"But basically, and it's like, she doesn't really have a good option. So you have any suggestions for people that find themselves in this, like no matter what decision I make, it's gonna make them unhappy? Yeah, so it's kind of a lot to unpack quickly, but- I don't ask easy questions. Well, the thing is that there's a lot of things at play. Number one is fear. Nobody's bucket list goal is to leave their house and move into a facility. And there's a lot of fear. What do I do with all my stuff? A lot of people in that... Because I took care of my mom with dementia for four years and my dad lives with me six months out of the year because I live here in Florida. But I know with clients and even with my own parents, the thought of, they lived in this house for 60 years, what do we do with all of our stuff? So there's like this whole list of things that we go over when we have our strategy session with the adult kids. I'm like, okay, I have your buy-in on putting a plan in place, but we need to like talk about strategy on tips on how to get mom on board. But also when it's the daughters or the sons, when families try to have these meetings on their own or like persuade their parents, it just does not always go very well because there's too much family junk that gets in the way. But when you have a neutral third party person, we have the ability to develop that rapport. We work as that advocate. Let me hear what you have to say, Dorothy, mom, Dorothy, and daughter, Sally. Let me... That's where some of that mediation comes in. And then, okay, what concerns you about leaving your house? Has she even been pre-qualified? Does she have enough money to get into that facility? Do they have an opening or do they have a four-year waiting list? So there's a lot that's to unpack with just that one scenario. I think there's too much emotion in history. I mean, it doesn't even have to be negative. It's just- Right. That's why when families try to do this on their own, it just doesn't go well. And then that's when some of those relationships, like I said at the earlier of the podcast, even the most close-knit families, this aging, caregiving, and dementia progression can put a wedge even in the most closest relationships. So you really do need to have a neutral third party help you navigate these conversations and put that plan in place so that they understand what care options are, viable options, and safe options for them. Oh, it makes sense. Yeah. And we were gonna talk about burnout, but it seems like care planning, that's the precursor to burnout. That's why I said at the top of the podcast, with an aging plan, we can prevent caregiver burnout because an aging plan is making sure that you understand the diagnosis that you're dealing with. You understand what care options your loved one can afford. If they have $5 million as assets, that's a lot different options than someone who has 200,000 and they're 74 years old. So when you have a plan, caregiving, aging, and dementia progression can be a more positive experience for everybody when you have an aging plan because you literally whip it out of your grab and go binder you say, okay, oh, we need home care now. Here's the four or five different home care companies that we've already interviewed, we've talked to, here's how much we know that they're gonna cost, here's how many hours we know that we have to commit to them. And if mom and dad can't stay at home, we already know that they're on the waiting list of these two or three different care facilities because we did the care matrix for them. And that way you have that peace of mind of, okay, if staying at home is no longer feasible or safe, because we talk about in that aging plan, well, what's your stay at home aging in place budget so that you don't then go through all of your money trying to stay at home because you made the promise. And now you can't get into any facility because now you went through all of your money and now you only qualify for a Medicaid facility. And what if there's not one in your area that has an open bed? And what if then, because you didn't know what you were doing or you acted too late, mom ends up in one facility and dad ends up in a different facility and they don't get to see each other again. And that would be rough. That's the shame. And it happens when you don't put a viable plan together. When you wing it, we spend all of our life planning for everything else in our world, like where we're gonna go to college, who we're gonna marry, where we're gonna live, where the kids are gonna go to school, where we're gonna retire, where we're gonna go on vacation. So in God's name, why wouldn't we put a plan together for the most vulnerable time of our life when you're the most at the mercy of other people to take care of you? You know, it just doesn't make sense for you to wing it. I think part of it is cultural, but I have a friend and I'm working on her. She doesn't want her children. She had three adult children, two young grandchildren. One's a baby, one's four. And she doesn't want her children taking care of her. She wants to live in her home forever, but doesn't wanna talk about an aging plan. And it's like, I'm gonna work. I just told her, I'm gonna work on you because this is not, you know, there's no rational here. And she just laughs at me. And so I'm just hoping that just by the occasional poke, jab, you know, kind of little, just like a little humorous, I'm gonna work on you and then just kind of drop it, hoping that I can maybe get her wheels turning. You know, her husband is a huge planner, so hopefully. Well, and here's the thing, and then I've got to close cause I have a client to meet with, but here's the thing. Here are the mistakes that families make. Denial, thinking that they have more time. Like I said, the people that had major strokes last Thursday didn't wake up thinking they had, that they were gonna have a major stroke and their whole life just totally was devastated by that one action, right? It wasn't on the to-do list. It wasn't on the to-do list, but those life has its own agenda. So we have to be planned ahead for that. So there's all this denial of, well, I have more time, or, you know, I can figure this out. I want, or this is a big one too, especially heading into this time of year. Well, I wanna spend my last Christmas in my house and then we'll talk about it. Well, what if something happens that, you know, before Christmas time? And then that's when I say, when you don't have a plan in place and you need care, you will get into whatever facility has an open bed. And that does not mean that that's gonna be a good fit facility. So people always think that they have more time to figure things out or put a plan in place. They're in denial and they certainly don't have their paperwork in order. You know, if, you know, all of us over the age of 18 should have our legal documents in order, our power of attorney, our living will, you know, because all those, all the people that we hear about on the news, they had a car accident and died at age 30, didn't wake up that morning thinking, no, I think I'm gonna have a car accident and die and leave my family vulnerable. So, you know, it's just, that's just how, you know, that's just how it is. And so we need to know that and be realistic that we all have a stamp on us on when it's our time. So why wouldn't we wanna just make it easier for all of our family members and ourselves? Well, isn't this saying that a failure to a plan is a plan for failure? Yep. That's exactly what that is. Yep. I don't know where that brain cell popped that one out of, but yeah, it's like, we want specific things, but then we just kinda like hope they're gonna happen and we know that's stupid. The Media Has Lost Its Mind When It Comes to Hamas and Israel
"You know, it's amazing to watch the way the media processes everything that's happening in Israel right now. That terror attack on October 7th, just the most horrific thing that really any country could imagine. 1400 Israelis killed many American citizens among them and just just brutalized by the terror group Hamas. And the media has lost its mind. They have no skepticism whatsoever of claims made by Hamas, but they have tons of skepticism for anything Israel says. Have you noticed The New York Times has a piece up today that says Israeli army takes journalists on controlled visit to Gaza hospital right away. They're trying to prejudice your take on the story. They want you to know that is Israel rigging this story. That's the way The New York Times presents this. Almost 48 hours after entering Gaza's largest medical complex, the Israeli military escorted journalists from The New York Times through a landscape of wartime destruction Thursday night to a stone and concrete shaft on its grounds with a staircase descending into the earth. Evidence had said of a Hamas military facility under the hospital. Sure. Do hospitals normally have stone and concrete shafts with staircases descending into the earth. Underneath them. Is that a normal thing for a hospital? Like, you're curious at all about that. But Colonel Elad Suri, the commander of Israel's 7th Brigade, said Israeli forces fearing booby traps had not ventured down the ...shaft at the hospital, Al -Shifa. He said it had been discovered earlier in the day under a pile of sand on the northern perimeter of the complex. In the darkness, it was unclear where the shaft led or how deep it went, although the military ... had sent a drone down at least several meters. Electrical wiring was visible inside along with a metal staircase. The controlled ... not settle the question of whether Hamas, the armed Palestinian group that rules Gaza, has been using Al -Shifa hospital to hide weapons and command centers as Israel has said. What? So what more evidence do you need? You know, Israel has laid out something that has sort of been widely known in the first place, which is that facilities Hamas uses like schools and hospitals as a means to carry out their terror attacks and then produce human shields to protect the vile military actions that they're taking, terror actions that they're taking. And so Israel says they're doing this from the hospital. We don't believe you, says the New York Times. OK, come with us to the hospital. They take him to the hospital and they say, look, there's the tunnel. Why would there be a tunnel built under this hospital?

