"The truth and ultimately it's the evidence that makes the difference in evidence comes in all different forms. There's physical evidence you know. Dna forensics things like that. There are videotapes. There are eyewitness and then there's testimony an expert testimony. All of that is considered evidence in a trial. But in this case. I don't think it's going to be the evidence that determines whether or not kyle rittenhouse is guilty or not guilty. I don't think so because as we've explained throughout the course of this podcast the videotape is. What it is and people are seeing it much differently so i think this case more so than any other trial right now that we are tracking a court. Tv this comes down to the lawyers the prosecutors the defense attorneys and how they present this case because to me. It's about the messengers message which is an interpretation of the evidence which will almost be uncontroversial. There might be some discrepancies about a few things that happened here or there but generally speaking of videotape speaks for itself. People see what they see so to me it. It comes down to the messengers. And as i discuss with julie. J. the attitude that both sides brought to the preliminary hearing and is using in all the court papers and filings. That we have in this case. I think are a potential problem for both sides and their great lawyer they they may already know this and they're not in front of a jury yet but when they get in front of a jury i believe whichever side can bond can create that relationship of trust with the jury and to create that relationship ship trust. I think the jury is going to trust whoever they like more and it shouldn't be about that right. I mean trials shouldn't be about I liked the prosecutor more than like the defense attorney. But in this case i think that is so important who is going to come into that courtroom with credibility and with the personality and attitude that will somehow connect with the twelve men and women of the jury. I believe it will make all the difference in this case. All the difference and some lawyers may argue in every case that make the difference. I don't necessarily agree with that. I think there are cases where the evidence is overwhelming one way or the other and sometimes the lawyering and the lawyers are somewhat irrelevant.

"That they're going to bring in his game playing If he plays. Ps anything if he has any You know very violent video games. I suspect that they're going to go into his face but they're going to go to social media president presence as suspect that they're going to go to what he watches which he listens to so with that being said he was already on point to be aggressive. He's already looking for a fight. It don't take it. Don't take much if you are already prepped. You have your gun you have your you. You already have your defense. Why because it's already politicized people are telling people are telling you that they're rioters. You're not there. Kyle live there so the only thing he got was here say that there are writers. They were protesting. I protests people can protest but there were other people that were damaging property. best match. Your bag that's not your concern mikhail. Rittenhouse that's why we have police and at the same time people are saying hey You know people are having issues with the whole phrase of be fun but the police let me well an argument. That doesn't help is when you have defunte. were saying. Defend the police right. But the argument against it is that head. We need all these people but yet skill while we have this heavily regulated police department. How this heavily gist funded law enforcement. It took a child to cross state lines to help. Protect property like it doesn't make sense. Make it make more sense for me. What i saw was Truck light trucks like Army trucks swerve past this person with the our team on his side. Well here's what i was to say though. Is that all all. The police were nowhere near what was happening. The police were doing nothing to protect the local businesses of kenosha which were being torched and destroyed and going back again to the is hunting or his e going there to protect. It's going to be the testimony at the preliminary hearing about the first shooting of rosenbaum. Was that. There's a still frame from a video that exists from a distance. But the testimony was clear at the preliminary hearing that you had rosenbaum running after. Kyle rittenhouse the first shooting victim is pursuing. Rittenhouse so how again is that consistent with hunting theme of prosecutors because again if commonsense and say listen if i'm going hunting i'm going after the prey. The praise not approaching me this is. This is the problem when when when your victim is dead. They can't testify to wherever the defendant said so he cleans. He cleaned up that piece. That little piece of evidence. That could have helped. that's coming. That's the police officer based upon the video based upon the video. When i'm trying to tell you nobody runs. After people it could have been. There could have been some discourse. We don't have that information. Why because the victim is dead. No longer live and i will tell you this i do not care i..

"Who was essentially is just as glaring reflection on. Just how different the criminal justice system chiefs black black boys white boys so he had to do it was it was necessary and i felt that it was a good move. So how does this play at trial. Because i've seen the videotape. Okay now what i see in the videotape. Is someone running walking quickly then running and jogging away from a crowd of demonstrators. I see a crowd of demonstrators pursuing him. So how does that translate into. He is going hunting. If he's going hunting he should be going after them. They shouldn't be going after him. Why don't hunt. But what. I've looked would i would learn from hunters are that they prepare so preparing is getting. Your thirteen preparing is getting to the right place that you wanna be preparing is where your prayed. Liz where you're prey is going to be at. That's preparation the Putting yourself as a victim which we see that often. He has a whole. Ar fifteen he has a whole adar fifteen that means he has death right across his shoulder that he can release death at any point in time. And you're telling me that people it people are walking toward him. He has a ar fifteen probably trying to help him. At the end of the day. When i have a ar fifteen. If i have a fifteen and you have whatever the hell you have. Guess what i win. It's automatic. i went it doesn't it doesn't i don't care if you are football player. I don't care if you are lying bike law by linebacker. I don't care if you are bee's mold himself if you have. Ar fifteen you want. You won this battle. You don't hear any fears. And i feel like he put himself in that position. And that's why the prosecution theory is it makes sense because you have to start from the beginning you started from the strengh. The prosecutor is starting from his bedroom. The prosecutors starting from his facebook post the prosecutor starting from his instagram. the instagram groups. That's the planning part. He was hunting humans and goals to hysteria. And i believe that he's right. Well what if the testimony comes out and this is what it seems to indicate from. Some of the evidence that has become public is that his friend gets a call from his former boss whose business is being torched and police are doing nothing to stop it from being torched so the man who owns the business as a. I need some people to come and stand guard and protect my business because police are not doing it. They've got to stand down order from the from the mayor so.

