She fires a single round and then she realizes she got her gun instead and daunte Wright collapses and then Kim Potter bawling collapses herself on the curb. So this is, I mean, it's horrific. It's a certain kind of negligence. I mean, you have to be trained to tell the difference between a taser and a gun. But at the same time, this was unquestionably an accident. And an accident by definition is not a crime, but nevertheless, Dante Wright being black. I think if he had been white a whole different story, but since he was black, suddenly it became, you got to prosecute or you got to charge her and sure enough she's charged with first degree manslaughter, which is a crime. And the jury in a kind of charged political environment goes ahead and finds her guilty. Both actually are for us to agree on second degree. Manslaughter and now Kim Potter comes up before a judge chew. This is Regina Chu for sentencing. And something really kind of remarkable happens. The prosecution is going for a 7 year sentence. In prison. Wow. 7 years sentence for an accidental shooting. And daunte Wright's family is, you know, piling on, they're like, yo, she should get the maximum sentence. She's not remorseful. And so they were there talking about how it was the worst day of their life, and of course I understand their loss. And Kim Potter does, because at the sentencing Kim Potter breaks down and she says to she says to daunte Wright, she says that the family of daunte Wright, I'm so sorry. I brought the death of your son, father, brother, uncle grandson, nephew, and then she says to the mom, Katie, I understand her mother's love. I'm sorry I broke your heart, my heart is broken for all of you. And this was so moving in the courtroom that the judge began to cry. This is judge Regina Chu and the judge basically says, come on, quote she never intended to hurt anyone, her conduct cries out for a sentence. Significantly below the guidelines. And so what does Kim Potter get? 16 months. And she's quite likely to be out in half of that.

And Donald Trump asks Supreme Court to block release of January 6th records. It's Friday. December 24. I'm Anthony Davis. A suburban Minneapolis police officer who said she confused her handgun for her taser was convicted of manslaughter on Thursday in the death of Dante Wright, prompting tears from the young black man's parents and a jubilant celebration by supporters outside the courthouse, who chanted guilty, guilty, guilty. The mostly white jury deliberated for about 27 hours over four days before finding former Brooklyn center officer Kim Potter guilty of first degree and second degree manslaughter. 49 year old Potter faces about 7 years in prison on the most serious count under the state sentencing guidelines, but prosecutors said they would seek a longer term. Judge Regina Chu ordered Potter taken into custody and held without bail and scheduled her to be sentenced on February 18. Outside the courthouse dozens of people who had gathered erupted in cheers, hugs and tears of joy as the verdicts were read. They chanted say his name Dante Wright some held yellow signs that said guilty in large block letters. Potter, who testified that she didn't want to hurt anybody, looked down without showing any visible reaction when the verdicts were read. As chew thanked the jury, Potter made the sign of the cross. Potter's attorneys argued against her being held without bail, saying she wasn't going to commit another crime or go anywhere. It was the second high profile conviction of a police officer won this year by a team led by Minnesota attorney general Keith Ellison. Outside the courthouse afterward, Ellison said the verdict brought a measure of accountability for Potter, but fell short of justice. A Texas board that had unanimously supported a posthumous pardon for George Floyd over a 2004 drug arrest in Houston backpedaled in an announcement on Thursday, saying procedural errors were found in their recommendation months after leaving the decision to Republican governor Greg Abbott. The unusual reversal was announced by Abbott's office two days before Christmas, around the time he typically doles out his annual pardons. The withdrawn endorsement was met with outrage from a public defender who submitted the pardon application for Floyd, who spent much of his life in Houston before his death in 2020 under the knee of a white Minneapolis police officer. Allison Mathis an attorney in Houston accused the two term governor of playing politics ahead of Texas march GOP primary elections as he faces challenges from the far right. Floyd's name was withdrawn along with two dozen other clemency recommendations that had been submitted by the Texas board of pardon and paroles. In a letter dated December 16, but not released publicly until now, the board told Abbott that it had identified unexplained departures from its process of issuing pardons and needed to reconsider more than a third of the 67 clemency recommendations it's sent to Abbott this year, including the one for Floyd. Mathis called the last minute reversal, a ridiculous farce. She said the board which is stocked with abbot appointees did not make her aware of any issues prior to the announcement from the governor's office. Floyd grew up and was laid to rest in Houston. In June, former Minneapolis police officer Derek Chauvin was sentenced to 22 and a half years in prison for Floyd's murder, which led to a national reckoning in the U.S. over race and policing. Pardons restore the rights of the convicted and forgive them in the eyes of the law. But in Floyd's case, his family and supporters said a posthumous pardon in Texas would show a commitment to accountability. Former president Donald Trump turned to the Supreme Court on Thursday in a last ditch effort to keep documents away from the House committee, investigating the January 6th insurrection at the capital led by his supporters. Trump's attorneys asked the Supreme Court to reverse lower court rulings against the former president, who was fought to block the records, even after president Joe Biden waved executive privilege over them. The federal appeals court in Washington previously ruled the committee had a uniquely vital interest in the documents, and Trump had provided no basis for it to override Biden and Congress. The records include presidential diaries, visitor logs, speech drafts, handwritten notes concerning the events of January 6th, from the files of former chief of staff, Mark Meadows, and a draft executive order on the topic of election integrity, according to a previous court filing from the national archives. Trump's filing came on the day that an administrative injunction issued by the appeals court was set to otherwise expire. That injunction preventing the release of records will remain in place for now. Lawyers for the House committee asked the Supreme Court later on Thursday to expedite its processes and consider the case as soon as mid January. Former presidents had a clear right to protect their confidential records from premature dissemination Trump's lawyers said. Meanwhile, the House committee has said the records are vital to its investigation into the run up of the deadly insurrection aimed at overturning the results of the 2020 presidential election. The only reason I believe it got this much coverage is because the suspect is black. Officer's white. Had been the other way around nobody would have given a dam, had it been a white officer, white suspect, nobody would have given a damn. And zero evidence to support any inkling that whatever Kim Potter did had to do with Dante Wright's race. Yet many newspapers referred to the officer as white, suspect is black. And when the officer was found guilty of two charges, there was cheers outside the courtroom, as if it was some sort of political rally. Clearly a lot of people felt that the reason this happened is because Dante Wright is black, and the cop is white.