"The two most frequency asked questions is, aging planning sounds great. When is the time to do it? Right now. And the reason is because all the people that had major strokes last Thursday, didn't wake up thinking, oh, I think I'm gonna have a major stroke today and put my whole financial and family life in turmoil, you know, with a bunch of question marks on, okay, what is our new baseline? What's our new normal? And can dad come back home again? Or is he gonna be stuck in a nursing home at 16 grand a month? You know, cause that's the reality. So, how to get mom and, cause like I said, it is almost always 99.999% of the time that it's the kids that are calling care, right? Cause they've heard me on a podcast, they've heard me present or it's all word of mouth referrals or it's from my book, you know? And so they're like, they're sold on the 30 minute consult. They're like, yeah, whatever it costs it is. Because reality is most of the adult daughters, the year before they hire us for an aging plan or if they waited until crisis, they're spending 15 grand. They're 15,000 just in the year prior, just an airfare. That's not car rentals. That's not the angst of when you get that phone call again or having to miss work or having to line up your own childcare or care for a spouse who's sick. That's just airfare. So anyway, how you broach this topic with your parents. And I'm not sure who's more your audience, if it's the moms and the dads or the adult kids or it's just kind of mixed. But yeah, I figured and mine is too. And so if you are wanting to approach these topics with your parents, you can say, mom and dad, I love you, speak from the heart. I love you, but we're in uncharted territory. We don't know what we don't know. We can't just wing this and hope for the best. And I want you to have the best quality of care possible. So we need to hire someone that can help us navigate this. It's too much of a learning curve. Your neighbor, Joe, down the street, his input's not gonna be helpful because his situation is totally different than yours and Google will only get you so far. So one way is speak from the heart. Mom and dad, we love you, but we're in uncharted territory. We need help navigating the what-when's of aging, dementia, care options, end of life. What's patient advocacy? Why do we need it? So hiring someone to help you. You can also ask mom and dad, mom and dad, is it important for you to have the best quality of life possible? Who's gonna say no to that? So ask them questions, who in their right mind would say no to that? And then ask them questions, is it important for you to have a say in what happens to you as you age? Like where are you gonna live? Who's gonna take care of you? Because if we don't put a plan together and you need care, you're gonna just have to go into a facility. So let's start talking about this now, otherwise you're not gonna have a say in it because just like when I was still an employee doing all the tours, parents didn't have a say at all because they're in the hospital. So it is the adult kids that are picking your facility. I know that's a cliche, but it's true. And so is it important for you to have a say in what happens to you as you age? Like where you live, where are you gonna get care? And you can also say, is it important for you, mom and dad to be as independent as possible? Again, who's gonna say no to that? Because that's part of our, most of us, that's our fiber is we're all just trying to grasp on to the shred of independence and dignity that we have left as we age. And so when these adult kids say, oh, mom and dad are just being stubborn and difficult. No, they're just trying to have as much dignity and independence as they can because they know they're in a losing battle. Aging, we don't get better as we age, right? So, I mean, no one is ignorant enough, they're in denial, but that's different than ignorant.

It's tuberculosis. It was tuberculosis that would take her life We've mentioned earlier from a very early age Therese, she had bronchitis every winter and she had whooping cough very often For several years the sisters had already noticed that her voice would get hoarse in the morning and in the evening Her cousin Marie who was the daughter of the pharmacist and whose letters are very helpful because she has a bit of the Doctor's eye and she describes more clearly than any of the others the symptoms Therese is undergoing as she's writing to family members and others They were worried. They could see that something was not right and a year earlier on Holy Thursday and Good Friday. She has that coughing up of blood Which almost incredibly was not taken as seriously as it should have been Now Therese herself to be fair in all of this Therese herself is in part if we can say this of a saint to blame because She minimized the symptoms she hid them as long as she could in fact when she had that bleeding She never said anything to her sister Pauline who only found out much later because she didn't want them worrying about herself and She struggled to keep up with the discipline and the the daily or Arrium and so forth of the monastery Carry out her tasks even at times just even to walk up the steps. She would almost have to stop at each step She would go through the day with fever and chills all of this has been going on but The symptoms will get to their worst in August where she has a month of excruciating pain But the tuberculosis is progressive and what it's doing is it's eating up the lungs and it's progressively getting harder and harder for her to breathe So a book by this Bishop whom I mentioned as perhaps the primary scholar of Therese He's not a dry academic he loves her and he writes well about her and with great knowledge This book is entitled the passion of Therese of this year, and it's by Bishop Guy Gaucher G -a -u -c -h -e -r And in one chapter in this book, he describes the symptoms that Therese undergoes with the tuberculosis So he entitles this section here from Therese words. I didn't expect to suffer like this. Oh Some of the remedies that were done and Therese bore them She knew they were going to be useless She's like her mother in this. Zelie never had much faith in the remedies The doctors would offer. Of course medicine was not at its present level at that time I'll only mention one of them which is just kind of hard for us to imagine It was called pointe de feu points of fire and what would happen was they thought to increase circulation to help the body a Needle would be heated to where it was red -hot and it would be applied to the skin of the person and Therese had this done several times up to 500 applications of these needles like this Now you can imagine the condition in which she would return to her her room or her infirmary the infirmary She bore all of these things, you know gives a whole new meaning to her expression about thousand little pinpricks. Oh My goodness, is that a possibility of something that I mean in that experience, I mean it gives it a whole new dimension, doesn't it? Well, it's really hard for us to imagine You know the kinds of things that end and diet foods that were just very difficult for her to eat and so forth You know it was and some other things I won't get into all the details But part of her martyrdom is really the only word for it Was the medical attention such as it was that she was given because she was also left without medical help At times when she desperately needed it and also morphine was available to sedate pain But the superior never allowed it now to be fair to the superior when she later herself She died of cancer a very painful death. She would not use it herself It was just considered something that nuns would not use, you know So it was not as though she was simply being cruel to Torres and although in effect it meant that Torres bore excruciating pain with no mitigation at all in these last months of her life But it was not necessarily out of bad will There were also other things involved There was a doctor who was the regular doctor for the Carmel and who was a friend of the superior and good man One of his sons was a priest But when he was away at times a family doctor that this actually was the husband that her cousin Jean married Could have come and helped but the superior just really didn't didn't want that So especially during that month of August when she went through the worst of her pain She had no medical attention during that time. Can I ask you this? I mean What would those sisters going through her blood sister is going through watching this? With this superior that didn't seem to be responsive. I It was terrible. In fact Surreptitiously on a few occasions they mixed a little morphine into drinks and things they did the best they could To try