So I'm going to start by asking both of you if there is a thread or a theme when you look across the week. What would it be in terms of all that's happened regarding confirmation hearings regarding the campaign Steven I'll start with you. I don't know I. I hate to say this, but I think it's it's chaos pattern is. Chaos and that's what it's been now it seems since March, I'm so tired of it. I'm. So I'm so eager for some normality and some sort of balance in in the news cycle but boy, it just keeps rolling and and changing and jutting from one extreme to the other I. think probably culminated last night when literally Americans were. Jumping from one channel to the other to try to hear the to main, who will be one of whom will be president of the United States talk about why they should get their vote. I mean I just I. could anyone three weeks ago have predicted that would be how we would have spent a Thursday night in October. Jack. Making exactly. Appoint. That really resonates that we've had so many examples of. Divisions in this nation I mean it was just it was embodied last night in in a literal split-screen on this country. Two different town halls to different cities to different tones entirely I. mean the divide with has never been starker. It never has been and it was on display in Washington at the confirmation hearings of judge. Judge Barrett and two points about that you know the the first is that those hearings displayed the Republicans mastery over a generation of court politics and it really came to a head in two thousand sixteen when candidate trump said that he would only appoint justices who would overrule row and he would appoint a list of justices taken from the Federalist Society according to Mitch McConnell That was the single biggest issue that brought out nine of ten Republicans to vote for trump and at the time and prejudice hyperbolic let's say it's five out of ten still it's a lot. At at at the time. By eight points Republican voters said the Supreme Court. Voting on. It was a very important issue by eight points more than Democrats. Now it's reversed, Democrats. Pie. By seven points say the Supreme Court is the most important issue, but it's too late. The Horse is out of the barn. The lusty loomed creature is down the road because it's it's now happened and and the Republicans have mastered this. Politics of the judiciary and it's the last redoubt of minority rule and they had defending it and look at how they handle the issue of retirements. When when when Justice Kennedy Single. Ready to retire president trump presented him a package he had Brett Cavanaugh. Kennedy's favourite clerk not up to take his place when. Was a done deal but look at president. Obama when in two thousand fourteen he had lunch with Ruth Bader GINSBURG and he said. According to reporting justice The Republicans are probably GonNa win the Senate and she did not take the hint which was this was time for you to retire. So I can appoint someone to take your place. She didn't take the hint and you know Chris coons in his presentation showed one hundred twenty cases in which Justice Scalia was on one side and five to four decisions and Justice Ginsburg was on the other and of course Jon Judge Barrett is an Acolyte of Justice Scalia and what are you saying was imagine if it had been judge Justice Barrett instead of GINSBURG. Puts all of, those Ginsburg rulings in doubt she couldn't retire. Justice Kennedy did and the rest appears to be history well, so Stephen I wanna hear hear your thoughts on that about the Horse being out of the barn here. Well it is in some very practical terms if judge Barrett is confirmed to the US Supreme Court of course, give Republicans and conservatives a really solid six vote majority the likes of which we have not seen in a really long time It's not just about them having been appointed by Republicans, it's also their judicial philosophy of these. Judges who sit very far to the judicial, right? and. So there isn't a whole lot of of chance given their age and given the sort of stasis of the court to to do a whole lot about that right now I think though that there will be an effort to try to a cabin the reach of the court in a way that maybe has not been considered before remembered that the court's authority. Is is something that's just tradition and is is not written in stone. There are lots of ways that Congress and the President Can can restrain the court from from doing certain things and I think the threat of changing the structure of the court. Itself could have an influence on what the court does if you think back to. Franklin Roosevelt and his fight with the court over new deal legislation. He didn't end up appointing new justices to the court. He said, he wanted to people said, they didn't think that was a great idea. But the result was that the court started really little differently on new deal legislation. So I you know. It's politics. The country always moves forward. Nothing is ever really over but but certainly you the conservative movement to control federal courts and to lock up the supreme. Court. which is a thirty or forty year effort is is culminating right now with Judge Barrett sitting in front of the Senate Judiciary Committee and then. Eventually probably being voted onto the supreme core within a