But in a victory for Biden, the court did side with his administration and its efforts to end the Trump era immigration policy that forced asylum seekers to await approval in Mexico. very special contributor Larry summers of Harvard So Larry the big issue everyone's discussing is can the fed bring about what is called a soft landing I guess that's to say avoid a recession As you know Bloomberg did a survey of 72 economists that show the economists are getting more and more skeptical It's up to 27.5% in April before it was 20% if you go two months back it was 15% Look I think the risks are going way up 27 and a half percent this year because next year is riskier than this year translates to something getting towards two thirds for a two year period and I'd be a bit above that in my judgment Here's the key fact we have never had a moment in the United States when inflation was above four at unemployment was below four when we didn't have a recession two years within the next two years So we may pull it off and certainly it's hugely important that we succeed in pulling it off but the combination of overheating followed by policy delay followed by supply shocks means I think it's a very difficult set of challenges and recession in the next couple of years There's clearly more likely than not some of the banks are starting to move in that direction Your survey moved in that direction and I suspect that's how the consensus will evolve And Larry I feel like we're caught a little bit between The Rock of the hard place that is between inflation on the one hand and recession on the other And we worry particularly about how the people who are less fortunate are affected you have a research paper from the national bureau of economic research this week talking about what happens with wage growth You would like to think that when wages grow that helps everybody not necessarily so Here's the here's the fact David if you just look at nominal wage growth just measured wage growth and growth in workers purchasing power up to a point perhaps 4% four and a half percent they move together But past that point because when inflation is running above 4% you start to have inflation serious inflation things moving the high opposite direction and higher wage growth seems to go with lower growth in workers purchasing power That's why I was so anxious on this show over the last year about the possibility of overheating labor markets And unfortunately that's what seems to be materializing with average real wages having one of their worst performances over the last year That we have seen Larry we've got a big event coming up on the weekend That's the first round of in the presidential election over in France We have marine le pen who was often thought to be just almost impossible to elect although it's a closer race at the moment than we would have thought What's going on there Look I'm not a political expert on France but what I see is eerily reminiscent of the period before Brexit in the U.S. In the UK and the period before Donald Trump's 2016 election in the United States I think by far the more likely thing is that president mccrone will win but we have to recognize that the fact that Marie le pen will ultimately be elected Looks at least as plausible now as Donald Trump's election did a bit before the U.S. election or as Brexit did a bit before the British election So I think we need to be nervous as we watch that situation and all people of good will have to be standing with the French people But I think this shows the power of pocketbook issues for regular people and frustration with elites which has been a potent political force all over the world Again I think this is going to end with president Macron but nobody should be serene or complacent that that's the case Yeah and to some extent Larry that comment takes us actually to Ukraine and Russia in this sense Mister Macron is really focused a lot on Ukraine and international issues Marine le pen on the other hand says how much does your gas cost How much does it cost to go to the supermarket And that appears to be part of what's lifting her up When it comes to Russia though I wonder how are we doing in the if I can call it the economic war against Russia the economic sanctions Because we've seen the rubles come back now the Russian Central Bank on Friday actually cut their rates there Are we at a stalemate at least if we're not losing that war just the way Russia appears to be losing or in the military war I think we're going to need to ratchet it up if we want to do grave damage to the Russian economy We can't allow it to continue to be the case that Russia is able to get huge levels of hard currency from the sale of products It can't continue to be the case that there's a.