to help her in that situation. This was Torres of the child Jesus and of the holy face very much It's her passion. That's the title of this book that we're quoting So I'm just going to list the symptoms now these symptoms as I'm as I'm saying We're not yet at this stage in May when the letter that we're reading was written But they indicate throughout this time to res continued to respond to letters there was a seminarian Maurice Belair and The very nice book has been written on this by Bishop Patrick Ahern. That's Maurice resin Maurice the story of a love a seminarian who was really struggling Wrote to the Carmel asked if a sister could pray for him the prioress asked her as to do this So in this last year and a half or so of her life You have this handful of letters that he writes And then her response. It's always the same he respites rights discouraged by his failures He writes back to encourage him. God is calling you to be a saint. I know it you can do it But especially for this I'll just quote this one instance because his need was so great in the midst of these kinds of pains And with a trembling hand with the pencil Torres would write sometimes even lengthy responses to these people So that's when you read them on a page. It looks like they're nice Sedate letters that that was not the case All right to describe the symptoms of the tuberculosis So the bishop says fever and profuse sweating for six months So that does include this may that we're looking at Torres suffered from a fever which fluctuated Sometimes her back was burning like fire Sometimes she was perspiring so much. She became dehydrated Digestive troubles Torres suffered frequently from nausea often losing her meals even before she became bedridden The doctor prescribed milk for her. She had never liked it. She could not digest it She continued to take it forced it down knowing what would happen Respiratory troubles as the tuberculosis spread through the lungs Torres suffered pains first in her right shoulder and arms then in her left side the continual cough emaciation Strikingly when you look at the photos of Torres and this is typical from what I've read about this her face looks unchanged Her face looks healthy and all the photos that you see and in fact This was one reason why many of the sisters didn't really believe she was very ill to look at her She seemed fine So she didn't get a lot of sympathy from many in the Carmel as as she went through this But underneath the habit she was becoming a skeleton Normally the face of a person suffering from tuberculosis takes on certain characteristics, but Torres face remained almost the same Her voluminous Carmelite habit hid her thin thinness and her face was full Only her thin hands betrayed her That's all you could see through the habit and gave the lie to the healthy look and the emaciation itself caused various afflictions weakness powerlessness and distress People suffering from tuberculosis like this obviously would have deep emotional discouragement and depression and pain They did the prodigious remedies customary at the time but ridiculous today do anything to alleviate all this suffering Basically the answer to that is no that they really didn't do much Right, that's and of course add to this that Torres is in the heart of the spiritual darkness at this point Which is centered on? This sense powerful in her that heaven is not real that when we die everything is over and She is making more acts of faith as she'll say than ever in her life at this point She writes these lovely poems about eternal life the sisters comment on it and she says I am writing about what I wish to believe So she is this is a martyrdom, you know This is a passion that Torres is going through and that's the context of this letter that she's writing So this is the second Person this case already ordained a priest that she was asked to accompany spiritually and it was a father Adolph Rulong Who was destined for the missions in China where he actually spent 13 years? He stopped by the Carmel at one point can't say that he and Torres actually saw each other because the grill was in between Although they tried to work it so that Torres was the last one.

Well, folks, XRP pumped and dumped this afternoon on news of BlackRock filing for an XRP spot trust. And this filing was actually on the government website in Delaware. So that's where people were going a bit crazy, like, wait, it's legit, right? It's not just a rumor. It's not somebody just tweeted, but rather the filing was actually on the site, but it was a fake filing. scammers, So these these people are getting more sophisticated and more bold. You know, the fact that you're taking BlackRock's name and going and filing a fake application. I mean, come on. Right. We don't know who did it, but, you know, maybe they're playing the market where they're doing some quick longs and then shorting it. Right. Because right away, the market dumped after the news came out that it was a fake filing. So TLDR the here, though, is that you can see the market is clamoring for a spot ETF, whether it be Bitcoin, Ethereum or XRP. This is where scumbag regulator Gary Gensler and the SEC need to act. Approve the goddamn ETF already, right? You got commissioners like Hester Peirce and Mark Ueda who are coming out saying the ETF's spot ETF should have been approved years ago. So right now we're just being delayed by the scumbag regulator, Gary Gensler. So here, Eric Balcones of Bloomberg said this is false, confirmed by BlackRock by me. So he contacted the folks at BlackRock. He said some wacko must have added using BlackRock executive name, et cetera. Come on, man. So, you know, it's it's so silly. And like I said, they're getting bolder. The fact that they're filing and putting this stuff on the website now because of the XRP fake filing that brought into question the Ethereum trust filing, which took place recently, I think a couple of weeks ago or one or two weeks ago. A lot of people are now asking if the Ethereum trust filing was real after seeing the XRP trust was fake. He said, yes, the iShares Ethereum trust is real and was confirmed via 19B -4 filing on Thursday. Only the XRP trust filing was fake. So I think the TLDR here, though, is once again, the market is clamoring for an ETF. Everybody's winning in anticipation. And these ETFs will have a price moving ability. You know, you're going to see the markets pump off of this and we're going to see Bitcoin spot ETF approved eventually all coin ETFs, right? Individual as well as baskets. So Ethereum, XRP, Cardano and the others. Right. It's just a matter of time. It's all going to happen, folks. I think we see the writing on the wall, the direction we're heading in. So I'm very bullish overall. It doesn't matter that this was a fake filing, because I know eventually these products will be built, especially the fact that XRP has the legal clarity in the United States. I mean, you know, obviously the SEC took a big loss, so very bullish overall, despite the fake news. Here's what attorney Fred Rispoli had to say regarding the fake filing. He said, one, it is indeed on the Delaware Corp permission website. I searched this all the time to look up the right entity to sue in my legal cases. He said, number two, could someone file a fake entity? I'm only familiar in filing these in California and Arizona. And yes, I could easily file a fake entity on a real corporation commission website in those states. Maybe it's hard to do in Delaware. So I didn't realize you can fake applications through a government website like so. It's interesting, but at least we know now, right? You live and you learn. And we got to be careful because these scammers are trying to, you know, manipulate the markets. If you recall, there was fake news around the Bitcoin spot ETF for BlackRock being approved. And that, you know, Larry Fink had to go on TV and say, no, that was fake, you know, but you can see the market is really ready for this. So speaking of Bitcoin spot ETF, though, Michael Sonnenshine, who's the CEO of Grayscale, tweeted out this morning, it's been a 10 year dress rehearsal. We're ready for the main event. Is he hinting to something happening soon? Because we got news here from Nate Guaracci, who is the president at ETF store. And you know, he lives, breathes and eats ETF. So these guys know everything about it. He said a spot Bitcoin ETF approval could come this week. And he shared an article here with him and James Safer. So it's possible something may happen this week, you know, no guarantees, of course. But for example, James Safer has been saying he's anticipating January 2024 that that's when this is going to happen. And by the way, I'm interviewing James tomorrow. So we're going to talk about all this news.

