"Someone alleges that Microsoft is a monopolist and someone alleges that the market it monopolizes is the market for for games for the XBox console. Like we alleged that apple is a monopolist, and we alleged that the market is the market for iphone applications, and it has to be very specific. And and in in antitrust law, you really need to look at a couple of things you need to look at who the monopolist is. And you need some work at what the market is. But if we're saying that the market is games for XBox console. Souls, then there's still competition because you haven't told me that there's a different market for the digital games versus the the Blu Ray disc games, if there's different markets in other words, you know, what I'm saying are the same games available either digitally or or on Blu Ray. Or are there different games? That are available only only on Blu Ray and not on the digital platform and vice versa only on digital platforms. The only games. Yeah. The the market has to include all reasonable substitute products. So if there's if the market is purely digital, and Microsoft is engaging in some kind of monopoly conduct. Then then yes, if you're forced to buy from Microsoft, and you buy your product from Microsoft, and you pay your money to Microsoft and the market is just those games that Microsoft distributes electronically. Then I think you have standing under the supreme court's decision yesterday. You would have standing to sue Microsoft for that on ledge monopolization. But I'm I don't know nearly enough about the platform or that market to be able to say, whether I think there's a claim or I don't think there's a claim it's just a question of standing and the supreme court said yesterday, it's a simple bright line test. Did the consumer buy directly from the alleged monopolist and pay his or her money directly to the alleged monopolist if the answer to those questions is yes, then that consumer has standing to sue that alleged monopolist? I I can't begin to describe what the claim may be. But at least I can tell you. That's the answer to the standing question. Got it sorry to be so technical. But it's it's a really narrow technical decision that the supreme court reached yesterday. Now, I appreciate it. That's this show is is all about ninety out of the stuff. So it's good. Okay. Good. I actually want to ask you about the decision and the composition of the majority. You had the four liberal justices and cabinet, and he actually split from Gorsuch in particular, who is regarded as an equally deeply conservative judge. How how did you get cavenaugh to to come over to the liberal side of the of the majority there? I'm always having to use the the labels liberal and conservative because I don't think that they apply equally. And every setting and I think this is this is a setting where? Where Justice cavenaugh saw an interpretation of a statute and of the supreme court's forty two years of precedent now under that Illinois brick rule that I told you about four the way we saw it. And I think it's it's the correct way to see it. The court has consistently said we look at the at the structure of the transaction. We look at who buys the monopolized product from whom and and we give standing to the person who deals directly with the alleged monopolist, and and applying the principle the way the court has apply it for forty two years in this case that points to the the consumers who buy the apps from apple on the app store and pay their money to apple through the app store. They have standing, and that's exactly what the five justices on the court said yesterday.

It continues to be a great day for supporters of Brad Kavanagh. He takes his place today on the supreme court of the United States. They're in session. It's october. They were hearing oral arguments earlier today. I think Justice Cavanaugh and yes now, he is Justice cavenaugh, not just judge cavenaugh Justice cavenaugh spoke beautifully last night. There is a real object lesson that I learned that I want to share with everybody, and it's a lesson about why some people are so indignant about fake news. And that's not to say that I'm not indignant about them and dignity about this. It's just that we've had bias in the media for a long long time. But sometimes it's particularly egregious. And I'll give you an example. I had watched the news coverage early this morning. About the ceremony last night, which I had not seen live and the ceremony last night was in the White House with. President Trump welcoming the whole cavenaugh family the two daughters who are so proud of their dad and his wife, Ashley. Judge Kavanagh's wife, Ashley. And Justice Kennedy. Was there all the judges justices of the supreme court were there? And what I heard about this event was oh, it's too bad. It was supposed to be such a nicer then. But Trump ruined it as he often does because what he said was so outrageous, and he was so off the rails. And he ruined this event never before any spoiled that n-, it's disgusting and horrible. And she don't want when you watch it that is simply not true. Let me tell you one area where I honestly, I think most of the coverage that I saw on NBC and very much on CNN which is deliberately misleading. They made it sound. As if. Justice cavenaugh Spokane spoke with dignity and then Trump spoke afterward. And then ruined everything the Justice. But it wasn't like that. Because President Trump spoke I and he welcome people introduced every they all walked in together. And then the president said, thank you very much. Thank you members of congress. Members of the cabinet honored guests and fellow Americans. It's my privilege to address you tonight from the eastern with the White House. And then after welcoming everybody he said joining us for tonight ceremony is every sitting supreme court Justice chief Justice Roberts. Thank you Justice Thomas. Thank you, Justice Ginsburg. Thank you and Justice score such now why in that order that's the order at which they were appointed to the court. And. Then he said this in setting up how his particular performance of his duty and helping to watch the swearing in of the Justice appointed how this was going to be different. I would like to begin tonight's preceding differently than perhaps any other event of such magnitude on behalf of our nation. I want to apologize. To bread and the entire Cavanaugh family for the terrible pain and suffering. You have been forced to endure. Those who stepped forward to