"Tv podcast seventeen year. Old kenosha shooter kyle. Rittenhouse had preliminary hearing last week. That quickly turned contentious court. Tv's giuliani was following along and has a report on the fireworks among the accusations. Kyle rittenhouse was hunting. Humans that night is this a fair description of his actions. Attorney and friend of the podcast at mercy thinks so and tell us why this is the court. Tv podcast with vinny polygon. Welcome to the court. Tv podcast on any polygon. You know there are a lot of big cases that we are following tracking and reporting on at court. Tv and most of these big cases. There's there's a general consensus among the public. The way they feel about him. For instance the george floyd case there are people who are looking at that skeptically the chargers by prosecutors but generally speaking. There's a consensus. There's something wrong obviously happened there and that someone needs to be held responsible. You take a look at the case of the doomsday. Couple out in idaho and other huge case we're following and i think that's an overwhelming consensus on on what's going on there. I mean they may turn into the most hated couple in america but there's another high profile case where it is so different so extremely different the way the public is seeing this. This is the most polarizing case that we are covering right now court. Tv and will be probably the most polarizing trial when we cover it. I'm talking about the case of seventeen year old. Kyle rittenhouse now. There are two different ways to look at this case. And i'll explain exactly what i mean on the one hand. Some people see this case as a seventeen year old kid who wants to be a cop who is gets into car goes from illinois to wisconsin because he wants to confront people with his gun and he's going to do he's going to do and ended up shooting and killing two protesters right. Have these protests. Taking place in kenosha wisconsin. He goes there to make trouble to confront people and he ends up killing two people to demonstrators. That's the way one group of people see that story now. The way the other group of people see the story is there were protests in kenosha there were riots.

"Other people he was a hero and i understand john huber's view of all of this and i'm sure there are many who agree with him and perhaps there are many who were there that night. Who agree with him that he was a hero that he was going after trying to stop someone that they saw as a threat but there were two words that he said that i found very interesting. Because it's it's a word that we've used a lot before or phrase active shooter and his son is the one in the second shooting. He's one of the victims shooting. Who has the skateboard who strikes kyle rittenhouse with the skateboard and then gets shot and killed at that moment. Does the video demonstrate that he's an active shooter at the moment that Mister uber son is going after him no but he hit already shot and killed somebody and was now running down the street from so from john huber standpoint. My son went to a protest because he feels something he goes. They're armed with. What is voice an escape or this kid shows up with an ar fifteen. He doesn't have a grill passion. He's that he's there for a fight so from john hewer standpoint. This kid wasn't active shooter and his son was a hero because his son solid happened and now sees this lunatic running down the streets within fifteen after already killing one person so is boy goes and tries to stop them and he ends up to. It's a very legitimate way to look at the exact same video that other people look at and say no. This is self defense as poor little seventeen year old was caught up in something. You couldn't handle any. He had to protect himself. If the one the one fact. I think though that may help the defense here is when they say he's running away. He's running directly towards the police line because there was a line where police were not going any further and there was a line of vehicles with the lights flashing which was very obvious to everyone and it. Was you know within a short distance of where the shooting takes place. And i think that's a direction is going so there's been a lot of discussion about a citizens arrest being made here. But he's he's running towards police and to me the complete picture. Neither side is giving the complete picture when they when they describe what they're seeing. You know what. I mean where one side avoids the that. He's going towards police. The other side kind of avoids the part that. Hey he had just shot someone. So it's a fascinating case. The police component really is is Fascinating too because before there's video of rittenhouse. Talking to police officers is social. Media said no. He's he's dedicated to khaliq. He's a seventeen year old. Who wants to be a cop or at least loves policing and so his mindset is yes. I'm gonna run to my allies. Well guess what he in his mindset when he shows up there with his. Ar fifteen in his seventeen year old brain. He thinks i'm a cop or the bad guys. I am a good. He deputized himself and he was reinforced. Who was reinforced by his mother. The bomb they're reinforced by the person that gave them the air. Fifteen reinforced by those police officers. Who gave him water at. Thank you for your service. That's the mindset that this kid had when he was put into a very volatile situation that he couldn't have right and the other part of it is looking at it from the other perspective is he had just shot someone in self defense and the one thing all the cases that we've covered in self defence. We always say well all right. You've just shot someone in self defense. Well what did you do next. You know did you. Did you just flee the scene or did you go and find police. Did you go to police. I think what the defense is gonna argue. He just shot someone. he's now in danger because there's a mob chasing him and he's going to. Police puts his arms up approaches the police vehicles to try to tell them what just happened and the police because of all the radio traffic of all the insanity that is taking place in the streets that kenosha wave this kid off a gada here. Just get away from us. We've got to deal with something down the road that just happened. And what did you do next. Though any he went home are any illinois. He went around and say. Hey by the way on the guy shop to people you may want to. You weigh wanna talk. He went home and turn himself in. He went home turned himself into local police. So i this is going to be a tough. One is going to be tough one but bail two million right do any indication that through all these donations and everything that he might be able to get himself read on the two million dollar bond a half million dollars right now on the latest website that is accepting donations. So he's got a long way to go. All right. ted. Rowlands court tv anchor on top of it as always thank you so much as i mentioned folks carl rittenhouse facing the potential of life without the possibility of parole the rest of his life behind bars but he's claiming not just that all i'm innocent. I am the victim here so the question is in a case like this where the evidence is like this. Is this a case where perhaps prosecutors should reach out and say. Hey here's a plea offer a potential deal that we will offer you. You admit your guilt to something less than what we have charged you with here. You do something less than life without the possibility of parole and we resolve this case without a trial. Well should prosecutors do that up next..