Well, like I said, we are picking up right where we left off with the bullish sentiment in crypto markets continuing across the weekend. Ethereum cemented its gains from Thursday's announcement of a spot ETF application from BlackRock. Now, there was a 5 % pullback from Thursday's seven -month high of $2 ,130, but throughout the weekend, Ethereum traders defended the $2 ,000 price level and saw a slight price improvement into Sunday night. Ethereum ended the week up more than 8%, extending its streak to four consecutive weeks with gains of 5 % or more. Bitcoin traded sideways over the weekend, but that means it stuck close to the $37 ,000 level. What's more, the week began with excitement around Bitcoin and the possibility of preliminary ETF approvals coming soon. Now, last week, of course, had begun with excitement around Bitcoin and the possibility of preliminary ETF approvals coming soon. Toward the end of that week, that enthusiasm rotated into altcoins. Indeed, Bitcoin slightly underperformed the broader crypto market with a 5 .8 % weekly gain. But overall, with the 124 % year -to -date price move, Bitcoin has filled in most of the negative price action dating back to the collapse of Luna last May and is now trading at more than half of its all -time high. One other indicator of how things are changing is the stablecoin market cap. Stablecoin market cap as a percentage of overall crypto market cap has been steadily decreasing over the past month. At the beginning of October, stablecoins represented almost 10 % of the overall crypto market, but last week that figure contracted to around 7 .4%. Now, that's still a long way from getting below the 4 % stablecoin dominance levels which we saw at the euphoric highs of the last bull run, but the last month has been the longest continuing streak of decreasing stablecoin dominance throughout the crypto winter and levels are at their lowest point since May 2022. Now, if you're trying to make sense of what that would actually indicate, think about it this way. A lot of money in crypto doesn't actually ever leave the crypto markets. It simply moves between different assets based on what's performing and so, of course, when things are bad, when we are in the depths of a winter and there's not much opportunity to be had, people simply hang out in stablecoins. The percentage of the market cap that comes from stablecoins going down is one indicator that more money is moving back into the other parts of the market. Now, of course, there were lots of vibes on Twitter to match all of this action. Size Chad writes, the bull market is back, baby. Bitcoiner BitPain writes, how have we gone up 38 % in a month with no serious corrections? What absolute beast is devouring Bitcoin every dip? Now, someone who is trying to have a little bit of chill when it came to this was Chris Berdiske from Placeholder Ventures. He's been using the analogy of getting drunk and noted that while crypto Twitter appeared to be a few drinks in, he said that he wasn't going to question the uptrend until everyone appears five plus beers deep. He added, although signs of intoxication are appearing, when BlackRock's handing out booze, it's hard to know when the party will stop. Still, he said, for me, it doesn't matter. This isn't a big bash. And so I'm still not buying, not selling, just riding.

The group Doctors Without Borders claims Israeli forces shot at people fleeing a hospital in Gaza City. The organization urgently called on Israel's military to stop the attacks, which it says was witnessed Saturday by staff members at Al -Shifa Hospital. The group claimed the shelling also killed several people inside the large complex. The Israeli military denied targeting the facility and said its forces are fighting Hamas militants nearby. It also said people are being allowed to leave the hospital safely. New York's Columbia University is barring two pro -Palestinian student groups from holding campus activities for the rest of the fall semester. According to university officials, the groups Students for Justice in Palestine and Jewish Voice for Peace have continued to violate policies for holding campus events despite being warned, including one held on Thursday. Now the two groups are not eligible to get university funding for the remainder of the semester. The Jewish Voice for Peace group released a statement yesterday saying that they find this an appalling act of censorship and intimidation by the administration. President Biden is paying tribute to America's veterans speaking at Arlington National Cemetery in Virginia. He said as a nation, we owe veterans a debt not only for their past active service, but every day after that.

A highlight from Markets Surge as BlackRock Files ETH Spot ETF

It is Friday, November 10th, and today we are talking about BlackRock's Ethereum ETF filing. Before we dive in, I just have to give you a little bit of information about the show and the weekend. Unfortunately, this show is going to be a little bit shorter than normal and there will be no weekend episodes. Late last night, I started having to deal with an unexpected family situation that has wanted to round out the bullish end to this week and really capstone our shift away from the SAM -based world of last year and face forward into what's coming next. With that in mind, on Thursday morning, news broke that BlackRock had registered an entity called the iShares Ethereum Trust in Delaware. Although representatives for BlackRock refused to comment, the filing appeared legitimate. It named the Managing Director of BlackRock Advisors as the filing agent. There was initially some skepticism at first and people not sure if it was rumors, but suspicions were confirmed in the afternoon after markets closed when it was revealed that BlackRock had filed to launch a spot Ethereum ETF. Now this is not the first spot Ethereum ETF to be filed. A few months after the flurry of spot Bitcoin ETF filings in June, asset managers doubled down on crypto products with matching Ethereum filings. VanEck, ARK Invest slash 21 shares, Hashdex and Invesco slash Galaxy Digital all have applications awaiting approval. There's also a conversion application for Grayscale's Ethereum Trust filed with the SEC. The difference with BlackRock's application is, of course, that they are BlackRock. They are an order of magnitude at least larger than the other asset managers. And of course, what that means, at least according to the markets, is that these ETF applications are not merely speculative but actually stand a good chance of being approved. BlackRock's track record speaks for itself. The firm has filed over 570 ETF applications with the SEC and all but one of them have been approved. Now the rationale for the legality of a spot Ethereum ETF is the same across all of the current applications. Following the Grayscale court decision, it seems that the approval of spot Bitcoin ETFs is almost assured to happen. The court found that there was no material difference between spot Bitcoin markets and futures markets. As the SEC had already approved futures based Bitcoin ETFs, they had no reason to deny spot based products. Ethereum futures markets have grown massively over the past few years, achieving a similar size to Bitcoin futures in 2021 when those ETFs were approved. Partly due to this increase in market size, a large number of asset managers were able to launch futures based Ethereum ETFs last month. So then, using the same logic that was deployed in the Grayscale lawsuit, Ethereum spot markets are obviously tied to futures markets. This would dictate that spot based Ethereum ETFs should be approved to trade alongside their futures based counterparts. Nate Grassi, the president of the ETF store, put it more succinctly in a tweet. Grayscale Courtwin plus SEC approval of Ether futures ETFs should equal spot Ether ETF approval. Now BlackRock pointed to this argument specifically in their filing, stating that, quote, given that the SEC has approved ETFs that offer exposure to ETH futures, which themselves are priced based on the underlying spot ETH market, the sponsor believes that the SEC must also approve ETPs that offer exposure to spot ETH, end quote. Now, if the BlackRock application is approved, it will include a market surveillance agreement with Coinbase to monitor spot markets for manipulation. BlackRock also leaned on existing surveillance sharing agreements with the CME Ethereum futures market that are present in the other products. They wrote in their filing, Ether CME surveillance can detect spot market fraud that affects both futures ETFs and spot exchange traded products, or that surveillance cannot do so for either type of product. Having approved ETH futures ETFs in part on the basis of such surveillance, the SEC has can detect spot market fraud that would affect spot ETPs, and the sponsor thus believes that it must also approve spot ETH ETPs on that basis.

