I mean, he accused him of fabricating the phone call. But the jury, there was no hard evidence that it was made up that the one witness Sergey milian in the phone call wasn't available to testify. In the case crumbled. We're hearing from Trump allies. They're not happy about any of this. They argue that this acquittal doesn't take away from the fact that what the dossier alleges was this conspiracy of connection between Russia and Trump. That's still hasn't been proven. And the dossier has a lot of information that has been specious from the start very questionable from the start stuff that has been debunked. And it has not held up well. That's for sure that's for certain steel was not on trial, and he didn't testify either. He's a British citizen, so he doesn't have to be compelled to come here to testify in our courts. But at the heart of this, danchenko was arguing the information that I gave to steal, I passed along as a rumor and speculation. And he pumped it up to the status of a fact. The truth. So he was upset with steel. They actually met. It was revealed in this trial. And it didn't shanko came away very upset after the meeting and he reported back to the FBI everything that he had said. Oh, that's really interesting that the little twister really quickly here, this investigation has been going on over three years. What has John Durham found? "So what I try to do when I'm doing a deep dive on like the Hunter Biden case is spygate case of the collusion case is I really try to remember the names. That way when I'm reading an article and the name creeps up, I'm like, holy, shakes. That's the same guy. That happened to me yesterday. So I mean this article by Jerry dunleavy about this FBI analyst who was deeply involved according to their reporting in making the Hunter Biden laptop story go away right before the election. So Brian ought in according to this whistleblower, and their team were in contact with FBI headquarters over their assessment that the Hunter Biden laptop was Russian disinformation. Here's a hint. Uh, attending the statute of limitations ending this week, supposedly, um, so what is looking into is whether or not this lawyer for the DNC Michael Sussman lied to the FBI. When he was basically shopping, Uh, opposition research about the Trump campaign all over town. He's given us a journalist, the State Department. And also to the FBI. And the allegation is that he may have, uh, lied to an FBI lawyer when he was shopping this information around so Durham is long been looking into How Clinton operatives Disseminated all this, you know, now debunked information about collusion. Um he's been looking for evidence of any you know, uh, lies to the FBI or any conspiracies to You know, basically defraud the government. Um, with that information now off the top of my head. One of the only guys who has been indicted here that I'm aware of is the guy who pled guilty was that FBI lawyer Kevin Kline Smith? Who, uh, who. Basically he had explicitly altered an email to suggest that Carter page and not been helpful to the United States government in the past by working with the CIA, he altered the email to suggest that Carter Page had not been a source when of course, the CIA had conveyed to the FBI that he had indeed been a source. Um, but that was okay. So that was an FBI lawyer again. Not high profile. Now we find out about another guy, Michael Sussman. This is now we're into The law firm Perkins Coe that was working on behalf of Hillary Clinton. We're now moving closer to Hillary Clinton with these charges. Yeah, that that that to me is the biggest significance. I was surprised to see that Michael Sussman was in the cross hairs on this mainly because he's a lawyer. You know, there's a lot of protections and a lot of leeway. The lawyers are granted. On on, you know when dealing with the government but the previous chart, although, although Kevin Klinsmann was himself an FBI lawyer that is kind of a different thing, he wasn't representing a client. The client, Smith was charged last year. So this is the first activity that we've really seen from Durham and more than a year people. Conservatives President Trump of all kind of started losing faith in Durham. But this development if the indictment does come down is Truly, in my opinion are really significant development not only because it gets closer to the to the Hillary, uh, orbit there, but also you know, it suggests that during is still going hard at it. He's still Uh, you know, uh, conducting his investigation, and if he's willing to charge a lawyer with making a false statement, um, making false statements to the FBI that tells me that they're on this, you know. Very serious about the the investigation. Um, this this law firm Perkins Coe is of course, known for its work with Democrats, Uh, and the guy who is probably the most famous in that law firm is a guy called Marc Elias, who was Hillary Clinton's lawyer working for the Clinton campaign. Um, and it was actually their election lawyer as well. So he needs to those