"All the demonstrations and riots and things that have happened this summer. Very few cases related to this have bubbled up to the top as as cases that people have been talking about are widely interested in. Because there's been a ton of criminal cases that have come out of these demonstrations and riots across our country. But there's really only two that are kind of on my radar in a big way. One is the case out of denver involving a guy who was working security for local news station. Who shot and killed a protester. And he's locked up by did not get bond in. We're following that one the other one. I think that's even higher profile is the one that involves a seventeen year old. His name is kyle rittenhouse. he's from illinois. And there's a protest demonstration and riots. Taking place close by to where he lives but in a completely different state in a completely different city in kenosha wisconsin. And for some reason. I don't know. I haven't spoken to her. We understand that his mom drives him. He's seventeen drives him to kenosha. And someone in wisconsin gives him an ar fifteen and then he is in the streets of kenosha seventeen years old. I mean that's young. And i don't care how much training you have. How mature you are you know. Seventeen year old being in the middle of all that. And then within fifteen. And i understand. He's probably trained. Been shooting guns for years. But he's seventeen years old. I mean i have a seventeen year old so but that's not what the case is about. What the cases about now is what happened afterwards. Once he was there there was some violence that broke out and he ended up shooting three people. Two of them died and now he's been charged with murder. He's been extradited back to kenosha wisconsin. And he's now got a face these charges as an adult and he's facing the potential of life without the possibility of parole and the and i mentioned to people are dead by the way so he was in court this week and We got us some interesting interesting insight. I think into the attitudes and the case in the issues. That are going to bubble up through this one as well. And i want to bring in court tv anchor. Ted rowlands who's been following this very closely. Ted is my assessment right or am. I missing something. Because in all the protests demonstrations and riots there have been tons of arrests and tons of crimes that have taken place but really to me. This is the one that seems to be on top of the rest and we really have been talking about many others in the reason is because the facts of the case are Are different rate in. Most of the arrested took blazer people that went to the protest and did something wrong and were arrested and move. It is what it is. This is different. Because you've got a two sides here and you've got two different stores in two ways to look at the exact same facts With the video we just take the video. You can look at the videotape. Oh explain the video explained the video to folks who maybe haven't seen it. I mean i think you've seen it and and check the show notes folks because you can get access to all this stuff but described video. What we see kyle. Rittenhouse has an ar fifteen in his hand. He's running down a street in kenosha. There's chaos around him and some people are basically chasing him down and this is the second shooting which is widely always is. There is shooting. But it's not clear and it just doesn't have the same opportunity to absorb. The situation is the second shooting and in this video. Rittenhouse is clearly attacked by two people. Turns around and shoots kills one of injures another one. The question is was this self defense. Many people say that's absolutely self defense others say no he didn't need to shoot the other armed people. He put himself in a situation that created his issue So that's where we are. That's why this case is so compelling like the thousands of other arrests that were made at protests around with that right throwing bricks attacking some wine or you know whatever it is now. I want you to take a listen to mark richards. This is the attorney for seventeen year. Old kyle rittenhouse there in court and this is a first appearance and it's also a bond hearing so they're trying to figure out okay. What's the bond going to be set at. How much money does he have to post to get out of jail. Let's listen mike. Sciences seventeen years old his no prior juvenile no other record whatsoever he has ties. The community is father lives mma community. He worked in the community to self defense claim in. This case is overwhelming. It's i'm videotape. And under all of those circumstances. Three quarters of a million dollars. 'electronic monitoring is more than sufficient. We have no objection to non monetary conditions but at a certain point the state can bury their head and sand and in reality. Who struck might client i. Who attacked my client. I mr rosenbaum deceit might clients running down towards the police line when he's attacked by a mob. We're not talking about demonstrators. were talking about rioters. Who had ill intention their arch and fortunately they came in second all right ted so that's mark richards and he's painting a picture very clearly. Been very aggressive the defense in this case and putting their version of what happened out out there in the public domain. And they're saying he's the one who's the victim absolutely that's part of their strategy from the fighting extradition on this has been out in front and center. They've received donations. A gofundme page was put up. Shut down they now have a new mechanism for donations and people are literally donating thousands of dollars for his defense. That's a strategy. The painting the picture of this being a wonderful person is accurate. I mean you know he was. He loved law enforcement is a lifeguard according to his family. The reason he was there was because a family friend own the business and was asking for volunteers. And he said oh. Let me go. Let me go and mom took him to kenosha to be there to help. Protect a business. That's all well and good but two people are dead because of this kid and that's the reason he's sitting in that courtroom in wisconsin and that's the reason why The judge said sorry. You're you're not walking. It was less than a million in. It's going to be two million dollars bail bonds. What's needed to get him out now. During this bond hearing one of the victim's father spoke. And and i found this you know. There's there's anger and there's heartbreak in it's mixed together. And i understand it. I'd never had to deal with the tragedy that he is dealing with. Which is the loss of a young son which is the worst thing that can happen to a parent. It is the worst and he was able to speak and you can actually hear his pain but he also paints a picture of the way he sees what happened to his son rittenhouse. They've he's above the law he's been treated as such by law enforcement and so he believes he's justified in this case in for for him to run Wouldn't wouldn't surprise me In this defense self defense that is impossible. That is impossible. I don't know what part of the video you watch. But he already killed a guy shot him in the head in an tried to run and my son was hero. He tried to stop him and so did everybody else. He was an active shooter and he tried to fleet and my son lost his life.

