I'm having flashbacks when we had that happened last time, and we had I mean surface streets, Shaft or traffic in downtown Seattle was like you couldn't move. So is this part of revived by five? Is that what this is again? They're not really classifying that as it but I mean, if you remember they had to put it on hold because they were lacking of the materials to do some of the work, So I think that we're trying to kind of fix things up before it starts to get rainy, and they can't do the work, So it's definitely something that we're going to watch for again. If you're traveling through downtown this weekend old Just don't It's really bad. Okay, Two lanes are blocked on north and four or five at 30th. And that's because this right here is really causing quite the delay outside of 167 now and heading out that direction, a wreck on the side on south and four or five at Coal Creek Parkway that's causing some issues and then south end of the Valley Freeway of 14. "Is 6 54 time for real time traffic. Here's Chris Sullivan and we are right at the first peak of the morning, and we're really starting to see things. The travel times hit their tops right now. Especially the worst of it is the rent of the Bill View Drive on the four or five north Beyond corridor. You're going to be on the brakes from 167 all the way up through 44th in Newcastle. 35 to 40 minutes to make that driving because it's so slow there in rent and merging on from 167 north down, has backed us up before 1/80. We also have earlier slowing. That's still there through the Auburn area, So give yourself about 22 minutes from Auburn to Renton. And about 45, maybe a little bit more all the way from the Sumner interchange on up. It's pretty heavy there on that transition from 1675 12 to 167 in the Puyallup area, the Tacoma drive by five. It's pretty heavy at this point, kind of off and on no matter when you hit it today has been pretty heavy there that you have some slowing towards Highway 18. And then you look at a 50 minute drive from the federal way area on up into Seattle, probably 25 minutes to South Centre another 25 on up into downtown. Out of the north end. We're looking at the slowing starting right around the Everett mall, and it kind of continues off and on. Not as bad as you might anticipate all the way down through the county line there. Give yourself about 40 minutes from effort to Seattle or ever to Bellevue, which isn't all that bad were slow across the trestle in the westbound direction. That's just volume. Same thing could be said for those of you heading westbound on five to to getting out of Monroe. Looks like we're really back into a normal traffic pattern. There are folks coming out of Monroe. That tribe has been of pre covid looking the last couple of days. Kyra Radio, real time traffic on the threes. I'm Chris Sullivan. Showers at the pass Our high Today in Seattle will be 73. "Apply here. I don't think former state Attorney General Rob McKenna, Rob thanks very much. Thanks, Dave. 6 53. It's time for Kyra Radio. Real time traffic with Chris Sullivan. How are things looking, Sally? Well, we've got some work to do as we approached seven o'clock as we reach our first peek of the morning. I'm going to start with the three mile backup that is slowly breaking up on eastbound 5 12. You should try to make your way over through South Hill and then down towards you all of the crash to started all this. I think it's just left to one police vehicle over on the right hand side, but either way We have some work to do there once you get through that Puyallup to rent and probably running around 42 minutes. Not all that bad. We've got about 17 minutes out of the auburn area, So we've kind of eased a little bit there on North found 167 north. Beyond I five into the Seattle area hasn't really been all that bad through the Kit Des Moines Road today. We do have slowing there. But it's not as packed in or as long as you might experience on some days, But we have some work to do. 20 minutes up into the South Centre area and then about another 2025 to make your way into Seattle. So about 45 minutes from February to Seattle were still working with the remnants of this crash on North found 99 right at the First Avenue South Bridge, which has caused some problems on 99 509. Of yourself a few extra minutes there nothing out of Redmond or is equal to get in your way. As you go west found over to Bellevue or continue across the lake. Really? Either on I 90 or on 5 20 out of the north end. We're looking really good. There is some slowing westbound on highway to getting across the trestle to effort. But it's not that bad. The heaviest slowing certainly right around the, uh, the Everett mall and then pulling away from Lynwood on both five and four or five is getting heavy. So About 40 minutes right now, But maybe trending in the right direction is the volume moves through there. So all in all word, not that bad of shape as we move on Cairo radio, real time traffic on the threes. I'm Chris Sullivan. Taking a look at the forecast today is going to be mostly cloudy in the morning and then partly sunny skies later in the days things open up high in the.