week of a presidential election. Let's listen to a little bit of what Judge Amy Conybeare did say during this week of confirmation hearings on Tuesday Democratic Senator Dianne Feinstein of California the ranking member on judiciary asked. Judge Baird if the constitution allows the president to unilaterally delay a general election and here's how responded if that question ever came before me, I would need to hear arguments from the litigants and read. There's not a world where Donald Trump won seniors by five or five or six points nationally in two, thousand, sixteen, one, eight, or nine in Florida a World War Joe Biden is ahead by three or four points seniors or maybe more right now in Florida. That's not up there's no math where that works for trump you can't win. Florida. Have you see your your position with seniors flipped by a double digit margin. A net double digit. So much of today's hearing was on Healthcare and Democrats warning that Amy Conybeare it would help overturn the Affordable Care Act Yvette how healthcare especially the issue of pre existing conditions being teed up as an election issue. Ifo's do come down with Kobe. They're worried about their ability actually pay for a medical services they need and frankly because of healthcare in this country that's always going to be a predominant issue. What we know about the affordable care act is an extended health care to millions of people and people are afraid of what happens if that gets removed without a replacement so far the GOP is continuing to try to threaten the ACA including a case we think might be teed up right in time for any conny. Perez Installation Supreme Court justice if she's confirmed that would take away health care for over twenty million people during the time when they need it most and so certainly, an issue that we're hearing on the campaign trail certainly something that a lot of candidates up and down the ticket are talking about and I think it will be an issue that voters will be thinking about when they go and cast their votes and Sarah, you vet mentioned a replacement president trump still hasn't given out a comprehensive plan to replace. which he's been promising for four years. Now, how does that potentially hurt him and his coattails given that it was a winning issue for Democrats in two thousand, eighteen, the midterms. He should put out a plan. Certainly, it is something that voters care very deeply about There are certain elements of obamacare that were very unpopular including the cost of premiums which went up over the life cycle of the Bell or its tenure in government I would say at the same time though you know I think mostly we're going to see this play out on the pre existing conditions debate and every Republican senator, every Democratic senator every senator. Is for protecting pre existing conditions. So this is really a legislative issue. It's not a court issue It doesn't belong in the court. The court shouldn't be legislating from the bench they should not be prescribing policy. They should simply be interpreting the law and ruling on it and so this where there's a will, there's a way the congress can pass a law that is superior to Obamacare. It can protect preexisting conditions, it can lower the cost of healthcare. And it belongs in the legislative body. Vet Tonight the president was in Florida, his first rally since his Cova diagnosis, and there are thousands of supporters mostly massless appealing to his base. How does this play? Do you think as a political campaign strategy? We continue to see time after time Donald Trump not taking this seriously and it it not only is tone death is getting to the point where it's feeling insensitive. And hurtful particularly for the growing number of people were contracting this virus and the number of number people were dying from it, and so I don't understand where he gains from doing this particularly when he is contracted a significant amount of people around him have contracted it. We've lost people as a result of and so I think that folks are really starting to wonder, does he get it? Is this intentional this is not a hoax this real, and again, folks want to see a president who relates to the struggle that they're in. All you have to do is where a mask be socially distant to show that you sympathize with a very real threat to a lot of Americans in this country, I don't know why he can't rise to that moment and I think it just continues. To alienate him with people across the spectrum, Republican and Democrat rich poor black white who have come face to face with this disease and been deeply impacted by a negative way Sarah. Let's think for a moment about suburban women voters who are so crucial for a trump victory in twenty nineteen polls seventy, seven percent of Americans supported Roe v Wade and in that same poll more than half of. Suburban women that crucial sector said, they would not support a presidential candidate who would appoint judges to overturn Roe. So how Republicans walk that fine line during this election year well, abortion is one of the most emotional issues on both sides of the aisle you get about ten percent of the Democratic Base, ten percent of the Republican. Bates. Who Vote on that issue exclusively so it is charged. So much of the abortion debate really is around the