Another government shutdown has been passed by the house and Senate. As Kristen Holmes reports. The president is expected to sign the Bill today. He's also expected to declare a national emergency to secure funding for his border wall. The as our Eighty-three congress passing a bipartisan deal to keep the government open emotional reconsider is laid upon the table sending the Bill to the White House. He will also be issuing a national emergency declaration at the same time. The White House announcing President Trump's attempt to fit your funding for his border wall through a national emergency at the border. In a statement saying the executive action was taken to quote, stop the national security and humanitarian crisis at the border. The president is once again delay. Covering on his promise to build the wall. Protect the border and secure our great country you first of all it's not an emergency. What's happening at the border Mana -tarian challenge to us. The president had complained to allies that Republican negotiators were outplayed by their democratic counterparts. Good deal. Includes one point three seven five billion dollars for fifty five miles of new border barriers funding for seventy five new immigration judges as well as money for humanitarian aide, improved technology at the ports of entry and hundreds of new customs and border protection personnel. The one point three seven five billion dollars secured for border barriers far below the five point seven billion. The president originally demanded some Republican senators raising concern about declaring a national emergency. And concern that we've got is is that we not set new precedent? I'm disappointed that the president has chosen take out this through in Washington. I'm Kristen Holmes. Until jimbohannon has more on the matter and what's happening at the White House today at ten AM this morning eastern time. President Trump is expected to sign that budget deal that was worked out on Capitol Hill and at the same time declare national emergencies as regards one of several laws that could possibly be invoked opening up a thicket of judicial and and other potential responses some of them even legislative so this is far from over. Let's talk a bit about where we stand with Ivan eland senior fellow at the independent institute online at independent dot ORG. I guess only thing we know for not even that not for certain, but ninety nine point nine percent certain Ivan is that there will be no federal shutdown on Friday night. Well, you never know what Donald Trump is going to do. But it does look like it. He said he's going to sign the Bill and declare a state of emergency. That's pretty straightforward. And if he if he does with that then. That's what it is. But the the real question is what will he used various military laws that he can he can invoke and that sort of thing. So have to see what happens. There are going to go to court. The Brennan center for Justice in New York University school of law, not exactly a conservative hotbed, by the way has identified one hundred thirty six federal statutes that which presidents may use in declaring a national emergencies of which they cite four that they say would apply to the border wall. And again, as I say, this is a a group that is not predisposed toward the president's point of view. So at least in the beginning, it would seem that the president has some legal footing on which to go down that path. Oh, yeah. I think certainly the lawyer's dream just pick the law that you wanted to make probably been working on this for a long time because he's he's had this in the works for a while. So I'm sure they'll have their legal ducks in order, but it's probably going to be there's probably going to be a lot of shoot from around the country. Maybe even from my answers down on the border. So I think this could be tied up in the courts for a long time. And of course, you know, we don't know how that's going to end up the Muslim ban or what started out as a Muslim banner during the campaign went to a ban travelers from seven countries. There was a lot of suit sprinkling suits, all over hoping that one court would notify it and hold it out. Which is what eventually the supreme court. Let it go approved it. But of course, it was delayed by a couple of years well about a year or so. Before before that happened. So I think the strategy will probably be too. In addition, the there are legislative actions, which can apparently be taken there could be under at least a provision of the national emergencies act of nineteen seventy six apparently a resolution. A simple majority in the house of the Senate could could block such a presidential action, and it would appear that in the house that'll be easy enough to get. But in the in the Senate, even there there could be enough Republicans that that could very well. Get in the way of the president even from his own party. Yes. And the people don't want to go on even if it doesn't pass in the Senate to the resolution of disapproval a lot of the Republicans don't want to have to vote on it in the first place, but it could pass because Republicans are uncomfortable with. At least some Republicans are with the fact that if Trump does this, you know, this could be a precedent for Democrats doing the same thing on environmental style or a gun or whatever democrat. Although, of course, and of course, this was cited by by Nancy Pelosi on the other hand, the president doesn't really have to be said this is not like a court ruling in which presidents have some weight. Certainly you could have this done by a liberal president declared a national emergency because everybody doesn't have health insurance at that would be regardless of what President Trump at this particular time while you're right? It's only a customary president, we shouldn't say, it's legal precedent. But it does make it easier for presidents do it. I've I've studied a lot of presidents behavior. And when one president does it makes it much easier for another president to come along. And do it simply because people get used to it. It's. They don't think twice about it anymore. So it does I think have some affect if Trump does it on future presidents, Republican or democrat bottom line, how much do you think is going to be sped assuming that the president goes down the path of both a national emergency to get money. Previously appropriate for other things the one point three seven five billion passed by congress of appropriations of some of the expropriated money from drug lords like El Chapo, you think the president could get his five point seven billion through all of the above. Oh, yeah. I think he'd probably could he he he had the choice of either just rating other accounts or declaring a state of emergency. And he wasn't gonna be able to get enough money for just rating other accounts. So now, he's going raider rate other accounts under the state of emergency. On an even grander scale. The problem is he's gonna face pushback from very powerful constituencies in the military because he's going to have to either pull up military construction money or he's going to get pushback from states because he's talking about. Cutting aid to California and Puerto Rico, and maybe other places I've an island is senior fellow at the independent institute their online at independent dot org. Fifteen till a.