A highlight from ETF Excitement Drives Bitcoin Past $36,000

Well, yesterday, as you know, we pivoted to bullishness, put the SPF trial behind us, and faced firmly forward, and boy, has today extended the excitement. So much so that I'm actually not even really covering the biggest bull thing from today, which is BlackRock registering an Ethereum spot ETF that happened just as I was finishing, so I am sure that that will be front and center tomorrow. For now, let's kick off today with a tweet from Steven Lubka, who's the Managing Director and Head of Private Clients and Family Offices at Swan. He tweets, I love how Bitcoin itself determines how busy my day is going to be. Today is going to be crazy. Thanks for almost cracking $37k overnight. So let's start this report with the ETF speculation. Grayscale has opened talks with the SEC in an attempt to finally move forward with the conversion of the Grayscale Bitcoin trust into an ETF. Grayscale sources said the company is now in active discussions with the SEC's division of trading and markets and the division of corporate finance. Both divisions play a key role in deciding ETF applications. Now, Grayscale, of course, won its lawsuit against the SEC in August, with the court ruling that the SEC must reconsider the firm's application to convert GBTC. If the SEC wanted to deny the application, it would need to come up with some new reasons after their existing rationale was found to be arbitrary and capricious. Craig Salm, Grayscale's chief legal officer, said, Right now, we're just laser focused on constructively re -engaging with trading and markets. There are still things that have to be worked through. He added that, Overall, it's been good engagement and it's a matter of when, not a matter of if anymore. Grayscale CEO Michael Sonenshine also confirmed that discussions with the SEC have commenced. He told Bloomberg that his team have been busy filing the required documents, which quote, When pressed for a timeline for approval, Sonenshine chuckled, noting that, Timelines are certainly not something that has been discussed, but what I can tell you is that the SEC is constructively engaging at the moment. We remain optimistic that we will get through any final hurdles that need to be there and our investors will finally get what they've been waiting for. Now, the market, for its part, clearly thinks the conversion is likely to be approved. The GBTC discount has now closed to 12 % from over 40 % back in June. It's the smallest discount since November of 2021. Now, widening to the rest of the pool of potential ETFs, Bloomberg analysts reported that the SEC has a brief eight -day window to approve all 12 spot Bitcoin ETFs at the same time, which begins today. ETFs are generally not approved while they are still open for public comment following an SEC decision. That comment period concluded today for seven of the ETFs, which were delayed as a group in late September. James Safart, one of the Bloomberg ETF analysts, followed up in a Twitter thread explaining that, If the agency wants to allow all 12 fliers to launch, as we believe, this is the first available window since Grayscale's court victory was affirmed. Now on November 17th, comment periods will reopen for three of the applications from GlobalX, Hashdex, and Franklin Templeton when they hit their next SEC deadline for approval or delay. That would leave the SEC able to approve only nine of the 12 applications until January. Safart, with some assistance from finance lawyer Scott Johnson, added some extra detail to the situation. They explained that there are two approvals required before the ETFs can begin trading. The SEC would need to approve the proposed rule changes, and then a separate division of the regulator would need to sign off on product disclosure forms known as an S -1. Johnson tweeted, If there's a hypothetical approval this week, there's probably minimum a month and probably a couple before any ETF actually launches. S -1's still under review and no real hard deadline for that process. Though I consider it more a formality at that stage. Would be a wild period. Safart agreed, stating that possible and even likely that there could be weeks or even months between approval and launch. This is in line with comments made by Valkyrie CIO Stephen McClurg last week, who said, A late November approval likely means a February launch. Now his view was that the SEC would likely wait until the new year to ask firms to put finishing touches on their S -1 filings before they were given the green light. Adding a little more intrigue to the process, SEC chair Gary Gensler released another one of his little videos. This one was an explanation of the Division of Corporation Finance, the group which has recently been giving feedback on ETF applicants on their S -1s. Gensler emphasized that the SEC is a quote merit neutral regulator. He explained that the basic bargain of US capital markets is that quote, investors get to decide what risk they take so long as public companies make complete and truthful disclosure. Now of course, the timing of this could be nothing, but some viewed it as a meaningful indication of what has been going on behind closed doors at the SEC. Senior Bloomberg ETF analyst Eric Balcones tweeted, Could be a coincidence, but probably not. They did preapproval educational stuff ahead of BITO approval as well. Also, I feel like this is his way of saying, look, we aren't endorsing these ETFs, we're just trying to disclose all the possible risks so you can decide. Hands washed. Investor Adam Cochrane reiterated the point, tweeting, Usually this kind of stuff is posted by the SEC as like a disclaimer before they approve things they don't like. For example, last time was four days before they approved the BITO futures ETF. We guess this puts Bitcoin ETF approvals at less than one week now. As one final little indication that things could be moving behind the scenes at the SEC, commissioners and staff attended a closed door meeting this afternoon. The agenda included quote, institution and settlement of administrative proceedings and resolution of litigation claims. These kinds of meetings are held as needed and we don't have any further detail to confirm the commissioners are voting on ETF approvals, but holding a meeting is a much stronger indicator than not holding a meeting. To sum up, analysts' current expectations is that the entire cohort of ETFs are likely to be approved at the same time so as not to pick winners and that this could all happen as soon as this week. After that approval, disclosure statements will need to be finalized before the ETFs can be launched, which seems likely to take weeks, if not months. Notably, Bloomberg analysts have not adjusted their odds for full approvals in January up from 90%. They're also leaving their odds at an approval for this year at 70%. There's currently no real expectation that ETFs will begin trading until early next year. All commentary has carried a very prominent disclaimer that approvals are far from guaranteed, but between all of these little indications, market sentiment is clearly pointing towards a Bitcoin ETF approval. Crypto trader AvocadoToast tweeted, ETF thesis is pretty simple, 90 % odds of approval by Jan 10th could happen any day really. Announcement, immediate FOMO to speculate, scramble to search for ETF tokens on DexTools screener and Twitter, find top choice ETF because first mover most liquid highest market cap most trustworthy one, mash buy button candle loads. We all know this is going to happen. Let's just skip the song and dance. Blockworks Jason Yanowitz said, this market still severely underestimates how insane it will be to have Bitcoin ETF approvals and Bitcoin having within 60 days of each other will be obvious in hindsight. Now all of this ETF speculation has of course been extremely positive for Bitcoin price action. The market tested the $36 ,000 level for the third time late on Wednesday evening and effortlessly broke through. Bitcoin settled at a new level of around $36 ,700 overnight. Now Matrixport said earlier on Wednesday that they expected the breakout above $36 ,000 to be imminent. Following on from that correct prediction, the firm said that they believed a sustained rally to follow. Their