edges I. Think Republicans have to be true to themselves. The have to be reasonable in their language, and most importantly, they have to be very careful because it is an issue that's affected a lot of families and it is Ingrid really matters. Great to be here. Do I want to start with that stunning image that we all saw president trump arriving back at the White House removing his mask what message do you think that sends to the American public? It really worries me if someone looks at that and thinks that well, if you're infected with Cova. Masks don't really matter. They're taking the wrong message the CDC's clear. Everyone. Should be wearing a mask. If you think you're infected with code or no, you're infected with code, you need to wear a mask and the White House is as you know, one of the most heavily fortified buildings in the world and yet it's essentially turned into a covert hotspot. What does that tell us about the testing protocols and the masking recommendations? Well I think it tells us that the virus doesn't care what political party you belong to. The virus will infect anybody and the public health guidance is is really clear. We should all be wearing masks in particular. You're indoors in you're in places where the virus may stay in the air longer those are high risk settings and you're at the top levels of our government. You would think that they would follow to the letter the. Recommendations of our nation's public health agency and we now know rich that the White House rose. Garden reception for Judge Amy Conybeare it resulted in at least nine people testing positive. But most of it was outdoors, how do you think that became a potential super spreader? When much of it was outside outdoor settings are safer than indoor settings but they're not totally safe and if you're you're close to people if you're hugging people kissing people. You don't know where those people have been whether they could be infected. You never know the risks that you're gonNA be around and so wearing masks helps protect notches you but those around you, let's talk about the president's treatments that we've been learning about. He was approved for compassionate care for a new drug called regeneration and when do you think the average American we'll have access to that kind of drug. Clearly, the president will get whatever the latest treatments are, and he got a wide range of drugs, but it lives up for me the big disparity in terms. Of Healthcare, they're twenty eight million people at the start of this pandemic without any health insurance, and you have to think about what kind of care they're getting many of the drugs that the president got are not widely available. Many of them haven't been shown yet to be affective or not, and we also know that president trump was treated with rim Davir and with steroids which are normally reserved for severe extreme cases of Covid nineteen. Well, when I look at the combination of drugs that he's getting, it's hard for me to figure it out because some of those drugs. Are recommended if for anybody for people who are severely ill for people who are on oxygen not for people with with milder infection but these are drugs. The decks methods on the steroid is widely available. The other drugs are not widely available. And yet, the president is also taking a curious mix of over the counter drugs. The White House said on Friday, he's taking Melatonin, vitamin D and pretty common. ANTACID. What is the science tell us about these types of treatments and should we all be running out and getting vitamin D? I think what it points to is the is the importance of really listening to scientists and listening to your doctor. We've seen the challenges during this pandemic of different treatments being recommended out of the White House that have shown not only to be not effective, but some of them to be dangerous. So I wouldn't rush out and buy any of these products talk to your doctor about what you can do. The best things you can do right now to protect your health handwashing wearing masks, social distancing, and getting your flu shot. That's the best setup for this for this winter and Friday Dr Fao Cheese said that vaccine may be coming online as early as December but that we should social distance for another year where are we in your mind when it comes to fast-tracking Vaccine Optimistic because there's so much work going on around vaccines, but I like to use the word if the trials on vaccines, I'm hopeful that one of these will pan out but if people aren't doing the things right now that we know work than waiting for a vaccine lives are going to be lost and the vaccine comes we don't know how effective it's going to be some vaccines, reduce your risk, but they don't eliminate your risk, and so we really have to be cautious and there's still so much to learn Dr Richard Besser, thank you so much for insights and for.