"Easy path forward for judge Jackson but it is expected that she will become the first black woman confirmed to the U.S. Supreme Court I'm Jack Fitzpatrick here with my Bloomberg government co host Emily Wilkins We've got to bring in our all star panel Bloomberg politics contributors Jeannie shin Zeno and Rick Davis who have insights on everything happening in Washington Guys you've got to start with the confirmation process for katangi Brown Jackson They're setting up a floor vote today tonight rather to get her confirmation out of the committee after that tide committee vote I've got to get your expectations Genie on how this goes forward if there are any barriers but I've also got to give you a little bit of a victory lap because the last time I was on the show after some Republicans such as John cornyn were saying in contrast to the Kavanaugh hearings where they got very personal Republicans were going to do their best to play nice We heard from a number of Republicans I would point to Josh hawley and Ted Cruz who made a lot of 7 to ten or so cases where they said judge Jackson was not tough enough on child pornography charges I think you deserve a little bit of a victory lap because those hearings got a little bit more heated than even some Senate Republicans had indicated but Jeannie tell us what are your expectations going forward Is this a glide path forward for Jackson Yeah I mean we heard everything from child porn to critical race theory something she's never really talked about or had anything to do with professionally children's books I mean you could go right down the list and you know by my understanding this is the first time since 1991 that you've had the judiciary committee deadlock on the vote like this And you know I think it does as you were just talking about with Greg it speaks to the times not to the nominee at all And we should of course remember that this is the anniversary of Martin Luther King's death in 1968 and now you have this historic nomination It certainly will get through but to your point even something like a delayed flight from California I think Emily said somebody you know stubbing their toe this could slow things down but this will get through by the narrowest margin I will be surprised if you get any more than we already have Collins I'd be surprised if you get one or two more that's going to be it for Republicans in our current system and situation That's bipartisan which is stunning in and of itself Rick Davis I wanted to ask you just because you're a man of the Senate You've worked with senators before What should we be reading into the fact that we haven't heard from Mitt Romney and Lisa Murkowski at saying how they would vote I mean certainly we've heard enough testimony at this point from judge Jackson I think for anyone to make their decision Yeah I think it's a sense that they are actually thinking it over right If there's anybody who even as you point out this late stage would be undecided it might be those two And there are a lot of different factors not only getting comfortable with the nomination and their preparation to vote on it but also the politics and the ramifications of it These things are intensely political for the one moment that they shine brightest in Washington And I have no doubt that Lisa Murkowski who's got a tough reelection fight in Alaska this year has got to have that entering her thinking Guys aside from that I was very interested in Greg valier's point just a few minutes ago on the challenges for President Biden Now I would push back a little bit and say a lot of some of the things that are weighing on him in the polls could improve a lot by November 2024 inflation for example We don't know how long the rusher Ukraine situation is going to last or what that will look like But one thing that plays against him it seems indefinitely is his age He would be 86 years old at the end of a second term He can't turn back the clock How much of a political issue is that really Rick You know look I think that's a serious political issue I remember having these conversations with John McCain at the spry young age of 72 about running for reelection And even in those days that was considered kind of pushing it So yeah I think it's a practical application of what people look for in their present and geriatrics is not the term that usually is applied So I think that the Democrats have an issue there If he decides to run he's got to take that on at first But it wouldn't surprise me that if he decides not to run it isn't because of the age gap Well Jeannie that raises the question if Biden decides not to run is there anyone at this point who is really stand out to be the next nominee for the Democrats Well you know of course you have to look at this sitting vice president Kamala Harris you know whether she would Garner the support in the democratic primary is another question but certainly she would be in line and you can look at all of the other people who ran in 2020 you know they may face similar issues but people like Elizabeth Warren people like Bernie Sanders I think Amy Klobuchar I mean you can just go down the list I'm certain they would have interest in thinking about it again but you know I think it's a little premature.

