"Well, I think that first of all, the alpha liberal comment that you made there. I think that my good friend and governor here in California stepped in and played a really good role in that. You know what? I'm not going to sit here and just get bashed by the media. I'm going to pull out ads on my own money with my own money and Florida and Texas and really point out the clear discrepancies between what we're doing here in California and what they're doing in Texas and Florida. Whether you agree with them or not, he's really stepped out there and taken the mantle berries. I'm sorry. No, I agree. I agree. Go ahead. Well, I think it's to your question about Biden and his administration. If they failed at any one thing, it's basically having very clear talking points on the successes they had had. And sometimes I think that early and early when we tried to have these really big, you know, the build back better, which is a really big program. I think they're a little bit tone deaf on their ability to get the whole package through. But this is a really underscore. This is a huge win. But once again, it's not Democrats worry. It comes down to one or two people. And here we are again, Manchin and sinema. I mean, literally cinema, Mike scuttled this whole thing now, even though we've gotten Manchin to agree with. So it's not Democrats. Won't get this done. It's two people. That's why we need to make them irrelevant. We need to, you know, I don't know if you're looking at polling, but I say we have more than a good chance, not just to get two Senate seats. We have a good chance of getting 8 more. If you look at race funds, I agree with you, I think the Democrats have a very good shot of not only walking away with one or two seats. I think they can actually end up with a 55, 45. Yeah. If you look at the numbers. Amazing. That's a different story. Yeah. Absolutely bleak on the democratic side. But I still am not, I think with roe V wade, I think with J 6, I'm not willing to, I'm not willing to give in to the doom and gloom, or in terms of, oh, we've already lost the house. I get that it's talking about it. Lanny Davis, my good friend, wrote out a standing piece. It was published in the hill where he pointed out very clearly how Democrats could be challenging the Republican counterparts. And it's on roe V wade. It's on Putin and Trump. They need to be very clear on that. Because the American people don't, you know, they need they need sound bites. I mean, we're busy in our day to today lives. And so we need to understand the clear discrepancies here and not just talking innuendo so much. It really hit the point. Let's talk about the democratic side, more, 'cause that's the other thing, bob cesca or friend tweeted about this morning about, you know, polling, I think, has a lot to do with how the mainstream media portrays the Biden and politics in general. But secondarily, he said, you know, this is what I like about alpha liberals. It stands strong and stands strong for your leadership. If anything, you're polling shows, is this a cult of Trump? They stand by Trump, no matter. I mean, it doesn't matter how many crimes out crimes he commits, whereas what you're polling shows in other polls have shown, of course, are that Democrats are nervous already about Joe Biden. First of all, as you know politically, 2024 is a billion years away from now, right? But the thing is, Democrats are nervous, right? That's what basically came out of this. You have, here it is. Democrats have a clear message for President Biden don't run again by a margin of 23.61% to 38%. They reject another Biden run. The preferences include Kamala Harris at 21%. Hillary Clinton in 19% Gavin Newsom and Pete Buttigieg tied for third at 9%. Where do you see that coming from? Is it generation is a generational? Is it that, you know, but again, Fox News, all they cover 24/7 is Biden old Biden dementia Biden, you know, I mean, just first of all, a bunch of stuff that's not true, you know? But I don't know how much that plays into Democrats nervousness. What do you think? I think that what the Democrats are saying to Joe Biden is we love you. You did your job. You got Donald Trump out of office. Now we're ready for a new type of leadership. I think it's, I think it's very clear to Americans that Joe's lost a little bit of a step and they're ready for a more energetic candidate in 2024. That's just my take. I think that as we get closer to the election and starts to shape out who we're going to be running against on the Republican side, I think that people will take an assessment on who is best there to win this job. Because it's all about winning, Stephanie, you know that. Yeah. I mean, yes. Well, I think it's I think he's earned the right that it's up to him. And I just wonder. Do you because I do know he said the thing about I am what do you say about I'm the bridge to the next generation. I'm like, ah. Listening. But it seems like we need this movie right now. You know, I'm watching it today. It's made in the 1940s. And there was things that resonate in that movie to the challenges that were going through as Americans today as a country. And George Bailey, we need more George baileys. In the world. And so I want to start by where did the genesis of this live tweeting Christmas Eve watching? It's a wonderful life come from. And I just want to talk a little bit about what the movie means to you and what it maybe should mean to us as a country right now. Well, like many of the great things in my life, it goes back to my parents. So, you know, as a kid, they