states as Donald Trump and his team and Rudy Giuliani were challenging some of the results in elections across the country. On the other side was Marc Elias. Throughout. But Elias left Perkins Coe Very recently he departed. Do we have any reason to believe that it's associated with this term investigation? Uh, you know, I have no insight into whether it was but I mean, the timing is definitely very, very interesting to say that, to say the least, Alliances with Perkins Kui for years and years And then now all of a sudden As durum is closing in on Perkins Couey. He jumped ship and informs his own law firm. Now the great irony here is that Elias is like a champion. To the left. You know, he's on MSNBC all the time, you know, accusing Republicans of undercutting election election integrity and things like that. But the truth is that Elias Along with Sussman. Back in 2016, You know, they paid political operatives Christopher Steele and Fusion GPS They paid hired these guys to essentially But they hired them. And then they, you know, fabricated or came up with the false collusion allegations and passed it all over Washington, D C to journalists again to the FBI. You know, in an attempt to make it seem like the Trump campaign was in cahoots with Russia. And if you look at that, you know, kind of a big picture view. Um, that I mean, that's definitely they at least attempted to undercut the integrity. Of the election and sway. Yes, the results of the elections. These are operatives to see. These are operatives who were trying to fraudulently weaponized the power of the United States government against their political opponents, and that has been proven over and over and over again. That's the law firm. That did the Clinton campaign and the DNC's heavy lifting here. They were basically the money laundering scheme for lack of a better term. All this campaign money went into the Clinton campaign. They then merged operations with the DNC. And then, during the spring of 2016. They sent a huge check. To, um To this to Perkins Kui, this law firm for opposition research right, and that money from opposition research ended up in multiple directions, But one huge chunk of it ended up with the creation of the Russian dossier through this Fusion GPS This like consulting firm that brought in the former M M I six agent, right? I'm trying to shorthand of this as much as possible, but that's what happened. Michael Sussman, an attorney with Perkins Kui apparently had a conversation with an FBI employee and that FBI in that conversation on September 19th 2016, the lawyer maintained that there were all of these facts. All of these, uh factoids and information in this Russian dossier that implicated Donald Trump's campaign. With Russian collusion, and this guy Michael Sussman knew that those statements were false when he made them and that would be a federal crime. Of course. Here's the problem member. I just said when this conversation took place, September 1920 16 Today is September. 16th 2021, lying to the FBI as a federal crime has a five year statute of limitations. So in other words, Mr. Durham has five. Excuse me three days. To bring charges against Michael Sussman. Or else he will get off on a technicality. Well, unfortunately, this does not surprise me. I think it was Mollie Hemingway, who said pretty well that most of the people involved in this, uh, Russian collusion scandal, meaning the fake Russian collusion narrative against former President Donald Trump would probably get off Scot free because of the incompetence of too many of the people with the FBI, which Obviously, we just talked about in terms of the Larry Nassar case. There were huge mistakes made there if you can even call them mistakes. Same thing is true in this Russian collusion. Uh, Issue. With all of these people fabricating claims against former President Donald Trump. Very few of them have actually been held accountable. That basically tied up the United States and this administration for four years. And so it's a perfect transition. It feels like a lot of people who were a part of that. You look at Brennan and you look at Sally Yates and different people that are in and around the DOJ. The state Department you know they're either coming back in better jobs. This administration Or they're very connected to and sort of waiting to get some kind of a gig with this administration, whether in an informal or formal advisory role. It feels like they pulled off the scam, and they all got promoted. They all got promoted. In fact, Peter Struck's wife is getting from promoted to the SEC big position at the Security and Exchange Commission, which guess what is going to oversee a lot of the issues that we're dealing with with big tech? The FBI literally fired him the good people inside the FBI because he lied because of his involvement in the investigation and cross fire hurricane into President Trump. Now his wife. Well, he cheated on openly in front of the entire country is going to get you know a very good position at the SEC. She