Making A Murderer: The key piece of evidence in the case of Steven Avery

"Of every criminal case, every case in the law, really? There is a key. There is a piece of evidence so critical that the case itself turns on it. In the case of Theresa Holbox murder, the key is literally the key and the key to understanding it is to understand that everything making a murderer has told you about it. Is wrong. I'm Dan O'Donnell and this is rebutting a murderer. The most vulnerable piece of evidence to attack is the key. And that's because of the evidence the state presented so the key isn't found until they're been repeated searches of Avery's trailer off that was highly suspicious. But overriding that is the DNA of Steven Avery on the key. First of all, Avery's attorney, Kathleen Zellner, isn't telling the truth about how the key was found. There weren't repeated searches of Avery's trailer at all. There was one and the key was found during the first search of the bookcase next to Avery's bed. The key was found in on November. 5th 2005. The day that Theresa Hall box wrapped for was found in the Avery Scrapyard on investigative team began searching the Avery property for Hall box body. Yet, as the Wisconsin Court of Appeals noted in its decision against Avery, investigators never performed a full search of Avery's trailer that day. Special investigator Tom Foss. Bender testified that most of the investigators in the trailer had already been working for 12 hours or more and exhaustion and safety issues were becoming factors that could affect the searchers ability to locate and collect evidence. In addition, there was a horrendous rain storm going on that created a risk of evidence being destroyed or lost as officers went in and out of the trailer to get equipment. Thus, the officers were focused on looking for the type of evidence that would be most at risk of being destroyed under those conditions. Boss Bender testified that in debriefing the officers that night, he was telling people we are not done in that house. Boss, Bender testified. As of Saturday night, the trailer was still part of my scene. This is an ongoing search. The search, however, was suspended that night. Next day. Investigators did indeed enter Avery's trailer, but not to search on Ly to obtain items that they had noticed the night before and listed in reports, most notably Avery's guns. Technicians from the Wisconsin State crime lab, then went in to swab for DNA but did not perform any sort of search of the trailer. The following day. Investigators entered the trailer again but never entered Avery's bedroom at all. They went in, only to get the serial number from Avery's computer. Only the next day November, 8th did the search that was suspended on November 5th resume, and it was during that search of Avery's bedroom, the first search of Avery's bedroom. That the key was found the officer who found it, Sergeant Andrew Colburn testified that this was the first time any investigators had gone room by room through the trailer looking for evidence. And that they were instructed specifically to collect the large number of pornographic photos of Avery's ex wife and girlfriend that he had kept in his bookcase. Colburn said he was frustrated and disgusted and having to sort through all of those pornographic pictures, and he slammed other items He found in the bookcase back into it while he was searching it. Because he had pulled the bookcase out from the wall to get better access to its contents. He picked it up to move it back when he was finished. At that point, the key fell out of the back. Photos of the bookcase submitted as evidence showed that the back panel was loose from the interior, making it easy for a key concealed in the bookcase toe fall out onto the floor when the bookcase was moved. Making a murderer has claimed for three years now that the key was found on Lee after repeated intense searches of the bedroom acclaim it has Zellner make again but it simply isn't true. It was found during the first search of the bedroom and the first search of the bookcase. Elders claim that Steven Avery's DNA a found on that key was planted is equally dubious. To test this theory. She hires forensic consultant Dr Karl Reich, who naturally immediately suspects that the evidence is planted. The thing that suspicious about the DNA is the quantity of it because she said it was touch DNA. And Dr Reich felt just looking at it that there was too much DNA on the key to have just been the result of handling yet again. Zellner conducts a rather unscientific scientific experiment to show that it would be impossible for the amount of DNA the state says Avery left on the key to be left by mere touch, eh? Identical vehicle was obtained. And an identical key was obtained to try and reproduce what the state came up with in terms

"So I saw this headline in one of those stories that I just will pay attention to whenever headline comes up on. That's the story of Steven Avery and really making a murderer that wonderful Netflix series, which captured everybody's attention about the case of Steven Avery. And I don't even know where you begin to talk about it, essentially, it was a murder investigation. But so much more than that. All right. Just a gripping story about a bunch of people one of them, and sort of the main character in this actual series of a crime story is Steven Avery. The headline is that he's getting a new trial. This is huge news perhaps. Okay. So tell me the details of this because I almost forgot that. There was a second season of making a murderer which I started to watch and watch the first three maybe episodes and this this second season featured his new attorney who was trying to get him a new trial. So in that is Kathleen Zellner, she filed a motion, and apparently the Wisconsin state court of appeals agreed to hear that motion to discuss new evidence in the case of Steven Avery. And according to thorton. The attorney alleges that investigators, and I was reading about this earlier it has to do with some of the evidence in the original