report stated, the Santa Claus rally could start at any moment with a steady increase in buyers during US trading hours and an ongoing attempt for Bitcoin to break out. We could see prices rallying into the end of the month and year. Matrixport included some macro commentary recognizing that this Bitcoin run has been supported by dovish federal reserve messaging, reducing long -term debt issuance from the treasury and a continued slowdown in inflation. They noted that above $36 ,000 there's a lot of fresh air considering how rapidly prices collapsed in early 2022. The report stated that quote, a break above $36 ,000 could propel Bitcoin toward our next technical resistance level at $40 ,000 potentially reaching $45 ,000 by the end of 2023. Now along these same lines, the Chicago Mercantile Exchange or CME, which hosts the highest volume market for Bitcoin futures in the US has continued to see a rush of trading. Open interest for Bitcoin futures has increased by 35 % over the past four weeks, moving above 100 ,000 Bitcoin for the first time. Indeed, the CME is snapping at the heels of Binance as the dominant market for Bitcoin futures trading. Binance currently has a little over 24 % of the market while the CME is closing in with 22 .7%. Now, according to K33 research, the two week price consolidation around 35 ,000 has primed bullish sentiment. Over the last two weeks, dips have been bought and Bitcoin has remained in a $2 ,000 range. That range, of course, is now broken to the upside, but the analysis still seems relevant. K33 observed that with Bitcoin range bound, altcoins have had a chance to run. We've seen numerous tokens achieve gains above 10 % in the past two weeks, which has brought the total crypto market cap back up to $1 .4 trillion for the first time since the Luna collapse. Bitcoin dominance softened slightly as a result of this altcoin run, but remained above 50%. Now, maybe most interestingly, volumes during US trading hours are dominating the market, vastly outstripping other regions. Premiums on front month options have exploded with calls settled at the end of November showing a 16 % annualized premium. ETF inflows continue to be strong, with the pro shares Bitcoin futures ETF BITO just receiving its third highest weekly inflow since November 2021. Now, despite the rush of activity in derivatives markets, Bitcoin's implied volatility remains below its three year average. A highlight from Crypto Update | Bitcoin Soars Above $37K While Ether Hits a Symbolic $2K. Here's Why

On today's show, we're talking about a new big name crypto exchange, Bitcoin fees, GDP growth, and more. So you don't miss an episode, be sure to follow the podcast on your platform of choice and turn on notifications. And just a reminder, Coindesk is a news source and does not provide investment advice. Now, a markets roundup. The crypto market is surging, with Bitcoin at one point today almost reaching $38 ,000. According to Coindesk Indices, at 10 a .m. Eastern Time this morning, the Bitcoin price was up 6 .8 % over the past 24 hours, trading at $37 ,604. Ether is up a stunning 8 .25%, breaking through the symbolic $2 ,000 level to trade at $2 ,036. Other assets are doing even better. Chainlink is up 14%, Solana up 10%, Cardano 9%, Polygon and Avalanche are up 8%. What is behind this strong sentiment? ETF speculation seems to be doing its part. As of today, the public rebuttal period for most of the existing Bitcoin spot ETF proposals has closed, which means a comment from the SEC decision on the Hashtech's strategy change proposal to convert its Bitcoin futures ETF into one based on the actual asset. Also, there's the reevaluation of Bitcoin's safe haven thesis, with the US debt becoming an ever more pressing problem and several renowned investors highlighting Bitcoin's provably hard cap on its supply and its immutable monetary policy. This morning, Coindesk's Omkar Gaboli reported on an options market metric that gives some insight into trader sentiment. It's called SKU and it shows the relative price of calls versus puts expiring in four weeks. Calls are options to buy at a higher price and therefore represent bullish positions. Puts are options to sell at a lower price and so are good vehicles for those who expect the price of the underlying asset to fall. According to Omkar, the SKU is at its highest since April 2021. This means that the premium of calls to puts or bullish to bearish is at its highest in more than two and a half years. Sentiment does seem to have changed. In macro indicators today, let's look again at GDP, but not at the actual growth, the expected growth. I've spoken before about the Atlanta Fed's GDP Now model, which takes in economic data as it is released and spits out a frequently updated growth estimate. They go to pains to specify this is not a forecast, it is an estimate based on actual data. You may recall that for the third quarter US GDP growth, the Atlanta Fed GDP Now model was aiming much higher than the consensus estimates from economists. It was signalling Q3 growth of 5 .4 % versus 4 .4 % average forecast, while the figure came in at 4 .9 % smack in between the two. So the Atlanta Fed figures are worth paying attention to. It updated its Q4 estimate yesterday. According to the Atlanta Fed, Q4 growth in the US will come in at 2 .4%. This is much lower than in Q3, less than half, but it is not yet a recession. Or is it? One misunderstood feature of recessions is that they do not depend on two consecutive quarters of negative growth. I'm not sure where that idea came from, but it doesn't hold. If you look at the annual rate of quarterly GDP growth at the start of the last few recessions, they were 1 .4%, 1%, 1 .7%, 4 .3 % in 1981. So, what determines whether or not a US recession is upon us? The answer is the National Bureau of Economic Research, known as the NBER, which is a private organization entrusted with this call. The reason this organization gets to make this call is to avoid dozens of different dates being declared, which would make it The NBER gets to decide when we are in a recession, and this is especially important given there is no established definition of what a recession even is. The NBER's definition is the following, and I quote, a significant decline in economic activity spread across the economy, lasting more than a few months. End quote. If you're wondering what the organization means by decline in economic activity, you're not the only one. It's not just declining GDP. Last year, real GDP declined for two consecutive quarters without the NBER declaring a recession, something that hadn't occurred in the US since 1947. Anyway, given the strength of consumer spending and business activity, although this is declining, we are probably not in a recession yet. Growth is declining, however, according to a lot of data points I've discussed on this podcast, and according to the Atlanta Fed GDP Now model. It's starting to feel like we're in a sort of twilight zone. Maybe we are, maybe we aren't. The rear view mirror will tell us more. Back to markets, where stocks seem to be taking a pause. Yesterday, the main US indices closed more or less flat, and futures are pointing to a tentatively positive opening today. This is despite government bond yields continuing to drop. Yesterday, the US 10 -year yield dipped below 4 .5%, although this morning it is back just above that level. In Europe, the FTSE 100 closed flat yet again. The German DAX index rose by 0 .5 % back up to its highest level in just over a month. The Euro stock 600 was up 0 .3%. So far this morning, sentiment looks more positive, with the main indices up at least 0 .5%. Sentiment was more positive in Asia today, with Japan's Nikkei index up 1 .5%, the Hang Seng up a third, and the Shanghai Composite flat on yesterday. The Brent crude benchmark fell another 2%, dropping below $80 a barrel for the first time since mid -July. Earlier today, it had recovered slightly, up 1 .2%, to trade at $81 .40 a barrel. Gold also continued lower, most likely weighed down by a busy schedule this week of central bankers, reminding us that there could be more rate hikes ahead. Yesterday, the metal dropped almost 0 .75%. So far today, the decline seems more muted, with gold trading down 0 .2 % at $1 ,946 per ounce.