Because I knew that the only reason the media gave a damn about this is because the suspect is black, and the cop is white. Had this been a white suspect? Who resisted arrest? And got in a car and drove away. And one of the witnesses at the scene, the officer supervising officer said that this suspect could have driven him away in the car, and that she, the cop on trial, would have been justified in using deadly force, let alone a taser. Obviously, the state had an expert witness. By the way, the same expert witnesses testified in the Derek Chauvin trial, who said that she was not justified in using the taser, let alone deadly force. And again, you changed the race of this and nobody gives a damn. It's supposed to have been a black cop. Who mistook his gun for a taser. And shot a white suspect, would CNN give a rip with MSNBC or give a rip?

you surprised by today's outcome Frankly a little bit surprised There's a compelling testimony in terms of the emotion of miss Potter when she testified and sometimes even though it's really not supposed to carry the day Sometimes that emotion can swing a jury but I think if you look at it legally and you look at the facts and they arrived at just verdicts Her lawyer said that this was an accident also that she thought her fellow officers were in danger Do you think the jury reached the right conclusion Yeah you know they raised that argument I was frankly I was a little surprised in their opening statements when they took such a hard position with regard to her fellow officers being in that much danger obviously at that point in time they had seen a lot more of the evidence that I had but as the trial unfolded it seemed like that argument was a bit shaky They really had to lead witnesses in order to get that testimony in And then I think if you couple that with her statements immediately after they just didn't seem to fit together So I think it was a clever argument to make but I don't know that it was supported by the evidence You know during the trial jurors wanted to see her hold her gun and her taser what did that tell you Well I think it suggests that they wanted to actually experience what the difference would be in holding the firearm compared to what they would experience in holding the taser It sounds like they reached a verdict on the lower charge the manslaughter two charge a couple of days ago on Tuesday but then they were still going back and forth on the manslaughter one charge until they reached the verdict today So I think that they just wanted to experience it for themselves to see what the difference in weight and feel of each of those weapons was like What are your big picture takeaways from today You know it really seems to mark a shift in public sentiment in terms of holding police officers accountable when black men are killed That is not what we have seen historically Frankly police officers were rarely even charged let alone convicted but it seems that there's a big shift now in the public just saying hey enough is enough my other hopeful take away from this is that police agencies across the country will go back and rethink the way that policing is done and also rethink that the way that police officers are trained in the support that they get They have a very difficult job There's no doubt about that And oftentimes just being honest I'm not sure that they get the support that they need in order to carry variant spreading widely throughout the U.S. that means that a lot of people including people who are vaccinated may potentially be coming down with severe COVID-19 So with absolutely crucial that we have other options for treating those patients should they end up becoming severely ill due to the result of a Macron If people can get the pill of course we've read that the government has initially ordered enough pills for about 10 million people and by one calculation that would be enough to last a single day if half the people who've tested positive got it Do you have high hopes for delivery to the patients that need it So that really is the downside to this Unfortunately I don't know that we will have the supplies to be able to provide this pill as widely as would be desirable to all the people who are potentially at risk Right now we're looking at extremely steep case trajectories meaning that we are seeing a lot of increasing cases in a very short period of time And both of the drugs from Pfizer and Merck seem to work best when they're given very early after you identify that you have been infected They have to be given within the first 5 days after diagnosis or symptom onset Otherwise they really don't work very well So it's going to be really really critical to find the patients that are the most at risk to make sure that they can get the limited supplies of these drugs It also is going to be really really important to make sure that people have access to testing so that they can be diagnosed as soon as possible But it is a real problem that supplies will unfortunately lag on into the new year and potentially we won't be able to provide this drug to all the people that need it until after the omicron wave has passed Yeah that's the problem That's a lot of ifs there Do they get a test Do they get.

verdict We've been through in the last few months And the second that's happened why we've been on the air And I got to tell you although I wasn't surprised at all with the written House of verdict there was no case against Kyle right now and I expected an acquittal there I expected an acquittal here too Ladies and gentlemen this is a tragic case but this is clearly a civil case This is not a criminal case It's not a criminal case I've been there You do a lot of things when you're a police officer You don't even remember afterwards You're in such a high stress situation I mean I remember responding to a domestic incident in east New York Brooklyn and one of my first days in an RMP a car but this guy George I was a young rookie and you know we responded to a domestic with this guyanese guy and his wife had called and he hits me with an ironing board Not like over my head it was the ironing board was up like they were ironing so many He grabbed the ironing board like you would kind of hug it and he swung it and buckled me at the hip and jumped on me as I fell on the couch Thank God my partner was there and got him off but I got to tell you after that thing was over I mean your heart rate's elevated It's probably beaten it I was young back then probably a 160 beats a minute You get tunnel vision I can tell you I don't remember much about that entire incident other than C in my partner at the time Get his PR 24 night stick and grab under the guy's arm to get him off me use it like a lever Like under his armpit but I don't remember much I can't do that I don't even remember what happened afterwards I know he called it ten 85 which is that officer needs assistance in New York in the NYPD But I remember anything about it.