absolutely loved that movie and whenever it was on, we'd have people over and watching it, quoting the lines and you know, it certainly struck me immediately as a kid, just as a beautiful picture and a beautiful story. And I think what you said Chad is very true. And to me, it's the very definition of great art. The fact that it could resonate so many years later and still be relevant many decades after it was created. So that to me is a beautiful thing. And I've always been sort of interested in it and I think it was a little bit maybe later in life that I learned a lot of the stories behind. I'm always interested like if I read a good book, I want to read about the author and the other books that authors written and how that person came up with the idea and all that. I always want the story behind the story. And there's a really, really interesting story about what it's a wonderful life, which is, you know, it came out in the 40s and got nominated for an Academy Award didn't win. And then was, you know, kind of largely forgotten is like a nice movie that went on the trash heap. And what happened was the studio and a complete clerical error error allow the copyright to expire. And when that happened, it meant that any television station anywhere had the ability to air that movie and not have to pay it the studio for the rights to that movie. And so this happened, I want to say it was the early 1980s. And all of a sudden, every local TV station around the country now you have to explain to your younger listeners about first of all what a TV station is. And then also just a world where there are only four or 5 channels, right? I grew up in Washington. We had channel four with NBC, channel 7 was ABC. Channel 9 was CBS channel 5 was independent. And channel 13 was PBS. That was it. That was it. And that's where you got your sports news was the local sports cast on the local news. So all of a sudden, this movie, which had been largely forgotten, was everywhere throughout the month of December because it was an obvious Christmas story when people are trying to watch it. I actually interviewed on my ill fated podcast. Carolyn Grimes, who played little girl zuzu, one day when she's older, she's walking past a TV store. She sees TVs in the window. And the movie's plan is she's looking at it and she's like, I could be mistaken, but I think I was in that movie. Like she had kind of it wasn't a big thing and she's like, oh yeah, I wasn't a movie. That's a wonderful life. So that's how the movie got to be rediscovered and then I think it was in the early 90s where they were able to put that Genie back in the bottle. NBC acquired the rights and so it has more limited showings. But that's how the movie really got reborn. And as far as the tweeting, you know, Twitter is what it is. And I think I was just watching it, and I just started tweeting about it and I was having a lot of fun and people replying. And so I don't know how many years I've done it, Chad. Maybe 5 or 6. And now, I live in California. So I have the problem of, if I wait till it comes on out here, then the holy coast is it's already over. So you know what I do? My father, the last few years, sets up like an iPad or a phone on FaceTime. And he's in Maryland and he puts it in front of the TV. So I'm watching the movie through my laptop on his device as his airing on the east coast three hours before. I tried to figure out if there's a way for me to do that from here, but you can't do that anymore, because of location. So I'll give a tip of the hat to lanny Davis for always being there for me with the FaceTime device and that's how I can live tweet on the east coast. And I have followed it and the replies and it's really for me as a nice way to experience the movie and then it's over and then it comes on the West Coast and I try to get my family to come watch it with me for a second time, but normally they have by that time they're sick of it. And sick of me, frankly. What's really interesting is every year the tweets are different, the takes are different, which is partly because this movie is just packed with amazing scenes, important messages that are sprinkled throughout the movie. You really can't take your eyes off it because something is always happening that's important that's going to play out later and that has something bigger to say. And so what's your favorite scene in it's a wonderful life? There's so many. I know. I always try to answer I'm gonna answer this as well. And in like 20. Yeah, there's a lot of them. I mean, I think the easy answer is Harry's toast at the end, which is you just, you know, just a mess. You know what comes to mind when you say that is the same early in the movie where a young George is in the soda shop with Mary and violet big. So first of all, it's one of the best lines in the movie where violence has to marry. He says, I like him. And then Mary says, you like every boy and violence says, what's wrong with that? But then, of course, remember George loses his hearing in his ear earlier in the movie when they fall through the ice. So he leans down and Mary leans over to the ear that he has no hearing aid. And she says to him, is this the ear you can't hear? George B Lee, I love you till the day I die. And I have put my kids to bed, my youngest in particular Gabriel is his name and my little angel. I'll put him to bed at night and I'll kiss him in alena's here. Is this the era you can't hear in? Gabriel Davis. I love you till the day I die. So and then of course the other one that comes to mind is I burped..