serve our country deserve a fair and dignified evaluation, not a campaign of political and personal destruction based on lies and deception. What happened to the Cavanaugh family, violates every notion of fairness? Decency and due process our country. A man or a woman must always be presumed innocent unless and until proven guilty. Okay. And then he goes on to make the most controversial declaration. He made in this statement. He goes on to say that that Justice Cavanaugh was proven innocent now. Okay. He's not proven innocent. But he was certainly judged innocent by anybody who's reasonable enough to look at this and to look at the preponderance of evidence, the preponderance of evidence was that anybody who was there at the time any of the named witnesses. Agreed with him. Not saying that I know this didn't happen. But in the saying, no, I I don't remember this at all. And I don't remember it at all like the way that Christina Ford described it, here's what President Trump said that you, sir. Under historic scrutiny were proven innocent. Thank you. Margaret analyzer is a great, man. He's a man of decency. Character kindness and courage who has devoted his life to serving his fellow citizens. And now from the bench of our nation's highest court, your father will defend the eternal rights and freedoms of all Americans. You know? Okay. This is just fine. And it's touching because you can look at the way the cavenaugh family his daughters. Margaret in LIZA, we're looking up at him and his wife. Ashley when when President Trump was saying these words, and what he says saying, he's a man of decency character, kindness and courage. There's no one who has stood up. To say anything different. If if there's someone who really believes that this was a disgrace somehow that that President Trump ruined the succesion you can give us a call and tell us why because I don't see at one eight hundred nine five five seventeen seventy six and judge Cavanaugh spoke, particularly beautifully. And yes, I think that some of his interchanges with the senators at his hearing were more testy than they needed to be. And yes, he didn't answer all the questions about his high school yearbook perhaps perfectly. But you know, what? In the sweep of history. I think President Trump is right? The entire process here as manipulated by the likes of Dianne Feinstein, and a s shoe and Spartacus and maisy Hirono and Richard bloom and fallen Sheldon Whitehouse. And the rest of them that entire process will be remembered. As a sham and a disgrace and not a positive thing for the country. So this is a good place to turn forward and move ahead. President Trump celebrated the newest supreme court Justice last night with every sitting member of the supreme court. And that he would always conduct himself fairly from the bench. I take this office with gratitude and no bitterness every American can be assured that I'll be an independent in in part. Tom Nichols is a professor of national security, the US naval war college. And he wrote about his decision in the Atlantic. Thanks for joining us. Professor nichols. Thanks for having me. You have belong to the Republican party for most of your life. Why did this confirmation process prompted relief? It wasn't the confirmation process itself that was more of the final straw disadvantage coming for a while. I had felt estranged from the party even after the twenty twelve elections. I was hoping for recovery in the wake of what I think will eventually be the implosion of the Trump administration. But with the cavenaugh confirmation, it just seemed to me that there was no moderate centre left in the Republican party. And so I just decided that it really was time to go. The confirmation was the straw that broke the camel's back so to speak. And I want to ask you about it in your piece for the Atlantic. You focused a lot on Senator Susan Collins, very drawn out decision on cavenaugh Collins, of course, is a Republican from Maine. This is a little bit of her speech from the Senate floor on Friday, the Senate confirmation processes, not a try but certain fundamental legal principles about due process. The presumption of innocence and fairness do bear on my thinking, and I cannot abandon them. Why did Susan Collins? Yes, vote matter to you so much. I found that Senator speech to me it was it was cynical. It was cynical in the extreme because you had a country that was anxious and divided and really wanted to get to this question of whether or not she was able to support this nominee. And instead she kind of gave America this come hollow lecture about constitutional law. I myself on many of the charges against judge capital. I was actually acknowledge, but I thought that his behavior before the Senate his extraordinary partisanship is disrespect for the Senate Judiciary committee was health disqualifying. And I was amazed at Senator Collins just walked past Paul, and I really didn't expect that from the last moderns weapon when there are no moderates left again, it's time to go. You've also criticized the Democrats, right? Where is your home? Now. I guess that's the big question for a person like you who's broken with the Republicans? Who's got problems with the Democrats where do you go? I assume you still want to participate in political life in this country. Well, now, I'm part of the largest voting block in America. The unaffiliated independence, and I will go wherever I think there are good ideas. And most important people who I think are decent and well-meaning because I think a big part of what the Republicans have lost his decency of it's a party that is based in no small measure on a certain one of these days, and that was not the optimistic party that I joined as a young person who are those people where do you find them these days, the kind of people the kind of leaders that you want to follow? Well, as I mentioned in the piece, I'm originally from physics. I would have no problem voting for Charlie Baker, for example, the governor of Massachusetts they are far. Not quite shower political home is now I don't think I will ever reach a party. And again, I think that one thing the Republicans lost the notion the character matters. So I think this is going to be a defining issue for for for Trump heading through this this first term, and assuming he's got to run for reelection that this is going to be something that he tries to seize on if only to distract attention from a whole range of domestic issues in the US.