Yesterday and talked about how katangi Brown Jackson was unable to answer a very basic question. She was not able to answer the question of what is a woman. Now, katangi Brown Jackson, of course, has been mocked openly by almost every major conservative media outlet. You wouldn't even know she said this if you looked at CNN or The New York Times, the only way they describe it is right wingers pounce on tangi Brown Jackson to be unable to answer question or to yielding to experts and it kind of struck me as very interesting the way that she answered this question. And I listened to this tape over and over again. And first of all, katangi Brown Jackson has a smug attitude. She has a contempt for the entire process. She feels entitled to be the next Supreme Court Justice. You're going to see in her mannerisms, the way she's answering questions, she does not have any, I don't think she has any humility that prior nominees have had such as Amy Coney Barrett, who I thought was magnanimous and charming, contagion Brown Jackson has no such tone. And how she's approaching this. But I want you to re listen to this tape, because I think it's very telling. In fact, it's a unique window into how katangi Brown Jackson and the upcoming CRT regime or the new status, if you will, that we are going to be battling for the rest of my life, how they view the world. So this is the and I've discussed this before in the podcast, the idea of the living constitution. I came across a very eloquent refutation of this idea. That was given by Calvin Coolidge almost well, almost a century ago. And I just wanted to read it because it's so beautifully states why the constitution and the founding itself are not in some sense living, but are dead in the sense that they reflect enduring principles that have been put down on paper and put down on paper for a reason. So here we go. It's often asserted that the world has made great progress in 1776, and that we have new thoughts and new experiences which have given us a great advance over the people of that day. And we may therefore very well discard their conclusions for something more modern. So see how cool age appears so prescient here in talking about things that people are talking about now. And then says Coolidge, but that reasoning can not be applied to this great charter. If all men are created equal, that's final. If they are endowed with inalienable rights, that's final. If governments derive their just powers from the consent of the governed, that's final. No advance, no progress can be made beyond these propositions if anyone wishes to deny to deny their truth or their soundness, the only direction in which he can proceed historically is not forward, but backward toward the time when there was no equality. No rights of the individual. No rule of the people. Those who wish to proceed in that direction can not lay claim to progress, they are reactionary, their ideas are not more modern, but more ancient than those of the revolutionary

"For judge katangi Brown Jackson from the majority leader of the Senate Chuck Schumer to a high school classmate Palm Beach county state attorney Dave aronberg She is just such an outstanding nominee It's amazed me that no one in her past who has worked with her both when she was on the private side and then as a judge has anything bad to say about her whether the Democrat Republican liberal or conservative All of us who did high school debate knew and respected kanti Brown And some of us feared her because we knew that if we ever competed with her we would come out with a big L because she was the superstar in high school debate President Biden announced judge Jackson as his nominee to be the first black woman on the Supreme Court last week And now the hard part of the confirmation process is ahead for Jackson The Senate judiciary hearings which in the case of Supreme Court nominees have become confrontational and at times down right nasty Joining me is ala tune day Johnson a professor at Columbia law school Judge Jackson would be joining a court where the conservatives overwhelmingly have the votes and they seem willing to push the court to the right on issues like abortion guns religion What does judge Jackson's addition to the court add in that context So I think for the general public we are always really focused on the really contentious ideological issue And so we see judge Jackson edition and say it's not really going to change the 6 three court Replacing Breyer her views may be aligned with his And I think that's true on some of the high profile issues I think her impact is one her historic nomination which it's easy to forget but we shouldn't forget there's never been a black woman on the court The other dimension of impact is that she has really a breadth of experience and on the issues that the public tends to pay less attention to criminal justice issues access to courts all of those things she's had experience representing people in private practice and serving as the public defender All of those things will shape her rolling And then finally you know you don't know how the court will be in the long term We're looking at a current court we know how it's composed They're willingness to put aside precedent in certain cases but that may not be true in ten years So this is an appointment for a longer period So do you think her background her experiences have the potential to add to the discussions that the justices have about the cases and their conferences Yes I think her background could make a tremendous difference I mean someone right now there's nobody on the court who's had criminal defense experience of any extensive nature who served as a public defender And so just today the core decided to not review a case involving ineffective assistance of counsel when one attorney represented four co defendants the same attorney and raising real questions about conflict of interest And that's the kind of case that she might bring insight to We don't know if it would make a difference for sure but those are the kinds of things that the justices can bring up in