"Is poised to confirm judge katon G Brown Jackson as the first black woman to sit on the U.S. Supreme Court Joining us live from Capitol Hill is WTO's Mitchell Miller Mitch this vote initially was expected to be very close razor thin in fact but now that's all changed It's very interesting market at one point it was thought this might be one of the closest confirmation votes in U.S. Senate history given the 50 50 split in the upper chamber but even though the Senate Judiciary Committee deadlocked 11 to 11 we've seen independent minded Senate Republicans come forward to support Jackson Maine senator Susan Collins Alaska's Lisa Murkowski and Utah's Mitt Romney And Romney had opposed Jackson when she came up for the D.C. federal appeals court so a big switch there He's come under sharp criticism as you know from the more conservative wing of the Republican Party But if everything holds to form the vote will likely be around 53 to 47 in favor of the confirmation some breathing room there for Democrats and that's a far cry from the early concerns among Democrats that vice president Kamala Harris might have to be the deciding vote Let's zoom out a little on this whole process Mitch if you would for a second because members of both parties have been critical of each other for how the confirmation hearings have taken place in recent years How does judge Jackson's confirmation hearings and process compare to some of the others Well certainly all of them frankly have had their ugly moments There's no question about that I think one of the most extreme ones of course was judge Kavanaugh That was very very difficult Obviously there were allegations of sexual assault and in fact part of that the hearings this time around there was kind of an airing of grievances as senator Booker mentioned from New Jersey related to Lindsey Graham from South Carolina who said that a lot of bad things had happened to Kavanaugh That ended up being a 50 to 48 vote That was probably the worst I think this confirmation proceeding was most closest to Amy Coney Barrett's She was confirmed 52 to 48 Republicans complained that a lot of Democrats singled her out for her religious background and her Catholic ties to Notre-Dame and other social issues But I think along those lines this one was pretty similar However a lot of Democrats as you know had a lot of complaints about the raising of issues in connection with sentencing and child pornography cases many just thought that it was a red herring brought up in these confirmation hearings At what point today can we expect this vote Well I think we're going to see a vote early this afternoon probably around two this afternoon Senate majority leader Chuck Schumer will of course really raised this into a historic moment because it truly is the first black woman being named to the Supreme Court So there will be after all the acrimony I think a lot of celebrating at least on the democratic side and then we'll have to see what happens down the line in the future because it certainly doesn't look like there is going to be any time where a Republican president or a democratic president can count on the U.S. Senate to confirm their nominee unless the Senate is of their same party That's for sure All right Mitch thanks so much Mitchell Miller on.

exchange the committee chair democratic senator dick Durbin tried to get Cruz to stop talking two minutes past his allotted time Even banging the gavel didn't help Allow her to answer the question chairman Durbin Thank you Why do you not want the American people to know what happened in the Stuart case Or any of these cases chairman Durbin I've never seen the chairman refused to allow a witness to answer a question You can bang it as loud as you want I can just tell you at some point you have to follow the rules Judge Jackson faced about 22 hours of questioning with equanimity Never even raising her voice But tears streamed down her face when democratic senator Cory Booker spoke of her nomination as shattering another glass ceiling Nobody's gonna steal that joy You have earned this spot You are worthy You are a great American Joining me is Adam Winkler a professor at UCLA law school Adam start by telling us about what judge Jackson would bring to the court Well there seems to be no doubt that judge Brown Jackson is a very well qualified nominee to the Supreme Court She has a lot of judicial experience she brings a diversity not just in terms of her racial identity but also in terms of her perspective having been on the sentencing commission having been a public defender We never had a public defender on the Supreme Court In other ways she's very much a standard candidate for the Supreme Court in the sense that she comes from a background of being a judge primarily in recent years Some of the district court and then on to the D.C. circuit and comes from Harvard Law School like so many justices these days come from the very very top law schools So she meets the traditional requirements but also has some elements of her past that give her a slightly different perspective Judge Jackson repeatedly said that she decides cases from a neutral position without fear of favor That echoes what past nominees have said Well I think what we see is what we see from so many Supreme Court nominees lately which is kind of very uncontroversial statements that they will be neutral arbiters as chief justice John Roberts said in his confirmation hearings just an umpire calling balls and strikes The truth is we all know that judges really do approach cases with their values and the philosophy influenced and informed by their own experiences And the sort of anodyne perspective on what judging is just a neutral arbiter almost like a machine that you can just put in information and get the right answer out of It seems to be what senators want these days but certainly doesn't accurately describe what any justice will do either justice Jackson or any other We've come to expect all the culture war questions about abortion religious freedom gun rights even though we know the nominee is not going to answer them But the last time criminal justice questions dominated Supreme Court hearings was in 1967 when thurgood Marshall the first black justice came before the committee Did that soft on crime work for the Republicans here They're not really going to derail this nomination I don't think they think they're going to derail this nomination I think what works for them is using these confirmation hearings as an opportunity to make political speeches to get your ten minutes of quotes in the various advertisements and Fox News and promoted by the local political party on Twitter or whatnot And really not about examining the experiences perspectives and philosophies of the nominees And so we see that over and over again And frankly it's not just a Republican thing It's a democratic thing too We saw that with regards to the Trump nominees to the Supreme Court that Democrats were trying to tie the nominee to the policies of the Trump administration This is basically what the confirmation hearings have become basically forums or senators to make political speeches that relate or not relate depending on the particular question to the nominee at hand Though the Republican senators characterized them as questions about her record it did seem like there were quite a few personal attacks Well we are seeing attacks on her character and on her background often sometimes scurrilous attacks I think Marcia Blackburn accused judge Jackson of a whole bunch of things that were based on a sort of scurrilous accusations quotes taken out of context putting at her feet responsibility for things like transgender rights even though she's never ruled on a transgender rights