case. And she claims that investigators violated state law by mishandling that evidence evidence was actually sent to the bone fragments of the victim. Theresa hall Bach. And again, this all stems from a murder that Avery and his nephew Brennan doc-. You're currently serving life in prison for so these bones apparently were found in a gravel pit your that story. She wants to have them tested to see if they're Theresa hall box. If they are at undermines estates theory that she was killed and her body was burned on the Avery property. But in this particular moment, the court has granted emotion. The court has granted a motion to remand to. I'm reading verbatim here to the circuit court to supplement the record with our new evidence that the state has destroyed material evidence by giving bones back to the whole back family. We believe he should be granted a new trial. What he is granted is emotion. So that the attorney will have the chance to argue that a new trial is necessary. So it is possible that he could at the end of this get a new trial, which would be you be gigantic. Yeah. Big. I mean, you know that. It really isn't. I'm not overstating it when I say that when that docu series took hold on net. Flicks. It swept to the nation, and it was really. I was trying not to say that. But it's true everywhere. You went people were talking about it. And with good reason because it was there's so much to the case. There's so much to the story and people became fascinated with multiple different angles of the story. And it's almost too much to get into in a quick little segment to try to understand all of the the levels that were of interest to people. But when they went ahead with the second season, I think I don't know if it did as well as the first season. No because well, I what I was gonna say is because I feel like people were watching it now in real time. And so understanding or caring. What was there wasn't gonna be any new revelation? It didn't seem in that second season that said the three episodes. I watched this attorney that he is working with. She is she's no joke if she means business, and she has she is paying attention to every single facet of the case to try to find a loophole to get. Retried for him because of all of the things that seem to have gone wrong that we all saw in that documentary, and you do feel I mean, you feel terrible for specifically Brendan Daffy the nephew of Steven Avery who's currently doing time. And we all watched his questioning something didn't seem right. Some things just didn't seem right. And so this is this is big news. And we will continue to pay attention to that for. Sure. Absolutely. Okay. I wanted to have a little conversation with the audience. Okay. Bradley trainer. This would be the play. Thank you. Because I noticed today. There is one thing. It doesn't matter. How late I'm running in the morning. Okay. It it doesn't matter. You know, what other kind of chaos in my life? There is one thing. I have to do in my house. Okay. What is the one thing you need to do before you leave the house to make it harder for the next segment? We're actually gonna fly. We got a couple of minutes gay. So most of the time, it's empty the dishwasher. All so our dishwasher, and plus like, you don't care about any of this. But I've been we've got time. Different containers and compartments and things and so that requires a lot of dishes, more than usual. So I feel like we've been doing dishes a lot more than we normally do. But even so it's not an everyday thing. But almost close if there are clean dishes. I don't like to leave the house unless they're emptied because I don't I actually tried to do that before. I take the dog on a walk get ready before I do all those things I feel like that gets me ready for my day outside get that dishwasher emptied. But certainly before I leave that door. I don't wanna come home to a dishwasher that I need to empty. See? I think that that's what it's about is that it's the thing that you don't want to come back to do later. It's the thing. Like if I get this one thing done before I walk out the door. I'm gonna feel fine. Getting through my day. I'm gonna come home. And it's not going to be the one more thing. I have to do and for you empty, emptying the dishwasher. Do you have something I kind of do don't because I. Just wake up and kind of throw things on. But. How old are you? I'm twenty six. I was like that. Yeah. So I think one of the things that I almost do all the time because I've left them on before I need like fifteen thousand alarm clocks because I can sleep through an earthquake. Okay. So I have an eye home another alarm clock my phone until before I leave. I make sure that all the alarms are shut off and everything because there's nothing worse than like somebody. My I live with my grandmother. My roommate Dr I don't want her to have to come down and turn down the no, it's it's it's just not cool. But other than that now. Okay. Turn off all of her alarm. What do you think about this? I you know, I went to school we went to college together on. And what was she like? Sweet we grow. I didn't know very well I had a class with her. She was sweet. Steve every. Yeah. I he was known as a creep in the area. He he had a not a great reputation. I I I I don't believe the media is portraying every the right way. And he's not innocent. If Brennan Dessie with curse in any way. It would be because he was maybe chorus by Steven Avery to help him met the murder. I think a lot of people reasonable people think that might have been the case doesn't it doesn't excuse that behavior or that conviction. But I think a lot of reasons people think that might have happened. Right. Absolutely. You know, I feel really bad for Theresa family you because they want to put this behind them. They felt like this was third one Steve got got convicted. And now this is really hard. It's hard to watch him really mad to watch the. Yeah. Imagine what that feels like the the horrific death of a child your child in the manner that she was killed. The fact