Meanwhile, back here in this Washington three days, that's how long it took for the legal battle to begin over the just past capital gains tax. Cairo radios Hannah Scott is live with us with details. Hi, Hannah. Hi, Erin. You also lawmakers passed the 7% tax on capital gains above $250,000 on Sunday. Yesterday, Max Nelson with the Conservative Freedom Foundation says they joined another team in filing the first lawsuit. Against what they call an illegal income tax. We're representing a group of plaintiffs from around Washington state. Yeah. The case was filed in Douglas County. A Superior court and we are arguing in short that the capital gains income tax proposal eyes unconstitutional, both under the Washington state and the U. S Constitution. Their arguments. We make several arguments as to why the capital gains income tax violates both the Washington state and the United States Constitutions. The primary argument for for Washington state is that our state Constitution provides that taxes on property have to be uniforms and our state courts have repeatedly held over the years that income. His property. And so any income tax that is imposed in Washington state needs to be uniforms. And that's not what we see in Senate Bill 50 96 targets specifically higher earning individuals or temple gains of over a certain amount, and it is not uniformly applied. And so we believe that violates the uniformity requirement for property taxes in Washington state. And specifically a to federal level. There's also a number of issues again, probably the biggest one eyes that it taxes. Sale of capital gains held outside Washington state. If the sale is made by by a Washington resident on we believe that violates the commerce clause of the U. S Constitution, which limits the ability of states to, uh, to pass legislation that has impact across their own borders. Now many wonder why they would even try this when the Democrats that is when the state Supreme Court has set clear president in the past, doesn't the court have to follow that court judges get to do with it with judges want to Diogo? Certainly, they're supposed to abide by past presidents. But obviously from time to time, they don't Esso again And once you get into the courtroom, there's there's no guarantees as to the outcome, But the president on these matters is very strong. And now it's It's also interesting to note that the Legislature went out of its way to try and muddy the waters with this issue. The Legislature called it an excise tax as opposed to a capital gains income tax. I don't think that makes a difference in the long run. It doesn't change the nature of the tax, you know all Every other state in the union in the I. R. S of all recognized that attacks on capital gains his attacks on income. No, no, I have not heard directly from any of the sponsors of this spill. But House Majority leader Pat Sullivan did issue a statement yesterday, saying that as far as these lawsuits, they're welcome to make their case. We assume that this will make it to the state Supreme Court. It is the position of the Legislature that this is an excise tax for that, Nelson says. Legislature can call it whatever it likes, but it doesn't change the nature of the tax as as a tax on income. But clearly the Legislature was trying to make this appear at least different from previous measures that have been struck down. Well. This was already filed in Douglas County. There's a second lawsuit on the way Hannah. People get fired up about this one. Yes, very, very, very passionate. About it. What? What was the what is the intended use of the of the tax of that tax money? This is going into the eye of a fair start for kids program. This is childcare. Early. Early Learning is the bulk of this, but then over overall, the idea is to start the effort of balancing our state's tax code. But the group that's going to be following the second lawsuit. They have some emails that they did some records request on actually think was Jason Russia over at the Washington Policy Center, who had Jensen public records request a while back, and he got some emails from a state senator saying that the reason the big deal why they want this capital gains tax past is because they wanted to go to court. And they want the court to revisit the decades old decision where they said income was property and thereby making this a any illegal income tax because everything had to be uniformity. It's a if it's a property, right, so that's what the goal is of the Legislature, and then that would be the door opening. Our income tax on all of us in the state. That's what they believe. The critics believe the ultimate outcome was desired. Kyra radios Hannah Scott, Excellent work has always Hannah. Thank you very much. You.

Okay, representative Terrorist. Simmons is the prime sponsor and as thief, first formally incarcerated state lawmaker believed in the nation. She knows just how important it is to fight for these rights. This bill is very personal to me, as a person who lost my right to vote due to a felony conviction is also too honored to be here today as a state representative. And honor that is directly tied to my ability to successfully re enter the community after incarceration and become a voter again, Simmons added at a hearing. There was a time where the person was convicted of a felony. They lost their right to vote forever. However, over the years, this state legislature has realized the social and racial injustice is inherent in these policies. Has made some progress in 2000 and nine the Legislature created a mechanism which is the current law today. It is a complicated process where an individual can restore their right to vote provisionally if they have enough money to make payments on their legal financial obligations and have completed the terms of their community custody. However, if they miss payments for their legal financial obligations, the prosecutor has the right to file a motion to revoke their right and that's a problem. But she's not alone in this effort. Several Democrats have had similar legislation in the past couple of years. But this time, Simmons snagged a Republican co sponsoring representative Jesse Young.