"Photo court TV live over the air uninterrupted. If you're watching television with an antenna, just rescan your channels now to add court TV and go to court TV dot com to see the exact position and more ways to watch court TV in your area. So there is one more reason why the prosecution cowl Rittenhouse is going to be difficult and we've sort of dancing around it here throughout this podcast, and that is the politics of this case. Okay. The politics of the case and the way it is broken down where you've got one presidential candidate looking at it one way or another one looking at it a different way and the people who support those those different candidates looking at it differently, and that's a problem for prosecutors and let me tell you why. Because if if that's the perspective and that's the way people see it. That's a split. Okay, and that's a split. I know basically down the middle of our nation and basically down the middle of Wisconsin. Okay. So you're GONNA have a jury of twelve. and. Arguably, half the people will see it one way half the people will see it another way. Based upon their politics now, I know there's a jury selection process there's deer. But the problem is. You can't kick everyone off the jury right at some point you're going to end up with some jurors who kind of see it one way and some jurors who kind of see it another way and the reason it's a problem for prosecutors and not the defense is that prosecutors are the ones who have to prove the case beyond a reasonable doubt to all twelve jurors. The only way you get a conviction is by convincing all twelve of the jurors. Anytime a jury comes back and it's Eleven to one, ten to two, nine, two, three, that's a win for the defense. It's a win for the defense because defended has not been convicted of the crime. So this is just another reason why it's so tough to be a prosecutor. The only way you win the case is by convincing twelve, the defense can win the case by convincing one. Just one. And in a case like this, that is breaking down on on political leanings. Think about it, and even if you get Jersey I can be fair and impartial based on on on the facts of the case it's the way you see the world. It's not going to be lost on this jury that there was a protest in Kenosha and the protesters were anti police and the protesters amazing engaged in some rioting and the protesters may have destroyed some businesses and the protesters were supporting Jacob Blake and then you've got it's not going to be lost on the jury that Kyle Rittenhouse supports police that Kyle Rittenhouse said he was going there to protect businesses the cow rittenhouse believes in the second amendment. And that's all politics. All of that is the politics of the way we're seeing the situation in the world right now. and. If you end up with just one juror. Who was leaning one way? Who sees the case through that through that filter? You can't get a conviction. nope. nope. No Self Defense Second Amendment, they'll come on. Can't do it. That's why it's such a challenge here. That's why I think it's a hard case, a difficult case, and maybe as Monica was saying, maybe this ends up somewhere else other than first degree murder. And when you have jurors that can agree one of two things can happen. One is you get a hung jury and you come back you got to do the trial again the other thing that can happen is that jurors can go back and forth and negotiate amongst themselves, and if sometimes there are lesser included charges so you have not guilty on one end. You have first degree murder on the other end but in the middle you've got you know reckless homicide, which is it's not murder it's not intentional, but it's it's something that is not not guilty, but it's something much less than intentional. Killing of another human being this premeditated this. This I intended I wanted to take a life I wanted to take. That's why I was there. That was my my mindset versus maybe I shouldn't have brought a gun. Maybe I was being a little careless maybe I was being a little reckless and it happened right. So that's why for prosecutors say it's a challenge always talked about what they're charging what they really believe it is. And prosecutors should only charge what they really believe happened here. You don't. You never bring charges that you don't believe you can prove that you personally do not believe in. Okay. So prosecutors in Wisconsin believe they can prove first degree murder and they believe this is first degree murder. So when I say this is a tough case that's what I'm talking about now could something Happen here perhaps, but the challenge here in a case that is turned. So political in a country that is so divided in a state like Wisconsin that is so divided. And remember if this case ends up in Wisconsin which I think it will at some point, it may not be heard in Kenosha it may be heard somewhere else. And think about. The whole jury process here in selecting this jury and going through their social media posts and what did they say about this? What did they say about that and you know who? who were they? Who are they leaning for for President? Who are they? What are they posting politically the attorneys on both sides you're going to be all in that. And at the end of the day, you can't get people. People will not be kicked off the jury merely because they voted one way or another. Or they see the world one way or another. The only way they get bounced by the judge is if they can't be fair and impartial if they can't put aside any preconceived opinions that they have about the evidence or the case, put them aside and base their verdict solely on the evidence presented in the courtroom. So this is a challenge above challenge I'm not saying it can't be done but it's GonNa take a really good prosecutor. It's GonNa take some incredible arguments. It's GonNa take. Some amazing examination of witnesses and cross examination of witnesses and you're going against the defense team that as we've been saying is. Aggressive. To say the least, they are not going to give an inch they're going to press press press. So we shall see again this is a case we will continue to track continue to cover on court TV, which is always folks your front row seat to justice it's not just a podcast is a website court TV dot com where we'll have lots of articles about. "Wrong situation. This is a gun toting police loving young man that is looking for trouble because he wanted to be strong and show that he had power and he found trouble and he found trouble in a big way. So I, think when the prosecutors starts with that story and then they have the video. It's not going to be as difficult as you think. Well here here's the problem though let's start with. There's three shootings. There's three victims right I one Joseph Rosenbaum, he's thirty six years old first of all, and there's video of him from that entire night antagonizing people. So the defense is going to be able to show this jury exact exactly who Joseph Rosenbaum is and the attitude that he was displaying before he got shot and then they have to concede that it was Rosenbaum and others who were trying to take the. Gun Away from Kyle Rittenhouse, they had him cornered then there's a gunshot take that is fired behind Kyle rittenhouse before he ever fires his gun. So he hears gunshots which he recognizes then he turns and you've got this group of people including Rosenbaum who are trying to wrestle the gun away from him. They've already threatened him and now they're trying to take his weapon. So now you've got a case where you as the prosecutor have to prove beyond a reasonable doubt that. There was going to kill these people I wanNA murder them or am I concerned that someone just fired a gun behind me and now these people are coming after me after threatening me trying to take my gun from me. Once you tried to take someone's gun that gun owner or that gun possessor? I. Believe has a good argument for self defense to use that gun. Yes. Sure. Typically that would be a good argument and there's no doubt that the victim in this case or not you know the altar boys right? They were there. At the protests that they were voicing their opinion they were you know going after him. So to speak you can't get rid of those bad tax in a good prosecutor will be able to know I can't get rid of these bad facts. You don't have to like the victim. You don't have to liked the victim did but he did not deserve to be shot and they did not deserve to be killed. Okay. Now the