may be great. She may be a fantastic attorney, but the objects look Terrible. And what about Samantha? Power? You know, the former U. N ambassador under President Barack Obama. How do you make sure everything's equitable These these are, you know positions of power that are being given back to people that are going to have access to some of the greatest tools. And the history of the world. You know, I like it When people say you know, Big tech. They're the most powerful. This is the most powerful we've ever seen on industry or corporation at any point in time in the history of mankind. Why, Because it's global. So big tech But also what about the government? The tools in our own government? And it makes me wonder. Like, How is it possible that you know so many people from all over the world, they look to the United States as a beacon of light. They look to the United States as a place where the justice system actually means something where corruption is outed where people pay the price. Yet what we've seen over the last four or five years. Is that nobody has answered for any of this. Nobody that was involved in the Russia hopes paid the price and then they're going to do it again. No better than this right so and you know, there are so many wonderful people just like you. Look who put their lives on the line who dedicated their and dedicate their life to the national security and safety of our nation. I don't want to take away from them. But what we're seeing on the official level and at the highest levels. I'm talking former CIA director John Brennan. Others within the agency that targeted insurgencies overseas that we're certainly very real threats to the United States. But now creating this kind of I call it an operation. A campaign Against American people. You know, the FBI is supposed to be charged with, you know domestic issues, whether that be groups within the country that are threat to our government, or, you know, kidnappings. Anything. You understand how this goes The CIA, Vienna say our intelligence Lee apparatus is supposed to be focused mainly. Almost solely when it comes to the CIA on overseas threats. Those that could trying to, for example, a huge problem for us right now. Russia, For example, Iran on Brother You know threats such as al Qaida, which hasn't disappeared or Islamic state. I'm not supposed to be focused on Americans. I almost feel as though they are trying to create an insurgency in the United States, as though they are trying to create divisions in the United States. I believe, you know, Operation Crossfire Hurricane and I believe other operations. That targeted the Trump administration and targeted the people around him. Show me where in the military in our United States military, they ask our young men and women have completely volunteer force. We've got got some news over the weekend made me think of you because we always talk about this subject that the Durham investigation is effort to go after literally anybody. What little we found out that we did find that a federal judge On January, 29th sentenced now former FBI attorney Kevin Kline Smith to 12 months of probation for forging an email. That the epic time says resulted in 71 of several major errors in the applications to spy on former Trump Campaign adviser Carter Page. This was US District Court Judge James Boasberg. On referred to climb Smith's forgery is a quote inappropriate shortcuts. So we got a big old wrist slap from the court here. Joe diGenova, What do we make of it? Um, it's the staggering event in terms of accountability. For the Russian hoax. Here is a lawyer working for the FBI, a senior lawyer, by the way, one of those in charge of the investigation. Falsified a piece of evidence to the five the court, which was essential what he falsified was a document the CIA had informed the FBI that Carter Page was cooperating with them. In essence, he was an asset for the United States government, not a spy, not a Russian asset. An American asset inclined Smith changed the email to make it look like Carter Page was a Russian asset. It is inconceivable to me that Mr Klein Smith would not have gotten at least some minimal jail time. A Z a warning to other people, both in the intelligence community and the FBI and DOJ. About the importance of telling the truth to the fires of court. This incomprehensible result is calm, pounded by the fact that Judge BOS Berg is a Fiza court judge. On. So how he could have reached. This conclusion is beyond me. Uh, you know, judges were given great independence in sentencing. But I must say that this one just doesn't make any sense. And indeed it's almost you get the impression But the judge didn't want to sentence Mr Client Smith and was doing it just because he literally had to, um, it Z disappointing in this sense. We need to send a very strong signal the people in the FBI and the DOJ and the intelligence community about the importance of protecting the civil rights of American citizens. Remember five is used to spy on foreign officials, and when it's