court in. So in that way, they could be used in the day may come when we actually get to see them.