prosecutor is going to focus on it doesn't matter if they antagonize him what matters is he showed up he. His home, he went to another state to come to a place that's already in turmoil with a big gun with the intent to cause a problem to patrol to protect play cup to play vigilante. Right just like George Zimmerman used to back in the day. Right he did this on purpose. So it doesn't necessarily matter what the victims were doing right now the victims are trying to take the gun away from him. Well. Heck. Yeah. Wouldn't you got the seventeen year old waving a gun and acting like you taught stuff I would want to try to protect myself and get the gun away from him too. So now that being said, I think, I agree intentional homicide is tough tough. I don't think he went there like you said with a plan for murder but the reckless homicide I think a no brainer because the way he taking a gun to protest like. There's no doubt he records. He was running. He was acting like he was a big guy on campus. Yeah. No problem with the reckless comments I I have to give it to you vinnie little tougher. Okay. So now let's get to the next victim because you're saying he's acting like the big man on campus he's running literally running away from a mob that is chasing him and there's video. Clips right to be the big man on campus. Okay. After the first shooting now he is is he tries to render aid. But he's then surrounded by more people, he's in fear of his own safety. So he is now retreating and running away and literally running from a mob as he's running down the street away from a mob he gets smacked in the head by one person then trips and falls on the as the mob is descending upon in the head. The head, his his hat flew off. How do you know it was actually smacked in the head while I will let let the jury decide is they look video that I saw I don't know which one you were watching. The one I was watching had then he calls in the street and this is crystal clear as he falls. Now, the mob is descending upon him and they second victim Anthony Brewer. Smacks him in the head with his skateboard and then goes for his gun. Maximum head with escape boarding goes for his gun. Again, you're going to try to after you've assaulted someone. Now you're trying to wrestle his gun away. I I don't see how it's not a reasonable argument to say self defense there, and again, the defense doesn't have to prove self-defense. It just has to be a reasonable alternative. It's the prosecution has to prove that it wasn't self defense, and that's where I see the real challenge is especially with victim number two here. I agree with you that there is definitely a challenge there but I think it's a challenge that the prosecutor to get over if the prosecutor is very careful about the jurors they get on that jury and does a great job setting up the theme and the theory of the case that here was a person that was trained act tougher than what he was taking a gun to a fight knowing full well that he was being reckless. And he intended to cause problems during his mind protect people. But again, he's not a police officer. So if you get the right people in on the jury Benny I think they're going to look at that whole skateboard incident and this guy the victim trying to take the gun and say you know what the defendant got what he deserved, and he did not have the right to turn around and do the entire sequence of what happened. All right. You talked about bringing a gun victim number three has a gun and brandishes a gun and points the gun at him. So, if someone is pointing a gun at you, I, think you're allowed to use your gun on them and this that. Aggressor. argued. Kidder is going to argue that it was written house that was the aggressor. He's the one that brought the big gun gun to the fight from a hallway. Here's. The size they're not conceding that he brought the gun from Illinois. Japan. So whether Wisconsin not right. Content. Another state. The third victim goes towards Rittenhouse. Okay. He he lunges towards Rittenhouse and brandishes the Weapon I. I, think that's another tough one. Now, this victim thankfully survived. So he's going to testify about it, but that means he's got to be cross examined. Why did you have the gun? What were you reaching I? Why are we reaching for his gun? Why are you going to have to? Why are you chasing him I mean More. You've got this victim now being able to use self defense because here's this that seventeen year old right. This young man that came from another state and had a gun somehow miraculously not from his state from somebody else I feel like he was the cop brandishing it using the big word that you have there the big law enforcement word you know showing it around, and now with this guy did victim but has the right to show the gun and to say, Hey, knock it off right and then he ends up getting shot I don't know of any I think I it's a tough case but I think the prosecutor has enough as long as they get the right juror jury in those. Ha. Monica Lindstrom. Great to have you here but you mentioned the jury. We're going to talk about that in just a second, but I want to thank you for coming on the program I. Think we can agree that the murder charges. So this means I win folks the murder charges we're going to be very difficult. Correct Then you're going to see very. Well you gotTA. Let me speak. Yes I'd say reckless and I'll say sometimes I have to let you win some battles so that I.

"Podcast. Thanks so much for downloading and listening on Vinnie politician former prosecutor with you. Also, the host on court TV's show every night from eight to eleven on television. So we've been covering a lot of these stories throughout the entire summer, and one of those stories we've been covering is out of Wisconsin and it started with a police shooting of a man named Jacob Blake and you. May recall this video that was taken by a citizen Jacob Blake kind of rounding his car or not his car, his fiancee's scar rounding or his girlfriend's car or is ex girlfriend's car or victim of his alleged crimes car it's not clear folks. It's not clear a lot in that case is not clear anyhow as he's walking around that vehicle and trying to get in, he gets by police he does not die. He survives and he's been charged with the crime in the investigation into the shooting of Jacob play us. So we're waiting to get some results there on whether or not anything will happen to the officers for shooting Jacob Blake. But in the in the aftermath of that, there were a lot of protests in Kenosha. Wisconsin, and these protests got very dicey, very violent and at the end of the day. Two people died and seventeen year old has been charged with their murder seventeen year olds. Name is Kyle, Rittenhouse. He was not even from Kenosha wasn't even from Wisconsin he's from Illinois, and after the shooting that night in the street, you may have seen the videos of it. He was not arrested that night and Went Back Home Illinois where he turned himself in well now is in Illinois and the folks Wisconsin obviously want him extradited hasn't been extradited yet, and there's a lot happening in this case and court TV crime injustice reporter Gina has been on top of it and covering it for us. Juliette. Thank you so much for joining us. Glad to be. Here. Okay let's start with a Kyle Rittenhouse. He charged in Wisconsin and the charges in Wisconsin are murder and they want to charge him as an adult correct he seventeen but they want to charge him as an adult right first degree, intentional homicide, two counts of that. But also he injured someone in that shooting and he had a dangerous weapon under the age of eighteen, which is against the law and Wisconsin. All right. So he's facing those charges, but he's in Illinois. So what's his status right now? Where is he and is he locked up busy in adult jail juvie jail? What's going on? Right now, he is in Juvie jail as called June out attention. He is behind bars. He had been ever since he turned himself in day after that video everything that we've seen the shooting how it happened held unfolded there different angles. He then went home past police. Arrested and he went back thirty miles across state lines to Antioch Illinois and the next morning after he went home with the sleep, got up the next morning turned himself in and has been in detention center ever since he is they're being held as a juvenile. So ex can't even find is information on the online docket because it is sealed. Right, juvenile records it's like family court