she was just doing her job, and then all the resulting hysteria and drama associated with these series that can't be positive for the family. And I and I think there's there's this push to kind of create these fake narratives and storylines that people love to watch on television. But really paint a very different picture than the reality that actually played out during the case on the ground. Right. Right. And it's unfortunate. Because now now people are trying to get Stephen free when he doesn't really deserve it. I agree with you. Thanks for the call texture from the ninety two Theresa Hallberg's brothers. My attorney a wonderful person from a wonderful family pains me to see this as an opportunity for people both attorneys and net flicks to make money with no thought given to the victim and their family. I completely agree with that so much of this stuff is about. Drama fake drama. Planting seeds of doubts and often in very theatrical ways to make that seem like something is real evidence is being planted evidence is fake one one. As the caller said this guy was a creep people knew he was a creep. And none nothing in that story suggests that this wouldn't be something that he wouldn't have done and most of the evidence does point to his guilt. We can argue about Brennan Dessie. But the bottom line is if he was a participant. And it's clear that he was there has to be a punishment for that. Kathleen, Zellner is doing what attorneys do planting seeds. I think of this one and then slender man that have become so much more than the original case. And the results of that case the convictions. Hey, good morning. Thanks for taking my call. Sure. So I watched the entire Netflix series. And what have you? Okay. But besides that is that you have a man that spent twenty some years in prison for something. He did not you're gonna call him. A creep. I I don't know that helps you how he's a creep. I don't know that here not considered socially awkward coming out into society. But then besides bet there is absolutely. No, no. There's no body found nobody ever even in the Netflix. You never even said anything about there's no body found in the human remains were found in the burn pile are inconclusive. There's a possibility that human, and I'm not saying insult anybody or the whole family. I feel horrible that this has happened. But I think the pictures a lot bigger than what's being told. And it's easy to close the case on something that's already been decided by by Cowan that may have thirty three million dollars that would bankrupt the county and I'm not saying it's a conspiracy. There's too many people that would be involved. For that to be the case. But to be an open and shut case, it has been without really looking into all the extra things, you know, as well as I do that if anybody else we're in the situation that hadn't been convicted before it would be looked at a little bit differently. Don't you think that he has gotten his day in court, though, if you're talking about Steven Avery, even even Brandon Desi, they have gotten additional hearings and appeals. And this is this is another attempt if you're saying that it's being shut down they're giving Kathleen Zellner, they're giving Stephen every every opportunity to present new evidence. And she says they're doing that. But I think it's the opposite of what you just said. They are giving them the opportunity. No, no, no, no, all the everybody. Anybody that's ever been arrested for anything knows that. You're you're guilty until proven innocent. That's why you sit in jail until you're proven innocent. And then once you're convicted it's the hardest thing in the world to get a court of appeals to return when you you need three three things, basically. In order to get the court of appeals to overturn that one thing that too, but three and those three things have already been established. And I'm not saying that he's innocent. I'm not I'm just saying that looking at all the things that have been tossed around for the last unfortunate. Eighteen plus years that this has been going on if it were open and shut case, we wouldn't even be hearing about it right now. Do you believe Steven Avery is innocent or guilty of the murder of Theresa halbert? I believe I do I believe he's innocent. I believe that Brandon Daffy is innocent. "It's been awhile since I dipped into the topic of if I had a VCR I tape this. But today seems like a good time to revisit it. Fresh off of my finishing part two of making a murderer for those of you who are not the million with the story. It is the tale of mostly Steven Avery and to a lesser degree. Brendan Dessie who were tried. And if you've never watched the show, I'm going to go ahead and say spoiler alert convicted of the murder of Theresa hall Bach. Who was a twenty five year old photographer? They're all located in the Manitoba county, Wisconsin area. There is in the first season of making a murderer an entire story plot about Steven Avery being wrongly convicted of a crime being imprisoned for a number of years being exonerated and then allegedly. Committing this rape and murder after all of that time in the first season chronicles all that. And I really enjoyed the first season. But the second season is out nail. And I have to say, I know it got mixed reviews by some of my friends, but I really found the second season to be even more compelling, and I think a lot of that is because the second season incorporates Kathleen Zellner who is an attorney apparently that is known for overturning wrongful convictions. I don't really want to go into too much detail about the show because those of you all who haven't seen it. I don't want to give away the outcome for specifically Brennan Dessie, although it's all over the internet and on the news. So it probably won't come as too much of a surprise to you. I don't want to give away a lot about what happens with Brandon. But I do want to say that in the Steven Avery segment of part to the end of that series. Really takes a twist in a turn in uncovering some perhaps likely