case in any way And so we do see these kinds of attacks because this sort of plays to the political base even though Republicans said they're not going to attack her personally Of course they're going to attack her It's true they're not commenting on her history of sexual assault like a previous nominee but that's because there are no credible allegations of such thing I believe we did learn one new thing during these four days of hearings And that is that judge Jackson is going to recuse herself from the affirmative action case against Harvard coming before the court next term So I often wonder what the point of these hearings really is The confirmation process is broken And the truth is it's been broken for a long time and maybe we shouldn't expect more given its history You know the first confirmation hearings for a Supreme Court Justice came after the nomination of Louis Brandeis The first Jewish person who was nominated for the Supreme Court And it was clearly a reflection of a fear of this sort of Jewish radicalism And then confirmation hearings didn't really ratchet up and involve the participation of the nominee himself really until after Brown versus board of education 1955 when John M Harlan was nominated at the Supreme Court all of a sudden now senators like Strom Thurmond wanted to have questioning of the nominee and to make sure they had the proper judicial philosophy So we've often seen the confirmation hearings be an effort by political coalition to try to retain and keep control of the Supreme Court Does it make a difference if judge Jackson can get a few Republican votes I don't think it really matters very much I don't think that if she gets one or two Republican votes it all of a sudden means that her nomination was one that satisfied the conservative movement or the Republican Party And it certainly won't show that the Republican Party is willing to ban on judicial nominees of the Democrats simply because one or two people might vote in her favor She is clearly an eminently qualified candidate and just as Republicans have been able to get their candidates through Pretty consistently I imagine that she'll get through with maybe exclusively democratic votes maybe one or two Republican The only thing I hope that comes out of it is that we don't see a nominee who finds that because of the process they are changed that they become a different person than they might otherwise be It's sometimes said that clarence Thomas became very bitter after his confirmation hearing and hardened his views on some issues I don't know if that's true or not but it's been said and certainly there was concern after Brett Kavanaugh railed against Democrats for their attack on him in the confirmation hearing promising payback which raised questions about whether as a justice he would be motivated by a desire for revenge in these kinds of confirmation hearing If so it shows one of the dangers of having this very highly politicized process Thanks for those insights Adam That's "And the constitution isn't just a law, it is the supreme law. So the point I think here, the problem with judge katon G Brown Jackson is not. This we're not having some argument over how to read the constitution. There are legitimate debates about how to read the constitution. There were arguments, for example, over whether or not the constitution sanctions a national bank. Jefferson and Hamilton disagreed about it. But what they didn't disagree about is that they had to consult the constitution and it's both explicit and implicit meanings in order to resolve their dispute. No one thought, well, this is just a living document. Well, you know what? It's obsolete the moment it was written. There's new knowledge that's comes in that enables us to make decisions. We don't have to really rely on this antiquated document. So that's really where the problem is. The problem is whether judge kanti Brown Jackson is bound by the constitution or not. And if she's not, she's not a judge, because a judge whose decisions are not based upon the text and the principles of the constitution is not a judge, but an activist masquerading as a judge. Now I think this is actually why she got the nomination, the left is actually very kind of clear eyed and ruthless about it. They just say, listen, what do we want to judge? Rewind somebody who's going to vote our way all the time. At least on all critical issues, Republicans often will say, no, we want to judge the wound do this and who can do that and who loves learning and went to one of the top law schools and believes in the original meaning of the text and so on the left doesn't care about any of that. They want votes on their side and they've picked up. They were a little unsure about Michelle childs. This is the other woman that both Lindsey Graham as well as Jim Clyburn were pushing from South Carolina, but the problem with Michelle childs was that they felt she might be too moderate. She may not side with them on some important issues and so the progressives who put a lot of money into these court fights essentially vetoed her and Biden of course mumbling went along with that. That's how we got judge Jackson. Now interestingly from the little I've seen of the hearing so far, it doesn't look to me that the Republicans have the appetite to really go after this woman to really attack her in the same way that the left attack Kavanaugh. And I think that as long as Republicans have this approach where sort of you sucker punch our nominees and we'll take the high road, the left is going to keep doing it. In other words, we're going to be getting more kavanaughs because the left is able to bruise our nominees, even with fabricated allegations and get away with it. At least get away with not having the kind of retaliation that they deserve. Now, this business about judicial activism of just sort of leapfrogging over the constitution. I think a lot of that was sanctified by the Brown decision going back to 1954. Essentially the judges and the Brown decision. This was a decision, by the way, that overturned segregation. And so it's one of those kind of iconic decisions, but the judges made the mistake in that decision of basically saying that there's new social science evidence that shows that it's stigmatizing to blacks to be in segregated schools, and so we're going to make a decision not really based on the constitution per se, but rather just based upon this kind of new pragmatic evidence that's come in this new empirical data that's come in and in that they essentially clear the way for future judges to start ignoring the constitution. Of course, the most grotesque example of ignoring the constitution roe versus wade, a right to privacy that is nowhere specified in the constitution. Well, yes, there's a Fourth Amendment right against unreasonable search and seizure, but I think nobody would reasonably say that this right to unreasonable search and seizure applies to the womb you can unreasonably search and seize my womb. No, there was a kind of generic right to privacy that the judges themselves admitted came out of nowhere, or in their words, came out of quote penumbras in the constitution. It's kind of sort of the idea that it's in there somewhere. We can't really find it, but so this is the issue. Do we want judges who are impartial? Do we want judges who are bound by the law? Do we want judges who play the role of, say, an umpire in a baseball game? Or do we want judges who are activists, judges who are playing on one team instead of the other, and in that sense, what we find is that these people, although they wear judicial robes, and they have the name judge in front of their name, they're not real judges. There are essentially impersonators who are pretending.