everything sealed. It's not it's not open. Like many of the records are so this. So now there's a hearing, right? So. Wisconsin wants him Illinois wants to send them there, but his attorneys are finding it I want to play. What John Pierce one of his attorneys said in the in the last hearing that had in this case, this again is the attorney for the seventeen year old Kyle rittenhouse clear your honor. It's no secret that this is a very unique extrordinary situation they're massive amount video evidence that shows that there's a shadow of a doubt that this is not legitimate. Criminal Prosecution is a political prosecution. There are serious issues with the extradition paperwork that in fact, bolster the suggestion that this is a political prosecution. These papers were were sent directly to the governor without us even getting a chance to look at them in the first instance without any notice. Is, no reason to rush there there is danger to this to this detainee there there is a presidential candidate in the heat of arguably the most heated election perhaps ever certainly since eighteen sixty s inflame the situation and recently asked that that that this detainees due process rights be observed. So we can challenge this in a proper way and ensure that this is illegitimate criminal prosecution and not something else all right Julia. What did what is John Pierce and Kyle Rittenhouse is defense. What do they want to happen here? What are they? What do they want the court to do? They want the court first of all to rule on writ of Habeas Corpus that they have filed challenging his arrest. The fact that he's behind bars, the fact that he's a minor they say also plays a role in this and he's got really savvy legal team. They brought up two separate issues that they have with this arrest I. They say the extradition paperwork that was used to try and get him from Illinois back to Wisconsin. Is Missing a signature and it doesn't meet statutory requirements without that signature and they. Say It involves some false statements that were obtained in order to get not only the arrest warrant, but the extradition documents say it fails on that and also they say that Illinois shouldn't be able to be compelled to send a minor over state lines when his constitutional rights are being violated vis-a-vis. This warranted they say is an improper and say Illinois would be an asylum state so that right now is. Still, in a holding pattern, he's not out of Illinois yet and it's been almost two months since the shooting happened it's fascinating because in most of the cases we cover Julia even even overseas sometimes, it becomes very easy to extradite someone within the United States all the states have an. Inter interstate agreement that they'll send detainees they'll send inmates back and forth, and it's and it's almost like a pro. Pro Forma kind of thing you just go into court and it happens most of the time they wave it but they're going to fight I. think they're going to fight every bit of this case. Don't you get that feeling from this defense team that every issue will be fully litigated that every they're not gonNA leave anything unturned they are not going to concede one inch in this. In anything tells us that extend video that they have already put out. We're in TV and it takes us some time to put together a really good piece and they put out a video for our listeners. You are not familiar with it. Produced video that walks you play by play through what their defense is going to be. The self defense that they are claiming is attributable to their client. They show you the angles and then they had these corruptions on the screen with all of these definitions of what's going on in why it absolves. Kyle. Rittenhouse why he's a true American why he's a Patriot why you should support him and they say this is actually even going to help with him in his fundraising and his legal. Defense Fund so. Defense team that is on it like that is already an indication that they are going to fight tooth and nail when it comes to this case. Absolutely. It's turning this case when you look at the reaction on social media and other places. Is Very political and it seems like people are taking sides depending upon their politics rather than looking at the straight up facts and the law in the case Pierce even mentioned it, and that statement he's saying one of the candidates had weighed in on it. He was talking about.

Okay, let me go a step further here all you're doing. Killian is saying I'm not being factually acted because I'm going by What the D A said. And what? The charges that have been filed. Hold on a second. Hold on a second. I She's not gonna let me talk. Alright. That's fine, Kellyanne. If you want to listen to see here's Here's what we're talking about here. We're talking about attorneys, right? And I brought up the OJ Simpson case for a reason. I guarantee you that Kellyanne thought that O. J. Simpson was guilty on Double Burger chart. She basically just said that, but O. J. Simpson's attorneys and I bring it up this case. I think it's important was a very divisive case because you're treading on your argument. If I could please you are incorrect. Okay, fine. You the attorneys? Can I finish my mission here is do you want to interrupt me again? I'll give you a chance to respond. If I could just please let me finish my thought. The reason why bring up O. J. Simpson is because OJ's attorneys still to today say that O J is innocent. And he was not on the scene of the crime. Does that mean we should believe every attorney that's defending their client? The answer is obviously. No. I don't believe any attorneys in this case. You know what I believe? I believe The evidence and let's wait and see what the trial is about to be charged with. Was he charged with transporting illegal gun across state lines? He was charged with the answer's No. Okay. Can I ask why he can't get an answer? And can I answer you? Because he got the gun? Can I answer? You got the gun from a friend in Wisconsin. Okay, Here's what? I'm not bring the gun from Illinois to whisker. Let's just say you're right. I am right. Let's just say you're right that I finish my statement the sentence If I may, he's charged with first degree murder of two people. Okay, thank Yu 257536. Let's go to Steve. Steve is next on the Vegas take on from Illinois to was what's up, man? What's on your mind? What's up? Steve ran a lot of color. She said that he went over there. Help clean up. What did he use his guns and his clips. Now there's pictures of him actually cleaning up high school with her video. Really? Yeah, there is. All I thought was a coward running down the street going gun didn't look. There was one guy chasing number. He knew he would get tasty. If his Steve Here's what JD is referring to JD is referring to a video that surfaced in the days earlier where he was cleaning off. Graffiti it just no, it was. It was earlier that day. Okay, Well, that's not according to what I saw. But even if that is the case last I checked. I didn't I I saw him with assault weapon that night, right, Steve? Yep, That's exactly right. That's doing that. You go from carrying a broom to carrying an assault weapons killed people. Yeah, that's exactly what I don't agree with that What he should be prosecuted and his mother should be a problem. I agree, Steve, I'll say that Steve and I appreciate the phone call. I'll say this. He has been charged with two counts of first degree murder. Okay, so we'll see what his mother took him within a legal weapon drove him across state lines, and he committed a and and what took place took place. She would be charged with Brian. The fact that she isn't charged Colorant House was given a ride from his mother from Illinois to Wisconsin, which, like 15 minutes away while he was there someone he met up with gay from that weapon because of how under siege the city was. And why did that happen? Because the governor of Wisconsin Tony Evers, did not did not give the amount of National Guard support. That the police chief and Kenosha requested. Okay, so I'll say this. The Wisconsin law It says very clearly that he was too young to carry that weapon and you weaken talk politics. All we want to because we got to take a break. We could blame Democrats. I'm not surprised you're doing that. But the bottom line still stays the same. Just because you disagree with the Democrats. Politics does not mean that an ignorant mother should drop her seven politics. The decision. He is different, okay..