additional suspects that could have been responsible for the rape and murder of Theresa hall Bach that I was astonished over I mean, I say I was astonished after the fact I recalled from the first season that there were some inconsistencies and irregularities in some of the stories of two individuals that they point the finger at at the end of this show, but still it's a turn. And twist that has some plausibility to be honest, but takes a really really dark angle. I know that's a lot of vague conversation about a show. I just don't want to give away too much for those of you who would like to watch it. But I did want to bring it up because I would love to hear from you on your theories about what you think actually happened in this extremely unfortunate event attend to like shows of this nature as I've detailed before shows like ozone. Mark. I was a big fan of breaking bad. But I do have to stop here in acknowledged that this is not fiction, my heart breaks for Theresa hall box family in what they went through then and continue to go through. I find myself at odds feeling as if I don't feel the fare was a concrete enough case to put away both Steven Avery and Brinton Desi. However, the multiple years that this family has been going through trials and appeals while warranted for someone who is wrongly convicted. And that is still again left four, I guess appellate courts to determine in Steven Avery case. I know it is an fortunate sad experience for her family, and especially dealing with not only the years of actual court conversations, but the court of public opinion, which is the other thing that I wanted to mention about this series. She even as of the recording of this show released new information yesterday pointing the finger at two of the suspects that she mentioned at the end of the show for season two and building the case more and more while they could be viable suspects. I can tell you. I have watched the first few episodes. See what I do is. I don't watch the entire show. And then do my rebuttal. I stick to every claim that the show makes I will stick to answering it directly. So every major claim that's made about Steven Avery and about the prosecution of him and Brendan doc-. I will answer using the evidence that the show leaves out using the facts that they ignore and using the logic that quite frankly, making a murderer's viewers. Don't why. What you to use because it all points to the unmistakable guilt of Avery indac-. Unfortunately, since this show premiered all of the misguided petitions to the White House all of the angry mobs that are definitely not mobs marching at the manitowoc county courthouse demanding Justice for Steven Avery have not changed. The fact that courts with one exception have all ruled against these killers. Brendan dicey had his case denied by the US supreme court. He will stay in prison barring any new evidence and thus far. The superstar attorney Kathleen Zellner has been honestly laughably unimpressive shy. Give you a little a little tease of what's coming up on rebutting. A murderer this show makes a big deal about her performing experiments that show that Avery. Couldn't be the killer. She does them in an uncontrolled environment. And she repeats the experiment twice. No lie. Two times. She says, well, it couldn't have been done this way. Because I tried to do it twice. And I couldn't do it. That's that's honest to goodness her experimentation like she. I don't know. How this show portrays the crusading hero with what they show at least in the first couple of episodes. It's laughable. I mean, laughably incompetent laughably and this. This is why courts are rejecting her. She files a twelve hundred page report. You know, what I'm gonna wait. I'm going to wait until rebutting a murder. It's just it's hilarious this season. Is you can almost tell that net. Flicks itself doesn't even believe in this show because how much if you really heard about how much is there. Ben promotion of it. I think she did she meaning she hated that experience. Obviously, it's a very grim thing to cover day in day out and day out. She's a pretty happy person. So out to cover something so dark and just terrible for the families that were involved, really tough. She even got a case of shingles on my it was row. I can't even imagine how stressful that would be basically, it is a belt the murder of a young woman and the trial the defense of the people who have been accused trying to figure out if the police set this guy up evidence. So it's basically the the story is from the side of the defense and. It really leaves you wondering like one minute. You're like, oh, yeah. He did it then the next minute. You're like. God, he totally didn't do it. So it's one of those that just always playing with your mind here is the trailer for the second season of making a murderer everything happened. All of these people would care. Attorney Kathleen Zellner best known for overturning. Wrongful convictions has taken the case. I have one goal, and that's to return they conviction of Steven Avery. Prosecution's case was treated never left the property last call kings off a cell phone tower miles away from the Abrahams property. Seventy to eighty percent of the people murdered by someone. They know each of those individuals have to be looked at as suspects. There's a lot based on that fuller. This is critical. Fun of avenue is good flip the whole case. Whoa. Whoa. I mean, I just that's what I remind. Yes. Is that they do not think he had anything to do with it. They're flip-flop beyond Steven Avery. Right. So for the family of the young woman was murdered. I do just for them to have to relive this through pop culture. Right. And her name, by the way is Theresa Theresa. How back thank you on. And she was a local photographer on gosh. This is going to be the I have to say that the defense. The team is really good. They are so good at their jobs. Wow. Evidently. Are you talking? Talking about the defense. We're talking about the convicted murderer, no. I'm asking the question that people might.
