"To and rational radio the Rick anger show. Welcome back to the Rick under show. It has been a screwy week in the world of healthcare. Of course, you will recall that we learned the other day that President Trump and the administration had decided to switch gears as to their take on this litigation involving the destruction of the Affordable Care Act ObamaCare. Right. So we know that the court in Texas, the federal district court located in Fort Worth Texas had ruled that because the congress had done away with the individual mandate that that undermined the entire Affordable Care Act, and that local federal district judge declared that because that was gone well ObamaCare was completely invalidated soup to nuts. It's that case is now moved to the fifth circuit court of appeals. It had not been the opinion and the approach of this administration prior to early this week to suggest that they believed that the the Affordable Care Act was constitutionally void in its entirety. But they changed their opinion in a two sentence letter sent to the circuit court the department of Justice data. Yes, we've changed our mind. We now believe that the lower court the district court in Texas was absolutely right that as a result of the removal of the individual mandate ObamaCare. No longer stands. It is no longer within the boundaries of the constitution. It has to go in its entirety. What came as a real shock to a great many people on both sides of the aisle, the Republicans were scratching their heads and going wait a second. We are having the best. Days since the president it became the president. Why because they're the interpretation of the attorney general's letter on the Muller report that they like to believe has fully exonerated the president of the United States from any wrongdoing. I don't agree with that. I think we have to wait and see I suspect many of you feel the same way. But setting that aside this was the backdrop of what was going on. It was dancing Jin time. And then the president steps in it he steps in it because we know of things we know that the American public over the nine years, we've had ObamaCare has changed its view once they got to have it in their life once millions of Americans found out that number one they now could get insurance and number two the insurance was working out pretty well for them. They started to see this differently. Now, the second part is we just. Came through the twenty eighteen midterms. And I don't think there are many who would dispute the fact that would put forty more Democrats into the house of representatives, creating the majority had almost everything to do with voters concerns over healthcare. And yet, the president turns around and does this now, you know, very well that this wasn't the first effort on the part of this administration to gut the Affordable Care Act. We all remember the many efforts going back before there was President Trump right up to the time that John McCain turned thumbs down all of those efforts that were made by the Republicans in congress. And now by this president to cut the meat out of ObamaCare to see to it that you could no longer get insurance. If you have a preexisting condition. Just a terrible terrible thing. But there was something else that this president. Did he thought he was being very clever when he proposed and put into the rules the opportunity for companies to band together to create their own health insurance programs for their employees. Now, understand what this effort was about understand that many companies in this country, particularly large ones are self insured. They don't buy insurance for their employees through a health insurance company. They may use a health insurance company to administrate their plan. But they actually take the financial risk when it comes to employees who might get sick. Right. So now because of that much of what they were doing fell outside of ObamaCare. So the president and his friends have a very interesting idea. They say, you know, what we're gonna do. We are going to let these companies band together and offer an insurance benefit well that doesn't sound so terrible. Especially if it's along the lines of what they're already doing. But they did something else. Really important the way that they define companies was a company was one person who's registered as a corporation, or even if they aren't you're just running a business. And there are also the only employee of that company. So if you are in that position, you're a one man one woman operation, you call up your friend across the street. Who is also a one man one woman operation, the only employees in each of these companies are the two are the two owners. And you say, hey, let's get together and offer up an insurance plan to ourselves. And by doing that, we can avoid a bunch of the stuff that's in ObamaCare. We can do whatever we want. We can go out into the marketplace, and we can buy what is affectionately referred to as junk insurance. Why junk because it doesn't have to offer some of the most basic things that are included as protections in ObamaCare. We can go out and buy a policy that's not going to cost us anywhere near as much will wasn't that clever. The president devised a means of seeing to it that people could buy insurance cheap, which as long as they didn't get sick. They're gonna look at him. Dude, you really came through for as my premiums are a fraction of what they used to be way to go President Trump except that when they do get sick. They start to find out what that insurance policy doesn't cover. This is why it's junk insurance you get what you pay for. So the president and department of health and human services thought they were being very very clever here. However, there was a judge in Washington who was not quite so impressed yesterday. Judge John Bates at the US district court for the district of Columbia blocked, the rules, which would allow these small businesses and individuals to band together to escape the responsibilities under the Affordable Care Act and go buy junk insurance as the judge said and keep in mind. This is not a liberal democratic judge. Judge Bates is somebody who was appointed to his job by George W Bush. The judge said as part of his I think fifty page opinion, quote, the final rule is clearly an end run around the ACA. And boy did he get it. Right. The judge continued indeed as the president. Directed and the secretary of labor confirmed the final rule was designated to expand access to these sorts of programs. Why well to avoid the most stringent requirements of the ACA the president admitted it the secretary of labor confirmed it this was the I DEA right from the outset. So let me tell you. If you think that this is somehow bad news because you were planning to buy or or get together with somebody to create one of these plans or by one of these plans together under these rules. If you think this is bad news because now you're going to be stopped from buying that lower priced insurance policy. Let me assure you, it is anything but bad news. I can very well recall the days before we had the Affordable Care ACT's where you could find all sorts of policies like this. They were. Are everywhere. But if you read the fine print, which it was kinda my job to do back in the days when I was in attorney working with this kind of stuff you would be stunned to find out what your germs policy didn't cover. The problem. Was you rarely found that out intil you were in need of relying on that insurance policy. Now, these kinds of policies were also able to avoid providing health insurance to people with preexisting conditions. It was taken outside of the rules of the Affordable Care Act. I don't see.