"Sidney Powell pleaded guilty to six misdemeanors last Thursday. Kenneth Chesbrough pleaded to one felony the next day, and on Tuesday, Jenna Ellis pleaded to one felony tearfully. I believe in and I value election integrity. If I knew then what I know now, I would have declined to represent Donald Trump in these post election challenges. I look back on this whole experience with deep remorse. Here to discuss how all this flipping affects the case against Trump is Michael Moore of Moore Hall, the former U. S. Attorney for the Middle District of Georgia. So, four down, 15 to go. How significant are these, please? I think it's significant anytime that you have a codefendant flip and the lawyer flipping or a little bit of a different bird baby than we normally see. When I listen to Miss Ellis and the charges against her, you heard a lot about the Trump pain. You heard about her direction from other, I think she called them more senior, more experienced lawyers. And that seems to me probably where the biggest jeopardy lies, and that is with those lawyers who have instructed her to do something. So, it sounded like that would be potentially Mr. Eastman and Mr. Giuliani. And of course, if they have pressure on them and they were then to cooperate, then they may get to the next level, which would be lawyers' deals? They are. They are unusually liked. I mean, remember that this case had been tagged as essentially the largest election fraud case in history or something like that. It's going to be a massive RICO case, and people are basically walking away with a slap on the wrist. They end up with probation, jail no time, and a first offender plea, which means that at the end of period of their probation and the completion of those requirements. The charges are essentially dismissed. So, they end up with no record. They can vote. They can have a gun. They can do all those things once they have completed the requirements that the court set out. So, they're unusually light, and they're especially light when you compare them with the sentences received by people who were involved at the Capitol on January the 6th, many of whom had jail sentences, some of them very significant. So, it's maybe a little bit like the architects of the building are not going to jail, but construction workers who worked on the building are. I can see why Willis gave the deals at this point to Powell and Chesbrough so that she wouldn't have to go to trial against them early and reveal evidence to Trump. But why give a deal such a good deal to Ellis? Jenna I think probably she has made some statements that the VA will find useful against other people in the indictment. I don't know necessarily that that's Trump, but I think she probably gave them information enough to at least move forward. And also too, she was essentially a mouthpiece for other involved folks with the campaign. And her culpability, I think, was probably less than other people may who have been more of a puppet master than she was. CNN I believe is reporting that Willis is talking to six more defendants who will be left to go to trial once it comes time for trial. I mean, does she a have number in mind besides Trump? I think there may be maybe a half dozen people or a few less that left will be standing. And those may be Trump and Giuliani. That may be one. Eastman may be another. People who think they have different constitutional arguments to make, there may be stronger arguments. It will be interesting to how Meadows is involved. I mean, we've heard that he was offered some immunity or cut a deal with Jack Smith. That's very interesting to me, given the statements that he has made in the Georgia case, especially during his motion to do the case to federal court. And, you know, essentially he came to Atlanta in federal court and said, everything I was doing awful. was This is part of my job and it's protected activity and it should entitle me as a federal official to move my case to federal court. And it sounds like to the contrary, when he got to Washington, D .C., he decided that he wanted to cut a deal with the special counsel and tell him that, well, I don't know that I was doing the right thing. And I tried to tell the former president was that he telling lies or whatever. I'm not quoting him but something to that effect. I don't think those are necessarily consistent positions and it'll be interesting to see how that plays out. So I don't know if Ms. Willis at this point given the objections that he made to having his case tried in Fulton County will look as favorably on potential a plea offer from him. So he may be one of the few that remain. That's really interesting because he has a very experienced attorney representing him. Do you let your client testify in a federal case to something that's going to cause you jeopardy in a state case? I don't think you do and I think that's the problem and I do think he has a very lawyer. good I just think some of the statements that he may have made in the federal court here in Atlanta may not be exactly consistent with positions that he has taken to the special counsel and I don't know how you claim that what you were doing was part of your actual lawful as a chief of staff and then suggest somehow that what you were doing you know you had objections to because you thought your boss was not tell the truth and this kind of thing so those will be maybe inconsistencies and what we would have to see actually the substance of each statement side by side we haven't seen those yet but any

"From Bloomberg radio I've been talking to Bloomberg legal reporter Joel rosenblatt about the sunny balwani trial which has reached the defense stage The prosecution rested its case last Thursday Tell us how the case mirrored its case against Holmes and how it differed Well many of the witnesses are the same So I would say by and large it's the same case There's some differences though I mean one big difference was the prosecution this time around was all set to present the former CEO of Wells Fargo who served as a director on the company and just because of scheduling really witnesses who are of that level It seems to me they get to determine whether they're going to testify and if so when and if the scheduling doesn't work out well it just doesn't work out And so he didn't testify Now in the balwani trial he would serve this role of director at there now This is the role that Jim Mattis the former Secretary of Defense played at the Holmes trial So that was the director spoke even if his testimony wasn't so compelling in terms of explaining Elizabeth Holmes's culpability it still just kind of riveting to have somebody of that level Testifying And here they don't have that Here they don't have that They just didn't get it The schedule didn't work out and I seems that the government feels confident enough to just go without that So that's one big example of somebody they didn't have I do think kind of reflects a confidence of the government that they've presented the case They need without somebody at that level I'm wondering about the case against Bel wani as compared to Holmes in another respect He helped finance the company by underwriting the $13 million loan and buying 5 million in stock And the defense claims that theranos had hundreds of millions of dollars in the bank at the time he left Does that make him seem different from homes I think it does I think that piece of evidence What it shows is well first of all there's a number of email exchanges in which sunny balwani shows his frustration with the company and I think a real regret at getting involved as you know Elizabeth Holmes and he were romantically involved in that One reason that the government gives and it's compelling that he decided to get involved as president and in the laboratories That personal investment to me shows a level of desperation A level of kind of commitment to get into the company and then eventually try to make it successful It hasn't always been explained I don't think to readers or listeners You know he did get his money back But then yes shortly after he got that money back he was gone So I think it explains some of his regret and some kind of desperation to try to make the company profitable to get off the ground and then seeing that that was not going to happen and then done Let's talk about his defense that prosecutors are cherry picking the bad results and ignoring millions of tests that work Are they trying to show the machine worked They're not trying to show the machine to work that they can't they can't really do that Because it didn't But it's kind of the inversion It's that it worked maybe well enough