"After the shooting of Jacob Blake in Kenosha Wisconsin, there's riding in the streets. There's there's fires there's businesses being burnt down, and somehow some way some informal militia was formed or communicated. I. Don't know WHO's through social media, how they all got together. But all of a sudden, there are bunch of of guys and I, don't think there were any women I didn't see any. From the videos, I looked at a bunch of is with. The calm long guns at a are fifteen, some had and they were in Kenosha while the demonstrators slash rioters or in the streets and they are protecting businesses. But inevitably, you know it's GonNa happen there's going to be there's going to be a conflict and there was and it was deadly and now a seventeen year old isn't kyle rittenhouse a seventeen year old from Illinois is now charged with shooting three different people. Three different people. He's seventeen years old I mean. Wow But. Let's get beyond and Michael is still with us. Court. TV, Anchor Michael had I think another discussion for another day. Why seventeen year old is there I wanNA. I WANNA save that for another time because that's going to send US A. WE'RE GONNA run out of time because my producers going to give me a rap Q. Right because because that's the way he is. So I want to focus on the law here and the Law of self defense. Okay. Based upon these three shootings and the reason why is I heard attorney speaking and his attorney came out and said, this is a clear case of self defense. So self. Let's talk about it. So cal rittenhouse seventeen years old..

"Or legal world of law enforcement. So it's difficult but this is how I feel. So you talked about more information coming out right. So the video comes out I on Sunday and obviously there's there's that reaction that you spoke about to the video. Let's take a listen to the Attorney General of Wisconsin filling in a few details surrounding all of this not A. But a few of the details during the incident. Officers attempted to arrest Jacob S Blake Age twenty nine. Law Enforcement. Deployed Taser to attempt to stop Mr Blake. Up at the Taylor was not successful in stopping him. Mr Blake walked around his vehicle. opened the driver's side door. And leaned forward. While holding onto Mr Blake Shirt Officer Rust and Fired his service weapon seven times. Officer Shatskikh fired the weapon into Mr Blake's back. No other officer fired their weapon. The KENOSHA police department. Does not have body cameras and therefore the officers were not wearing body cameras. Okay. So there are some of the details and not a lot of details, Michael, which is interesting but more details or alleged details as what I'm going to call them came from the police union because the Police Union as we know as a union to represent the interests of the police officers involved but they came forward and released a statement and put a lot more into it. So I wanted to walk through that and ask you a couple of things I. The first thing is. You know. How much weight do you give a statement coming from the Police Union and the number two? Let's presume that the stuff is true and we're just presuming for the purposes of what does it mean if what they're saying is true right because I think it's going to be contested. They say the were dispatched the location due to a complaint that Mr Blake was attempting to steal the callers keys. Vehicle officers were aware of Mr Blake's Open Warrant for Felony Sexual Assault Third Degree before they arrived on scene. Okay. Let's let's first of all. Let's answer the big question as we go through this entire police union statement, your thoughts about the weight at this point should be given to the statement. You know police unions in this country as we discuss some of the issues surrounding police departments across the country least unions have been cited as one of the major problems. They will back and protect their people almost to a fault and what we're finding is that a lot of their attitudes towards the people they are policing are not necessarily positive. So how much weight do I give it I? Give it very little weight. I don't know where getting their information from I. Don't Know Wall of you know how they have come to certain conclusions. If you noticed throughout the document, they're using inflammatory words that have they could have chosen different words. So they're trying to paint it in the direction that serves their client because I consider the police in this instance, their client. So it's the same weight I would give a defense attorney's statement I mean that they have a purpose in releasing it they're trying to accomplish something and that's to create a narrative that works for their their client. They're they're the folks that they represent and that's how I look at. Okay. Absolutely. So as we go through this now though I want to want you to go against your gut right and just let's just presume that these facts are true and what they mean legally to the case and the investigation and whether or not..

"Looking at all of that was an interesting situation. You saw the same papers I saw on, uh, hey, was trying to get away from them against looks like any fell on Then they very violently attacked him. And if there's something that we're looking at right now, and it's under investigation, but I guess he was in very big trouble. He would have been, I probably would have been killed. Er, it's under investigation. You notice that called Kyle Rittenhouse Vigilante? As I know the story. He was already in Wisconsin. He did not bring a gun across state lines. It was already there when when he got the rifle he was going to supposedly help. Oh, and just got his med kit and everything else. I don't know the dude. I don't know his real intentions. I do want to know what a 17 year old was doing there. A 17 year old was doing there with the rifle at that place. And if you say to me what does that matter? I'll save us 17 and maybe you need to take a breath and get yourself some fresh air, Maybe a cool drink and reduce the vapors. Maybe that's what's necessary here. Don't Don't lie to me. Don't don't kid yourself. That would be that would be foolhardy. Absolutely foolhardy to do. But it doesn't mean that he wasn't defending himself. And it does not mean he was a vigilante. This is mythology. And the press is apoplectic that Trump is even saying anything.