oral argument They can bring up in discussions with their colleagues and sometimes it influences how justices even decide decisions Sandra Day O'Connor would talk about her experience with justice thurgood Marshall who was the last justice on the court of significant criminal justice experience And about how he would talk to her about what it was to represent black men in the south who had been unjustly accused of crimes and to represent people on death row And she writes about it as shaping her view of criminal justice issues It doesn't mean that she voted with him in every case It doesn't translate like that But it can bring perspective and a more in depth understanding of how these legal rules that the justices are deciding The lives of individuals Republican senator Lindsey Graham who voted for judge Jackson to be on the D.C. circuit Court of Appeals tweeted that the radical left was behind the Jackson pick And I think in born in fact groups like demand justice were behind her pick However is she in any sense radical left Yeah I'm not even sure what those terms mean And it's really disheartening to have that kind of debate around her I mean you look at her record and first of all she was recently elevated from the district court to the appellate court And her record was thoroughly come through And anyone found was a reasonable judge who I think would make from all signs a really fair minded justice So I don't think there's anything in her record that really points to that temperamentally People only have lovely things to say about her I have met her on several occasions She clerked several years after I did on the Supreme Court And she's just a lovely person of warm and generous person She discussed when she was being presented by Biden as the nominee about how influence she was by justice Breyer and his temperament which is that he really tries to be generous and fair minded in terms of the legal issues and also in how he interacts with his colleague in that grace is what I see in judge Brown Jackson from all my interactions and from what litigants and clerks say but also in what she has professed she aspires to be So I think it's a disheartening debate but I don't think it's about her I think really it's about a larger fight around the court and the importance of that to the Republican base I think that's a lot of what's informing this comment Coming up next we'll talk about the "One of a lot of people who were putting forth names So I think it would be a dereliction of duty for my part Not to advance the name of someone that I thought should be considered while all others were advanced to their names I joined in the Frick and we came up short but I think we did a good service to the judiciary by putting for their name There were some concerns about not choosing the judge from South Carolina congressman because that means you don't get a vote from senator Lindsey Graham and based on his statement last week we do not expect that he will vote to approve katangi Brown Jackson in the confirmation hearing Would that have been an easier path to confirmation if the judge had come from South Carolina Well I don't do it Maybe easier for Lindsey Graham but there are other people there who are have their considerations We all care about personal choices That's something to be expected But we all are part of this great country This great experiment that we call democracy And this is a part of it And you can't always win But if you don't get in the game you will never win Yeah And so we got in the game Didn't win this time but we're going to stay in the game State of the Union tomorrow night congressman I don't suspect we'll hear build back better what do you want to hear from Joe Biden tomorrow night I want to hear those parts to build back better that we can agree on And he's going to be talking about that And I've been talking to the senators and I know that there are men who build back better that we can go forward with And we should do that We ought to do what is necessary to keep our children that we brought out of poverty as a positive We all did what we can to expand healthcare to as many people as we possibly can All of these things are in build back better And I think that we should look at those things Look at what we can do about drug prices bringing those downs doing what we can about the climate crisis and let me tell you the climate crisis this month of February is always the coolest nothing South Carolina Last week was one of the hottest reach in South Carolina we ever had And so I think that we have got to do something to address climate change Despite everything we're talking about here though congressman the president is dealing with persistently low approval ratings we saw another low in an ABC poll over the weekend It's in part due to dissatisfaction among his base including black voters as an important adviser to this president I wonder if you are or how you're advising him to repair that relationship Well I don't think that the relationship has been broken I think that people have expressed some disappointment One thing you did last Friday was to address some of that disappointment And I think that we have got to do a better job at telling people what this president has done And he looked at this I'm amazed at the number of people who don't realize that this president has put 8 African American women on the courts of appeal on the second court of appeal That adds up to what all the other presidents have done put together and people don't know it He said more important to the discipline than any president in his first year and people don't know it I just expect that we're doing a poor job of telling people what this president has done The glass may not be full Well let's talk about it being half full rather than being half after Congressman we're out of time Do you plan to wear a mask tomorrow night at the State of the Union Yes A great one whenever I feel comfortable wearing it And whenever the palace is dictated many thanks to congressman James Clyburn with us today on Bloomberg TV and radio coming up.