She probably be president today. I mean, that was that's been at the core of this. This this whole Republican and Middle America push. You know, people like, Well, why did she stay with him? Well, you know, I'm not, You know, that's that's absolutely disturbing. Because now it is me, too. Era that we're in. Now This stuff is coming out. More people are speaking up and granted. He did a lot of great stuff domestically, But I'm sorry. I just really just destroyed his family's legacy for me as a voter. Well, I without a doubt, I totally agree. And and it hurt. I think you know, I think Chelsea Clinton you're thinking about politics. And you know the Clinton name? Look, Let's be honest. When when, Um, you know, Clinton was not a liberal. He took. He stole the Republican Matt stole. But he co opted the Republican welfare reform and passed draconian, Uh, measures against welfare in this country made it really difficult for people to get social services that really needed it. How does being confronted with something like a very aggressive special prosecutor sort of shade the device or shade. The job look me. Get the softballs right. I've known bob muller. He was deputy assistant attorney general for the civil the criminal division. When i was white house counsel have immense respect for him but he brings with him all of the dynamic flaws of a special counsel office that justice scalia in morrison bills and described You set up a officer. Seventeen highly high-powered excellent hard-nosed prosecutors to investigate a single matter and i single a small group of people it is It is dangerous. It is something you need to pay attention to one bob. Mahler and his officer under aaron the fishbowl too and they're going to be second guessed to a fair the will of whether they investigated every facet of this that That ought to be investigated. They're going to be second guessed as to whether they've turned over every grain of sand. Not whether they turn over every rock and every pebble So it's it's it really changes the dynamic It is something that is also very difficult in a white house where you have the business of the most powerful nation. The world being conducted twenty four seven time to separate out the president seeking advice from people who who don't have a privileged relationship with who are not his personal council Is is very difficult to do. And you can in. An apparently with with a bob muller wanting to see the records from air force one When the browser apparently dictated a response relating to his son is an example of that it's really hard to maintain the the requisite discipline To keep the government business from the private business separate as i should be so you mentioned sort of obviously there wasn't a special prosecutor but but i really am quite aggressive congress and that was really interested in investigating a lot of different topics. Is that so different than something. Like a special prosecutor image. Did you feel that. That same dynamic player. Is this really something kind of different. I think this is very different. My one experience with anything like what he has described was the starr investigation of president clinton in that circumstance. I didn't represent the executive branch i represented. The congressional leadership represented dick gephardt in assembling the defense team in house and i went to the and represented the senate democratic majority during the impeachment trial so my experiences from that side of it but of course we could absorb it close quarters. I think many people could see around the country dynamic that ab describes here. There's an enormous amount of pressure on the executive branch. I can't find anything to disagreeing with. Abc's about the challenge must present to the lawyers. The one the one important legal issue. Susan is executive privilege of executive privilege visited the grand jury supreme. Watergate committee lost its subpoena for the watergate ticks. So the You do have certain. Executive privilege gives the white house a a defense that you don't have in these special counsel case or impeachment case i with his ab. But i think it's interesting. You water getting i. I think the winds have really shifted against the executive. I think that's a political cultural change. I think it's very difficult to go before the court with before court and And basically have the executive argue that on a matter involving the production of evidence that may be relevant to a crime that you know the privilege in effect. Trump's i mean i could be wrong about that but i think it's very very difficult. It'll be interesting to see whether any of these issues were served up. In the current administration both view in some ways had kind of easy clients in the sense that you both served under president who were really quite quite disciplined and quite concerned about Soliciting and accepting legal advice having any precedents as a client cannot cannot be easy they must all be sort of difficult plants in their own ways is the relationship we're seeing between trump and magana trump with trump and legal counsel. Is it really so unusual or no. When you're the president of the united states and your lawyer says things that you don't agree with you don't necessarily like. Is there always sort of that. That tension did you guys have those moments of feeling like god. Being the worst president is a really tough job. I was very fortunate because the president that i served was a lawyer. Not only was he lawyers a constitutional law professor. So i didn't have to labor to translate of the concerns that i had about the law in a in a language that could understand. We often took pride and this is just the way to work out this way. I'm not suggesting that every president has to be a lawyer a much less of a constitutional law professor but we took pride in being able to draft memoranda. Say about constitutional issues. We wrote them the same way. We would have written them for colleagues at the law firm or for the general counsel of a large corporation. We didn't have to go into an explanation of what it meant that there were different standards of review rational basis versus me. All of that well known to the client.