"He was very critical of as he put it women and especially minority women who are single mothers who have more kids so that they can get more welfare payments in many ways. He's a throwback to Reagan Era Republicans any he talks a much darker message in his district than he certainly did on stage in front of all those American flags. So the protests, we've been seeing this summer continue police shootings, and the conventions been taking place against the shooting of Jacob Blake a twenty nine year old black man by police officers in Kenosha Wisconsin and these protests like those across the rest of the country have been largely peaceful but on Tuesday night three protesters were shot two of them fatally and ten year old Kyle Rittenhouse has been tape has been arrested in connection to the deaths and has been linked to right wing militias and previous trump rallies. Talk a little bit about that. The theme of protests, how the police shootings and the protesters fit into the trump campaign and the message they are broadcasting. You know it seems to me Donald Trump is playing the hand. He's got. He can't talk about Kovic because that has gone badly he can't talk about the economy because that has gone badly he can't talk about how? He is replaced the affordable care act. What he's got right now is as he likes to say in all caps line order and the protests recently in Kenosha just up the road from Chicago very much play into his narrative that the cities are awash with anger and hate and violence, and you'll hear we have heard throughout the convention This notion that boy under Joe Biden things would be ever worse. These democratic mayors have lost control. You need me Outta trust me to to fix things it's very much the American carnage message. is in he did announce that he would be sending federal law enforcement into Kenosha to restore law and order as he did out in Portland, which didn't go entirely as he had hoped, it would. He did say that yes, and last night at least the protests in Kenosha were quite peaceful. Twitter is trump's most effective weapon. I think it's safe to say and you I know have been closely following his feed. Could you talk a little bit about that and how representative that is of what's been playing out? Yeah, it's it's entertaining I guess is that the word to to watch trump on twitter but also maddening? If you combine trump's twitter feed with the trump campaign's daily email barrage you get a message of venom victimization. You'd think they were at the Alamo outnumbered not the ones who are actually in charge of of the country and pretty much holding all the levers of power. The mainstream media does talk a lot about fear and how trump stokes fears and how effective that is but we probably should point out that show. Biden. Who accepted his nomination last week with a speech all about love and unity. His campaign hasn't been versus stoking fears either about the dangers trump poses to American democracy. You know whatever you think about that he has been making that message very clear. One assumes it's mostly a tactic to fire up his own base but how are republicans responding to this apocalyptic view of what might await us with a second term of Donald Trump? Will we know from many trump supporters that they're all in on this notion that the mainstream media, the liberal elites all of these.

"Is Kyle Rittenhouse. Be interviewed believed my daily caller before the shooting incidents were you doing out here obviously are armed and you're in front of this business We saw burning last night. So it's up. People are getting injured our jobs protect this business. My God, There's somebody hurt. I'm running into you. Hard to understand, but I mean, he was there with a number of others who believe that was their job to protect businesses. Uh, you know, Oh, at the at the very end of the last clip, you could hear the police unit on you hear the horn of the police on saying is someone injured that way? What you can't hear is what you see on the video, and that is Because the person is capturing the video of the civilian. That's Captain video keeps the frame on on Kyle Rittenhouse, and he puts his gun down, still has it on him, still has his hand on the weapon and walked toward the police units. And walks right past them as the police units, you know, go to take care of the injured. I don't know if they're not clearly not aware that the person that fired the shots that caused the injury is walking right by them. S so it's a It's it's. It's a whole lot of mass. Carl. You know, the interesting thing here, though, is that you have people who are well intentioned and this is what we have said from the get Go. You have law abiding Americans who are watching this on TV and say This is wrong. The people's businesses should not be destroyed. That people should not be attacked in the streets on that the police clearly you're not being supported and given the go ahead to do their jobs. So you know, I've got to get out there and help. I've got to do something. This is not right. These are not people there to burn down buildings to steal Nike shoes. Tio Lieut. These air people who literally just want people to leave businesses alone and leave others alone. I'm sure if you asked these individuals do you support people's freedom of speech to protest? They'll say, sure, but not to burn down buildings so the motivation may be genuine. It may be good, but We've said this from the get go. My biggest concern here is that when the police are not allowed to do their jobs, Maura people will be hurt because the looters and the violent rioters will inflict damage on innocent civilians. And people who think they're doing the right thing are gonna end up not doing the right thing because they're not trained. This kid probably thought And we've we've educated people on the show that you're not allowed to shoot someone just because they're stealing from a store or or if they're lighting something on fire. Unless you can show that you are in imminent danger, and that you are simply defending yourself. You're not allowed. To use deadly force. And so that's why this kid this kid ate 17 years old. This kid is facing charges. What he did was wrong. What he did was a crime and from what I can see right now, it's likely that he, you know, shot this guy thinking that, you know, lighting something on fire and not complying with my command. To stop lighting it on fire is justification for me using force to protect the property. No. In the law. You don't have a right to use deadly force. When property is at risk, you could only use deadly force when people's lives. Are at risk, including your own. So that's also very long. Wisconsin. I don't think extends to your right to go on someone else's private property and draw Eso open carry its open carry. Okay. I think you're thinking about the castle doctrine, which is you can defend your home and your property to separate things. One is you're either his home's always property. He's he's itself aborting. The self important himself. You know, some kind of a A soldier protecting the streets of Kenosha. That isn't what he is, and we've raises concern with others. And now it's come to pass. It has now come to be a reality. Your thoughts on this sad incident 806 100 Kogo 806 105 646 at Carl DeMaio at Lou Penrose. We gotta talk about Biden's response as well as the Democrats.