used to spy on Americans, there's a very high bar. And apparently, Judge Boasberg thought that that high bar had been met here again. It's incomprehensible this sentence, and one of the things that I found astonishing is that the judge did concur with the defense's argument. That Mr Klein's clients, Smith did not intend to lie. The thing that I think is astonishing about this is, of course, this affected Carter Page lives immensely. The falsified information that was released the news reported on this impacted his life, even if somebody even if it was true, and I don't know, through the believed that that Mr client Smith did not intend to lie. Shouldn't there still be tricks? Stricter punishment? For the harm that he caused to Carter Page. There's no doubt about that. I mean he, along with others in the the high command of the Department of Justice, and the FBI ruined Carter Page is life. They named him a Russian spy when in fact they knew he was not. He was just the opposite. He was a CIA asset. That is another reason. Beverly exactly what you've given for this to every Steve for Mr Klein Smith, who received some jail time some prison time. The notion that he didn't intend to lie is almost impossible to accept. Given his role as a lawyer and the falsification of a document. He literally changed the meaning of the document. How you do not intend to do that. Is beyond me as a lawyer and as a citizen. Move to the president's impeachment trial. A second impeachment trial be set to begin next week. Impeachment lawyers that the team of lawyers that he was working with have left they claimed by The Associated Press is that the president wanted them to use a defense that relied on maintaining allegations of election fraud through the trial, So these attorneys leave and then we get another report last night that Maura attorneys have actually joined The team as well. What do you know, if anything about the president's legal defense team? And how should he construct a legal defense for this impeachment trial? Well, I don't know anything about the president's legal defense team. Other than what I have read in the press, including the latest developments you just alluded to, um I think it's pretty clear given the preliminary vote that was taken. On Rand Paul's motion to dismiss for lack of jurisdiction Which well, his his motion to dismiss failed 55 to 45. But in fact it one 45 to 55 by showing that there weren't enough votes to convict the president in any impeachment trial, which is why Tim Kaine is trying to get a censure motion passed. The problem with the center motion is the same problem as the impeachment trial itself. I do not believe it is constitutional. To put on trial. A former president or a former civil official. Impeachment is for removal from office and nothing else that without removal, there is no jurisdiction. It's pretty obvious that the situation that the president should argue is that the Senate has no jurisdiction. I would if you know if if that doesn't work Then he's gonna have to argue whatever he wants, including the legalities of for the unconstitutional conduct of several states in enacting election laws, which violated the U. S Constitution. You can do that without getting into the nuts and bolts of fraud. And all that you do with Texas argued in the Supreme Court, which the Supreme Court unfortunately thing here, which is states violated the U. S constitution by enacting laws in violation of the U. S constitution in in a way that couldn't be done because they did it through governors. And through secretaries of state, So apparently, we don't know what the president's going to argue because now got his new team literally within days of the trial. Do you think that this is an opportunity? Not just for the president but also for Republicans, since there isn't likely to be enough votes for a conviction for them to talk about election fraud, that this is a way to put it? In front and center in front of the American people. This is a way for Donald Trump or hit him to still be able to state the case that he had been stating up until inauguration day. So do you think this can be turned to an opportunity for them? Well, if it gets to the point where they discussed the actual election itself, I think the most important thing to discuss are the ways in which individual states like Pennsylvania and Michigan and Wisconsin. Violated the U. S constitution violated their own state laws by the manner in which they allowed mail out voting and other changes to certification of signatures and then ballots. And envelopes that to be is the key thing. Then if you want to get into areas such as keeping Republicans out of observation post, so they couldn't even see the opening of that a ballot and envelopes that today is where they should be going, if they if they get into the substance of it, you know, the amazing thing about all of this show is like what they've done is they've set up this framework will Donald Trump talking about any of this is what incited violence in America.
