Following the latest developments in President Donald Trump's federal indictment in the classified documents case, the former president is accused of directing an aid to hide documents from investigators with some of the papers being found in a bathroom and shower at Mar -a -Lago. We have one set of laws in this country and they apply to everyone. Special counsel Jack Smith there making his first public comments in the case. He says prosecutors will seek a speedy trial. Mr. Trump is scheduled to appear in court Tuesday in South Florida facing the possibility of prison if convicted. More tonight from CBS News correspondent Scott McFarland about what's being called a damning indictment. Scott joined us bit just a earlier on Skype. You needn't have a law degree to recognize we're in unchartered waters. Not only is this a federal criminal charge against a former president of the United States on any which of these counts could be punishable by to 10 25 years in prison and quarter of a million dollar fine, but the granularity and the absolute overpowering nature of some of these accusations striking. They're making clear in charging this document the former president is alleged to have personally overseen some of the movement of these boxes with America's most classified top secrets included. That the former president was also knowing that these records were being sought part of a conspiracy to obstruct the investigation to block information from getting to a grand jury or to investigators and it is clear these are state secrets allegedly being shared by the former president with people who didn't security have clearances outside of a secured compartmental information facility and it was done on more than one occasion. We've learned that Judge Eileen Cannon, who is a Trump appointee, will oversee case. the She's made some favorable rulings for him in the past. So it's looking like the 11th circuit Court of Appeals. Is going to be the center of some important action here and may well shut down Donald Trump's special master as the three judges on the panel express skepticism that judge Eileen cannon had jurisdiction to take action before an indictment take action by applying this special master to the process. Which means potentially an indictment comes any time. Let's reassemble the panel. Rick Davis and Genie Chan xeno are here. Is that how you see this happening, Rick? For sure. Jack Smith already has some momentum. People wondered whether he was going to take some time to get started and he didn't even take Thanksgiving off. So this is the new special counsel. The new special counsel and the person in charge of these prosecutions from the Department of Justice, point of view. And so if the 11th circuit throws out the arguments by canon that you needed a special master, which it seemed to be leading in that direction, as early as this week, that really opens the door for a prosecution for an indictment of Donald Trump on the charges that have been enumerated in this debate. So I don't think we have long to find out what mysteries will unfold as it relates to the special counsel's Jack smith's intent to potentially indict Donald Trump. How does that impact this campaign for The White House that he has formally launched Genie if at all? Well, you know, we believe that there were a couple of reasons that he decided to announce so early and one of them was to scare other people in the Republican Party out of running. The other was to put the Justice Department in a position where it would have a hard time prosecuting a candidate because it's the Justice Department of Joe Biden. But of course, the appointment of a special counsel has removed it from essentially the Justice Department's control and the 11th circuit hearing was just really an awful legal moment for the Trump team because as bad as it was the Supreme Court that last week also ordered him to turn over his taxes, this essentially gave the Justice Department the special counsel now the ability to really delve into this issue of these classified documents at Mar-a-Lago without having to deal with this special master, and we know that traditionally Donald Trump has used the court to delay delay delay, and in this case they are getting a boost if they rule in the way we think they will. They are going to get a boost in terms of being able to delve into those documents and what happened there without having to deal with the special master. And so that'll help move this along much more quickly than we thought and potentially we could see a decision to indict, you know, in early 2023, if they decide to do that. Well, this is a big deal and one that all of our listeners should keep an eye on here as we discuss a few remaining topics here on sound on because that's not what everybody was talking about with Donald Trump over the weekend. "Well, it's 6 30 in the morning here in Hong Kong. I'm Stephen engel. And I'm Brian Curtis looking at markets this morning quite narrow ranges, but we are trading a little bit higher. In fact, S&P E minis now up about four tenths of 1%. We'll get you details on markets in a few moments, Steve. All right, let's start with OPEC plus unexpectedly deciding to cut output in October. The 100,000 barrel a day cut is the first in more than a year. After OPEC's meeting, Saudi Arabia said that the group will remain proactive. Here's Bloomberg's Julian Lee. I think that this is an attempt to sort of, if you like, talk the market back up. I mean, let's face it. An output cut of a 100,000 barrels a day on paper targets that they're already missing by more than 3 million barrels a day is meaningless in terms of actual physical supply. So this is about messaging. This is about telling the oil markets that OPEC plus is prepared to act and act quickly if the market looks like it's weakening. Well, OPEC plus is facing a market where concerns about demand have started to outweigh supply fears, crude futures have lost about 20% in the past three months on the threat of a global economic slowdown. And we heard that quote meaningless, but we did see a bounce in the price, WTI is up 2.6%, $89 and 13 sentence a barrel. Well, Russia may face a longer, deeper recession than previously thought. Bloomberg's Denise Pellegrini has the story. Two of the three scenarios in a new internal report say it could take Russia's economy at least a decade to recover after an intensifying slowdown. The report prepared by government officials and experts says U.S. and European sanctions are really hitting Russia where it hurts and handicapping the sectors Russia has relied on for years to power its economy. The report also says as many as 200,000 IT specialists could leave Russia by 2025. Denise Pellegrini Bloomberg daybreak Asia. Well, Germany is moving to keep two nuclear plants available this winter in a policy reversal. Well, let's take a closer look at markets, Asian equity futures, as mentioned, ticking a little bit higher this morning. Flits to China a 50s or up three tenths of a percent, similar gains for Hanks and index futures. Futures are up a little bit less than that in Australian futures advancing about a tenth of 1%. The dollar had been strong, particularly during the Europe session, but weakening a little this morning now. The Bloomberg dollar spot has dropped about a tenth of 1%. Dalyan won 40 51. The Euro gaining a little strength, 99.43 U.S. cents, and the yield on the ten year treasury at 3.18%. And that's a look at market Steve.