But there are many ways their philosophies are quite different judge Barrett's legal career. We'll be under the microscope in the weeks ahead. So this is a good time to talk with our justice and judiciary editor, Vivica, Novak, Vivica good to have you here. To be with mark, I want to start out with the basics just who is judge amy, coney? Barrett and why are conservatives so enthusiastic about her nomination. She is a known conservative. She was a clerk for Justice Scalia and has often spoken of him very admiringly. She's been a lot professor Notre Dame and she has continued to teach while she has been on the Seventh Circuit Court of Appeals in Chicago in general the anti-abortion groups feel very confident that she would be a vote in their favour whether she'd Overturn Roe v Wade is is unclear, but she is generally not a fan of abortion. Obviously abortion is getting a lot of discussion in this conversation, but this is a court that could. Rule on many different areas including health care even the twenty twenty election would her presence mean on the court? Well, she will be the person who gives the conservatives a six to three majority on the court, and even if Justice Roberts who has occasionally sided with the liberals even if he does that in the future on on certain cases, you know they will still have five votes, five conservative votes. So that's that's one important factor here. She will be probably not a vote in favor of upholding the affordable care act and that's one of the. First arguments. The court will hear it's coming up in November is a challenge to Obamacare and Justice Roberts a couple of years ago in another court challenge to the care he voted with the Liberals and she has actually said in a speech that she believes he voted wrong in that case in fact, he wrote the opinion she believes he was wrong. So that's one important issue coming up, and of course, the election none of us really wants to relive the two thousand election I don't think which was turned to the Supreme Court but it. Could happen it could happen, and if it does, you know there are some trepidation about the six three makeup of the court being certainly not in favor Joe Biden, we have election looming around the corner Republicans are moving forward planning to hold hearings the week of October twelfth in the hopes of confirming her before Election Day. So who will motivate more? How will this affect the election really good question conservatives generally in the past have been known to be more motivated by the prospect of putting more people on the federal courts including the Supreme Court. Democrats this time though are going to be framing things I think in terms of issues they're going to be talking about the affordable care act which most Americans are in favor of most Americans like it. They'll be talking to some degree about abortion probably not as much. They'll be talking about the election though and what could happen there. They will try very hard to peel off a couple of Republican votes. It's GonNa be tough hall, and Right now it looks like Mitch McConnell has. The votes and there isn't very much the Democrats can do about it. There may be a few procedural things that can slow things down, but it is really stretching to think that the Democrats I think could could slow this down, push it after the election, and then perhaps kill the nomination that's really pie in the sky. At this point it seems both parties feel a sense of urgency here as this is a lifetime appointment here and particularly her being so young, she's only forty eight. Could be on the court for a good long time and it's unclear. You know there are some other justices who are not that young but there are a lot who are actually not that old. So you know president trump has made it a point to name. People who have probably a good couple of decades at least on the court. Are Movements now to, for instance, put term limits on justices even if that were to make it through Congress and that's that's going to be hard to do. But even if were to make it through, even if a president were to sign it, it probably wouldn't apply to justices who are already on the court. It probably would be applied going forward. There are also people who talk about expanding the court. Some people call court packing that's kind of a derisive term, but expanding the court to add two more justices or more. And you can also say I don't have enough information. I can either defined deny were affirm. So if I say, I do not recall that's the middle ground, which is neither agreeing or disagreeing. It's neither agree nor disagree. That's what they said. I don't recall. That's not refuting. That's this is a judge saying it was reviewed. That's a lie by the judge. He lied. He said he never attended a gathering like the one described by Dr Ford. I I never attended a gathering like the one doctor for describes her allegation his own calendar. Says he did. His own calendar says he did. So he lied. They did not travel in the same social circles. Well, his July first calendar entry about drinking skis. Lists squeeze the nickname for his high school classmate. Chris Garrett Blasi testified that she briefly dated went out with Garrett in the summer of eighty two. So that's also a why I did not drink beer the point of blacking out. Well, again, this is whereas Yale classmates totally disagree with him as do other people. It happened. Justice Ford is actually stepped down from the supreme court in nineteen sixty eight because of huge controversy around him. This is not the first time. It's not new stop with your overarching statements that we're all gonna die because of it. Whatever. It's not good. All right. So we're going to move.