our work as well as other laboratories And so this is a real thing It's called the list It's a giant database that stored the blood testing results of millions of patients And it's gone It's just gone and so this is kind of a longer explanation but the short version is the government says there are no intentionally destroyed it and sunny balwani argues that the government sat on the database for a long time without kind of figuring out how to revive it and let it go defunct And so this is being litigated to what extent something ball wanting can present this defense is still not completely resolved and we're going to find out shortly But it's a central piece of his defense And I think as far as the defense goes for somebody in his position I think it's a viable potentially good good defense as good as you can get So we're going to learn shortly whether or not he gets to do that into what degree Elizabeth Holmes blamed balwani is balwani blaming Holmes Well so Elizabeth Holmes blamed him in kind of a more logistical way pointing to sunny ball wanting being in charge of fundraising and finance and defense responsible for the financial statements which were false and also pointed to his role in the laboratory But in the much more sensational way of course she pointed to him as abusive sexually and psychologically abusive Sony balwani is blaming Elizabeth Holmes for being the person who founded the company and started it and got it going She was the chief executive and founder of the company long before he came on as president That's a fact that's true So he is pointing to her not in the sensational way that she did But as the person who was the CEO and in charge he is doing that But more subtly And it's difficult argument to make because all the emails show how cooperative they were how closely they work together They were of course intimately involved but they were working side by side for years And really during the years where all the money started coming in So it's difficult for him to do Is there any chance that he'll testify Yes there is Unusual for a white collar criminal defendants to testify but Elizabeth Holmes did she did of course in the sensational way we've discussed But sunny ball one we don't know yet But he testified in his can you still face a lawsuit Civil suit by the Securities and Exchange Commission And he could have pleaded the 5th in that case and said I'm not going to testify But he did not do that And he's somebody who I've just seen over the years from depositions from his demeanor in court from his aggressive posture as aggressive legal defense He's somebody who you could imagine wants to present his side of the story That of course comes with enormous risk not the least of which is that existing testimony to the SEC If he deviates even a little bit from that testimony prosecutors are going to jump on that And I think prosecutors would love the opportunity to cross examine him But he may just be that kind of defendant who despite the advice of his lawyers even will take the stand We'll find out we don't know yet What's happening with Elizabeth Holmes Well so Elizabeth Holmes is just beginning to file for arguments for sentencing She will be sentenced in September So that's really what we're waiting for We will see arguments in court filings before then but the judge needs to evaluate kind of what happened here with sunny ball one He's going to want that information even for sentencing Elizabeth Holmes So he's going to want to have the whole picture before he sentences Elizabeth Holmes What is she facing Under the investor fraud counts that she was convicted of she faces up to 20 years in prison So she's likely to get about half of that which is still really significant The reporting initially kind of widely initially after the verdict was that she will end up getting a few years That's not true because of the size of the investor fraud The amounts of money that investors were defrauded of really kicks her sentence up significantly I don't think that she's going to get less than 7 years and maybe as much as ten or even more We know you're watching closely Joel thanks so much That's Joe We're so used to something being tested for years upon upon thousands and thousands of people. Before it's okayed right? Except in this time. Except for this one. I mean, it says right on the on the packages. You know, this is an un on verified or on. Uh, yes, the unapproved vaccine. Well, I had a question Do and I don't know if he either of you guys know this are the flu vaccines that come out every year because they change them. Are those approved? Are they emergency use? I don't know. I'll take those. I think there would be approved, but they have to change. How do they know? Year to year? They can't test them. Well, it's just of it. You know, it's just the toss of the coin, which one they think is I guess I don't know. I've never been so they only have three or four different flu vaccines that are approved. And they just pick one that they think that that's the kind of flu it's going to be this year. I'm reading the fact sheet that was handed to you when you got your vaccine. Uh, haven't had a copy of it right here that I've kept just for it, says the Moderna Covid 19 vaccine is an unapproved vaccine. That may prevent Covid 19. There is no FDA approved vaccine to prevent Covid 19. That's in the sheet. They hand you when you're getting your shot. Uh, So I understand why people say Hey, don't have enough information. I mean, Can't argue that Yeah, I don't know. I got it. But if the person next to me didn't get it, I don't hold it against them. You know, so According to this survey, 62 that they talked to Um 62%. Of of whites that they had received at 48% of Latinos, 43% of blacks. 67% of people 45 over. Mm only 40% of those under 45. Well. Yeah. I? I don't know. The way, you know. I mean, nobody. No. Here's an interesting number. Uh, what's the top reason? You have not made an appointment to get a vaccine? Okay. Among African Americans. Mm. The number one reason 64% is concerned with side effects. Okay, that drops way off found like Latinos, only 23% of them are concerned with side effects. Only 29% of white folks are concerned with the side of folk side effects. But 64% Of African Americans. I'm concerned about the side effects. I'd have to find out why that is. That's a big number. Then on Monday, this time they broke into the garage and stole 500 bucks worth of tools. Does the reeds are religious people with huge faith in God. They also have eight kids. They say it goes without saying that their patient people because the police hadn't showed up yet. He said. That explains their calm demeanor when you Hear that, In between All these thefts can discovered his dad dead at 86 years old and the family dog passed away. Local 12 interviewed them on Thursday evening, investigators said. Police had not followed up yet nor taking their videos to begin investigating the scene of the crime. The insurance company told him there are three separate thefts they'd have to pay $9000 because they were individual cases. So now what? But eventually they're like oh man maybe we do need a speed limit and so they come together and you'll find out that most of the times lots of the times they'll reinvent the same bureaucracy that they burned to the ground and throughout and so i would encourage our listeners. That are really anti doolittle heart check. Is this just your egner. Chimpanzee throwing some feces. Because you just don't like to be focused one day. Maybe it is. Get rid of all the rules right. And i've oftentimes heard it said in this kind of referring to political thought but sometimes people say well you know we should have. We have the statue of liberty but it needs to be balanced by the statue of responsibility. And i think that the same thing applies in our organizations. There's this balance that we have to seek and continually hone between complete autonomy and having structure. So that's a little bit about. We're talking about here. You know we look at any organization there there a lot of bureaucracy. You have functional divisions for example you have the. It folks you have the hr folks. You have the accounting and finance opposite sales. Whatever always different parts of the organization that are bureaucratic in terms of them being specialized areas of expertise and there are benefits to that now. Are there drawbacks. Yeah you could very easily start to get these silos in the organization so you know where maybe one department stop talking to another and all those types of things but it is prevalent and there is a reason for it It can be helpful then..
